1824: John Smith

On this date in 1824, John Smith, 25, was publicly hanged before an angry crowd at Lincoln Castle for the murder of his fiancee, 24-year-old Sarah Arrowsmith.

John and Sarah had been seeing each other for a long time. Sarah had a three-year-old son by him, and was heavily pregnant with another child. She was under the impression that the wedding banns had been published and they would marry soon, but matrimony was the furthest thing from John’s mind.

On December 4, 1823, he bought a pound of white arsenic from the chemist for nine pence, saying he was going to use it for washing sheep. Instead, Smith mixed the arsenic with some flour and gave it to Sarah. She, in turn, baked some cakes with the poisoned flour and served them to her friends for tea.

Neil R. Storey records what happened in his book A Grim Almanac of Lincolnshire:

In less than a quarter of an hour, Sarah, her sister-in-law Eliza Smith, her friend and neighbour Mrs. Dobbs, and three children—two of them her younger sisters, and one of them Smith’s illegitimate child with Sarah—all suffered intense burning in their throats and excruciating pains in their stomachs. Several medical men were sent for and, immediately on arrival, the surgeons, Mr. Tyson West and Mr. Pell, set about administering antidotes and emetics. They rapidly had to admit that Sarah Arrowsmith was in a hopeless condition and sent for magistrates to take her deposition from her death bed. Sarah told them who had given her the flour and soon two constables were sent to the cottage where Smith lived in Little Steeping; they arrested him.

Although Smith presented two character witnesses at his trial who described him as a good farmhand and a sober, even-tempered and hard-working man, the evidence against him was strong and public sentiment equally so. The London Morning Chronicle reported on Dec. 27, 1823, that as Sarah Arrowsmith lay painfully expiring so heavy was the crush of gawkers that her bedroom’s only supporting cross-joint “snapped in the middle, and had not every person except the sufferer, who was in bed, made a hasty retreat, the floor would have fallen in.”

She succumbed the next day (to the poison, not to a fall) and “a great concourse of persons was assembled from all parts of the country round” to lay her to rest — “and the only feelings displayed upon the solemn occasion, were those of indignation against the unhappy wretch who was the author of the untimely death of the poor woman and her child.”

Smith could surely tell that his goose was cooked, and even as his life hung in the balance there was “an extraordinary apathy about him.” (Storey) Prior to his death he admitted his guilt.

It is believed that the other poisoning victims survived.

1821: Elizabeth Warriner, Lincoln poisoner

For this just-in-time-for-Halloween wicked stepmother, we are indebted to the highly browsable The Word On The Street, a collection of highlight broadsides held by the National Library of Scotland.

The Last Dying Words, Speech, & Confession of Elizabeth Warriner. Who was Convicted at the last Lincoln Assizes, for the Horrid Murder of her Step-Son, J. Warriner, by poison, and who was Executed at the City of Linclon [sic], on Saturday the 27th of Oct. 1821.

ELIZABETH WARRINER was indicted for the Murder of J. Warriner, her Step-Son, at Surfleet, by administering poison to him. The prisoner was the second wife of a Farmer. The deceased was his Son by a former marriage, about 12 years of age. From the period of her marriage, the prisoner treated the child with great cruelty. On various occasions she was heard to say she would be the death of him. At length on the morning stated in the indictment, the boy, immediately after breakfast, which consisted of bread and milk, was taken ill. Medical aid was called in, but he breathed his last in the course of the day. After she had poisoned the unfortunate boy, she dragged him out of the house, and put him in the stable, and hanged him up, with a rope round his neck, to make people believe he had hung himself, as there was no marks of violence round the neck. The body was opened by a surgeon, when the stomach and intestines were found to exhibit all the appearance of arsenic having been administered. It was afterwards ascertained that a quantity of arsenic was in the possession of the father, who used it for some husbandry purpose, [and to] which the prisoner had access. It further turned out, that a small quantity was found [in t]he basin from which he had eaten his breakfast: and that the prisoner had given him his breakfast in that basin. This circumstance, added to a variety of others, which in the [cou]rse of the examination of the witnesses, seven in numher, came out, led to to the conclu[sion], that the prisoner administered the poison.

