1806: Dominic Daley and James Halligan, hated foreigners

On this date in 1806, immigrants Dominic Daley and James Halligan were hanged at Northampton, Massachusetts. In the words of one widely reproduced report, “They persisted in their innocence to the last moment, although there were perhaps not a single one of the numerous spectators present, which was presumed to amount to nearly 15,000, who entertained a doubt of their guilt.”

Today, nearly everyone thinks them innocent.

The case began, as many wrongful convictions do, with a particularly outrageous crime — a young farmer, Marcus Lyon, found dead in a Massachusetts creek en route to his home in Connecticut. He’d been shot through the chest and his brains battered out of his skull. The motive: robbery.

In the absence of substantive evidence, some witnesses with vague reports of strangers on the fatal turnpike furnished tissue for an entire theory of the case, and through the misapprehended focus of tunnel vision the strangers became Irishmen, and the Irishmen became Dominic Haley and James Halligan.

In the close aftermath of American independence, New England was still overwhelmingly Anglo-Saxon and Protestant. Most of the Irish people about at this moment were also Protestants: large-scale Irish Catholic immigration into the region only began in the 1820s and it panicked the normies when it came, with preachers and politicians railing against the insidious incursions of idolatrous papists.

So in 1805, when the hunt for strangers settled on two Irish-born Catholic immigrants … well, what was left to know? Just days later, a North Wilbraham Congregationalist minister thundered from the pulpit,

We see the evil attending a continued influx of vicious and polluted foreigners in this country. Many of the outrages we suffer proceed from this source. Who break open our homes in the unsuspecting hours of sleep? Who set fire to our large cities and towns for the sake of plunder? And who rob and commit murder on our highways? We are far from exculpating all of our own native citizens; we regret, indeed, that so many of them disgrace themselves and injure society by evil deeds. But these things notwithstanding, we are doubtless justified in saying, that a great proportion of the crimes above mentioned, together with many others which might be named, are committed by foreigners. And that atrocious deed which has so recently congealed all our blood with horror, in this place, is supposed to have been perpetrated by foreigners. Look at the annual reports of the overseers of the prisons and you will find them be principally occupied by foreigners

The first planters of this country were, generally speaking, men of pure lives and good morals and they were induced to come here for the sake of religion. And, for a long time, they maintained a wholesome and orderly state of society. But since the rapid increase of our commerce with other nations, and the great ingress of foreigners, many of whom are said to come here for the sake of escaping the retribution of justice in their own country; we have ripened apace in all the arts of vice and depravity. Some, who come among us from abroad, we readily acknowledge to be worthy and good men, and we cordially welcome their approach. But the number of these is comparatively small. The best and most useful citizens are cautiously retained, while the worst are readily parted with. Hence the rapid influx upon us, of late, of the most violent and abandoned of the human race. The late and present disturbances in foreign countries have greatly increased the calamity. The prisons of Europe and the West Indies are now disgorging themselves upon our shores; and this country is thus becoming the general asylum of convicts. This is a sore evil, and will furnish an increasing number of inhabitants for our prisons and victims for the halter.

The case in court would comprise 24 witnesses not one of whom had witnessed the crime; at most they could suggest that two strangers had taken the same well-trafficked public road on the same day as the victim, who was also a stranger in these parts. Even this much was not certain among the witnesses; their renderings were vague, tentative, contradictory — but witness recollections and prejudicial readings of circumstance soon shaped themselves around the shared understanding of events, and from so much smoke they wove the hemp.

The friendless immigrants’ court-appointed attorney, Francis Blake, who had been tasked with this first capital case of his life a bare 48 hours before the trial opened, made a vehement, eloquent, and futile address to the jury against “this illiberal, this inhuman prejudice” closing around the throats of his clients.

That the prisoners have, however, been tried, convicted, and condemned, in almost every bar-room, and barber’s-shop, and in every other place of public resort in the county, is a fact which will not be contested. That the sentence of the law has not been anticipated, and that they have not already suffered the penalty of death, may be ascribed rather to defect of power, than to lenity of disposition, in many of their accusers …

There is yet another species of prejudice, against the influence of which it is my duty to warn you. I allude to the inveterate hostility against the people of that wretched country, from which the Prisoners have emigrated, for which the people of New-England are peculiarly distinguished …

