1502: Vitellozzo Vitelli and Oliverotto da Fermo, Borgia casualties

On New Year’s Eve 1502, Cesare Borgia had two treacherous condottieri put to summary death at Senigallia.


The Showtime series The Borgias got canceled before it reached this particular depredation in Cesare Borgia’s career.

The “nephew” — that is, son — of Pope Alexander VI, Cesare resigned a cardinalcy in 1498 to follow his true passion, bloodshed, and set up as one of the Italian peninsula’s warring dukes. He had many a martial adventure before getting ambushed by a party of Spanish knights in 1507. Machiavelli considered him an able leader compromised by owing his temporal power to the pope’s territorial allotment. In The Prince, Machiavelli remarks on the lesson of Borgia’s reign, that “he who has not first laid his foundations may be able with great ability to lay them afterwards, but they will be laid with trouble to the architect and danger to the building” — and yet Cesare Borgia’s own fall months after his patron paterfamilias passed “was not his fault, but the extraordinary and extreme malignity of fortune.”

Cesare went from victory to victory in the first years of the sixteenth century, enough so that he threatened to make himself hegemonic in Italy. Several of his own allies, of which our day’s principals Vitellozzo Vitelli (his family ruled Citta di Castello) and Oliverotto da Fermo* (lord of Fermo) were two, began plotting against him and sent out feelers to build an anti-Borgia alliance among small powers who fretted the prospective domination of Cesare. (Though Borgia had them killed on a separate occasion, the others of note for purposes of this post are two members of the powerful Orsini family — Francesco Orsini, known as the Duke di Gravina; and, Cardinal Pagolo.)

As Florence’s own representative to Borgia’s court during the events in question, Machiavelli had a first-person view of events and recorded them in some detail. Taken on the back foot momentarily, Borgia stalled, firmed up his relations with friendly cities like Florence, and beat a brief tactical retreat. He came to terms with his friends-cum-rivals, who once more resumed campaigning on Borgia’s side.

Putatively back on the same team, several of the plotters soon found themselves at a stalemate besieging Senigallia, which refused to surrender to any but Borgia himself. They were therefore required to summon the dangerous prince from Lombardy. True to his name, Borgia did not miss the opportunity of an innocent invitation to destroy his foes.

Borgia marched into Seniallia with 10,000 infantrymen and 2,000 cavalry for a friendly little reunion. According to Machiavelli (who in this passage refers to Borgia as Duke Valentino, or simply as “the duke”),

Vitellozzo, Pagolo, and the Duke di Gravina on mules, accompanied by a few horsemen, went towards the duke; Vitellozo, unarmed and wearing a cape lined with green, appeared very dejected, as if conscious of his approaching death — a circumstance which, in view of the ability of the man and his former fortune, caused some amazement. And it is said that when he parted from his men before setting out for Sinigalia to meet the duke he acted as if it were his last parting from them. He recommended his house and its fortunes to his captains, and advised his nephews that it was not the fortune of their house, but the virtues of their fathers that should be kept in mind. These three, therefore, came before the duke and saluted him respectfully, and were received by him with goodwill; they were at once placed between those who were commissioned to look after them.

But the duke noticing that Oliverotto, who had remained with his band in Sinigalia, was missing — for Oliverotto was waiting in the square before his quarters near the river, keeping his men in order and drilling them — signalled with his eye to Don Michelle, to whom the care of Oliverotto had been committed, that he should take measures that Oliverotto should not escape. Therefore Don Michele rode off and joined Oliverotto, telling him that it was not right to keep his men out of their quarters, because these might be taken up by the men of the duke; and he advised him to send them at once to their quarters and to come himself to meet the duke. And Oliverotto, having taken this advice, came before the duke, who, when he saw him, called to him; and Oliverotto, having made his obeisance, joined the others.

So the whole party entered Sinigalia, dismounted at the duke’s quarters, and went with him into a secret chamber, where the duke made them prisoners; he then mounted on horseback, and issued orders that the men of Oliverotto and the Orsini should be stripped of their arms. Those of Oliverotto, being at hand, were quickly settled, but those of the Orsini and Vitelli, being at a distance, and having a presentiment of the destruction of their masters, had time to prepare themselves, and bearing in mind the valour and discipline of the Orsinian and Vitellian houses, they stood together against the hostile forces of the country and saved themselves.

