1979: Two former dictators of Ghana with four of their aides

On this date in 1979, the putschist government of Ghana shot former military rulers Frederick William Kwasi Akuffo and Akwasi Amankwaa Afrifa along with four others at the Teshie Military Range for corruption.

Twenty-two years before, Ghana had become the first black sub-Saharan former colony to gain independence, but after a 1966 coup it had staggered through political and economic chaos. Six different men had been head of state in that span, three of them deposed by coups. By 1979, General Fred Akuffo‘s government was the target of explosive anger.

Enter Flight Lieutenant Jerry Rawlings, who had actually failed in a coup attempt in May and was in line for execution himself before his mates toppled the government on June 4.

Seeking to stabilize the situation — and, Rawlings himself has said, riding the tiger of popular fury — the new government served up a few high-profile morsels on charges of pilfering the treasury in order to forestall a general slaughter of senior officers by the armed forces’ lower ranks.

There was no alternative. We had to contain it within the military so it didn’t spill into the civil front — if it had it would have been terrible.

We had no choice but to sacrifice the most senior ones — the commanders.

Another former head of state, Gen. Ignatius Kutu Acheamphong, had been shot earlier in the month; on this date, Akuffo and Gen. Akwasi Afrifa, one of the original 1966 plotters who had ruled Ghana in 1969-70, followed him. Afrifa, ironically, had written to Acheamphong worrying that political upheaval and military discipline could find them … well, where it eventually found them:

I feel greatly disturbed about the future after the government … In order to discourage the military from staging coups in the future, how about if they line all of us up and shot us one by one? I do not certainly want to be arrested, given some sort of trial and shot.

All these shootings had an unseemly character of haste and summary justice; charges against the four senior ministers* shot along with the former rulers have struck an especially sour note. Rawlings has claimed that he only wanted the two former heads of state shot and tried unsuccessfully to stop the other four executions.

I attempted to prevent it and sent an officer but the firing squad shot the officers before their commander could give the order … you must understand our country was in a state of rage then, not different from what Russia was when it had its revolution.

I was a partial hostage to that situation. I had no force. The authority that I enjoyed was my moral authority with the people. Their action (the execution of the senior officers by the boys) was to curtail the anger of the nation.

Rawlings would hand power over to a civilian government, which he then overthrew again in 1981 — looking like this:

He would run Ghana for the next two decades, the last eight years after winning elections. Rawlings’ legacy is much up for debate, but to many he cuts the figure of a benevolent dictator (how many former strongmen have fan pages?) whose human rights abuses were mild in the scheme of things and helped usher in a relatively prosperous and democratic Ghana that stands a very far cry from the country he took over in 1979.

Rawlings himself has graduated to a sort of global elder statesman — for instance, he recently called for fair elections in Zimbabwe. And he has not been hesitant to justify his political actions, as in this interesting BBC interview from 2005 — in which, pressed on the executions of the former state ministers, he concedes:

There were some of them who probably deserved it. Pardon me for putting it that way. There were some of them who did not — very brilliant, beautiful officers. But we had no choice but to make that sacrifice.

The bodies of all the officers executed in June of 1979 were exhumed for “fitting burial” under Rawlings’ successor in 2001.

* One of the aides held the Ghanaian high jump record at the time of his death, a mark not surpassed until 1996.

1711: Ifranj Ahmad, Janissary

On this date in 1711, a Janissary captain in Ottoman Egypt was beheaded in Cairo as the “Great Insurrection” gave way to the last gasp of Mamluk power in Egypt.

Mamluks (or Mameluks) — enslaved soldiers who had evolved into a military caste — had ruled Egypt from 1250 until absorbed by the Ottoman Empire in 1517. Now nominally under the power of the sultan, Mamluks remained as beys (district governors) and were drawn into a labyrinthine political environment that boiled down to a contest for rent collection from the lucrative country.

The relative power in Egypt of the Ottoman viceroy (wali) vis-a-vis Mamluk beys in shifting alliances waxed and waned through the 17th century, but the position of wali was always fundamentally undermined by his short-term appointment and the presence of imperial troops who did not answer to him and therefore became independent players Cairo. The most prominent of these were the Janissaries — elite troops whose original servile composition somewhat mirrored the Mamluks’ own and who had established themselves as the wealthiest (and most arrogant, and most resented) regiment by making profitable commercial partnership with the Cairo artisans.