Pronounce then a verdict against them! Condemn them to the gibbet! Hold out an awful warning to the wretched fugitives from that oppressed and persecuted nation! Tell them that although they are driven into the ocean, by the tempest which sweeps over their land, which lays waste their dwellings, and deluges their fields with blood; — though they float on its billows upon the broken fragments, of their liberty and independence; — yet our inhospitable coast presents no Ararat upon which they can rest in safety; that although we are not cannibals, and do not feast upon human flesh, yet with all our boasted philanthropy, which embraces every circle on the habitable globe, we have yet no mercy for a wandering and expatriated fugitive from Ireland. That the name of an Irishman is, among us, but another name, for a robber and an assassin; that every man’s hand is lifted against him; that when a crime of unexampled atrocity is perpetrated among us, we look around for an Irishman; that because he is an outlaw, with him the benevolent maxim of our law is reversed, and that the moment he is accused, he is presumed to be guilty, until his innocence appears! …

The lives of the prisoners are now consigned to your disposal. Before you proceed to the performance of this awful duty, let me borrow the language of one of their countrymen, not degraded by the ignominious reproaches against his nation, but elevated to the highest rank among the orators of the elder world by the most splendid talents, the purest patriotism, and the most unsullied integrity. Let me beseech you to “remember that there is another than a human tribunal, where the best of us, will, on one day, have occasion to look back on the little good we may have done. In that solemn trial may your verdict on this day give assurance to your bones and afford you strength and consolation in the awful presence of an adjudging God!”

The words fell on deaf ears.

Daley and Halligan maintained their innocence from arrest to execution, but in the end they would require the offices of another foreign refugee, Father Jean-Louis de Cheverus, a French-born priest in Boston, who had fled the anti-clerical paroxysms of his own homeland. (Later, he would become the first Catholic Bishop of Boston.) It’s said that he stayed in jail with his charges, as no one in Northampton would suffer the papist priest to sleep under their own roof — and that his ministrations to them included the first Catholic mass said in that city.

Folklore cropped up around the 1830s to the effect that a local man had given a deathbed confession exonerating the hanged Irishmen … and that this murderer was the kinsman of one of the witnesses against Daley and Halligan. I cannot establish that this is any more than a just-so story, a fable, but even so it speaks to the continuing injury done by this execution to the now-growing Irish Catholic community. In time that demographic’s maturing numbers and political muscle flipped the story of Daley and Halligan from one of foreigners ripened in depravity to a sobering caution against bigotry and rush to judgment.

We have no real way, now, to access a definitive assessment of guilt or innocence; we can certainly say with confidence that the evidence was appallingly flimsy to hang a man even for the time. Both Daley and Halligan were posthumously exonerated by a writ of Massachusetts Gov. Michael Dukakis in 1984. 1584: Samuel Zborowski, dangerous precedent

On this date in 1584, Samuel Zborowski was beheaded at Krakow’s Wawel Hill for treason and murder committed ten years before.

A monument to the timeless abuse of the prosecutor’s discretion, Zborowski (English Wikipedia entry | Polish) was a powerful nobleman who got into a snit when nobody of equal stature would enter the lists with him at a tournament.

Instead, his challenge was answered by a common trooper in the retinue of the castellan of Wojnice,* one Jan Teczynski. Pissed at the affront, and doubly so when his own retainer was defeated by Teczynski’s, Zborowski went right after Teczynski right there in the presence of the newly elected Polish king, Henry de Valois.** The affront of lese-majeste was compounded when Zborowski’s flailing mace mortally wounded another castellan who attempted to intervene.

The outlawed Zborowski fled to the protection of Stephen Bathory,† Voivode of Transylvania.

That might have been that, and left Zborowski to join Europe’s forgettable ranks of exiles, adventurers, and pretenders playing out the string under the patronage of some foreign prince.

But when the elective throne of mighty Poland came open soon thereafter, Zborowski’s patron decided that he liked the look of it — and he obtained the result, with the help of a dynastic marriage into Poland’s Jagiellon dynasty of illustrious memory.

Since the Zborowskis had been big supporters of Stephen Bathory, Samuel returned as well, justifiably anticipating not merely pardon but elevation. To their dismay, they found themselves frozen out … and they responded with a series of insubordinations: plotting with the invading Russians, fomenting an unwanted diplomatic crisis with freelance attacks upon the Ottomans.

In the end, our man was undone by the same violent highhandedness that had forced his flight from Poland in the first place. Zborowski’s ill treatment of the young lute composer Wojciech Dlugoraj left the latter so desperate to escape Zborowski’s court that Dlugoraj stole some treasonable correspondence between Zborowski and his brothers and sent it to Zborowski’s enemy, Jan Zamoyski.‡ Those letters indicated that Samuel was contemplating assassinating the king.

Zamoyski found, and Bathory agreed, that the most expedient way to remove this troublemaker was simply to execute the 1574 sentence, from that bludgeoned castellan. The new regime had conveniently never bothered to lift it.

