1860: William Fee, the only person hanged in Wayne County

On this date in 1860, William Fee became the only person ever executed in Wayne County, New York.

Fee’s alleged victim is not distinguished by a name, at least not one known to Fee’s prosecutors. The anonymous woman turned up dead September 26, 1859 on Wayne County’s old Montezuma Turnpike. She had been strangled, the coroner said — and ravished.

Though she was a stranger, the victim had been seen in the area inquiring about employment. Fee and another man named Muldoon had been observed following her the day previous, and that “following” was cast in a sinister light by their now-unknown whereabouts. Both men were laborers working on an enlargement of the Erie Canal around Lyons, N.Y.

Fee was eventually arrested in New York City; Muldoon, in Scranton, Pa. We’ll return to Muldoon later.

Fee and his ill-favored “Hibernian countenance” stood trial from January 30 to February 3, 1860. “Seats were at a premium in the court room and in the gallery behind the curtains there was a crowd of ladies, listening breathlessly to the testimony,” ran a retrospective from 1913. “During the noon hour, seats were bargained for and sold at 10 cents to 50 cents apiece.”

And though he maintained a superficial calm when the jury returned a guilty verdict against him — “Damn tough, but I’m not going to lie awake thinking about it” — William Fee broke down sobbing when the judge finally sentenced him.

The kid came from a working-class family and had a scrappy reputation. It wasn’t clear as he approached execution that he was handling it with the gravity expected for the occasion by right-thinking gentlemen. Then there was the worry for his eternal salvation: born of mixed Protestant/Catholic parents, he was essentially irreligious and indifferent to a parade of ministers who called upon his cell. (Fee accepted the ministrations of a couple of Catholic priests in his very last hours.)

While clerics kneaded the hard clay of Fee’s soul, municipal officials took a chisel to logistics. Since this was the first (and last) hanging in these parts, the equipment had to be obtained on loan: they borrowed the upward-jerking gallows recently used to execute Ira Stout in upstate New York.*

The gallows was erected in one of the small halls of the jail … four upright posts twelve feet high and five feet apart. Across the top was an oak timber projecting two feet or more beyond the frame. At the front end, above where the prisoner was to stand was a grooved wheel or pully; and another was inserted in the timber over the centre of the frame. The main rope ran over these rollers, one end falling in front, to which the halter was attached, the other dropping to the centre of the gallows frame, where heavy weights were attached. These weights, in all 254 pounds, were suspended by a small cord passing through the main timber above and over it to a pin. The weights had a fall of perhaps eight feet. When the cord was severed by a blow of the axe, the weights fell and jerked the main rope running over the grooved wheels. In order that there should be no failure, Sheriff Snedaker had the gallows put up in the court house and fully tested before removing it to the jail. (New York Herald, April 3, 1860)

Fee came to this device still asserting his innocence, but also asserting that Muldoon wasn’t involved. Don’t worry if those seem a bit at odds; the execution party was confused enough to require clarification, too. Cut him some slack: those 254 pounds of weights weren’t going to cut him any.

The hanging went off without difficulty and, whether influenced by Fee’s parting attempt at exoneration or otherwise, Muldoon was never ultimately brought to trial. The evidence against him being unsatisfactory, he was released some months later.

William Fee’s afterlife — apart from this blog post — is allegedly spent haunting his old Lyons Jail (today, the Wayne County Museum).

* From reports, Wayne County didn’t return the gallows: it was eventually scrapped (someone made a chair out of part of it), and the Lyons Republican nicked the hanging-weight to use as a doorstop.

1136: Gwenllian, the Welsh warrior woman

On an uncertain date perhaps around February 1136, the Welsh princess Gwenllian (or Gwenlhian, or Gwenliana) lost a battle to a Norman lord, who had her summarily beheaded.

This execution occurred in the aftermath of the Norman conquest. Having taken England, those invaders had made inroads into its western neighbor, even temporarily occupying much of the country.

But Welsh lords pushed the Normans back, and we find those Normans at this moment in disarray over an internal succession crisis — a period known as “The Anarchy”.

