1936: Allen Foster, who fought Joe Louis

More than twenty-five years ago, one of the southern states adopted a new method of capital punishment. Poison gas supplanted the gallows. In its earliest stages, a microphone was placed inside the sealed death chamber so that scientific observers might hear the words of the dying prisoner to judge how the human reacted in this novel situation.

The first victim was a young Negro. As the pellet dropped into the container, and the gas curled upward, through the microphone came these words: “Save me, Joe Louis. Save me, Joe Louis. Save me, Joe Louis…”

It is heartbreaking enough to ponder the last words of any person dying by force. It is even more poignant to contemplate the words of this boy because they reveal the helplessness, the loneliness and the profound despair of Negroes in that period. The condemned young Negro, groping for someone who might care for him, and had power enough to rescue him, found only the heavyweight boxing champion of the world. Joe Louis would care because he was a Negro. Joe Louis could do something because he was a fighter. In a few words the dying man had written a social commentary. Not God, not government, not charitably minded white men, but a Negro who was the world’s most expert fighter, in this last extremity, was the last hope.

This story isn’t precisely accurate as Dr. King told it, but the factual basis for this empathetic legend is Allen Foster.

On this date in 1936, Foster was the first man executed by lethal gas in North Carolina — and en route to this minor distinction he punched his ticket for commemoration in civil rights literature when he flourished a flamboyant uppercut to witnesses as he was led to the gas chamber and cried out, “I fought Joe Louis!” It was an allusion to having matched with the world champ when both were youngsters in Alabama.

This coincidental brush with celebrity was about as strange as the fact that it occurred in a gas chamber at all.

After the arrival of the electric chair, the South adopted it virtually across the board; North Carolina had switched from hanging to electrocution in 1910.

But the Tarheel State was also generally more progressive than its neighbors;* V.O. Key would write of North Carolina, “It has been the vogue to be progressive. Willingness to accept new ideas, sense of community responsibility toward the Negro, feeling of common purpose, and relative prosperity have given North Carolina a more sophisticated politics than exists in most southern states.”

Part of that “sophisticated politics” was, in the 1930s, a growing debate about the application — indeed, the mere existence — of capital punishment.

According to Trina Seitz’s “The Kiling Chair: North Carolina’s Experiment in Civility and the Execution of Allen Foster” (North Carolina Historical Review, Jan. 2004):

North Carolinians were beginning to doubt the effectiveness of the sanction and the method used to enforce it. Furthermore, private citizens, humanitarians, and state institutions alike were increasingly scrutinizing the demographics of those being put to death.

Though this scrutiny did not lead so far as actual abolition, it provided the receptively reformist environment for Mitchell County Dr. Charles Peterson’s “pet project” of switching the execution protocol to lethal gas.

The reason for his fascination with gas seems to be obscure; the method had never been employed east of the Mississippi. Maybe it had something to do with 1932’s remarkably smooth gassing of a North Carolinian from nearby Burke County in Nevada, the nation’s gas chamber pioneer.

Whatever the reason, Peterson took a seat in the legislature in 1935 and won adoption for his idea in this very first session.

Unfortunately for Peterson — and doubly so for Foster — North Carolina didn’t have quite the same facility with hydrogen cyanide, and Foster’s execution was a notorious botch that immediately got people back on the electrocution bandwagon.

Foster was doomed for raping a white woman — this may be progressive North Carolina, but it’s still the South — and according to Seitz’s rendering of the News and Observer‘s first-hand report:

“Good-bye.” The Negro’s lips framed the words so clearly that no man in the witness room could doubt what he had said. As he said it, he winked and then forced a smile at the faces peering in at him. Then he began to suffer. No man could look squarely into his eyes and fail to perceive that they were registering pain. The Negro fought for breath, knowing he was going to die and fighting to get it over with as quickly as possible …

he sucked the gas desperately until his head rolled back three minutes later, indicating to physicians that the man finally had lost consciousness. But after a period of quiescence, his small, but powerfully built torso began to retch and jerk, throwing his head forward on his chest, where witnesses could see his eyes slowly glaze … The torturous, convulsive retching continued spasmodically for a full four minutes.

Officially, it took about 11 minutes for Foster to die, and as those agonizing minutes dragged by a physician broke the witness room’s mortified silence by exclaiming, “We’ve got to shorten [the execution method] or get rid of it entirely.” Um, yeah? The prison warden was quoted the next day as saying that even hanging was preferable to this.