Although legal, Zborowski’s execution was obviously quite irregular and it outraged many in the nobility who perceived it a potential precedent for absolutism; recrimination over the action tore apart the 1585 meeting of the Polish Sejm. (In later years, this body formally endorsed Zamoyski’s actions but only after enacting a Lex Zborowski to better govern the handling of treason cases.)

* At the time an important fortified city, Wojnice or Wojnicz was ravaged by a Swedish army in the 1650s and never recovered; today, it’s a town — having only re-promoted itself from “village” status in 2007 — of fewer than four thousand souls.

** This youngest son in the French royal house had seemed to the Valois safe to make available on the transfer market for foreign sovereigns. However, his brothers’ uncanny talent for dying young without issue very soon required his return to his homeland to take up the throne of France as Henri III during that country’s Wars of Religion. There Henri proved not to be exempt from the family curse: we have previously explored the circumstances of his own violent death — which was also the end of the House of Valois — during the War of the Three Henrys.

† A legendary surname in the annals of horror. This Stephen Bathory was the maternal uncle of the infamous “Countess of Blood”.

‡ The gambit did indeed get the scared lutenist free from Zborowski’s control, but he had to flee to Germany for fear of Zborowski kinsmen’s vengeance.

1989: Stephen McCoy, botched

Rapist-murderer Stephen McCoy succumbed to a badly botched lethal injection in Texas on this date in 1989.

McCoy, according to the Death Penalty Information Center,

had such a violent physical reaction to the drugs (heaving chest, gasping, choking, back arching off the gurney, etc.) that one of the witnesses (male) fainted, crashing into and knocking over another witness. Houston attorney Karen Zellars, who represented McCoy and witnessed the execution, thought the fainting would catalyze a chain reaction. The Texas Attorney General admitted the inmate “seemed to have had a somewhat stronger reaction,” adding, “The drugs might have been administered in a heavier dose or more rapidly.”

McCoy with two accomplices, James Paster and Gary LeBlanc, had committed a cut-rate murder for hire, grossing $1,000 to shoot someone’s ex-husband in the parking lot of a club. Paster, who actually pulled the trigger on that murder, suggested to his mates that they would all rest a little easier in one another’s silence if they jointly committed two more homicides, with each taking his own turn as the murderer.

To that end, they kidnapped one Diana Oliver in November 1980, gang-raped her, and had McCoy take her life with an improvised garrote. Their third victim was 18-year-old Cynthia Johnson, abducted from her stranded vehicle on New Year’s Eve 1980, and also raped and strangled to death.

Paster was also executed. LeBlanc copped a long prison sentence for cooperating with the state against his accomplices.

1883: Not Alferd (sic) Packer, #nerdprom attendee

The National Press Club is probably best known for its White House Correspondent’s Dinner. This site prefers to think of it as the site of the Alferd Packer plaque, a memorial to a cannibal who avoided hanging.

The plaque is rather unassuming, its simple polished brass declaring: “The Alferd Packer Memorial Grill — In Memory of Stan Weston 1931-1984.” Weston was the public affairs officer at the U.S. Department of Agriculture, who came up with a 1977 contest to name the USDA’s new cafeteria. But hold that thought for now.

Packer was born in Pennsylvania in 1842. He made his way west and joined the Union Army in Minnesota, then ambled on into the Rockies as a pioneer after the Civil War. In a particularly stunning feat of incompetence, he and five others separated from a larger expedition and tried to make it across a mountain pass in January 1874. Three months later, Packer arrived on the other side, declaring that he got separated from the other five.

But Packer had taken money and effects from them, which made the remaining members of his expedition more than a little suspicious. Caught out in a lie, Packer confessed to a carnivorous progress through his comrades: Israel Swan froze to death, and he was eaten; James Humphreys died a few days later, and he was eaten; then Frank Miller was likely murdered and eaten; and George “California” Noon fell to the pistol of Wilson Bell. With Bell armed and dangerous, Packer claims to have killed him and taken a bit of a snack for the road.*

Packer was arrested shortly after his return, but he slipped his bonds and escaped to Wyoming. There the law finally caught up to him. He was returned to Colorado, where a judge sentenced the cannibal to death.

The hanging was not to be. Packer appealed the conviction, which was ultimately overturned by the Colorado Supreme Court; on retrial he was remanded for a 40-year prison sentence instead. He was paroled in 1901, took a job as a guard at the Denver Post (who had, incidentally, helped him make parole), and died in 1907.

Back to the memorial grill.

Why would the USDA honor such an odd historical figure? Politics.