But the duke’s soldiers, not being content with having pillaged the men of Oliverotto, began to sack Sinigalia, and if the duke had not repressed this outrage by killing some of them they would have completely sacked it. Night having come and the tumult being silenced, the duke prepared to kill Vitellozzo and Oliverotto; he led them into a room and caused them to be strangled. Neither of them used words in keeping with their past lives: Vitellozzo prayed that he might ask of the pope full pardon for his sins; Oliverotto cringed and laid the blame for all injuries against the duke on Vitellozzo. Pagolo and the Duke di Gravina Orsini were kept alive until the duke heard from Rome that the pope had taken the Cardinal Orsino, the Archbishop of Florence, and Messer Jacopo da Santa Croce. After which news, on 18th January 1502, in the castle of Pieve, they also were strangled in the same way.

1771: Henry Stroud and Robert Campbell, for revenge

On this date in 1771, Henry Stroud and Robert Campbell were hanged at Bethnal Green Road — a pointed message to the Spitalfield working class.

Their hanging was tit for tat in an exchange of deadly violence between the state and laboring Londoners.

Two years before, an anti-union law making it a capital crime to cut silk out of looms had actually been put to use with the hanging of two as part of the suppression of a Spitalfields weavers riot.

This execution provoked in the following months a horrifying mob vengeance against the independent weaver who had testified — falsely, it was suspected — against those hanged men. When said informer, name of Daniel Clark, was recognized walking in the area one day, an angry crowd formed and “stript him, tied his hands behind him, took him to a pond, threw him in, and then threw stones and brickbats at him for some time; then took him out, tied a cord round his neck, and threw him in the pond again, and then threw stones and brickbats at him till they beat out his brains.”*

Snitches get … brickbats.

Justice David Wilmot** determined to hunt out some of this lynch mob he could make an example of, not disdaining to resort to arm-twisting and witness-buying.† Wilmot’s advertisement for leads drew anonymous threats, which the justice scornfully published in newspapers to up the ante.

The writers of these letters … [are] pursuing with insatiable & heart felt revenge, their designs against you should any one person suffer from your busy concern. & know farther that having such connections at all your haunts, and free access at most time to your person, ’til not the whole third regiment of guards that can protect you from the well concerted plan for your destruction.

The result was a chaotic five-day trial, at which witnesses openly flinched at the prospect of popular vengeance waiting outside the Old Bailey doors.

Henry Stroud, nevertheless, was identified by several witnesses as having taken a prominent part in visiting popular justice upon Clark, in the form of two or three hurled bricks that knocked the victim down — while Robert Campbell was reputed to have thrust the bloodied Clark’s head into the pool.

They were pointedly put to death behind a heavily armed cordon near the very spot of the homicide. Stroud, at least, went to his death still vigorously protesting his innocence.‡

“Thus did the alternating pageants of ritual murder come to an end,” writes Peter Linebaugh of this exclamatory execution in The London Hanged. “A hundred bayonets from the War Office protecting the hangman and the magistrates. The scapegoating of the class antagonism concluded with this powerful, official display of power in the streets, where usually the trill of [weaving] shuttles would fill the air.”

** Not to be confused with Justice Wilmot, then the sitting Chief Justice of the Common Pleas. Justice David Wilmot’s credentials from this affair and otherwise established him as a hated enemy of the London working class, and consequently his home was torched during the proletarian Gordon Riots.

† viz., testimony of one witness among the several in the Old Bailey transcript who openly discuss payola: “another gentleman offered me fourscore pounds; a gentleman that brought me the summons; he said, you know one Bob Campbell; I said, I did not by name; he said, he would give me fourscore pounds; I was frightened, he said, I see you are a stranger; if you will but swear to the man I will give you fourscore pounds.”

1883: Heinrich “Henry” Furhmann, oldest hanged in Montana

On this date in 1883, Heinrich “Henry” Furhmann was hanged in Helena in the then-territory of Montana. He was the first person hanged in that city, and at seventy years old, the oldest person ever executed in Montana.

A non-English-speaking German national who walked with a cane, Furhmann was tiny. There was even speculation that at less than 100 pounds, he didn’t weigh enough to stretch the rope.*

Furhmann was executed for the murder of his son-in-law, Jacob Kenck, whom he’d shot three days before Christmas the previous year. While Kenck was standing in the doorway of his saloon on upper Main Street, talking to another man, Furhmann walked up to him from behind and shot him in the head.

The victim collapsed immediately, but didn’t seem to realize what had happened: as a crowd gathered around him, he said, “Boys, what is the matter? Is somebody hurt?” He passed out and was carried home, where a doctor was summoned to tend to his wound.

Furhmann was arrested immediately and, when told Kenck might survive, said he was sorry and would kill him again if he could.

But Furhmann’s disappointment didn’t last long: Kenck died within hours.

The old man had moved to Montana from his native country a decade before, after his daughter, who had emigrated before him, raised the money for his passage. She sickened and died several years after his arrival and Furhmann blamed her husband, Kenck, and nursed a bitter grudge against Kenck the way Kenck hadn’t nursed his late wife back to health.

After the emigre’s arrest he admitted he’d been plotting the murder for a year and had been carrying a gun everywhere he went, waiting for his chance.

News of the murder rocked the community, and that night a crowd gathered in front of the jail. Tom Donovan, in his book Hanging Around The Big Sky: The Unofficial Guide to Lynching, Strangling and Legal Hangings of Montana says they were a mixed lot: “interested citizens trying to maintain law and order as well as angry members of the community who wanted to take care of business, with a sprinkling of curious folks wanting to see how it would all turn out.”

There was quite a lot of shouting, but no actual attempt to storm the jail, and eventually the mob dispersed. The curious, perhaps, went home disappointed.

Given the fact that Furhmann shot the victim at literal high noon on literal Main Street in front of witnesses, it’s surprising that the jury deliberated a full 24 hours before convicting. When jurors returned with the condemnation — after it was translated for the defendant — he responded indifferently, “It is what I expected.”

He didn’t hope for clemency, just for the more-honorable death of a firing squad. Nein!

Furhmann died with a smirk on his face. His last words, referring to Jacob Kenck’s brother, were, “Now Chris Kenck will laugh.”

After his death, doctors removed and examined his brain, which turned out to be of average size and perfectly ordinary in appearance.

* Not that it was being used in Big Sky Country, but the classic drop tables/formula would potentially imply a fall of more than three meters to develop the necessary force to break such a slight man’s neck.

1889: Alfred Schaeffer, diabolical dynamiter, lynched near Seattle

From the Chicago Daily Inter Ocean, January 8, 1889 (paragraph breaks added for readability: the original had none at all):

A DIABOLICAL DYNAMITER.


After Killing Three Persons and Wounding Others He Is Barbarously Lynched

SEATTLE, Wash. T., Jan. 7. — Alfred Shaffer [sic], a Bohemian, fired a heavy charge of giant powder under the house of George Bodala, at Gilman,* thirty miles east of Seattle, at 4:30 o’clock this morning, instantly killing John and Michael Scherrick, and Anna, the 9-year-old child of Bodala, and badly wounding Bodala, his wife, and little son and daughter.

Last spring Bodala caused the arrest of Schaeffer on the charge of criminal assault upon his wife. Schaeffer was sentenced to a short term of imprisonment, and when he was released he made such serious threats against the life of Bodala that he was again arrested, and incarcerated in jail nine days.

When he was released he returned to Gilman, and since then he lost no opportunity attempting to injury Bodala, and this morning put his threats into execution. The two Scherricks and the little girl were instantly killed.

Bodala was brought to the Providence Hospital to-day, and is in a very bad condition. The other three will probably recover. Schaeffer was found by the people of Gilman at his own house. He was placed under arrest, and later in the afternoon, upon the arrival of the sheriff, turned over to that officer.

This afternoon while the Sheriff was at dinner a crowd of 100 broke open the door of the house where Schaeffer was confined, took him to a tree opposite the railroad depot, and strung him up, first trying to make him confess.

He refused, and was hanged.

After thirty seconds he was cut down again and given another chance to confess, still declining he was again elevated and cut down for a second time after forty-five seconds.

He was then very weak, and, efforts to make him confess failing, he was again pulled up, and left hanging until death ensued.

1600: The corpses of John and Alexander Ruthven, for the Gowrie conspiracy

Remember, remember, the fifth of … August?