The ensuing political controversy, however, did not succeed in reverting the method to electrocution.

Like the original electric chair, North Carolina’s gas chamber was the beneficiary of some hasty technical fixes: heating the gas chamber (it was at the freezing point when Foster died; Colorado executioners advised North Carolina that this would impede the gassing); tweaking the chemical formula.

The very next week, a white murderer named Ed Jenkins followed Foster into the toxic plume, this time to rave reviews: he “died painlessly and the method of execution was humane”. These advances were enough to keep the gas chamber in place, although the state legislature considered several bills to return to electrocution from 1937 to 1943.

During one such debate, North Carolina playwright Paul Green testified to the assembly (per Seitz),

Some day the electric chair and the gas chamber will be set up in the State Museum as symbols of an age of horror and ignorance. School children will look at them and feel superior to us as they look back upon an era of ignorance

Three hundred sixty-two people ultimately died in North Carolina’s gas chamber. And as Green anticipated, the execution chair resides today in the state’s Museum of History.

* This is still true of North Carolina: it has employed the allegedly more humane method of lethal injection since 1984, when no other Southern state save Texas used the needle until the 1990s; that use has been sparing enough that its per-capita execution rate remains markedly lower than most other former Confederate states; and in 2009, North Carolina implemented a stillcontroversial Racial Justice Act empowering condemned prisoners to challenge their sentence with statistical evidence of racial disparity even though courts don’t require this at all.

1943: Rosanna and Daniel Phillips

Executions on New Year’s Day have not been unheard-of in U.S. history, but it’s been Auld Lang Syne since the last such event — a North Carolina double-gassing on this date in 1943.

The previous year, January 1, 1942, had seen the Tar Heel state host the Rose Bowl at Duke University’s stadium: that was just 25 days after Pearl Harbor, and the California coast was considered a potential target. With war in the Pacific trending America’s way, however, the tournament of Roses — although still not the associated parade — was back in Pasadena on New Year’s 1943. So instead, North Carolina did this.*

Daniel and Rosanna Phillips, black sharecroppers, died consecutively in the Raleigh Central Prison gas chamber for the ax murder of their farm owner a mere five months before.

This laboring couple, lovers living out of wedlock (they married after the murder), seem to have had a violent relationship with one another; their 13-hour trial would feature the defendants’ mutual recriminations of black magic, and allegations by each that the other one was the real killer. (Theft appears to have been the motive.)

The U.P. wire report (as run in the New York Times, Jan. 2, 1943) says that the pair forgave each other by the end. Still, Daniel was gassed first “at the request of the State Parole Commission, on the possibility that he might make a last-minute statement exonerating his wife,” which would have spared Rosanna. One wonders if she was still in a forgiving mood when she found out that he hadn’t breathed the word that might save her.

At least some newsmen also reported a malfunction in the chair’s cyanide-dropping rack for Rosanna’s execution, which required guards to re-open the chamber after its strapped and hooded subject had been sealed in, and putz about the mechanism while she waited.

* Actual reason to do this on New Year’s Day: the mere happenstance of automatically scheduling execution dates a set number of days after the defendants’ last appeal failed.

1920: Tom Johnson and Jim McDonald, criminal assailants

Charlotte Observer, Nov. 27, 1920 (Nov. 26 dateline)

Govenror Bickett today signed the death warrants of Tom Johnson and Jim McDonald, negroes convicted of criminal assault and whose appeal to the Supreme Court had been dismissed. Johnson, a native of Guilford county, and McDonald, of Davidson, will die in the electric chair at the state prison on December 3.


Charlotte Observer, Dec. 4, 1920 (Dec. 3 dateline)

Tom Johnson and Jim McDonald, Guilford and Davidson county negroes, died in the electric chair at the state prison here today for criminal assault, Johnson preceding McDonald to death by only a few minutes. The killing today was the fourth double electrocution by the state since the electric chair was substituted for the hangman’s noose. Both the prisoners appealed to the supreme court for new trials but their cases were dismissed two weeks ago.