In 1977, newly appointed Secretary of Agriculture Bob Bergland had a beef with the General Service Administration, which refused to terminate the Nixon-era contract award for cafeteria services and food. Bergland’s response? Let the disgruntled employees name** and shame. The USDA cafeteria became the Packer Memorial Grill,† and Bergland paraded the press through the facility, taking every opportunity to point out just how similar he felt the food was to the diet of the honoree.

The contract was rescinded later in 1977. The plaque, meanwhile, was taken off the wall just a week after its installation. Initially, the GSA claimed it was not approved prior to installation, but it turns out the building manager, a GSA employee named Melvin Schick, simply found the name distasteful.

All of which begs the question of how it ended up gracing the National Press Club’s bar, emblazoned with Stan Weston’s name. The answer probably lies in Wesley McCune, founding member of the “Friends of Alferd Packer” and member of the National Press Club. Schick returned the plaque to Weston after the goings-on at the USDA cafeteria, and Weston hung it in his office. McCune’s group met most Aprils to hold an Alferd Packer dinner at the National Press Club. Stanley D Weston died in July of 1984, and while it’s unclear when the plaque went up, by 1989, this unusual object had a permanent home.

1693: Francis Winter, at the Whitefriars sanctuary

On this date in 1693, Francis Winter was executed for the murder of a London sheriff.

Winter’s hanging takes us back to the last days (in England) of a queer old institution: sanctuary. Dating to centuries before the Norman conquest, this privilege of holy places to confer legal immunity upon fugitives was well into its dotage. In principle and sometimes in practice, a fellow could once upon a time frustrate the pursuit of the law by reaching such a sanctuary. However, most legally recognized sanctuaries had been eliminated with the Reformation.

Among the last of their breed was a dubious district between Fleet Street and the Thames, known as Whitefriars after the Carmelite monastery that had also germinated its zone of sanctuary. Though the Carmelites had been expelled in the 16th century and the right of sanctuary for criminals abolished in general during the 1620s, still Whitefriars held onto this association through the 17th century, gradually accumulating civil refugees such as debtors and an accompanying red light district bustling with taverns, brothels, thieves, and other accoutrements of the urban underbelly.*

This interesting place would come to be nicknamed “Alsatia”, tribute to the continental frontierlands between France and Germany which was controlled at the time by neither and thus perceived as lawless, and its reputation earned a literary profile to match: playwright Thomas Shadwell had a 1688 hit with his cant-heavy** portrayal of Whitefriars rogues (with evocative names like Cheatley, Shamwell, and Scrapeall) in The Squire of Alsatia.


Whitefriars retained its shady reputation long after the end of sanctuary: In William Hogarth‘s 1747 Industry and Idleness prints, the gallows-bound “Idle ‘Prentice” is seized by the authorities at a dive in the district’s Hanging Sword Alley. (Meanwhile, a murdered body is dumped into the cellar in the background.)

By this late date, “sanctuary” was a fading custom and was for that reason defended all the more vigorously by its claimants — all of whom shared a desperate interest in the crown’s maintaining a hands-off policy in “Alsatia”.

“The libertines, the rogues, and the rascals, who frequented its purlieus and committed abuses and outrages on peaceable citizens, made it a notorious place of criminal resort,” one history observes. “Bailiffs and officers of the law were afraid to enter its precincts to serve warrants or make executions.”

Our man Francis Winter was one of these fugitives bold enough to strike fear into the officers of the law.

In 1691, the Temple attempted to seal a gate connecting to Whitefriars. The Alsatians resisted this impediment to their movement, and when sheriffs showed up to control the situation the resistance turned into an outright riot. A lawman named John Chandlor was fatally shot in the fray.

This near-insurrection was far too much disturbance for a state whose tolerance for an open thieves’ district was very near its end. After some months evading arrest, Francis Winter would hang on May 17, 1693 for leading the angry mob. (He may or may not have personally pulled the trigger that killed Chandlor; given the chaotic situation, even contemporaries weren’t sure about it.)

Winter was a Cornish former ship’s captain who had commanded a vessel in England’s war against the Dutch a generation earlier; according to the Newgate Ordinary, Winter had then “behaved himself with a great deal of Candor and Courage.” Financial ruin later in life had driven him to Whitefriars where evidently he still retained the knack for leadership. Despite his offense against the public peace, Winter earned the Ordinary’s regard for accepting his sentence with pious equanimity.

