1961: Patrice Lumumba

No brutality, no torture has ever made me plead for mercy, because I prefer to die with my head up, with unshakable faith and deep confidence in the destiny of my country, rather than live in submission and spurning of scared principles.

One person’s “murdered under controversial circumstances” is another person’s “executed.” By most unbiased accounts, Patrice Lumumba was both.

A strident anti-colonialist caught in the most inflammatory of Cold War power struggles, Lumumba remains a controversial figure.

In 1956, Patrice Lumumba was a mail clerk in Belgian Congo recently out of prison for embezzlement of post office funds. Though previously involved with the Liberal Party of Belgium, a colonialist political party, after prison, he helped found the Mouvement National Congolais, a pro-independence national party (an important distinction at the time, as most pro-independence parties were at least partially tribal in nature).

Convicted in 1959 of inciting an anti-colonial riot and sentenced to 6 months in prison, Lumumba was released early as Congo won its independence and the MNC became an important political force. Just how important became apparent the following June, when the 35-year-old Lumumba was ratified as the newly independent Congo’s first prime minister.

From criminal to high statesman in just over a year, Lumumba took his new power in stride, and watched in disgust as the deposed King Baudouin of Belgium attended the new nation’s first Independence Day celebration, and before a fawning international media condescendingly congratulated Belgium’s colonial beneficence to its former slave plantation.

Struck from the day’s official celebrations in favor of the the lukewarm exhortations of the new President Kasa-Vubu, Lumumba found time on the day’s unofficial program. Strident, emotional, and unabashed in its anticolonialist, nationalist, and pan-Africanist bent, Lumumba’s famous speech was roundly criticized by the domestic and foreign press, but well-received by the crowd and ultimately delivered directly to history.

Lumumba’s tenure as prime minister was short-lived, however.

Mere weeks after independence, a mutiny on army bases broke out in reaction to Lumumba’s ill-fated decision to leave the military out of a government pay raise. The resulting anarchy quickly spread throughout the country, and the province of Katanga, with the support of King Baudouin and powerful mining companies, declared independence. As United Nations troops failed to quell the situation, Lumumba appealed to the Soviets, whose intervention succeeded only in causing Lumumba’s political support to crumble.

Kasa-Vuba dismissed Lumumba in September; in response, Lumumba declared Kasa-Vuba deposed — quite illegally, as it happens — and appealed to the Senate, from whom he managed to win a vote of confidence.

At this point, in the heat of the Cold War, things got interesting.

Deposed again, this time in a CIA-endorsed coup, Lumumba found himself under house arrest and under the protection of UN troops. Not certain whether to trust the rule of the various laws surrounding him, Lumumba slipped out under the cover of night and escaped to nearby Stanleyville (now Kisangani), where he believed he had enough supporters to set up his own government — and army, whom one supposes he had by then resolved to pay rather better.

Pursued by forces loyal to the new government, Lumumba was captured and arrested in early December 1960 and charged with “inciting the army to rebellion.” Devoid of his former UN protection, the man who would be the leader of a newly free nation watched as he became a pawn in a much larger struggle. UN Secretary General Dag Hammarskjöld appealed to the process of law –- whatever that was –- while the USSR jumped a step ahead, demanding that Lumumba be immediately released and reinstated as prime minister and all UN forces withdrawn.

So much for that. The UN Security Council convened, and, a week later, the USSR’s resolution was defeated. Another, Western-backed resolution that would have given the UN power to act as impartial arbitrator was vetoed by the USSR.

At this point, caught between hostility of Cold War politics and the ever-hazy idea of “international law,” Lumumba languished in the military barracks of an even more hostile government. Hearing of plans for his transfer to barracks at the now-subdued Katanga province, Lumumba was wild on the plane trip and was forcibly restrained after appealing to other passengers to intervene on his behalf. Late at night after his arrival at his new prison, Lumumba was driven to an isolated spot and executed by firing squad. News of his death was not released until three weeks later, when it sparked protests in several European cities over the role of the Belgian government, which denied any involvement.

The extent of US and Belgian involvement in Lumumba’s death remains the subject of ongoing speculation. So does the question of what might have been.

1934: Marinus van der Lubbe, for the Reichstag fire

On this date in 1934, Dutch bricklayer Marinus van der Lubbe was beheaded by guillotine in Leipzig for setting the Reichstag Fire.

A watershed event* in the formation of the Nazi dictatorship, the Reichstag fire days before a parliamentary election enabled Hitler to stampede voters, suspend civil liberties, suppress left-wing parties on grounds of a suspected Communist plot, and seize “emergency” powers he would never relinquish.

This clip from an American miniseries on Hitler with the characters chattering in unaccented English portrays the fascists’ opportunistic use of the attack on a national symbol … something not exactly unknown to later generations.

Van der Lubbe, who was arrested on the scene, suffered the predictable fate. Four other Communists charged as accomplices were acquitted, in a trial with the gratifying spectacle of Hermann Goering personally testifying, and being undressed on cross-examination by one of the reds. One is reminded here that Hitler did not yet have everything in the state apparatus at his beck and call … although he did have a great deal already, inasmuch as the arson law under which van der Lubbe died was passed after the Reichstag fire and made retroactive.

If the big-picture outcome of the Reichstag fire is pretty clear-cut, its real origin and the corresponding rightness of the judicial verdicts have remained murky ever since. The fact that the scene of the crime became Nazi ground zero for the next decade sort of obscures the evidence.

Van der Lubbe confessed, so his participation is generally taken as a given.

Whether he was really able to start the blaze acting alone, as he insisted, and the Nazis “only” exploited this fortuitous calamity; whether he was part of a larger leftist plot, as his prosecutors claimed; or whether, as Shirer and many others since have viewed him, he was a patsy in a false flag operation set up by the Nazis with an eye towards creating a politically advantageous national emergency — these possibilities remain very much up for debate.

For what it’s worth, postwar West German courts reversed and un-reversed the sentence before officially rehabilitating van der Lubbe last year on the non-specifically indisputable grounds that the legal machinery brought to bear on the Reichstag fire “enabled breaches of basic conceptions of justice.”

I do not see that one can blame the majority of Germans who, in 1933, believed that the Reichstag fire was the work of the Communists. What one can blame them for, and what shows their terrible collective weakness of character … is that this settled the matter. With sheepish submissiveness, the German people accepted that, as a result of the fire, each one of them lost what little personal freedom and dignity was guaranteed by the constitution, as though it followed as a necessary consequence. If the Communists had burned down the Reichstag, it was perfectly in order that the government took “decisive measures”!

Next morning I discussed these matters with a few other Referendars. All of them were very interested in the question of who had committed the crime, and more than one of them hinted that they had doubts about the official version; but none of them saw anything out of the ordinary in the fact that, from now on, one’s telephone would be tapped, one’s letters opened, and one’s desk might be broken into. “I consider it a personal insult,” I said, “that I should be prevented from reading whichever newspaper I wish, because allegedly a Communist set light to the Reichstag. Don’t you?” One of them cheerfully and harmlessly said, “No. Why should I? Did you read Forwards and The Red Flag up to now?”

1900: En Hai, the murderer of von Ketteler

On the last day of the 19th century, a Chinese officer was beheaded on the public street where he had precipitated western* military intervention in the Boxer Rebellion by killing a German diplomat.

Foreign commercial penetration — and domination — was generating domestic turmoil in China. As liberal reforms foundered in the late 1890’s, a more radical anti-foreigner movement blending spiritualism and martial arts launched the Boxer Rebellion (or Yihetuan Qiyi, in the local coinage).

In addition to massacring hated missionaries, the Boxers besieged foreign diplomatic missions in Peking … and veteran German ambassador Klemens von Ketteler was killed in a firefight on a crowded street. (The particular circumstances of the killing seem highly confused, and were immediately colored by the various interested parties’ axe-grinding; it’s sometimes called an “assassination,” but there’s no proof von Ketteler was specifically targeted, and the ambassador himself managed to get a shot off in the fray.)

Given the financial interests at stake, it would be far too much to say that von Ketteler’s death caused the military intervention that ensued, but it certainly catalyzed the conflict. The next day, China’s Dowager Empress declared war against the Eight-Nation Alliance. Within two months, Peking (Beijing) was under foreign occupation.

The man detained as von Ketteler’s murderer — En Hai, or Enhai, or Su-Hai — was proud to claim the act himself, and intimations of the Chinese government’s official blessing for anti-foreigner activities were carefully massaged since the Eight-Nation powers would have need of the Qing dynasty to keep order locally.


On the afternoon of this day in 1900, En Hai was brought out from German custody to the street where von Ketteler had met his end and handed over to the Chinese for beheading. Notice the substantial foreign attendance in both the photograph and the drawing. A German officer’s diary entry cited in The Origins of the Boxer War: A Multinational Study recounted the scene.

Ketteler’s murderer was executed at last — for months past the unfortunate wretch has been begging for his execution. It took place in one of the busiest thoroughfares but there were only a few curious onlookers. Scarcely fifty yards away the usual business was being quietly transacted in the streets, people who were eating did not suffer themselves to be interrupted, and a teller of fairy-tales who was recounting his absurd stories had interested his numerous audience much more than the execution.

And to see that the lesson would not be lost on future generations of Chinese, the humiliating peace imposed upon China that December (and formally signed the following year) required China to expiate its guilt by

erect[ing] on the spot of the assassination of his Excellency the late Baron von Ketteler, commemorative monument worthy of the rank of the deceased, and bearing an inscription in the Latin, German, and Chinese languages which shall express the regrets of His Majesty the Emperor of China for the murder committed

Having been made an offer it couldn’t refuse, China honored the intersection (German link) where both the victim and his killer had died in their turns with a massive pailou archway, inscribed

This monument has been erected by order of His Majesty the Emperor of China for the Imperial German Minister Baron von Ketteler, who fell on this spot by heinous murder on the 20th of June, 1900, in everlasting commemoration of his name, as an eternal token of the Emperor’s wrath about this crime, as a warning to all.

“Everlasting commemoration,” in this case, lasted 15 years.

The national aspirations that had fired the Boxers reared up again in 1911-12 to topple the Qing. Days after Germany’s surrender in World War I, the Chinese Republic began removing the von Ketteler monument.

Visitors will need to look sharp to catch it now, in Zhongshan Park (aka Sun Yat-Sen Park or Central Park), where it has been rededicated to abstractions that age a little better than our German civil servant.

But this was still not quite the last the name von Ketteler was heard in the consular world. A relative (German link) of the man slain in Peking was a conservative diplomat of the Weimar and early Nazi period who opposed the national socialist government. Wilhelm Emmanuel von Ketteler was abducted by the Gestapo in 1938 and murdered thereafter in unclear circumstances, possibly for involvement in a very early plot to kill Hitler.

* “Western” in this case includes Japan, the regional industrial power that also flanked the Russian Empire to the east — very much a player on the European balance-of-power chessboard. Germany (obviously), France, Italy, Russia, the U.K., and the U.S.A. were the other nations involved in the intervention, along with the Austro-Hungarian Empire, whose naval deployment to China included future Sound of Music character Georg Ritter von Trapp.

1903: Emily Swann and John Gallagher, the Wombwell murderers

On this date in 1903, a 42-year-old mother of 11 was hanged side by side with her 30-year-old lover for murdering an abusive husband in the small South Yorkshire town of Wombwell.

That June, Emily Swann had shown her outgoing boarder and lover John Gallagher (together with some neighbors) the results of William Swann’s latest beating. John returned to the house and repaid the injuries in kind — and with interest.

After some minutes of fighting audible to the neighbors, Bill had been beaten to death.

Emily’s battered-wife situation might cut a lot more ice today, but by the jurisprudence of the day it was a fairly straightforward case, especially since all kinds of incriminating remarks were attributed by the neighbors to both Emily and John — “Give it to him, Johnnie, punch him to death,” for instance, and Gallagher’s own mid-bout respite at a neighbor’s house where he reported having broken four ribs with plans to break more. Both illustrated a level of intent among both parties beyond the heat of passion.

And you wouldn’t say the authorities were disposed to sympathize with Emily’s situation in general. They rather viewed her immorality — with John and otherwise — as the cause of the thrashings William gave her.

the wonder is that he has not killed her. He has frequently gone home after leaving work and found his wife drunk in the house and nothing prepared for him in the way of food. (case file comment, quoted here)

Fortified by a stiff drink of brandy, Emily Swann glided onto the platform at Leeds’ Armley Prison beside her already-trussed defender and delivered the somewhat famous greeting, “Good morning John.” Gallagher managed to return the salutation, and a few seconds before both were launched into eternity, she replied, “Good-bye. God bless you.”

It was an unusual exchange because the English execution protocol did not solicit remarks from the doomed prisoner, and in the occasional double hangings,* most participants were too frightened, awed or preoccupied to make small talk with their fellow-sufferers in the few seconds available.

* England would soon do away with double hangings altogether. Subsequent convicts to be hanged “together,” like Edith Thompson and Frederick Bywaters, were in fact executed simultaneously but at different prisons.

1979: Hafizullah Amin

On this date in 1979, the 104-day term of Afghan president Hafizullah Amin met a violent end as a Soviet-engineered coup raised the curtain on a war destined to bring misery to both Cold War combatants.

The Soviet Union’s ongoing intervention in Afghan politics had through the 1970’s steadily mired it deeper into an unstable political situation.

Now, it was running out of patience with the country’s president, Hafizullah Amin.

He’d got the best of rival Nur Mohammad Taraki in a power struggle that September, but to the political chaos and the blossoming Islamic insurgency roiling his country, Amin added a level of brutality that was all his own, and a streak of diplomatic independence that was distinctly unwelcome in Moscow.

Amin was a Communist himself, and both he and the predecessor he’d murdered had wanted ever-increasing Soviet aid to keep the country stable.

But that proved to be a Faustian bargain.

Though Kabul radio would announce that Amin had been tried and summarily executed for “crimes against the state,” the short-lived dictator’s fate had been decided two weeks before when the Soviet Politburo passed a secret resolution for his ouster — having lost whatever confidence it had once held in him as a dependable satellite governor.

“The Soviet Union,” said the New York Times in a more innocent time,

has seemed deeply troubled by the inability of either the Taraki or Amin governments to put down the rebellions in Afghanistan, which have been largely tribal but also militantly anti-Communist.

Amin survived a KGB poisoning, so the Red Army dispensed with subtlety by raiding the palace, plucking their preferred satrap out of exile in eastern Europe to take Amin’s place.

It would not see the last of Afghanistan until 10 years, 15,000 Soviet dead, and hundreds of thousands of Afghan casualties later.

1922: Seven Republican guerrillas in the Curragh of Kildare

Seven men were executed in the Glasshouse, in the Curragh Camp on December 19 in the biggest official executions of the Civil War. They were Patrick Bagnall and Patrick Mangan, Fairgreen, Kildare; Joseph Johnston, Station Road, Kildare; Bryan Moore and Patrick Nolan, Rathbride, Kildare; Stephen White, Abbey St. Kildare and James O’ Connor, Bansha, Co. Tipperary. These seven men, along with Comdt. Thomas Behan were found in a dug-out at Mooresbridge, on the edge of the Curragh, on the night of December 13. They were under the command of Comdt. Bryan Moore, 38, a veteran IRA officer, and comprised a section of the 6th Battn. Column. They were armed with rifles bought from a soldier stationed in Naas Barracks.

A detachment of troops from the Curragh searching a farmhouse at Mooresbridge, about one-and-a-half miles from the Curragh Camp, “found the proprietress in possession of a fully loaded Webley revolver.” A subsequent search disclosed a dug-out underneath a floor. The dug-out was surrounded by National soldiers who called on the men to come out. Eight men were in the dug-out, which was also found to contain 10 rifles, a quantity of ammunition, one exploder, a roll of cable and food supplies. When they surrendered Tom Behan was struck with a rifle butt and had his arm broken. When the captives were ordered into the back of a truck Tom Behan could not climb aboard because of his broken arm. He was struck again on the head with a rifle butt and died at the scene. Behan was a veteran IRA man and at the time of his death was Intelligence Officer, 1st Eastern Division. The Free State authorities claimed that Behan was shot while trying to escape through a window in the Glasshouse (so called because of its roof), issuing a statement saying: “One of the party of men arrested when trying to make his escape from the hut in which he was detained at the Curragh, ignoring the warning of the sentry to desist, was fired on and fatally wounded.” Mick Sheehan was in the Glasshouse at the time and thought it highly unusual that an experienced volunteer like Tom Behan would try to escape through such a small window. It was only years later that he found out the truth. The Glasshouse was a small stone and brick military prison up the hill where the military usually housed their own prisoners. It consisted of two floors enclosed within a twelve foot high walled enclosure with cells for 64 prisoners. During the Civil War, and after, it was used as a punishment block for Republican prisoners.

The remaining seven men were executed by firing squad on the morning of December 19. The following official report was issued from Army Headquarters, GHQ, on that evening: “Stephen White, Abbey Street, Kildare, labourer; Joseph Johnson, Station Road, Kildare, railway worker; Patrick Mangan, Fair Green, Kildare, railway worker; Patrick Nolan, Rathbride, Kildare, railway worker; Brian Moore, Rathbride, Kildare, labourer; James O’Connor, Bansha, Tipperary, railway worker; Patrick Bagnel, Fair Green, Kildare, labourer who with others, were arrested at Rathbride, Co. Kildare, on the 13th inst., were charged before a Military Committee with being in possession, without proper authority, of – 10 rifles, 200 rounds of ammunition therefor, 4 bomb detonators, 1 exploder.

“They were found guilty and sentenced to death. The sentence was duly executed this morning, 19th inst., at 8.30 a.m.”

They were all veteran IRA men and belonged to a column of ten which operated against railways, goods trains and some shops in the vicinity of Kildare. Five of them were on the derailment of engines at Cherryville on December 11 when they made a serious attempt to dislocate the whole railway service on the Great Southern and Western Railway Line. Two engines were taken out of a shed at Kildare and sent down the line by Cherryville. One engine ran out of steam and did no harm, while the other overturned and blocked the line for a considerable time. The column was also responsible for an ambush on National troops at the Curragh Siding on November 23 when a large party of troops were returning to Dublin after escorting prisoners to the Curragh Internment Camp. On their return journey the troops were fired on at the Curragh Siding and two were wounded. In the confusion a policeman was accidentally shot by a National soldier. Father Donnelly, chaplain to the troops, administered to the seven volunteers before their executions. They were shot one by one and were buried in the yard adjacent to the Glasshouse.

The last letters from the seven men were printed in the Republican paper Eire. /The Irish/ /Nation/. James O’Connor of Bansha wrote to his mother: “I am going to Eternal Glory tomorrow morning with six other true-hearted Irishmen.” Patrick Mangan wrote to his mother: “I am to be shot in the morning. I fought for Ireland and am sorry I could not do more… I have made my peace with God and was never so happy as tonight.”

On March 31 1923 Eire (The Irish Nation) printed the last poignant letters from Bryan Moore, Patrick Bagnell and Paddy Nolan under the title ‘Last letters of “executed” soldiers of the IRA.’*

The executions caused a lot of bitterness locally. Both Mick Sheehan’s uncles, who had taken the pro-Treaty side, left the National Army. One, Capt. Patrick Kelly, who had served in the Republican Police, resigned his commission and went to the Civic Guards.

1917: Thirteen black soldiers of the 24th U.S. Infantry Regiment

On this date in 1917, thirteen black soldiers were secretly hanged at dawn at a military camp outside San Antonio for their parts in a Houston race riot four months earlier.

During the nadir of American race relations and just months after America’s entry into World War I, the soldiers of this historic all-black unit had been dispatched to build military facilities in Harris County, where they met animosity from whites beyond the everyday insults of Jim Crow law. Here, the service of “arrogant, strutting representatives of black soldiery” was hated and feared.

When white police arrested a black infantryman who tried to prevent their detaining a drunk black woman, then beat up and shot at a black corporal sent to inquire after him, hostility boiled over. Over one hundred soldiers marched through the city — confronting a mob of white citizens and police who had likewise armed themselves. Fifteen whites and four blacks were killed in the ensuing confrontation.

Their lenient treatment has led negro soldiers to believe that the government is in sympathy with their arrogance and impudence toward white people …

No white Houstonian was ever prosecuted for the day’s events, but the largest court-martial in U.S. military history tried 63 black soldiers and condemned 13 to die:

The sentence was carried out without appeal, the time and place only announced after the men had already hanged but evidently witnessed by the New York Times reporter who wrote that “the negroes, dressed in their regular uniforms, displayed neither bravado nor fear. They rode to the execution singing a hymn, but the singing was as that of soldiers on the march.”

Two more mass courts-martial would follow, resulting in six more hangings the following year.

For years afterward, the incident clouded and complicated race relations, especially in the War Department.

Some blacks openly applauded the mutiny as a justified resistance against racist provocation. This inflammatory opinion piece, quoted in Mark Ellis’ Race, War and Surveillance, landed the editor who agreed to run it in federal prison:

We would rather see you shot by the highest tribunal of the United States Army because you dared to protect a Negro woman from the insult of a southern brute in the form of a policeman, than to have you forced to go to Europe to fight for a liberty you cannot enjoy. Negro women regret that you mutinied, and we are sorry that you spilt innocent blood, but we are not sorry that five southern policemen’s bones now bleech [sic] in the graves of Houston, Tex.

Meanwhile, the Army noted “the tendency of the Negro soldier, with fire arms in his possession … to become arrogant, overbearing, abusive and a menace to the community in which he happens to be stationed.” It held down its black enlistment throughout the interwar period.

Sympathizers with the policy would continue — until the raw manpower requirements of World War II trumped the discussion — to cite the Houston riots both as evidence of the dangers of arming blacks, and the disloyalty of a populace willing to register open disgust with lynch law during wartime.

* Baltimore was the soldier who had come after the missing men; his altercation with a white policeman who answered, “I don’t report to any negro” and pistol-whipped him — and, it was incorrectly rumored among the 24th Infantry that night, killed him — triggered the riot.

Baltimore’s role is developed in a fascinating study of primary documentation on the case in Edgar A. Schuler’s “The Houston Race Riot, 1917” published in The Journal of Negro History, Vol. 29, No. 3 (July, 1944). Schuler also treats the interesting tensions between the Houston black community and the black regiment, and the emergence of a white narrative of uppity, out-of-control Negroes rather than ones responding (however wrongly) to specific provocations … which conveniently turned Jim Crow law from the problem into the solution.

1859: John Brown’s body starts a-moulderin’ in the grave

That line between “martyr” and “terrorist” is often a matter of historical perspective or even accident.

Were the person’s actions justified?

If not justified, were they at least historically significant?

If not historically significant, did they at least inspire some really great songs?

Or, movies?

John Brown, abolitionist, father of 20 children, advocate of armed insurrection as a direct means of ending slavery, is just such a figure. Before looking at how his actions influenced history, however, it is instructive to consider how history influenced him.

Born into a devout family opposed to slavery on religious and moral grounds, Brown grew up in a vehemently anti-slavery district of Ohio and, as a young man, began training in New England to become a Congregationalist minister.

When money ran out, he returned to Ohio and began a series of variously successful business ventures and married his first wife, with whom he would have seven children. When his businesses failed, he moved to Pennsylvania, buried his wife, married his second, and started a tannery, which began to founder as one of his sons died and Brown fell ill. He moved his family –- now with more than a dozen children –- back to Ohio, where he was hit hard by the economic crisis of 1839 (PDF link). In 1842, he was declared bankrupt; the following year, four more of his children died of dysentery.

In spite of these setbacks, Brown remained dogged in his pursuit of ventures to get himself out of debt, becoming a seasoned expert among small sheep farmers and acting as a self-appointed crusader for their empowerment against the encroaching interests of manufacturers. While this backfired and Brown remained impoverished into the 1850s (thought not as much as when he was declared bankrupt), it solidified his interest in helping the underdog.

Bleeding Kansas

Moral and religious interest in the abolition of slavery had been part of Brown’s upbringing, but it wasn’t until 1855, when five of Brown’s adult sons began sending word of often violent pro-slavery machinations in the Kansas territory, that Brown first became committed to drastic action on behalf of the cause. His strategy wasn’t at first overtly violent, but was rather convinced that the anti-slavery cause could win by the ballot box; over the course of the next year, however, he became convinced that the only sure way of preserve Kansas as a free territory was by “fighting fire with fire” (historical opinion as to the precise extent of the pro-slavery violence in relation to Brown’s later actions is divided).

In 1856, with tensions reaching a boiling point, Brown, four of his sons, and a band of other abolitionists killed five pro-slavery settlers in Franklin County, Kansas in what became known as the Pottawatomie Massacre. No legal retribution was possible or likely; Brown and his party escaped handily (although one of his sons was killed the following August), and Brown spent the next three years using various aliases to travel among abolitionists raising funds to launch an all-out assault on slaveowners back East.

“The crimes of this guilty land will never be purged away but with blood.”

That he chose the federal arsenal in Harpers Ferry, Virginia (now West Virginia) for his historic attack was no accident; it “evinced federal power stained by slavery.”

Brown believed his actions would be the start of a lasting insurrection in which slaves would rise up against their owners in an insurrection that would quickly spread to neighboring counties and throughout the South. While violence was expected, it was to be minimized, and, after the initial raid, used only in self-defense.

Twenty-one men, in total, took part in the raid; Brown’s expected hundreds of recruits never materialized. The slave population never got a chance to rise up against their masters, as townspeople promptly began firing on the raiders; by the morning after the start of the raid, the invaders were surrounded by a company of US Marines.* Brown was captured, along with seven of his men; ten were killed, and four escaped.

Tried in Virginia for murder, treason and conspiracy, Brown was convicted on November 2, just weeks after his failed insurrection, and sentenced to be hanged within a month. His often-cited speech in Court in response to this sentence would become a rallying cry for the abolitionist movement:

This court acknowledges, as I suppose, the validity of the law of God. I see a book kissed here which I suppose to be the Bible, or at least the New Testament. That teaches me that all things whatsoever I would that men should do to me, I should do even so to them. It teaches me, further, to “remember them that are in bonds, as bound with them.” I endeavored to act up to that instruction… Now, if it is deemed necessary that I should forfeit my life for the furtherance of the ends of justice, and mingle my blood further with the blood of my children and with the blood of millions in this slave country whose rights are disregarded by wicked, cruel, and unjust enactments, I submit; so let it be done!

“Make the gallows glorious like the Cross.”

During his last month on Earth, Brown seemed well-aware that he was on his way to be a martyr. Refusing rescue by a supporter who had managed to infiltrate the prison, he wrote letters of valor and conviction which were increasingly picked up by the Northern abolitionst press, and attracted pleas of clemency from sources as removed as Victor Hugo.

John Brown hanged at Charles Town, Virginia (present-day West Virginia — another thing Virginia lost during the Civil War). This 19th-century drawing is from the Virginia Military Institute archive of the event, which includes eyewitness accounts of soldiers who attended the hanging, including Thomas “Stonewall” Jackson.

Hanged in the mid-morning of December 2, 1859, Brown stated ominously: “I, John Brown, am now quite certain that the crimes of this guilty land will never be purged away but with blood. I had, as I now think, vainly flattered myself that without very much bloodshed it might be done.”

Brown’s dramatic enactment of an attempted armed insurrection –- even an abortive one –- stoked longstanding Southern fears of slave rebellions, leading the South to reorganize and equip its outdated militias, and the Union to increasingly valorize a man who held, with sheer and utter clarity, the very convictions in which they must needs believe to fight and win the coming War Between the States.

Called a “misguided fanatic” by the man who would lead that war, Brown’s actions nonetheless both hastened the inevitable schism already drawn so dramatically across a nation in which one out of every ten human beings was held in legal bondage, as well as gave moral and spiritual courage to those who would ultimately rise to eradicate it.

Or in the words of Frederick Douglass:

Did John Brown draw his sword against slavery and thereby lose his life in vain? And to this I answer ten thousand times, No! No man fails, or can fail, who so grandly gives himself and all he has to a righteous cause. No man, who in his hour of extremest need, when on his way to meet an ignominious death, could so forget himself as to stop and kiss a little child, one of the hated race for whom he was about to die, could by any possibility fail.

Did John Brown fail? Ask Henry A. Wise in whose house less than two years after, a school for the emancipated slaves was taught.

Did John Brown fail? Ask James M. Mason, the author of the inhuman fugitive slave bill, who was cooped up in Fort Warren, as a traitor less than two years from the time that he stood over the prostrate body of John Brown.

Did John Brown fail? Ask Clement C. Vallandingham, one other of the inquisitorial party; for he too went down in the tremendous whirlpool created by the powerful hand of this bold invader. If John Brown did not end the war that ended slavery, he did at least begin the war that ended slavery. If we look over the dates, places and men for which this honor is claimed, we shall find that not Carolina, but Virginia, not Fort Sumter, but Harpers Ferry, and the arsenal, not Col. Anderson, but John Brown, began the war that ended American slavery and made this a free Republic. Until this blow was struck, the prospect for freedom was dim, shadowy and uncertain. The irrepressible conflict was one of words, votes and compromises.

When John Brown stretched forth his arm the sky was cleared. The time for compromises was gone – the armed hosts of freedom stood face to face over the chasm of a broken Union – and the clash of arms was at hand. The South staked all upon getting possession of the Federal Government, and failing to do that, drew the sword of rebellion and thus made her own, and not Brown’s, the lost cause of the century.

1922: Robert Erskine Childers, for carrying the gun of Michael Collins

On this date in 1922, Robert Erskine Childers was shot by the Irish Free State for carrying a gun its founding colossus had gifted him.

Many Irishmen were executed on either side in this terrible time, but Childers cuts a unique figure among them.

To begin with, he wasn’t all that Irish — “that damned Englishman,” fellow Republican turned Civil War enemy Arthur Griffith called him. The London-born son of a British scholar and an Irish mother, Childers was a lifelong Protestant, itself an anomaly since Irish nationalism mapped (and still maps) strongly to Catholicism.

You’d think he’d be a loyal man of the empire. Early on, that’s just what he was.

In his twenties, Childers volunteered for the Boer War, and he would later say the rank savagery and underlying injustice of England’s war “changed the whole current of my life and made me a Liberal and a Nationalist.” (Source.)

Laying down the sword, Childers took up the pen and wrote several books of military history. (Long since into the public domain, at least two can be read free online: War and the Arme Blanche, German Influence on British Cavalry.) He also wrote a novel, The Riddle of the Sands, that has a (debatable) claim as the first spy novel. Riddle has never gone out of print since it was published in 1903, though it is also available free online.

Both in fiction and nonfiction, Childers’ warnings against the German challenge to British hegemony were prophetic, but he was himself becoming a man divided. 1914 saw him running German guns to Irish nationalists aboard his yacht Asgard … and then signing up for the royal navy when World War I erupted.

The British crackdown on the Easter Rising during the war completed his radicalization; he moved to Dublin and turned his eloquence against the British.

Here, Childers was swept into the tragedy of the Irish War of Independence, and the civil war that followed it; though both were in the delegation that produced the contentious Anglo-Irish Treaty, Childers broke with Michael Collins over it and backed the IRA nationalists who fought the Irish Free State.

After Collins’s assassination, emergency laws promulgated the death sentence for anyone caught armed without authorization. Childers was a writer, not a partisan, but he was arrested in early November with a small sidearm — a gift Michael Collins had given him, back when they were on the same side. It was a time of bloody justice, and they threw the book at him.

Childers knew as well as Collins had that the internecine conflict would have to end. He checked out with awe-inspiring forgiveness; summoning his 16-year-old son to prison the night before his execution, Childers extracted a promise that the boy would find everyone who signed his death warrant … and shake their hands. (Young Erskine Hamilton Childers eventually became President of Ireland.)

Childers himself likewise shook the hands of his own firing squad, one by one. His last words (reported in a number of slightly different variations) were lightheartedly addressed to them:

Take a step or two forwards, lads. It will be easier that way.

1869: Hamiora Pere, Maori “traitor” to the Queen

On this date in 1869, Hamiora Pere became the only New Zealander ever executed for treason.

Maurice Shadbolt’s Season of the Jew is a historical novel of the conflict that doomed Hamiora Pere. It’s told from the standpoint of Te Kooti, who liked to compare the Maori cause to that of the Israelites resisting Egypt, and founded a religious sect that still persists today.

Pere* came by the distinction quite accidentally — even setting aside the queer circumstance of his “betraying” a state on the opposite side of the globe by resisting its claim to his ancestral homeland.

Hamiora Pere was one of five Maori prisoners from the Siege of Ngatapa during Te Kooti’s War — an indigenous resistance against British colonization — to face the fatal charge.

The crown handled these cases carefully.

Though all five men drew death sentences (mandatory for treason), the government was evidently trying to stay out of the martyr-making business — as revealed by a judge’s comment during official deliberations.

I believe the result is the very best that could have been arrived at. I am glad to know that Mr McLean thinks that one execution will be useful as more would have been by way of example and caution.

Unfortunately for Hamiora Pere, the one of those five who was most likely set up to be the “example,” Wi Tamararo, committed suicide in prison shortly after his sentence.

Pere seemingly became the next in line for hanging because he was associated with murders in a noteworthy massacre at Matawhero that slew 33 Europeans and 37 of their Maori allies. Notably, however, the charge of murder actually filed against him was dropped prior to trial since he could be placed at the scene of the attack, but not directly shown to have killed anyone. Even off the indictment, it may have been the thing that doomed him.

Whatever the nature of the deliberations — and this report (pdf) of New Zealand’s Waitangi Tribunal inconclusively attempts to unpack the story with the patchy evidence available — the remaining convicts got clemency. Four years later, they were pardoned outright.

Pere got the noose at Wellington, and the accidental historical footnote. He would seem destined to maintain his unusual distinction indefinitely, since New Zealand has abolished the death penalty altogether.

Fear of Death

It is the circumstantial distinction of his case that earns Pere his place in this blog out of the numberless thousands to meet his same fate.

But in the end, he faced the gallows in that existential nakedness common to all us mortal wretches beholding death. Many in these pages meet their ceremonial end with with bravado; Hamiora Pere, by contrast, suffered all the pitiably human torments of fear, according to the report of the Daily Southern Cross:

He received the notice of his approaching death with calmness, and it was not until the morning before the execution that he gave any outward sign that he realised his terrible position. … [after his last farewell with his family he] became terribly distressed. He evidently fully recognised his position; he knew that he had looked for the last time on those from whom only he had any right to expect sympathy; every incident was reminding him how rapidly his term of life was decreasing, and it was not until his spiritual adviser … had been with him some time, that he became more composed.

[on the morning of the execution, Pere’s] responses [to his spiritual advisor] were accompanied by a peculiar moaning, and by convulsive sobbing. … the prisoner, quite a young man, and with nothing in his general appearance worthy of special remark, was sobbing bitterly, and was evidently suffering from intense mental agony; he looked anxiously around, yet stood firm and erect while he was being pinioned, repeating, as well as his trembling voice would allow, the prayers that were being offered on his behalf. … At the foot of the steps [to the gallows] the prisoner halted a moment, but, being led up, was quickly placed in the centre of the platform, under the noose, which was immediately fixed round his neck. From the time the prisoner left his room, until the rope was adjusted, he continued praying in a low moaning tone, interrupted frequently by violent sobbing …