1838: Tsali, Cherokee

The decade following establishment of the “permanent Indian frontier” was a bad time for the eastern tribes. The great Cherokee nation had survived more than a hundred years of the white man’s wars, diseases, and whiskey, but now it was to be blotted out. Because the Cherokees numbered several thousands, their removal to the West was planned to be in gradual stages, but discovery of Appalachian gold within their territory brought on a clamor for their immediate wholesale exodus. During the autumn of 1838, General Winfield Scott‘s soldiers rounded them up and concentrated them into camps. (A few hundred escaped to the Smoky Mountains and many years later were given a small reservation in North Carolina.) From the prison camps they were started westward to Indian Territory. On the long winter trek, one of every four Cherokees died from cold, hunger, or disease. They called the march their “trail of tears.”

This date in 2010 happens to be Thanksgiving in the United States.

Dating to the Civil War in its modern incarnation, its ancestral event is the “first thanksgiving” wherein European colonists* chowed down with the Wampanoags who had saved them from starvation in New England.

This moment of apparent amity obviously also presages the near-annihilation of native peoples by those European colonists over the succeeding centuries; even in 1621, the seeds of future conflict were at hand. By the very next year, Wampanoag chief Massasoit would demand the execution of legendary Pilgrim-befriender Tisquantum (Squanto).

So it’s also fitting to remember that this day in 1838** was the execution of Tsali, the hero of those escaped North Carolina Cherokee whom Brown mentions — a man tied to a tree and shot this date by the U.S. Army for resisting “Indian removal”.

While assimilated Cherokees like Chief John Ross were themselves right in the thick of the debate about deportation, Tsali was a traditionalist farmer in North Carolina who had little contact with such sketchy political machinations.

When Washington’s ethnic cleansing policy shed its diplomatic cover for naked force, Tsali and his family killed some of the soldiers sent to capture them for removal.** General Scott was not amused.

The individuals guilty of this unprovoked outrage must be shot down; & there is another object demanding equal & immediate attention, viz: –the protection of the white families, residing in that region, who are, doubtless, much alarmed (& may be in great danger) at the most unexpected spirit of hostility evinced by the fugitive Indians about them by the murders in question.†

And, of course, they were. Tsali is said to die in that fearlessness of the noble savage, a fitting aspect for any martyr at the last.

I have a little boy…If he is not dead, tell him the last words of his father were that he must never go beyond the Father of Waters, but die in the land of his birth. It is sweet to die in one’s native land and be buried by the margins of one’s native stream.

It’s one of those ironies of empire (not unlike Thanksgiving Day itself) that Tsali’s dying wish was made possible by the very fact that other Cherokees collaborated in his death. Or at least, that’s how Tsali came to be remembered.

Other Cherokee with farms outside the boundaries of the formal Cherokee nation were then maneuvering to avoid the effects of the removal treaty — which by its own letter ought not apply to other Cherokee. William Holland Thomas, the remarkable Caucasian-born orphan adopted by the chief of these Cherokee, Dancing Bear, cut a deal with General Scott:

if [Dancing Bear’s Cherokee] would seize Charley [Tsali] and the others who had been concerned in the attack upon the soldiers and surrender them for punishment, the pursuit [for other Cherokee in the Great Smokies] would be called off and the fugitives allowed to stay unmolested … he could secure respite for his sorely pressed followers, with the ultimate hope that they might be allowed to remain in their own country …

It was known that Charley and his party were in hiding in a cave of the Great Smokies, at the head of Deep creek, but it was not thought likely that he could be taken without bloodshed and a further delay which might prejudice the whole undertaking. Thomas determined to go to him and try to persuade him to come in and surrender. Declining Scott’s offer of an escort, he went alone to the cave, and, getting between the Indians and their guns as they were sitting around the fire near the entrance, he walked up to Charley and announced his message. The old man listened in silence and then said simply, “I will come in. I don’t want to be hunted down by my own people.” They came in voluntarily and were shot … one only, a mere boy, being spared on account of his youth.†

Scott honored the deal, goes the story, and those un-removed Cherokee indeed persisted in North Carolina. Whether due to Tsali’s sacrifice or not, they remain there to this day: the Eastern Band of Cherokee Indians, headquartered in Cherokee, N.C.

On November 25, 1838, Tsali was executed … They were ordered to kill him so they could stay in North Carolina. Tsali was killed. We are still here. Tsali is a Cherokee hero.