As we lay our scene in the early 18th century, the Ottoman walis have been thoroughly eclipsed; politically, Mamluk Egypt is independent in all but name. The Mamluks are themselves grouped into two great factions, the Qasimi and the Faqari.*

Each faction was composed of the personal mamluks of the leader, retainers who attached themselves to the leader, bedouin tribes, men of the garrison regiments [that is, the Janissaries and other Ottoman military corps], and private armies composed of free-born Ottoman mercenaries. An accelerating cycle of revolts and disturbances culminated in the “Great Insurrection,” (or “Great Sedition”) several years of friction climaxing in three months of armed conflict in early 1711 — “to all intents and purposes, a civil war among the elite” over dividing up spoils, as Afaf Lutfi Sayyid-Marsot puts it.

Ifranj (or Ifrandj, or Afranj) Ahmad — “Ahmad the European,” a distinctive name since the Janissaries were mostly locally born by this point — was a lower officer, but a predecessor in his position had mounted a temporarily successful revolt against the Janissary brass in the 1690’s, and Ahmad (as events would prove) commanded the loyalty of his regiment. A dispute over an attempt to remove him helped precipitate the open fighting in 1711.

Ifranj Ahmad was just an excuse … The main reason was the resentment of the other regiments, primarily the ‘Azab [“armourers” — (distantly) second only to the Janissaries among the military corps], at the privileged position and the profits the Janissaries were enjoying. … Siding with Ifranj Ahmad were the majority of the Janissaries, the pasha [the wali], … the Faqari governor of Upper Egypt who brought with him reinforcements of … bedouins, some elements of the other regiments, and most of the Faqari beys and their Mamluk households. On the other side were almost all the ‘Azab and the other regiments, 600 Janissary defectors, the Qasimiyya beys, and Qaytas Bey, a Faqari grandee who had quarrelled with … the Faqari leader, and had joined the Qasimiyya. In short, the Faqari and Qasimi factions, backed respectively by the Janissaries and the ‘Azab.

As one can readily infer from Ifranj Ahmad’s presence in these pages, the Qasimi had the better of the fight; Ahmad was nabbed trying to flee and summarily beheaded, a fate shared with several other Faqari leaders.** Here’s the account from Al-Damurdashi, an ‘Azab officer at the time:

Afranj Ahmad and his colleague had fled through the Mahjar Gate, but as they passed by the guard post … [and] captured and were [being dragged] to the ‘Azab barracks, but one of the [captors] brought [Ahmad] to the ground with a blow on his jugular vein. He then cut off his head, took it to the ‘Azab barracks and received a reward from the senior officers.

Although Istanbul would continue trying to exert its influence, this day’s denouement marked the end of real Ottoman authority on the Nile — the Turks had their hands full fighting the Russians at this moment, anyway — and inaugurated a long sunset of Mamluk power until Napoleon’s quixotic Egyptian adventure overturned it for good.

* There are many different transliterations of both these names — Faqari, Faqariya, Faqariyya … Qasimi, Qasimiya, Qasimiyya

** It was so far from an extermination, however, that the Faqari turned the tables on the Qasimi twenty years later, and the Qasimi thereupon faded from influence.

1864: William Johnson, a bad example

On this date in 1864, the Union army in the American Civil War hanged a black deserter outside Petersburg, Va., for — in the delicate words of the army dispatch — “an attempt to outrage the person of a young lady at the New-Kent Court-house.”

The Union army was just taking up position for the coming monthslong siege of the Confederate capital, Richmond. Johnson, who confessed to deserting another unit, offered savvy blue commanders a win-hearts-and-minds opportunity: a public reassurance that the Old Dominion’s dim view of Negro outrages upon young ladies would be honored by its soon-to-be occupiers.

Not bad in theory. The execution left something to be desired.

The field of public relations being very much in its infancy, the upshot of this salutary demonstration seems not to have been conveyed to its target audience; so, when a defending Confederate battery caught sight of the gallows being thrown up in brazen view of its own lines, it jumped to the not-unreasonable conclusion that the Yanks were about to make an example of a southern spy. Rebel guns promptly made the Union detachment their “target audience.” An artillery shot struck one Sgt. Maj. G. F. Polley (or Polly) and “tore him all to pieces” before

[a] flag of truce was sent out to inform the enemy that a negro was to be hung who had insulted a white woman the day before; they stopped firing. We then marched back and saw the negro hung.

