On this date in 1437, the Earl of Atholl finally reached the end of a three-day carnival of public tortures and lost bowels, heart, and head for assassinating the King of Scotland.
When Stewart’s grandson Robert exploited the family’s familiar proximity to the king to admit a team of assassins on the night of Feb. 20-21 1437, it ended a strange run for James I.* James had been melodramatically kidnapped by pirates at age 12 and sold to the English — who held the Scottish king** for ransom for 18 years.
By the time James returned to native soil in 1424, he had had quite enough of being some other lord’s shuttlecock and irritated Scotch magnates — who had formerly enjoyed the run of the place and therefore dragged their feet when it came to repatriating their hostage king — by his overweening grabs at land, money, and power. One prime example that would come back to haunt him in the events of this post was the 1425 destruction of the Albany Stewarts, which netted the crown the forfeiture of three earldoms. Clients of the Albany Stewarts, like Sir Robert Graham, delivered a fair fraction of the 28 stab wounds that shuffled King James off this mortal coil.
But even James’s allies had to look sharp when it came to any demesnes not nailed down.
Our principal for today’s post, Walter Stewart, was one of these. James’s uncle and supporter, and the son of King Robert II, Stewart/Atholl had pushed for the magnates to ransom James.
Putatively seen as the king’s ally, Atholl’s complicity in regicide made him a byword for treachery to outraged Scottish chroniclers; the apparent grab for the throne led his captors to put a “corone of papir … upon his hed, the which was all abowte depaynetid with jubettes, and for the more dispite and shame to hym was writyne with thes wordes, TRAITOUR, TRAITOUR, TRAITOUR,” according to The Dethe and False Murdure of James Stewarde, Kyng of Scotys.
In a 1992 article on events&:dagger; historian Michael Brown noted that what Atholl had added to his holdings through his nephew the king was the earldom of Strathearn, and it was but tentatively held: granted for Walter Stewart’s lifetime only, it would revert to the king with the septaugenarian’s death, leaving his heirs no better off than Walter’s own efforts had made them circa 30 years before.
Brown depicts the aging lord as a savvy operator who “would increasingly have despaired of keeping the earldom of Strathearn in his family … [as] a consequence of James’s general opportunism when it came to increasing the revenues of the crown.” A couple of specific adverse interventions that trimmed Atholl’s estates might have presaged — in the earl’s mind, at least — a potential royal move against his position, a move that Atholl would be best advised to check preemptively or never at all. Who could say in February of 1437 whether the Stewarts would by March or April still be royal confidantes in any position to have “left the Kynges chamburs doore opyne; and … brussed and blundird the lokes of hem, yn such wise that no man myght shute hem”?
If we’re not sure of exactly why they did it, we do know very clearly that the plot failed as a coup attempt. Both the queen and the six-year-old heir James II survived that evil night, and James’s violent deposition met not support, but horror. Within weeks the conspirators were hunted to ground. Atholl, for his part, protested his innocence of the regicide all the way to the end, a protest that neither contemporaries nor historians have much credited.
And his death declar’d that there is nothing more popular than justice, for they who were wont to detract from him whilst he was alive, now he as dead had most flagrant desires after him, insomuch that the Nobles, as soon as they heard he was murder’d, came in of their own accord from their respective countries and before a tryal was appointed they voluntarily sent out into all parts to apprehend the murderers and bring them to justice.
Very many of them were taken. The principal of them was put to new and exquisite kinds of death. The rest were hang’d. The chief heads in perpetrating the wickedness were reckon’d to be Walter Earl of Athole, Robert his nephew by his son, and their kinsman Robert Graham.
The punishment of Walter (because he was the chief author and instigator of the whole plot) was divided into three days suffering. In the 1st he was put on a cart wherein a stork-like swipe [crane] or engine was erected, and by ropes let through pullies was hoisted up on high and then, the ropes being suddainly loos’d, he was let down again almost to the ground with grievous pains by reason of the luxation [stretching] of the joints of his body. Then he was set on a pillory that all might see him, and a red-hot iron crown set on his head with this inscription, that he should be called King of all Traitors. They say the cause of this punishment was that Walter had been sometimes told by some female witches (as Athole was always noted to have such) that he should be crown’d king in a mighty concourse of people. For by this means that prophecy was either fulfill’d or eluded, as indeed such kind of predictions do commonly meet with no other events. The day after, he was bound upon a hurdle and drawn at an horse-tail thro’ the greatest street in Edinburgh. The 3rd day he was laid along upon a plank in a conspicuous place and his bowels were cut out whilst he was alive, cast into the fire, and burnt before his face. Afterwards his heart was pulled out and cast into the same fire. Then his head was cut off and expos’d to the view of all, being set upon a poll in the highest place of the city. His body was divided into four quarters and sent to be hang’d up in the most noted places of the best cities of the kingdom.
After him, his nephew was brought forth to suffer, but because of his age they would not put him to so much pain; and besides, he was not the author, but only an accomplice in another man’s wicked design, as having obey’d his grandfather therein, so that he was only hang’d and quarter’d.
