1814: Vicente Salias, Venezuelan national anthem author

On this date in 1814, the Venezuelan doctor and writer Vicente Salias was shot in San Felipe castle at Puerto Cabello by the Spanish who meant to run the place.

Salias (English Wikipedia entry | Spanish) was a founding member of the Sociedad Patriotica de Caracas and editor of the nationalist publication El Patriota de Venezuela.

He worked for the First Republic of Venezuela, a short-lived (1810-1812) attempt to break away from a Spanish empire preoccupied by the Napoleonic Wars. In 1810, Salias is said to have* composed the lyrics for Gloria al Bravo Pueblo (Glory to the Brave People),

Captured attempting to escape the approaching royalist forces of Jose Tomas Boves, Salias was shot with the spectacularly defiant last cry of “God Almighty, if the Heavens admit Spaniards, then I renounce the Heavens!”

* There are some revisionist hypotheses postulating other authors.

1814: John Ashton, Lord Wellington, at Horace Cotton’s first hanging

This isn’t exactly the most historically important execution, but as the Newgate Calendar says, “The circumstance which attended the execution of this unfortunate man alone entitles him to a place in our pages, for otherwise his case is void of interest.”

What follows is the Calendar’s entry, which comes verbatim from the Aug. 23 London Times.

He was apprehended for a highway robbery, and convicted at the Old Bailey, when he received sentence of death. From the time of his conviction, he either affected, or suffered, complete insanity; but this did not release him from the consequence of his sentence; and, on Monday, August 22d, 1814, he was executed in front of Newgate, along with William Henry Lye, for burglary; John Mitchell, for forgery; Francis Sturgess, and Michael Mahoney, for highway robbery; and John Field, alias Jonathan Wild [not that one -ed.], for burglary. By half past six o’clock the Old Bailey, and houses adjacent, were crowded to great excess. At half past seven Mahoney was brought forward, for the purpose of being disencumbered of his irons. While his irons were knocking off, it was found necessary to search for a knife to cut some part of the cordage, which confined the irons. Mahoney, seeing this, stooped, and, with an Herculean effort, tore it asunder. This being the only Catholic, the Rev. Mr. Devereux attended him in constant prayer, in which he joined most fervently. Sturgess, Field, and Mitchell, conducted themselves with great propriety. The unfortunate Ashton had been in a state of insanity since the receipt of the awful warrant for his execution. In the Press Yard he distorted his countenance horribly. He was the fifth who mounted the scaffold, and ran up the steps with great rapidity; and, having gained the summit of the platform, began to kick and dance, and often exclaimed, ‘I’m Lord Wellington!’ The Rev. Mr. Cotton, who officiated for the first time as Ordinary, enjoined him to prayer, to which he paid little attention, and continued to clap his hands as far as he was permitted by the extent of the cord. Mitchell often invited him to prayer. All that could be done was ineffectual, and it was necessary to have two men to hold him during the awful ceremony. When they released him for the purpose of the Lord’s Prayer being said, he turned round, and began to dance, and vociferated, Look at me; ‘I am Lord Wellington!’ At twenty minutes past eight o’clock the signal was given, and the platform fell. Scarcely, however, had the sufferers dropped, before, to the awe and astonishment of every beholder, Ashton rebounded from the rope, and was instantaneously seen dancing near the Ordinary, and crying out very loudly, and apparently unhurt, ‘What do ye think of me? Am I not Lord Wellington now?’ then danced, clapped his hands, and huzzaed. At length the executioner was compelled to get up the scaffold, and to push him forcibly from the place which he stood.

Quite a baptism for the Rev. Horace Salusbury Cotton’s very first gig as the Ordinary. Cotton noted Ashton’s remarkable behavior in his execution diary; the relevant pages can be seen here.

Nothing daunted, Cotton enjoyed a 25-year run in the position (he was the cleric Charles Dickens saw at work when the writer visited Newgate in 1835), and “enjoyed” really does seem like the right word. “He was a robust, rosy, well-fed, unctuous individual, whose picture may be seen in Cruikshank‘s plate of the Press yard in Pierce Egan‘s ‘Life in London,'” wrote Horace Bleackley. “His condemned sermons were more terrific than those of any of his predecessors, and he was censured by the authorities for ‘harrowing the prisoner’s feelings unnecessarily’ in the case of Henry Fauntleroy, the banker.”

1812: William Booth, forger

On this date in 1812, William Booth was hanged at Stafford for counterfeiting.

Booth might have murdered his brother John, who was found beaten to death in a Warwickshire stable in 1808. He defeated that charge for want of evidence.

