1652: Joan Peterson, the Witch of Wapping

On this date in 1652, Joan Peterson was hanged at Tyburn for witchcraft.

Joan is a long time in the ground, and her dying refusal to be cowed by the officious prelate ordained to badger her into self-incrimination would alone stand her in very worthy stead in these pages. Even the hangman got annoyed when Joan, at the gallows,

was by the Ordinary nine on ten times earnestly pressed to confesse something against the said Mrs. Levingstone: Whereupon the Executioner told the Ordinary, he might be ashamed to trouble a dying woman so much, to which he replyed, he was commanded so to doe, and durst doe no otherwise. And afterwards the said Ordinary still insisting in his discourse, and very often pressing the said Peterson to confesse and discharge her conscience before God and the world; she answered that she had already confessed before the Bench, all she had to confesse; that she had made her peace with God; and therefore desired to dye in quiet, for now she was to appeare before God who presently would Judge her, and that God was witnes, that she dyed Innocently, and was in no wise guilty of what was laid to her charge.

Go, Joan.

This account comes to us from one of the surviving pamphlets (pdf) about her case, a document that, were it produced today, would probably draw a severe sanction under Britain’s nasty libel laws for its scandalous indictment of Joan’s persecutors.

It lays out an unscrupulous conspiracy of local grandees scrabbling after inheritance money, in which the “Witch of Wapping” swung for being the only honest broker in the room. Sure, we can’t prove it. But the rival, anti-Joan pamphlet (also at that same pdf link) has a lot of rot about our woman damningly chattering with a diabolical familiar in the cunning guise of a squirrel.

According to the pro-Joan pamphleteer, the trouble started when an elderly woman named Lady Powell died, leaving her wealth to a particular relative — the “Mrs. [Anne] Levingstone” mentioned in the excerpt above — and stiffing several others.

These others contrived a scheme to charge Anne Livingston with witchery in order to separate her from her windfall and get their own hands on it. Though witch-hunting never really reached the epidemic dimensions in England that it often achieved on the continent — the English ban on torture helped prevent self-sustaining cycles of forced denunciations — it did have its moments, and the characters in question may have been encouraged by the recent exploits of notorious witch-diviner Matthew Hopkins in preposterous judicial homicide.

But they weren’t targeting Joan Peterson at all. They just wanted to use her to get at Livingston.

When Peterson, a local healer with a knack for fixing migraines, refused a bribe to accuse Livingston of sorcering, the plotters made it an offer she couldn’t refuse (and protected themselves from exposure) by accusing Joan herself.

Our pamphlet presents a riveting and revolting story of the conspirators essentially being one with the local judicial officials — in fact, when it comes to trial, they’re literally Joan Peterson’s judges — but even as they groped her for witches’ teats and the like, they endeavored “to perswade the said Peterson to confess [since] she needed not fear what she confessed, for it was not her life they aimed at, but to have matter whereby to accuse one Mrs. Levingston, who had gotten the said Lady Powels estate, and thereby had undone 36 Persons of the said Ladyes Kindred.”

Playboy parliamentarian (and, recently, regicide) John Danvers* made a rare appearance in the neighborhood to help orchestrate events. Danvers was a sound man to have for an expedient financial racket; he was famous for acquiring his fortune by marrying an older widow. She’d since died, and he’d since squandered it.

Even with the fix in, however, Joan’s ability to produce physician testimony and a written post-mortem ascribing Lady Powell’s death to natural causes — the doctors were impressed she’d managed to make it to age 80 what with the “the Dropsie, the Scurvey, and the yellow Jaundies” — ran that whole case aground.

Considering the incriminating threats and blandishments Joan had heard, however, they just got her on a second, simultaneous indictment — for bewitching one Christopher Wilson, on the grounds that he’d gone to her for a cure, gotten a little better, and then relapsed. If you think modern libel law is harsh, you should see Protectorate malpractice law.

Wilson, one should add, did not make this complaint himself: others were induced to level the charge on his behalf, while the court itself barred most defense testimony with threats to imprison the witnesses as probable witches themselves. (Nevertheless, some did appear for Joan.) Somehow, this was enough for conviction.

Even after her condemnation,

the said confederates and their agents went very often to her promising her a Repreive or Pardon if she would confesse that Mrs. Levingstone had Imployed her to make away the life of the Lady Powell, to which she replyed she could not, because it was altogether false. But one of the said confederates urging her againe to say something against Mrs. Levingstone, she told him he was a rogue, and gave him a blow on the face, which made his nose bleed: Where it is to be noted, that what for love of money they could not tempt her to, they resolved at last for love of her life to force her to, by necessitating her either unjustly to confesse a notorious falsehood against the said Mrs. Levingstone or else to dye without mercy or Repreive, which otherwise was proffered her by the said Confederates, to make her unjust in doing the same.

* There’s a street named for him in Chelsea. His family name (though not selected specifically for John Danvers) also adorns the town of Danvers, Massachusetts … which was renamed in the 18th century to help bury its notoriety as Salem Village, an epicenter of the Salem witch trials.

1677: Thomas Sadler and William Johnson, mace thieves

On this date in 1677, Thomas Sadler and William Johnson were hanged at Tyburn for one of the most impudent burglaries in English history.

Thomas Sadler alias Clarke, William Johnson alias Trueman and Thomas Reneger … broke burglariously into the dwelling house of Heneage Lord Finch the Lord Chancellor of the said Lord the King and then and there stole and carried off a silver mace gilt gold worth one hundred pounds and two velvet purses imbroydered with gold and and silver and sett with pearles, worth forty pounds, of the goods and chattels of the said Lord the King.”

That’s right. They robbed the Lord Chancellor of his ceremonial mace while he slept, and a couple of embroidered ceremonial purses. (Representative pictures here.) The only reason they didn’t make off with the Great Seal of the Realm too was that the Chancellor had it under his pillow while he slept, for safekeeping. That’s some security.

The robbers, to their misfortune, were little better conscious of this crucial precaution.

They paraded through the darkened streets with mace poised on shoulder, a glorious revelry of knaves celebrating what they surely anticipated was the signal achievement of their lives — and the knell of their deaths.

Upon return to their lodging-house, and having no particular place to stash this hottest of loot, they just stuck it in a cabinet. There, the landlady ran across it while cleaning, and raised the alarum.

So Sadler and Johnson died for the astounding crime — Reneger, who didn’t, hadn’t been involved in a previous robbery that Sadler and Johnson committed, which might have helped mitigate his guilt — along with three distinctly undercard common criminals whom even the Newgate Ordinary scarcely noticed.

Johnson left a mournful little self-eulogy, many centuries since lost but preserved for us in that Ordinary’s evocative text.

Before his Tryal, having an excellent fancie, and a hand no less happy at Limning, he had drawn most lively on the wall of his Chamber in Newgate, a pair of Scales, and in one balance the Mace, and in the other Tyburn; the last much over weighing the first: But since his Condemnation, he drew in one Scale the Gallows, in the other a Crucifix; the first mounted up by the greater weight of the last, and these lines under-written, as I have been informed.

My Precious Lord, from all Transgressions free, Was pleas’d, in tender pity unto me, To undergo the Ignominious Tree.

I Suffer justly; but his Sacrifice, I trust, shall make my groveling Spirit rise, And from the Gibbet mount the glorious Skies.

1900: Louisa Josephine Jemima Masset

On this day in 1900, 36-year-old Louisa Josephine Jemima Masset (also called “Louise” in some accounts) was hung for the murder of her young son the previous year. She was the first woman, indeed the first person, to be executed in London in the brand spanking new 1900s.

Her crime, even by today’s standards, was shocking and there is little doubt that had it occurred today, Louisa would be featured on blogs with names like People You’ll See In Hell. (Actually, she got a TV miniseries in the early 1990s.)

The story of the murder and Louisa’s trial and death were recorded in detail in John J. Eddleston’s A Century of London Murders and Executions. Capital Punishment U.K. provides additional details, and the trial records can be seen here.

Our story begins a little after six on Friday, October 27, 1899, when a lady at the Dalston Junction train station in London found the body of a small boy shoved behind the door to the women’s lavatory. The child was naked, bloody and partially covered with a black shawl, and a bloodstained brick lay nearby.

The post-mortem determined that the child had been beaten “with much violence” on the head and face, but the actual cause of death was suffocation. He probably died only about an hour or two before his body was found. There was no indication of his identity, so his description was published in the newspapers with hopes that someone would recognize him.

Someone did: the following Monday, a children’s nurse named Helen Eliza Gentle came forward and identified the murdered boy as Manfred Louis Masset, age three and a half, who had been in her charge until the previous Friday.

Manfred was illegitimate and had been in Helen Gentle’s care since shortly after birth. Louisa, his mother, doesn’t seem to have been the maternal type. She paid 37 shillings a month for his care and would visit him once every two weeks and take him to the park. The money supposedly came from Manfred’s father in France; Louisa herself earned a living as a day governess and gave piano lessons.

The arrangement with Helen Gentle ended when Louisa told Helen that she was sending Manfred to France to be with his father. Helen handed the child over to her at 12:45 p.m. on October 27, only hours before his death.

When she was tracked down at her brother-in-law’s house, Louisa denied having harmed her son and stated she didn’t even know he was dead until she read about it in the newspaper. She admitted the story about taking Manfred to France a lie and said she only wanted to transfer him to another carer, as she thought Nurse Gentle wasn’t educating him properly. Louisa claimed she had met two women, one of them a schoolmistress, in the park a few weeks earlier. She arranged to enroll Manfred for the price of £18 per annum, and handed the little boy over on October 27.

When pressed, however, Louisa couldn’t remember much about these women or their school. The police smelled a rat and took her into custody for murder.

At Louisa’s trial in December, she stuck to her story about giving Manfred to a schoolmistress. She said she’d handed him over at the train station at 4:00 p.m., along with a £12 deposit towards his school tuition, then took the 4:07 train to Brighton. No one at the station saw the two women Louisa described. However, three witnesses at the train station remembered seeing Louisa and Manfred, who was crying, hanging about the station for over an hour on the afternoon of Manfred’s death: one of those same witnesses saw and spoke to Louisa at the station at 6:50 p.m., nearly two hours after Louisa claimed to have left, and said her little boy wasn’t with her anymore.

The icing on the cake was when the brick used to batter Manfred was shown to be same kind as those in Louisa’s garden.

Louisa’s story was partially true; she did go to Brighton that day, hours later than she said, and Manfred’s clothes turned up in the waiting room of the train station there. Eudor Lucas, Louisa’s next-door neighbor, said they had spent the weekend together in Brighton, sleeping in the same bed, and he had “had connection” with her.

The jury must have been outraged by their blatantly immoral behavior, and in any case the evidence against Louisa was overwhelming. The jury got the case on December 18 and took thirty minutes to convict her. She was hung just three weeks later.

1831: John Bishop and Thomas Head, the London Burkers

On this date in 1831, two of the “London Burkers” hanged for murdering a child to sell his body to anatomy schools for dissection.

It was one of the city’s most infamous crimes, touching explosive resentments among Londoners for the vampiric trade in human cadavers ultimately demanded by medical students. Thirty thousand packed the streets around Newgate Prison to send this date’s hated offenders on to the hereafter.

As the gang’s nickname indicates, it closely followed the similar affair of Burke and Hare in Edinburgh. (“Burking” had immediately come to mean “killing someone for their marketable cadaver”, a shadowy underworld phenomenon that was in need of a catchy name.) But although William Burke made the OED, it was the London Burkers who most directly triggered the legislation to reform the anatomy business.

Historian Sarah Wise wrote the acclaimed book about this case, The Italian Boy. Executed Today is thrilled to interview her on this 180th anniversary of the London Burkers’ deaths.

Book CoverET: Let’s begin with the title of your book, The Italian Boy — an allusion to the victim in the case. Who was this youth, how did he come to be in London, and what did the city look like to a penniless foreign child in 1830?

SW: Well the book is less a ‘whodunnit’ and more of a ‘who-was-it-done-to’. The identity of that particular victim was never fully established. But, as still happens today in murder cases, some types of victim seem to have more appeal than others, and rumour that a little Italian beggar boy was missing from his usual pitches snowballed into a situation where even the courts, police and newspapers were accepting it as fact that it was his body that had been delivered to an anatomist. The final chapter of my book goes into why this might not have been so.

The ‘Italian Boy trade’ was a racket, whereby traffickers paid poor peasant parents, worried about what future they could offer their children, and took charge of the child, walked them north to the wealthy cities of northern Europe, and got them exhibiting small animals or plaster images around the streets, in the hope of being thrown a penny or two. Huge sums could be obtained in this way, but needless to say, the children themselves saw little of this. [There’s an 1872 New York Times article describing the trade into North America here. -ed]

I was fascinated by the warmth shown to these kids in what was otherwise a pretty mean city. This really is the London of Oliver Twist — dark, filthy, with all sorts of Fagin types (and much worse) around. Child vagrancy (as with adult vagrancy) was all too common and yet there were practically no public or civic bodies to offer any help; the idea of hordes of kids sleeping rough is just extraordinary, but that’s how London was right up until the end of the 19th-century.

But Londoners loved these attractive, exotic-looking little Italian waifs, and would also defend other types of beggars if anyone appeared to be hassling them. Ordinary city-dwellers seemed to me, in reading the primary source material, to be a lot less withdrawn and in their own little world than we city-dwellers are today, and seemed to show more class, or social, solidarity.

And how about the killers? What’s their own background, and how do they get into the business of killing people to sell the bodies?

One of the killers, John Bishop, came from a good, solid, small-business background, having been bequeathed a successful carting company. He drank away the family firm, and then turned to the related trade of bodysnatching — there was often a close connection between those involved in city transport and those who needed to move their very questionable goods around surreptitiously. Both trades had the pubs in the street called Old Bailey as their headquarters.

The other killer, Thomas Head, aka Williams, was younger and harder to find out about. He was said to have come from a very poor but honest home, and his parents were devastated when he began to go off the rails in his adolescence, firstly petty-thieving, and then moving on to the less petty-thieving of grave robbery.

I’ve touched a bit elsewhere on the site on the underlying dynamic at work: more demand for medical cadavers than was being met by the gallows. Do we have a sense at this time, after the Burke execution, what proportion of those extra cadavers were being provided by resurrectionists? And how many might have been provided by outright homicide?

Numerical estimates vary hugely for every aspect of this subject. In terms of the sheer volume of bodies medical students were getting through, the 1828 Select Committee on Anatomy canvassed many opinions, and came up with the hugely divergent total of between 500 and 1,000 in a year — the ideal being three bodies per student, with each student completing a 16-month surgical and dissection training. The Select Committee suggested that on average, the Resurrection Men were supplying around 500 to 550 corpses a year — by one means or another. But all these stats should be used with caution.

As for grave robbery: it was all highly surreptitious, as you would expect — there is no great documentary source to turn to, and so we have only scraps of rumour and hearsay. John Bishop, one of the Italian Boy murderers, is said to have ‘lifted’ between 500 and 1,000 corpses in his career, which lasted from 1818 to 1831. That is a huge differential and there is no way of checking whether the lower or higher number is the more likely. Someone shouted at Bishop, in the Old Bailey cells, ‘You’re a bloody murdering bastard, and you should have been topped [hanged] years ago!’, which suggests that the Italian Boy killing was not his first.

As we know, only around twelve people a year were executed for murder in England in these years — people executed for other crimes were not sent to the anatomists. My guess is that many folks who died in public hospitals or workhouses were anatomised, but that this was a highly secret matter and went on illegally. The other main sources of corpses, to make up the shortfall, will have been corrupt undertakers, church sextons and gravediggers. I suspect many coffins in London graveyards were filled with nothing more than brick or earth. As the 1820s wore on, actual exhumations are likely to have declined in favour of more simple ‘sneak-thieving’, with insiders giving the tip-off about where a recently deceased body was likely to be found.

One more ‘statistic’ for you: in a plea bargain attempt during the Italian Boy case, the police placed in front of one prolific bodysnatcher a list of all the resurrection men they had ever known or come across and asked the witness if he would mark with a cross any of the 50 whom he thought capable of murder for dissection. When he handed it back, he had marked six names.

Huge irony: when anatomised, John Bishop was found to be one of the very best specimens the Royal College of Surgeons had ever dissected — great, strong muscles, extremely fit and hearty, from his horrible career in body-handling.

How overtly implicated were aspiring or actual doctors with this sort of thing (even “mere” resurrection as against murder) as a “necessary” part of their education that they chose to turn a blind eye towards? And was there any engagement with the problem as an ethical question?

The public cared hugely about the ethics; the legislature very little. That’s why Dr. Knox, in the Burke and Hare case, was so unusual — no one protected him when the case came to trial, and he was vilified and more or less chased out of Edinburgh. But in the Italian Boy murders, no doctor got anywhere near the witness box. Society and the legislature really rallied around them, to make sure the public did not take their feelings out on them.

But popular resentment that the doctors might have encouraged, or turned a blind eye to, grave-robbery (not murder) remained very common.

By around 1800, doctors and students had wholly outsourced exhumations for dissection material — gangs of specialised labouring men did it for them, and part of the deal was that (in return for a good wage) the bodysnatchers themselves, if caught, would keep silent, do their stretch in gaol, and they and their families would be looked after financially by the surgeons who commissioned them.

One surgeon, Joshua Brookes, fell foul of the bodysnatchers (refusing to put up their wages) and in revenge, they placed half-dissected corpses close to his Soho premises. These were tripped over in the dark by pedestrians, which caused a huge rumpus and the police had to come to protect Brookes from the mobs who wanted to stone his house. Such events were the exception, rather than the rule.

There’s something just sublimely Swiftian about a disposable person being literally, bodily consumed by the city and its professional class. Was it surprising that a doctor would bust these men when they came to sell the body, and/or that it would trigger an aggressive police response? Had they probably pulled this trick with a wink and a nod many times before?

The Italian Boy case was highly unusual in that it was a surgeon, Richard Partridge, who blew the whistle — not only on the killers but essentially on the whole trade. He was the anatomy teacher at the brand-new King’s College, which was very religious-based, though funnily enough, I don’t think Partridge himself was devout. In getting the men arrested, he really blew wide open this secretive, terrifying world of the trafficking of (poor people’s) corpses.

It is the Italian Boy case — not Burke and Hare — which brought about swift legal change, which ensured the demise of surreptitious grave-robbery for anatomical teaching.

Other than hanging the perps, what was the fallout from this case at the level of policy or social evolution? Was there conflict between the privileged and the poor over how to understand this sort of crime and how to go about addressing it?

The ‘resolution’, the ‘evolution’, was the 1832 Anatomy Act, which essentially legalised what had been going on all along. It permitted anatomists to claim as legitimate teaching material the corpse of anyone who died in a workhouse or public hospital whose body went unclaimed by friends or family for private burial. In practice, it seems that even when apparently friendless beggars died, and associates did come forward, the doctors had already earmarked the body for their own purposes.

This type of thing caused decades and decades of bitter class resentment in this country, and fear of doctors and hospitals was even discernible in my late parents’ generation. These worries still occasionally resurrect themselves. The UK’s Human Tissue Act of 2004 was passed following disclosure of the mass storage of children’s organs, without any permission or consent having been sought from the parents. I think consent remains a huge issue in medical matters, in most cultures, and those who are deemed powerless in some way — by class, race, caste, gender and so on — are by far the more likely to have their bodies commandeered in the name of science.

1330: Roger Mortimer, usurper

The prince I rule, the queen do I command,
And with a lowly congé to the ground
The proudest lords salute me as I pass;
I seal, I cancel, I do what I will.

And, when I frown, make all the court look pale.

On this date in 1330, Roger Mortimer’s three-year run as de facto ruler of England ended with a rope at Tyburn.

Mortimer was a key figure in the Despenser War — a revolt of nobles against King Edward II and the king’s hated-by-nobles right hand Hugh Despenser.

That war failed and landed Mortimer in the Tower. Then, things really got interesting.

Mortimer escaped his cell in 1323 and fled to France. There he took up with King Edward’s own wife, Queen Isabella, when the latter came to court on some state business.

This was, needless to say, quite a scandalous arrangement — but hey, Isabella had seen royal cuckolding right in her own family before.

So the adulterous lovebirds settled in to canoodle and set about planning some serious homewrecking.

Both Isabella and Mortimer are by every appearance among the most outstanding personalities of their day, and they had ambition to match their considerable personal gifts.

In the autumn of 1326, they invaded England and won a swift victory as those disaffected nobles from the recent wars declared for the usurpers. This time, Hugh Despenser was put to death.

Edward didn’t fare that much better. By the next January, he had been forced to abdicate in favor of his 14-year-old son, which in reality meant ceding power to his ex and her lover. And you thought your divorce settlement was bad.

In the long tradition of rival heads of state being disposed of, Edward II was, well, disposed of: strangled in captivity later that same year (allegedly! there is some doubt as to whether he really died in 1327), and given a state funeral that put Roger Mortimer into a bogus public display of mourning

(Mortimer’s kinsman and historical-fiction-biographer Ian Mortimer thinks Edward actually survived, which is neither here nor there as pertains the fate of Mortimer.)

Once he got to the top of the heap, Mortimer too had rocky aristocratic relationships. He irked the lords of the realm with his tendency to behead them. He lost the First War of Scottish Independence. Oh, and he was a regicide. All this frayed his popularity. (This just in: governance is hard.)

More than that, since he and Isabella ruled in the minority of the titular king, Edward III, they were rearing a wolf to their own destruction — a wolf with a built-in personal grudge about his father’s overthrow and murder. All young Edward needed was a plan to disencumber his fangs.

As is so often the case, the most direct solution proved to be the best. In one of the more dramatic family moments in the English royal annals, Edward joined his close friend and a small band of trusted armed men, and burst in on Mortimer at Nottingham Castle, arresting him while his mother plaintively implored Edward to “have pity on gentle Mortimer.”

But Mortimer got as much mercy as he’d given the late Edward II. A mere six weeks removed from mastery of England, Mortimer was presented bound and gagged for the formality of a condemnation by Parliament on grounds of assuming royal authority. Then he was hustled off to Tyburn dressed pointedly in the same black tunic he had once worn to mourn Edward II. It was the first documented case of a nobleman being hanged at that grim destination.

1724: Jack Sheppard, celebrity escape artist

“Yes sir, I am The Sheppard, and all the gaolers in the town are my flocks, and I cannot stir into the country but they are at my heels baaing after me.”

On this date in 1724, the hangman finally got Jack Sheppard.

Sheppard was a thief, a romantic hero, a highwayman of the urban proletariat, a Houdini whom no prison could hold.

It had become possible in his time to ride criminal notoriety into celebrity: Jack Sheppard, a mere 22 at his death, proved as adept with that quicksilver element during his personal annus mirabilis of 1724 as he was with a lockpick.

Sheppard’s world had him fitted to wield a hammer better than thieves’ tools — but at about age 20, a young man awash in the illicit liberty of London’s underbelly, he ditched the square carpenter to whom he was apprenticed to live free by his wits.

Peter Linebaug’s The London Hanged finds in Jack Sheppard’s career and his runaway popularity an important marker of the capital city’s “refusal of subordination: — contra Foucaultian discipline, which “makes the rulers of government and society seem all-powerful.”

An important meaning of liberation … [consisted of] the growing propensity, skill and success of London working people in escaping from the newly created institutions that were designed to discipline people by closing them in. This tendency I have dubbed ‘excarceration’ because I wish to draw attention to the activity of freedom in contrast to its ideological or theoretical expressions…

This lithe youth is most famous for his literal talent for freedom: four times in 1724 he escaped from custody in ever more dramatic fashion.

He busted out through the ceiling of St. Giles Roundhouse. He rappelled with a bedsheet rope down the 20-foot wall of Clerkenwell Prison with his lover.

This sort of thing won the enterprising rogue growing folk hero status. The vaunted Sheppard “made such a noise in the town, that it was thought the common people would have gone mad about him, there being not a porter to be had for love nor money, nor getting into an ale-house, for butchers, shoemakers and barbers, all engaged in controversies and wagers about Sheppard.”*

It also drew the unwanted attention of 1720s London’s Jabba the Hutt: “thief-taker” Jonathan Wild, who managed a vast thieving cartel enforced by Wild’s willingness to turn in non-participants in his ingenious cover role as the city’ preeminent lawman. That’s some protection racket.

Sheppard, to the fame of his memory, scorned obeisance to the crime lord as much as to any guild carpenter and worked for no man but himself. A vengeful Wild shopped him to the authorities.

This time, Sheppard was actually condemned to death for burglary but broke prison again, using yet another classic ruse: the “disguised in smuggled women’s clothes.”

Back on the lam, he posted a cocky letter to his executioner “Jack Ketch” giving his regrets at not having joined two fellow-sufferers on the scheduled hanging date. (September 4.)

I thank you for the favour you intended me this day: I am a Gentleman, and allow you to be the same, and I hope can forgive injuries; fond Nature pointed, I follow’d, Oh, propitious minute! and to show that I am in charity, I am now drinking your health, and a Bon Repo to poor Joseph and Anthony. I am gone a few days for the air, but design speedily to embark, and this night I am going upon a mansion for a supply; its a stout fortification, but what difficulties can’t I encounter, when, dear Jack, you find that bars and chains are but trifling obstacles in the way of your Friend and Servant

London’s finest were determined to put an end to this character’s preposterous run of prison breaks, so when they caught him the fourth time Sheppard found himself loaded with manacles and chained to the floor of a special strongroom in Newgate Prison. Get out of that, Jack.

Somehow, Jack got out of it.

On the night of Oct. 14, Sheppard authored the sublimest breakout in Newgate’s voluminous annals. Picking the locks of his fetters with a small nail, our acrobat scurried up a chimney, picked, prised, or otherwise passed a succession of locked doors in the dead of night, paused to rest on the condemned pew of the gaol chapel, forced a grille, reached the roof, and threw another homemade rope over the wall to scamper down to safety.

And then “he promptly went forth and robbed a pawnbroker’s shop in Drury Lane of a sword, a suit of apparel, snuff boxes, rings, &c., and suddenly made a startling appearance among his friends, rigged out as a gentleman from top to toe.”

There’s no doubt but that Jack had showmanship, but at a certain point he could have done with just the tiniest measure of discretion. But then, this was a man writing his own legend. Sure, he could have put his head down and tried to disappear into some nameless Puritan settlement in the New World. (His distraught mother kept telling him to get out of the country.) He traded those dull and toilsome years for the fame of generations: his candle burned at both ends.

When next Sheppard was detained, it was towards his apotheosis. It was the only time he would be arrested and fail to escape.

A throng of thousands mobbed London’s route to execution this date, almost universally supporting the ace escapologist. And Sheppard very nearly had for them the piece de resistance in his career of magical disappearances: it was only at the last moment before boarding the fatal tumbril that Sheppard’s executioners found the penknife their prey had secreted on his person, evidently intending to cut his cords and spring from the cart into the safety of the surging crowd. What an exploit that would have been.

This indomitable soul has enjoyed a long afterlife as a subversive hero.

A celebrity in his own time, his execution-eve portrait was taken by the Hanover court painter himself, James Thornhill. Sheppard is a very likely candidate as an inspiration for the criminal Macheath in The Beggar’s Opera completed just a few years after his death; likewise, his abandoned apprenticeship makes him the most apparent model for Hogarth‘s “idle prentice” plates.

A century later, prolific historical novelist William Ainsworth** claimed the convict-martyr for an 1839 retelling. This popular potboiler — read it free online here — came in for a spate of 19th century social panic when it was learned that a notorious servant-on-master murder had been carried out by a young man who had recently read it. A two-decade ban on public plays based on the Jack Sheppard novel ensued.

For as much as Jack Sheppard is romanticized in his remarkable individual characteristics, his story has always had a class undertow that raises the hackles of the powerful — and is celebrated by the people who menace that power. Linebaugh, again:

Jack Sheppard, housebreaker and gaol-breaker, was once the single most well-known name from eighteenth-century England. His fame spread across oceans and the centuries. When the bandit Ned Kelly was alive, the Australian press was full of comparisons between him and Sheppard. At the same time on the other side of the globe in Missouri, Frank and Jesse James wrote letters to the Kansas City Star signed ‘Jack Sheppard’. In England his name cut deep into the landscape of popular consciousness. Henry Mayhew noted that Cambridgeshire gypsies accepted Sheppard stories as the archetype of ‘blackguard tales’. Among English sailors anyone with the surname of ‘Sheppard’ was automatically called ‘Jack’. Within the Manchester proletariat of the 1840s his name was more widely known than that of the Queen herself. One of these lads said, ‘I was employed in a warehouse at 6s. 6d. a week, and was allowed 6d. of it for myself, and with that I went regularly to the play. I saw Jack Sheppard four times in one week.’

The oral history of Sheppard has maintained his memory within human contexts where books were scarce and working-class resources for an independent historiography were non-existent. Moreover, that memory was kept in contexts of social struggle in which a continuity, if not a development, with earlier moral and political conflicts was suggested.

1767: William Guest, coin shaver

On this date in 1767, a larcenous bank clerk was hanged at Tyburn for robbing the till.

In this case, it wasn’t anything so gross as grabbing the money and running. No, our malefactor William Guest — the “son of a clergyman of unblemished character” whose “constant handling of gold [for the Bank of England] shook his integrity” — started milling the edges of the guineas he handled and innocuously returning them to the bank’s stock whilst piling up his own supply of gold filings.

It’s sort of the pre-digital version of the Office Space scheme: “I’m just talking about fractions of a penny here, but we do it from a much bigger tray. A couple of million times. So what’s wrong with that?” Literal profit on the margin: perfect for the FIRE sector.

Though 18th century London’s perpetual necktie party was obviously focused on the lowest classes, its busy gallows had room enough for the occasional white-collar crime.

And by England’s lights, debasing the currency was as serious a crime as there was: Guest’s conviction wasn’t for larceny or fraud, but for treason.

Because of that, he didn’t get the plain-old cart ride to the gallows, but was drawn on a sledge — the “drawn” bit of “hanged, drawn, and quartered,” although for this penny-shaver the execution itself didn’t entail the horrible quartering.

After enduring this archaic ignominy, the minister’s son “was indulged to pray on his knees” before being noosed and “his whole deportment was so pious, grave, manly and solemn, as to draw tears from the greatest part of the numerous spectators.”

1780: Five for the Gordon Riots

This date in 1780 saw three men and two women hanged at various spots around London for the previous month’s Gordon Riots. They were the first five souls among 19 who would suffer the last extremity of the law for that disturbance.

The eponymous Protestant Lord George Gordon, had inflamed a mob against the 1778 Papists Act, which disencumbered British Catholics of some of their legal disabilities. (In part to pad out the redcoat ranks as the army found itself stretched thin by the American Revolution.)

The Gordon Riots started from Lord Gordon’s march on Parliament to serve it an anti-Catholic petition, and turned into five days of anti-Catholic mayhem before the troops were finally called out to quell it. (The want of a standing professional police force was among the deficiencies London encountered.)


This did not help Britain’s diplomatic overtures towards Habsburg Austria.

But the matter metastasized well beyond a merely sectarian event: a mass rally originating in the working-class Moorfields took an unmistakable class dynamic — assailing Newgate Prison and The Clink, liberating convicts in the process. The latter dungeon would never resume operations. “Crimping houses” for impressed sailors and “sponging houses” imprisoning debtors were also liberated.

Alongside white sailors and day laborers, London’s emerging black population would feature prominently in this affair. A “copper coloured person,” a former slave named John Glover, was observed at the front rank of those torching Newgate. Peter Linebaugh attributes to Glover the incendiary (and, as it turned out, credible) threat, “Damn you, Open the Gate or we will Burn you down and have Everybody out.” (Glover was condemned to death, but reprieved for likely-fatal servitude on the African coast.)

Three of the five executed in London on this date were hanged at Tower Hill, including both women, Mary Roberts and Charlotte Gardiner. Gardiner, like Glover, was an African; she and Roberts had helped sack the house of an Italian Catholic innkeeper.

Although nineteen folks put to death within a month and a half hardly constitutes giving the rioters a pass, it’s somewhat striking in view of the unabashedly anti-authority conflagration in hemp-happy 18th-century England that the death toll wasn’t greater. And it could have been: in a treatment in the December 1997 History Today, Marika Sherwood reports that fully 326 people were tried for some role in the Gordon Riots. But elites’ sense of the situation may well be captured by Edmund Burke’s remark,

If I understand the temper of the publick at this moment a very great part of the lower, and some of the middling people of this city, are in a very critical disposition, and such as ought to be managed with firmness and delicacy.

Less than two score were actually condemned to death for all this mess, and barely half of them were actually executed.


The 19th century writer Charles Dickens set his very first historical novel,* Barnaby Rudge, during the riots, and has his fictitious lead characters among the crops doomed to the scaffold.

(As we have seen several times, Dickens abhorred public executions, a circumstance also apparent in this passage.)

Barnaby would have mounted the steps at the same time — indeed he would have gone before them, but in both attempts he was restrained, as he was to undergo the sentence elsewhere. In a few minutes the sheriffs reappeared, the same procession was again formed, and they passed through various rooms and passages to another door — that at which the cart was waiting. He held down his head to avoid seeing what he knew his eyes must otherwise encounter, and took his seat sorrowfully, — and yet with something of a childish pride and pleasure, — in the vehicle. The officers fell into their places at the sides, in front and in the rear; the sheriffs’ carriages rolled on; a guard of soldiers surrounded the whole; and they moved slowly forward through the throng and pressure toward Lord Mansfield‘s** ruined house.

It was a sad sight — all the show, and strength, and glitter, assembled round one helpless creature — and sadder yet to note, as he rode along, how his wandering thoughts found strange encouragement in the crowded windows and the concourse in the streets; and how, even then, he felt the influence of the bright sky, and looked up, smiling, into its deep unfathomable blue. But there had been many such sights since the riots were over — some so moving in their nature, and so repulsive too, that they were far more calculated to awaken pity for the sufferers, than respect for that law whose strong arm seemed in more than one case to be as wantonly stretched forth now that all was safe, as it had been basely paralysed in time of danger.

Two cripples — both mere boys — one with a leg of wood, one who dragged his twisted limbs along by the help of a crutch, were hanged in this same Bloomsbury Square. As the cart was about to glide from under them, it was observed that they stood with their faces from, not to, the house they had assisted to despoil; and their misery was protracted that this omission might be remedied. Another boy was hanged in Bow Street; other young lads in various quarters of the town. Four wretched women,† too, were put to death. In a word, those who suffered as rioters were, for the most part, the weakest, meanest, and most miserable among them. It was a most exquisite satire upon the false religious cry which had led to so much misery, that some of these people owned themselves to be Catholics, and begged to be attended by their own priests.

One young man was hanged in Bishopsgate Street, whose aged grey-headed father waited for him at the gallows, kissed him at its foot when he arrived, and sat there, on the ground, till they took him down. They would have given him the body of his child; but he had no hearse, no coffin, nothing to remove it in, being too poor — and walked meekly away beside the cart that took it back to prison, trying, as he went, to touch its lifeless hand.


Gordon himself, an odd duck, had better resources than these poor saps, and repelled a treason prosecution.

However, fate still ordained him a death in Newgate Prison — by illness many years later, after being convicted of defaming Marie Antoinette. By that time, the former Anglican rabble-rouser had converted to Orthodox Judaism, circumcision and all.

* The first of just two historical novels for Dickens; the second, of course, was A Tale of Two Cities.

** We’ve met Lord Mansfield before, articulating the jurisprudence of a slave society. His home was also targeted by Moorsfield rioters.

† Dickens is wrong about “four wretched women” being hanged: Gardiner and Roberts, our day’s pair, were the only two. Evidently, though, these two were arresting enough in the public conscience to forge “memories” of entire cartloads of ladies gone to Tyburn. (n.b.: none of the Gordon Rioters were hanged at Tyburn, either.)

1730: James Dalton, Hogarth allusion

On this date in 1730, career criminal James Dalton was executed at Tyburn.

Crime ran in the family for young master Dalton; his father hanged upon the information of notorious (and himself eventual gallows-bird) Jonathan Wild. According to the Ordinary of Newgate’s report, our day’s principal “went between his Father’s Legs in the Cart, to his fatal Exit at Tyburn.”*

Who knows but what naughty urchins (or parents) in the throng were deterred by that affecting spectacle. For the Daltons, it was more like Take Your Child to Work Day.

While the elder Dalton’s skills ran towards card-sharping, young master James went in for the more conventional varieties of larceny — both those practiced by stealth, and those practiced by force.

These pursuits saw him twice transported to America, for which we have to thank the English judiciary on account of Dalton’s resultant biography at Early American Crime.

(In)famous for his many dalliances, Dalton’s exploits could move copy in their day — and their author transgress the lines between the underworld and “legitimate” celebrity.

“In the height of all our Robberies” [Dalton] and his companions “used to go to the Playhouse, dressed like Gentlemen,” and that once, while watching The Beggar’s Opera, “Captain Macheath’s Fetters happening to be loose,” one of them “call’d out, Captain, Captain, your Bazzel is undone.” The real thieves, having shown up the actors with their superior knowledge of both irons and cant, then retired in style to an alehouse, “in four Chairs, with six Lights before each Chair.”**

Just another hanged thief.

Except, also not — because while his career in malefaction would undoubtedly have added up to a death sentence, his condemnation was secured upon the word of a perjurer upon a very doubtful charge.

A character named John Waller, an “affidavit man” whose profession was supplying bogus testimony to hang whomever could be hanged where a reward was available, insisted that Dalton had robbed him upon the roads. Dalton vigorously denied (and even rebutted with evidence) this charge even while admitting his general life of crime, but it was upon this dubious offense against Waller that he stretched his neck. Dalton died at Tyburn with three others, though a fifth member of their party, one Hugh Norton or Haughton, managed to cheat the executioner by hanging himself in his cell.†

It was the rough justice of the 18th century, a time frequently admitting opportunity to repay tit for tat.

In this case, the professional perjurer who hanged Dalton was two years later convicted himself after making a bogus accusation of highway robbery. Waller was condemned by the court to stand in the pillory at the Seven Dials — a dangerous punishment cousin to the era’s death penalty, inasmuch as the mob violence thereby invited not infrequently proved fatal.

Waller had quite a reputation, but the fury of the crowd was nothing next to that of James Dalton’s brother, Edward — who, with a confederate, brazenly climbed onto the platform, wrenched the “assize man” out of his pillory, and savagely beat him to death.

1720: A deserter, by fellow-deserters

The sentence of death was often pronounced by courts-martial and not unfrequently carried out, a deserter convicted for the third time rarely escaping with his life. Many a man was shot in Hyde Park during the twenty years of peace, and no opportunity was lost to enhance the terror of the penalty, the firing party sometimes consisting solely of fellow-deserters, who were spared in consideration of the warning given by the ghastly body which their own bullets had pierced

Fortescue’s notes on this passage draw attention to the following account in the May 7, 1720 Weekly Journal.

On Thursday Morning the four Men, sentenced by a Court-Martial for Desertion, were brought hand-cuff’d to the Tilt-Yard Guard, from whence they marched with the Grenadiers at the Head of the Detachment to Hyde-Park; at the Place of Execution they were met by the Chaplain of the second Regiment of Guards, who prayed with them for a while; then three of the Prisoners, having before received the King’s Pardon, were restored to the Regiment, and ordered immediately to load their Pieces, and fire at their Comrade, which they obey’d; the Man was observed to give a little Spring after the Discharge of their Pieces, and a Corporal, who was kept, as usual, in Reserve, shot him through the Head; the other three Shot were lodged in his Breast. This is the third Time of his deserting.
