1822: The audacious Denmark Vesey

On this date in 1822, white South Carolinians hanged the most terrifying slave insurrectionary who never rose — and breathed a sigh of relief as they clamped the shackles ever tighter upon their groaning servile class.

Inspired by slave revolts shaking the Caribbean, the Denmark Vesey plot was the South’s worst nightmare: Nat Turner, multiplied by about nine thousand.

That’s the size of the slave and free black network Vesey is said to have recruited — ready to undertake a coordinated uprising to seize Charleston, slaughter the white populace, and possibly then to sail for a Haiti whose own slave revolt had recently established it a black-governed republic. The mind boggles at such a scheme’s bravado … but in an age when horseshoes and mizzenmasts could outrun information, Vesey’s plot could have been past any prospect of obstruction before anyone in a position to obstruct it even knew what happened. Had they not flown but defended Charleston, the event would have ignited a conflagration to outshine every other slave uprising.

The weak point, of course, were those 9,000 — or however many — slaves who had to act ruthlessly and in unison, and keep their peace until they struck. It is incredible enough that such a secret kept among so many for up to four years.

The plot finally leaked mere days before it was to have been attempted when a middling player attempted the unnecessary freelance recruitment of a house slave — a class Vesey had intentionally (and rightly, events would prove) excluded for dangerously excessive personal loyalty to their masters’ families.*

Melancholy Dane

A well-educated and well-traveled man on account of his years as the personal property of a slaver — Joseph Vesey, who bequeathed his purchase both a surname and the given name Telemaque, subsequently corrupted into “Denmark” by Charlestonians — the plot’s signature hero/villain had managed to purchase his freedom and establish himself in the anomalous position of free black artisan/entrepreneur in the slaveholding South.

His successful carpentry business (apt choice, for a martyr) had given him the prestige and the werewithal to start an independent African Methodist Episcopal church where he poured out a hatred of chattel slavery undiminished by his own liberty.

For several years before he disclosed his intentions to any one, he appears to have been constantly and assiduously engaged in endeavoring to imbitter [sic] the minds of the colored population against the whites. He rendered himself perfectly familiar with those parts of the Scriptures which he could use to show that slavery was contrary to the laws of God; that slaves were bound to attempt their emancipation, however shocking and bloody might be the consequences … (Source)

His judges were later incredulous that he’d be so hung up about it:

It is difficult to imagine, what infatuation could have prompted you to attempt an enterprise so wild and visionary. You were a free man, comely, wealthy, and enjoyed every comfort compatible with your situation. You had, therefore, much to risk and little to gain.

An American Spartacus?

Denmark Vesey blurs into myth as he approaches his end, together with lieutenants: among them, Peter Poyas, the organizational maven of the operation who was hanged along with Vesey and four others; and Gullah Jack, an African priest among the 29 more who would die in the weeks ahead.

Most of the principals held their tongues before interrogators; the tribunals were held secretly; their records were censored against the apprehension by other slaves of the potential for such designs as “a bottle with poison to put into my master’s pump & into as many pumps he could about town.”

But there was enough known to shatter forever any illusion of paternal congeniality more liberal masters might have fancied. One planter was incredulous that his agreeable charge might be involved in such nefarious doings until he asked the man directly and was astonished to hear from his trusted coachman’s lips the frank intention “to kill you, rip open your belly and throw your guts in your face.” (Both quotes are from this book review.)

Whites were scared. “I have never heard in my life, of more deep laid plots or plots more likely to succeed,” wrote Anna Haynes Johnson, niece to Gov. Thomas Bennett. (Source) Another concluded that “our NEGROES are truly the Jacobins of the country.” (Source)

But as initial panic (and federal troop deployments) gave way to a more pervasive undertow of security paranoia, the affair was self-consciously downplayed and records intentionally destroyed for fear that too-careful documentation of its particulars could map the way for a revival. An 1861 piece in The Atlantic — an excellent read on the progress of the conspiracy — grapples with what was even then a gaping evidentiary vacuum.

The intense avidity which at first grasped at every incident of the great insurrectionary plot was succeeded by a distaste for the memory of the tale; and the official reports which told what slaves had once planned and dared have now come to be among the rarest of American historical documents. In 1841, a friend of the writer, then visiting South Carolina, heard from her hostess for the first time the events which are recounted here. On asking to see the reports of the trials, she was cautiously told that the only copy in the house, after being carefully kept for years under lock and key, had been burnt at last, lest it should reach the dangerous eyes of the slaves. The same thing had happened, it was added, in many other families. This partially accounts for the great difficulty now to be found in obtaining a single copy of either publication; and this is why, to the readers of American history, Denmark Vesey and Peter Poyas have been heretofore but the shadows of names.