But he would not be two times lucky before the bar.

As a “farmer” living on 200 acres, he enjoyed the privacy to build his own mint, complete with forged royal stamps for churning out banknotes — more than enough cause to hang a man should he be caught, which Booth was. He was a difficult fellow to arrest, the Bury and Norwich Post reported (Aug. 19, 1812), because his farmhouse turned out to be “a little fort, full of trap-doors, and barred and bolted like a bastile.”

Booth’s engineering acumen might have come in handy for his executioners. As a broadside notes, the gallows Booth

ascended with a firm and steady step, but turned his back upon the populace almost immediately; after some time spent in prayer, the rope was adjusted, and a signal being given by the malefactor, (throwing his handkerchief from him that he was ready to submit to his fate,) the drop sunk, when, shocking to relate, by the cord slipping from the fatal tree, the unfortunate man fell from the top of the gallows upon the platform, a distance of eight or ten feet, where he remained motionless and insensible for some minutes.

The stunned prisoner was gradually revived, and redoubled his pieties. The fall must have rendered the noose unusable, because for some reason a delay ensued sufficient to stretch out the proceedings to two full hours, all of which Booth spent in the shadow of the gallows. Even when they finally had him trussed up and ready to hang again, they needed a do-over: Booth once more dropped his handkerchief, but the drop embarrassingly failed to dislodge. Booth, who had twice prepared himself to walk to the brink of death only to twice survive, asked for his handkerchief back once the apparatus had been fixed so that he could re-drop it.

Having faced two capital trials, and two executions, Booth couldn’t even get buried right on the first time. Apparently a re-drawing of the county line required his remains to be exhumed and re-interred, giving rise to a ballad, “Twice Tried, Twice Hung, Twice Buried”.

(Although this version proposes twice hanged and once drowned: suffice to say, Booth lived an interesting death.)

1812: Hölzerlips, Blood Court prey

On this date in 1812, the German bandit Hölzerlips — that’s just “Philip of the Woods”, despite what your dirty mind was thinking — was beheaded with three compatriots at Heidelberg.

They were part of a gang of six vagrant souls (the other two were spared on account of youth) who, finding everything displaced in the time of the Napoleonic wars, made their daily bread robbing around the Spessart in southern Germany.

In this capacity they racked up at least 15 known incidents of highway robbery, going so far as to kill a Swiss merchant on the road in 1811.

Captured shortly thereafter, Heidelberg grandees considered them (in)famous enough to merit a staged Blutgericht (“Blood Court”) followed by beheading this date, a spectacle that drew 30,000 gawking spectators in its day.

1813: Johann Christian Claudius Devaranne

Two centuries ago today, Johann Christian Claudius Devaranne got himself shot for resisting Napoleon’s draft in Germany.

The Corsican had fallen back following the debacle of occupying Moscow, but the attempts of Napoleon-allied forces to recoup dwindling numbers by conscription provoked fierce resistance in Solingen — where the draft board was driven out and recruiting materials destroyed.

This little flare-up goes by the excellent title of the “Russian Truncheon Insurgency,” but it soon ran into the bayonets of Napoleon’s German partners. On January 30, 1813, a week after draft riots first erupted, troops began suppressing it. Devaranne, a 29-year-old father of five, was seen as a leader in the resistance and a price put out on his head … a price his own maid collected when the fugitive innkeeper was reckless enough to sleep at home one night.

He was tried and shot at Dusseldorf months later, during a lull in the year’s bloody campaign season.

For the 120th anniversary of Devaranne’s execution — which was also six months into Adolf Hitler’s Chancellorship — Solingen dedicated a memorial plaque to Devaranne, claiming his nationalist martyrdom as its own.

“It is no accident that precisely the Third Reich celebrates the memory of this hero. The same spirit which animated Devaranne, animates our SA as well,” said the city’s Lord Mayor. (There was an SA honor guard on hand for the occasion.) “Then as now, we revolt against repression, then against the Corsican, today the SA’s revolution against the Marxists. We need the memory of our heroes to redirect us to their spirit in dark hours.”

The plaque went missing after the war, but Devaranne still has a street named after him in Solingen.

1810: Leatherlips, tomahawked

On this date in 1810, Ohio’s Wyandot (aka Huron) tribe executed Leatherlips by tomahawk.

This evocative name,* and his proper Wyandot name of Chief Shateyaronyah, appears among the signatories of the Treaty of Greenville — a pact secured after military action ceding Ohio to white settlers. It’s just an early installment of the rolling continental conquest with its familiar Hobson’s choice for natives: resist or accommodate?

Leatherlips was a leader of the accommodationist strand, advocating peacable relations with neighboring whites.

And in a few years, this would become a very big problem for the leader of the resistance camp — Tecumseh. This soon-to-be-renowned Shawnee would shortly raise a broad confederation up in arms against whites.

To do this, Tecumseh felt it necessary to eliminate the go-along, get-along types.

On June 1, 1810, six Wyandot warriors showed up at the historic Black Horse Tavern, a regular Leatherlips haunt at the Sells Settlement. This germ of present-day Dublin, Ohio, was the Scioto River property of the settler John Sells,** a friend of Leatherlips.

Sells heard about this unsettling visit the next morning, and immediately set out on horseback to find the party. He came upon them in a lodge, with Leatherlips bound, being tried for witchcraft — a charge that was all the vogue after the recent death of a Lenape chief who was thought to have been enspelled. Leatherlips was pushing 80 years of age.

Sells’s attempts to save the elderly Wyandot’s life were in vain. That afternoon, Leatherlips painted his face, sang a war chant, and knelt by his own grave, where one of the braves slew him by tomahawking his head. The Wyandot warriors allegedly drew the Sells party’s attention to Leatherlips’s sweating face as he died, viewing this phenomenon as an indicium of guilt.

* As much as it sounds like the poor guy needed some lip balm, “Leatherlips” was actually a nickname conferred (by whites) for his trustworthiness … as in, any promise that passes his lips is strong as leather, just like RUN-DMC.

** Today, there’s a John Sells Middle School in Dublin in this pioneer’s honor. Leatherlips, for his part, has his name on a street.

1818: Abraham Casler, marital woes

On this date in 1818, Abraham Casler was hanged in Schoharie, N.Y. for escaping an ill-advised marriage by means of an illicit powder.

Casler had got young Catherine (Caty) Sprecker pregnant and was only induced to change her name in 1812 by threat of prosecution. Even at the wedding he told the bride’s own brother that he didn’t intend to live with the poor girl.

Casler immediately regretted committing himself to wedlock in any form whatsoever (his alternative would have been to pay a fine, much the bargain as compared to an unpromising marriage — particularly so in those benighted days before no-fault divorce). So he promptly enlisted in the army then fighting the War of 1812 so as “not to live with his wife that he wished … was out of the land of the living,” as he said to another recruit.

Well.

If wishes were fishes, they’d have arsenic inside. (n.b.: they do!)

When he finally had to return, Casler preferred to spend his time paying court to a widowed Albany innkeeper, and generally had a manifestly unhappy time of it with Caty. The latter’s epileptic fits probably only exacerbated the unwilling husband’s ire.

At last, while traveling, Caty Casler took ill with “a burning heat at her stomach & breast … cold chills by spells accompanied with sweat.” She “said her whole body was in pain; she was alernately [sic] cold and hot; would throw off the bed clothes, and then cover herself again.” After a couple of miserable bedridden days, all the while being personally treated by an attentive Abraham Casler who also shooed away attempts by other guests to assist or to summon medical aid,* Caty Casler succumbed, and “looked blue round the mouth and eyes” and “her hair came out.”

Doctors who conducted the post-mortem found what they were certain was arsenic and opium in Caty’s stomach. The trial record features a number of these medical men describing the exact tests they used to establish the presence of this deadly mineral; for instance, a Dr. James W. Miller described finding “particles … of a vitrious appearance” in the stomach.

Some of those particles were placed on a heated iron; a dense white fume arose from their combustion. Some of them were likewise placed between two plates of polished copper prepared for the purpose; those coppers were bound by an iron wire and placed into the fire until they were brought to red heat; they were then removed and after they were cold they were separated, the interior of the plates were whitened towards the edges of the plate in the form of a circle.

Last, taking two teaspoons of stomach fluid containing these suspicious particles,

He diluted it with a pint of water, then took the nitrate of silver and dissolved it and put into a separate glass; took pure ammonia into another glass; then took two glass rods, wet the end of one of them in the solution of the nitrate of silver, and dipped the end of the other in the pure ammonia, then brought the two ends of the rods in contact on the surface of the water in the vessel containing the contents of the stomach, and passed them down into the fluid; there was a precipitate from the point of contact, that precipitate was of an orange colour. He repeated that experiment several times, and also with arsenic dissolved in water. The results of the experiment were similar; the same precipitate in the one as in the other, tho’ it was more distinct in the solution made of arsenic, that being coulourless.

There was, in Dr. Miller’s opinion, “arsenic in the stomach; [he] has no doubt of it; considers the test made by him infallible; does not know that any thing except arsenic, will produce the same effect on copper, as was produced by those particles in the experiment.”

The court record merely summarizes the testimony witness by witness rather than providing a literal transcription, but one gets a sense of the thing merely leafing through it: it has 16 pages of prosecution testimony, from Casler’s Albany crush and family members catching him in suspicious circumstances, plus six different physicians, one of whom was a Professor of Chemistry at Fairfield Medical Academy.

The defense has one-half of one page, consisting of a flat denial by Casler and the observations of one former boarder with nothing useful to say.

The jury took two hours to convict.

After Casler hanged at the eponymous seat of Schoharie County (admitting his guilt on the scaffold), the gallows were left standing “as a solemn admonition of the penalty such crimes demand.”

That admonition had to be repeated: less than a year later, the crossbeam that had once supported Casler’s dying throes was tested again to dispatch a farmer from Sharon Springs who had bludgeoned a deputy sheriff to death.

* “It would only make a bill of expense,” Casler said of the prospect of summoning a physician for his wife. This was also the same disquieting answer he gave when asked if he would be taking the body to bury with her family; instead, he unsentimentally buried it at the nearest available spot, where it was soon exhumed by suspicious locals. The guy hung himself with skinflintedness.

1816: Four sodomite sailors of the Africaine

On this date in 1816, four British sailors on the HMS Africaine were hanged for buggery. One other crewman suffered 200 lashes; a second, a 17-year-old sentenced to 300, had the flogging stopped at 170 stripes by a surgeon who feared the youth’s life was in danger.


The Africaine: it was a French ship originally, captured in 1810 by the British.

“The Africaine had a reputation as a ‘man-fucking ship’ long before evidence of sodomitic practices came to the attention of Captain [Edward] Rodney,”* Arthur Gilbert explained in his seminal study published in the very first (volume 1, issue 1 — 1976) edition of the Journal of Homosexuality. “There were several reports of ‘uncleanliness’ on the ship early in 1815 and, on one occasion, two seamen were punished for ‘lying on a chest together one night’.”

Late in 1815, Captain Rodney determined to crack down on the man-fucking and by threatening them with “dreadful consequences” coerced two of the crew into implicating themselves and a great many others in a buggery ring. As the Africaine made its way back to Portsmouth that autumn, it was scene to an ever-widening investigation.

Out of about 220 to 230 men aboard, some 50 members of the crew would ultimately be involved in the investigation, 23 of them charged or implicated with a wide variety of riffs on “the unnatural crime”: one Raphael Seraco was seen “with his yard actually in the posterior of John Westerman”; another sailor “placed his yard between [my] thighs and in that position effected an emission”; still another had “his yard against the backside of the boy Christopher Jay and … in quick motion as if he was committing the unnatural crime”; one of the ship’s boys “being much hurt sung out ‘Oh'” during an attempted rape; and someone had been rogered “on the flag stones of the Galley.”

While seabound sodomy was hardly unheard-of, the practitioners among the Africaine‘s crew had seemingly grown unusually (and dangerously) bold about practicing it without a modicum of concealment, “copulating in plain view like dogs.”

“God must put it into men’s heads to commit the unnatural crime of buggery,” an accused boatswain’s mate had allegedly declared. “If God was to put it into his head to fuck a man, [I] would as soon do it as fuck a woman.”

The sheer number of men rolled up in accusation and counter-accusation made across-the-board death sentences inconceivable. And among those implicated, it was extremely difficult to ascertain truth when fear and favoritism and innuendo were so thick in the air — “terrified as we were,” as one accused man later recounted, “in the idea of being prosecuted for the horrible crime imputed to us, dismayed and alarmed … in the duress of our situation, our minds and feelings every moment distorted by hope and fear without a friend to counsel us.”**

Blackstone had long before noted that the witch-hunt potential of a charge of sexual deviance demanded “that the accusation should be clearly made out.” To Rodney’s credit, he didn’t start stringing people up from the yardarm while the Africaine was at sea.

In port, Captain Rodney gave the matter over to the Admiralty with what one imagines was probably no small relief. In the grand tradition of prosecutorial discretion, the court-martial board proceeded to break down the many accused into those who would be charged and those who would cut deals to implicate the charged.

Seraco and Westerman, mentioned above, were the first sentenced to death, and then Seraco again condemned along with another partner, John Charles. (Seraco had been implicated by several people during Captain Rodney’s seaside inquiry, and Seraco in turn had accused no fewer than 14 of his mates in a vain attempt at self-protection.)

One of the other (uncharged) seamen giving against Seraco offered this juridically damning and sociologically interesting testimony:

Seraco put the question to me whether I would let him fuck me. I told him I did not much mind. He connected with me forward on the Starboard side. He entered my backside — I did the same with him three times. John Charles the prisoner was the first who mentioned the thing to me or I should never have had such a thought in my head.

Testimony of this nature, Gilbert says, posed a problem of jurisprudence: this was evidence not directly bearing on the charge that the defendant committed a specific act of sodomy with the other defendant. Legally, unless the Seraco-Charles liaison had been the charge at the bar, this testimony was extraneous. The Attorney General opined that, in a like civilian trial, he would have advised against executing a death sentence that had been obtained with such evidence — and that fact may have helped procure a pardon for a sailor named Joseph Tall.

Raphaelo Treake (Troyac), condemned with Tall, got the same favor — but Treake was immediately re-tried for a different act of buggery and re-condemned. Treake was another Italian, and Albert notes that their common crime was popularly euphemized as le vice Italien and considered a characteristically Mediterranean indulgence. “All the scandalous behavior in the Africaine has been owing to Treake and Seraco. They are the origin of the whole of it,” another crew member — a Spanish Morisco — testified.†

As January 1816 unfolded, several others went before the court martial and received prison sentences (or in the odd case, acquittal) as the great sodomy-and-uncleanliness audit proceeded.

By month’s end, it was all finished but the noosings.

On February 1, the four condemned “died truly penitent acknowledging the justice of their sentences and admonishing their shipmates to take warning from their unhappy fate not to be guilty of such detestable practices.” The ship’s clipped log entry tersely recorded that unhappy fate.

a.m. Fresh breezes and cloudy … employed getting ready for punishment. At 9 made signal [with] a gun. At 11 executed Seraco, Westerman, Charles, and Treake [for] a breach of the 29th article of war, and punished alongside [John] Parsons … with 200 lashes and [Joseph] Hubbard with 170 lashes for a breach of the 2nd article of war as sentenced by a court martial.

p.m. … sent the bodes of the executed to the hosptal. Read articles of war to the ship’s company.

On that same date as the poor buggers of the Africaine suffered their various corporal punishments, the Portsmouth commander Admiral Edward Thornborough appointed three captains to lead an inquiry into whether this floating Sodom was the fault of Captain Rodney’s soft discipline. The investigators heard good testimony all around among the ship’s junior officers to the conduct of Captain Rodney, and within days exonerated all the higher-ups, only pausing to complain that there could have been more frequent religious services and readings of the Articles of War.

And that was that … even for the ship itself. By mid-February, the HMS Africaine was being stripped down at a Thames dock. She would be officially decomissioned and broken up that year.


How exceptional were the Africaine sodomites in the British navy as the 18th century gave way to the 19th?

Dr. Richard Burg, author of Boys at Sea: Sodomy, Indecency, and Courts Martial in Nelson’s Navy as well as a 2009 Journal of Homosexuality article on the Africaine case (see †), was generous enough to offer his insights into this elusive subculture.

I’d like to start with a question about the historiography. Arthur Gilbert brought this incident to wide public view in the 1970s, and you’ve written about it much more recently. How has the scholarly sense of homoeroticism in the British navy, or in western militaries generally, evolved in the past forty years or so?

Its evolution has paralleled the gay rights movement that began with the Stonewall riots. Generally, scholars have come to realize that homoeroticism in the ranks is more than an isolated phenomenon. Most research on the matter, however, has centered on the persecution of gay service members or the rights of gays to serve openly: can it be allowed, what problems would it create, how military personnel and the public might deal with it, etc. Scholarly interest in the historical dimension of military homoeroticism has been confined to an isolated handful of researchers. Most scholars are dealing with more contemporary and more relevant aspects of the subject.

How widespread were same-sex trysts in the Royal Navy at this time?

No idea. This is, of course, what everyone wants to know, and there is simply no data that even suggests a guess let alone an answer.

What was it about the case of the Africaine that resulted in this sizable court-martial and multiple hanging, when at least some other incidents of “buggery” and “uncleanliness” over the years appear to have been dealt with quietly or discreetly ignored?

What made the Africaine different? The number and conspicuousness of the Africaine business meant it had to be dealt with. All other known incidents that produced courts martial or even summary punishment involved only pairs of mariners. Admittedly, some mariners were involved with multiple partners, but the relationships were dyadic rather than involving multiple partners simultaneously.

Do we know if men who engaged in homosexual behavior within the navy also did so on terra firma, or is that an “identity” most took on specifically to adapt to their confined all-male environment at sea? Is there any connection or analogue we can speak to between these cases and the simultaneous molly culture?

I have only run across mention of one or two navy sodomites who took their proclivities with them on land. This does not mean it didn’t happen. It is just that it is almost impossible to follow sailors once they leave their ships. They leave almost no evidence of their individual activities when not signed on board navy ships. No, I see no parallels or connections to eighteenth-century molly culture.

This is a a tangential point, but I was struck by your remark relative to the Italian Rafael Seraco that “sodomy, Popery, and Italy were inseparably linked in the minds of eighteenth-century Englishmen.” Why was that?

Sodomy, Popery, and Italy were linked in the minds of Englishmen long before the eighteenth century. Sodomy arrived in England as an Italian import according to popular views prevalent at least since the early seventeenth century, and probably earlier. The pope and the Catholic Church were also considered the handmaidens of sodomy at the same time. Part of this is due to raging anti-Catholicism in England dating from the Reformation of Henry VIII. Another part of it is the human tendency to blame the “other” for real or perceived ills: Jews, Communists, Fundamentalists, Liberals, whoever is handy. Catholics and sodomites were easy targets for Englishmen from the sixteenth century onward.

* Captain Rodney was the youngest son of Admiral George Brydges Rodney, a famed commander during the American Revolution. It’s thanks to Admiral Rodney’s career that the name Rodney became popularized as a first name.

** Midshipman Christopher Beauchamp. This was his explanation for why he had (falsely, he said) confessed to the lesser offense of (non-penetrative) “uncleanliness”.

1813: 14 Luddites at York

On this date in 1813, the British intensified their war against machine-wrecking Luddites by executing 14 at York.

We touched last week on Mellor, Smith, and Thorpe, three Luddites hanged for assassinating a wool manufacturer during the dirty war that resulted from mechanizing formerly-artisanal textile production. Today, the Luddite Bicentenary marks the mass hangings of January 16, 1813, pursuant to sentences issued by that same special tribunal in York. Most had been convicted of an attack on nearby Rawfolds Mill; others, for taking part in two home-invasion robberies for the purpose of obtaining weapons.

Enjoy the full story at Luddite Bicentenary … but here’s a teaser excerpt from the January 23, 1813 Leeds Mercury‘s account of the “inexpressibly awful” sequential mass-hangings, seven upon seven, widowing 13 wives and leaving 56 children (and a 57th on the way) fatherless.

Execution.

After sentence of death had been passed upon the persons convicted of making the attack on Mr. Cartwright’s Mill, at Rawfolds, and of the Burglaries, fifteen in number, all of them except John Lumb, who was reprieved, were removed to the condemned-ward, and their behaviour in that place was very suitable to their unhappy situation…

if any of these unfortunate men possessed any secret that it might have been important to the public to know, they suffered it to die with them. Their discoveries were meagre in the extreme. Not one of them impeached any of their accomplices, nor did they state, as might reasonably have been expected, where the depot of arms, in the collection of which some of them had been personally engaged, was to be found. When interrogated on this point, some of them disclaimed all knowledge of the place, and others said, Benjamin Walker, the informer against Mellor, Thorpe, and Smith, could give the best information about the arms, as he had been present at most of the depredations. … The principal part of these ill-fated men were married and have left families. William Hartley, has left seven children, their mother, happily for herself, died about half a year ago. John Ogden, wife and two children; Nathan Hoyle, wife and seven children; Joseph Crowther, wife pregnant, and four children; John Hill, wife and two children; John Walker, wife and five children; Jonathan Dean, wife and seven children; Thomas Brook, wife and three children; John Swallow, wife and six children; John Batley, wife and one child; John Fisher, wife and three children; Job Hey, wife and seven children; James Hey, wife and two children; James Haigh, wife, but no children. On the morning before the execution, the eldest daughter of Hartley obtain permission to visit a wretched parent, when a scene took place which we will not attempt to describe. The heart-broken father wished to have been spared the anguish of this parting interval, but the importunate intreaties of his child a last prevailed, and they met to take a long farewell, never again to be repeated in this world. What must be the feelings of an affectionate father, (for such in this trying moment he appears to have shewn himself,) when, though standing on the brink of eternity, he declines to see a darling child; how great an aggravation of his punishment must those parting pangs of inflicted, and how loud an admonition does this melancholy incident suggest to the Fathers of families against entering into combinations that may place them in the same inexpressibly afflicted situations. It was Hartley’s particular request that the public should be informed of the number and unprovided situation of his orphan family.

At 11 o’clock on Saturday morning, the Under Sheriff went to demand the bodies of John Ogden, Nathan Hoyle, Joseph Crowther, John Hill, John Walker, Jonathan Dean, and Thomas Brook. They were all engaged in singing a hymn:

Behold the Saviour of Mankind,
Nail’d to the shameful tree;
How vast the love that him inclin’d
To bleed and for me, &c.

Which one of them [Luddite Bicentennary notes: John Walker, according to the Leeds Intelligencer] dictated in a firm tone of voice; and in this religious service they continued on their way to the platform, and some time after they had arrived at the fatal spot. They then join the ordinary with great fervency in the prayers appointed to be read on such occasions, and after that gentleman had taken his final leave of them, ejaculations to the throne of mercy rose from every part of the crowded platform.

Joseph Crowther addressing himself to the spectators said, “Farewell Lads;” another whose name we could not collect said, “I am prepared for the Lord,” and John Hill, advancing a step or two on the platform, said, “Friends! all take warning by my fate; for three years I followed the Lord, but about half a year since, I began to fall away; and fell by little and little, and at last I am come to this; persevere in the ways of godliness, and O! take warning by my fate!” The executioner then proceeded to the discharge of his duty, and the falling of the platform soon after, forced an involuntary shriek from the vast concourse of spectators assembled to witness this tremendous sacrifice to the injured laws of the country.

The bodies having remained suspended for the usual time [LB: 12.00 p.m.], they were removed, and while the place of execution was yet warm with the blood of the former victims, the remaining seven, namely, John Swallow, John Batley, Joseph Fisher, William Hartley, James Haigh, James Hey, and Job Hey, were led at half-past one o’clock from their cell to the fatal stage, their behaviour, like that of their deceased confederates, was contrite and becoming; James Haigh expressed deep contrition for his offences. John Swallow said he had been led away by wicked and unprincipled men, and hoped his fate would be a warning to all, and teach them to live a life of sobriety and uprightness. They all united in prayer with an earnestness that is seldom witnessed in the services of devotion, except in the immediate prospect of death [LB: the Leeds Intelligencer said they sung the same hymn as those executed earlier]. A few moments closed their mortal existence, and placed at the bar differing from all earthly tribunal’s [sic] in this infinitely important particular — here, owing to the imperfections of all human institutions, repentance though sincere, cannot procure forgiveness — there, we have the authority of God himself for saying, that the cries of the contrite and broken-hearted shall not be despised. Charity hopeth all things.

The criminal records of Yorkshire do not perhaps afford an instance of so many victims having been offered in one day to the injured laws of the country. The scene was inexpressibly awful, and the large body of soldiers, both horse and foot, who guarded the approach to the castle, and were planted in front of the fatal tree, gave to the scene of peculiar degree of terror, and exhibited the appearance of a military execution. The spectators, particularly in the morning, were unusually numerous, and their behaviour on both occasions, were strictly decorous and unbecoming. [sic]

1813: The Yorkshire Luddites, for murdering William Horsfall

This is the bicentennial of the hanging of three Luddites for the murder of manufacturer William Horsfall.

“Luddite” has come to refer imprecisely to a wide range of anti-mechanization machine-wrecking in early 19th century Britain; however, it’s most properly applied to a specific 1811-1816 movement.

While often understood casually as a sort of mindless technophobia, wreckers — Luddites and otherwise — actually had material labor grievances. New more efficient power looms reduced skilled workers to the ranks of unskilled subsistence labor, or to those of the superfluous unemployed.

With trade unionism illegal (and severely repressed), their means of resistance were of a desperate character. Lord Byron, almost alone in Parliament, rose to defend them: “These men were willing to dig, but the spade was in other hands; they were not ashamed to beg, but there was none to relieve them. Their own means of subsistence were cut off; all other employments pre-occupied; and their excesses, however to be deplored and condemned, can hardly be the subject of surprise.”

Hence, Byron sarcastically remarked, “new capital punishments must be devised, new snares of death must be spread, for the wretched mechanic who is famished into guilt.” Parliament did indeed extend its capital statutes to the protection of these new looms.

“Wrecking,” in the analysis of the late Eric Hobsbawm, “was simply a technique of trade unionism in the period before, and during the early phases of, the industrial revolution.”

Hobsbawm quotes a Nottingham town clerk describing the way textile manufacturers “acquire entire control of their workmen” by putting them to work on the owners’ power looms rather than hiring out workers who use their own looms. “Perhaps the most effectual manner in which the combination [read: proto-union] could coerce them was their former manner of carrying on war by destroying their frames.”

And the descriptor “war” was not far off.

The Luddites — so named for legendary loom-smasher Ned Ludd — proliferated in 1811-1812. Beginning in Nottingham with a protest against falling wages signed by General Ned Ludd and the Army of Redressers, they tapped a wellspring of discontent.

It was a time of war, of economic crisis, of spiking wheat prices whose rise to an 1812 record peak further immiserated those who scraped to earn a living by the sweat of their brow. A generation after the French Revolution, with Napoleon rampant on the continent, English elites had reason to fear their own legitimacy stood on unstable ground.* In 1811, the king even went mad.

And they thrive well who from the poor
Have snatched the bread of penury,
And heap the houseless wanderer’s store
On the rank pile of luxury.

From their birthplace in Nottingham, Luddite societies spread out through textile country, conspiring by moonlight to break into factories and smash up frames or commit other acts of industrial sabotage. (There’s a pdf timeline here) Byron, the Luddites’ defender, owned that the night before he departed a recent visit to Nottingham, “forty frames had been broken the preceding evening as usual, without resistance and without detection.”

Terrified manufacturers — some were known to have armored their establishments with what amount to siege fortifications; others, to outfit homes with early panic rooms as bolt-holes in the event of a Luddite attack — met this mob action violently. Westminster put 12,000 troops into Luddite country to fight the wreckers.

And the wreckers fought back.

William Horsfall, owner of a Marsden wool mill with 400 employees, had vowed to “ride up to his saddle in Luddite blood” … which promise gave a poetic twist to his actual fate: while riding on Huddersfield‘s Crosland Moor** in April 1812, a group of Luddites lying in wait opened fire on him and shot Horsfall through the groin.

“As soon as he fell after being wounded the inhuman populace surrounding him reproached him with having been the oppressor of the poor — they did not offer assistance,” an officer later reported. “Nor did any one attempt to pursue or secure the assassins who were seen to retire to an adjoining wood.” A fellow-manufacturer helped Horsfall to an inn, where he expired painfully 38 hours later.

It was several months before the powers that be were able to crack it.

Eventually, the energetic Huddersfield magistrate Joseph Radcliffe† was able to exploit the threat of hanging to force a Luddite cropper‡ into impeaching his confederates in the plot. This investigation is covered in marvelous detail at the Luddite Bicentenary blog, an outstanding resource on the period in general, but for our purposes we’ll sum up to say that the hunt for Horsfall’s killers wound up zeroing in on George Mellor, Thomas Smith, and William Thorpe.

They were tried over 11 hours on a single day, January 6, 1813 (summary: 1, 2, 3, 4).

That was a Wednesday.

That Friday, the three hanged in their manacles behind York Castle under heavy military guard to forestall any possible rescue, having never admitted any part in the murder. The authorities judiciously eschewed a more demonstrative (and potentially riot-inducing) execution at the scene of the crime.

“The number of people assembled was much greater than is usual in York, on those melancholy occasions; but not the slightest indication of tumult prevailed, and the greatest silence reigned during the whole of this solemn and painful scene,” the Leeds Mercury reported§ — and darkly explicated the intended lesson of the scene for other machine-wreckers.

all those who may have been so far infatuated as to become members of such societies should, from this moment, and by one common consent, desist from taking another step in furtherance of their objects. They must now see that they have stood on the brink of a frightful precipice, and that another step might have plunged them into that gulph which has overwhelmed their less fortunate associates.

The mailed fist deployed against wreckers in 1812-1813 did indeed smash the movement. Still, sporadic Luddite attacks would continue as late as 1816, and Luddite veterans went at the fore of the 1817 Pentrich Rising … just outside the place it all began, Nottingham.

* It was in just this period — in fact, only a few days after William Horsfall’s murder — that Prime Minister Spencer Perceval was assassinated. Given the conditions abroad in the land, many an elite feared upon first notice of this event a revolutionary rising … although Perceval’s killer turned out to be a deranged merchant whose confused private grievance had nothing to do with Britain’s social tensions.

** Not far from the spot of Horsfall’s murder — and a standard stop on every present-day Luddite commemorative walk — you’ll still find William Horsfall Street.

† Radcliffe’s exertions in the war against the Luddites secured for his family a still-extant baronetcy.

‡ Benjamin Walker, the Luddite informer who sent Mellor, Smith, and Thorpe to the gallows, was denied the advertised £2000 reward and wound up a beggar in London.
