1802: Jacques Maurepas and his entire family

On this date in 1802, a Haitian general, his family, and his men, were butchered by French forces fighting to retain control of Saint-Domingue.

Haing recently mastered the French Revolution, Napoleon Bonaparte — ever one for keeping it in the family — late in 1801 dispatched his brother-in-law* and brother-in-arms Leclerc to suppress the Haitian Revolution.

Over the course of 1802, Leclerc made headway towards accomplishing just that, as much with carrots as with sticks.

Maurepas was one of the Haitian commanders tasked by Toussaint L’Ouverture with defending Saint-Domingue, in his case, Port-de-Paix. Faced with a French landing, Maurepas burned the town to the ground and withdrew for an effective guerrilla resistance in the mountains.

But he eventually came to terms with the French, as did other Haitian officers, L’Ouverture included — reintegrating forces back with the French on the understanding that all that liberte, egalite, fraternite stuff would at least extend as far as not reintroducing slavery.

The French had other plans for their lucrative once-and-future colony, and when the Haitians caught wind of them, trouble resumed — now under the leadership (since the French had sagely deported L’Ouverture) of Jean-Jacques Dessalines.**

Leclerc had the, er, “fortune” of succumbing to yellow fever shortly after Dessalines’ promising revolt got underway; he was succeeded by the brutal Rochambeau, who threw away the carrots and relied on naked violence to control the island. (Again, not uncharacteristic of Napoleonic conquests.)

Maurepas had not actually gone over to Dessalines, but the fact that he was a black Haitian general was reason enough for his white French superior officer to arrest him preventively. Immediately upon assuming command, Rochambeau made an example of Maurepas.

The sea off the Cape was chosen to be the theatre of an execution, unparalleled in what is called civilized life. For fear that Maurepas, who had gained distinction under Toussaint L’Ouverture, after having embraced the side of France, should join the insurgents, Leclerc had written to him to come by sea, with his family and his troop, to take the command of the Cape, which he destined for him as a reward for his services. No sooner had he arrived than he and his soldiers were seized and disarmed. Rochambeau ordered preparations to be made for a barbarous punishment in order to put the negro general to death, with his troop, consisting of 400 blacks. It was also put in deliberation whether death should be inflicted on his children, in order to prevent them from rising up to avenge their father.

After having been bound to the mast of a vessel, Maurepas was frightfully insulted. His wife, his children, and his soldiers were brought to be drowned under his eyes. The executioners were astounded when they beheld a father fix his dying eyes by turns on his children, his wife, and his companions in arms, undergoing a violent death; while they, on their part, turned their eyes away from a father, a husband, a general, whose countenance was disfigured by the tortures he was enduring. After being made to contemplate each other’s sufferings, they were all tossed into the ocean. They died without complaining in a manner worthy the champions of liberty. With a reversal of the order of nature, the father died last; he also suffered most.

Thus died Maurepas, whose character was a compound of frankness and severity. Thrice had he repulsed the French at the gorge of Trois-Rivières; he had at once the glory and the misfortune to go over to the French with victorious arms. The elevation of his soul equalled his valor. He preserved a tender feeling for the master whose slave he had been; he caused funeral honors to be paid to that master, and when his grave had been negligently prepared, he threw off his upper garment in order to perform the pious office properly. Among men of his own blood he was a powerful chief. A spirit of order and justice prevailed in his life. His riches, which were considerable, were given up to pillage. It would almost seem as if so much excellence were subjected to so much ignominy, expressly to show that while black men are capable of any virtue, white men are capable of any crime. Certainly, my narrative is replete with instances which, beyond a question, prove that moral as well as mental excellence is independent of the varieties of color.

This brutal punishment, preceded by vile perfidy, filled the camps of the insurgents with horror. That horror was augmented when Rochambeau, at the Cape, put to death five hundred prisoners. On the place of execution, and under the eyes of the victims, they dug a large hole for their grave, so that the poor wretches may be said to have been present at their own funeral.