If you didn’t get August 5 off, your jurisdiction is ignoring the Scottish parliament’s 1600 decree: “in all times and ages to come the fifth of August should be solemnly kept with prayers, preachings, and thanksgiving for the benefit, discharging all work, labour, and other occupations upon the said day.”*

They didn’t mean to keep it out of excess reverence for St. Emygdius: rather, August 5 was the date of the Gowrie conspiracy, a sketchy supposed assassination attempt on King James VI of Scotland (soon also to become King James I of England). John Ruthven, Earl of Gowrie and his brother Alexander Ruthven were both slain on the spot during that event … but not until 15 weeks later did Parliament rule that “the said bodies of the said Traitors shall be carried, upon Monday next [i.e., November 17], to the publick cross of Edinburgh: and there to be hangd, quarter’d, and drawn, in presence of the hail People: and thereafter, the heads, quarters, and carcasses, to be affix’d upon the most patent parts and places of the Burroughs of Edinburgh, Perth, Dundee and Stirling.”

Did they deserve it?

Scottish writer John Prebble considered the Gowrie conspiracy one of his realm’s best mysteries. It’s a maddeningly perplexing sequence of ambiguous (or altogether dubious) events related by interested, partisan sources.

I am murtherit!

The summary official version — and we’re skipping over such writerly red herrings as a mystery man in the turret, a still-stabled horse, and a wild fable about a pot of foreign gold — is that while staying at the Ruthven estates, James’s courtiers saw him shouting out the window, “I am murtherit! Treassoun! My Lord of Mar, help! help!”

While Lord Mar and others spent half an hour (!) trying to batter down a locked entrance to the regicidal turret, a page named John Ramsay found another staircase in, where he came upon the king and Alexander Ruthven grappling. Ramsay stabbed Ruthven about the head and neck, and Ruthven fled down Ramsay’s same staircase: there he careened headlong into more arriving royal retainers who killed him flat. Ruthven died exclaiming “Allace! I had na wyte [blame] of it!”

Meanwhile, the Lord Gowrie — quite possibly knowing nothing but that there was a commotion involving the king in his home — had rallied outside the courtyard with his own household and marched in swords drawn, passing the fresh-slain body of his little brother on the way. He must have been in an evil temper when he burst into the chamber, there to discover Ramsay and friends, and only them: the king had been locked in another room for his protection. Ramsay demanded Gowrie’s submission and the two crossed swords, with Ramsay running the elder Ruthven through, too.

(Small wonder Ramsay went on to become a royal favorite.**)

“… if it be true”

“A very wonderful story, your Majesty, if it be true,” one lord is supposed to have replied to James upon hearing this amazing tale.

Suspicion was immediately rife that this “treason” stuff was a cover for the king to take out a rival noble. The Ruthvens had often been at odds with King Jamie’s own family; John and Alexander’s own father was beheaded in 1584 for trying to kidnap the then-teenaged king, and their grandfather had helped a gang of nobles destabilize James’s mother Mary by murdering her favorite courtier David Rizzio right before her eyes. And of course, the crown would be able to seize all the “traitors'” estates, nicely flipping around a significant cash debt owed to the Ruthven clan.

Edinburgh Presbyterian ministers openly disputed the Ruthvens’ guilt, refusing to thank God for James’s “deliverance”.† James found it necessary to forcibly quash this talk, and he would insist upon the Ruthvens’ guilt all his days. But those outside the reach of Scottish royal power had looser tongues.

French nobles who had met Gowrie on the latter’s recent return from his continental studies, and Queen Elizabeth, who had received Gowrie warmly at court, openly doubted the official account: it was thought wildly at odds with the young man’s character. The nature of the interaction between the king and Alexander Ruthven prior to the intervention of John Ramsay depends upon the account of the king himself — that account, and no other. The other witnesses were dead. And the object of the plot seems unclear: sure, maybe Alexander Ruthven could have killed the king mano a mano, but then what? There was no indication at all of confederates (even Alexander’s brother reacted in confusion), nor coherent design for some next step like massacring James’s courtiers or toppling the government or even escaping. These were scheming aristocrats, not deranged lone assassins. And both James and Gowrie had behaved for all the world before this incident as if the unpleasantness with the father was water under the bridge.

“The assassination of the Gowries was the most indefensible act that has ever appeared on the pages of Scottish history,” avers mildy a 1912 volume of the Ruthven family papers. It was “a cunning conspiracy that has disgraced the historical record for more than three hundred years.”

The jury’s still out

Still, the hypothetical account of a royal anti-Gowrie conspiracy seems if anything even less satisfying than the official story. Most of the happenings besides what passed between Alexander and James were witnessed by others, so … the king falsely yelled “treason” counting on the handful of his guys staying in the Ruthvens’ own place to kill the Ruthvens instead of the other way around? Events played out so chaotically that this convenient outcome seems mere [mis]chance. What was the plan if John Ramsay hadn’t found the unlocked second entrance?

And yet some 350 witnesses were examined without turning up any concrete design, and three Ruthven retainers hanged on August 23 insisting upon their innocence of any treasonable intent.

One can go a lot of ways from here, and it’s hard to spin any one story that satisfyingly accounts for all the evidence. A scheme to kidnap (and extract policy change from) the king, rather than murder him? Alexander an unwilling pawn, forced into it by his brother? Or, as one English envoy supposed, a destructive spiral of events proceeding from a silly misunderstanding wherein a chance reference to the Ruthvens’ executed father led Alexander to defend the family a little too hotly and the king to start shouting in panic when he realized he was unarmed in the company of an excited, and much larger, man?‡

We’ll never really know. Light a candle for epistemological uncertainty next August 5.

* August 5 was indeed “solemnly kept” during the reign of James, according to F.C. Eeles in “The English Thanksgiving Service for King James’ Delivery from the Gowrie Conspiracy” from the July 1911 Scottish Historical Review. As the title of that piece suggests, there was even a service promulgated (though never incorporated into the Book of Common Prayer), beseeching God that James “may bee kept as the apple of thine eye, and thy kindnesse and mercy may follow him all the dayes of his life, with abundance of all thy blessings both heavenly and earthly upon his Majesty, our gracious Queene, the Prince …”

The Prince in question was the future King Charles I, which might cause one to doubt the prayer’s efficacy.

** Ramsay would be supplanted in the royal sun come the 1620s, by George Villiers.

† Religion affords another potential motivation here, although perhaps only retrospectively. James was working a long-term project to reintroduce episcopacy — crown-appointed bishops — to control the loose canons of Scotch Presbyterianism. “No bishop, no king,” in the aphorism attributed him.

With the Gowrie plot as backdrop, James was able to force radical ministers and their tin-foil hats out of Edinburgh and obtain the consent of the rest to James’s own hand-picked bishops — the camel’s nose under the tent, if you like. (See Maurice Lee, Jr., “James VI and the Revival of Episcopacy in Scotland: 1596-1600,” Church History, 43 (1974).) The Ruthven family papers volume also sets great stock by the idea that a Catholic party was out to get Lord Gowrie.

1642: Henri Coiffier de Ruze, Marquis of Cinq-Mars

On this date in 1642, with the last words “Mon Dieu! Qu’est-ce que ce monde?”, 22-year-old former royal favorite Cinq-Mars was beheaded at Lyon’s Place des Terreaux.

Henri Coiffier de Ruze (English Wikipedia page | French) had been under Cardinal Richelieu’s protection since the boy’s father died in 1632; in 1639, the Red Eminence introduced the then-19-year-old whippersnapper to Louis XIII as a prospective royal favorite (read: lover).

Though the king did indeed take to the youth, Cinq-Mars, in the age-old custom of sullen teenagers everywhere, soon found the luxurious profligacy of the favorite’s life rather overbalanced by irritation at both of his sickly, aging patrons.

Tart talk to intimates graduated to something more serious after Richelieu rudely put the kibosh on Cinq-Mars’s (unrealistic) designs on a wealthy noblewoman — which was also a bid to parlay his tenuous favorite gig into some lasting power.

Now considering himself personally begrudged of the Cardinal, Cinq-Mars fell into the conspiracies (French link) to depose, assassinate, or otherwise replace him.

Eventually Cinq-Mars would go so far as a real blockbuster (French again): he signed a secret pact with the Spanish king to support a noble revolt in exchange for handing over French possessions, a seditious plan also backed by perennial plotter Gaston d’Orleans, the king’s scheming brother.

Our angry moppet had more than met his match in Richelieu, however: the cardinal’s agents intercepted (more French) the treasonable correspondence and had Cinq-Mars dispatched this date along with his confederate de Thou.

Richelieu himself was already dying as he undid this last conspiracy against him. The cardinal succumbed on December 4, 1642 … with Louis following him into the grave the next May.

While Richelieu’s name is fixed in the firmament of history and literature, Cinq-Mars has to make do as the namesake of a rarely-seen Gounod opera, based on the 1826 historical novel Cinq-Mars by Alfred de Vigny.

1831: Julien Sorel, in The Red and the Black

According to Michel Crouzet,* literary scholar of Stendhal, it was on this date in 1831 that the protagonist of said French author’s magnum opus was guillotined.

“Everything passed simply, decorously, and without affectation on his part,” is the entirety of Stendhal’s death scene for his man.

Julien Sorel, the flawed (or anti-) hero of The Red and the Black (Le Rouge et le Noir), is the intelligent son of a provincial carpenter who puts his wits to use trying to climb Restoration France’s treacherous social ladder.

Ambition, says Stendhal, is “the very essence of his existence,” much as it is for his milieu, and through Julien’s exertions — brilliant and resourceful at times; infuriatingly handicapped by social prejudice against the protagonist’s low birth at others — the author sets down one of the most psychologically forceful works in the canon.

Julien Sorel’s ambition also powers his youthful passion, and his fall: to conquer the mother of the children he tutors, and to likewise conquer the daughter of a nobleman.** This latter conquest has him a made man, married into the aristocracy and set with a plum military assignment that has Julien dreaming of Napoleon … so when the spurned former conquest denounces Julien to the father of that latter conquest as an upstart seducer cynically shagging his way into decent society, the incensed Julien hauls off and shoots that previous conquest. (As she kneels at Mass, no less.)

Is it a mere jealous fit? Even though his victim survives the attack, and forgives her lover, Julien obstinately pleads guilty, and insists on his own maximum culpability. It’s not only an individual criminal culpability, but a culpability of class aspiration.

‘I ask you for no mercy,’ Julien went on, his voice growing stronger. ‘I am under no illusion; death is in store for me; it will be a just punishment. I have been guilty of attempting the life of the woman most worthy of all respect, of all devotion. Madame de Renal had been like a mother to me. My crime is atrocious, and it was premeditated. I have, therefore, deserved death, Gentlemen of the Jury. But, even were I less guilty, I see before me men who, without pausing to consider what pity may be due to my youth, will seek to punish in me and to discourage forever that class of young men who, born in an inferior station and in a sense burdened with poverty, have the good fortune to secure a sound education, and the audacity to mingle with what the pride of rich people calls society.

‘That is my crime, Gentlemen, and it will be punished with all the more severity inasmuch as actually I am not being tried by my peers. I do not see, anywhere among the jury, a peasant who has grown rich, but only indignant bourgeois …’

* The date is not explicit in the text. The Red and the Black was subtitled Chronique de 1830, but several past-tense allusions to the event show that the main action takes place after the July Revolution of 1830 that toppled Charles X and raised Louis-Philippe to the throne. There is, however, a late and seemingly anachronistic allusion to Julien’s lover/victim intending to “throw herself at the feet of Charles X” to appeal for his life. Oh well: ambiguity is the novel’s stock in trade.

1721: Cartouche, French bandit

On this date in 1721, the French outlaw Cartouche was broken on the wheel in Paris.

Your basic superstar robber during that archetype’s golden age, Louis Dominique Garthausen, aka Bourguignon, aka Cartouche was the son of a German mercenary-turned-French wineseller.

Little Cartouche — his nickname came from a Francophone corruption of his German surname — distinguished himself from childhood as the most charismatically intrepid of the local hooligans, and by adolescence was already the leader of a troupe of rascally thieves.

By his twenties, after a detour through the army, Cartouche and his merry men (the Cours des Miracles gang, after the slum they operated out of) were raiding the lucrative Versailles-Paris route, plundering the virtue of marchionesses, distributing stolen booty the poor, maintaining perfect courtesy in the society of gentlemen, and generally becoming the heroes of that species of literature that revels in bodice-busting sybaritic rakes who play by their own rules but have a heart of gold. (Sample escapade: walking a carnival parade with a cart full of police effigies — whipping them all the way, to the glee of the crowd. Thackeray celebrates more Cartouche folklore here, like the time he robbed as part of a threesome, talked one accomplice into murdering the other in order that the two survivors should have greater shares of the spoils to divide — only to round self-righteously on the killer once his pistols were safely discharged and gun him down in turn with the words “Learn, monster, not to be so greedy of gold, and perish, the victim of thy disloyalty and avarice!” That’s a pretty good one, whether it really happened or not.)

The flesh-and-blood police started to roll up this group around 1719, turning arrestees into informants and hunting ringleaders to ground. True to character, Cartouche defied with his liberty the growing price on his head, deftly giving gendarmes the slip until a confederate betrayed him into his enemies’ hands literally while his pants were down.

The guy very nearly broke out of prison — tunneling out of a dungeon of the Chatelet into a neighboring basement, only to have the clank of his chains rouse the family dog into a woofing frenzy that betrayed him before he could vanish out the front door. But even back in the clink,

came a period of splendid notoriety: he held his court, he gave an easy rein to his wit, he received duchesses and princes with an air of amiable patronage … His portrait hung in every house, and his thin, hard face, his dry, small features were at last familiar to the whole of France. M. Grandval made him the hero of an Epic — “le Vice Puni.”

Cartouche was doomed to breaking on the wheel after a morning suffering the tortures of the boot in an unavailing effort to extract further incriminations from the rogue.*

Cartouche seems to have fully expected his troupe to reciprocate this heroism by rising to the dramatic occasion of a rescue from the very scaffold. But as the prisoner arrived at the Place de Greve, he perceived at last that like Christ he had been abandoned at the critical hour by the men who had sworn oaths with him. The great desperado’s final act was to retaliate upon these faithless friends (and family!) by taking aside his prosecutors and detailing his every accessory in crime, even his lovers. What the worst extremities of medieval torture could not procure from him, the compelling incentive of revenge instantly conjured.

Our hero went to his death this day but his revenant spirit stalked France for many months thereafter as dozens succumbed (pdf) to Cartouche’s scaffold indictment. One diarist recorded the following July,

Nothing but hangings and breakings on the wheel! Every day some Cartouchian executed.

* Available sources are flatly contradictory between the story that Cartouche was to die on the 27th and his confessions stalled things until the 28th, or was to die on the 28th all along, or was to die and did so on the 27th.

1814: Mary Antoine, jealous lover

On this date in 1814, while the nation as a whole was consumed by the War of 1812, Mary Antoine stopped for death at the Peterboro, N.Y. gallows.

We’ve already met Mary’s father in these pages. The old man would outlive his child, which no parent ought to do, but he made it up to her by the way he checked out.

The two cases are closely related. The father killed one John Jacobs, a half-breed, because he had been the chief witness against his daughter. The daughter allegedly killed a “female” who had “alienated her husband’s affection.” Despite public sympathy being associated with the Indian Abram, the law was obliged to take its course. (Source)

1778: James “Sandy Flash” Fitzpatrick

On this date in 1778, Revolutionary War-era bandit James Fitzpatrick was hanged — very badly — at Chester, Pennsylvania.

Fitzpatrick was then, and still is now, a legendary character in Chester County. He’s better known as “Captain Fitz” or, with a bit more flair, “Sandy Flash”.

Born to Irish immigrants in Chester, Fitzpatrick joined up with the Continental Army when the Revolutionary War broke out.

But after being subject to the commonplace but brutal punishment of flogging for some failure of military discipline, Fitzpatrick deserted, swimming off Long Island in the dead of night and eventually returning home. There, he was recognized as a deserter and clapped in jail until he agreed to fight again.

All this built up a terrific grudge in the young man’s heart, and he “agreed” just long enough to get out from behind bars and abscond again. After warding off yet another press gang sent to retrieve him, Fitzpatrick vengefully took to the road.

This was not necessarily out of bounds for Fitzpatrick’s milieu. As detailed by Rosemary Warden (“‘The Infamous Fitch’: The Tory Bandit, James Fitzpatrick of Chester County,” Pennsylvania History Summer 1995):

Fitzpatrick’s bold outlawry must be seen against the background of many Chester Countians’ lack ofsupport for the Revolution, ranging from passive neutrality to outright loyalism. Forty percent were Quaker, settled most heavily in the eastern township. Only a small number actively supported the Revolution or the British cause … Fitzpatrick’s two favorite targets, militia recruiters and tax collectors, often met violent opposition in Chester County during this period, and not always from loyalists …

It is not surprising that revolutionary General Anthony Wayne wrote to Council President Thomas Wharton in the spring of 1778, to suggest that he stop recruiting troops in Chester County, a wasted effort, and concentrate on raising men in Berks, Lancaster, York, or Cumberland Counties. Nor is it surprising that a loyalist bandit who particularly targeted militia officers would find clandestine support and safe hideouts in Cheser County.

Playing to the hilt the part of “Tory highwayman,” Captain Fitz targeted Chester County Whigs, and especially agents of the revolutionary government. And he did not neglect the opportunity to inflict with the flog the suffering he had once endured himself. Still,

Despite his many crimes, there was a rough chivalry in the character of the man which exhibited itself in his marked gallantry towards women, in his open, generous disposition to aid them on when ill fortune bore heavily; indeed, he was never known to rob a poor man or ill-treat a female. Many are the instances related when he bestowed upon the destitute that which he had taken from those in good circumstances, and the weak or defenseless never suffered at his hands. On one occasion an old woman, who made a meagre living by peddling from house to house odds and ends of female apparel, encountered Fitzpatrick in the neighborhood of Caln Friends’ meeting-house. She was at the time on her way to Philadelphia to buy goods, and all the money she possessed was on her person. She had never seen Capt. Fitzpatrick, and she informed, the tall, handsome stranger that she was told that the outlaw had made some demonstrations in that neighborhood a short time before, and she was afraid that she might fall in with him and be robbed of all her money. Fitzpatrick, by a few questions, drew from her the particulars of her business, and her difficulty in winning an honest livelihood. He then good naturedly told her she need be under no apprehension, Fitzpatrick never warred upon the weak or defenseless, that she was talking to that personage; and taking a purse from his pocket containing several gold pieces, he gave it to her to aid her in increasing her scanty stock of goods. Then, wishing her a safe journey, he turned into the woods and disappeared.

What a guy.

His prey among the Whig well-to-do not being constrained to treat Fitz with any similar measure of gallantry, the bandit was at length captured when, in the course of raiding a household, he briefly set down his weapons — and his hostages jumped him. (The hostages in question had an argument with each other afterwards over who should get the reward.)

“Sandy Flash” is a prominent character in Bayard Taylor‘s portrait of revolutionary Pennsylvania, The Story of Kennett, where, Turpin-like, he’s “transformed” (the author’s own words) “from a living terror into a romantic name.” Here, Bayard dramatizes an allegedly real exploit, in which Fitzpatrick boldly presents himself at a public inn* where a posse hunting him has holed up.

All eyes, turned towards the crossing of the roads, beheld, just rounding the corner-house, fifty paces distant, a short, broad-shouldered, determined figure, making directly for the tavern. His face was red and freckled, his thin lips half-parted with a grin which showed the flash of white teeth between them, and his eyes sparkled with the light of a cold, fierce courage. He had a double-barrelled musket on his shoulder, and there were four pistols in the tight leathern belt about his waist.

Barton turned deadly pale as he beheld this man. An astonished silence fell upon the group, but, the next moment, some voice exclaimed, in an undertone, which, nevertheless, every one heard,—

“By the living Lord! Sandy Flash himself!”

There was a general confused movement, of which Alfred Barton took advantage to partly cover his heavy body by one of the porch-pillars. Some of the volunteers started back, others pressed closer together. The pert youth, alone, who was to form the third party, brought his musket to his shoulder.

Quick as lightning Sandy Flash drew a pistol from his belt and levelled it at the young man’s breast.

“Ground arms!” he cried, “or you are a dead man.”

He was obeyed, although slowly and with grinding teeth.

“Stand aside!” he then commanded. “You have pluck, and I should hate to shoot you. Make way, the rest o’ ye! I’ve saved ye the trouble o’ ridin’ far to find me. Whoever puts finger to trigger, falls. Back, back, I say, and open the door for me!”

Still advancing as he spoke, and shifting his pistol so as to cover now one, now another of the group, he reached the tavern-porch. Some one opened the door of the barroom, which swung inwards. The highwayman strode directly to the bar, and there stood, facing the open door, while he cried to the trembling bar-keeper,—

“A glass o’ Rye, good and strong!”

It was set before him. Holding the musket in his arm, he took the glass, drank, wiped his mouth with the back of his hand, and then, spinning a silver dollar into the air, said, as it rang upon the floor,—

“I stand treat to-day; let the rest o’ the gentlemen drink at my expense!”

He then walked out, and slowly retreated backwards towards the corner-house, covering his retreat with the levelled pistol, and the flash of his dauntless eye.

* Specifically, the Unicorn, a patriotic tavern. Filed under “small world”: this pub was owned by Joseph Shippen, the uncle of the woman who would marry soon-to-beturncoat Benedict Arnold.