Antebellum September 11

Even as a nonstarter, the insurrection was an antebellum 9/11 that spurred a reactionary crackdown on perceived liberalities in the system — most vividly symbolized by the construction of the fortress that became the still-extant military academy The Citadel, but more systematically impinging blacks’ everyday freedom to assemble and worship, and even requiring (until the Supreme Court overruled the law) free black sailors be detained whenever a northern ship called at port. Pro-slavery southerners blamed open disapprobation for slavery voiced in Congress during the recent Missouri Compromise wrangling, and even similar sentiments expressed in the British parliament, for emboldening the terrorists.

All this yielded a rich political harvest from the fruit of the gallows — like Charleston mayor James “there is nothing they are bad enough to do, that we are not powerful enough to punish” Hamilton, who rode his timely suppression of the plot to Congress later that year.

Such political profiteering, combined with the sketchiness of primary sources, has licensed a revisionist take on the orthodox history — that there was never any conspiracy, but that reactionary white elites concocted the plot from a tissue of loose liberation talk, false confessions, and latent white fear in order to win political power. This contested minority interpretation has been a recent topic of academic dispute, since Michael P. Johnson floated it in 2001 (an account is required to read Johnson’s original essay; here’s a synoptic article that appeared subsequently in The Nation).

Markers of historiography around these competing versions of Vesey, bearing directly on the question current in today’s Charleston of whether and how to memorialize this episode, are ripe with controversial modern-day implications.

Consider: if Vesey is a rebel indeed, the silence of (most of) the plotters is a noble acceptance of torture to protect their confederates; if they’re framed, they’re silent because there’s nothing to confess. Either way, the modern reader’s sympathies are likely to lie with the blacks, but Johnson’s interpretation removes the locus of action from them to white elites. If he’s right, would that derogate an entire narrative of black resistance to slavery, drain the martyrdom from their deaths? Or would it correct an overstated romantic mythology of armed resistance, and color this day’s hanging with a different heroism: refusing to purchase their lives with a false accusation?

1882: Charles Guiteau, James Garfield’s colorful assassin

On this date in 1882, America’s weirdest assassin recited fourteen verses of the Gospel of Matthew and (sans requested orchestral accompaniment) a poem of his own composition entitled “I am Going to the Lordy,” and was hanged in the District of Columbia jail for shooting forgettable Gilded Age president James Garfield.

Mad as a march hare, Charles Julius Guiteau had irritated the obscure reaches of the Republic near four decades, trying his hand at free love, law, newspapering* and evangelism. A contemporary account of his religious flimflammery survives:

Charles J. Guiteau (if such really is his name), has fraud and imbecility plainly stamped upon his (face). (After) the impudent scoundrel talked only 15 minutes, he suddenly (thanked) the audience for their attention and (bid) them goodnight. Before the astounded 50 had recovered from their amazement…(he had taken their money and) fled from the building and escaped.

Having failed at each characteristic American monkeyshine more comprehensively than the last, he naturally gravitated to politics; while today Guiteau might tilt with his psychoses on some vituperative blog, in 1880 he published and delivered as a speech a widely-ignored crackpot encomium** for his eventual victim. Guiteau reckoned the GOP carried the 1880 elections on the strength of such rhetorical thunderbolts as “some people say he [Garfield] got badly soiled in that Credit Mobilier transaction but I guess he is clean-handed.”

Stunned that his contributions did not earn him a diplomatic posting to France, Guiteau stepped out of obscurity and into this blog’s pages by shooting the ungrateful (and unguarded) executive in the back at a Washington, D.C. train station (since demolished, and today occupied by the National Gallery of Art).

“To General Sherman: I have just shot the President. I shot him several times as I wished him to go as easily as possible. His death was a political necessity. I am a lawyer, theologian, and politician. I am a stalwart of the Stalwarts. I was with Gen. Grant, and the rest of our men in New York during the canvass. I am going to the Jail. Please order out your troops and take possession of the Jail at once. Very respectfully, Charles Guiteau.” (Click for the full image.) From the Georgetown Charles Guiteau collection.

Thoughtfully, he had already hired a cab to take him to jail, where he expected to be liberated by General William Sherman.

Malpractice

The bugger of Garfield’s assassination is that Guiteau was no better at killing presidents than he was at electing them. Despite his exultation “Arthur is President now!”, he actually inflicted what could have been a non-fatal flesh wound that through ten-thumbed medical intervention became an agonizing eighty-day Calvary for the miserable Garfield.

Doctors jabbed unwashed hands into the the wound, failing to dig out the bullet they were looking for but successfully turning the three-inch wound into a crater, puncturing Garfield’s liver, and passing him Streptococcus. Alexander Graham Bell invented a metal detector to find the missile, but the damn thing gave a bad reading … because Garfield was lying on a bed with metal springs. His doctors, feuding with one another and with the press, instituted a regimen of rectal feeding — “Nutritive enemas — consisting of beef bouillon, egg yolks, milk, whiskey, and several drops of opium … Garfield’s flatulence became intolerable,” according to one biographer — that “basically starved him to death.”† He lost 100 pounds before succumbing; the autopsy concluded that Garfield probably would have lived if not for the medical attention, which didn’t stop the doctors from submitting a sizable invoice to the feds for services rendered.

(In a moment of lucidity, Guiteau defended himself with the observation “The doctors killed Garfield; I just shot him.”)

Not Ha-Ha Funny

Horribly hilarious, this American Absurdistan. “Except for the dead-serious details of his assassinating President Garfield and being in all likelihood clinically insane, Charles Guiteau might be the funniest man in American History,” Sarah Vowell put it.

Guiteau’s circus trial — with the defendant constantly interrupting to harangue participants, object to his own attorneys or converse with the spectators, plus the macabre appearance of the late Garfield’s actual vertebrae (now at Washington D.C.’s National Museum of Health and Medicine) as an exhibit — was for all that a landmark test of evolving law around criminal insanity.

Just as Garfield probably would have survived his injury had he been treated by the next generation’s medical norms, Guiteau probably would have survived his brush with the law if treated by the next generation’s legal norms.

Against an almost-too-strict-to-achieve earlier bar for legal insanity, a more accommodating jurisprudential norm called the M’Naghten Rules or M’Naghten Test was even then being adopted from English courts: essentially, did the “criminal” realize his act was wrong? Still the basis for legal insanity claims in much of the U.S. today, the first trial of a presidential assassin would be the M’Naghten standard’s trial by fire.

While the judge gave ample leeway for the defense to use M’Naghten, the legal standards it implied were still not widely understood and the medical testimony about Guiteau’s mental condition was (embarrassingly, for the profession) wildly contradictory. Ultimately, the judge cued the jury that “the law requires a very slight degree of intelligence indeed” on Guiteau’s part to impute him with sufficient criminal culpability to hang. There were cheers in the courthouse when the jury took an hour to decide that Guiteau had that very slight degree of intelligence indeed.

In the final analysis, as Charles Rosenberg observes in The Trial of the Assassin Guiteau: Psychiatry and the Law in the Gilded Age, the jurors’ prompt conviction of the widely hated, barking-mad defendant underscored the real-life constraints of dry legal theory as applied by an outraged community to a notorious offender:

[T]he Guiteau case demonstrated anew that the circumstances of a particular case had ordinarily as much to do with its disposition as the precise injunctions of rules of law … Many observers agreed after the trial that if an individual of Guiteau’s marked eccentricity had killed an ordinary man … he would almost certainly not have been convicted; very likely he would not even have been brought to trial. Similarly, while Garfield lay on his sickbed, it was commonly assumed that his assailant would be institutionalized if the President should survive. But if not, then not.

Reckoning the gesture could cost him the 1884 Republican nomination, Chester A. Arthur declined to spare his “benefactor” (“Arthur has sealed his own doom and the doom of this nation,” was Guiteau’s reaction, picturing fire and brimstone) and left Guiteau to his strange and lonely fate. The latter was talked out of an early plan to go to the gallows in the Christlike garb of only his undergarments, but did insist upon delivering his incoherent parting ramble in a high-pitched childlike tone (“the idea is that of a child babbling to his mama and his papa”).

1950: Milada Horáková, democrat and feminist

On this date in 1950, Milada Horakova was hanged with three others in Prague’s Pankrac Prison as a spy and traitor to the Communist Czechoslovakian government.

Not (yet) as internationally recognizable as Rudolf Slansky,* the Communist General Secretary in Horakova’s time who would run afoul of Stalin and die on the same gallows two years later, Horakova (English Wikipedia page | Czech | the detailed French) is a potent symbol domestically of her country’s Cold War nightmare.

Lawyer, social democrat, and a prominent feminist in the interwar and postwar periods — her life’s work, rather overshadowed by an end that was memorable for different reasons — Horakova survived Nazi imprisonment and was a member of parliament when the Communists seized power in 1948.

She spurned counsel to flee the country, and found herself the headline attraction at a show trial for a supposed plot to overthrow the government. In a hopeless scenario, she distinguished herself with off-script defiance despite having broken under torture and signed a confession; Albert Einstein, Winston Churchill and Eleanor Roosevelt all pleaded in vain for clemency.

Horakova left the world clear in her purpose. In a letter to her teenage daughter awaiting execution, she justified her own dangerous choices:

The reason was not that I loved you little; I love you just as purely and fervently as other mothers love their children. But I understood that my task here in the world was to do you good … by seeing to it that life becomes better, and that all children can live well. … Don’t be frightened and sad because I am not coming back any more. Learn, my child, to look at life early as a serious matter. Life is hard, it does not pamper anybody, and for every time it strokes you it gives you ten blows. Become accustomed to that soon, but don’t let it defeat you. Decide to fight.

Hours before her hanging, she wrote a few last words for her loved ones:

I go with my head held high. One also has to know how to lose. That is no disgrace. An enemy also does not lose honor if he is truthful and honorable. One falls in battle; what is life other than struggle? (Both excerpts cited here)

The only woman among Czechoslovakia’s postwar political executions was abortively rehabilitated during the 1968 Prague Spring. Since the fall of the Iron Curtain, her resistance to both Naziism and Communism — worthy of an opera (topical interview) and a forthcoming film — have elevated her into her country’s official pantheon.

As a result, this date is “Commemoration day for the victims of the Communist regime” in the Czech Republic.

Meanwhile, Horakova’s now-octogenerian prosecutor Ludmila Brozova-Polednova, whose repulsive legal barbs at trial (“Don’t break her neck on the noose. Suffocate the bitch — and the others too.”) were probably the consequence of the foregone conclusion more than the cause, was convicted late last year for her role in the trial. That verdict has kept in the news these past several months — most recently, the Czech Supreme Court returned it for retrial after an appeals court overturned the sentence — a tangible symbol of the challenges inherent to confronting the past. (Brozova-Polednova, for her part, is unapologetic.)

* One of the goons who tortured confessions out of the conspirators in Horakova’s “terrorist center,” Karel Svab, was among those later hanged with Slansky.

Unspecified Year: Justine Moritz, Frankenstein family servant

Around this date in the unspecified 18th-century year of Mary Shelley’s Frankenstein, the titular family’s servant is put to death for the murder of their youngest child, William.

In the novel, smarty-pants university student Victor Frankenstein has created (and immediately rejected) his famous monster. Not long after, he receives a letter (dated May 12, “17–“) from his father informing him of the murder of his youngest brother.

About five in the morning I discovered my lovely boy, whom the night before I had seen blooming and active in health, stretched on the grass livid and motionless; the print of the murder’s finger was on his neck.

Covering the 600-plus kilometers home to Geneva, Victor becomes convinced that his creation is the culprit.* But upon reaching his destination, he finds that circumstantial evidence has accused the family’s blameless (and ironically named) servant, Justine.

He’s back just in time to watch, in horror, as she’s convicted — impotent (or at least that’s what he tells himself) to help her with his fantastical truth, and despairingly watching her friends abandon her to her fate.

Justine has grown up with Victor and the others, so the entire Frankenstein family remains convinced of the servant’s innocence, though they’re practically alone in Geneva in that belief.

Shelley includes an interesting passage in which Justine (having already been convicted) is battered by her priest into falsely confessing to the crime. Though clearly anti-clerical in intent, it’s also a moment with remarkable current resonance given the prevalence of false confessions in modern wrongful conviction scenarios:

“I did confess, but I confessed a lie. I confessed, that I might obtain absolution; but now that falsehood lies heavier at my heart than all my other sins. The God of heaven forgive me! Ever since I was condemned, my confessor has besieged me; he threatened and menaced, until I almost began to think that I was the monster that he said I was. He threatened excommunication and hell fire in my last moments if I continued obdurate. Dear lady, I had none to support me; all looked on me as a wretch doomed to ignominy and perdition. What could I do? In an evil hour I subscribed to a lie; and now only am I truly miserable.”

The poor woman’s fate is sealed either way — and in her parting conversation with Victor and his future wife Elizabeth, we find Justine more at peace than the monster’s creator:

“I do not fear to die,” [Justine] said; “that pang is past. God raises my weakness and gives me courage to endure the worst. I leave a sad and bitter world; and if you remember me and think of me as of one unjustly condemned, I am resigned to the fate awaiting me. Learn from me, dear lady, to submit in patience to the will of heaven!”

During this conversation I [Victor] had retired to a corner of the prison room, where I could conceal the horrid anguish that possessed me. Despair! Who dared talk of that? The poor victim, who on the morrow was to pass the awful boundary between life and death, felt not, as I did, such deep and bitter agony.

“In these last moments I feel the sincerest gratitude towards those who think of me with kindness. How sweet is the affection of others to such a wretch as I am! It removes more than half my misfortune, and I feel as if I could die in peace now that my innocence is acknowledged by you, dear lady, and your cousin.”

Thus the poor sufferer tried to comfort others and herself. She indeed gained the resignation she desired. But I, the true murderer, felt the never-dying worm alive in my bosom, which allowed of no hope or consolation. Elizabeth also wept and was unhappy, but hers also was the misery of innocence, which, like a cloud that passes over the fair moon, for a while hides but cannot tarnish its brightness. Anguish and despair had penetrated into the core of my heart; I bore a hell within me which nothing could extinguish. We stayed several hours with Justine, and it was with great difficulty that Elizabeth could tear herself away. “I wish,” cried she, “that I were to die with you; I cannot live in this world of misery.”

Justine assumed an air of cheerfulness, while she with difficulty repressed her bitter tears. She embraced Elizabeth and said in a voice of half-suppressed emotion, “Farewell, sweet lady, dearest Elizabeth, my beloved and only friend; may heaven, in its bounty, bless and preserve you; may this be the last misfortune that you will ever suffer! Live, and be happy, and make others so.”

And on the morrow** Justine died. Elizabeth’s heart-rending eloquence failed to move the judges from their settled conviction in the criminality of the saintly sufferer. My passionate and indignant appeals were lost upon them. And when I received their cold answers and heard the harsh, unfeeling reasoning of these men, my purposed avowal died away on my lips. Thus I might proclaim myself a madman, but not revoke the sentence passed upon my wretched victim. She perished on the scaffold as a murderess!

Shelley gives us quite the gentle picture of the Frankenstein family, in which Victor is practically the only exponent of vengeance after the dreadful crime. Even the father’s initial letter home, written in the immediate shock after discovering the boy’s body, summons his son to come

not brooding thoughts of vengeance against the assassin, but with feelings of peace and gentleness, that will heal, instead of festering, the wounds of our minds.

After the hanging, dad again endeavors to keep Victor from wasting himself on rage … which it seems that Victor would have readily assented to had he not carried his secret burden of guilt:

“Do you think, Victor,” said he, “that I do not suffer also? No one could love a child more than I loved your brother” — tears came into his eyes as he spoke — “but is it not a duty to the survivors that we should refrain from augmenting their unhappiness by an appearance of immoderate grief? It is also a duty owed to yourself, for excessive sorrow prevents improvement or enjoyment, or even the discharge of daily usefulness, without which no man is fit for society.”

This advice, although good, was totally inapplicable to my case; I should have been the first to hide my grief and console my friends if remorse had not mingled its bitterness, and terror its alarm, with my other sensations.

Frankenstein is available free at Project Gutenberg. Of course, it has been adapted many times into other cultural artifacts; these are somewhat famous for their infidelity to the original work, and Justine tends to get short shrift in most (although she’s hanged in quite an over-the-top spectacle in the 1994 Kenneth Branagh vehicle Mary Shelley’s Frankenstein (review here)).

If Justine is usually pulled from the story, Hollywood has found a role for the scaffold elsewhere. Where Shelley has Victor haunting “charnel houses” and the like, the seminal and oft-imitated 1931 Boris Karloff film makes a point to include a hanged criminal for some of the creature’s parts — although “the brain is useless”:

But a criminal brain finds its way into the monster just the same, an explanation of its behavior completely antithetical to Mary Shelley’s:

Nothing in human shape could have destroyed the fair child. HE was the murderer! I could not doubt it. The mere presence of the idea was an irresistible proof of the fact.

** The precise date is never disclosed, but the events are roughly dated by Victor’s subsequent narration, “it was about the middle of the month of August, nearly two months after the death of Justine, that miserable epoch from which I dated all my woe.”

1864: William Johnson, a bad example

On this date in 1864, the Union army in the American Civil War hanged a black deserter outside Petersburg, Va., for — in the delicate words of the army dispatch — “an attempt to outrage the person of a young lady at the New-Kent Court-house.”

The Union army was just taking up position for the coming monthslong siege of the Confederate capital, Richmond. Johnson, who confessed to deserting another unit, offered savvy blue commanders a win-hearts-and-minds opportunity: a public reassurance that the Old Dominion’s dim view of Negro outrages upon young ladies would be honored by its soon-to-be occupiers.

Not bad in theory. The execution left something to be desired.

The field of public relations being very much in its infancy, the upshot of this salutary demonstration seems not to have been conveyed to its target audience; so, when a defending Confederate battery caught sight of the gallows being thrown up in brazen view of its own lines, it jumped to the not-unreasonable conclusion that the Yanks were about to make an example of a southern spy. Rebel guns promptly made the Union detachment their “target audience.” An artillery shot struck one Sgt. Maj. G. F. Polley (or Polly) and “tore him all to pieces” before

[a] flag of truce was sent out to inform the enemy that a negro was to be hung who had insulted a white woman the day before; they stopped firing. We then marched back and saw the negro hung.

The return on investment for the souls of Johnson and the misfortunate NCO was altogether unsatisfactory:

The incident was cleverly turned to advantage by the Confederates, who had been losing hundreds of Negro laborers by desertion. The Rebels marched Negroes past the spot, pointing out to them the perils of fleeing their lines, saying that the Yankees hanged all ‘Contrabands.’ For weeks nocturnal escapes of Negroes ceased on that front. It wasn’t a total loss, however. The Library of Congress ended up with some striking archival photos.

1747: Mary Allen and Henry Simms, Gallows Lovers

When Oscar Wilde allegedly gestured at the garish wallpaper in his cheap Parisian hotel room and announced with his dying breath, “Either it goes or I go,” he was exhibiting something beyond an irrepressibly brilliant wit. Freud, you see, wasn’t whistling “Edelweiss” when he wrote that gallows humor is indicative of “a greatness of soul.” The quips of the condemned prisoner or dying patient tower dramatically above, say, sallies on TV sitcoms by reason of their gloriously inappropriate refusal, even at life’s most acute moment, to surrender to despair.

The Ordinary’s Accounts are some of the earliest true crime stories written in English. Their popularity came at the same time the masses learned to read, and some think there was a cause-and-effect relationship there — Englishmen learned their letters when there were some bloody good murder stories that made the exercise worthwhile.

The Accounts were, in essence, press releases issued by the Newgate prison in London after each execution to give lessons to posterity and to stimulate respect for the criminal laws. Those from the 1740s-1750s are online here.

The authors of these accounts were required to speak to the condemned every day for the weeks between the conviction and execution. They chronicled the confessions and behavior of men and women doomed to die, focusing largely on the personal history of each criminal, their crimes, and questions of faith.

In 1747, an Ordinary recorded the extraordinary story of a shoplifter named Mary Allen and a highwayman named Henry Simms, whose love was born in gaol and lasted to the gallows.

Mary Allen was 26 years old and through shoplifting had “gathered together a large Quantity of Goods of various Kinds, very near sufficient to have furnished a Shop, which it seems was her Intent; which Goods were found in a Room in Park-street.”

The Ordinary did not like Mary. She didn’t want to talk to him because she would have no speeches made about her when she was dead. He thought she was surly, obstinate. She also said it was grief enough to her parents that she was being executed, and she didn’t want to add to their afflictions with her dying quotes. The Ordinary thought it a pity she didn’t think of her parents before she embarked on her criminal career.

Since she wouldn’t speak to him, the Ordinary was forced to record his observations of her. He noted that she was of

[A] turbulent Spirit, and frequently quarrelled with her Fellow-Prisoners, and being the weaker Vessel, frequently came off damaged. When she was tried she had two black Eyes, which she got in a Quarrel; and when she went to the Place of Execution, she had a black Eye, received but a few Days before in another Skirmish. During her Confinement she contracted a great Fondness for Gentleman Harry.

Henry “Gentleman Harry” Simms, aged 30, was an orphan turned highwayman and pimp, known for his large Cutlass and his dandy clothes, and in the Ordinary’s words he was

[As] famous a Thief as ever yet adorn’d the Gallows. The Money he gain’d by Robbing he generally spent among the Whores about Covent-Garden, and as he generally wear very genteely dress’d, they gave him the Title of Gentleman Harry.

While under Sentence of Death, his fertile Brain was continually contriving Schemes in hopes to save his Life. He wrote several Letters to the Secretaries of State, and even to his Majesty himself.

While under Sentence he … still seemed found of the gay Part of Life, having a Number of Ladies coming frequently to see him, and did not appear so much concerned as one in his Circumstances should be.

What occupied Gentleman Harry in his last days was his fellow sufferer Mary Allen. They fell in love and spent their last days in intimacy (though the Ordinary also noted that “they sometimes fell out, when Simms generally beat her.”)

And on the final day, Mary Allen and Gentleman Harry indulged in hugs and kisses and hand-holding until their last moments on earth and met death with a defiant embrace.

THE Morning of their Execution, after going up to Chappel, where they all behaved very devoutly, they were brought down into the Press-Yard, had their Fetters knock’d off, and was then convey’d to Tyburn … Simms was cleanly dress’d in a White Fustian Frock, White Stockings, and White Drawers; and just as he got into the Cart at Newgate, threw off his Shoes. Being arrived at the Place of Execution, some Time was spent in Devotion, in which they all most heartily joined.

SIMMS … owned the Robbery of Mr. Smith in the Borough.

ALLEN Wept a good deal, and own’d the Robbery for which she died.

And they all went off the Stage calling to the Lord to have Mercy on their Souls.

Just before they were turn’d off, Simms and Allen saluted each other; and then joyning Hands, went off, taking hold of each other.

1958: Imre Nagy, former Prime Minister of Hungary

Fifty years ago today, the onetime Hungarian Prime Minister and three others associated with the country’s shattered 1956 revolution were hanged in Budapest for treason by the Soviet-backed Hungarian government.

A moderate Communist, Imre Nagy assumed leadership of Hungary from 1953 to 1955, a period of ideological thawing after the death of Joseph Stalin.

Nagy charted a “new course” towards Austrian-style neutrality or Yugoslavian-style “national Communism” not yoked to Moscow, opposed domestically by his predecessor and rival Matyas Rakosi, who eventually ousted the reform-minded minister.

But Nagy’s anti-Soviet credentials saw him elevated back to the office by popular acclamation during the 1956 Hungarian Revolution — an interval of the nation’s history still deeply cherished in Hungary today. Here’s a recollection by newsreel montage to the strains of Beethoven’s salute to the national martyrs of another time and place.

Nagy held the office for only ten days before Soviet intervention crushed the revolution. He issued this radio appeal to the world (in Hungarian, followed by the English version at about 0:34) on November 4, 1956:

It was an appeal against all geopolitical realities; Hungary was the Soviet Union’s sphere, and western counter-intervention could have precipitated World War III. Verbal outrage abounded, of course:

But Khrushchev gibed that the United States had “supported” the revolution “in the nature of the support that the rope gives to a hanged man.”

For all that, the abortive revolution has won the benediction of history: still venerated in Hungary, and arguably a turning point in the postwar world when the Soviet Union set itself unmistakably and, eventually, fatally against the legitimate aspirations of its subjects.

Less the leader of this stirring movement than carried along by it, Nagy nevertheless embraced the revolution fully.

His government hardly had the opportunity to implement any sort of programme, but it gestured towards multiparty parliamentary democracy. Nagy attempted to withdraw Hungary from the Warsaw Pact. And to the fame of his memory, he refused Soviet blandishments after his capture to recant and accede publicly to the new Hungarian government.

For these principles, Nagy, his defense minister Pal Maleter, and revolutionary officials Miklos Gimes and Jozsef Szilagyi underwent a weeklong trial June 9 to 15, culminating in execution on this date — all strictly hush-hush, and not announced until the bodies were cold.

Though secret, the trial was tape-recorded in its entirety. This past week, to coincide with the anniversary of the affair, the full 52 hours of audio were publicly aired for the first time — over the same June 9-15 span, and at the location of the original trial. The recordings are held by the Open Society Archives, which maintains a wealth of information on the 1956 revolution (such as, topically, this ‘death circular’ issued by anti-Soviet Hungarians). Formerly held under lock and key, the audio files are not yet published for public distribution at this point, but one would expect that it’s only a matter of time.

Nagy and his companions were officially rehabilitated and, on this date in 1989, reburied with honors; tens of thousands turned out to pay respects that had been officially prohibited for 33 years. In this chaotic period as Soviet domination of eastern Europe crumbled, their fellow-traveler Bela Kiraly (who gives a fascinating account from the inside of the Revolution in this 1996 interview) returned from exile for the reinternment ceremony and found that he was technically still under the sentence of death he had received in absentia at Nagy’s trial.

1945: Aniceto Martinez, an American rapist in England

On this date in 1945, the last man executed for rape in England was hanged at Shepton Mallet prison — an American serviceman, hanged by the United States military.

Our story finds us in the Staffordshire town of Rugeley (for a second consecutive date), where a Mexican-American prisoner-camp guard named Aniceto Martinez raped a 75-year-old local. He should have put some thought into his alibi: he was the only American out of the camp that night, and hence easy pickings.

No, Martinez is notable only for his accidental milestones. His was the last U.S. military execution in Britain during World War II (actually coming over five weeks after Germany had capitulated). And he was the last person hanged on Albion’s soil for rape. This offense was not a hanging crime by English statute at the time, but was a capital offense in a U.S. military court … although all six of the personnel upon whom the sentence was inflicted were non-white, a pattern noticeable in stateside civilian cases as well.

Martinez also, as it turned out, retired the use of Shepton Mallet as a facility for conducting executions. Dating to 1610, the prison had been out of commission during the 1930’s but taken over by the visiting American forces during the war years. (It’s remained in operation since, England’s oldest functioning prison.)

Though conducted under American law, the 16 hangings* at Shepton Mallet were actually carried out by British executioners in something of a procedural amalgam. American procedures in general governed the affair — and prolific British hangman Albert Pierrepoint, who conducted several, remarked on the (to him) oddities in his autobiography:

[A] custom which was strange to me was the practice of laying on a mighty feast before the execution. We were eating badly in this country at that time, but at an American execution you could be sure of the best running buffet and unlimited canned beer. The part of the routine which I found it hardest to acclimatise myself to was the, to me, sickening interval between my introduction to the prisoner and his death. Under British custom I was working to the sort of time where the drop fell between eight and twenty seconds after I had entered the condemned cell. Under the American system, after I had pinioned the prisoner, he had to stand on the drop for perhaps six minutes while his charge sheet was read out, sentence spelt out, he was asked if he had anything to say … and after that I was instructed to get on with the job.