Perhaps in respect for this frame of mind — or more probably, the better to orchestrate the demonstrative spectacle of an execution at the very gates of Whitefriars — Winter was reprieved from a May 8 mass hanging at Tyburn by Queen Mary II. (King William III was away, warring on France.) Then, upon the 17th,

he was put into a Coach at Newgate Stairs, and from thence Conveyed down Old Baily, and over Fleet-Bridge, to the Fryars Gate, in the way to which place, there were several Thousands of Spectators, who thronged to see him, when the Cart was settled under the Gibbet, and he put into it, (which was Erected there on purpose) he stood up, and spake as follows: I have no Publick Declaration to make here, my Thoughts being wholly taken up in the Concerns of my Eternal Welfare, for that is the Work that I am come here to do: Therefore I desire that I may not be interrupted. Then the Minister Prayed with him, and for him, and Recommended him to the Mercy of God, Etc.

The right of sanctuary was fully abolished in 1697.

* One notable denizen was the writer Daniel Defoe, who sought relief from his debts in Whitefriars in 1692.

1968: Karol Kot, the Vampire of Krakow

On this date in 1968, Polish serial killer Karol Kot, called the Vampire of Kraków, was hanged in the city of Mysłowice. He was only twenty-one years old.

Kot was born in Kraków in 1946, the son of an engineer and a housewife. His abnormal, violent behavior began early. He was jealous of his baby sister, who was born when he was eight, and thought their parents loved her more. While their parents were away, he beat her and even tortured and killed her pets.

He was fascinated by death and hung around slaughterhouses in his free time, helping the employees there kill calves and drinking the animals’ blood.

Most of the sources about Karol Kot, such as this Warsaw Post article, and this article from Polish Newsweek, are in Polish. He was, however, the subject of an episode in the 2014 English-language documentary series Killers: Behind the Myth.

This Kraków Post article describes Kot’s origins. He did well enough in his studies at school, but his classmates knew him as a shy, withdrawn loner and a weirdo. Between that and his enormous knife collection, it’s no wonder there was a running joke at Kot’s school that he must be the Vampire of Kraków.

One of the few things he truly excelled at was shooting; he was the star of the local rifle club. At one point he was ranked tenth in the entire country in the youth division. Kot’s coach mentored him, invited him to his home and even told his own son, “Be like Karol.” Kot found this hilarious: he had been planning to murder the boy.

He committed his first knife attack in September 1964, at the age of seventeen, stabbing a 48-year-old woman repeatedly inside a church as she knelt to pray. She survived. In fact, she didn’t even realize she was hurt until she went home, removed her coat, saw that she was bleeding and went to the hospital.

Kot went after his second victim, a 73-year-old woman, a few days later. Kot saw her exit a tram, followed her home, and stabbed her in the back as she walked up her front steps. She survived, but remained paralyzed for the rest of her life.

Six days later he stabbed a third woman, 77 years old, again inside a church; this was his first fatality. When the nuns found her, with her dying breaths the victim whispered that her attacker had been a schoolboy.

All three of Kot’s first victims were older females. He committed no more stabbings for a year and a half, but became interested in poison instead. Kot laced open bottles of beer and soda with arsenic and left them lying around, hoping someone would drink from them, but no one was tempted. He tried giving a poisoned drink to a classmate, but his intended victim poured it out because it smelled funny.

In 1966, Kot gave up on the poisoning idea and returned to his old weapon, the knife. He changed his target demographic from elderly women to young children.

In February, he stabbed and killed an eleven-year-old boy named Leszek at Kościuszko Mound. It was a horrific attack, with far more wounds inflicted than were necessary to kill Leszek. In April, Kot attacked a little girl named Małgorzata as she was checking the mail outside her home. He stabbed her a total of eleven times in the chest, back and abdomen. She suffered from severe internal injuries, but survived.

After knifing Małgorzata, Kot went to the militia to get his gun permit renewed, then went home.

In Communist Poland, crime was rarely reported in the newspapers. In the case of Kot’s murders, however, the vexed police took the rare step of issuing press releases about his crimes, appealing to possible witnesses to come forward with information.

The citizens of Kraków were terrified. People began going out with boards and cast-iron pot lids stuffed under their clothes to protect themselves from the Vampire’s blade.

Kot was caught after he bragged about his crimes to fellow member of the rifle club. She didn’t believe him until she read in the newspaper about the attempted murder of Małgorzata. Then she went to the police.

He was arrested, but was permitted to take his final school-leaving examinations, in hopes of forestalling an anticipated insanity plea. Police used the fact that he passed his exams as evidence that he was rational and sane.

After being taken into custody, the baby-faced killer denied everything. But after his surviving victims all identified him as their attacker, he cheerfully confessed to everything. He said he committed the murders because it gave him a sense of pleasure, and he enjoyed drinking his victims’ blood as they lay dying. He even studied books of human anatomy to figure out where to place his knife.