But Robert Graham, who did the deed with his own hand, was carried in a cart thro’ the city, and his right hand was nail’d to a gallows which was set up in the cart, and then came executioners which did continually run red-hot iron spikes into his thighs, shoulders, and those parts of his body which were most remote from the vitals, and then he was quarter’d, as the former. After this manner was the death of James vindicated.
‘Tis true, ’twas a cruel one, but ’twas reveng’d by punishments so cruel that they seem’d to exceed the very bounds of humanity. For such extreme kinds of punishment do not so much restrain the minds of the vulgar by the severity as they do make them wild to do or suffer any thing; neither do they so much deter wicked men from committing offences by their acerbity as they lessen their terror by often beholding them, especially if the spirits of the criminals be so hardened that they flinch not at their punishment. For among the unskilful vulgar a stubborn confidence is sometimes prais’d for a firm and stable constancy.
* James’s successors handed down the throne, father James to son James, right down into the Stuart dynasty that came to rule England as well. This makes our James I an ancestor of such scaffold worthies as Mary Queen of Scots and Charles I.

On this date in 1563, Jean de Poltrot de Méré was ripped apart in the streets of Paris for assassinating the Duke of Guise.
The opening act of the civil war between Catholics and Huguenots that would devour France in the late 16th century was but a year old at this moment, and Guise was the very man who had set off the powderkeg with a notorious massacre of Huguenots the previous March that had sent agitated confessional armies into the fields.
During the ensuing months, Guise stood at the fore of Catholic forces, opposite the Huguenot commander Conde.
Come early 1563, Guise was besieging the Huguenot-held city of Orleans when Poltrot (English Wikipedia page | French) contrived to ambush him on a nearby road. Poltrot shot Guise with a pistol* and fled; he’d be arrested a day later.
In the Wars of Religion, each previous atrocity justified the revenge that followed it; Guise’s death — and Poltrot’s confession under torture** that it was the Huguenot Admiral Coligny who directed his hand — would help to set the scene for the St. Bartholomew’s Day Massacre visited by Catholics on the Huguenots nine years later. (In fairness we ought also to add that this was not Guise’s first brush with Protestant assassins.) And heavily Catholic Paris was even before the Guise murder violently agitated against Huguenots. During the fighting in 1562,
Reputed Huguenots were struck down in the streets. Sometimes mock trials were held; the attackers grilled the captives on their religious beliefs and, when not satisfied with the answers, killed them on the spot. Officials who tried to intervene were themselves in danger, and edicts against violence were bitterly protested. As one anonymous memoirist described it, “The people wanted nothing less than permission to kill and exterminate the Huguenots without any form of trial; but the consequences were too dangerous.” He implied that permission might have been given, had it been possible to contain the violence.†
All this rage, when focused on the assassin of the Catholic party’s champion, was enough to tear a man limb from limb.
Poltrot’s sentence was to be publicly ripped apart by horses straining his limbs to the four points of the compass. It didn’t quite work: sinew and muscle is too dense and tough to shred by main force, even for a horse; it was only by dint of the the executioner’s helpful hacking that the beasts could dismember their prey.
Quartering by horses is a punishment so preposterously horrific that it could only belong to an age of intentional spectacle.
Indeed, Florike Egmond and Peter Mason argue‡ that until the 16th century such a theatrical execution “was a purely fictional punishment in Europe, which ever since Roman times emerged occasionally in literature, legend and folk-tales as an outrageous form of retribution for (high) treason and related offences” — such as Livy’s mythic rendering of the end given faithless ex-ally Mettius Fufetius, the treatment of St. Hippolytus, and foggy distant Frankish legends.
Although the concept might have existed in imaginations for centuries before, equine execution was at best a vanishingly rare event in reality; certainly when Poltrot was butchered, nobody present had ever before beheld such a sight. For Egmond and Mason, this was an innovation of his judges who “jumped the gap between fiction and historical records” in pursuit of ever “more expressive forms of punishment in order to emphasize the outrageousness of the offense.”
It was an outrage whose time had come, however, for quartering by horses was employed several times more for regicidal offenses in the ensuing decades — including for the Catholic militant who assassinated the Huguenot King Henri IV.
* This event would appear to dislodge the 1570 murder of Scotland’s Regent Moray from its popular acclamation as history’s earliest firearm assassination. As Guise lingered for six days and finally succumbed to effects of his doctor’s own bloodletting, perhaps the view is that Poltrot’s pistol only earned half-credit.

A True Account of the Behaviour, Confession, and Last Dying Speeches Of the Criminals that were Executed at Tyburn, On Wednesday the 8th, of March, 1693.
On the Lord’s-Day, in the Forenoon the Ordinary preacht on the 16th. Verse of the 24th. Chapter of the Acts of the Apostles, viz. And herein, I exercise my self, to keep always a Conscience void of offence toward God and Men. From which Words, The Doctrinal Observation was, that it is the Duty and Priviledge of every True Christian, to get aud retain the Integrity of Conscience. For the Explicating of this Four General Heads were inquired into, and Stated.
First, What is Conscience? It is a Mans Judgment of his Souls Estate and Actions, as these are subjected to the Judgment of God in his Revealed Will. The Lord hath placed Conscience in all Men to approve of what is Right with Complacency, and to disallow what is Evil with Grief, Shame, and Abhorrence. It is a Spy and Register in the Bosom of Ungodly Men, that they cannot Sin, in quiet. Conscience makes a Judgment and Determination. How we have observed the Rule of God’s Sacred Law, or swered from it, accordingly, it Acquits and Comforts; or, Condems and Terrifies.