Far from cowing the rebels into submission, this savagery fired more ferocious resistance from men, women, and children who now perceived that their race subjected them to wholesale and arbitrary cruelty that no display of loyalty could overcome.

A terrible retribution was determined upon. Dessalines erected 500 gibbets, and hanged half a regiment of French that he had captured by a bold countermarch. A war of extermination followed, and in December, 1803, aided by an English squadron, the French were compelled to evacuate the island.

January 1, 1804 is Haiti’s Independence Day.

* By way of marriage to Napoleon’s sister Pauline. Pauline enjoyed the Saint-Domingue adventure more than did her spouse; she sported with lovers and balked at returning to France. “Here,” she noted, “I reign like Josephine; I hold first place.”

1724: Jack Sheppard, celebrity escape artist

“Yes sir, I am The Sheppard, and all the gaolers in the town are my flocks, and I cannot stir into the country but they are at my heels baaing after me.”

On this date in 1724, the hangman finally got Jack Sheppard.

Sheppard was a thief, a romantic hero, a highwayman of the urban proletariat, a Houdini whom no prison could hold.

It had become possible in his time to ride criminal notoriety into celebrity: Jack Sheppard, a mere 22 at his death, proved as adept with that quicksilver element during his personal annus mirabilis of 1724 as he was with a lockpick.

Sheppard’s world had him fitted to wield a hammer better than thieves’ tools — but at about age 20, a young man awash in the illicit liberty of London’s underbelly, he ditched the square carpenter to whom he was apprenticed to live free by his wits.

Peter Linebaug’s The London Hanged finds in Jack Sheppard’s career and his runaway popularity an important marker of the capital city’s “refusal of subordination: — contra Foucaultian discipline, which “makes the rulers of government and society seem all-powerful.”

An important meaning of liberation … [consisted of] the growing propensity, skill and success of London working people in escaping from the newly created institutions that were designed to discipline people by closing them in. This tendency I have dubbed ‘excarceration’ because I wish to draw attention to the activity of freedom in contrast to its ideological or theoretical expressions…

This lithe youth is most famous for his literal talent for freedom: four times in 1724 he escaped from custody in ever more dramatic fashion.

He busted out through the ceiling of St. Giles Roundhouse. He rappelled with a bedsheet rope down the 20-foot wall of Clerkenwell Prison with his lover.

This sort of thing won the enterprising rogue growing folk hero status. The vaunted Sheppard “made such a noise in the town, that it was thought the common people would have gone mad about him, there being not a porter to be had for love nor money, nor getting into an ale-house, for butchers, shoemakers and barbers, all engaged in controversies and wagers about Sheppard.”*

It also drew the unwanted attention of 1720s London’s Jabba the Hutt: “thief-taker” Jonathan Wild, who managed a vast thieving cartel enforced by Wild’s willingness to turn in non-participants in his ingenious cover role as the city’ preeminent lawman. That’s some protection racket.

Sheppard, to the fame of his memory, scorned obeisance to the crime lord as much as to any guild carpenter and worked for no man but himself. A vengeful Wild shopped him to the authorities.

This time, Sheppard was actually condemned to death for burglary but broke prison again, using yet another classic ruse: the “disguised in smuggled women’s clothes.”

Back on the lam, he posted a cocky letter to his executioner “Jack Ketch” giving his regrets at not having joined two fellow-sufferers on the scheduled hanging date. (September 4.)

I thank you for the favour you intended me this day: I am a Gentleman, and allow you to be the same, and I hope can forgive injuries; fond Nature pointed, I follow’d, Oh, propitious minute! and to show that I am in charity, I am now drinking your health, and a Bon Repo to poor Joseph and Anthony. I am gone a few days for the air, but design speedily to embark, and this night I am going upon a mansion for a supply; its a stout fortification, but what difficulties can’t I encounter, when, dear Jack, you find that bars and chains are but trifling obstacles in the way of your Friend and Servant

London’s finest were determined to put an end to this character’s preposterous run of prison breaks, so when they caught him the fourth time Sheppard found himself loaded with manacles and chained to the floor of a special strongroom in Newgate Prison. Get out of that, Jack.