The murders thrilled him and gave some spark to his “heavy, dull and colorless” life, he said. He felt no remorse at all.

Kot’s rifle coach was outraged at first when he heard that such a fine young athlete had been arrested. Surely this was a miscarriage of justice. After Kot confessed, however, his devastated coach wrote to him in prison, asking him to return his rifle medals because he was unworthy of them.

In his final interview, Kot said, “Soon, where I’m going, I’ll meet with my victims, and we can speak. Here on Earth, I have no one to talk to.”

Kot was sentenced to death, but his sentence was reduced to life imprisonment on appeal due to his youth. However, after the General Prosecutor intervened, the death sentence was reinstated and Kot was hanged.

On autopsy, a large tumor was found in his brain. It had gone undiagnosed in life. Whether this was the reason for Kot’s sadism is anyone’s guess.

1916: Thomas Kent

On this date in 1916, Thomas Kent was shot in Cork, Ireland — the only person executed that May for the Easter Rising outside of Dublin.*

The Kents were were prominent nationalists of several generations’ standing in County Cork and were all set to join the Easter Rising until the last-minute countermanding order went out.

When the Rising happened anyway in Dublin — a day later and numerically much smaller than originally intended — the constabulary was preventively dispatched throughout the island to arrest known fellow-travelers … like the Kents.

The constabulary’s attempted raid on the Kent property May 2 met armed resistance that became an hours-long siege; Constable William Rowe was shot dead, as was Richard Kent.

The surviving Kent brothers, William and David,** along with our man Thomas, were all tried for affair: William was acquitted, David condemned but the sentenced commuted, and only Thomas actually executed.

Cork’s main railway station was in 1966 re-christened Kent Station in his honor.

* In August of that year, Roger Casement hanged in London for treason in connection with the Easter Rising. Casement had not taken any direct part in the fighting, but had worked to arrange the (attempted) support of Britain’s wartime enemy, Germany.

1864: Utuwankande Sura Saradiel, Ceylon social bandit

Ceylon social bandit Utuwankande Sura Saradiel (or Sardiel) was hanged by the British on this date in 1864.

Saradiel fled a barracks servant’s life to take the road as a bandit. He’s alleged to have gallantly shared his proceeds with the poor; what he unquestionably did was tweak the tail of the powerful (and in this case, colonial) overlords. As is often the case with social bandits, it is difficult to know for certain whether it is for reason the latter that he enjoys the reputation of the former.

The indefatigable brigand was captured multiple times and made at least two escapes — inherently a winning public relations move — eventually maintaining himself from a picturesque mountain cavern and authoring throwback knight-of-the-road exploits to earn the nickname “Robin Hood of Ceylon”.*

Naturally, there is always a Sheriff of Nottingham.

Saradiel cinched his fate by shooting dead a constable in the course of his arrest. Considering that circumstance, we here at Executed Today are officially skeptical of the legend that a misplaced comma — “kill him, not let him go” when “kill him not, let him go” was intended — decided the man’s fate.

* The best one is that, having robbed from a father what he later learned to be the dowry for a bride-to-be, the robber found his victim again to return the sum, compounded by gambling winnings. Heart of gold, this guy!

Unspecified Year: Vilem, the Forest King

On this date in an unspecified year, the bandit Vilem is broken on the wheel and beheaded in the classic Czech poem Maj, by Karel Hynek Macha.

Maj (“May”) commences with a lass called Jarmila on the first day of that month who waits on the shores of a Bohemian lake now named for Macha for her outlaw lover … only to be told by a boatman that her sweetheart in fact reposes across that body of water, weighted with irons in a castle dungeon, where he awaits a dawn execution for murdering his own father, who was also Jarmila’s seducer. All concerned reflect and pine through a melancholy night, and come morning Vilem is put to death as planned and gibbeted on his breaking-wheel; years later, his still-visible remains occasion a traveler-narrator to discover and somberly reflect on the events, and the ephemerality of all things: “My youth, alas, my youth! My season and song are May! / An eventide of May on a rocky, desolate shore: / Light laughter on the lips, deep grief in the heart’s core.”

This tale, recognizable to every Czech, has been put to the silver screen on several occasions. Macha’s timing was impeccable, for he self-published it in 1838, right when central Europe’s romantic social banditry mythos was forming. According to Mohmir Grygar, the name “Vilem” (Wilhelm, William) might allude to the executed Tyrolean chancellor Wilhelm Biener, although Biener himself — a fallen overmighty politico, not a gold-hearted brigand — bears little resemblance to his alleged literary descendant.