‡ These Cherokee would form a legion in the Confederate army which actually had the distinction — under then-Colonel William Thomas — of firing the last shots in the Civil War east of the Mississippi.

§ John Finger’s sacred cow-slaying take on the evolution of the Tsali legend in The Eastern Band of Cherokees: 1819-1900 is that only the family turned in voluntarily, but the army left Tsali alone once the younger men were killed, and the old man was mopped up (involuntarily) by the Cherokee themselves: “there was no noble sacrifice … [and] the capture and execution of Tsali little affected the right of the Qualla Cherokees to remain in North Carolina.”

That version would also resolve the apparent discrepancy in the date and number executed, with Tsali captured on the 24th and shot on the 25th.

1879: Three botches in three states

America’s weird love-affair with Frankenstein execution technology has been an occasional theme on this blog, but the fact is that the old-school execution methods these ghastly machines replaced were unpleasantly hit-and-miss.

On this date in 1879, three different U.S. states produced botched executions, each blurbed this New York Times article. (pdf)


One is attracted most readily to the firing-squad execution of murderer Wallace Wilkerson in Utah.

Wilkerson appealed the constitutionality of this method of execution, and in 1879’s Wilkerson v. Utah, the U.S. Supreme Court held that “the punishment of shooting as a mode of executing the death penalty for the crime of murder in the first degree is not” cruel and unusual punishment.

This legal precedent has actually been cited* by the present-day Supreme Court in rejecting legal challenges to lethal injection. Which is ironic, because a couple of months after the high court issued Wilkerson v. Utah, Wilkerson suffered a very cruel execution indeed.

The doomed man talked the officials conducting his execution into allowing him to die without being strapped down. With the resultant range of motion, Wilkerson at the last breath before the fusillade hit him drew his shoulders up as he braced for the impact — and pulled the white target pinned to his shirt above his heart.

The volley didn’t kill him — it just knocked him out of his chair to the ground, screaming “Oh, my God! My God! They have missed!”

He bled to death in 27 minutes, prompting the tongue-in-cheek observation by the Ogden Junction that “the French guillotine never fails.”


Meanwhile, on the very same day in Missouri …

ST. LOUIS, Mo., May 16.–A special dispatch from Booneville, Mo., says: “John I. West, who murdered a tramp last October, was to-day hanged at the Old Fair Ground near this city. When the trap was sprung, at 11:41 A.M., the rope broke, and the culprit fell to the ground on his back, but was too weak to rise. His groans and the gurgling sounds of strangulation were terrible to hear. He was picked up and speedily raised to the trap again, and, while being held by four or five men, was dropped a second time. This time he swung, and in 11 minutes was pronounced dead.

After reaching the platform of the gallows, West spoke nearly half an hour to the crowd present, reiterating his confession of the murder of Shinn, reviewing his past life, and appealing to young men and women to take his fate as a warning. There were about 8,000 people present, among whom was the father of West, who had come from Chapin, Ill.

(There’s a great deal more about West’s crime in the Times article, but it’s pretty dull reading for all the column-inches. He was a tramp who committed a semi-random murder, seemingly activating all the crime-freakout circuits so familiar to cable news programmers.)


Hillsboro, North Carolina, held a first-ever triple hanging — of the “Chapel Hill burglars”. As you might guess, these gentlemen burgled, and said burgling occurred in Chapel Hill. It was for housebreaking, not murder, that they were condemned, with the help of a confederate who turned state’s-evidence against them as soon as the lot was arrested.

Each of the culprits proclaimed his innocence to the last moment. [Lewis] Carlton spoke for an hour, and said his salvation was sure. The parting between [Henry] Andrews and his sister on the scaffold was most affecting, and moved the crowd of witnesses to tears. All the doomed men bore themselves firmly, and showed no signs of wavering. The hanging took place at 2:30 P.M., and was very badly conducted. The ropes around the necks of [Henry Alphonso] Davis and Carlton were too long, and their feet rested on the ground. They were raised up and the ropes retied, causing death by strangulation.

(According to this “history of the University of North Carolina” page, one of the burglars’ victims was writer Cornelia Phillips Spencer. Famous as the woman who rang the bell re-opening UNC in 1875, her role in closing the university in the first place in 1870 and her retrograde racial politics have recently been in Tar Heel news. The linked article suggests that her brush with the Chapel Hill burglars might have given Spencer an appreciation for the Ku Klux Klan’s version of order. After all, a white supremacist vigilante is just a liberal who’s been burgled.)

The St. Louis Globe-Democrat of May 17, 1879 adds of our men’s exit (in an addendum to a report primarily about the aforementioned West) that

[t]he execution was romantic in the extreme. Just as the doomed men ascended the platform a murky cloud, which had been drifting around, hung over the crowd and the instrument of death. Alfonso Davis began to speak, and as he opened his mouth the thunder began to peal, and the rain came down in torrents. Not a man, woman or child in the vast crowd moved or seemed to be aware that the rain was falling, so wrapped up in the death scene were they. At times the cloud threw such a dense shadow over the scene that it seemed as though night had enveloped the place. Then the lightning, vivid and intense, lit up the field of blood and cast forward, in bold and statuesque relief, the figures of the doomed and their executor as he stood like an artilleryman, lanyard in hand, ready to send the signal of death forward … the souls of three burglars went out and beyond, forked lightning illuminating their way and the wildest of thunder pealing their requiem.


The Bayou State redeemed this black day for the executioner’s craft by the uneventful hanging one Robert Cheney (black, of course) “for ravishing Amelia Voight in June, 1878.”

All told, four states killed six men on May 16, 1879, but only two of them died “cleanly.”

1677: William Drummond, for Bacon’s Rebellion

“Mr. Drummond, I am more glad to see you than any man in Virginia; you shall hang in half an hour.”

Virginia Governor William Berkeley didn’t deliver gallows justice as rapidly as promised, but the outcome was just as certain.

Scotsman William Drummond, the former colonial governor of Abermarle and therefore the first governor of North Carolina,

was made to walk to Middle Plantation, about eight miles distant, and tried before a drum-head court-martial, the next day, at the house of James Bray, Esq., under circumstances of great brutality. He was not permitted to answer for himself; his wife’s ring was torn from his finger; he was stripped before conviction, was sentenced at one o’clock and hanged at four. (Source)

There’s nothing worse than a poor winner.

Drummond caught Berkeley’s considerable wrath for associating himself with Nathaniel Bacon’s Rebellion of frontier settlers demanding lower taxes and more energetic genocide against their Indian neighbors. When Berkeley balked, the movement metastasized into a republican revolution which declared the agent of royal authority in Virginia to have abdicated and proposed to reconstitute it by popular convocation.

It was very much short of an actual attempt to separate from England, but in its form and complaints one easily perceives the germ of the American Revolution a century hence. Sarah Drummond was reported to have been at least as vehement as her hanged spouse, and she is credited with prophesying “the child that is unborn shall have cause to rejoice for the good that will come by the rising of the country.”

Armed struggle between two desperate factions was truncated by the fatal case of dysentery* contracted by the namesake insurrectionary. His unpleasant and untimely demise crippled the rising rising, and left Drummond as about the most prominent target available for the victorious Berkeley’s fury.

Not that there wasn’t much more to go around — even when the British navy finally landed in late January with reinforcements too late to do any good, a general amnesty Berkeley had not clemency enough to use, and a successor to Berkeley the aging governor did not like one bit. Nineteenth-century historian George Bancroft in his History of the Colonization of the United States writes of the crackdown,

In defiance of remonstrances, executions continued till twenty-two had been hanged.** Three others had died of cruelty in prison; three more had fled before trial; two had escaped after conviction. More blood was shed than, on the action of our present system [i.e., the constitutional government of the United States], would be shed for political offences in a thousand years. Nor is it certain when the carnage would have ended, had not the assembly convened in February, 1677, voted an address “that the governor would spill no more blood.”

Finally the new guy managed to get Drummond on a boat back to the mother country with an unflattering report of his conduct. The crotchety septuagenarian, who had been a spry mid-30’s courtier when first appointed Virginia governor by Charles I, was coldly received by Charles II. “The old fool,” remarked the sovereign, “has taken more lives in that naked country than I have taken for the murder of my father.”

* “The bloodie flux” was an unsatisfying avenger for his foes, as indicated by the doggerel

“Bacon is Dead, I am sorry at my hart
That lice and flux should take the hangman’s part”

** Some sources put the total number executed at 23, not 22; I have been unable to locate the source of this discrepancy.