Somehow, Jack got out of it.

On the night of Oct. 14, Sheppard authored the sublimest breakout in Newgate’s voluminous annals. Picking the locks of his fetters with a small nail, our acrobat scurried up a chimney, picked, prised, or otherwise passed a succession of locked doors in the dead of night, paused to rest on the condemned pew of the gaol chapel, forced a grille, reached the roof, and threw another homemade rope over the wall to scamper down to safety.

And then “he promptly went forth and robbed a pawnbroker’s shop in Drury Lane of a sword, a suit of apparel, snuff boxes, rings, &c., and suddenly made a startling appearance among his friends, rigged out as a gentleman from top to toe.”

There’s no doubt but that Jack had showmanship, but at a certain point he could have done with just the tiniest measure of discretion. But then, this was a man writing his own legend. Sure, he could have put his head down and tried to disappear into some nameless Puritan settlement in the New World. (His distraught mother kept telling him to get out of the country.) He traded those dull and toilsome years for the fame of generations: his candle burned at both ends.

When next Sheppard was detained, it was towards his apotheosis. It was the only time he would be arrested and fail to escape.

A throng of thousands mobbed London’s route to execution this date, almost universally supporting the ace escapologist. And Sheppard very nearly had for them the piece de resistance in his career of magical disappearances: it was only at the last moment before boarding the fatal tumbril that Sheppard’s executioners found the penknife their prey had secreted on his person, evidently intending to cut his cords and spring from the cart into the safety of the surging crowd. What an exploit that would have been.

This indomitable soul has enjoyed a long afterlife as a subversive hero.

A celebrity in his own time, his execution-eve portrait was taken by the Hanover court painter himself, James Thornhill. Sheppard is a very likely candidate as an inspiration for the criminal Macheath in The Beggar’s Opera completed just a few years after his death; likewise, his abandoned apprenticeship makes him the most apparent model for Hogarth‘s “idle prentice” plates.

A century later, prolific historical novelist William Ainsworth** claimed the convict-martyr for an 1839 retelling. This popular potboiler — read it free online here — came in for a spate of 19th century social panic when it was learned that a notorious servant-on-master murder had been carried out by a young man who had recently read it. A two-decade ban on public plays based on the Jack Sheppard novel ensued.

For as much as Jack Sheppard is romanticized in his remarkable individual characteristics, his story has always had a class undertow that raises the hackles of the powerful — and is celebrated by the people who menace that power. Linebaugh, again:

Jack Sheppard, housebreaker and gaol-breaker, was once the single most well-known name from eighteenth-century England. His fame spread across oceans and the centuries. When the bandit Ned Kelly was alive, the Australian press was full of comparisons between him and Sheppard. At the same time on the other side of the globe in Missouri, Frank and Jesse James wrote letters to the Kansas City Star signed ‘Jack Sheppard’. In England his name cut deep into the landscape of popular consciousness. Henry Mayhew noted that Cambridgeshire gypsies accepted Sheppard stories as the archetype of ‘blackguard tales’. Among English sailors anyone with the surname of ‘Sheppard’ was automatically called ‘Jack’. Within the Manchester proletariat of the 1840s his name was more widely known than that of the Queen herself. One of these lads said, ‘I was employed in a warehouse at 6s. 6d. a week, and was allowed 6d. of it for myself, and with that I went regularly to the play. I saw Jack Sheppard four times in one week.’

The oral history of Sheppard has maintained his memory within human contexts where books were scarce and working-class resources for an independent historiography were non-existent. Moreover, that memory was kept in contexts of social struggle in which a continuity, if not a development, with earlier moral and political conflicts was suggested.

1781: Tupac Katari

On or about this date in 1781,* the native Aymara revolutionary Tupac Katari (or Tupac Catari, or Tupaj Katari) was torn apart in the Bolivian village of Penas — a messianic warning on his lips of his Spanish captors’ future comeuppance.