One important concession to the British practice: use of the variable drop, designed to break the condemned wretch’s neck rather than a standard drop without accounting for the weight of the prisoner … which risked either slowly suffocating or outright decapitating the hanged man.

1856: Dr. William Palmer, the Rugeley Poisoner

On this date in 1856, the Victorian poisoner William Palmer stepped on the scaffold at Stafford prison, eyed the trap suspiciously, and asked, “are you sure it’s safe?”

It wasn’t.

One of the more notorious characters of 19th century crime, Palmer hanged for poisoning a gambling buddy with strychnine, but he was widely thought to have left many more bodies in the ground. The philandering physician certainly had a knack for having people turn up suddenly dead around him:

  • The last four of his five legitimate children;
  • His illegitimate child;
  • Two people to whom he owed money;
  • His mother-in-law;
  • His wife (after Palmer took out insurance on her);
  • His brother (ditto);
  • And John Parsons Cook, whom Palmer was finally convicted of killing.

Evidence against Palmer was completely circumstantial, the public mood was completely prejudicial, and the case was completely sensational. It didn’t help Palmer’s cause that future Lord Chief Justice Sir Alexander Cockburn was on the case, inflicting a withering cross on the defendant. Neither did it help his cause as much as one might think having the victim’s body come up negative for any lethal dose of poison. Robert Graves wrote a book about the case, and reckoned it a likely frame-up. Most other popular recollections — like Madame Tussaud’s, where Palmer stood until 1979 — have figured him for the same cold-blooded poisoner his public thought him. Gambling debts on the verge of burying him afforded him very plausible motivation (Cook was supposedly killed because Palmer had fraudulently borrowed a few hundred pounds against his name and was about to be found out).

How quickly “crimes of the decade” fade away. Palmer was the O.J. Simpson of the 1850’s, although his spell in the public eye was only a few months. Parliament had to intervene to move his case from Staffordshire to London for want of an unprejudiced jury; 35,000 people crammed the streets overnight in the rain to watch him swing; and time was you could get yourself the Unabridged Edition of The Times‘ minute-by-minute report on the Palmer trial or bone up on the case in the 19th century’s legal tomes, to say nothing of the requisite (and in this case, poetic) broadsheet and enough cultural ejecta to stock a museum exhibit.

Palmer earned a passing name check in Sherlock Holmes — “When a doctor does go wrong he is the first of criminals. He has nerve and he has knowledge.” His case is supposed to be the source of the pub idiom “what’s your poison?”

Legend — scurrilous, of course — has it that his hometown of Rugeley even petitioned the government to change its name for fear of never escaping its association, but that the change would only be permitted if the town named itself after the Prime Minister: Lord Palmerston. Rugeley it remains.

* Notably, Palmer was convicted of poisoning in the face of exculpatory toxicology evidence. He denied the poisoning to the end.

1983: Simon Thelle Mogoerane, Jerry Mosololi and Marcus Motaung, anti-apartheid soldiers

This date at dawn in 1983, three African National Congress cadres were hanged — together with two unrelated common criminals — for attacks on apartheid-era South African police stations.

“Terrorists” in the eyes of the white government and “freedom fighters” in the eyes of many blacks, the “Moroka Three” — Simon Thelle Mogoerane, Jerry Mosololi and Marcus Motaung — bore arms against as part of the ANC’s military wing, Umkhonto we Sizwe (MK).

Their attacks in 1979 and 1981 had claimed the lives of four (black) policemen.

South African law until 1990 mandated hanging for a murder conviction without any extenuating circumstances — a “fact associated with the crime which serves in the mind of reasonable men to diminish morally, albeit not legally, the degree of the prisoner’s guilt.” The courtroom adjunct to MK’s guerrilla operations was establishing its position that its soldiers were prisoners of war under international law, and that that classification constituted an extenuating circumstance under South African law.

1977 protocols had extended the Geneva Conventions governing treatment of prisoners of war to explicitly cover anti-colonial and anti-racist insurgents. South Africa, unsurprisingly, did not ratify this amendment. The judge dismissed the argument that these protocols had acquired the binding force of customary international law — “we do not need to waste time.”

A decade or so later, in the waning years of apartheid, this sort of argument would find a toehold. But not in a defiantly “anti-terrorist” Pretoria of the early eighties.

The three were hanged in the face of worldwide appeals for clemency — such as this one from U.S. Congressmen and -women, and the pamphlet below by the British Anti-Apartheid Movement:
