1721: Joseph Hanno, “miserable African”

On this date in 1721, Joseph Hanno was hanged in Boston, Massachusetts for the murder of his wife, Nanny.

He’d killed her “in a very barbarous manner” on November 10 the previous year: while she was getting ready for bed, he struck her twice in the head with the blunt end of an ax and then slit her throat. He made a feeble attempt to pass the murder off as a suicide, but the coroner’s jury was not fooled.

“Could Hanno expect a fair trial in a Massachusetts court?” asks Mark S. Weiner in his book Black Trials: Citizenship from the Beginnings of Slavery to the End of Caste.

Perhaps surprisingly, Weiner believes the answer is yes:

In general, free black men received rather even treatment in the New England judicial system, at least at this period … They were entitled to the full range of legal rights, with the important exception of the ability to serve on juries. There also was no marked inequality between the punishments they received and those of white convicts. And though Hanno, in particular, certainly faced hostility and anger in the courtroom, in [Judge Samuel] Sewall, he was facing no irredeemably biased magistrate; in fact, years earlier, Sewall had written the first antislavery pamphlet published in the American Northeast.

Weiner notes that Hanno “had no defense counsel, for at the time the institution was almost unknown.” He may have hoped to beat the rap because there were no witnesses to the murder. But the jury convicted him and the judge pronounced the sentence of death.

Ultimately, Hanno himself admitted his guilt.

Other than her name, nothing is known about the victim in this case. But we know something about the perpetrator because of a sermon preached at the time of his execution and distributed in pamphlet form under the bombastic title of “TREMENDA: The DREADFUL SOUND with which the WICKED are to be THUNDERSTRUCK, Delivered upon the Execution of a MISERABLE AFRICAN for a most inhumane and uncommon MURDER.”

The sermon was promulgated by none other than Cotton Mather, the Puritan minister noted for his role in the Salem witchcraft trials. (Old Cotton really got around the gallows back in his day.)

Hanno had been brought over from Africa on a slave ship as a child and grew up in slavery. He was freed in 1707, when he was about forty years old, and then settled down in Boston with his wife.

He was literate and his masters brought him up as a Christian, and he enjoyed “vain gloriously Quoting of Sentences” from the Bible. Indeed, when Cotton Mather offered spiritual counsel to the condemned, Hanno boasted, “I have a great deal of knowledge. Nobody of my color, in old England or new, has so much.”

Replied the minister (without apparent irony), “I wish you were less puffed up with it.”

Hanno himself seems to have subscribed to the “slippery slope” theory of criminality. A newspaper account of his execution says he

hoped that all Mankind would take warning by him to keep themselves from committing such Sin & Wickedness as he was guilty of, particularly, Sabbath-breaking and willful Murder, the one being the Ringleader to the other, for which last he was justly Condemned, which had he not been guilty of the first he might probably have never committed the second.

An aside: although he may have been the only person executed that day, Joseph Hanno didn’t stand alone on the gallows.

At the same time a white woman did public penance on the same gallows. Her crime: giving birth to a child of mixed race. This being considered the lowest depth of self-degradation (especially if the father was a Negro), the woman was made to sit on the gallows with a noose around her neck — a sign of extreme disgrace. Then she was whipped through the streets until her back was raw. (Source)

1726: William “Vulcan” Gates, Black Act casualty

March 14, 1726, was the hanging date of five men* at the gallows of Tyburn.

We’ll come to the other four of them presently, but our featured case among the group is one Bill Gates — not the Microsoft billionaire, obviously; this fellow was, rather, a victim of the plutocracy.

William Gates was a blacksmith by trade, presumably the source of his outstanding nickname or alias “Vulcan”.

But he also liked to hunt, and that’s how he ended up having his neck pinched.

It was only logical in the early 18th century for hunters like Vulcan to take quarry from the common lands. But these longtime traditional rights were under long-term attack; just a few years before, the “Black Act” dramatically escalated penalties and enforcement mechanisms for “poaching”.

Among other things, the Black Act permitted a suspect to be accused by reading out charges “on two Market Days, and in two Market Towns in the County, where the Offence is committed.” If the named party failed to turn himself in within 40 days, he stood convicted — no trial necessary.

This was Vulcan’s situation exactly. He’d been accused of “being one of the Men that entered Enfield Chace, killed two Deer,” and took some potshots at the gamekeepers. Having not given himself up, the entirety of the short proceeding once Gates was taken was to establish his identity. (A potentially tricky affair in those days, but not in this instance.)

Frequent death-blog litterateur Charles Dickens glossed this story for the literary magazine he founded, All the Year Round, quoting in Vol. 18 the account of the Ordinary of Newgate when Gates and the four who were doomed to die with him “took it into their foolish heads that they would not be hanged.” (I’ve added line breaks to the Dickensian version, for readability.)

The day on which they were executed, when I [the Ordinary] came to Newgate to give them their last exhortations and prayers, they would not allow any person to come near them, having got an iron crow into the prison, with which they had forced out stones of a prodigious bigness, and had made the breach two feet deep in the wall.

They had built up the stones at the back of the door of the condemned hold, so that nobody could get at them. The keepers spoke to them through the door, but they were inflexible, and would by no entreaties yield. I spoke to them also, representing to them how that such foolish and impracticable projects interrupted their repentance, and the special care they should have taken in improving those few moments to the best advantage; but they seemed inexorable.

I said that I hoped they had no quarrel with me. They answered, ‘No, sir, God bless you; for you have been very careful of us.’ Bailey said, that they would not surrender till they either killed or were killed.

It was twelve at night before they began this enterprise; and, to conceal their purpose from the keepers, while part of them were working, the rest sung psalms, that the noise might not be heard.

Sir Jeremiah Morden, one of the present sheriffs of London and Middlesex, came with proper attendance, and, desiring them to open the door, they refused it; upon which they [not the prisoners, but the sheriff and his men] were obliged to go up to the room over the hold, where there is a little place that opens, which is made in case of such disturbances.

This shutter they opened, but the prisoners continuing obstinate, they [the sheriff’s assistants] fired fifteen pistols with small shot among them, not to kill, but to wound and disable them. They retired to the remotest part of the room where the shot could not reach them, yet Barton and Gates, the deer-stealer, were slightly wounded in the arm.

At last Sir Jeremiah Morden spoke seriously to them through the little hole above, desiring them to surrender. Barton asked, ‘Who are you?’ Sir Jeremiah answered, ‘I am one of the principal sheriffs.’

‘Show me your chain,’ says Barton. Sir Jeremiah was so good as to show him his gold chain through the little hole, upon which they consulted, and agreed to surrender.

After this they removed the stones for the back [of the] door, and, the keepers entering, Barton snapped a steel tobacco–box in the face of one of them, which made a little noise like the snapping of a pocket-pistol, and then gave him the box” [saying ‘D-me, you was afraid.’ -Dickens omits this taunting clincher (ed.)]

After this the unctuous Ordinary tried to dog the intended escapees out of any parting sacrament on the grounds that their souls were not adequately prepared, to which the mutineers justly replied that they “been busied otherwise; they said it was only out of a desire of self Preservation … upon which account they desired to be excused.”

The Ordinary is vague on whether he excused them so far as to grant a last absolution. They were never to be excused from the rope.

While we’ve mentioned the singular case of Vulcan Gates, the other four were a more prosaic bunch of convicted burglars. Three of the four denied their guilt to the last. And while it’s nigh-impossible to judge credibility from the few second-hand words of an interlocutor religiously convinced of their culpability, it’s quite an affecting testimony to the scant circumstances needed to doom a fellow under the Bloody Code.

More than likely we’re a little skeptical of Benjamin Jones, who said that he chanced to stumble upon some silver plate in the darkness when stumbling out drunk from his tavern to pick up a whore. Was it just a bit of mutual aid among thieves that Jones accused a different prisoner, one Frazier, who was sick on his deathbed? The Ordinary said that he “ask’d Frazier, if this account was true? who said that it was, and that he had written the full Narrative thereof to Persons of the highest Quality.”

Hmm.

Francis Baily was doomed by the detailed testimony of a fellow-inmate in his same boarding house. He did admit to being a professional robber whose real crimes were quite enough to stretch his neck, but that his particular condemnation was thanks to the perjury of “one of the most infamous, wicked Women in the World who had sworn away his life, as she had the Life of some others, besides several there whom she had got transported and whipp’d &c. Baily pointed the finger at the absconded landlord of the house, the aptly named Matthew Wildman, who was his frequent burglarious partner.

Maybe.

The saddest of the self-proclaimed innocents was William Swift. He was accused along with another man, Lawrence Simpson, of having been part of a gang of highway robbers who committed a couple of muggings one evening. Although it was dark, one woman claimed to have been able to recognize Swift’s face by the light of “a Lamp about 6 Yards off,” and this was enough to seal his fate. Simpson hadn’t been glimpsed so clearly, so he was acquitted.

As for the last fellow at Tyburn that March 14, John Barton didn’t claim any species of innocence at all. Instead, he announced at the scaffold, “I am the Man, who in Company with two or three others, whom he named, particularly one Capel [Bob Cable], who committed the Robbery for which Swift dies.” (Barton had been set to testify at the Swift-Simpson trial, but was disallowed on account of his own pending burglary charges.)

* Seven were originally condemned to die this date; two petty thieves received the crown’s mercy.

1727: An Irish deserter at Gibraltar

This account of an incident during the 1727 Spanish siege of Gibraltar, where the British army garrisoned, comes from an unknown soldier who signed himself only

December 9th. Last night a deserter clambered up within a little of Willis’s battery and was assisted by a ladder of ropes by our men. When the officers came to examine his face, they found him to have deserted out of the Royal Irish two months ago. Asking the reason of his return, he said he chose rather to be hanged than continue in the Spanish service, so is to have his choice.

It is not positively stated that the hanging itself did take place on this date. Since we concern ourselves in these doleful pages with the circumstances under which life becomes dispensable, an assortment of other anecdotes from this same soldier’s journal helpfully illustrate the life of British soldiery at the Pillars of Hercules.

March 9th. Came a deserter who reports that while our guns were firing at them an officer pulled off his hat, huzzaed and called God to damn us all, when one of our balls with unerring justice took off the miserable man’s head and left him a wretched example of the Divine justice.

April 12th. A recruit refused to work, carry arms, eat or drink was whipped for the fifth time, after which being asked by the officer he said he was now ready to do his duty.May 7th. This morning Ensign Stubbs of Colonel Egerton’s regiment retired a little out of camp and shot himself.

June 17th. Today two corporals of the Guards boxed over a rail until both expired, nobody can tell for what reason.

October 11th. One of Pearce’s regiment went into the belfry of a very high steeple, threw himself into the street, and broke his skull to pieces.

October 16th. Will Garen, who broke his back, was hanged.

January 2 1728. Here is nothing to do nor any news, all things being dormant and in suspense, with the harmless diversions of drinking, dancing, revelling, whoring, gaming and other innocent debaucheries to pass the time — and really, to speak my own opinion I think and believe that Sodom and Gomorrah were not half so wicked and profane as this worthy city and garrison of Gibraltar.

1723: The first London executions under the Waltham Black Act

“The law of England has displayed no unnecessary nicety, in apportioning the punishments of death …. Kill your father, or catch a rabbit in a warren — the penalty is the same! Destroy three kingdoms, or destroy a hop-bine — the penalty is the same!”

E.P. Thompson’s classic Whigs and Hunters: The Origins of the Black Act, has its titular legislation as “an expression of the ascendancy of a Whig oligarchy, which created new laws and bent old legal forms in order to legitimize its own property and status”

On this date in 1723, seven Waltham Blacks were hanged at Tyburn.

These poachers were the impressive first salvo of the Black Act, a new-minted statute early in the landmark government of Robert Walpole.

This law had been enacted to combat the rise of game poaching. As we’ve noted before, poaching was a longtime conflict zone in a Great Britain emerging as distinctly capitalist.

The Black Act would not merely sharpen those conflicts — it would intentionally define them, helping to enclose a labor marketplace enforced with hemp.* The Black Act added nearly 50 capital offenses to the rolls; it was a seminal statute for the 18th century’s notorious “Bloody Code”.

“The Black Act had a much wider sweep than a statute intended merely to protect the royal forests,” Frank McLynn notes. Poaching gangs “provided the occasion for draconian legislation; they were not its cause.”

These huntsmen were, early in the 18th century, increasingly bold taking game on forest preserves in defiance of hunting restrictions that made an absurd mishmash of feudal anachronisms and latter-day statues all of which contrived to limit the hunt only to a handful of wealthy landed aristocrats. It was, per Blackstone, “a bastard slip, known by the name of the game laws … wantoning in the highest vigour.”

This vigourous wantoning actually made for a multilateral class conflict. The rural poor, being displaced by enclosures, were barred from opting out of proletarianization for a life on the forage. (Nobody was allowed to sell game meat.) Sportsmen had the run of the land, but only the very richly landed could be “sportsmen”: small farmers were forbidden to take game even on their own property, whereas those whose huge estates licensed them to hunt were entitled to tramp through neighboring crops in pursuit of their quarry.

Poaching followed these un-neighborly injuries to traditional commons rights as vigorously as hounds follow hares. The state answered with the Black Act, and did not scruple to accuse known companies of “Blacks” of being Jacobite catspaws.

So named because it targeted poachers’ practice of “blackening” their faces, the 1722 law made it a hanging crime to go on the hunt in disguise, as well as a hanging crime to poach deer, rabbits, conies, or fish. Formerly, “deer-stealing” and the like had been mere misdemeanors.

The act also mandated death for a broad range of other rustic crimes such as damaging orchards, gardens, or cattle, with like penalties attached to conspiring to commit any of these crimes or rescuing anyone imprisoned for these crimes.**

The seven hanged this date were “Blacks” who happened to be captured shortly after the Black Act took effect in mid-1723 — from Windsor forest, and elsewhere. As a show of resolve in enforcing its grim new decrees, the crown had all these men shipped to London, far from their own communities where jurymen themselves aggrieved by game laws were known to acquit.

* Lest one doubt this red-tinged historiography of the Act, its apologists were no less clear on its objectives.

“No man, however successful in the profession, can expect to get as much profit by deer-stealing, as by following his lawful business,” intoned the Newgate Calendar about today’s hangings. “[Y]oung persons cannot learn a more important maxim than that in the scripture; ‘the hand of the diligent maketh rich.’

“In this place it may not be improper to make a single remark on the game laws. These are supposed to be, possibly not without reason, severe: it is contended that those animals which are wild by nature are equally the property of every man. Perhaps this is the truth: but persons in the lower ranks of life should remember, that when laws are once enacted, THEY MUST BE OBEYED. Safety lies in acquiescence with, not in opposition to, legal institutions.” (emphasis added)

** Just for good measure, it also prescribed the noose for just about every form of arson, and for anyone who “shall wilfully and maliciously shoot at any person in any dwelling-house, or other place” regardless of injury.

1721: Jean-Pierre Balagny, Cartouche lieutenant

On this day in 1721, Jean-Pierre Balagny, alias Capuchin, was broken on the wheel in Paris. He was one of the lieutenants and boon companions of legendary French outlaws Cartouche.

We have noted that that renowned bandit crowned his fame at the last by enduring all tortures, only to voluntarily give up the names of his companions as he approached the scaffold and perceived that they had failed to arrange a rescue.

“Capuchin”, who was with Cartouche when he was captured and subject to much the same interrogation, proved as good as his captain. He, too, endured the boot without breaking. And he, with two companions, likewise reached the scaffold and only there coughed it up.

They gave information as to their accomplices, and made, at the foot of the scaffold, confessions which torture had failed to elicit from them.

They implicated so many persons, that another series of trials began, which lasted as long as the declarations of convicted prisoners compromised other persons, and threw new light on the immense ramifications of an association of miscreants which had for many years defied the police. More than sixty persons were under lock and key at the time of the execution of Cartouche and Balagny. This number increased every day in consequence of the confession of those who hoped to save their lives by denouncing their accomplices, and in June of the following year it rose to one hundred and fifty … all this blood, instead of washing the affair away, seemed rather to make it more serious. Every day brought to light some new discovery; and this shows how profoundly mistaken were those who denied that Cartouche, the centre and wire-puller of this horrible association, possessed the organising spirit without which he could not have extended this immense net over the Parisian society.

One is left to infer from this entry in the memoirs of the Parisian hereditary executioner-family Sanson that Balagny likewise did in his friends over some ornate notion of honor … although if the anecdote is true, one could as easily suppose any number of less “creditable” reasons.

At any rate, Balagny’s evidence added to that of Cartouche’s snowballed into a bloody cycle of tortures and executions and fresh denunciations over the year to come.

Of course, getting rid of all the criminals did not get rid of crime.

“In spite of the executions at La Greve, there are more thieves than ever in Paris,” lamented one observer (quoted here). “Cartouche has died on the wheel; but his name and memory engender robbers.”

1724: Willem Mons, head grafter

On this date in 1724, Willem Mons was beheaded in St. Petersburg for peculation.

Mons was the brother of the German commoner Anna Mons, a beautiful young woman who segued from being the May-December lover of Peter the Great‘s trusted admiral Franz Lefort to the mistress of the teenage emperor himself. Peter and Anna had a famous (famously scandalous) romance through her twenties, but as she entered her thirties and heard the clock ticking, her bid to make Peter put a ring on it by flirting with a Prussian diplomat came to grief and got her briefly tossed in prison.

Willem Mons was still a minor when his big sister fell from Peter’s graces. He would prove to have an equally adroit instinct for imperial bedchamber politics.

“One of the best-made and most handsome men that I have ever seen,” in the French ambassador’s estimation, Mons hustled his way into the train of the woman Peter had married instead of Anna — Catherine.

There Willem Mons and his other sister Matryona Balk monopolized the access routes to the empress and lucratively tolled all petitioners who traveled them. Wealth and status accumulated; the immigrant bourgeois’s son even stopped going by William in favor of the more impressive “Moens de la Croix”.

Not surprisingly, the emperor himself was the last to discover the open secret of his wife’s household’s river of graft.* Peter, who could be quite the moralist, was incensed; he interrogated the chamberlain so terribly that the young man fainted dead away.

“Moens de la Croix” was no longer. In both senses.

Having issued the confessions to condemn himself under the very credible threat of torture, Mons was socked away in Peter and Paul Fortress. Catherine made bold to defy Peter’s edict that nobody petition him for Mons’s life; in response, the enraged tsar smashed a Venetian mirror with his bare hand and roared, “thus I can annihilate the most beautiful adornment of my palace!” Court observers reported that marital relations between the two were visibly strained well after the scandal.

These weren’t happy days for the oft-sickly Peter; indeed, they were the last months of his life. Early the next year, he would succumb to a gangrenous bladder and leave the throne to this very Catherine. Perhaps his decrepit state accounts for the likely scurrilous rumor that the handsome chamberlain’s real offense wasn’t so much corruption as cuckoldry. It’s fair to say that such an affair would have been an extraordinarily reckless thing for Catherine.

On November 16, 1724, William Mons and Matrena Balk were taken in sledges to the execution site. Mons behaved courageously, nodding and bowing to friends he saw in the crowd. Mounting the scaffold, he calmly took off his heavy fur coat, listened to the reading of the sentence of death and laid his head on the block. After his death, his sister received eleven blows of the knout, very lightly administered so that not much harm was done, and was exiled for life to Tobolsk in Siberia. Her husband, General Balk, was given permission to marry again if he wished. (Source)

The late courtier’s severed head was preserved in alcohol (legend says that the fuming Peter made Catherine contemplate it). It was eventually deposited in the Kunstkamera museum, famous for housing Peter’s gross horde of collected pickled fetuses, dwarves, and other medical curios. Mons’s head still resides there today.

1722: Cartouche’s brother, hanged by the armpits

On this date in 1722, the younger brother of the great French outlaw Cartouche was punished with a bizarre non-fatal hanging in Paris’s Place de Greve.

At least, it was supposed to be non-fatal.

Little Louison was a whelp of 15 years and already condemned to hard labor in the months-long smashing-up of the gang that followed the ringleader’s 1721 execution. “Nothing but hangings and breakings on the wheel!” one diarist scribbled in July 1722. “Every day some Cartouchian executed.”

As a sort of piece de resistance for the month, a judge named Arnould de Boueix, sore about the murder of a gendarme in his family, ordered the young Louison “hanged” under the armpits (the rope about his chest) for two hours as an additional punishment/humiliation. Judge de Boueix apparently devised this thing without any sort of precedent or anatomical expertise that would actually confirm the safety of the procedure.

[Louison] cried out very loudly at first, and begged that he might be put out of pain at once, as the weight of his body seemed to force every drop of blood down to his feet. “Ce-qui” (adds Barbier) “est la souffrance des pendus.” [“Such is the suffering of the hanged” -ed.]

Later, his tongue protruded, and he spoke no more. Without waiting for the ordained two hours to expire, the lad was taken down and placed in medical care; but it was too late. He was already dead. “He was very wicked for his years,” says Barbier, “and had been an accomplice of his brother from a very early age.”

1721: Cartouche, French bandit

On this date in 1721, the French outlaw Cartouche was broken on the wheel in Paris.

Your basic superstar robber during that archetype’s golden age, Louis Dominique Garthausen, aka Bourguignon, aka Cartouche was the son of a German mercenary-turned-French wineseller.

Little Cartouche — his nickname came from a Francophone corruption of his German surname — distinguished himself from childhood as the most charismatically intrepid of the local hooligans, and by adolescence was already the leader of a troupe of rascally thieves.

By his twenties, after a detour through the army, Cartouche and his merry men (the Cours des Miracles gang, after the slum they operated out of) were raiding the lucrative Versailles-Paris route, plundering the virtue of marchionesses, distributing stolen booty the poor, maintaining perfect courtesy in the society of gentlemen, and generally becoming the heroes of that species of literature that revels in bodice-busting sybaritic rakes who play by their own rules but have a heart of gold. (Sample escapade: walking a carnival parade with a cart full of police effigies — whipping them all the way, to the glee of the crowd. Thackeray celebrates more Cartouche folklore here, like the time he robbed as part of a threesome, talked one accomplice into murdering the other in order that the two survivors should have greater shares of the spoils to divide — only to round self-righteously on the killer once his pistols were safely discharged and gun him down in turn with the words “Learn, monster, not to be so greedy of gold, and perish, the victim of thy disloyalty and avarice!” That’s a pretty good one, whether it really happened or not.)

The flesh-and-blood police started to roll up this group around 1719, turning arrestees into informants and hunting ringleaders to ground. True to character, Cartouche defied with his liberty the growing price on his head, deftly giving gendarmes the slip until a confederate betrayed him into his enemies’ hands literally while his pants were down.

The guy very nearly broke out of prison — tunneling out of a dungeon of the Chatelet into a neighboring basement, only to have the clank of his chains rouse the family dog into a woofing frenzy that betrayed him before he could vanish out the front door. But even back in the clink,

came a period of splendid notoriety: he held his court, he gave an easy rein to his wit, he received duchesses and princes with an air of amiable patronage … His portrait hung in every house, and his thin, hard face, his dry, small features were at last familiar to the whole of France. M. Grandval made him the hero of an Epic — “le Vice Puni.”

Cartouche was doomed to breaking on the wheel after a morning suffering the tortures of the boot in an unavailing effort to extract further incriminations from the rogue.*

Cartouche seems to have fully expected his troupe to reciprocate this heroism by rising to the dramatic occasion of a rescue from the very scaffold. But as the prisoner arrived at the Place de Greve, he perceived at last that like Christ he had been abandoned at the critical hour by the men who had sworn oaths with him. The great desperado’s final act was to retaliate upon these faithless friends (and family!) by taking aside his prosecutors and detailing his every accessory in crime, even his lovers. What the worst extremities of medieval torture could not procure from him, the compelling incentive of revenge instantly conjured.

Our hero went to his death this day but his revenant spirit stalked France for many months thereafter as dozens succumbed (pdf) to Cartouche’s scaffold indictment. One diarist recorded the following July,

Nothing but hangings and breakings on the wheel! Every day some Cartouchian executed.

1724: Jack Sheppard, celebrity escape artist

“Yes sir, I am The Sheppard, and all the gaolers in the town are my flocks, and I cannot stir into the country but they are at my heels baaing after me.”

On this date in 1724, the hangman finally got Jack Sheppard.

Sheppard was a thief, a romantic hero, a highwayman of the urban proletariat, a Houdini whom no prison could hold.

It had become possible in his time to ride criminal notoriety into celebrity: Jack Sheppard, a mere 22 at his death, proved as adept with that quicksilver element during his personal annus mirabilis of 1724 as he was with a lockpick.

Sheppard’s world had him fitted to wield a hammer better than thieves’ tools — but at about age 20, a young man awash in the illicit liberty of London’s underbelly, he ditched the square carpenter to whom he was apprenticed to live free by his wits.

Peter Linebaug’s The London Hanged finds in Jack Sheppard’s career and his runaway popularity an important marker of the capital city’s “refusal of subordination: — contra Foucaultian discipline, which “makes the rulers of government and society seem all-powerful.”

An important meaning of liberation … [consisted of] the growing propensity, skill and success of London working people in escaping from the newly created institutions that were designed to discipline people by closing them in. This tendency I have dubbed ‘excarceration’ because I wish to draw attention to the activity of freedom in contrast to its ideological or theoretical expressions…

This lithe youth is most famous for his literal talent for freedom: four times in 1724 he escaped from custody in ever more dramatic fashion.

He busted out through the ceiling of St. Giles Roundhouse. He rappelled with a bedsheet rope down the 20-foot wall of Clerkenwell Prison with his lover.

This sort of thing won the enterprising rogue growing folk hero status. The vaunted Sheppard “made such a noise in the town, that it was thought the common people would have gone mad about him, there being not a porter to be had for love nor money, nor getting into an ale-house, for butchers, shoemakers and barbers, all engaged in controversies and wagers about Sheppard.”*

It also drew the unwanted attention of 1720s London’s Jabba the Hutt: “thief-taker” Jonathan Wild, who managed a vast thieving cartel enforced by Wild’s willingness to turn in non-participants in his ingenious cover role as the city’ preeminent lawman. That’s some protection racket.

Sheppard, to the fame of his memory, scorned obeisance to the crime lord as much as to any guild carpenter and worked for no man but himself. A vengeful Wild shopped him to the authorities.

This time, Sheppard was actually condemned to death for burglary but broke prison again, using yet another classic ruse: the “disguised in smuggled women’s clothes.”

Back on the lam, he posted a cocky letter to his executioner “Jack Ketch” giving his regrets at not having joined two fellow-sufferers on the scheduled hanging date. (September 4.)

I thank you for the favour you intended me this day: I am a Gentleman, and allow you to be the same, and I hope can forgive injuries; fond Nature pointed, I follow’d, Oh, propitious minute! and to show that I am in charity, I am now drinking your health, and a Bon Repo to poor Joseph and Anthony. I am gone a few days for the air, but design speedily to embark, and this night I am going upon a mansion for a supply; its a stout fortification, but what difficulties can’t I encounter, when, dear Jack, you find that bars and chains are but trifling obstacles in the way of your Friend and Servant

London’s finest were determined to put an end to this character’s preposterous run of prison breaks, so when they caught him the fourth time Sheppard found himself loaded with manacles and chained to the floor of a special strongroom in Newgate Prison. Get out of that, Jack.

Somehow, Jack got out of it.

On the night of Oct. 14, Sheppard authored the sublimest breakout in Newgate’s voluminous annals. Picking the locks of his fetters with a small nail, our acrobat scurried up a chimney, picked, prised, or otherwise passed a succession of locked doors in the dead of night, paused to rest on the condemned pew of the gaol chapel, forced a grille, reached the roof, and threw another homemade rope over the wall to scamper down to safety.

And then “he promptly went forth and robbed a pawnbroker’s shop in Drury Lane of a sword, a suit of apparel, snuff boxes, rings, &c., and suddenly made a startling appearance among his friends, rigged out as a gentleman from top to toe.”

There’s no doubt but that Jack had showmanship, but at a certain point he could have done with just the tiniest measure of discretion. But then, this was a man writing his own legend. Sure, he could have put his head down and tried to disappear into some nameless Puritan settlement in the New World. (His distraught mother kept telling him to get out of the country.) He traded those dull and toilsome years for the fame of generations: his candle burned at both ends.

When next Sheppard was detained, it was towards his apotheosis. It was the only time he would be arrested and fail to escape.

A throng of thousands mobbed London’s route to execution this date, almost universally supporting the ace escapologist. And Sheppard very nearly had for them the piece de resistance in his career of magical disappearances: it was only at the last moment before boarding the fatal tumbril that Sheppard’s executioners found the penknife their prey had secreted on his person, evidently intending to cut his cords and spring from the cart into the safety of the surging crowd. What an exploit that would have been.

This indomitable soul has enjoyed a long afterlife as a subversive hero.

A celebrity in his own time, his execution-eve portrait was taken by the Hanover court painter himself, James Thornhill. Sheppard is a very likely candidate as an inspiration for the criminal Macheath in The Beggar’s Opera completed just a few years after his death; likewise, his abandoned apprenticeship makes him the most apparent model for Hogarth‘s “idle prentice” plates.

A century later, prolific historical novelist William Ainsworth** claimed the convict-martyr for an 1839 retelling. This popular potboiler — read it free online here — came in for a spate of 19th century social panic when it was learned that a notorious servant-on-master murder had been carried out by a young man who had recently read it. A two-decade ban on public plays based on the Jack Sheppard novel ensued.

For as much as Jack Sheppard is romanticized in his remarkable individual characteristics, his story has always had a class undertow that raises the hackles of the powerful — and is celebrated by the people who menace that power. Linebaugh, again:

Jack Sheppard, housebreaker and gaol-breaker, was once the single most well-known name from eighteenth-century England. His fame spread across oceans and the centuries. When the bandit Ned Kelly was alive, the Australian press was full of comparisons between him and Sheppard. At the same time on the other side of the globe in Missouri, Frank and Jesse James wrote letters to the Kansas City Star signed ‘Jack Sheppard’. In England his name cut deep into the landscape of popular consciousness. Henry Mayhew noted that Cambridgeshire gypsies accepted Sheppard stories as the archetype of ‘blackguard tales’. Among English sailors anyone with the surname of ‘Sheppard’ was automatically called ‘Jack’. Within the Manchester proletariat of the 1840s his name was more widely known than that of the Queen herself. One of these lads said, ‘I was employed in a warehouse at 6s. 6d. a week, and was allowed 6d. of it for myself, and with that I went regularly to the play. I saw Jack Sheppard four times in one week.’

The oral history of Sheppard has maintained his memory within human contexts where books were scarce and working-class resources for an independent historiography were non-existent. Moreover, that memory was kept in contexts of social struggle in which a continuity, if not a development, with earlier moral and political conflicts was suggested.

1720: A deserter, by fellow-deserters

The sentence of death was often pronounced by courts-martial and not unfrequently carried out, a deserter convicted for the third time rarely escaping with his life. Many a man was shot in Hyde Park during the twenty years of peace, and no opportunity was lost to enhance the terror of the penalty, the firing party sometimes consisting solely of fellow-deserters, who were spared in consideration of the warning given by the ghastly body which their own bullets had pierced

Fortescue’s notes on this passage draw attention to the following account in the May 7, 1720 Weekly Journal.

On Thursday Morning the four Men, sentenced by a Court-Martial for Desertion, were brought hand-cuff’d to the Tilt-Yard Guard, from whence they marched with the Grenadiers at the Head of the Detachment to Hyde-Park; at the Place of Execution they were met by the Chaplain of the second Regiment of Guards, who prayed with them for a while; then three of the Prisoners, having before received the King’s Pardon, were restored to the Regiment, and ordered immediately to load their Pieces, and fire at their Comrade, which they obey’d; the Man was observed to give a little Spring after the Discharge of their Pieces, and a Corporal, who was kept, as usual, in Reserve, shot him through the Head; the other three Shot were lodged in his Breast. This is the third Time of his deserting.