Secondly, What is essentially necessary to constitute your Conscience Morally Good and Comfortable. First, It must be cleansed and sanctified by Renewing Grace, that it may be conformable in all Things to the Law of God. Secondly, Because its exactest Obedience is defective, therefore it must be spingled with the Propiatory Merits of Christ’s Bloodshed. Thirdly, From the Virtue of Christ’s death, there must be exprest, the lively Fruits of an Holy Conversation, with a constant Reliance on Christ’s Intercession to preserve the Integrity of Conscience, under the Violence of all Temptation to Sin, and to support its Comfort, under the deepest Tryals of Affliction.
Thirdly, What Influence doth the Practical believe of the Judgment Day.
What doth the Exercise which preserves a Good Conscience include? It signifies, to be train’d up, under the Discipline of Christianity, so as to be confirm’d in an Holy Conversation against all Contempt and Opposition. So dare be openly Good and Strict in the Practice of all Christian Virtues, when the present Age is most degenerate. It is to make True Religiion our Recreation, and to promote its Aymiableness, in the Uniformity of our Obedience. Righteousness toward Men, Severe[d] from Piety toward God, is veiled Ath[e]ism; and Holy Exercises toward Him, with the neglect of Relative Duties toward men is demure and glittering Hypocrisie. Therefore the Charitable Testimony of others, cannot comfort the Conscience, under its presumptive Groundles Hopes, concerning its Renewed State. This is Infallibly known to God, altho’ Conscience may make a false Report, by Self-flattery, and the Sinners deep Security. Therefore, let us Summon our Hearts, to a strict Account, what preparative Dispositions are formed in us, which may present us before Christ’s Tribunal, with Approbation. But such, who carry their unpardoned Guilt and unrenewed Nature, to the Judgment Seat of Christ, shall have Convulsive pangs of desperation in their Conscience, and shall be rejected by Christ, with the Greatest Abhorrency. After several Rules and Directions, how to get and preserve a Good Conscience, The Conclusion was thus directed to the Condemned Criminals. How may St. Paul‘s Example in the Text, reflect a sad Aspect on your Consciences. These you have defiled, by prostituting them to the Infamous Lusts of your Fleshly Minds. Have you not striven to rase out the Dictates and Sentiments of common Equity? when your Convictions have been troublesome, you have flattered Conscience, with Carnal Reasonings. How have you deafed it to Divine Instructions. By Wordly Diversions, and have drowned the Cries thereof in sensual Pleasures, and thereby, brought the sly Artifices of Sining, unto a destructive Maturity. You have sinned in despight of all Admonitions, and the Examples of Publick Justice. Notwithstanding, when your Consciences shall be arm’d with God’s Commission, they will be active to Condemn you, though cast at present, into a Lethargy of Stupidity. You cannot deny, that you have been great Sinners, yet, there is pardoning Mercy to be obained, by that Satisfaction Christ’s death hath made to God’s offended Justice. This applied by Faith unfeigned, purifies the Heart in Obedience to all Divine Commands. This Renewed Frame, by sprinkling the Merits of Christ’s Bloodshed on the Conscience, turns his Tribunal of Strict Justice, into a Throne of Grace and Mercy. So shall we (at last) be presented to God the Father, not only void of Offence, but in a perfect State of Holiness to all Eternity.
I proceed to give an Account of the Behaviour and Confessions of the Condemned Criminals.
I. Mr. Best, Condemned for High-Treason, in Clipping, Filing, and Diminishing the Current Coyn of England. He is Aged 50 Years. Was Educated at School in Hertfordshire. His Father sent him to in Cambridge, where, he continued his Studies, till he took the Degree of Bachelor in Physick. Afterwards, he practised in that Science, and might have lived comfortably upon it. But by Degrees, he neglected to follow his Profession; and was drawn into Bad Company, of which he now Repents. He denied not, that he had been a great Sinner. I enquired into the Particulars of his Evil Conversation, it being a necessary Duty, to unburthen the Conscience of a Load of Sin, by a free discovery, of it, that so, Serenity of Mind, may be obtained. Besides, there is great difference betwixt Person lying on a sick Bed whose Sins are more secreet, and who may recover to a longer Space of Repentance. Such, are not so strictly obliged, to confess their particular Enormities. But for those, who by Notorious Crimes have given Publick Scandal to the Christian Religion, and brought themselves under the Sentence of Death; such ought to make Publick Acknowledgment of their Excesses in Sinning, that their Repentance may be as Exemplary, as their Conversation hath been Vicious upon this, Mr. Best, was better convinced of his Duty. And freely confest, that he had been Guilty of most Sins, Murther only excepted. Saying withal, that he doubted not the Truth of his Repentance, and that God was reconciled to him, in Christ. I replied, that the Heart of Man is very deceitful in Judging its Spiritual State Godward, especially when Persons have contracted a Custom in Sinning, and thereby hardned their Hearts, to persist therein. To this he replied, that Naturally Man’s Heart is inclined to Self-flattery, but he hoped, the Spirit of God had so sanctified this distress, that his Heart was thoroughly broken for and from the Love of all Sin, chiefly, as an offence against God, who might have justly cut him off, by an untimely death, for his younger Excesses in Sinning. But, said he, I would not be Reclamed, by a more gentle Rod; therefore God now compells me, by greater Severity, to turn to him, and Blessed is the Man, whom the Reproachful stroke of Death, makes (tho’ late) a Partaker of God’s Holiness. I replied, that I was glad, he was convinced of his sinful State, and in some Preparation, to apply the Promises of Salvation. But, it is safest, to be poor in Spirit, and thereby, to Magnifie the All-sufficiency of God’s Grace. He replied, that he endeavoured to be Self abas’d in as much, as the Omniscient, Heart-searching God, would not be Mockt, and could not be deceived with semblant Flourishes in Soul-Concernments.
II. James Steward, Condemned for Breaking the House of Elizabeth Thorne. He is Aged 24 Years, or thereabout. His Father placed him forth, to the Employment of a Chyrugeon. He said, that his Father was of the Roman Religion, and bred him up, in it, so that he knew not well how to quit it. I replied, that we are not obliged to live and d[i]e, in the Religion of our Parents, not grounded on the Purity of God’s Word. And endeavoured to convince him of the Hazard and Danger, in Adhearing to False Principles in Religion, in as much, as these have Influence on an Immortal Conversation. He replied, that he had so much Knowledge, as not to believe the gross Errors of the Romish Church. He also said, that be could not have wanted this Severe. Yet, Just Dealing of God with him in as much, that now he is thoroughly awakend from his Security, and Hopes, that God will turn this distress, into a means of his Conversion; and then, he shall not be troubled for his Reproachful Death. I Stated to him, the Nature and Effects of True Saving Faith and Godly Sorrow for Sin: To which he was attentive and seemed to comply with my Advice, that he might be prepared for Death. He said, that if he had followed his Wives Good Counsel to have been content with an Honest Employment, he had not fallen into this Shameful and Untimely End.
III. Elizabeth Wann, Condemned for Robbing Frances Coguer of a Gold-Chain, Value 8 l. being stopt, the Neck-Lace was found in her Mouth. She is Aged 16 Years. Had Good Education, but was Disobedient to her Mother. Whereupon she left her Family, and entered her self a Servant in London with a Mistress, who employ’d her, most what in Needle-work; but she soon left that Service. Then she grew idle and kept bad Company. She confest, that not Poverty, but only her wicked Heart, inclined her to commit the Crime she did not observe the Sabboth days of later time, and when she did pray, (which was seldom) she performed that Holy Part of Worship, very carelesly. She denied not that she had been a Great Sinner, but being Reprieved, as with Child she promised, that she would not absent her self from the Publick Worship of God, but would endeavour, to beg of Him, firrm Resolutions of Amendment.
IV. David Shammel, Condemn’d for Felony. He is Aged 33 Years. He said, that he was bred up, to Husbandry, and continued that Employment for some length of time, but leaving it, and betaking himself to an Idle Life, he became Poor, and so adventur’d to commit this Felony. He was willing to make an Acknowledgment of his Evil Life. and in particular accused himself of Sabboth-breaking, neglecting to pray that God would keep him, from the wicked incliantions of his own Heart, and the Mischiefs of bad Company. He wept, yet complained of the Hardness of his Heart. Saying, he prayed earnestly, that God would make it thoroughly Contrite, that upon the Change of it, and being made Holy, he might be in a fit Frame to die.
V. John Noble, Condemn’d for Felony and Burglary in Breaking the House of William Cook together with others, not yet taken. He is Aged 53 Years. He said, that he had used the Employment of a Seaman for 38 Years. That he had been Master of a Ship, some time since, but of late, he serves King William in the Fleet. That he had escaped many Perils at Sea. That in great Distresses, he made several Vows to God, that is he would preserve him, his Life should be Reformed. But he forgot the sparing Mercies of the Lord, and return to his former Evil Course of Life, which is now, a greater Trouble to his Mind. He said, that God was Righteous in bringing him to Shame and Punishment: But he prays, that this may work upon his Heart, to make him thorouhgly sensible of all his Sins, that the Lord may Pardon them and in Mercy, save his Soul, when he shall undergo the Pains of Death. I hope he was Penitent.
VI. Philip Mackqueere, Condemned for Robbing John Lacey Esq; in the High-way. He is Aged 28 Years. Was born in Ireland of Protestant Parents. They educated him with Religious Instruction, but he now grieves, that it made not that Impression on him, which they expected. For, he was not obedient to them, as he ought. Upon that, he left them to Travel into Spain and Portugal, after that, into the West-Indies when he returned into England.
He entr’d into Sea-service, under King Charles the II. He said, that he was entertain’d in a large Ship of War last Summer, and was Engaged in a Sea-Fight: But he left that Employment, and thereupon, joyning with bad Company, fell into many Excesses in Sinning. He said, it Repents him, that he did not take Warning by former escaping the Sentence of Death. But since his last Confinement, he hath endeavour’d to get his Heart made sensible of all his sins, which now lie as an heavy Burden on him. He was attantive to the Exhortations given him, to prepare for Death. He promised that he would endeavour to the utmost, by God’s Assistance, to improve his Time, for the getting his Heart into a more penitent Frame, that he may make his Peace with God, and be fit for his Appearance at Christ’s Judgment Seat
On Wednesday the 8th. of March these Five Prisoners were convey’d to Tyburn, viz.
Josiah Best (who was drawne in a Sledge) Phillip Mackguire, James Steward, David Shammell, and John Noble. Mr. Best Confest that he had been Educated at the University of Cambridge, and there took the Degree of Batchelour in Physick; though now he had unworthily declined his profession; which was a great trouble to him, he desires the Ordinary to come to him in the Sledge, which he did, where he told him that he had great hopes of Salvation through the Merits of Christ, and that he was very willing to Dye, though he had sometimes some doubts and jealousies upon him as to his Eternal welfare: Yet now he was Composed, and so did continue to the last, in an humble Frame, after a Devot manner; Joyning in Prayer, and Pray’d to Almighty God in a very sensible manner with Contrition; acknowledgeing that God was Jnst and Righteouss.
David Shammell, was very Ignorant as to to the concerns of his Soul, but was willing to hearken to Instructions; desiring all he Spectators to take warning by his untimely end, and particularly to beware of Whoredom, evil Company, and breach of the Sabbath.
James Steward, and Phillip Mackguire, Declared that they Dyed in the Roman Catholick Religion, (tho’) when they were in Newgate, they always came to the Chappel. Steward at last spake to this effect; Gentlemen, I am but a young Man, and by my sins, I have brought my Body to be Exposed before you, but I hope God will have Mercy upon my soul: I desire that all young Persons would take Example by me, that they may not be Disobedient to their Parents; I run from mine, and would not be ruled by them, they Indulged me and gave me Money, which spoiled me, I had good Education, and might have lived honestly, but Pride and Lastness hath brought me to this shameful End, and now God is just; I spake this that all Parents may take heed, and breed their Children well; and in the fear of God, and that all men may be warned by my fatal End.
Mackguire said but little, only desired all Men to take timely Warning by him; acknowledging that God had justly brought him to such severe Punishment.
John Noble, behaved himself a little unseemly, being very unsensible, of his latter End; would not be perswaded to hear good Counsel, he seemed to be disturbed in his Brain.
This is all the Account I can give of this Sessions.

Whereas a Picture was lost some time since being the Representation of Flushing, one of the Provinces, or a Town in Holland, with a Sea incompassing it; a Packet-boat under Sail, a large Ship under Sail: and a little above the Ship it was torn about eight Inches, and but corsely swen up. On this date in 1678, Catholic courtier Edward Col(e)man was hanged, drawn and quartered at Tyburn — the second victim of Titus Oates’s “Popish Plot” concotion.
Colman was a Catholic convert whose zeal for the old faith led him into a variety of treacherous intrigues with the French court — although Colman’s eager and fruitless offices more annoyed than profited his allies.
His behavior was sufficiently indiscreet that fabulist Titus Oates had Colman queued up by name* as a Catholic plotter in the first round of 1678 Catholic terrorism allegations that would roil the realm for the next three years.
That indiscretion was very real, however, and extended to a careless presumption of his own safety. He seems to have been tipped to his danger by the judge who first took Oates’s evidence, a friend named Sir Edmund Godfrey, but he failed to use this advance intelligence to destroy his own correspondence. Godfrey in his own turn went on to a starring role in the Popish Plot debacle when he turned up murdered in October of 1678, a crime whose immediate attribution to the Catholic conspiracy that Oates had unfolded for him sent England clear round the bend.**
Colman’s case had already begun and half-fizzled by that point but with the apparent assassination of the judge a cry for his own blood now shook Parliament — “Colman’s letters!” alluding to that correspondence he surely wished he had burned: its volumes unfolded intelligence leaks, offers to exert French influence in the government even so far as dissolving Parliament, and applications for King Louis’s gold.
There are some incriminating examples in the trial transcript that, Lord Chief Justice William Scroggs charged, show “That your Design was to bring in Popery into England, and to promote the interest of the French King in this place, for which you hoped to have a Pension.” While Oates was a legendary perjurer and his fables destined to take the lives of 20-odd innocent souls in the months to come, the fact was that Colman really was caught out. His scheming ought not have merited such spectacular punishment under less extraordinary circumstances, but the things Colman really did do made it easy for Oates to position him as a paymaster in the fictitious regicidal conspiracy. “Mr. Colman, your own papers are enough to condemn you,” Scroggs said when his prisoner asserted innocence.
Nor could he protect himself with position. (Men even higher than Colman would succumb to the panic in time.) As detestably elevated as Colman looked to the average commoner, he was not himself a lord and was already (pre-Oates) regarded by King Charles II and many members of the court as a loose cannon. Everything pointed to sacrificing him … and they did. But as events would prove, the popular rage was not quenched on Colman’s bones alone.
* By name — not by face: Oates would be embarrassed at Colman’s eventual trial by the prisoner pointing out that Oates, who now claimed to have been personally paid out by Colman for various seditious errands, had utterly failed to recognize his “conspirator” when Oates appeared before the Privy Council to lay his charges in September.