The return on investment for the souls of Johnson and the misfortunate NCO was altogether unsatisfactory:

The incident was cleverly turned to advantage by the Confederates, who had been losing hundreds of Negro laborers by desertion. The Rebels marched Negroes past the spot, pointing out to them the perils of fleeing their lines, saying that the Yankees hanged all ‘Contrabands.’ For weeks nocturnal escapes of Negroes ceased on that front. It wasn’t a total loss, however. The Library of Congress ended up with some striking archival photos.

1536: Anne Boleyn

On this date in 1536, Anne Boleyn lost her head.

Any queen decapitated by her king would of course rate an entry in these grim pages. But this does not quite explain Anne Boleyn‘s enduring appeal, relevance and recognizability for the most casual of modern observers, and her concomitant footprint in popular culture, even with the “Greek tragedy” quality of her life.

Anne stands at the fulcrum of England’s epochal leap into modernity. Whether she was that fulcrum might depend on the reader’s sympathy for the Great Man theory of history, but little more do we injure our headless queen to regard her as the woman for her time and place — the accidental hero (or villain) raised up and thrown down by the tectonic forces of her milieu.

Through Anne was born — for reasons of momentary political arrangements of long-forgotten dynasts, which seems a shockingly parochial proximate cause — the English Reformation, and through the Reformation was born the crown’s decisive triumph over the nobility, the broad middle class nurtured on the spoils of Catholic monasteries, the rising Britannia fit to rule. Most would take as an epitaph historical accidents of such magnitude.

Of course, by those same accidents, Anne was the instrument of thousands of deaths herself, and little did she appear troubled in life by the corpses upon which she ascended the throne.

Her own family maps the change wrought on England. An ancestor was beheaded in the Wars of the Roses, medieval England’s last great breakdown; her uncle Thomas Howard was one of the throwback scheming Dukes, mastered by his sovereign to the extent of issuing Anne’s capital sentence from his own lips;* the beheaded woman’s daughter, Queen Elizabeth I, set a recognizably centralized English state on the path of empire.

Fitting tribute that, from the Tower where she met her end** to lands undreamt-of in her time, people still, like Henry, find her captivating.

* Anne’s father also declared for her guilt. Unprincipled as these men undoubtedly were, it cannot have been a pleasant responsibility; the question of whether she was actually guilty of adultery-cum-treason, the fatal charge extracted from a supposed lover by torture, has been hotly and inconclusively disputed by posterity.

** With a solemn speech submissive to Henry but not admitting any guilt — in an earlier moment of levity, she had famously remarked of the French swordsman hired to do the job, “I heard say the executioner was very good, and I have a little neck.”

1794: Lucile Duplessis and Marie Hebert, friends at the end

On this date in 1794, two women whose husbands had been deadly enemies in the French Revolution followed them to the guillotine.

The radical Jacques Hebert had been beheaded on March 24; Camille Desmoulins, the acerbic Dantonist journalist who had often savaged Hebert, followed him on April 5. Between the two, Robespierre had destroyed the principle remaining factions to his left and his right, respectively.

In Desmoulins’ last days, a supposed plot involving his wife formed part of the charge against him, and he became frantic that a bride he loved tenderly (he died clutching a lock of her hair) would follow him to the scaffold. It was barely a week later that it came to pass, when Lucile shared a tumbril with an unlikely friend: the widow of Hebert.

Their fate was nothing to the Revolution, but it remains an affecting personal portrait amid the tempest of factional massacres. Here is their end, sketched by the (markedly anti-Revolutionary) Paris in the Terror:

As Camille Desmoulins had foreseen, his wife soon followed his footsteps to the guillotine … Lucile was arrested immediately after Camille’s execution. It suited the Committee [of Public Safety] to support St. Just’s story of a “dangerous conspiracy in the prisons.” Along with having been seen in the vicinity of the Luxembourg (carrying the baby Horace in her arms in the hope that Camille might catch a glimpse of him),* Lucile had gone to Robespierre’s house and tried to gain admittance in order to plead with the Incorruptible on her husband’s behalf. No man was less accessible to the pleas of wailing women than Robespierre, and his door remained adamantly closed. Such manifestations of despair conveniently lent themselves to St. Just’s contention that revolt was afoot, and Lucile was accordingly arrested.

(Robespierre, in fact, had been the chief witness at Camille’s wedding and was actually godfather of little Horace.)