Seeing the opportunity, Wales’s constituent principalities rose in a “Great Revolt”.

Gwenllian, that hottie from history, was daughter of the ruler of Gwynedd, married in a political match to the ruler of Deheubarth.

While these two men in Gwenllian’s life met up with one another to plot their next moves, Norman raids on Deheubarth forced Gwenllian to lead a force into the field to fight them.

It was a sight “like the queen of the Amazons, and a second Penthesilea,” writes the chronicler. “Morgan, one of her sons, whom she had arrogantly brought with her in that expedition, was slain, and the other, Malgo, taken prisoner; and she, with many of her followers, was put to death.”

That was a bummer for Gwenllian — doomed to haunt the castle under whose walls she fought her fatal battle — but not only her, as her bereaved proceeded to mount a furious counterattackwith a vast destruction of churches, towns, growing crops, and cattle, the burning of castles and other fortified places, and the slaughter, dispersion, and sale into foreign parts, of innumerable men, both rich and poor.”

For centuries afterwards, Welsh armies took the field crying “Revenge for Gwenllian!” The field where the battle was fought is named in her honor, as is a spring there that’s reputed to have welled up at the spot where her head fell. She’s even been speculatively — maybe a bit hopefully — identified as a possible author of the Mabinogion, a Welsh literary classic, but she’s definitely the subject of a bardic lullaby

Sleep, Gwenllian, my heart’s delight
Sleep on through shivering spear and brand,
An apple rosy red within thy baby hand;
Thy pillowed cheeks a pair of roses bright,
Thy heart as happy day and night!
Mid all our woe, O vision rare!
Sweet little princess cradled there,
Thy apple in thy hand thy all of earthly care.
Thy brethren battle with the foe,
Thy sire’s red strokes around him sweep,
Whilst thou, his bonny babe, art smiling through thy sleep
All Gwalia shudders at the Norman blow!
What are the angels whispering low
Of thy father now
Bright babe, asleep upon my knee,
How many a Queen of high degree
Would cast away her crown to slumber thus like thee!

There’s obvious, as-yet-unrealized commercial potential here in this sacrificial princess (though she’s not to be confused with Gwenllian of Wales). Word is that a silver screen treatment of the Gwenllian legend is circulating in Hollywood studios looking to duplicate the success of Braveheart.

1938: Juan Soldado, patron saint of Mexico-US migrants

On this date in 1938, Juan Castillo Morales was shot in a cemetery for raping and murdering an eight-year-old girl.

Morales was executed under the strange ley de fugas (“law of fugitives”), an expedient quasi-lynching arrangement that gave the inmate the opportunity to flee for his life in front of the firing detail. He didn’t make it — nobody ever made it.

But the method of his death is the least bizarre thing about his story.

Juan Castillo Morales is better known today as Juan Soldado, “Juan the Soldier.” He was an army private serving at the border town of Tijuana, just across from San Diego, Calif., when young Olga Camacho disappeared on February 13. (Yes, that’s four days before the execution.)

Olga’s abduction — and the discovery of her body, throat slashed and sexually molested — triggered a public outcry.

Our man was arrested on the 14th, and the evidence quickly started stacking up against him. Even his wife incriminated him. At least, allegedly: there’s very little documentary evidence remaining from the case, and very little about the life of Juan Castillo Morales, all of which helps fuel its latter-day ambiguity.

Castillo Morales, again allegedly, confessed in jail. The public had its pedophile: the man was nearly lynched by rioters threatening to put the whole town to the torch. This radioactive case was disposed of in great haste by a secret military tribunal before the whole city spiraled out of control. Thousands of onlookers turned out for the public “fleeing” execution.

So far, so unsurprising (at least by the standards of these grim pages): a notorious sex crime, a mini-moral panic, a perp done (however unusually) to death.

Now, it gets interesting.


With blood lust sated and Morales entombed in the cemetery where he was shot to death, mysterious reports began circulating … that his grave was oozing blood, and that his anima (soul) was floating around proclaiming his innocence.

Book CoverMaybe there were people who already believed that but dared not speak up when lynch law reigned. Maybe the rushed, not-altogether-judicial “investigation” and the cruelty of the execution catalyzed some latent communal guilt.

But for sure, once the idea that the man was innocent got out there, it had legs. There’s a folk belief that “those who have died unjustly sit closest to God”; before 1938 was out, newspapers had already begun to report people praying at the grave … and some of them reporting miracles worked in consequence.

He wasn’t Juan Castillo Morales the executed army private any more: for posterity, he would be Juan Soldado, the everyman sublime.

Against any odds you’d care to stake, Juan Soldado has developed in the decades since into a going cult figure in Tijuana, and throughout the border region — a popular saint (by no means acknowledged by institutional Catholicism) for everyday people’s problems. A chapel built over his resting place bursts with offerings and thanksgivings.

Juan, as befits a border-town saint, is particularly regarded as a patron of migrants crossing the U.S.-Mexico border, and particularly liable to relieve the troubles of migrants. With that following has, of course, come a general understanding among most devotees that Juan Soldado was innocent, even that he was executed to cover up for a powerful general who was the real killer.

Juan Soldado receives tribute and supplication throughout the year, but particularly on June 24: so little is known about John the Soldier’s real biography that the official feast date of John the Baptist has been appropriated for his celebration, and picnics, pilgrimages, mariachi bands singing “happy birthday”, crowd the cemetery on that day. (The Day of the Dead is another biggie at Soldier John’s shrine.)

Olga Camacho’s family still lives in Tijuana and understandably disdains the cult around the little girl’s presumed murderer.

The curious phenomenon of a devotional following for an executed sex-killer is sensitively explored in the late Paul Vanderwood’s Juan Soldado: Rapist, Murderer, Martyr, Saint.

As a historiographical phenomenon, Soldier John fits into a pattern of folk saints from early 20th century Mexico, including similarly dubious characters like executed bandit Jesus Malverde, the unofficial patron saint of drug trafficking — as well as non-executees like Pedro Jamarillo and Nino Fidencio.

Part of this, surely — and Vanderwood developed the theme — is the story of the border, the story of Tijuana and Mexico in the 1930s. But part, too, is the story of Catholicism and of the contradictory, occasionally transformative, emotions excited by execution.

The potential of even an unambiguously guilty criminal to become in his passion a channel for worship goes all the way back to, well, the Passion itself, and the “good thief” on the cross with Christ. Twentieth century France has its own guillotined murderer who’s also a candidate for sainthood. And this is hardly the only occasion when folk veneration has produced an unofficial saint. Some of them even become official saints with the passage of time. But official or otherwise, once adopted into the practice of a living community of believers, they are animated by the life of that community and in return they succor the same.

“I pray to Juan Soldado even if the church does not approve,” one woman told Vanderwood. (Here quoting his “Juan Soldado: Field Notes and Reflections” in the Winter 2001 Journal of the Southwest). “I do not think that God minds.”

1929: Myles Fukunaga

This date in 1929 saw the hanging of a Shakespeare-quoting, suicidal kidnapper for “the most brutal murder in the history of Hawaii”. It was among the last civil executions in Hawaii.

As detailed in the 1991 essay “A Short History of Hawaiian Executions, 1826-1947” (pdf) by Joseph Theroux, a resource we’ve touched on before and which also includes a full list of 75 known legal executions in Hawaii during that period:*

[I]n the death of Gil Jamieson, who had been kidnapped by a mad youth who filled his ransom letters with quotations from the Shakespearen play [Macbeth]: “Life’s but a walking shadow, a poor player / that struts and frets his hour upon the stage / and then is heard no more …”

The victim had his skull chiseled in and was strangled and left near Seaside Avenue in Waikiki.

The murderer and author of the letters was captured some days later, tried, convicted, and sentenced to hang, all within three weeks. This feat was facilitated because his lawyers, Beebe and Huber, offered no defense and called no witnesses. The jury included members who were part of the search party and the victim’s bodyguard and gravedigger. A Navy psychiatrist offered to testify for the defense but was rebuffed. The medical examiner was also the prosecution psychiatrist, Doctor Robert Faus. He testified that past suicide attempts by Miles Fukunaga were “normal.” Despite protests and appeals, Fukunaga was hanged.

Ten years earlier, a well-known local haole athlete, David Buick, found himself down on his luck. He ordered a taxi driver, one Ito Suzuki, to drive out of Honolulu proper to a place called Red Hill. He ordered the man to stop the car and get out. He pointed a gun at the driver and robbed him of one dollar. When Suzuki turned to flee, Buick shot him in the back. Before he died, the taxi driver identified Buick a the gunman. The charge was eventually reduced to second degree murder, and Buick is said to have returned to the Mainland following his jail time.

In both cases, there was premeditation, kidnapping, murder, and flight. Fukunaga willingly confessed and indeed showed extreme remorse. Buick never confessed or showed the slightest regret over his actions. But Fukunaga had murdered a fine boy of a prominent haole family.** Buick had only murdered a middle-aged Japanese taxi driver.

This shocking crime — Fukunaga openly cited the notorious Leopold and Loeb murder and the more recent Hickman kidnapping as his models — ratcheted up ethnic tensions in Hawaii between whites, especially elite whites, and Japanese.

The Japanese community’s newspaper Hochi mounted a vigorous clemency campaign emphasizing sentencing differences like that vis-a-vis Buick. “If Myles Fukunaga is hanged it will not be because he killed a human being,” the paper editorialized. (pdf) “It will be because he killed the son of the vice-president of one of our big trust companies and because his victim was a white boy.”

* Ethnic data of those 75 executed: 24 Hawaiian; 24 Filipino; 9 Japanese; 6 Korean; 5 Chinese; 3 Puerto Rican; 3 unknown; 1 Caucasian.

** Gill Jamieson’s father, Frederick Jamieson, was a vice president of the Hawaiian Trust Company (since folded into the Bank of Hawaii). According to Kokugo Gakko in, the targeting of a bankster family by a frustrated working-class youth (Fukunaga was reportedly logging 80-hour weeks in menial jobs, having been forced to quit school in his teens to support his family) was no coincidence at all.

In terms of his motives he said that revenge had been foremost in his mind. In 1928 his parents had been unable to meet monthly rental payments. The Hawaiian Trust company served as the collecting agent for their landlord and had sent a rent collector to the Fukunaga family to demand full payment of back rent. Humiliated and ashamed, Fukunaga bitterly resented the bank’s action and, on learning that Vice President Frederick W. Jamieson had a son, he decided to seek revenge … by kidnapping and murdering the boy. Fukunaga also confessed to another motive. As the eldest son of seven children, Fukunaga stated that he had felt a filial obligation to help his poor parents … he had hoped to accomplish this filial act with the ransom money.

All this might tend to militate against the “insanity” defense, which Fukunaga himself energetically rejected.

1537: Janet Douglas, Lady Glamis

On this date in 1537, a Scottish noblewoman suffered the fate decreed for her treason — in the terse entry of the judicial record, combusta.

Knocking around Glamis Castle — where Shakespeare’s great villain Macbeth got his start, as Thane of Glamis* — Janet Douglas had the going enmity of Scottish king James V on the substantial grounds that Janet’s father had held the teen-king his virtual prisoner for a few years in the 1520s. Once James got free, he proscribed the lady’s brother, the Earl of Angus (whom Janet continued to shelter when occasioned), confiscated properties, forbade Douglases from approaching his person, and all that sort of thing.

Presumably according to this same anti-Douglas animus, an abortive attempt was made in 1531 to try our Lady Glamis for poisoning her late first husband, Lord Glamis. However, the charge foundered on the refusal of her peers to participate: “the lairds of Ardoch, Braco, Fingask, Abernethy, Piferran, Lawers, Carnock, Moncreiff, Anstruther, Lord Ruthven, Lord Oliphant, and many others, were fined for absenting themselves from the jury.”

Six years later she was more successfully returned to the dock, this time on a charge of plotting to poison the king himself. There seems to remain very little detail that would trace the precise unfolding of those years and offer later interlocutors a clear interpretation; while “innocent noble railroaded” is the most conventional read — Henry VIII’s agent reported that the conviction was secured “without any substanciall ground or proyf of mattir” — this book gives it a “maybe she did, maybe she didn’t” spin. That whole embittered proscription thing cuts both ways, as motives go.

At any rate, torture induced Janet Douglas’s own 16-year-old son John to testify that she had procured a potion intended to resolve that feud, and despite reported doubts and a spirited defense, the judges found her “committit art and part of the tressonabill Conspiratioune and ymaginatioune of the slauchter and destructioune of our soverane lordis” and therefore to “be had to Castell hill of Edinburghe, and thair brynt in ane fyre to the deid as ane Traytour.” (John was reprieved of this fate, but he still had to watch.)

King Jamie took over Glamis Castle and hung his spurs there until his own death in 1542 … whereupon his crown passed to Mary, Queen of Scots, and the castle reverted to that young John, the new Lord Glamis.

Glamis Castle still stands, picturesquely, and legend has it that the visitor there might encounter the burned woman’s ghost haunting the place as the Grey Lady.**

* Not actually true of the historical man Macbeth.

** Not to be confused with the New York Times. Actually, there are several ghosts who go by this colorless title.

1992: Johnny Frank Garrett, “kiss my ass because I’m innocent”

On this date in 1992, Johnny Frank Garrett was executed by lethal injection, with the tart last words,

“I’d like to thank my family for loving me and taking care of me. And the rest of the world can kiss my everloving ass, because I’m innocent.”

Although Garrett was only 17 at the time a nun from a neighboring Amarillo convent was raped and murdered, and he may have qualified as developmentally disabled to boot — both factors that today would exclude him from execution — that whole innocence story didn’t have much public traction.

“No, no, not at all,” New Mexico attorney Jesse Quackenbush told this site in an interview. “He was villainized from day one: he was a nun-murderer who needed to be executed. The only sympathy really came from the Pope.”

But two decades on, Garrett’s dying profession is one of the more troublesome skeletons in the Texas execution machine’s closet, thanks in no small part to Quackenbush himself.

Quackenbush directed the documentary The Last Word (viewable free on Netflix), a powerful brief not only for Garrett’s innocence* but against the comprehensive rot of the system that shunted hm off this mortal coil — from the front-line investigators all the way through the Lone Star State’s intentionally broken executive clemency farce.

“It was a system-wide failure that caused this kid to die. It wasn’t just the legal system,” Quackenbush said. “The media played a part. The governor was looking more to her own re-election hopes.* There was a dysfunctional family. The Supreme Court wasn’t morally deep enough to realize that executing 17-year-olds and ‘mentally retarded’ prisoners was wrong. There’s the system in Texas that allowed the prosecutors to hand-pick the pathologists to provide junk science.

“It’s a multifaceted failure, and no one facet is more to blame than the others.”

Garrett, a white teenager, disappeared into a Kafkaesque legal labyrinth, after the alleged supernatural vision of a local soothsayer acclaimed him the culprit in the murder of a nun named Tadea Benz. Corporeal indicia of guilt falls somewhere between circumstantial and laughable: fingerprints in a convent he had visited many times, the inevitable jailhouse snitch, and an unrecorded supposed “confession” that Garrett refused to sign.

As in a preponderance of death cases, especially in Texas (pdf), a meek and all-but-unfunded defense team offered scant resistance as prosecutors made the most of this eminently disputable evidence: once the one-sided trial was in the books and the crucial direct appeals likewise slipped past, the proceedings lay beyond the reach of judicial review.

This novel is inspired by the Garrett case.

For all that, there yet remains one un-litigated piece of evidence.

Around the time of Sister Benz’s death, there was another rape-murder of another elderly Amarillo woman, a crime that authorities publicly described as “too similar” to the Benz case not to be part of the same crime spree.

That case went unsolved … but years after Garrett’s execution, DNA databases matched an old semen sample from that second crime to a Cuban rapist (he was among the criminals and undesirables that Castro expelled to the U.S. during the Mariel boatlift) named Leoncio Perez Rueda.

Suggestive.

More dispositive evidence in the form of still-testable crime scene samples may yet reside in Amarillo’s evidence lockers — semen and blood samples that, in the era of DNA, Quackenbush thinks would exonerate Johnny Frank Garrett.

If testing this sort of thing sounds like a no-brainer, you don’t work for Amarillo.

“The [Garrett] family offered the city of Amarillo complete civic immunity and they still refused to run a DNA test, and threatened to countersue** if the family tried to pursue it,” Quackenbush says. “In the state of Texas there are still only laws protecting DNA access for living people: if you’re already executed, you have no rights.”

Which is a particular pity — since “the chances of executing innocent people are still really high.”

** In this, it’s not unlike the Ruben Cantu case, where post-execution evidence of innocence has also been met with legal threats by the state.

1860: John Guthrie, antislavery horse thief

On this date in 1860 in “Bleeding Kansas” — the frontier zone of dirty war by and against the Slave Power where John Brown got his start — a man named John Guthrie was hanged under scant-to-no color of law.

The site of this execution is still known as Guthrie’s Mountain or Mound … and it’s even alleged that the spot is still ill-omened by the event, and that the dying Guthrie “assailed his executioners for lynching an innocent man,” prophesying that “each of them would meet a horrible death” which curse the imminent U.S. Civil War carried into effect.

I know a story I think worth preserving of a Bourbon county execution without benefit of clergy, but it was not a lynching. I have had the story from a lot of people, including two eyewitnesses — not participants, of course. Away back in the later territorial days, when Bourbon county was in the ‘region beyant the law,’ a young man named Guthrie was caught up near Mapleton riding somebody else’s horse. Everybody knows that at that time in those parts, horse stealing and nigger chasing and homicide were offenses in a class by themselves. The hardheaded and hard-fisted farmers thereabouts gathered in a hurry. But there were no courts that they respected or had reason to respect. What to do?

Just across the river south of Mapleton in the Little Osage bottom is a little round hill about three hundred feet high shaped almost exactly like an overturned soup bowl. They adjourned to the top of that hill. There they elected a judge and a sheriff and a prosecuting attorney. They selected a jury and tried their man, who admitted his guilt. After the verdict and the proper sentence, the sheriff had no place to keep the man, so he executed the sentence at once by hanging him to the limb of a jack oak tree nearby. His body was buried where it was cut dawn. It is there yet.

From what I have been told I am quite satisfied that that trial was quite as regular and formal as many cases in the regular courts of that day, though not sanctioned by the law.

By the way, that hill is the same ‘pretty little hill’ where Lieut. Zebulon M. Pike ate the fried venison steak that September morning in 1806, as he notes in his journal. It is still called Guthrie mountain, and is one of the real beauty spots of old Bourbon.

The horse-thief story has different versions, in which Guthrie is either innocent of the charge or not. For what it may be worth, the 1860 New York Times also reported a “very imperfect” version of this take.


However, there’s at least one primary document suggesting that “thieving” may have been a pretext for killing the man over his anti-slavery stance.

Mapleton, K. T., Feb. 12, 1860. “MY DEAR PARENTS: … Last Sunday night about 1 o’clock a man named John R. Guthrie was hanged about a mile and a half from here on the top. of what is known as Tigret Mound. He was left suspended until Monday eve. His corpse was in plain sight from here as he hung. The proslavery’s hung him for an alleged crime of horse stealing. They arrested him without authority or shadow of law and never gave him even a mock trial, as has generally been the case. The country is again in commotion. I know not what will be the result, the probability is that unless Montgomery takes the field again it will soon blow over and give them a chance to hang the next ones that gets in their way.

1859: Danford Balch, inadvertent PDX benefactor

On this date in 1859, five to six hundred folks braved a dreary Portland morning to witness the first execution in the state of Oregon — Oregon having graduated into statehood just that very year, as it says on the flag.

Danford Balch, who would surely merit an entry in these pages for his name alone, had staked out a 345-acre land claim near the small settlement of Portland, but all that money couldn’t buy his daughter’s love.

Anna, the eldest of nine kids at a blossoming 15, was amenable to a suit by the farmhand, one Mortimer Stump — this is a Dickensian roster of characters — and in the face of Papa Balch’s opposition, eloped with him over the Columbia River to Vancouver, Wash.

So Danford Balch stewed, and drank, and was allegedly incited by his shrewish wife Mary Jane — this one has an ironically innocent moniker — until, encountering the Stumps in town for supplies one day, Danford Balch tried to retrieve his daughter and ended up shotgunning his unwanted son-in-law, right in the face.

Ka-blamo.

Bystanders tackled Balch immediately, though it took nine more months to bring the killer to trial: in these sparsely-populated frontier precincts justice was being administered on the old “assize” model of wandering judges who dropped in for a spell to try everything at one go. It was enough time for Balch to bust out of a rain-rotted jail cell once and get recaptured (once on the lam, he returned to his own home).

When court was finally in session, conviction was a mere formality. He’d done the deed in public, after all. But the offended father seemed genuinely bewildered by the outcome: apart from the shooting being accidental (so he said), he clearly expected that a court would uphold the dominion of the family patriarch over his wayward progeny.

Heaven knows what fumes he was fuming by the time he climbed the scaffold and beheld that naughty daughter Anna turned up to witness his hanging — sitting in the front row with the [rest of the] Stump family in what you have to think was a somewhat uncomfortable party for all concerned.

Little more affectionate was the post-mortem behavior of the allegedly un-alienated part of the Balch clan.

That widow Mary Jane, whom Danford hinted gave him quite a goading over their wanton daughter, shafted the remaining rugrats out of inheriting their chunks of the family land and instead routed most of it to her next husand.

Though pretty difficult to admire by the yardstick of human decency, that behavior turned out to be Danford Balch’s redeeming legacy.

Having passed through several hands, the lion’s share of his former land was in 1897 donated to the city by its then-owner Donald Macleay, who was sick of paying taxes on the unprofitable parcel. That was the time the famously green PDX received its first land gift designated by the donor for parkland: Macleay Park. (Including a Balch Creek.)

Today, it’s all part of the larger Forest Park, and it’s a lovely hiking space for a city that grooves on its outdoor rec … complete with a gorgeously ruined Depression-era stone ranger station that’s popularly believed to be haunted, maybe by the spirit of poor old Danford Balch himself.

1902: Fred Hardy, the first hanged in Alaska

On this date in 1902, a hanging in Alaska capped a gold rush story fit for Jack London.

Actually, this tale is set not in London’s characteristic Klondike gold rush, but a subsequent one centered on remote Nome. There, in the words of the Rex Beach novel The Spoilers, “a frenzied horde of gold-seekers paused in their rush to the new El Dorado. They had come like a locust cloud, thousands strong, settling on the edge of the Smoky Sea, waiting the going of the ice that barred them from their Golden Fleece — from Nome the new, where men found fortune in a night.”

The victims in this case of mercenary arctic brutality were a party of four who set up prospecting camp on Unimak Island, in the Aleutians. Their impression that they were safely alone on this large territory was refuted with the inexorable cruelty of a slasher flick.

After being caught out by the elements in a secondary camp, the party returned to its unsecured main base to discover “that their tent had been torn down in their absence and their stores taken away.”

Here the ominous overture fades in, and by the time it hits crescendo the mysterious robbers will have visited a cold-blooded massacre on our quartet of prospectors.

“Suddenly a man, who had been hid by the tall coarse grass, jumped up several hundred yards away, and took aim with a rifle at Florence. He fired and Florence fell with a scream. ‘Con’ and I ran for the boat, jumped in, and Rooney started to shove her off. The next moment a shot came from somewhere in the cliff above our heads.

“Rooney grabbed hold of his right knee, cried ‘They’ve got me too,’ and sank into the surf. Con and I saw that there was no use trying to get away in the boat, and so took it on the run for the shelter of the cliffs. We hadn’t gone twenty steps when another shot rang out; Con threw up his hands and fell headlong upon the beach, stone dead, with a shot between the shoulders. I kept on running, hearing shot after shot fired at me and striking about me with dull thumps like pieces of heavy hail.”

That’s from the riveting account of the lone survivor, one Jackson, who managed to escape into the island’s interior and after tramping about for two weeks, near to starvation and in continual terror of his stalkers, was finally found at death’s door by a friendly hunter.

Jackson’s information was able to tip off an investigation that led to the capture of two suspects. By the time Fred Hardy and George Aston were nabbed, they had “taken possession of” a fishing village and “kept [the fishers] in a terrified state.” They also happened to have the late prospectors’ booty, including personal items like an inscribed watch.

Aston wisely turned on his confederate, saving his own neck at the cost of stretching Hardy’s.

Hardy, a veteran of America’s colonial adventure in the Philippines and a nephew (so he said) of department store magnate John Wanamaker, denied guilt all the way to the scaffold but got no help from appellate courts or from President Teddy Roosevelt. (Since Alaska was still a territory, executive clemency was up to the White House.) He was put to death “in an addition built to the ice-house on the lot opposite the jail” (according to Washington state’s Morning Olympian, Oct. 3, 1902) at Nome City itself.

It wasn’t actually the first execution in Alaska, or even American-run Alaska, but Hardy’s hanging was a significant milestone. Prior to 1900, the vast territory was next door to lawless, order enforced in the interior by miner’s meetings or not at all, while a smattering of coastal military and customs outposts projected vague federal authority. Data on executions from this period is sketchy and incomplete.

In 1900, with the Alaskan population booming from that locust cloud of gold-hunters, promulgation of a civil code set Alaska on the way to something resembling normal government. Hardy’s execution was the first under legal judicial authority — the first of eight in the first half of the 20th century. Alaska abolished capital punishment shortly before attaining statehood in 1959.

1911: Sitarane and Fontaine, Reunion Island occultists

This date marks the centennial of perhaps the most famous execution in the history of Reunion Island: the June 20, 1911 guillotining of Sitarane and Fontaine.

Sitarane (French link) — his actual name was Simicoudza Simicourba — hailed from Portuguese Mozambique, supposedly from a long line of sorcerors.

A contract job brought him to Reunion, but he soon abandoned it for the black [magic] economy. A fellow purported necromancer named Pierre-Elie Calendrin pulled Sitarane and run-of-the-mill hoodlum Emmanuel Fontaine into a prolific little crime ring that terrorized Reunion around 1907 to 1909, amassing about a dozen murders.

And what murders!

Most of the sources on this circle are French, and they narrate weird occult criminality: reading tarot and sacrificing a black cock before a proposed adventure, drinking the blood of their victims to gain their strength.

Still, this was practical magic: Calendrin, Sitarane and Fontaine killed people so that they could rob them.

So it was with their dark arts, too: the sacrificed chickens were drugged and tossed to watchdogs; a mysterious powder blown through keyholes narcotized targets before the gang burst in to do its dirty work. It’s Sherlock Holmes in the Indian Ocean.

The three were finally surprised in the midst of one of their mercantile and monstrous sorties, and tried in 1910.

Although all three received death sentences, Calendrin — who as the trio’s leader would figure to have been the most culpable among them — had his execution mysteriously commuted to penal transportation to Guyana instead. Maybe he foretold the lottery numbers for a judge, or just cooked him a mean chicken dinner.

Sitarane died wailing a Comorian death-chant. Fontaine, more panicky, resisted the executioners and got his neck in a twist, resulting in a bad strike from the blade that lodged in his jaw.

But bad luck on the appellate circuit would mean a bit of immortality that the spared Calendrin could never obtain: today’s doomed — most particularly Sitarane — live on yet as popular saints with a special appeal to the underworld.


Sitarane’s jaunty red grave in Saint-Pierre attracts a lively flow of cult offerings from supplicants hoping to avail the powers of its resident thaumaturge … and of gawkers who do not fear to tempt the evil eye by photographing same. Allegedly, it’s the place to pray for fortune in the sort of nefarious scheme Sitarane used to get up to: folk contemplating a robbery or homicide are among those particularly likely to invoke their criminal forebear, as are those who fear such plots against them.