Hard on the heels of Tupac Amaru‘s public dismembering in nearby Cuzco (present-day Peru), Julian Apasa Nina took up the name and mantle of recent Bolivian insurgent Tomas Katari.

Julian Apasa’s new name Tupac Katari was as ambitious as his plans, for he took the thousands of indigenous Americans who flocked to his banner and laid siege to La Paz from the adjacent El Alto.**

The object was not mere plunder, but rolling back Spanish domination full stop.

A friar who met Katari reported that the Spanish tongue was forbidden on pain of death, and the rebel leader aimed to “totally separate himself from all Customs of the Spanish.” (Source) He did not shrink from ferocity to achieve his ends, hanging captives outside the walls of the city, enforcing military discipline ruthlessly. (Source) The Aymara fought with “a spirit and pretentiousness so horrible that … it can serve as an example as the most valiant nation.” (Source)

Though the siege† reduced Spanish defenders to eating bark and horseflesh, and starved out thousands, the city held out and the siege was at length lifted and Tupac Katari betrayed into his enemies’ hands.

Condemned to death (a fate his wife Bartolina Sisa would share months later), Katari was lashed to four horses who strained until his body ripped into quarters suitable for placarding towns of the district. But before he went, Katari bequeathed posterity a legendary final sentiment.

“I shall return, and I shall be millions.”

* It appears that the primary sources themselves are unclear on the precise date, and there are citations for the execution taking place anywhere from Nov. 13 to Nov. 18. Nov. 15 appears to be the best-preferred by scholars, or the co-number one with Nov. 14, and we’re inclined to prefer this date because of the 20th century Indian social justice movement which explicitly cited Katari’s inspiration — the Movimiento 15 de Noviembre (more in Spanish). It’s part of an entire political tendency in Bolivia called Katarismo. If the date is good enough for the Aymara, it’s good enough for this blog.

That wasn’t the only 20th century movement to situate itself as Katari’s heirs. A set of Marxist indigenous guerrillas styled themselves the Tupac Katari Guerrilla Army, and a former member of this Che-inspired militia is currently Bolivia’s vice president.

1960: Phineas Tshitaundzi, the panga man

On this date in 1960, South Africa conducted a mass execution of 15 miscellaneous criminals (14 black, one white) in Pretoria Prison.

The headline attraction was one of the 14 blacks: Phineas Tshitaundzi, the “panga man” or any number of related headline-worthy nicknames — the panga slasher, the panga maniac. (“Panga man” can also just be any old fellow with a panga, like an agricultural worker.)

A panga is a machete, and Phineas Tshitaundzi wielded this intimidating instrument during a 1950s spree terrorizing white lovers’ lanes around Johannesburg. “He would assault the men and rape the women — to whom, it was said, he then gave bus fare home,” wrote Jean and John Comaroff in Law and Disorder in the Postcolony.* “There could hardly have been a more intense figuration of the dark, erotically charged menace that stalked the cities in the white imagination.”

The assaults were non-fatal — panga man was the only one of the 14 blacks hanged this day not on the hook for murder — but the many survivors whose affairs were on the illicit side had injuries to cope with beyond those inflicted by the blade.

Tshitaundzi was finally caught as a result of fencing some of the proceeds of his crimes, whereupon it transpired that the terrifying perpetrator had been so difficult to capture because he’d been working as a mild-mannered 40-year-old “tea boy” at police headquarters itself, a position that allowed him to stay wise to various attempts to ensnare him.

The terrible “panga man” was installed in a kitschy exhibit in the police museum opened by his employes turned captors.

1663: Corfitz Ulfeldt, in effigy

On this date in 1663, Danish noble Corfitz Ulfeldt — then a fugitive abroad — was executed in effigy.

Ulfeldt (English Wikipedia page | Danish) is notorious as his country’s greatest traitor.

To commit great betrayals, one needs to begin with great trust. Ulfeldt was the son of a chancellor and was married off to Leonora Christina, the daughter of King Christian IV.

When Christian died, Ulfeldt was the de facto ruler of the realm or a few months in 1648 while the elective monarchy sorted out where to pass the crown next.

The choice ultimately fell to the late king’s son Frederick III, but this saturnine prince was distrusted by the Danish nobility, who forced on him as the price for his power a Haandfaestning — a sort of temporary Magna Carta circumscribing a monarch’s power for the period of his individual reign. It set a less than comradely tone for the two men’s relationship.

In 1651, an accusation surfaced that Ulfeldt was in on a plot to poison the king — an accusation that cost Ulfeldt’s lover her own head. Deciding that he didn’t need to be around when the next specious regicide allegation made the rounds, Ulfeldt pre-emptively fled the country.

From there, Ulfeldt’s lust for power and personal enmity for Frederick would light his path to infamy.

He signed up with Sweden’s King Charles X — Denmark’s greatest foreign rival — and mounted an invasion of his native country, possibly even financed by stolen Danish treasure. Rewarded with a Swedish noble title, he promptly began double-dealing against them, until his disgusted new sovereign dispossessed him, leading Ulfeldt to return hat in hand to Copenhagen.

Imprisoned there for that whole leading-an-enemy-invasion incident, Ulfeldt again managed to wriggle out and immediately tried to raise a German army against Denmark. Really — enough, dude.

Frederick certainly thought he’d seen enough too. Not having the compulsive traitor available to execute bodily, he resorted to the weird ritual of punishing a mannequin, and ordered the prison governor:

Know that you have to command the executioner in our name, that to-day, November 13, he is to take the effigy of Corfitz, formerly called Count of Ulfeldt, from the Blue Tower where it is now, and bring it on a car to the ordinary place in the square in front of the castle; and when he has come to the place of justice, strike off the right hand and the head, whereafter he is to divide the body into four parts on the spot, and carry them away with him, whilst the head is to be placed on a spike on the Blue Tower for remembrance and execration.

A few months after, the hunted Ulfeldt was reported to have died in Switzerland, a report considered highly suspicious in his native land. Nevertheless, he was never captured or heard from again, so whenever or however he died, it seems he managed to cheat the executioner of his flesh. As to the judgment of posterity: that, he had long since squandered.

The royal and loyal widow Leonora Christina enjoys a reputation quite a bit more favorable than her husband. She swallowed every draught of his exile, and more — remaining imprisoned under harsh conditions long after Corfitz’s death, only released in 1685 with the passing of King Frederick’s wife, her vengeful personal enemy. In that time, and in between fending off in her dungeon the local vermin, lecherous jailers, and the poison of personal bitterness, she wrote voluminous and well-regarded memoirs.

1793: Jean-Sylvain Bailly, moonstruck

See Bailly, likewise of Paris, time-honoured Historian of Astronomy Ancient and Modern. Poor Bailly, how thy serenely beautiful Philosophising, with its soft moonshiny clearness and thinness, ends in foul thick confusion — of Presidency, Mayorship, diplomatic Officiality, rabid Triviality, and the throat of everlasting Darkness! Far was it to descend from the heavenly Galaxy to the Drapeau Rouge: beside that fatal dung-heap, on that last hell-day, thou must ‘tremble,’ though only with cold, ‘de froid.’ Speculation is not practice: to be weak is not so miserable; but to be weaker than our task. Wo the day when they mounted thee, a peaceable pedestrian, on that wild Hippogriff of a Democracy; which, spurning the firm earth, nay lashing at the very stars, no yet known Astolpho could have ridden!

On this date in 1793, French astronomer turned revolutionary Jean-Sylvain Bailly was guillotined during the Paris Terror.

Bailly ditched a family trade in the arts — his father was a supervisor at the Louvre — and turned his gaze skyward.

Studying astronomy under Lacaille, Bailly made a quick splash in astronomical circles with meticulous work on Halley’s Comet and the moons of Jupiter. He was inducted into the French Academy of Sciences while still in his twenties. Not quite the guy every schoolchild knows, but a significant scientist in his time. As one twentieth-century reviewer put it,*

Bailly was not a great thinker or the discoverer of new concepts; no case can be made for placing his name beside those of Newton, Leibnitz, and Laplace. But he should not be denied a niche among the numerous competent and persevering work-a-day scientists who, perhaps, in the long run make possible the achievements of a few great men. His observations and reductions, his application of a mathematical discipline to the movements of the heavenly bodies, and his detailed publications had brought him, by 1766, considerable credit among fellow scientists.

His “considerable credit” in the public sphere, enhanced by his widely-admired writing, set him up for election to the Estates-General in 1789. Indeed, Bailly was elected to head the body’s Third Estate.

On June 20th of that pregnant year, days after the Estates-General had constituted itself a National Assembly with ambitions far outstripping the limited purpose of revenue collection the king intended them for, Louis XVI locked the delegates out of their meeting-room.

Bailly, in consequence, would lead one of the pivotal actions of the embryonic French Revolution. “I do not need to tell you in what a grievous situation the Assembly finds itself,” he said to the assembly reconvened at a nearby tennis court. “I propose that we deliberate on what action to take under such tumultuous circumstances.” The result of that deliberation was the Tennis Court Oath.

When the Paris provost — an archaic municipal office — was shot by the mob on Bastille Day, Bailly became the City of Light’s first mayor.

But as with other principals of the Revolution’s earliest stirrings, like Bailly’s ally Lafayette, the man was left behind by the rapid progress of events. He’d been two years retired out of public service in Nantes when he was hailed before the Revolutionary Tribunal on the preposterous charge of having conspired in Louis XVI’s attempted flight and guillotined on that basis.

A lunar crater — the largest crater visible from earth — is appropriately named after this prolific observer of the heavens.

1880: Ned Kelly

On this date in 1880, legendary bushranger Ned Kelly hanged at Melbourne Gaol.

The Dick Turpin of Australian outlawry — in the sense that he’s the first name on the marquee — Kelly was the son of an Irishman shipped to Van Damien’s Land on the British convict transportation plan.

Setting down in Greta, Victoria the Kelly family cultivated a keen reputation for criminality (e.g., see this 1880 newspaper article; also, here).

When Ned was all of 11, pa died doing a six-month prison stint at hard labor for stealing a neighbor’s cow, and it wasn’t much longer before young master Edward was making the acquaintance of the law himself: arrested for assault in 1869 at age 14; arrested once again the following year as an accomplice to the bushranger with the pornstar name, Harry Powers; imprisoned later in 1870 for three years for receiving stolen goods … and then he got into the family horse-rustling racket upon his release. Crime and gaol were just part of Ned’s world.

So was police antagonism.

The man’s famous last years started with what reads as a trumped-up run-in with a cop who turned up at a station complaining that the Kellys had shot him. (The Kelly story is that he got fresh with Ned’s sister and got whacked by a shovel.) Whatever the facts of the matter, it sent Ned and his brother Dan into the bush as fugitives.

At Stringybark Creek, the “Kelly gang” got the drop on the police posse sent to arrest them, and three officers died in the firefight. Now there was real trouble.

An 1878 “Felons Apprehension Act” immediately proscribed the men, making it “lawful for any of Her Majesty’s subjects whether a constable or not and without being accountable for the using of any deadly weapon in aid of such apprehension whether its use be preceded by a demand of surrender or not to apprehend or take such outlaw alive or dead.”