Lucile was condemned to death on April 13, along with eighteen other victims. She accepted her sentence with serenity. “In a few hours I shall see my Camille again,” she declared to her judges. “I am therefore less to be pitied than you, for at your death, which will be infamous, you will be haunted by remorse for what you have done.” At the same trial, the widow of Hebert was also condemned. The two women whose husbands had so bitterly hated each other struck up a friendship in the last few days of their life. “You are lucky,” Mme. Hebert said to Lucile as they departed for the scaffold. “Nobody speaks ill of you. There is no shadow upon your character. You are leaving life by the grand staircase.”

Upon hearing the news of her daughter’s sentence [Lucile’s mother] sent a frantic letter to Robespierre. “It is not enough for you to have murdered your best friend [Camille],” she cried. “You must have his wife’s blood as well. Your monster Fouquier-Tinville has just ordered Lucile to be taken to the scaffold. In less than two hours’ time she will be dead. If you aren’t a human tiger, if Camille’s blood hasn’t driven you mad, if you are still able to remember the happy evenings you once spent before our fire fondling our Horace, spare an innocent victim. If not — then hurry and take us all, Horace, myself and my other daughter Adele. Hurry and tear us apart with your claws that still drip with Camille’s blood … hurry, hurry so that we can all sleep in the same grave!”

* This particular of strolling outside the prison in hopes of giving the doomed man a glimpse is echoed by Dickens in A Tale of Two Cities in the person of Charles Darnay‘s wife — Lucie:

“[T]here is an upper window in the prison, to which Charles can sometimes gain access at three in the afternoon. When he can get to it — which depends on many uncertainties and incidents — he might see you in the street, he thinks, if you stood in a certain place that I can show you.”

In all weathers, in the snow and frost of winter, in the bitter winds of spring, in the hot sunshine of summer, in the rains of autumn, and again in the snow and frost of winter, Lucie passed two hours of every day at this place; and every day on leaving it, she kissed the prison wall.

1979: Zulfikar Ali Bhutto, Prime Minister of Pakistan

In the small hours of the morning this date, the Pakistani military junta hanged former Prime Minister Zulfikar Ali Bhutto.

At the end of 1971, Bhutto, a former cabinet official who had broken with Pakistan’s military strongman, rode a wave of discontent into power as the economy crumbled, and East Pakistan broke away from Islamabad to form Bangladesh.

Born to a well-heeled Muslim family in British India, the charismatic and often arrogant Bhutto had feets in the streets and a way with both the domestic audience and the global one:

But he did not necessarily have a power bloc equal to the weight of the Pakistani military as he navigated the storm of controversial domestic challenges; in retrospect, it seems only a matter of time before his hold on power would slip.

In July 1977, Army Chief of Staff Muhammad Zia-ul-Haq, a fellow clan member whom Bhutto had promoted ahead of more senior officers, repaid his sponsor by overthrowing him in a virtually bloodless coup.

A protracted — and vengeful — legal drama with a pre-scripted ending unfolded over the ensuing two years, with Bhutto twice released and twice re-arrested, convicted of an earlier political murder on the testimony of “witnesses” who had obviously been tortured and coached, and his sentence upheld by a divided Supreme Court gamed to avoid the presence of a pro-Bhutto judge.

It was not out of character for this affair that the fallen Prime Minister was hanged secretly and before he expected, his (widely protested) death not announced until the following morning.

Bhutto makes a flawed saint, but his turn at power stands as an island of something like democracy in a sea of Cold War Pakistani dictatorships.

The Pakistan Peoples Party he founded still remains a principle organ of liberalism in Pakistan, and still honors its martyred leader. Reflective of both the vision and the personal autocracy of its progenitor, its leadership has passed dynastically through Bhutto family members, most famously daughter Benazir Bhutto, who succeeded Gen. Zia (he died in a suspicious plane crash) as Prime Minister — the first female elected head of state in the Islamic world.

Benazir Bhutto, of course, was assassinated this past December, just ahead of parliamentary elections that have just now produced a coalition government that will vie with Islamabad’s most recent military ruler for power.

325: Licinius, Constantine’s last obstacle

On an uncertain date in the spring of 325, the Roman Emperor Constantine the Great had his onetime co-emperor — and now prisoner — Licinius executed for a purportedly treasonable plot.

In the system of tetrarchy whereby the Roman world was divided in two, each half governed by an Augustus with a lieutenant Caesar, Constantine and Licinius had established themselves as masters of the west and the east, respectively.