** Godfrey’s murder has never been satisfactorily explained. There’s a good chance that it was a wholly unrelated affair with amazing bad timing; the revenge of the truculent Earl of Pembroke, whom Godfrey had prosecuted for murder a few months previous, is one leading possibility.
On this date in 1591, Brian na Múrtha Ó Ruairc — Brian O’Rourke to the English who killed him — was drawn and quartered as a rebel at Tyburn.
O’Rourke was a chieftain in a disappearing world, the Gaelic Ireland that the English had been engaged in reducing ever since King Henry VIII realized that he was King of Ireland back in 1542.
O’Rourke’s patrimony in this Tudor conquest was the kingdom of West Breifne, with a lineage going right back to its 12th century founder. As far as the Tudors were concerned he was just one more truculent local lord to subdue — even if the very “proudest man this day living on the earth.” (per Nicholas Maltby)
O’Rourke’s pride put him into oppositin against the English satrap and even to succor sailors taking refuge from the shattered Spanish Armada in 1588. But fighting in his environs and eventual outright occupation steadily constrained the scope of his autonomy.
In the end it was his brother-Celts in Scotland who finished him: when O’Rourke turned up there in 1591 seeking license to recruit sword-arms there from King James VI (James was not yet James I of England at this point), Queen Elizabeth successfully prevailed upon her Scottish counterpart to arrest and extradite the man — an incident that triggered a riot in Glasgow.
Tried on the highly dubious grounds of treason against England committed in Ireland — plus a lese-majeste incident of having the queen’s image dragged in the mud tossed into the indictment for good measure* — O’Rourke scornfully refused to plead, or to defend himself unless Elizabeth herself would deign to sit in judgment — sovereign to sovereign. The court required only O’Rourke’s body, not his assent, to proceed.
O’Rourke had a sharp enough tongue when minded to deploy it, however. On the scaffold, he witheringly abused the notoriously avaricious bishop Miler Magrath who had been sent to minister to him. Then …
Upon Wednesdaie the 3 of November, Bren O’Royrke was drawne to Tyborne, and there hanged, his members and bowels burned in the fire, his heart taken out, and holden up by the hangman, naming it to be the archtraytors heart, and then did he cast the same into the fire, then was the head stricken off, and his bodie quartered
O’Rourke’s son Brian oge O’Rourke inherited his position, and his struggle, until younger brother Tadgh O’Rourke deposed him with English support. Tadgh died young in 1605 — and with him, West Breifne expired too.

He deployed for the old religion his “fervour, zeal and ready wit” in Lancaster from 1612 to 1622, withstood an arrest, then entered the Jesuit order and resumed his underground ministry — until, as the story has it, a man whom Fr. Arrowsmith had chastised for his adulteries petulantly shopped him.
Arrowsmith suffered the horrible public butchery of drawing and quartering, as well as posthumous burning. From the remans, someone retrieved as a relic a charred hand and sent it to Arrowsmith’s relations, who (per a 19th century relative) “keep it in a silver case, and honour it very much, and every Sunday all the crippled or diseased Catholic poor come to kiss it, and the priest touches them with it. It has performed many authentic cures, — some in our time, — so strong is faith.” It has since been transmitted to the Church of St. Oswald and St. Edmund Arrowsmith in Ashton. Radical priest John Ball was hanged, drawn, and quartered on this St. Swithin’s Day in 1381 for the edification of the 14-year-old king whom he had very nearly deposed.
The wandering “hedge priest” Ball emerged out of St. Albans in the heart of the calamitous fourteenth centry spitting class leveling to rapt audiences of aggrieved peasants. He paid the price with at least three stints in prison. In 1366, an edict forbade his would-be flock from hearing his seditious theology demanding clerical poverty and (so complained the Archbishop of Canterbury) “putting about scandals concerning our own person, and those of other prelates and clergy.”*
But there was a reason that Ball’s illicit sermons could command such attention, and ordering him to shut up was mere whistling past the graveyard.
Wat Tyler’s rebellion was one of the most spectacular risings England ever saw, and one of the first acts of peasants marching on London was to liberate Ball from ecclesiastical custody in Maidstone.
Ball preached to his rescuers at Blackheath, coining his great egalitarian slogan-couplet, “When Adam delved and Eve span, Who was then the gentleman?”
When Adam delved and Eve span, Who was then the gentleman? From the beginning all men by nature were created alike, and our bondage or servitude came in by the unjust oppression of naughty men. For if God would have had any bondmen from the beginning, he would have appointed who should be bond, and who free. And therefore I exhort you to consider that now the time is come, appointed to us by God, in which ye may (if ye will) cast off the yoke of bondage, and recover liberty.
They came breathtakingly close to accomplishing it.
For a few days that pregnant June the rebels controlled London, even putting to death the Archbishop of Canterbury and mounting his head on London Bridge — and Ball the “mad priest” stood in leadership alongside Wat Tyler and Jack Straw. Peasant rebellions are usually destined to end horribly; maybe this was one always was too, but it achieved very much more — terrifyingly much, to England’s ruling class — than previous other disturbances by the pitchfork crowd. By appearances, Wat Tyler and John Ball and the rest were within an ace of overturning England’s feudal hierarchy. Certainly they had the opportunity to slay young king Richard II, whose courage in command at this moment might have saved the crown to be taken from his descendants. During face-to-face negotiations between Richard and Wat Tyler himself, the rude peasant was murdered — and Richard acted smartly to bluff his villeins into marching away at a moment when they could easily have turned regicidal.
The beheaded movement was soon dislodged from London, and while promises of mercy (not always observed) did for the mass of rebels, those in its leadership could never hope for the same — least of all a career rabble-rouser. Ball was hunted down in hiding, and this time would be indulged no ecclesiastical detention: instead, his head replaced the Archbishop of Canterbury’s on London Bridge.
Wat Tyler’s name attaches to the rebellion, but for posterity it is the words of Ball, few as have survived for us, that describe its aims in something like its own voice.
Those words still make for a powerfully current critique in our own oligarchical age. When in 2015 a marker was unveiled commemorating the peasants’ rebellion, it was done on this anniversary of John Ball’s execution — and with a summons to equality he issued that has never yet been answered.
Things cannot go on well in England nor ever will until everything shall be in common. When there shall be neither Vassal nor Lord and all distinctions levelled.
* Ball’s radicalism also helped turn English elites against the religious reforms sought by John Wycliffe, who was still alive during the 1381 peasants’ rebellion.

Into whose Hands those my Dying Words shall come; they may not be look’d upon as a Form, because it is Customary, for unfortunate Persons under my Fate so to do; No, but with a sincere Heart to clear my Conscience, as I am a Dying Man. First to my Creator & Redeemer, by whom and thro’ his great Mercy I hope to merit Salvation.
I JAMES DUNBAR, was born in the Town land of Grogan, in the Parish of Drummal, near Ronaldstown, in the County of Antrim of honest Parents; My Father was a Farmer, Liv’d in the fear of God, attended the Meetings constantly with his Family, doing to the best of his Knowledge as became a Man in his Station; brought up all under his care in the fear and service of God. To this Day I well remember when I was about Eleven years of Age, I had amongst others learned a great Word to swear by my Conscience, and in his hearing, he finding it became practice took an opportunity to Chastize me for it, but with that pleasant Fatherly Correction, that he perfectly sham’d me out of it, the same was so imprinted in my mind, be in what Company soever, I never was any way addicted to that Sin of Swearing to this Day. He taught me the Catechism and Psalm Book; brought me up to the Age of Sixteen, then I stray’d away from him and Listed in the Service, where in Flanders and Ireland I served seven years under King William, in which time I receiv’d three Wounds, during my whole Travels my mind was always bent upon the Genuine part, casting Molds of several sorts, each exceeding the other.
Upon my return I settled, Marry’d a Wife, and got things necessary about me: But in process of time, hearing such a Character of New England, what great Advantage was to be made by those that could carry some Money with them, I resolv’d for that place: In order thereunto I made Sale of all I had, & proceeding forward at Newtown-Stuart chang’d my Mind, which I now dearly repent. Settles again there about three Years. At Leisure times to recreate my self with an Innocent Pleasure I took delight in Fishing; but once too often, for by an unhappy fall, there was a Knife with the point Towards me, stuck into and gave me a Wound six Inches deep, the same I lay by sixteen Weeks. And the very God of Peace sanctifie you wholly, and I pray God your whole Soul and Body be preserved blameless unto the coming of our Lord Jesus Christ &c.
Consider my Chidlren, these words, Pray without Ceasing. It is not that you should always be upon your Knees at Prayer, but that you shall be always in a Praying Flame of Spirit. But more particularly, dear Children see that ye neglect not to Pray in secret every Morning, and at Night, for that is the Duty of all others. That you may pour foth [sic] your Hearts to God, in the most familiar way without Bashfulness or Confusion, and expect most of the Presence of the Holy Ghost.
Eph. 6 16, [sic: he means Ephesians 6:18] Praying always with all prayer and Supplication in the Spirit and watching thereunto with all Perseverance and Supplication for all Saints.
And now my dear Children, I might have Recommended you to many more Places of Scripture, but I rather Recommend you to the search of the whole Old and New Testment, [sic] which is able to make you Wise unto Salvation.
I humbly beg leave of thee, O Father, of Heaven and Earth, to return thee my hearty thanks, for inspiring an Spirit of Remorse & Pity, into the Hearts and Minds of those Learned Gentlemen the Clergy of the Presbytery of the Town of Belfast &c. Who was pleas’d to remember me in their publick Service, joyn’d with their Congregations, on Sunday last. The Speech of Patrick Macallaher
I Patrick Carraghar am the Nephew of that Collmore who was Executed last Wednesday, who was the Ruin of me, who am but Eighteen Years of Age now, tho’ of these Tender years, I am very sensible of the great Follies and Sins that I have been Guilty of, my Father and Mother Liv’d in the Place call’d Loghross, in the County of Armagh, as for my Father People may say what they please of him; for he is Alive, but for my Mother she was never charg’d with anything that was ill, and the Neighbours in the Country knew her to be an honest good Woman she dy’d when I was very young, neverthleess I was bound Prentice to a Taylor, but did not serve my Master long, but followed my Uncle, which is the Cause of my coming to this untimely End, tho’ I was Try’d for keeping Company and assisting one Gillaspy M’Culum, a Proclaimed Tory, for my part I was neither Guilty of Murhter nor Robbery of my self, but I have been by when Robberry was committed, I have no more to say but that I die a Roman Catholic, and I beg of thee O my great God to have Mercy on my poor Soul. Dear Christians Pray for me.