The ensuing two-year saga was a captivating cycle of dramatic robberies, escalating government bounties, state hostage-taking in the form of imprisoned family and friends, and Kelly’s own Joycean self-vindication.

he would be a king to a policeman who for a lazy loafing cowardly bilit left the ash corner deserted the shamrock, the emblem of true wit and beauty to serve under a flag and nation that has destroyed massacreed and murdered their fore-fathers by the greatest of torture as rolling them down hill in spiked barrels pulling their toe and finger nails and on the wheel. and every torture imaginable more was transported to Van Diemand’s Land to pine their young lives away in starvation and misery among tyrants worse than the promised hell itself all of true blood bone and beauty, that was not murdered on their own soil, or had fled to America or other countries to bloom again another day, were doomed to Port Mcquarie Toweringabbie norfolk island and Emu plains and in those places of tyrany and condemnation many a blooming Irishman rather than subdue to the Saxon yoke Were flogged to death and bravely died in servile chains but true to the shamrock and a credit to Paddys land.*

The hunt culminated in a cinematic shootout at the Glenrowan Inn, Kelly an accomplices entering the fray clad in bulky but effective homemade body armor they’d literally hammered out of ploughshares. (It’s thanks to the armor’s protection of his head and trunk that Ned Kelly survived the Glenrowan siege so he could be hanged instead.) Now on display at the State Library of Victoria, it’s the most queer and recognizable artifact of an era that was already then slipping into the past.

I do not pretend that I have led a blameless life or that one fault justifies another; but the public, judging a case like mine, should remember that the darkest life may have a bright side, and after the worst has been said against a man, he may, if he is heard, tell a story in his own rough way that will lead them to soften the harshness of their thoughts against him and find as many excuses for him as he would plead for himself.

This cut no ice with the men who judged him guilty of murder, but the brawler, cop-killer, bank-robber Kelly seems to have found a way to tell that story to posterity and its thoughts have softened very much indeed.

Everything from his hardscrabble upbringing to his romantic man-against-the-world criminal career to his iconic robot-suit armor to his existentially heroic last words “such is life” equips his image for posthumous appropriation. He seems one-half charming anachronism, one-half hirsute postmodern avatar, especially when you go sculpt a mailbox out of him.

131 years dead today, Ned Kelly remains very much alive in memory. To this day, descendants and supporters lay flowers at the Melbourne Gaol where he hanged, and the recent decision to release his remains for reburial (as Kelly himself requested) made national headlines.

As to Kelly in the wider culture … well, you can’t escape him.

1834: The bushrangers John Jenkins and Thomas Tattersdale

Cried Peter, where’s your certificate
Or if you have not one to show
Pray who in Heaven do you know?

And lastly were by Jack Ketch strangled.

On this date in 1834 was strangled the aforementioned Jenkins — John, to his friends — alongside accomplice Thomas Tattersdale for one of 19th century Australia’s headline-grabbing crimes.*

Along with a third man who would turn state’s evidence to save his own neck, these convicts busted out of jail.

On the run in the bush, these fugitives came across the massive estate of Dr. Robert Wardell, a prominent public figure in early Australia. When this newspaper publisher, barrister, and land magnate personally bumped into the trio, he naturally urged the prisoners to give themselves up. Instead, John Jenkins shot Wardell dead.

These outlaws were definitely not of the gentleman variety.

Tattersdale, a non-triggerman who had actually tried to talk Jenkins out of killing Wardell in the first place, sported a suitably Dostoyevskyan appreciation of his own guilt, and basically just asked the court for a few days to prepare his soul. Jenkins made the trial a three-ring circus with his profane attacks on the court, and his bodily attack on his fellow-defendant when he learned that Tattersdale had offered to testify for the crown. (Tattersdale weepily made up with an irritated Jenkins at the time of their hanging, which was only three days after they were condemned.)

Tattersdale’s lamblike submission just got him written out of the ballads; even the newsmen covering the hanging itself “did not much regard” him.

Jenkins, by contrast, stole the show “with that vulgar attempt at bravado courage which distinguishes men of his class.” He’d been joking about his hanging since the trial, and he played cocksure right up to the time they dropped the trap on him — including a distinctly unauthorized last comment on his life and crime.

Well, good bye my lads, I have not time to say much to you. I acknowledge I shot the Doctor, but it was not for gain, it was for the sake of my fellow prisoners because he was a tyrant and I have one thing to recommend you as a friend, if any of you take the bush, about every bloody tyrant you come across, and there are several now in the yard who ought to be served so.