History, which records Constantine as the vessel of Christianity’s political triumph, recommends religious faction as the cause of the strife between them: the two had jointly promulgated the Edict of Milan establishing religious toleration, but their realms had become poles of the two hostile religions — rising Christendom gathering under Constantine’s banner; the pagan world it would supplant dominant under Licinius. The latter is said to have reneged his toleration, though not necessarily to the extent of a full persecution.

Whether we can accept religious policy as a cause sufficient to throw the Roman world into civil war, or suspect more prosaic rivalries over land and power, the two were at one another’s throats before long. Conflicts, invariably won by Constantine, and truces stabilizing an increasingly one-sided balance of power, punctuated the fraying relationship during the decade before Licinius’ decisive defeat.

Upon his deposition, Licinius was allowed to live, courtesy of the offices of his wife, Constantine’s half-sister — legacy of bygone imperial marital politics — but his confinement in Thessalonica didn’t last long.

Fifth-century Greek historian Socrates Scholasticus describes the former emperor’s allegedly treasonable end:

Accordingly he having taken him alive, treated him with the utmost humanity, and would by no means put him to death, but ordered him to take up his abode and live in tranquillity at Thessalonica. He having, however, remained quiet a short time, managed afterwards to collect some barbarian mercenaries and made an effort to repair his late disaster by a fresh appeal to arms. The emperor being made acquainted with his proceedings, directed that he should be slain, which was carried into effect. Constantine thus became possessed of the sole dominion, and was accordingly proclaimed sovereign Autocrat.

Writing much later, Gibbon had a more skeptical interpretation of this convenient execution:

[Licinius’] confinement was soon terminated by death, and it is doubtful whether a tumult of the soldiers, or a decree of the senate, was suggested as the motive for his execution. According to the rules of tyranny, he was accused of forming a conspiracy, and of holding a treasonable correspondence with the barbarians; but as he was never convicted, either by his own conduct or by any legal evidence, we may perhaps be allowed, from his weakness, to presume his innocence. The memory of Licinius was branded with infamy, his statues were thrown down, and by a hasty edict, of such mischievous tendency that it was almost immediately corrected, all his laws, and all the judicial proceedings of his reign, were at once abolished. By this victory of Constantine, the Roman world was again united under the authority of one emperor, thirty-seven years after Diocletian had divided his power and provinces with his associate Maximian.

It was upon Licinius’ tomb that Constantine built that legacy so fundamental to the western world down to the present day. That same pregnant year of 325, he would summon the Council of Nicea, establishing Christian orthodoxy in a pact with temporal power; soon after, he built up Constantinople, to which he then relocated his court and transferred to the future Byzantine Empire such brio as still persisted in the listing hulk of Rome.

1803: Edward Marcus Despard, a patriot without a nation

On this date in 1803, during an era ruled by an Empire’s rough assertion of security against instability abroad, Britain hung its liberal-minded former governor of Belize — along with six others — for treason.

But there was much more to be said about Despard than his sentence. Today, Executed Today is pleased to feature Col. Edward Marcus Despard as remembered by his biographer, Mike Jay.

The day Colonel Edward Marcus Despard was executed was one of the most dramatic, and strangely forgotten, in British history. In this, as in much else, his death mirrored his life.

He was to be publicly hung, drawn and quartered for high treason, a punishment which had barely been carried out in London within living memory. Its most vivid associations were still with the Jacobite rebellions over fifty years before: the days when the British state’s greatest fear had been that a Catholic monarch might seize the throne. Those days were now long gone and, many thought, the old ceremony with them; Despard, as it turned out, would be the last person on whom the sentence would ever be passed. As specified by the Lord Chief Justice, the Colonel and his six confederates were ‘to be drawn on a hurdle to the place of execution, there to be hanged by the neck, but not until you are quite dead, then to be cut down and your bowels taken out and cast into the fire before your faces; your heads to be taken off and your bodies quartered’.

Intimations of the drama had already begun to transform the city the day before: Sunday 20 February 1803. At first light, carpenters had begun to assemble scaffold and gallows, large enough to accommodate the seven men, on the roof of Surrey County Jail in Horsemonger Lane, just south of the Thames in Southwark. The jail was a plain barracks-style building, recently constructed to replace the old prison which had been torn down in the Gordon Riots some twenty years before. The roof had been built flat for precisely this purpose, and this was the first occasion for its use. The main gates of the jail opened to admit seven plain wooden coffins.

According to contemporary witnesses, even as the preparations began, ‘vast multitudes of people immediately began to assemble’. It was noted that the throng consisted ‘chiefly of the lowest of the vulgar’, but that, unusually for a public execution, ‘a considerable number of persons of genteel appearance were observable’. The forces of law and order, too, were out in unprecedented force. Every single member of the Bow Street police patrol, the other London patrols at Queen Street, Marlborough Street and Hatton Gardens, and a ‘numerous tribe’ of petty constables from the outlying London boroughs, were placed on duty. The jail and its surrounds were emphatically staked out, surrounded by a cordon two officers deep. All ‘the public houses and other places of resort for the disaffected’ bristled with police. A detachment of mounted Horse-Guard cavalry clopped into Horsemonger Lane; all the infantry regiments in the city, at the Tower of London and Knightsbridge Barracks, were placed on the highest alert. The head keeper of the jail was issued with six sky rockets, each containing a pound of explosives, ‘to be let off as a signal to the military, in case of any disturbance’. London’s entire martial forces were instructed not to leave their posts until the danger was past.

The impending execution had dominated the news all week. The Times had led its news pages with testy dismissals of the rumours which were spreading around the city: that Despard and his confederates were being cruelly chained together, that they were being tortured for their confessions, that a last-minute reprieve was in the air. It was beginning to dawn on the authorities that the graphic medieval ritual they had scheduled might be counterproductive, inflammatory and unpredictably dangerous. The Police Magistrate of Southwark had expressed grave concerns, pointing out that the question which had been on the common people’s lips during the week was ‘When are these poor men to be murdered?’. It had been hard, apparently, even to find labourers prepared to erect the scaffold. When the warrant for the execution was issued on the morning of 20 February, it became clear that these anxieties had led to a change in the sentence. Exercising their statutory discretion, the magistrates announced: ‘we have thought fit to remit part of the sentence, viz. the taking out and burning their bowels before their faces, and dividing the body severally into four parts’. Despard would now be drawn –- to the place of execution on a carriage without wheels –- hung until dead, and then beheaded. The Observer commented with relief that ‘the cutting out of the heart of the malefactor, quartering &c is very humanely and properly to be dispensed with’.

On the day of the execution, 21 February 1803, the pace quickened long before dawn. ‘A vast number of police officers’ were soon massively outnumbered by the spectators streaming through the bitter cold and darkness. Southwark was a hard area to police at the best of times, a hinterland to the city of London proper dominated by the unedifying activities which were prohibited across the Thames. A warren of timber shacks among the marshy waste ground and garbage landfills, it had long been a teeming red light district; in recent times it had become dominated by malodorous and insanitary industries — distilleries, tanneries and vinegar mills — which were forced south of the river by City of London edicts. It also had a long history of insurrection. In 1381, Wat Tyler had led the Peasant’s Revolt through the same streets; in 1450, Jack Cade had set up camp here with his Kentish rebel army. Despard’s sentence of high treason had more powerful resonances with this period than it did with the freshly-minted nineteenth century. Most of the crowd had never seen a treason execution; now, jostling to witness one, they were passing shops selling roller-skates, umbrellas, toothbrushes, matches, alarm clocks, condoms, Twining’s Tea and Pears’ Soap. Part of the appeal of the spectacle must have been this lurid collision of the old and the new; part, also, the uncertainty on all sides as to whether the crowd had really assembled only to stand and watch. It was widely rumoured that the execution would not take place as scheduled — or, if it did, that the main event would turn out to be an entirely unscheduled one. The people of London had rioted countless times over much less — and, given the nature of Despard’s alleged crime, there were an unknown number among the crowd who might attempt to turn a riot into a full-scale revolution.

The character of execution crowds seems, as with most crowds, to have been largely in the eye of the beholder. For many, they were simply the scum of society: crude, vulgar, leering, gawping, sadistic. For others, though, they were the salt of the earth, good men and true come to witness and legitimise the exercise of state power. Despite the rough spectacle that they presented, they were often visibly civic-minded: rescuing stranded children, or crying ‘shame’ if one of their number insulted a woman. The beholder’s view of such crowds tended to reflect their attitude to public execution itself, as the most graphic and visceral demonstration of the ultimate power of the state. There were many who were already campaigning for its abolition on the grounds, as one put it, that ‘the real effect of these scenes is to torture the compassionate and harden the obdurate’. There were many more, though, who thronged to such occasions in high spirits. Their hilarity and ribaldry –- the proverbial ‘gallows humour’ – may have been heartless mockery, but it may also have been a response to the unspoken but unmissable tension between the pomp and solemnity of the occasion and ghastly reality of the act.