For our Parts we have but little to say for our selves, only that we were born in the Fews, in the County of Armagh, and our Parents Lived Poor and Honest, but many honest Parents has had Wick’d Idle children as we both have been very Disobedient to our Parents or Friends, which gave us good advice, but we follow’d too much of our own, which Brings too many young Fellows either to the Gallows or to be Transported, and as we are Dying Persons, we desire all young People to take the Advice of their Parents and Friends, here we die for Robbing a poor honest Man’s House in the County of Cavan, his name is one Coleman, we can’t deny the Fact, it being prov’d so home on us, though we thought what we took there did not deserve Death, but this with other wicked Sins and Crimes is the Cause of our being Brought to this shameful End, O great God we Crave Mercy, and Begs of thee O merciful Father to receive our Souls, O good People pray for us, for we die Roman Catholicks, and sweet Jesus receive us Amen. One of the Quinn’s had the Impudence to Curse and Abuse the High Sheriff, the Grand Jury and the whole Court, and told them that they Murdered him.
The Whole Tryal and Examination of Capt. Collmore a Proclaim’d Tory, and was Noted for being Guilty of Bloody Murthers, Rapes and Robberies in the County of Armagh
When Collmore was brought to the Bar to be Tryed, he denied himself to be the Man, then the Clerk of the Crown was obliged to Swear to the Proclamation where he was nam’d; so when the Jury was call’d and Sworn, he was asked several Questions, but answered to no Purpose, then one Andrew Thompson appear’d, and the Book was given him, who Swore that he was the same Charles Carraghar who Liv’d formerly with Mr. Blykes of Darcy in the Fews, and that he Stole Two Heffers from Aldarman Grimes, and was for the same Indicted and Proclaimed at Ardee[.] Collmore objected against the Evidence, because he said that Thompson had formerly forsworn himself, to which the Evidence answered, that as he was coming home late to his House one Night, that he was met by this Collmore, and was forced in Defence of his Life, which was so much threaten’d by him, to Swear that he never Presented him, the Jury immediately brought him in Guilty.
Councellor Townly gave him the following sentance, That he should be Hanged; and be Cut down before he was dead, his Privy Members to be Cut Off, his Bowels burn’d, and his Quarters to be dispos’d off at the King’s Pleasure.
When Collmore was brought to the Gallows, he Hang for a small Time, he was Cut down while alive, when the Hangman was cutting off his Privities, he cry’d out, then the Sheriff ordered his Throat to be Cut, the Hangman could not do it readily, for he strugled very much, his Head was afterwards Cut off, his Chops open’d and shut, tho’ his Head was a Yard from his Body, his Carcass was divided into 4 parts, and set up in 4 several Parts of the Country. He died very obstinately.

Almighty God has by a just Providence brought me to this untimely End, He has been Mercifully pleas’d not to Cut me off in the midst of my Sins, but to allow me some Time to reflect on my unhappy mis spent Life, and to Implore Forgiveness for my many Iniquities, which I trust he will graciously Pardon.
And as my Crimes have been of publick crying Nature, so I think myself Bound to make a publick Confession of them both to God and my Country.
And first with Shame and Confusion of Face I confess I have been Guilty of many Robberries and Thefts, and have also Seduced and Encouraged others to do the like.
I Barbarously and Unjustly Embru’d my Hands in the Blood of my Fellow Creatures, and in particular I Murder’d Martin Grey and Christopher Betty, and suffer’d that worthy honest Gent. Mr. Edmond Reily to be wrongfully Executed at Cavan Assizes for the said Murders; He being no ways Privy or Accessary to them, but entirely Innocent of that bloody Fact which was the ruin of his Wife and several small Children. I likewise Confess I was at the Inhumane Murders and Butchery of Bryan O’Hanlan, and M’Gibbin, for all which I most humbly beg the Almighty’s Pardon, and the Pardon of all whom I have in any way Injur’d, and declare I have a thorow sence of my former Impietys and an utter Abhorence and Detestation of them, and hope God will please to look on me, and accept of my Blood, tho’ a most unworthy Offering, since my Punishment is not half what I deserve.
I die a Member of the Church of Rome, tho’ an unworthy one, and do freely forgive every one that have Injur’d me, especially John M’Keoine who betray’d me, and I declare I wou’d have Fought my way thro’ the Soldiers who surrounded the Cabbin where I was, and had new Charged and Prim’d my Pistols in order to it, but was prevented by the Entreaties of my Nephew, and am now thankful to God for it since I have by that had opportunity to think of my Soul. I humbly Recommend into the Hands of my most Merciful Redeemer, and beg the Prayers of all good People.
After he was Executed there was 3 Kishes of Turff lighted, wherein his Harts Livers Lights and Members were Burned, and his Head set on the Goal, Two Yards higher than any of the rest, with His Hat and Wigg on; his Nephew James McCaraghar and 3 more are to be executed on Saturday 21st.