* An unrelated criminal named McCormick died with them, for murdering his wife.

1842: Stephen Brennan, desperate bushranger

From the 1908 History of the Australian Bushrangers:

Stephen Brennan was sent to the island for bushranging. He was tried there and found guilty of the murder of another convict. There had been no quarrel between the two men, who were as friendly as circumstances permitted under the rigid discipline, nevertheless Brennan suddenly struck Patrick Lynch a blow with a stone-breaker’s hammer, and then stabbed him with a knife. The murder was committed avowedly so that the perpetrator might be hung, and thus escape the harsh treatment he was subjected to, and it is not improbable that it was committed with the consent of the victim, for although there is no evidence of this in this case, it is well known that men had actually drawn lots in Norfolk Island, to decide which should murder the other and get hung for the crime.

This is a very compelling parable, but as a factual matter we’re not sure the basis of the word “avowedly” here; be that mutual lot-drawing trend as it may, the reporting accessible from the National Library of Australia archives suggests that Brennan mounted a vigorous defense, and continued to claim to the foot of the gallows that the homicide was strictly self-defense.

Incidents of “suicide by hangman” had been known among the prison population under the island’s rigorous recent commandant, Joseph Anderson.

But in the early 1840s, the once notoriously draconian penal colony was being run by noted reformer Alexander Maconochie, who relaxed prison discipline with mixed results. (Rougher varieties of discipline would be reimposed thereafter, contributing to the prison riot that resulted in the hanging of bushranger Jackey Jackey.)

1861: Sushun, by Empress Dowager Cixi

One hundred fifty years ago today, Qing China’s last great ruler, the Empress Dowager Cixi, having seized the helm of the state she would drive for 47 years, had her deposed predecessor executed.

Formally, China was being “ruled” at this time by the illustrious Tongzhi Emperor, age five.

This child’s old man, depressively self-medicating at the drubbing China was taking in the Second Opium War, had died young, leaving his only son the throne, in care of a council of regents.

As one of the late monarch’s key advisors, Sushun was among that eight-strong panel, and he was popularly regarded as the worst of the lot — vicious, drunken, spendthrift, and just the guy to blame (along with co-regents Zaiyuan and Duanhua) for all the vicious, drunken, and spendthrift stuff the deceased emperor had put his seal to. Or, just the sort of stories trumped up by the rivals of the man really steering the state. Either way is good.

More perilous for Sushun was his burgeoning rivalry with “the Concubine Yi,” the master of harem politics and mother of the new boy-emperor. She had long distrusted the courtier.

Recast in both title and name with her lover’s passing, the woman now known as “Empress Dowager Cixi” was able to obstruct the regency’s policies. And she did one better than that, intrepidly allying with disgruntled princes to engineer a coup d’etat against Sushun’s faction.

The end of Sushun’s regency arrived within months, and transpired within days: less than a week separated Sushun’s liberty from his beheading in a vegetable market. (Striking a liberal pose, Cixi declined to have him put to death by lingchi.) Cixi’s side simply took him into custody, decreed his execution on the attainder of a secret committee, and speedily carried it out. Zaiyuan and Duanhua were ordered to commit suicide the same day.

“Surely,” wrote a British diplomat who had only barely avoided execution at the hands of the lately toppled regime, “we may trace the finger of God in these events, and trust that they augur well for the future of China … we yet may see peace or order return to this poor torn country.” Peace and order and a robust opium market, he meant.

But whatever the form, the poor torn country was in the hands of the Empress Dowager Cixi from here on in.

For a half-century, she would be the consummate survivor — but it was survival during an epoch of terminal decline for the Qing. Riven by conflicts within and without, the imperial system simply couldn’t adapt.

And when the cagey Empress Dowager finally died in her 73rd year, the whole enterprise came apart.

On her deathbed in 1908, Cixi named as emperor the toddler Puyi. A few years later, revolution ensured that Puyi would be the last person ever to hold that title.