This tension reached its high water mark with Despard’s execution. There had been a long observed trend in Britain towards public disrespect at hangings: the victim cheered, the executioner and officials booed and mocked. But the crime of high treason placed an unprecedented focus on the legitimacy of the act a focus sharpened still further by the fact that the majority of the onlookers believed Despard to be innocent of it. He had been accused and convicted of a shocking, cold-blooded plot to overthrow the state, an accusation which he had consistently and calmly denied. Now, at the moment of the state’s cold-blooded retribution, he had a final chance to speak the case for his defence. Part of the unique appeal of executions was always that the victims, in the moments before their death, might say anything; it was often the only time that the unspeakable could be spoken in public. But if Despard chose to speak the unspeakable, it would be more than a howl of rage, a fruity obscenity or a cheeky quip. The danger he posed might yet be far from over.

The bell of St.George’s Church began tolling at five, and continued for about an hour. By the time it finished, every conceivable vantage point was packed solid. It was estimated that there were twenty thousand people jammed into the carriageway of Horsemonger Lane and spilling onto every nearby roof and patch of open ground ‘that afforded the least prospect’. It was evident, too, that this was no ordinary gallows crowd, just as it was no ordinary hanging. The packed observers were almost completely silent: ‘no tumult, no disorder appeared among the multitude … all was stillness and expectation of the approaching event’. For the massed guards and officers, this must have been considerably more unnerving than the unruly mob which they had feared. It might be an expression of uncertainty, of a crowd unsure of the tone of the event, and too diffident to break the silence. But it could equally, and perhaps more plausibly, be read as a mute but chilling sign of pre-arranged intent.

Inside Surrey County Jail, as the prison bell struck seven, Despard was invited into the chapel for a service of last rites. He politely refused the invitation, and remained in his cell. At seven thirty, his arms were bound with ropes and he was led out into the walled and enclosed prison yard. He was still a colonel, and still entitled to wear the uniform of his rank, but he appeared instead in his favourite dark greatcoat and boots, bare-headed, without wig or powder. His solicitor was waiting for him outside his cell and, manoeuvering around his ropes, he shook hands with him ‘very cordially’.

Awaiting Despard in the prison yard was a very strange sight indeed. Two horses were harnessed to a small cart which contained two trusses of clean straw, and whose floor rested directly on the ground. Behind the cart stood the Sheriff of Surrey; behind him a fully-robed priest, and behind the priest the head keeper of the jail, Mr.Ives, solemnly holding a white wand. Behind Ives stood a line of high constables, and behind them a line of duty policemen. Bringing up the rear was the executioner, holding up a drawn sword.

The quartering and dismembering had been waived, but there had never been an execution for high treason without the victim first being drawn through the streets to the scaffold. It was integral to the ceremony, but today it was out of the question. The ritual was intended to allow the people to vent their feelings towards the traitor, to abuse him and spit on him; today, though, no-one was minded to test how the ominously silent crowd outside would react if Despard was paraded among them. Apart from anything else, the packed streets made it logistically impossible. It had hastily been decided to switch the ritual to the privacy of the prison yard.

Outside the yard, the traditional gallows humour may have been conspicuously absent, but Despard himself was unable to keep a straight face at the display of furtive pomp that confronted him. ‘Ha! ha!’, he laughed, ‘what nonsensical mummery is this?’ The solemn procession was not programmed to respond. Despard was ushered into the cart, seated backwards on the straw bales and, as the dawn spread grey over the prison walls, bumped around the cobbled yard until it was deemed that the drawing had been completed. There was to be no thwarting of justice, but neither would the ancient ritual of drawing a traitor survive that morning’s embarrassment and ridicule. Despard, though powerless against it, had nevertheless passed a sentence of death on the sentence itself.

1587: Mary, Queen of Scots

A Death:

Shrewsbury: ” … Madam you must die, you must die!…”

The executioner held up the severed head of the Queen of Scots for all to see — but horror as the hair separated from the head, and the head dropped to the floor. There was a stunned silence from the spectators — the Queen, once considered the most beautiful woman of her time, had lost her hair and vanity dictated the wearing of a wig.

The Dean of Peterborough stood over the corpse of the dead Queen and uttered the words all longed to hear: “So perish all the Queen’s enemies”.

The body of the dead Queen was stripped, in readiness to be received by the embalmers — but the dead Queen’s corpse held yet another surprise. Concealed within her skirts was a small terrier, which positioned itself betwixt the severed head and the body, and nothing could move it. It alone remained loyal to the Queen.

But the indignity of the execution of the Queen of Scots was not over. The execution block, her clothing and any other object which could be considered a relic was burned at Fotheringhay, which was in lock down.

It was not until approximately four in the afternoon that the Queen of Scots’ body was prepared for burial — but not the burial one would associate with a monarch. No — the Queen’s lead coffin was walled up within the precincts of Fotheringhay Castle. It was not until her son succeeded as James I of England, that the Queen was accorded a suitable and more Christian burial at Westminster Abbey.

A Life:

Mary was born 8 December 1542 at Linlithgow, Scotland, the daughter of James V of Scotland (d. 1542) and Mary of Guise (d. 1560). From the day of her birth, Mary was betrothed to the future Edward VI of England — the vetoing of this marriage led to war with England.

In the ensuing conflict, the Scots were defeated at Pinkie (10 September 1547) by forces of the Duke of Somerset. A French alliance was decided upon. Mary was sent to the French court aged 5 (1548), where she received a Catholic upbringing under her Guise uncles. Mary married the Dauphin Francis at Paris, France (24 April 1558). Her husband succeeded to the French throne as King Francis II (1559).

Mary became Queen of France but shortly after, Francis died (1560/1561). Mary was returned to Scotland (1561), and upon her arrival promptly proclaimed herself rightful Queen of England as the granddaughter of Henry VIII’s sister, Margaret Tudor.

However, during her absence, things had changed in Scotland, and Mary had to adapt to the anti-monarchical, anti-Catholic, anti-French elements that now dominated Scotland. Then Mary embarked upon an ill-considered marriage to her cousin Henry Stuart, Lord Darnley (29 July 1565) at Edinburgh, Scotland. Mary soon gave birth to a son, James VI (of Scotland) & I (of England) (1566).

The following year Mary was caught up in the scandal surrounding the murders of her Secretary David Riccio and her husband, Darnley (1567). From then on, Mary made mistake upon mistake. Soon after both deaths, Mary made a scandalous third marriage to James Hepburn, 4th Earl Bothwell (1567), who just happened to have been recently acquitted of Darnley’s murder. Mary claimed that this marriage was made under duress — but none were convinced. There was an immediate uprising of Scottish lords which resulted in military defeat for Mary at Carberry Hill and Langside (1568).

Mary fled Scotland for England and threw herself on the mercy of Elizabeth I, who kept her imprisoned in various strongholds. Following numerous intrigues to rescue her and place her on the throne of England, Mary was placed on trial (Oct. 1586). She was found guilty of treason and sentenced to death (25 October 1586).

After delaying for as long as possible, Elizabeth reluctantly signed Mary’s death warrant (1 February 1587) and Mary was executed at Fotheringhay (8 February 1587).

A Question of Legality:

Was the execution of a monarch of one country by a monarch of another lawful?

Mary was initially brought to trial under the English Act of Association (1585) — which in the eyes of the English made Mary just as guilty as those who conspired against the Queen of England, either with or without her knowledge. Guilt by association — a phrase I am sure we have all heard of.

Mary herself said: ” … as Queen and Sovereign, I am aware of no fault or offence for which I have to render account to anyone …”

In fact, just how was it legal for a Queen of a foreign country to be tried for treason by a Queen whose subject she was not; in fact, how could one then execute this foreign sovereign?

The sovereignty of any monarch, at this period in time, was taken with all solemnity. Elizabeth I herself was fully aware of the implications — if Mary could be treated and punished like an ordinary subject, then what could Elizabeth herself expect should she venture beyond the English Channel? In fact, Mary could only be judged by her peers — and to this end, only Elizabeth filled this position — not the privy councilors or nobility.

The English jurists pondered over this question — if Mary committed treason, she should have been expelled from English soil. But in the end, the legal minds of England came up with a suitable solution. King Henry VIII claimed suzerainty over Scotland; thus, Mary was a subject of the English Queen and could be tried (and executed) for treason under English law.

As author Antonia Fraser wrote: “In the case of the trial of Mary Queen of Scots the traditional blindfold across the eyes of Justice was ruthlessly torn aside by English commissioners so that the desired verdict might be reached.”
