On this date in 1804, two known as John Setton/Sutton and James May were hanged at Greenville, Mississippi.
They were, in fact, Wiley “Little” Harpe and his outlaw partner Peter Alston — the survivors (well, up until then) of a notorious gang of Mississippi River pirates and frontier highwaymen.
Their villainous coterie had plagued the Mississippi (river) and the proximate byways from Kentucky down to Mississippi (state), making a couple of spots on the great river legendary pirate hideouts in the process.
With a bounty of the notorious leader Samuel Mason, “Sutton” and “May” coldly murdered their captain to turn in his head for the reward.
They got their reward alright. They were recognized as Mason’s own fellow-bandits, and themselves put on trial for piracy.
The Harpe Brothers
This date’s hanging was not only the end of the Mason gang — it was the end of the Harpe Brothers.
Micajah Harpe (“Big Harpe”) and Wiley Harpe were brothers or cousins who cut a bloody swathe through the early American Republic, such that some have acclaimed the Harpes that young nation’s first serial killers. They were, in one historian’s words, “the most brutal monsters of the human race.”
Heading west out of North Carolina after Revolutionary War service as Tory irregulars, the Harpes made for Knoxville, Tennessee, kidnapping wives for themselves along the way. When they were rousted out of their cabin on accusations of livestock-rustling in 1797, their notorious careers really began in earnest.
This was, then, the extreme western frontier of the United States, and the Harpes were consequently able to plunder in wilderness impunity.
And they slew with a frequency and savagery far in excess of the professional demands of a bush robber.
Big Harp confessed before dying in 1798 to 20 murders, probably not counting the babies. Estimates are as high as 40, but usually around 30. After two killings, one in Knox County and one on the Wilderness Trail, the Harps left Tennessee in December 1798 for Kentucky, where they killed two traveling men from Maryland…
The final stretch of slaughter took place soon after this, in July 1798, when the Harps returned to Eastern Tennessee. The victims included a farmer named Bradbury; a man named Hardin; a boy named Coffey; William Ballard, who was cut open, filled with stones, and dumped in the Holston River; James Brassel, with his throat ripped apart on Brassel’s Knob; John Tully, father of eight. On the Marrowbone Creek in south central Kentucky, John Graves and his teenaged son, out planting crops, had their heads axed. Moving toward Logan County, the Harps came upon a little girl, whom they killed, as they did a young slave on his way to the mill. Once in Logan County, near today’s Adairville, near the Whippoorwill River, they butchered an entire migrating family asleep in their camp, but for one son who survived. (Source)
TruTV also has an account of them sending a hijacked flatboat passenger over a cliff, and bashing a little girl’s head in against the side of a bridge.
“They murdered all classes and sexes, without distinction,” a Knoxville man* recounted years later, “not for plunder but for the love of shedding human blood.” We don’t have Little Harpe’s conscience on the record, but Big Harpe would only express remorse for one of his dozens of homicides: smashing his own infant child against a tree to make it stop crying.
That sentiment would come at the end, when Big Harpe had been cornered by a posse after murdering a frontier woman. The widower in that posse halved the Harpe menace by hewing Big Harpe’s head from his shoulders.
For generations after the subsequent roosting-spot of this deathly visage — presented to a justice of the peace to verify the man’s death (and pocket the price on his literal head), then hung up for public display by the intersection of Morgenfield, Henderson, and Maidensville Roads in Union County — was known as Harpe’s Head.
Little Harpe’s subsequent career with Sam Mason and his own violent demise capped the Harpe brothers’ nefarious legacy.
Their name was so infamous that many of their family changed it … including, according to rumor, the ancestors of legendary Wild West lawman Wyatt Earp.
* J.W.M. Breazeale was part of the posse that hunted down Big Harpe, and a witness to Big Harpe’s death, and gives the outlaw the (possibly tall-tale) last words directed to his slaughterer in mid-beheading: “You are a God damned rough butcher, but cut on and be damned.”
A miners’ boom town since prospectors struck gold nearby the previous year, Virginia City was even, briefly, the capital of the Montana Territory.
For order, it depended upon a Vigilance Committee of local grandees … and that committee had just days before carried out the hanging of Henry Plummer, the sheriff of the nearby mining town of Bannack and a reputed outlaw gang boss.
Plummer’s supposed “road agents” did the wilderness-trail robbery act familiar of the western milieu, but on a nearly industrial scale: it was suspected that “horses, men and coaches” traveling around Bannack and Virginia City were systematically “marked in some understood manner, to designate them as fit objects for plunder.”
The next act in the Vigilance Committee’s confrontation with these highwaymen and bywaymen was to bust up the Plummer network by seizing and hanging five supposed road agents on this date.
The evidentiary basis for these conclusions was varied, and in most cases less than what you’d call ironclad; the club-footed cobbler George Lane was thought to be marking stages for outlaws to hit, but the crippled rancher Frank Parish? Or Jack Gallagher, who wasn’t even on the list of wanted road agents the vigilantes were working from?
(The Vigilance Committee’s Parish Pfouts would record in his diary “that every man executed by the Vigilance Committee at that time was proved to be a murderer or highway robber.” The unsavory whiff of lynch law notwithstanding, those vigilantes have not wanted for latter-day defenders.)

Upon the Vigilance men’s summary and predetermined judgment, the quintet was marched down the street to a then-unfinished log structure and strung up on an inside beam.
On this day in 1721, Jean-Pierre Balagny, alias Capuchin, was broken on the wheel in Paris. He was one of the lieutenants and boon companions of legendary French outlaws Cartouche.
We have noted that that renowned bandit crowned his fame at the last by enduring all tortures, only to voluntarily give up the names of his companions as he approached the scaffold and perceived that they had failed to arrange a rescue.
“Capuchin”, who was with Cartouche when he was captured and subject to much the same interrogation, proved as good as his captain. He, too, endured the boot without breaking. And he, with two companions, likewise reached the scaffold and only there coughed it up.
They gave information as to their accomplices, and made, at the foot of the scaffold, confessions which torture had failed to elicit from them.
They implicated so many persons, that another series of trials began, which lasted as long as the declarations of convicted prisoners compromised other persons, and threw new light on the immense ramifications of an association of miscreants which had for many years defied the police. More than sixty persons were under lock and key at the time of the execution of Cartouche and Balagny. This number increased every day in consequence of the confession of those who hoped to save their lives by denouncing their accomplices, and in June of the following year it rose to one hundred and fifty … all this blood, instead of washing the affair away, seemed rather to make it more serious. Every day brought to light some new discovery; and this shows how profoundly mistaken were those who denied that Cartouche, the centre and wire-puller of this horrible association, possessed the organising spirit without which he could not have extended this immense net over the Parisian society.
One is left to infer from this entry in the memoirs of the Parisian hereditary executioner-family Sanson that Balagny likewise did in his friends over some ornate notion of honor … although if the anecdote is true, one could as easily suppose any number of less “creditable” reasons.
At any rate, Balagny’s evidence added to that of Cartouche’s snowballed into a bloody cycle of tortures and executions and fresh denunciations over the year to come.
Of course, getting rid of all the criminals did not get rid of crime.
“In spite of the executions at La Greve, there are more thieves than ever in Paris,” lamented one observer (quoted here). “Cartouche has died on the wheel; but his name and memory engender robbers.”
On this date in 1722, the younger brother of the great French outlaw Cartouche was punished with a bizarre non-fatal hanging in Paris’s Place de Greve.
At least, it was supposed to be non-fatal.
Little Louison was a whelp of 15 years and already condemned to hard labor in the months-long smashing-up of the gang that followed the ringleader’s 1721 execution. “Nothing but hangings and breakings on the wheel!” one diarist scribbled in July 1722. “Every day some Cartouchian executed.”
As a sort of piece de resistance for the month, a judge named Arnould de Boueix, sore about the murder of a gendarme in his family, ordered the young Louison “hanged” under the armpits (the rope about his chest) for two hours as an additional punishment/humiliation. Judge de Boueix apparently devised this thing without any sort of precedent or anatomical expertise that would actually confirm the safety of the procedure.
[Louison] cried out very loudly at first, and begged that he might be put out of pain at once, as the weight of his body seemed to force every drop of blood down to his feet. “Ce-qui” (adds Barbier) “est la souffrance des pendus.” [“Such is the suffering of the hanged” -ed.]
Later, his tongue protruded, and he spoke no more. Without waiting for the ordained two hours to expire, the lad was taken down and placed in medical care; but it was too late. He was already dead. “He was very wicked for his years,” says Barbier, “and had been an accomplice of his brother from a very early age.”
On this date in 1691, Jack Collet was hanged for “sacrilegious burglary.”
This little-known highwayman ditched an apprenticeship with a Cheapside upholsterer to take the road, and carved a niche as the guy what robbed while dressed up as a bishop. (Once having lost his ecclesiastical garb at dice, he re-robed by sticking up a churchman on the road and forcing his victim to dis-.)
“As if he had been determined to live by the Church,” clucks the Newgate calndar, “he was at last apprehended for sacrilege and burglary, in breaking open the vestry of Great St Bartholomew’s, in London, in company with one Christopher Ashley, alias Brown, and stealing from thence the pulpit cloth and all the communion plate.”
For this bid to render un-from God, Caesar rendered Collet unto Tyburn.
This was the hanging-date in 1689 of William Bew, the less-noted younger brother of a more impressive (but by this time deceased) highwayman “Captain Bew”.
Will, too, took to the road. His thieving career might not have been outstanding, but it did give the Newgate Ordinary occasion to wax smug over the nigh-literary comeuppance young Bew once delivered to feminine vanity.
The following story, which Bew himself used to tell, is of an adventure of Bew with a young lady, whom he overtook on the road, with her footman behind her. He made bold to keep them company a pretty way, talking all along of the lady’s extraordinary beauty, and carrying his compliments to her to an unreasonable height. Madam was not at all displeased with what he said, for she looked upon herself to be every bit as handsome as he made her. However, she seemed to contradict all he told her, and professed with a mighty formal air that she had none of the perfections he mentioned, and was therefore highly obliged to him for his good opinion of a woman who deserved it so little. They went on in this manner, Bew still protesting that she was the most agreeable lady he ever saw, and she declaring that he was the most complaisant gentleman she ever met with. This was the discourse till they came to a convenient place, when Bew took an opportunity to knock the footman off his horse; and then addressing himself to the lady, “Madam,” says he, “I have been a great while disputing with you about the beauty of your person; but you insist so strongly on my being mistaken, that I cannot in good manners contradict you any longer. However, I am not satisfied yet that you have nothing handsome about you, and therefore I must beg leave to examine your pocket, and see what charms are contained there.” Having delivered his speech he made no more ceremony, but thrust his hand into her pocket and pulled out a purse with fifty guineas in it. “These are the charms I mean,” says he; and away he rode, leaving her to meditate a little upon the nature of flattery, which commonly picks the pocket of the person it is most busy about.
A spirit of hatred and revenge took possession of me. I had numerous fights in defense of what I believed to be my rights and those of my countrymen. I believed we were unjustly deprived of the social rights that belonged to us.
On this date in 1879, legendary Californio outlaw Tiburcio Vasquez was hanged in San Jose.
Born to a respectable family (his grandfather was the first mayor of San Jose) when the land was under Mexican control, Vasquez was among the many chagrined to find themselves demoted to second-class citizenry by the norteamericanoconquest of the Mexican-American War.
That occurred when Vasquez was in his early teens, and soon thereafter the young man was plying California’s ill-policed byways with the whole litany of depredations characteristic of the frontier outlaw: livestock rustling, highway robbing, shopkeep stickups.*
One of the latter furnished the proximate cause of his death and probably the most infamous single incident among his exploits: an armed robbery in Tres Pinos** that resulted in three shooting deaths and a serious manhunt.
For Vasquez, the end of the rope (last word: “Pronto”) was just the last act of a legendary career, of poetry and horsemanship and countless enchanted inamoratas. He was renowned in his own time, and has graduated since into a mythical, and potently symbolic, figure of the other peoples of the Golden West.

How did you separate fact from folklore researching this outlaw? How much do we really know about him?
Generally speaking the whole genre of outlaws and lawmen is sort of known for bad research and myths and crazy stories. It tends to attract — here I’m denigrating myself– people who are a little off. Like myself. The movie buffs tend to get reality mixed up with what they’ve seen in the movies.
The whole genre has attracted poor research and sensational writers since the days of the dime novels. Though there are real historical groups: the Wild West History Association is probably the best example — True West magazine and Wild West magazine do a god job of publishing authentic history.
With Vasquez in particular, he became a folk hero in his own lifetime to disadvantaged Hispanics.
He was personally very well-liked; as a general rule, he didn’t rob Hispanics (although he did from time to time); he paid for safe harbor and food; he was a terrific dancer; he wrote poetry to is female admirers. He was a bigger-than-life personality, sort of the life of the party.
Among the larger Hispanic community as he became more notorious in the 1870s, he became a folk hero in his own lifetime. A lot of the myths are exaggerations of things he really did.
When the colonized cannot earn a living within the system, or when they are degraded, they strike out. The most physical way is to rebel. This can be done in an organized way, as was done by Juan Cortina in Texas, or it can express itself in bandit activity. An analysis of the life of Tiburcio Vasquez clearly demonstrates that, while in the strict sense of the word he was a criminal, at the same time his underlying motivation was self-defense. Some Anglo-American folklorists have attempted to portray Tiburcio Vasquez as a comical and oversexed Mexican bandit … dismiss[ing] the legitimate grievance of Chicanos during the nineteenth century. While it is true that Tiburcio Vasquez was an outlaw, many Mexicans still consider him a hero.
His outlaw career seems like it’s bound up in this Anglo-Hispanic cultural collision. To what extent does that influence how he’s “read” by others?
His life is sort of a microcosm of what was going on. The first portion of my book deals with the rise and fall of the native settlers of California.
With the loss of California in the Mexican-American War and then the discovery of gold, they became second-class citizens in their own land. So Vasquez becomes a folk hero — he robbed stagecoaches, thumbed his nose at the sheriff, and got away.
But he was also a bandit.
In the 1960s, the so-called Chicano historians (pdf) latched on to Vasquez, and they actually believed he was a Robin Hood figure or a “social bandit”. This is a total crock.
You find these same outlaw myths in all cultures. Vasquez is no different, though he’s better documented than most. People would sing corridos about him.
There were some quotes by him that says that he was driven to it, the Anglos drove me to it — but that’s no different from Jesse James or Billy the Kid saying they were driven to it, even if it’s true. Most of these guys I’m talking about are or were history professors; they should have known better.
What led you to this story?
When I was a kid in the early 60s I watched all the westerns. Clint Eastwood and Steve McQueen were my favorite. But then I wanted to know, was there a Wild West here in California? So when I got into high school I went and read everything I could get my hands on about early California history.
Vasquez and Black Bart were pretty much the most famous early California outlaws. So I started researching Vasquez in high school, and collected information for about 40 years, but it took me another four years to write it.
There’s never been a biography about Vasquez. There were three paperback books published about him, one after he was captured and two right after he was hanged — they’re not dime novels, but they’re sort of semi-fictional. There have been many magazines, many book chapters since, but everything published about him has just been a rehash of those three books. It must have been a compelling story for you to stick with it for 40 years.
It’s just sort of a great story from early California. Vasquez was very colorful.
He fell under the influence of a guy named Anastacio Garcia when he was about 16 years old, and his parents seem to have separated. He had a large family; all of them were extremely honest. One of his brothers was a very prominent rancher; another brother served a term as a justice of the peace in Los Angeles County.
Vasquez, possibly because his father wasn’t around, fell under the influence of Garcia and got involved in the Roach-Belcher feud. Garcia was a hired gun, and the two of them were involved in a brawl in a Fandango house in 1854 and one of them killed a local constable. Tiburcio Vasquez fled Monterrey and never appeared openly after that.
But he basically did not change.
He was engaged to Garcia’s sister when he was 17 and she apparently broke it off. That seemed to have embittered him because he never had another serious relationship again with another woman. He was a real rounder, he got shot over women, took off with the wives of other gang members.
That was very foolish — that’s what got him the noose, when a cuckolded gang member testified against him at trial. He never made any effort to change; he was what you call a career criminal.
He was a very cultured person, and even if you compare him to more modern-day criminals like Clyde Barrow or Pretty Boy Floyd or John Dillinger, none of them had that kind of culture. He really was sort of the prototype of that sort of charismatic bandit who at the same time is both charming and deadly.
Probably the thing to me that was the most fascinating was the information I dug up about his family: his parents, his sisters who were very loyal to him; his brothers who all tried to get him to go straight. I was very pleased to meet the descendants of some of his brothers, so it was fascinating to reconstruct his family life to try to explain his personality.
So what was the nature of that bandit career?
Well, he wasn’t a remorseless killer, though he was involved in nine murders — he always said it was someone else.
The one that he was hanged for, his gang killed three people in a robbery. He claimed someone else pulled the trigger. Some witnesses said it was Vasquez himself, but under the law then and now, if you band together to commit a felony and someone dies, everyone involved is culpable for murder.
He’d been doing a lot of robberies before then, but he’d do them in remote areas. He tried not to kill anyone; he’d tie people up — but he was also involved in a lot of gunfights. Basically he’d shoot to escape. In doing the research I found that he had fired into a brothel in Santa Cruz and wounded three people; another time he fired into a stagecoach station.
One of the great Vasquez stories is, he gets out of San Quentin and he goes to San Juan Bautista which is one of the most picturesque villages in California then and now — it was one of his favorite hangouts. One of his gang members, Salazar, had tried to go straight. Vasquez shows up at San Juan and finds out that Salazar has married this gorgeous 15-year-old named “Pepita” and he and another gang member lust after her and get her to run off with the gang. So Salazar comes gunning for him; they have a gunfight right there in front of the mission, and Salazar shoots Vasquez through the chest and damn near kills him. His gang gets him out of it … the girl gets pregnant, evidently with Tiburcio’s child and she dies of a botched abortion. It’s sort of the Vasquez story in a microcosm, it looks pretty romantic on the surface and you look a little deeper and it becomes pretty grisly.
He gave a lot of interviews after he was captured and they give color to the story. There’s the natural human inclination to paint yourself in the best light.
None of which helped him avoid execution.
His hanging was actually the most publicized hanging in the history of the Pacific coast; newspapers came from Canada, New York all over the country to witness the hanging.
He was hanged in front of a big crowd, a thousand people or more present. People climbed trees and telegraph poles became the jailhouse was packed. The sheriff had 300 or 400 invitations issued and then many many more were clustered around.
Executed Today would be remiss not to add that our day’s gallows-bird was the namesake of the Vasquez Rocks, a small Natural Area Park north of Los Angeles where the outlaw used to hide out.
This striking triangular rock formation, thrust out of the earth by tectonic action, has been used extensively in film productions of every genre since at least the 1930s, including with almost compulsive frequency in the Star Trek franchise — e.g., Captain Kirk fighting the Gorn:

On this date in 1880, Andrew George Scott and Thomas George “condemned to death for the part they took in the outrage at Wantabadgery, resulting in the death of constable Bowen, were executed at Darlinghurst Gaol.”

Scott is our main man here, an Anglican lay reader turned grifter turned flat-out outlaw with the nom de plunder “Captain Moonlite”: one of the strangest characters in Australia’s criminal annals.
How did a fellow with such a family-friendly alias end up involved in an “outrage”?
This colorful, charismatic immigrant (from Ireland, via New Zealand — and, legend has it, with a side trip to Italy to fight with Garibaldi) became a notorious public figure when, in outlandish masked getup, he robbed the bank of the South Victoria gold rush town of Mount Egerton.
His distinctive voice — remember, he was a parish reader — was recognized by his erstwhile friend at the other end of the gun, but Scott brazenly reversed the accusation and actually had his victim in the dock for a time. This Mount Egerton crime is the source of the man’s luminescent nickname, after the signature placed on a stickup note.
When he got out of prison in 1879 — having defended himself with panache, and escaped once along the way — he had a public profile, and actually got out on the lecture circuit for a brief spell.
But he soon returned to the annals of preposterous criminality.
Gathering five young followers, Moonlite went full-time into the bush. Allegedly spurned in a bid to join Ned Kelly‘s gang, Moonlite et al sought work at Wantabadgery Station.
When this refuge, too, turned them away, the outlaws found themselves in a rather pathetic state of hunger and desperately seized the place by main force. The resulting “outrage” was not a wholesale plunder of the station or wanton abuse of the prisoners (no rapes, no murders … although Moonlite did conduct a kangaroo “trial” of one of his hostages for attempting to escape: the verdict was not guilty): it was the inevitable ensuing shootout with police in which the bushrangers James Nesbitt and Augustus Wernicke died, along with the constable Bowen.
Two of the other three who survived this shootout also survived their brush with the law by blaming Captain Moonlite. The “Captain” may have been plenty eager to accept this fatal inculpation for reasons beyond those of mere honor.
In his prolific prison correspondence awaiting execution, Scott avowed his broken-hearted love for James Nesbitt, one of the two companions who had been killed in the shootout. The terms are astonishingly explicit for the time.
“My boy with a golden heart who died trying to save me … He was my constant companion; we had the deepest, truest bond of friendship. We were one heart and soul, he died in my arms and I long to join him, where there shall be no more parting. He died in my arms; his death has broken my hear. When I think of my dearest Jim, I am nearly driven mad. My dying wish is to be buried beside my beloved James Nesbitt”
Scott hanged wearing a ring of the late Nesbitt’s hair,* but his wish to share a burial plot was not honored — until Captain Moonlite was exhumed and reburied in 1995.
On this date in 1721, the French outlaw Cartouche was broken on the wheel in Paris.
Your basic superstar robber during that archetype’sgoldenage, Louis Dominique Garthausen, aka Bourguignon, aka Cartouche was the son of a German mercenary-turned-French wineseller.
Little Cartouche — his nickname came from a Francophone corruption of his German surname — distinguished himself from childhood as the most charismatically intrepid of the local hooligans, and by adolescence was already the leader of a troupe of rascally thieves.
By his twenties, after a detour through the army, Cartouche and his merry men (the Cours des Miracles gang, after the slum they operated out of) were raiding the lucrative Versailles-Paris route, plundering the virtue of marchionesses, distributing stolen booty the poor, maintaining perfect courtesy in the society of gentlemen, and generally becoming the heroes of that species of literature that revels in bodice-busting sybaritic rakes who play by their own rules but have a heart of gold. (Sample escapade: walking a carnival parade with a cart full of police effigies — whipping them all the way, to the glee of the crowd. Thackeray celebrates more Cartouche folklore here, like the time he robbed as part of a threesome, talked one accomplice into murdering the other in order that the two survivors should have greater shares of the spoils to divide — only to round self-righteously on the killer once his pistols were safely discharged and gun him down in turn with the words “Learn, monster, not to be so greedy of gold, and perish, the victim of thy disloyalty and avarice!” That’s a pretty good one, whether it really happened or not.)
The flesh-and-blood police started to roll up this group around 1719, turning arrestees into informants and hunting ringleaders to ground. True to character, Cartouche defied with his liberty the growing price on his head, deftly giving gendarmes the slip until a confederate betrayed him into his enemies’ hands literally while his pants were down.

The guy very nearly broke out of prison — tunneling out of a dungeon of the Chatelet into a neighboring basement, only to have the clank of his chains rouse the family dog into a woofing frenzy that betrayed him before he could vanish out the front door. But even back in the clink,
came a period of splendid notoriety: he held his court, he gave an easy rein to his wit, he received duchesses and princes with an air of amiable patronage … His portrait hung in every house, and his thin, hard face, his dry, small features were at last familiar to the whole of France. M. Grandval made him the hero of an Epic — “le Vice Puni.”
Cartouche was doomed to breaking on the wheel after a morning suffering the tortures of the boot in an unavailing effort to extract further incriminations from the rogue.*
Cartouche seems to have fully expected his troupe to reciprocate this heroism by rising to the dramatic occasion of a rescue from the very scaffold. But as the prisoner arrived at the Place de Greve, he perceived at last that like Christ he had been abandoned at the critical hour by the men who had sworn oaths with him. The great desperado’s final act was to retaliate upon these faithless friends (and family!) by taking aside his prosecutors and detailing his every accessory in crime, even his lovers. What the worst extremities of medieval torture could not procure from him, the compelling incentive of revenge instantly conjured.
Our hero went to his death this day but his revenant spirit stalked France for many months thereafter as dozens succumbed (pdf) to Cartouche’s scaffold indictment. One diarist recorded the following July,
Nothing but hangings and breakings on the wheel! Every day some Cartouchian executed.
* Available sources are flatly contradictory between the story that Cartouche was to die on the 27th and his confessions stalled things until the 28th, or was to die on the 28th all along, or was to die and did so on the 27th.
On this date in 1880, legendary bushranger Ned Kelly hanged at Melbourne Gaol.
The Dick Turpin of Australian outlawry — in the sense that he’s the first name on the marquee — Kelly was the son of an Irishman shipped to Van Damien’s Land on the British convict transportation plan.
When Ned was all of 11, pa died doing a six-month prison stint at hard labor for stealing a neighbor’s cow, and it wasn’t much longer before young master Edward was making the acquaintance of the law himself: arrested for assault in 1869 at age 14; arrested once again the following year as an accomplice to the bushranger with the pornstar name, Harry Powers; imprisoned later in 1870 for three years for receiving stolen goods … and then he got into the family horse-rustling racket upon his release. Crime and gaol were just part of Ned’s world.
So was police antagonism.
The man’s famous last years started with what reads as a trumped-up run-in with a cop who turned up at a station complaining that the Kellys had shot him. (The Kelly story is that he got fresh with Ned’s sister and got whacked by a shovel.) Whatever the facts of the matter, it sent Ned and his brother Dan into the bush as fugitives.
At Stringybark Creek, the “Kelly gang” got the drop on the police posse sent to arrest them, and three officers died in the firefight. Now there was real trouble.
An 1878 “Felons Apprehension Act” immediately proscribed the men, making it “lawful for any of Her Majesty’s subjects whether a constable or not and without being accountable for the using of any deadly weapon in aid of such apprehension whether its use be preceded by a demand of surrender or not to apprehend or take such outlaw alive or dead.”
The ensuing two-year saga was a captivating cycle of dramatic robberies, escalating government bounties, state hostage-taking in the form of imprisoned family and friends, and Kelly’s own Joycean self-vindication.

The hunt culminated in a cinematic shootout at the Glenrowan Inn, Kelly an accomplices entering the fray clad in bulky but effective homemade body armor they’d literally hammered out of ploughshares. (It’s thanks to the armor’s protection of his head and trunk that Ned Kelly survived the Glenrowan siege so he could be hanged instead.) Now on display at the State Library of Victoria, it’s the most queer and recognizable artifact of an era that was already then slipping into the past.

I do not pretend that I have led a blameless life or that one fault justifies another; but the public, judging a case like mine, should remember that the darkest life may have a bright side, and after the worst has been said against a man, he may, if he is heard, tell a story in his own rough way that will lead them to soften the harshness of their thoughts against him and find as many excuses for him as he would plead for himself.
This cut no ice with the men who judged him guilty of murder, but the brawler, cop-killer, bank-robber Kelly seems to have found a way to tell that story to posterity and its thoughts have softened very much indeed.
Everything from his hardscrabble upbringing to his romantic man-against-the-world criminal career to his iconic robot-suit armor to his existentially heroic last words “such is life” equips his image for posthumous appropriation. He seems one-half charming anachronism, one-half hirsute postmodern avatar, especially when you go sculpt a mailbox out of him.
131 years dead today, Ned Kelly remains very much alive in memory. To this day, descendants and supporters lay flowers at the Melbourne Gaol where he hanged, and the recent decision to release his remains for reburial (as Kelly himself requested) made national headlines.