Mr. Justice Holroyd summed up tne evidence, and the Jury found her gulity, The [judge] in passing sentence, obserted to the prisoner, that the crime of murder in all cases [was] an heinous one, and in all countries was punished with death; but there were gradations e[ven] in this crime, and her’s [sic] was of the worst nature. She had destroyed her Step-Son; and no other motive could be assigned than that arising from a cruel, hardened, and vicious disposition — her crime was that of muder, the most heinous and cruel. — He hoped she would sincerely repent of her crime, and take all possible care of her soul during the few hours she had to live, so to be reconciled to her offended Maker; he feared she was not so convinced of the necessity of this as she ought to be, but trusted she would seek for that advice which would satisfy her of that necessity, and enable her to meet her future Judge, with a well-rounded hope in his mercy from the sincerity of her contrition; all that remained for him to do was to pass sentence upon her which the law required, which was, that she should be taken from whence she came, and on Saturday the 27th October, 1821, to be taken from thence, to the place of execution, there to be hanged by the neck till she was dead, and that her body should be delivered to the surgeons for dissection — concluding with — “and may the Lord have mercy on your soul.”

The moment she heard that her life was to be forfeited for the barbarous murder, and her cruel treatment to her Step-Son, she jumped up from the floor in the greatest agony, wringing her hands, and other symptoms of distraction.

About ten o’clock on Saturday morning, she ascended the fatal scaffold with a greater degree of fortitude and resignation than could have been expected; and addressed the numerous spectators around her in nearly the following words: “Good people, you see now before you an unfortunate woman, cut off just in the prime of life, and for the most dreadful of al [sic] crimes, Murder! let my dreadful fate be a warning to you not to suffer your passion to work forcibly on your minds, which has been the cause of the melancholy situation in which I am now placed; let me beg your prayers — good people pray for me; O pray for me.”

On the morning of her awful execution, she was dressed all in white, with a child suckling at her breast, which was taken from her by the executioner and her melancholy cries was heard at a great distance. It was shocking to the surrounding multitude.

She then dropped a handkerchief she held in her hand, as a signal, crying, O my Child! my Child! and was immediately launched into a dreadful eternity.

1834: Eliza Joyce, confessed poisoner

On this date in 1844, Eliza Joyce was hanged on the roof of Cobb Hall at Lincoln Castle for the murders by poison of her two daughters and her stepson.

She was the fifth and last woman to be publicly hanged at the castle during the 19th century, and she remains the last woman in England to be hanged for a crime she’s pleaded guilty to.

Eliza had married William Joyce, a gardener, in 1840. He had two children by his prior marriage, Emma and William Jr., and he and Eliza went on to have a daughter together, Ann.

However, Emma died suddenly in October 1841 and William took sick the following year. In September 1842 he was visited by a doctor, who prescribed medicine for him. Eliza went to the chemist’s … where she picked not that medication, but arsenic.

Her husband found out and took the poison back to the chemist’s, where they realized some of it was missing. By then William Jr.’s condition had worsened considerably and he was showing symptoms of arsenic poisoning. Before his death at Christmastime he gave a statement, confirming his stepmother had given him the arsenic. He was fifteen years old.

Early in 1843, Eliza’s baby daughter Ann also died. Eliza was charged with William Jr.’s murder, but the indictment was thrown out on a technicality. She was then re-charged with attempted murder, which at the time carried the same penalty: death. But at her trial she claimed William Jr.’s poisoning was accidental: she’d spilled some of the arsenic powder on the floor, she said, and picked it up with a spoon, and later without washing it she used the same spoon to give William his medication.

The jury bought the story and Eliza was freed in the summer of 1843.

However, in light of what had happened, her husband cast her out and she had to move into the workhouse.

Eventually, her conscience began to trouble her and she confessed she’d been guilty all along of William Jr.’s murder, and that she had also poisoned both Emma and Ann with laudanum.

When asked why she’d done such terrible things, she plaintively replied, “I don’t know, except I thought it was such a troublesome thing to bring a family of children into this troublesome world.”

By now fully resigned to her punishment, she offered no defense to the court and pleaded guilty to both girls’ murders. (She couldn’t be charged with her stepson’s murder a second time.) William Calcraft handled her execution, and (for once) he didn’t botch it; she died quickly and quietly.

The prisoner walked with tolerable firmness, being only occasionally supported; and once, when about midway on the platform, she paused for a second, and turned to take a parting glance at the sunny scenery by which she was surrounded, and, as if to bed a lingering farewell to the bright and glorious world which she had sacrificed: her face and features wore an aspect of ghastly agony which none can forget who gazed upon her. Having ascended to the top of the tower on which the scaffold was erected, her bonnet was removed, her arms pinioned, and the cap placed over her face. She then ascended the step of the gallows. The effect of her appearance on the immense crowd was awfully striking. In an instant, the hootings, bellowings, and imprecations, which ever distinguish such enormous assemblages, were hushed, and a profound stillness reigned throughout the living mass.

1875: William Wilson, taking the priest with him

From The Fabulous Frontier, 1846-1912. (The entire text below is a single large paragraph in that book, so line breaks have been added for readability.)

On August 2, 1875, Robert Casey was shot and killed by William Wilson in Lincoln with a bullet fired from a Winchester rifle. Wilson was tried, convicted by a jury and sentenced to be hanged.

On December 10, 1875, the appointed day, a large crowd gathered in the Lincoln* jail yard to witness the hanging. Ash Upson** was present as a representative of the press, but left shortly after the trap was sprung, probably to get a drink.

After being suspended by a rope for nine and one-half minutes by the Sheriff’s watch, Wilson’s body was taken down from the scaffold and placed in the coffin.

Spectators nudged the Sheriff and told him that Wilson was not yet dead.

Red-faced and embarrassed the Sheriff and several helpers lifted William Wilson from his wooden coffin, escorted him once more to the scaffold. The rope was again tied around the condemned man’s neck and he was suspended for an additional twenty minutes, at the end of which time there was not much doubt that the demands of the law had been satisfied.

Father Antonio Lamy, twenty-eight years old, a native of France, a nephew of Archbishop John B. Lamy of Santa Fe, had been a reluctant witness to the hanging … Padre Lamy had been in Lincoln on a missionary tour. He called at the jail to offer spiritual consolation to William Wilson, soon to be hanged. Wilson prepared himself for death under Father Lamy’s direction and accepted his offer of company to the scaffold.

The hanging and rehanging of Wilson proved too much for the frail young man of God.

Rather desperately ill, suffering from chills and high temperature, the Padre insisted on returning on horseback to Manzano a few days after William Wilson had been hanged. Arriving in Manzano, Father Lamy’s condition rapidly became worse. He died there on February 6, 1876.

The remains of the priest were buried under the floor of the parish church at Manzano. The story of Padre Lamy’s death has for many years been kept alive in the Manzano community. His grave in the church has long been a silent sermon in opposition to the brutality of capital punishment.

* Lincoln was a little hit and miss with its necktie parties: it’s also the town where Billy the Kid escaped a hanging.

1872: William Frederick Horry, Marwood’s first

Victorian riddle/pun

On this date in 1872, the landmark hanging career of William Marwood commenced — when, having persuaded the authorities at Lincoln Castle Gaol, he executed his very first subject.

The man of the milestone was William Frederick Horry, a Boston native — not Boston, Massachusetts, but the Lincolnshire port that was its namesake.

“Fred” wed Jane and the two ran The George Hotel in Burslem together.

Until Fred’s drunken, possessive outbursts led Jane to flee the house. Let it be said that a partnership in the hospitality industry might not be the ideal choice for your controlling type.

Jane and the couple’s three children actually took refuge with Fred’s own kin, the husband’s father barring his own son from the home. Horry got around that by showing up with a revolver and shooting her dead in an act of coldly calculated passion: he immediately handed the gun to his stunned brother and stayed to await arrest, saying, “You have no notion, Tom, how I loved that woman, but I could not stand the jealousy.” Nor did he show any interest in appealing for clemency; he hanged within days of his conviction.

If this reads to modern eyes like the unedifying passion play of an abusive, loutish spouse, many in Burslem were ready to consider Fred Horry “a martyr, more sinned against than sinning.” (The funeral oration of a rector!) Three thousand people lined the streets to respectfully see Horry’s coffin to its rest; even the requisite crime broadsheet concurred in the apparent public judgment about Jane’s culpably easy virtue.

Now all you who give way to jealous passion,
And the crimes which it entails,
I hope that you will learn a lesson,
From my sad and mournful tale.
Their married life has ended early,
For his wife he says his temper tried
But for them now it is all ended,
For her faults she bled and died.

Supporters erected a monolith in his honor, an unusual tribute for a wife-murderer.


The man tasked to mete out the lesson for Horry’s jealous passion was, heretofore, a Horncastle cobbler.

Already into his fifties by this time, William Marwood was strictly self-educated in the science of hanging … but it is he who would bring the exacting mechanical arts to the hangman’s ancient craft.

(Actually, Marwood was fond of distinguishing himself from the mere hangman. “Calcraft hanged them,” he said of his notoriously slipshod predecessor’s operations. “I execute them.” He went so far as to assert his professionalism with business cards.)

To make this famous mark in the annals of capital punishment, Marwood the cobbler first had to talk his way into the Horry job. This was surely facilitated by the fact that the most recent execution at Lincoln Castle, that of Priscilla Biggadike or Biggadyke, had been a bit of a botch, with one of the realm’s forgettable barely-competent hangmen clumsily fitting the noose to the front of the convict’s throat on the supposition that this would snap her neck. Instead, she strangled.

Marwood’s arrival spelled the quick end to folklore and guesswork on the scaffold; his was the rational hand of industrial Britain finally touching the ancient hanging ritual.

For most of English history, the hanging had entailed simply shoving the unfortunate subject off a ladder or a cart, leaving them to gradually choke to death at the end of the noose. This protracted process was sometimes associated with unruly public scenes, and with “executed” criminals surviving (and even intentionally calculating to survive) the hanging. “Such as have but a very superficial Notion of Anotomy, may easily conceive how a Person very soon cut down may shew even strong Signs of Life,” the Ordinary of Newgate had passingly remarked in 1736, as if it really were no big deal.

Of course, it had long been understood that adding a little plummet could generate the force necessary to break the neck, to the advantage of both speed and certainty. Guy Fawkes is supposed to have exploited the carelessness of a Stuart executioner to hurl himself off the ladder when they were just setting up for the non-fatal hanging portion of his “hanged, drawn, and quartered” sentence — and thereby cleverly offed himself before they could do the agonizing Braveheart bits to his living body.

Small drops came into use with the move towards hanging platforms late in the 18th century, and by the mid-19th century larger drops of some kind were standard operating procedure: witness the description of the setup for the country’s first private hanging a few years before our date.

But the length and the nature of the drop remained very much within individual hangmen’s ad hoc discretion. The science of dropping would only arrive in the 1860s and 1870s. Until then, execution bulletins reporting that the unhappy soul “died hard” denoted the frequent occasions when death was effected via agonizing minutes of choking spasms. Even in the London Times‘ Dec. 22, 1875 report on one such man who “died hard” noted that “in the memory of Mr. John Rowland Gibson, the prison surgeon, extending, in that capacity, over more than 40 years, there are only two instances on record in Newgate of the neck of a convict having been dislocated during execution.”

Aiming to remedy that substandard record, the Irish doctor Samuel Haughton in 1866 published a landmark paper, “On hanging considered from a Mechanical and Physiological point of view” (read it here), in which he noted that whereas a short-dropped prisoner’s death by apoplexy or asphyxiation is “preceded by convulsions, lasting from five to forty-five minutes,” a broken neck “is instantaneous and painless, and is unaccompanied by any convulsive movement whatever.”

“It seems to me unworthy of the present state of science,” Haughton continued, “to continue a mode of execution which, as at present used, is extremely clumsy and also painful to the criminal.”

In a mass of equations abstractly working out foot-pounds’ shock expended on the neck and which vertebrae constituted the superior articulating surface, Haughton proceeded to suggest a protocol (adapted from the American drop method) “to give hanging all the rapidity of death by the guillotine without the painful spectacle of bloodshed.”

Haughton was just a theorist. Marwood actually put those concepts into practice.

Marwood is presumed to have been influenced by Haughton’s studies; although the basis for that renowned hangmanexecutioner‘s calculations is not known, Marwood is distinguished as the creator of the “long drop” hanging method — giving variable 4- to 10-foot falls to his subjects based on their body weight, with the knot stationed under the left jawline.

He was able to do all that because this first hanging of William Horry went off without a hitch. Still, as a nonentity at first, Marwood had to continue to hustle his hanging assignments — as with this solicitous handwritten 1873 pitch (page 1, page 2) to work an upcoming death date.

But Marwood’s clean long drops — he was the only executioner using the technique — soon secured him appointment as state executioner and the official London and Middlesex hangman. Over an 11-year career from 1872 to 1883, Marwood put 178 humans to death, the bulk of British executions during that period.

Marwood’s legacy — not his direct creation, since it was formalized in the years following his death — was the bureaucratic standardization of the hanging in the form of “drop tables” defining the length of rope to use relative to the weight of the executed prisoner to guarantee the death penalty would be implemented “in a becoming manner without risk of failure or miscarriage in any respect.”

1961: Wasyl Gnypiuk, sleep-killer

On this day in 1961, a Polish/Ukrainian immigrant with the unpronounceable name of Wasyl Gnypiuk was hanged for murder in Lincoln, England.

The 34-year-old Gnypiuk was living in a toolshed in Worksop when he murdered his 62-year-old landlady, Louise Surgey, on July 17, 1960. He had spent some time in Nazi concentration camps during World War II, and suffered terrible nightmares as the result of his ordeal. The night of the murder, he broke into Surgey’s house while she was sleeping, drank some of her liquor, and passed out.

Gnypiuk — so he later claimed — had a dream where he was fighting Nazis. When he woke up, Surgey lay dead at his feet: he had strangled her in his sleep.

The authorities treated his claims with understandable skepticism. He didn’t help his case by trying to hide the body and stealing some money that had been lying around the house. He had a two-day trial in November and was duly convicted and sentenced to death. Gnypiuk was the last person to be hanged in Lincolnshire before the UK abolished the death penalty in 1965.

The truth about what happened will never be known for sure, but Gnypiuk is still regularly listed among cases of homicidal sleepwalking.

1881: Not Billy the Kid

“You will be hanged by the neck, Billy, until you are dead, dead, dead!”

“You can go, Judge, to hell, hell, hell!”

We have no source for whether William Bonney’s reply to the judge who sentenced him to hang was vindicated by the Almighty. But the judge’s sentence, due to be executed this day, assuredly never came to pass: two weeks before, Billy the Kid effected the last of his famous escapes.

The exploits of this legendary gunfighter — and his legend rather exceeds his exploits — are exhaustively chronicled online. The Manhattan-born Kid, a pup of 21 at his death, was a gunfighter in the Lincoln County War, a fight between two frontier magnates. Billy counted himself among the Regulators, a deputized posse (so it claimed, by way of legality) that was the armed militia of a murdered rancher.

Billy’s winning way with the press after his capture helped endear him to popular imagination, even after he was condemned in Mesilla, New Mexico for ambushing a lawman.

Here’s how Emilio Estevez played the crime in Young Guns:

On April 28, in a building that still stands in Lincoln, New Mexico, Bonney got the drop on one of his guards and high-tailed it out of town.

Though spared the ignominy of the gallows, Billy the Kid would not long outlive his judicially appointed hour. Lincoln County sheriff Pat Garrett found and killed the fugitive a few months later.

Ironically, this transaction darkened the reputation of the successful officer of the law — the circumstances of the killing were ambiguous, and seem less than honorable to some — while helping valorize the young outlaw who by all rights should long since have been at the end of a rope. And for this, maybe Billy’s shade has stood Garrett’s a drink or two, because a shadowy and youthful disappearance from the scene helped catapult Billy into folklore that has long outlasted the forgotten Lincoln County War.

Billy the Kid — even the name evokes the American self-image with perfect pitch — has come to so fully embody the floating signifiers of the Wild West, of America in its adolescence, that around the same time Bob Dylan composed “Knockin’ on Heaven’s Door” for the clip above (the 1973 film Pat Garrett and Billy the Kid), Billy Joel took the gunslinger for an all-purpose western motif in “The Ballad of Billy the Kid”. Joel’s song’s describes a life that seems to be just what the listener thinks it ought to be while remaining factually untrue of its titular character in almost every particular, including, in his version, a picturesque death by hanging:

Skip music and cinema a generation ahead and we have Guns n’ Roses covering “Knockin’ on Heaven’s Door” and power balladeer par excellence Jon Bon Jovi climbing the charts with this signature hit from the Young Guns II soundtrack:
