1906: William Williams, the last hanged in Minnesota

On this date in 1906, Minnesota hanged a Cornish immigrant for the murder of his homosexual lover … and hanged him so clumsily that it never hanged again.

William Williams shot Johnny Keller dead after Keller’s mother intervened in the teenagers’ relationship. A series of mooning-slash-menacing letters failed to win back affections. “I want you to believe that I love you now as much as I ever did,” Williams wrote. “Keep your promise to me this time, old boy, as it is your last chance,” he wrote, later.

When the man with the redundant name went to die in the dead of night at a St. Paul prison, it seems that there’d been a slight miscalculation. When dropped through the trap, Williams’s “feet touched the ground by reason of the fact that his neck stretched four and one-half inches and the rope nearly eight inches.”

Consequently, three deputies on the scaffold hoisted the rope up to get him airborne, where he strangled to death over the span of a ghastly quarter-hour.

Slowly the minutes dragged.

The surgeon, watch in hand, held his fingers on Williams’ pulse as he scanned the dial of his watch.

Five minutes passed.

There was a slight rustle, low murmurs among the spectators and then silence.

Another five minutes dragged by.

Would this man never die?

Fainter and fainter grew the pulsations of the doomed heart as it labored to maintain its function.

The dead man’s suspended body moved with a gentle swaying.

The deputies wiped their perspiring brows with their handkerchiefs.

Members of the crowd shifted from one foot to another.

There were few murmurs, which died at once.

Eleven, twelve, thirteen minutes.

The heart was beating now with spasmodic movement, fainter and fainter.

Fourteen minutes—only a surgeon’s fingers could detect the flow of blood now.

Fourteen and a half minutes.

‘He is dead,’ said Surgeon Moore.

The end has come.

And the end had come.

Two things happened in consequence of this sensational press narrative.

First: the news entities who promulgated these descriptions were themselves prosecuted under a law sponsored by anti-death penalty Republican legislator John Day Smith to make executions as secretive as possible. The St. Paul Pioneer Press, St. Paul Dispatch and St. Paul Daily News each caught fines of 25 bones or clams or whatever you call them.

Second: those illicit descriptions out in the public eye triggered efforts (eventually successful in 1911) to abolish the death penalty full stop in the Land of 10,000 Lakes.

Smith’s law was adopted as a half-measure when death penalty abolition couldn’t pass in 1889, as a bit of moral hygiene against the unseemly spectacle of public execution. The measure pioneered the familiar 20th century routine of conducting executions after midnight behind prison walls. Newspapermen derisively called it the “midnight assassination” law — but it was taken up by many other states over the succeeding years as public executions went extinct.

As for Smith himself … there’s a rumor of a ghost story, and (given a tragic love story, a sensational crime, a capital punishment milestone, and a queer identity) the palpable fact of a play.

1679: The hot-blooded Lady Christian Nimmo

On this date in 1679, a spurned lover laid her head on the block in Edinburgh and began her career as a spook.

Decadent widower James Forrester (or Forester), having run through his cash, was marking his time at the pub and in the arms of Lady Christian Nimmo.

She was a great deal younger than himself, and a niece of his first wife’s. This near relationship greatly increased the scandal, which was aggravated by Lord Forester having always professed to be a religious man, and a rigid Presbyterian. [Edinburgh’s rigid Presbyterians had a recurring misconduct problem. -ed.] Mrs. Nimmo, besides being a very beautiful woman, was of a violent and impulsive nature. She was believed always to carry a sword under her petticoats, and so was not a person to be treated lightly, especially by those who reflected what blood ran in her veins, — Mrs. Bedford, who had murdered her husband a few years before, being her cousin-german. She was also related to the unhappy Lady Warriston, who suffered death for the same crime in 1600. Lord Forester’s passion for her appears to have cooled; and, shutting his eyes to possible consequences, he permitted himself in one of his carouses to speak more than lightly of her. This came to her ears, and, seized with fury, she went at once to his castle at Corstorphine … a violent altercation took place between them. In the midst of it, she snatched the sword from his side, ran him through the body, and killed him.

… She confessed her crime, but pleaded that Lord Forester, being ferocious and intoxicated with drink, had drawn his sword; that, to save herself, she had snatched it from him, and that in the struggle he had fallen upon it, and so killed himself. In spite of this defence, sentence of death was passed upon her … [she was] beheaded at the Market Cross on the 12th November 1679. At her execution she appeared dressed in deep mourning, with a long veil, which, before laying her head on the block, she took off, and replaced with a white taffeta hood. She met her fate with great courage. It was said at the time that, in spite of his professed Presbyterianism, a dispensation from the Pope to marry Mrs. Nimmo was found among Lord Forester’s papers, and that his delay in using it had caused her fury. An apparition known as “the white lady” is supposed to haunt the site of the murder with a melodramatic bloody sword.

1793: The smitten Adam Lux

Among all the strange and pathetic love-stories of the Revolution, when hearts were won within prison walls and wedded by the guillotine, is there another as fantastic and wonderful as that of Adam Luchs? (Source)

Adam Lux (as he’s better known, and a fitter name to his character could hardly be invented), German Republican turned French Revolution representative, was so lovestruck by the arresting figure of Charlotte Corday that it was downright … mortifying.

Many were men to whom the Norman maid played muse, like the poet Andre Chenier.

But Lux was something else.

Thrilled by this chaste heroine’s sacrificial blow against the Revolution’s monster, Lux was supposed to have fallen madly in love with the murderess the one time he actually saw her, on her serene way to the scaffold.

Eros thus yoked to Thanatos, the besotted fellow promptly hurled himself after the exaltation of death. Imitation, after all, is the sincerest form of flattery.

Certainly knowing it to be fatal, Adam Lux published under his own name a vindication of Ms. Public Enemy #1 and her “tyrannicide,” and generally went extravagantly mooning about in this sort of vein as he prepared to get his head cut off this date in 1793:

The guillotine is no longer a disgrace. It has become a sacred altar, from which every taint has been removed by the innocent blood shed there on the 17th of July. Forgive me, my divine Charlotte, if I find it impossible at the last moment to show the courage and the gentleness that were yours! I glory because you are superior to me, for it is right that she who is adored should be higher and more glorious than her adorer!

Adam came off a little needy, you’d have to say.

Not surprisingly, he didn’t get the girl in the end.

1977: Princess Misha’al bint Fahd al Saud and her lover

On this date in 1977, a 19-year-old royal adulteress and her paramour were executed in a Jeddah parking lot by the order of the girl’s powerful grandfather.

Princess Misha’al‘s fate has been obscured by secrecy and the Rashomon-like interpretations imposed upon it by observers.

In its outline (and the first stock interpretation we’re imposing) it’s that timeless human tragedy, the love story, in which headstrong royal daughter and suffocating traditional family square off over the seditious power of the feminine libido.

The princess, in a youthful arranged marriage by most accounts, took up with a Saudi boy while both were studying abroad in cosmopolitan Beirut, and dangerously attempted to maintain the affair back in the royal kingdom to the point of a quixotic (and obviously foiled) escape attempt. Whether under color of a judicial proceeding — the story says Misha’al refused to walk away by simply renouncing her lover and defiantly brought down the death sentence by confessing adultery — or simply on his own authority, the girl’s staunchly conservative* grandfather exercised his right as tribal patriarch to inflict an honor killing for the disgrace they had brought on the family.

The execution in Jeddah — she by gunshot,** he by a very clumsy beheading — that is supposed to have occurred on this date was public, but quiet; news of it got abroad only slowly and incompletely. Small wonder that, once it did, the blended motifs of Romeo and Juliet, harem titillation and oil politics made dynamite material for high-, middle- or lowbrow exploitation.

In 1980, the affair became the subject of one of the most notorious television programs ever aired, the docudrama Death of a Princess. This film’s airing in Britain in 1980 led Riyadh to expel the British ambassador, and cost £200 million of lost revenue for the UK from canceled orders and product boycotts by the Saudis.†

It was aired on in the United States on PBS in 1980 to similar controversy, as oil companies rushed to distance themselves from it.

Rebroadcast in 2005, Death of a Princess is available online for your judgment (as is this partial script): is this a muckraking expose of a shameful crime? orientalist heavy petting? “a sensitive and thoughtful exploration of the Arab dilemma,” as per its own advance publicity? and what did the official apologies (and in only a few countries, censorship) say about the political weight of the petroleum industry?

These, meanwhile, are the western reactions, already removed from events by a further layer of mediation, a forest of axes seeking grinding. If the writer who composed this piece is to be believed, the executed girl has posthumously achieved a sort of universal symbolic gravity in the Arab world, standing for the plight of any hopeless cause of justice dashed against authoritarian power.

* For the House of Saud, it must be recalled, the personal was political in the problematic confrontation between tradition and modernity athwart the desert kingdom’s sea of oil.

** “Princess Misha’al” was executed fully veiled, which permits the rumor that the slain woman was actually a surrogate and the onetime royal favorite lives on incognito somewhere.

1708: Jack Ovet, who left no hempen widow

On this date in 1708, an English highwayman whose sense of chivalry crossed the line between old-fashioned and delusional was hanged at Leicester.

Love and outlaws: a match made for balladeers.

Apprenticed a shoemaker, Jack Ovet had a mind to be a gentleman and the enterprise to seek his fortune among the unguarded coaches of Stuart England’s highways. And he affected full rehearsal for his future social role with an arch mien of chivalry. When one of his victims cited him for cowardice, Ovet laid down his pistols and fought a duel with swords, slaying the burgher.

In Crime and Punishment in Eighteenth Century England, Frank McLynn examines the odd but sometimes real rules of honor observed by this romanticized species:

… there clearly were ‘Robin Hoods’ among the highwaymen, as well as individuals of refined sensibility and exquisite courtesy … The courtesy of highwaymen was shown in various ways: politeness to women, avoidance of pointing guns directly at victims, lack of thorough searches of passengers, even the return of favourite items of sentimental value.

Ovet went so far as to become genuinely besotten with a pretty young thing whose purse he relieved, rarely a wise move for a fellow living on his guile. He made bold to seduce his victim in a pseudonymous letter, thus:

MADAM,-These few lines are to acquaint you that though I lately had the cruelty to rob you of twenty guineas, yet you committed a greater robbery at the same time in robbing me of my heart; on which you may behold yourself enthroned, and all my faculties paying their homage to your unparalleled beauty. Therefore be pleased to propose but the method how I may win your belief, and were the way to it as deep as from hence to the centre, I will search it out. For by all my hopes, by all those rites that crown a happy union, by the rosy tincture of your checks, and by your all-subduing eyes, I prize you above all the world. Oh, then, my fair Venus, can you be afraid of Love? His brow is smooth, and his face beset with banks full of delight; about his neck hangs a chain of golden smiles. Let us taste the pleasures which Cupid commands, and for that unmerited favour I shall become another man, to make you happy. So requesting the small boon of a favourable answer to be sent me to Mr Walker’s, who keeps an ale-house at the sign of the Bell in Thornbury, in Gloucestershire, give me leave to subscribe myself your most humble servant to command for ever,

The lady remained resolutely unsmitten — and had a significantly more accurate forecast of her suitor’s future prospects than all that golden-smiles stuff:

SIR,-Yours I received with as great dissatisfaction as when you robbed me, and admire at your impudence of offering me yourself for a husband, when I am sensible ‘twould not be long ere you made me a hempen widow. Perhaps some foolish girl or another may be so bewitched as to go in white to beg the favour of marrying you under the gallows; but indeed I should venture neither there nor in a church to marry one of your profession, whose vows are treacherous, and whose smiles, words and actions, like small rivulets through a thousand turnings of loose passions, at last arrive to the dead sea of sin. Should you therefore dissolve your eyes into tears, was every accent a sigh in your speech, had you all the spells and magic charms of love, I should seal up my ears that I might not hear your dissimulation. You have already broken your word in not sending what you villainously took from me; but not valuing that, let me tell you, for fear you should have too great a conceit of yourself, that you are the first, to my remembrance, whom I ever hated; and sealing my hatred with the hopes of quickly reading your dying speech, in case you die in London, I presume to subscribe myself yours never to command,

2005: Elias Syriani, a family affair

On this date in 2005, North Carolina executed 67-year-old immigrant Elias Syriani at Raleigh’s Central Prison for the murder of his wife — despite the emotional clemency intervention of the couple’s children.

Syriani, an ethnic Assyrian driven from his native Jerusalem by al nakba who moved to the U.S. from Jordan through marriage to a Jordanian immigrant, had a stormy marriage hit the rocks in 1990. Teresa filed for divorce after a few years facing Elias’s violent objections to her westernized behavior.

Syriani responded by jumping her when she drove home one night, and stabbed her to death with a screwdriver in front of their 10-year-old child.

This case meandered forgettably through the bowels of the criminal justice system; the traumatized children moved on (.pdf).

Until the year before Syriani met his fate, when the mysteries of the human heart flipped the script.

The four children visited Syriani and found themselves forgiving their mother’s murderer … and forging an unexpected bond with the father they hadn’t known for a decade. They called it a miracle, a gift from their late mother to go from “hate, absolute hate, to love in a split second.”

The children — by then grown — became Syriani’s advocates for executive clemency, posing an unusual challenge for Gov. Mike Easley: in an environment that (rhetorically, at least) often counts on survivors’ rage and grief as arbiters of punishment, would he spare a father for killing a mother when the children said execution would redouble the family’s injury?

But commutations rarely happen — there’s just no percentage in them for politicians.

“After careful review of the facts and circumstances of this crime and conviction, I find no convincing reason to grant clemency and overturn the unanimous jury verdict affirmed by the state and federal courts.” (Easley)

This startling story became the subject of a 2007 documentary, Love Lived on Death Row

The following are excerpts from an interview with the film’s Producer/Director Linda Booker originally conducted by Sean O’Connell of The Charlotte Weekly.

When did you first hear about/become interested in this story?

Back in July 2005, I was checking the weather on a local news website and scanning the headlines when the article about the Syriani siblings forgiving their father caught my eye. I think at first it interested me because I have been involved with our local domestic violence agency as a volunteer and fundraiser, but as I read the article something about their reconciling with and forgiving their father really touched me. At this point they had begun to share their story with the public and had just appeared at a domestic violence conference in Charlotte called “Hope to Heal.”

At what point did you get the idea to film the story in documentary form? How long did it take to complete the film?

It was an immediate reaction for me upon reading the article that their story might make a compelling documentary film. I printed it out and carried it around with me. But I was still finishing up interviews and editing my first documentary project “Millworker: the Documentary” so I didn’t act on it right away. Then several months later I learned that they would be speaking in Chapel Hill, close to where I live, and I thought, “okay, if I feel this strongly about this, here’s my chance to meet them and film their discussion.” So there I was, a relatively new filmmaker and very nervous about that first step, but I received permission to film that night. That’s also when I first heard about and met Meg Eggleston, who had been writing letters and visiting Elias Syriani on death row for four years and the Syriani sibling’s attorney Russell Sizemore, who was helping them through their father’s clemency appeal pro-bono. I came to learn that Meg’s friendship with Elias was an essential part of their father’s transformation and was such an interesting story in itself.

I started filming in October 2005, edited in the fall of ’06 and started doing preview screenings in early ’07. Since then the film has screened at film festivals and many grassroots screenings with various non-profits and faith groups as sponsors in the U.S. especially in North Carolina.

The Syriani children are open and honest in the film. Did you have trouble accessing them? Were they open to the idea of participating in the film, even though at this point it could not help their father?

I started filming interviews with Meg Eggleston and Russell Sizemore first who trusted that I was not trying to do a sensationalized story, but that I recognized the Syriani’s story of forgiveness was inspirational, regardless of the outcome of the clemency appeal. The Syrianis knew that I was working with Meg & Russ, but out of respect for all they were going through, I did not push the issue of their participation. About six months after the appeal, I wrote them about participating and subsequently we went to California and Chicago in the summer of ’06 to film interviews with them. While they know that a part of the discussion around the film will be capital punishment, the Syriani siblings have expressed that they want their story to live on in hope that their experience of surviving a domestic violence tragedy and the healing that came from forgiveness will touch people’s hearts and help others.

I think it’s because this case is so unique, but I found the film’s stance on the death penalty unclear. Can you, as the filmmaker, clarify your thoughts on the death penalty?

Well, I’ll take that as a compliment, because the documentaries I admire aren’t pounding you over the head with the filmmaker’s opinion. I can tell you that making this film made me face how I felt about the death penalty and I spent a lot of time researching and doing some deep thinking about the issue.

Needless to say it’s very complex, and it is completely understandable that feelings of anger and retribution can occur when you have lost a loved one to violence. We need to do more for those dealing with the aftermath of murder with as much support, assistance and counseling services as possible, especially children. But as I went to restorative justice forums and have met many people who belong to organizations such as Murder Victims Families for Reconciliation, I kept hearing stories about how the death penalty was causing more grief, stress and division in families that had experienced murder. Between making the documentary and doing the research, I came to the conclusion that I couldn’t support a system of justice that can possibly create more pain and victims in its wake and that was also irreversible and arbitrary.

1952: George Muldowney, for loving and killing the original Bond girl

On this date in 1952, Irish steward George Muldowney was hanged at Pentonville Prison for the rather pathetic murder of a dashing Polish spy who had survived much greater villains.

Allowing that nobody ought to die on the floor of the Shelbourne Hotel with a sheath knife stuck in their chest, Christine Granville in particular really deserved a better exit.

Before the outbreak of World War II, she was Krystyna Skarbek, daughter of a Polish aristocrat sinking into poverty. After Germany overran Poland, she went off the marriage meatmarket and on Her Majesty’s Secret Service for a stunning career as a stunning spy that still has ’em sighing today.

Rechristened “Christine Granville” by Britain’s Special Operations Executive, she spent most of the war carrying out feats of cloak-and-dagger derring-do, with a Bond-like aplomb for extricating herself from tricky situations.

If only half the stories they tell about her are true …

  • Commuting between Hungary and Poland by skiing over the Tatra Mountains to gather intelligence and pull other agents out of harm’s way.
  • Getting herself and a fellow agent released from arrest by feigning tuberculosis by chewing her tongue until it bled.
  • Escaping capture at a checkpoint by pulling the pins on two grenades and daring the guards to shoot her.
  • Marching alone into a not-yet-liberated concentration camp to have POW’s reprieved from execution — by telling the Nazi commandante that he’d get the same treatment unless he spared them.
  • Snatching spymaster Francis Cammaerts from the Gestapo ahead of his execution.

And the love affairs! Or that’s what they say — including fellow agent Ian Fleming.

Granville earned the French Croix de Guerre, the George Medal for Special Services, the Order of the British Empire and other decorations, although merely surviving so much time in the field might have been her greatest achievement … but when the war ended, she was just another unwelcome Polish refugee, scrounging for service work in a recovering economy with no welcome waiting for her in her Soviet-dominated homeland.

From here on in, the trite and the tawdry eclipse the heroic.

A stewardess gig on a cruise ship attracted the attentions of her eventual murderer; his crush unreciprocated, and her companionship with another man jealously noticed, Muldowney stalked her and — on the very eve of Granville’s departure to reunite with a wartime confederate/lover — murdered her at her Kensington hotel.

To read the London Times‘ accounting the last moments of this woman so recently outfoxing the Nazis is to behold the face of banality triumphant.

Mr. Ian Smith, for the prosecution, said that, in a written statement at Kensington police station, Muldowney …

“describes how he waited outside the hotel and saw her go in. He went in after her and asked her for some letters he had exchanged with her. She said she had burned them. He did not believe her, and then says: ‘She told me she did not want anything to do with me and was off to the Continent and would see me in two years’ time.’

He then says: ‘Then I took the knife from the sheath which I had in my hip pocket and stabbed her in the chest, and then somebody came up.'” It was a deep stab wound up to the hilt of the knife, and penetrated the heart.

Muldowney didn’t fight the charge; he’d been planning to poison himself after the murder, and tried it when he was in custody. He declined legal aid and pleaded guilty at trial, seemingly eager to expiate his sin or join his would-be lover in death. It was less than 16 weeks after the crime that he stood on the gallows.

While Muldowney moulders in well-deserved obscurity, his victim reportedly inspired her former lover to create the character of Vesper Lynd — the original femme fatale secret agent in the original James Bond novel, Casino Royale. (And the smashing cocktail named for her in the same volume.)

She — Christine, not Vesper — is buried under a spadeful of symbolic Polish soil in St. Mary’s Roman Catholic Cemetery in London.

1803: Robert Emmet, “let no man write my epitaph”

On this date in 1803, Irish nationalist Robert Emmet was hanged and posthumously beheaded, a day after his trial for treason against England.

The well-to-do scion of a Protestant family, Robert Emmet followed his older brother into the Republican ferment of the time and led an unavailing uprising in Dublin on July 23, 1803.

Captured a month later when he romantically recklessly moved his hideout closer to his beloved Sarah Curran.*

Emmet won his great laurels in the annals of Irish Republicanism with a stirring “Speech from the Dock” addressed to the courtroom the day before he died. Or better to say that it was addressed in a courtroom, for knowing that his death sentence was a foregone conclusion, the real audience was posterity and a wider world.

Emmet found that audience with one of the great orations of the 19th century.

I have but one request to ask at my departure from this world — it is the charity of its silence! Let no man write my epitaph: for as no man who knows my motives dare now vindicate them. let not prejudice or ignorance asperse them. Let them and me repose in obscurity and peace, and my tomb remain uninscribed, until other times, and other men, can do justice to my character; when my country takes her place among the nations of the earth, then, and not till then, let my epitaph be written. I have done.

On the strength of such sentiment — and the public’s learning of his love for Sarah Curran — the 25-year-old became iconic in death. Robert’s own death inspired the mandatory Irish patriotic ditty, “Bold Robert Emmet”:

But that sundered love between Emmet and Sarah Curran — who broken-heartedly accepted another proposal and moved to Sicily — was at least as stirring to the Romantic imagination. Washington Irving dedicated a short story to the lost romance; Emmet’s friend Thomas Moore made Curran the subject of a poem (beware: link opens an auto-playing audio file).


Anti-British terrorist Robert Emmet has a statue on Washington, D.C.’s Massachusetts Ave, and probably an entry on the no-fly list.

* 19th century Irish poet Thomas Moore paid her tribute in “She Is Far From the Land”:

She is far from the land where her young hero sleeps,
And lovers are round her, sighing:
But coldly she turns from their gaze, and weeps,
For her heart in his grave is lying.

She sings the wild song of her dear native plains,
Every note which he lov’d awaking; —
Ah! little they think who delight in her strains,
How the heart of the Minstrel is breaking.

He had liv’d for his love, for his country he died,
They were all that to life had entwin’d him;

1848: Camila O’Gorman and Father Ladislao Gutierrez, for traditional family values

On this date in 1848, a pregnant 20-year-old socialite and her forbidden lover were shot at the order of an Argentine dictator.

Virtually a lens for the contradictory currents of gender, class and power in her time, Camila O’Gorman was the daughter of an elite family of (as her name suggests) Irish extraction, and a bosom friend of the daughter of her future executioner, dictator Juan Manuel de Rosas.

She fell into a torrid affair with Gutierrez, the family priest, and in 1847 eloped with him, a grand gesture of romanticism that brought a government warrant for their capture to “satisfy religion and the law and to prevent further cases of immorality and disorder.”

A scandal, as one might suppose — there was much chatter over who seduced whom, and whether it was a kidnapping — but a manhunt (and womanhunt)? Rosas appears psychotically enraged by two young people crazy in love, and still more so for summarily decreeing their death when he had them in his clutches. Another priest, it turned out, handed them over — more in sadness than in anger, in the manner of such folk, but understanding deep down that the arbitrary law is the law and immorality and disorder don’t go about preventing themselves.

O’Gorman was the first woman executed in independent Argentina, and she was eight months pregnant: the better to “satisfy religion” (though not the law, which forbade the execution of a pregnant woman), O’Gorman’s unborn child was baptized … by making her mother drink holy water.

The lovers were then shot together at the town of General San Martín, then known as Santos Lugares de Rosas.

According to this effusively pro-elopers essay,

Camila and Uladislao’s brave sense of freedom upset the structured norms of a society used to obeying through fear. Their only way of facing the tyrannical power was escaping from a society which would never understand. They did not give up on their love to please the Restorer [Rosas], as was expected in those days. They never showed signs of repentment, [sic] on the contrary their peaceful minds reflected their clean consciences.

And among the many questions this tragic true story might raise, there’s one that particularly appals [sic] us: why did Rosas shoot Camila knowing the law stated a pregnant woman could not be murdered? Was that baby guilty of his parents’ “crime”?

He evidently was, since by being born he would symbolise the testimony not only of the criminal act, but also the evidence of “disobedience” of a moral code imposed by a fearful dictator.

Such Shakespearean drama ripped from recent history has not failed to inspire literary treatment — such as Enrique Molina’s Una Sombra Donde Suena Camila O’Gorman, (“A Shadow Where Camila O’Gorman Dreams”) and this 19th century Spanish text.

On the screen, O’Gorman and Gutierrez’s doomed love was the topic of one of the first Argentine feature films (a century-old silent film now thought lost), and an Academy Award-nominated 1984 film with plenty of talking:

1953: Julius and Ethel Rosenberg, “the first victims of American fascism”

On this date in 1953, Julius and Ethel Rosenberg were put to death in Sing Sing’s electric chair as Soviet spies.

Divisive since it was handed down — or more precisely, since a famous article in London’s Guardian challenged the verdict and helped elevate it into a latter-day Dreyfus case — the Rosenbergs‘ sentence has inspired so much acrimony over several generations that merely to observe the date is to invite a debate capable of eminently more heat than light.

Where to begin with a case so towering in the recent cultural milieu?

A textbook might say that Julius and Ethel were convicted of passing atomic secrets to the Russians, that they maintained their innocence and their defenders carried that flame years after their deaths, and that intelligence files opened after the Cold War — notably the Venona project — apparently confirmed that Julius was a spy after all, though Ethel seems to have been little more than an approving bystander and Julius, come to think of it, never had anything so worthwhile as atomic secrets to share with Moscow. This information (which does have its own skeptics, albeit a small minority) undermines the maximal “absolute innocence” position that this day’s victims always asserted, but it’s a curious leap to take it as vindicating the legal outcome.

Half a century on, juridical guilt or innocence seems distinctly secondary in the lasting importance of the Rosenberg trial, the two-year battle to save them, and their potent symbolic afterlives.

The Rosenbergs are the only stateside judicial executions for espionage since the Civil War.* That is a remarkable distinction, after all; so, how comes it that it is held by — to state the case against them in its strongest imaginable terms — two enthusiastic but bush-league players, and not by the likes of Aldrich Ames? How was it that a judge with a largely center-liberal career on the bench would read them a sentence of death hysterically accusing these Lower East Siders of causing the Korean War?

[Y]our conduct in putting into the hands of the Russians the A-bomb years before our best scientists predicted Russia would perfect the bomb has already caused, in my opinion, the Communist aggression in Korea, with the resultant casualties exceeding 50,000 and who knows but that millions more of innocent people may pay the price of your treason.

I feel that I must pass such sentence upon the principals in this diabolical conspiracy to destroy a God-fearing nation, which will demonstrate with finality that this nation’s security must remain inviolate; that traffic in military secrets, whether promoted by slavish devotion to a foreign ideology or by a desire for monetary gains must cease.

It is here in the age of McCarthyism, in the shadow of the USSR’s balance-altering A-bomb test in 1949, that the Rosenbergs stand in sharpest relief — not because of “guilt” or “innocence”, but as the ne plus ultra of that era’s range of social discipline.

A few years before, the United States and the Soviet Union had made common cause against Hitler in World War II, the United States pumping war materiel to Russians bearing the brunt of the fighting.

No longer operative.

The Communist Party USA enjoyed membership rolls pushing six figures; other socialist parties and movements had found niches in American life in the interwar years.

As the Great War gave way to the Cold War, the great powers remained nominal allies (that’s the reason the Rosenbergs weren’t tried for treason), but shifted rapidly into conflict. The American polity organized to expel the red menace by rendering it foreign and criminal — ideological rigging for the forty years’ imperial contest ahead. Loyalty oaths, blacklists, the House Un-American Activities Committee … in the whole of the self-conscious construction of communism as “contagion”, the power and willingness of the state to kill Julius and Ethel Rosenberg formed the tip of the spear, and an ugly contrast to that same state’s solicitous handling of Nazi scientists then developing the vehicles to deliver atomic technology to Moscow in mushroom cloud form.

Though different in many particulars, the thrust will be familiar to any sentient denizen of post-9/11 America: the extreme penalty enforces a wall between the suspect and abject (but tolerated) loyal liberal and the enemy left. Depend upon Ann Coulter for the most brutal articulation:

We need to execute people like John Walker [the American-born soldier captured fighting for the Taliban in 2001] in order to physically intimidate liberals, by making them realize that they can be killed, too. Otherwise, they will turn out to be outright traitors.

Like most symbols, the Rosenbergs came by their exaltation by accident; at the strictly personal level, their deaths are nearly operatic performances of human stubbornness and bureaucratic inertia. Investigators rolling up a spy ring** were looking for confessions and names to keep the indictments coming.

Julius refused to provide either, so his wife was arrested for leverage against him on the reasoning that he would confess to protect her. The gambit failed: both prisoner and hostage remained obstinate. The government’s bluff had been called, and it ruthlessly executed its threat.

Had the two really been responsible for starting a war, execution would hardly begin to cover the bill — yet to the very foot of the chair, the condemned, and Julius especially for the sake of his wife, were pressed with offers of mercy for confessing and “naming names”.

An Execution in the Family

Given names to name, the personal mystery of their silence — the ultimate heroism or folly or tragedy or transcendence — only deepens the resonance of their fate both for contemporaries and posterity, the poignance of their orphaned children’s subsequent path, the contrast with Ethel’s brother David Greenglass who has since admitted to perjuring testimony against Ethel in order to shield his own wife. (Greenglass says the Rosenbergs died from the “stupidity” of not copping a deal of their own.)

Even before Julius and Ethel went to the chair this date,† they had become the emblem of a paranoid age. In the days following, Sartre savaged the United States for trying “to stop scientific progress by a human sacrifice”:

Your country is sick with fear. You’re afraid of everything: the Russians, the Chinese, the Europeans. You’re afraid of each other. You’re afraid of the shadow of your own bomb.

Decades later, the shadows haven’t faded altogether. In playwright Tony Kushner’s imagination, the spirit of Ethel stalks her real-life prosecutor, closeted McCarthy henchman Roy Cohn, as he succumbs to AIDS in the 1980’s.‡

* There is one partial exception in the unusual case of six German saboteurs electrocuted in Washington, D.C., during World War II on a charge sheet that included espionage. The hearing was held by a military commission and only one of the six was an American citizen, so it was far from the regular judicial process — if one can call it that — the Rosenbergs faced.

** Originating in the investigation of Klaus Fuchs, the man who actually did what Julius and Ethel Rosenberg were accused of doing — passing atomic secrets to Moscow — although with debatable ultimate effect for the Soviets’ research. Fuchs served nine-plus years in a British prison and was released to East Germany; more than a few were galled at the difference between his sentence and the Rosenbergs’.

Stateside, George Koval was another spy far more valuable to Moscow in the nuclear race than were the Rosenbergs. Koval got away clean and died in Moscow in 2006.

† Julius first, then Ethel. Her execution was botched; repeated shocks were required to kill her.

‡ Cohn’s posthumous autobiography did acknowledge illegally rigging the Rosenberg trial, as his Kushner character does.