Rocks are piled heavy on that far shore
Where flowering land and lake are meeting,
And there an oak-tree old and hoar
Roots in the rocks-once, once the dove
Called there deliciously to love—
Oh, fair lost hour and fleeting!
Never again! The mound is nearing,
The column an the wheel appearing.
Beyond the hill there slips away
A young wood, murmuring mournfully;
Radiant the sun on vale and lea—
The morning dew—the morning May.

Beauty once more the felon’s eyes receive,
Beauty which now for ever he must leave,
And passionate regret his heart possesses:
Deeply he sighs—tear after tear flows over—
One last long look, lingering as looks the lover,
Then to the sky his tear-dimmed eyes he raises.
In the azure vault of heaven the blanching mists are dancing,
In light dissolving zephyrs tattered,
And on the far horizon scattered
White cloudlets over the placid sky go glancing.
The grieving prisoner greets them as they race:
“You clouds, who in your wandering course embrace
Like secret circling arm the earth her own course keeping,
You dissolutions of stars, shades in the blue of heaven,
You mourners ever to mutual sorrow given,
Who know so well the ways of silent weeping—
Bear you my charge, of all things that have birth.
Where you pass from me on your long, wide way
To the distant shore, there for a moment stay,
There, pilgrim clouds, greet reverently the earth.
Ah, well-beloved earth, beautiful earth,
My cradle and grave, the womb that gave me birth,
My sweet, sole land, left to my spirit’s keeping,
Ah, vast and single of beauty as of worth!-
Seek there that rock, and when your swift sails gain it—
If you shall see—by the shore—a woman weeping—”
There fails his voice, the strangling tears have slain it.
Down from the height the guards their prisoner lead
By a wide pathway through young pinewoods threading,
Down and still down; now on the mound they’re treading;
And now the multitude is hushed indeed.
The executioner with his sword stands ready.
Yet one more time the prisoner lifts his eyes,
Worships the sweet, encircling world-once sighs-
And on the approaching death his soul makes steady.
His breast and throat he bares, kneeling to earth he leaves it;
Back steps the headsman-an age the frozen mind believes it!—
The sword flashes; a rapid forward stride—
The sword circles; the bent white neck receives it—
The head falls—a tremor—and yet a tremor beside—
And falls the body after, one with the grieved earth growing.
Into the earth, so beautiful, so beloved.
His cradle and grave, the womb that gave him birth,
His sweet, sole land, his heritage approved,
In the generous earth, the single, holy earth,
Into the mother’s heart the blood of her son is flowing.

The prisoner’s shattered shell, limb after long limb broken,
Twined in the wheel’s embrace is raised, a terrible token,
And over the wheel his head, a blind, oblivious thing.
So died the lord of the woods, the dreaded Forest King.
On the dead countenance the last dream lingers still.
Gazing upon his face, mute round the little hill
The unquiet multitude awaits the long day’s ending,
Till the declining sun draws to the west once more,
Into the head’s blind eyes its gay last laughter sending.
Hushed is the broad lake-hushed is the evening shore.

Above the far dark hills the last radiance blazed.
The pale, dead face of the head is softly silvered o’er,
Silvered the silent mound, hushed by the lake-shore,
As in the evening hush the moon’s fair face is raised.
Distant are grown the towns, far as a cloud in air,
Beyond to the edge of seeing the dead eyes steadily stare,
To the edge of sight, to his youth-Oh, brief, bright childhood day!

Time in its headlong flight has carried that Spring away.
Far fled is his dream, a shadow no more found,
Like visions of white towns, deep in the waters drowned,
The last indignant thoughts of the defeated dead,
Their unremembered names, the clamour of old fights,
The worn-out northern lights, after their gleam is fled,
The untuned harp, whose strings distil no more delights,
The deeds of time gone by, quenched starlight overhead,
Heresy’s pilgrimage, the loving, lovely dead,
The deep forgotten grave, eternal board and bed;
As the smoke of burned-out fires, as the shattered bell’s chime,
Are the dead years of the dead, their beautiful childhood time!

Late eve—the second eve of May—
The twilit May—the time of love—
Meltingly calls the turtle-dove:
Vilem! Vilem! Vilem!!

Intermezzo II

Close the hills lean to each other,
Underneath a dark cloud hiding,
Like a vaulted ceiling riding
Taut from one peak to his brother.
Dark this place by evening gloom is,
Dark and silent as the tomb is.
In the portal deeply-shaded,
Where the hills shrink back dividing,
Sharp rocks in the opening spaces
Steeply rear their frowning faces,
Lower, narrower, blackly biding;
Underneath the cloud dark-braided
Shuts this gate of rocks and boulders.
In the valley’s heart deep-gladed,
Darkly red a camp-fire smoulders,
Broken from the west bright-beaming,
A long sliver of the sunset;
Round its red nocturnal gleaming
Circle night-birds, wheeling, plaining,
In a red and restless onset,
Till the blue of night they borrow.
Sinks the fire, still waning-waning,
Till the broad and bounteous heaven
Melts in nightly dews of sorrow,
And the earth to grief is given.

Oaks a hundred years a-growing,
Darkness within darkness throwing,
Hide a company of friends there.
Cloaked in white, as in the bright time,
Sit the comrades of the night-time.
Each before him groundward bends there,
Wordless, motionless, his vision,
As if terror’s chill transition
Into stone their flesh had stricken.
Through the valley seems to quicken
Whispered breath of lamentation
Round the moveless men who plain him,
Secretly, without cessation:
“Lost, our leader!—they have slain him!”

And the wind, the smoke-wreaths plying,
To the moveless men is crying:
“Lost, our leader!-they have slain him!”

And the restless leaves aquiver
Underneath the cold cliff-faces,
Trembling, murmuring, utter ever
These insistent, changeless phrases:
“Lost, our leader!-they have slain him!”

All the forests in their station
Sound the great, sad accusation:
“They have slain him—slain him!!—slain him—!!!”

Beautiful May is passed, withered the bloom of Spring;
The summer fire burns high, wanes, and as soon is gone,
Autumn, and winter after; another Spring comes on,
As time bears off the years on its unresting wing.

The seventh year it was, the seventh year’s last day;
Deep on it lay the night, and with the midnight chime
A new year would be born. The cold earth dreaming lay.
Lone hoof-beats by the lake troubled the silent time.
I was that wayfarer, bound for the town by night,
Led by chance to the mound, where, long ago at rest,
The dreaded Forest King lingered a quiet guest;
There first I saw Vilem- a bare skull glistening white.
There in the midnight land, far as the eye’s reach ranging,
Through valleys, over hills, by forest, lake and meadow,
A wide, white pall of snow lay level and unchanging,
Over the skull and wheel-all white without a shadow.
Deep clouds hemmed in the moon, which seemed to droop and sicken;
Sometimes the weird owl cried, ever the sad wind’s shaking
Plucked at the wheel above, and set the loud bones quaking,
So that my horse and I with panic dread were stricken.
Forward I spurred in fear, there where the safe town hailed me,
And asked what wheel, what bones were these which grimly grew there,
The old innkeeper told the story all men knew there-
The story I have told-and on that wheel impaled me.

Far I went through the world-and the world has enough of pain,
Many a storm of heart blew over me and bled me;
But still this old, worn woe beckoned me back again,
Till in a young Spring season home to the mound it led me.
Under the stake I sat, just as the sun descended,
Under the wheel which bore the skeleton and skull there,
Gazing sad-eyed on Spring, whose cup was fair and full there,
Even to the misty rim where earth and heaven blended.

Evening once more, the first of May-

Lay like a wreath of roses growing,
Gilding the bony face with light,
On fretted skin and white jaw glowing.
In the hollow skull the breezes sped
As if grim laughter mocked the dead,
and lifted lightly here and there
What time had left of his long hair;
Beneath his brows the dewdrops borrow
The sunset light, as if, discerning
The evening beauty of May’s returning,
His dead eyes brim with tears of sorrow.

There I sat on, until the young moon’s light
Blanched both my face and his with rays as pale as bright;
Now like a snowy pall its whiteness spreads before him
Over the vales and woods to the distant hills that bore him.
Sometimes from far away the cuckoo’s greeting sounds here,
Flung from the flowering vale, sometimes the owl’s grave warning;
From many a farmyard near the bark of dogs rebounds here;
Out of the dust arises a sweet incense of mourning,
The little tears of the Virgin upon the hill are flowering,
Deep in the heart of the lake a secret light is burning;
And the fireflies, shooting stars, about the wheel are showering,
Glittering in their play, touching the pale skull brightly,
Lighting to launch again, and launch again ac lightly,
Like fiery falling tears, all his spent tears embowering.

And in my grieving eyes two hot tears rise and break,
Glittering down my cheeks as sparks play in the lake;
For my young years, mine too, my childhood golden-gay,

Strain your eyes as you will, the end you cannot see,
As over the edge of vision he falters and finds no rest.
Never-ah, never! And this is all life offers me!
Comfort? Who comforts me? What charm this heart can move?
Love is without an end!—And bitter is my love!

Joseph Sollis was executed in North Carolina on this date in 1827 for murder. It didn’t go so well, apparently leading a regular gawker to pierce the spectacle’s fourth wall and get involved in the action himself.
