1845: John Tawell, the man in the Kwaker garb

On this date in 1845, John Tawell was publicly hanged in Aylesbury (while broadsheets were hawked beneath the scaffold to the crowd of thousands) for the murder of his mistress — making history as the first criminal apprehended with the use of the telegraph.

Tawell had had an interesting 60-plus years on the planet. He did well as a young banker on the make to avoid the halter for the capital crime of forging banknotes.*

In those sanguinary days of our penal code, this crime, if brought home, would have led to his certain condemntion and ignominious execution as a felon. The particulars of the affair were, however, suppressed as far as possible, on account of the insuperable disinclination of the bankers to be in any way instrumental in taking away human life.**

Clapped in irons and sent to Australia, he waxed wealthy — “by his fortunate, and, it is to be presumed, honest trading,” our wry biography remarks. (As a pharmacist. That’s what we in the biz call “foreshadowing.”)

Tawell returned to England in 1831, got Sarah Hart as a bit on the side (she’d initially been hired to nurse Tawell’s dying wife), and then married a respectable Quaker woman. To conceal the affair — or perhaps because the payola Tawell was obliged to send for the maintenance of his mistress and the kids he begat with her was chewing into his straitened finances — Tawell poisoned Hart on New Year’s Day 1845.

Unfortunately for him, he was noticed leaving the scene of the crime by a neighbor, who found the victim before she had even expired.

Tawell had hopped a slow train for London ahead of apprehension, but it transpired that the station had installed the newfangled telecommunications device, the telegraph, which was requisitioned to dispatch to Paddington station a famous missive.

A murder had just been committed at Salt Hill and the suspected murderer was seen to take a first class ticket to London by the train that left Slough at 7.42pm. He is in the garb of a Kwaker with a brown great coat on which reaches his feet. He is in the last compartment of the second first-class carriage.

(This landmark police event is not to be confused with the first use of wireless telegraphy to apprehend a criminal — the next century’s very similar philandering-apothecary-on-the-lam case of Dr. Crippen.)

Caught, convicted,† condemned. (And confessed, secretly, to the prison chaplain.) The usual. Botched strangulation hanging. Hardly unusual. Love triangle murder? Downright trite.

But still: Tawell’s strange and variegated life left a strange and variegated legacy. (pdf)

In Australia, the memory of Tawell lingered for many years after his death because considerable legal argument took place about the validity of the Crown’s hndling of his property there. The Governor, Sir William Denison, affixed the Great Seal of the colony to the grant documents on his own initiative, which creted a serious difference between him and his chief minister. Known as the “Great Seal case”, it dragged on for some 16 years before it was resolved. It provided a dramatic epilogue to Tawell’s activities.

John Tawell had pharmacy qualifications of a sort, and he was no better or worse than many of the doctors around Sydney at the time who had received no regular professional instruction. When Tawell ventured into competition with the medical establishment in the colony it was a huge gamble because until 1820 many government doctors saw private patients and had clerks to do their dispensing, usually from hospital stores. He showed that independent pharmacy could thrive away from the medical shadow, but the commercial nature of his success also showed that the founding of independent pharmacy in Australia occurred as a retailing activity rather than as a needed profession.

* As a teen, Tawell was friends with a Quaker linen-draper who was himself ultimately executed for forgery, Joseph Hunton.

** This claim for bankers’ gentility is advanced in the context of the story of a banker who in fact went on to commit murder. Aside from that obvious paradox, it will come as no surprise to any denizen of the post-bailout neoliberal era that bankers proved more than ready to involve themselves in human misery, sufficiently remunerative. If Tawell’s sweetheart plea bargain reveals anything about the financier class, it’s that bankers aren’t keen on precedents for taking away bankers’ lives.

† John Tawell’s trial lawyer, the eminent jurist and politician Sir Fitzroy Kelly, disputed the coroner’s poisoning conclusion by arguing that Sarah Hart might have just eaten too many apple seeds. (Prussic acid, aka hydrogen cyanide, does occur naturally in many fruits.)

This attempted Chewbacca defense earned the barrister the nickname “Apple-pip Kelly”. However, since the cutting-edge technology of the day was only telegraph and not Twitter, the case does not appear to have launched any of Apple-pip Kelly’s progeny into lucratively pointless careers as famous-for-being-famous socialites.

1994: Andrei Chikatilo, the Butcher of Rostov

On this date in 1994, Ukrainian serial killer Andrei Romanovich Chikatilo was shot dead in a soundproof room in Novocherkassk, Russia, for a stupendous serial murder spree in the 1980s USSR.

The quintessential case study in anonymous middle-aged melancholy turned larger-than-life horror, the sexually dysfunctional Chikatilo raped, murdered and mutilated dozens in a homicidal career beginning at the unusually late age of 42.

After that initial foray into rape-murder in 1978, three years passed before the factory clerk (molestation allegations had drummed him out of teaching in the interval) began his harvest of 50-plus victims: children and teenagers of both sexes, and young adult women.

In addition to the staggering body count, the murders of the “Rostov Ripper” were marked by orgiastic savagery: breasts severed, eyes gouged out, genitalia mutilated and even eaten, and bodies lacerated with scores of stab wounds.

Like many monsters, he was also, as much as his more well-adjusted fellows, a creature of his own time and place.

Chikatilo was a socially maladjusted child in part due to his father’s capture by the Germans during World War II, subjecting the family to the postwar ostracism that awaited returning POWs. (Some sources also say Chikatilo saw his mother raped by German soldiers.)

The part of his life for which he’s most famous, meanwhile, drew out into a years-long bloodbath even though he was a suspect from the very first murder — a crime for which another man was wrongfully executed. Sclerotic bureaucracy and investigative cock-ups hobbled the police effort throughout, a sort of criminological emblem of the Soviet Union’s twilight. Authorities were loathe to involve the public by admitting the presence of a serial killer, a type officially associated with bourgeois society.

Chikatilo was arrested once in 1984 carrying a Bundy-esque murder kit, but authorities couldn’t make anything stick (Chikatilo’s Communist Party membership helped); another officer stopped him leaving the forest where bodies turned up, but didn’t search the satchel which contained his most recent victim’s severed breasts. Chikatilo was investigated early on, but ruled out as a suspect because of a blood type mismatch between his blood and crime-scene semen — apparently the result of a rare biological anomaly that (combined with authorities’ outsized confidence in forensic detection) bought him years of killing and involved thousands more suspects before investigators finally circled back to Andrei Romanovich.

Even at his last arrest, investigators who knew they had their man nearly let him slip away because they couldn’t charge him within 10 days — finally cajoling a confession and the killer’s cooperation at nearly the last possible hour.

According to Cannibal Killers, the Chikatilo task force solved 1,062 unrelated crimes, including 95 murders, while puzzling out the Rostov Ripper.

1823: Dr. Edme Castaing, the first to kill with morphine

On this date in 1823, French physician Edme Castaing expiated upon the scaffold history’s first conviction for murder with morphine.

The good doc used the drug, a new twist on an ancient remedy only recently brought to market, apparently to poison off one of two wealthy brothers with the connivance of the other wealthy brother, the latter of whom stood in danger of being disinherited.

And then, the beneficiary of that crime wrote a will of his own to the profit of the poisoner.

Do not try this at home.

Castaing, naturally, poisoned off the other brother, too, and relieved some considerable financial distress along with, one must think, the burdensome company of a complete dullard.

The science of toxicology,” however, “was not greatly advanced at this time, and … the above conclusion was based on presumption rather than fact.”

While today, such a case might be ripped from CSI, in 1823 it entailed an uncertain trial with varying (and wrong) medical testimony and a circumstantial trail of witnesses drawing flailing rebuttals from the accused that ran towards the unconvincing and the contradictory. Quite convicted in the public eye (a verdict history has had little cause to revisit), Castaing was judicially acquitted of the murder of Hippolyte Ballet, and doomed by the barest 7-5 majority verdict for the second Ballet boy. The London Times complained in its report of the execution (printed Dec. 9, 1823), that

[t]he faculty speak in very harsh and unmeasured terms of Dr. Pellatan, who neither described with care and accuracy, what he himself observed on opening of the body of Ballet, nor gave them the means of forming an opinion themselves, by bringing to Paris the intestines of the deceased. The physicians join the rest of the world in ascribing Ballet’s death to substances administered by Castaing, but they regret that criminal justice could not, owing to the neglicence or ignorance of Pellatan, obtain more satisfactory proofs of the crime. Beyond his own confessions, contradictions, and admissions, there was confessedly no ground to convict him.

A few years later, Victor Hugo (we keep meeting him here) had the title character in “The Last Day of a Condemned Man” occupying Castaing’s former cell, and evidently thought the matter possessed sufficient notoriety to name-check the headless poisoner decades afterwards in Les Miserables.

1666: Robert Hubert for the Great Fire of London

On this date in 1666, a hapless French watchmaker was hanged at Tyburn for starting the Great Fire of London — his obstinate confession in the face of all other evidence making him the convenient fall guy for an accidental cataclysm.

Of Robert Hubert Lord Clarendon would write,

though the Chief Justice told the King, ‘that all his discourse was so disjointed that he did not believe him guilty;’ nor was there one man who prosecuted or accused him: yet upon his own confession … the jury found him guilty, and he was executed accordingly. And though no man could imagine any reason why a man should so desperately throw away his life, which he might have saved, though he had been guilty, since he was only accused upon his own confession; yet neither the judges, nor any present at the trial, did believe him guilty, but that he was a poor distracted wretch weary of his life, and chose to part with it this way. Certain it is, that upon the strictest examination that could be afterwards made by the King’s command, and then by the diligence of Parliament, that upon the jealousy and rumour made a Committee, who were very diligent and solicitous to make that discovery, there was never any probable evidence, (that poor creature’s only excepted,) that there was any other cause of that woeful Fire, than the displeasure of God Almighty.

Was London lucky to have the Great Fire?

Yes, I suppose so. Lots of people have sort of argued that London missed an opportunity to make more changes, but they just didn’t have the money to do them at the time.

There were a lot of improvements made. They widened the streets. The city was rebuilt in brick instead of wood, although that rule was in place from before 1666. The regulations were restated and extra ones were added in; a lot of people think that it was because of the Great Fire that people started building in brick, but that regulation already existed from earlier in the 17th century.

You’ve got acres and acres and acres of land that have been reduced to rubble during the Great Fire, and en masse, all these new buildings are going up. But yes, it made life more healthy & more pleasant in the city. You had pavement put in for the first time. All these little things you wouldn’t think of, like the houses had to have gassers for the first time, as opposed to just spouts that would spray water on you if you walked down the street. The Great Fire gave people the opportunity to get rid of all those inconveniences.

And they were able to do other things, like the slope down to the River Thames was quite steep, and they were able because of all the rubble to ease the slope.

How did it reshape London? What might have been different about the subsequent life of the city if it had never occurred?

Within days of the fire going out, various architects like Christopher Wren were supplying architectural plans to rebuild London, perhaps around an American grid plan, or European-looking piazzas.

What they really wanted to do was get people moving back into London and rebuilding their houses as quickly as possible, so they kept the medieval street plan and instituted new regulations, like the streets had to be widened, and they could no longer build the houses hanging into the street. The size of the house you could build was proportional to the size of the street you were on, so if you lived on a main boulevard instead of a small lane

Where’s the best place in London to catch a glimpse of that world, as it looked then?

It’s kind of a hidden thing because of course we were bombed in the Second World War, but there are places, like behind St. Paul’s Cathedral, in Amen Court.

So who is Robert Hubert?

He’s a French watchmaker from Rouen, and he was seized in Essex apparently attempting to flee the country. There were various other foreign people who were seized as well, but Hubert confessed to starting the fire.

But his evidence* was very conflicting; he kept changing his mind of what he’d done. He said he’d been part of 23 conspirators and put a fireball through the window of the bakery where the fire started. The baker himself said there wasn’t a window there.

The jury really thought that Robert Hubert was mad, but he was so insistent that he’d done it.

The following year, they discovered that he hadn’t actually arrived in London until two days after the fire started.

Lucky for the baker! He didn’t end up catching any blame for burning down the city?

Hubert was a very convenient scapegoat, and Thomas Farynor** of the bakery was incredibly relieved. Right from the start, Farynor had said “I put my oven out that night, it can’t possibly be me, it must be arson.”

I’ve had a little look at the records of Pudding Lane to see whether he rebuilt his house, and he did.

One of the interesting resources on your site deals with the going fear of “Catholic incendiarism” (pdf), and the use of the Great Fire as a touchstone for the succession conflicts of the 1680’s. Would it have been conventional wisdom by that time, a generation or so after the event, that the Great Fire was a Catholic plot?

It becomes all caught up in the contemporary politics of the time, so it’s really got nothing to do with the fire. It’s people not liking James II for being a Catholic. It’s the fictional Popish Plot, completely fabricated. It’s probably not a coincidence that at the height of the Popish plot that they put up the plaque on the side of the bakery saying that the Fire came from “the malicious hearts of barbarous Papists.”

Given the combustible material all about, why wasn’t something like the Great Fire a more regular occurrence?

There were six serious fires in the 17th century before the Great Fire happened; one of them was a great explosion of gunpowder.

Fires were sort of a common hazard. The thing about the Great Fire was that there was sort of a whole load of circumstances. There was a drought, so it was dry; there were storm winds coming in from the east, so it blew the fire on faster than it would have; it started at 1 o’clock in the morning, so people were in bed. I think the problem is that it’s all these circumstances combining together. Maybe if it happened at 3 o’clock on Monday when it was raining, it wouldn’t have gone beyond the block.

Logistically, how did the society and the state handle the mass homelessness and unemployment that followed? Where did all these people live right after the fire, and how smoothly were they reintegrated?

People were camping out in the fields outside of London; others were moving into areas that were unburnt but having to pay hugely inflated rents. Some people had to move into other towns. There was evidence that people were still living in shantytown tented accommodations up to eight years after the fire, because there’s another rebuilding regulation in the 1670s that addresses that.

In the first year after the fire, only 150 houses are rebuilt; the rebuilding happens over 10 years, though some houses took up to 30 years. Some people were in very desperate circumstances, so formerly very wealthy people who had lived off their rents might now be working as servants. People coped, a lot of times in reduced circumstances from what they were used to.

There was a particular man you can read about in Samuel Pepys’ diary, and he threw himself into a pond in an attempt to commit suicide because he was so indebted.‡

As curator of an exhibit, what do you hope visitors take away from London’s Burning?

One thing that I really wanted people to understand as they go around the exhibition is the effect on people. You learn about it at school, but you don’t really focus on how people cope and how they rebuild.

There’s also a lot of urban myths about the Great Fire, like the ‘fact’ that the fire is supposed to have ended the Great Plague, which is not the case (pdf); those are things we wanted to dispel.

Alexander Pope savaged this civic pamphleteering with the couplet,

Where London’s column, pointing at the skies,
Like a tall bully, lifts the head and lies.

Poets and elites might think what they like, but Lord Clarendon recorded a popular anti-foreigner freakout as England reached

a universal conclusion, that this Fire came not by chance … the wicked authors … were concluded to be all the Dutch and all the French in the town, though they had inhabited the same places above twenty years. All of that kind, or, if they were strangers, of what nation soever, were laid hold of; and after all the ill usage that can consist in words, and some blows and kicks, they were thrown into prison. And shortly after, the same conclusion comprehended all the Roman Catholics, who were in the same predicament of guilt and danger … In the mean time, even they [the King’s Privy Councilors], or any other person, thought it not safe to declare ‘that they believed that the Fire came by accident, or that it was not a plot of the Dutch and the French and Papists, to burn the City;’ which was so generally believed, and in the best company, that he who said the contrary was suspected for a conspirator, or at best a favourer of them. the story is that it seems on Thursday last he went sober and quiet out of doors in the morning to Islington, and behind one of the inns, the White Lion, did fling himself into a pond, was spied by a poor woman and got out by some people binding up hay in a barn there, and set on his head and got to life, and known by a woman coming that way; and so his wife and friends sent for. He confessed his doing the thing, being led by the Devil; and do declare his reason to be, his trouble that he found in having forgot to serve God as he ought, since he come to this new employment: and I believe that, and the sense of his great loss by the fire, did bring him to it, and so everybody concludes.

Although the man survived the drowning, he caught his death from the attempt and died in bed; Pepys intervened to see that the desperate suicide’s remaining estate would not be confiscated from his widow for his “self-murder.”

1986: The Stoning of Soraya M

It was on this date, according to French-Iranian journalist Freidoune Sahebjam’s The Stoning of Soraya M, that 35-year-old mother Soraya Manutchehri was stoned to death in an Iranian village.


In a scene from The Stoning of Soraya M, the titular character awaits her titular fate.

In Sahebjam’s telling, a journalistic trip to the Islamic Republic chances upon a mountain village with a terrible secret.

The story he uncovers features one Ghorban-Ali, nasty husband par excellence who grows tired of the arranged wife he’s spent 22 years beating and (falsely) accuses her of adultery in order to put her out of the way so that he can remarry a younger bride.

With the complicity of the local mullah, the impolitic silence of the accused, and the structural misogyny of the law, Soraya Manutchehri quickly finds herself condemned to death on this date, and stoned within hours — Soraya’s own father casting the first stones.

This powerful story, officially denied by Tehran, has just been released in cinematic form. The Stoning of Soraya M. (movie homepage) features an unsubtle dramatic tableau, a stomach-churning 20-minute stoning sequence, and Iranian-American actress Shohreh Aghdashloo as Soraya’s aunt Zahra Kahnum, fearlessly giving the foreign journalist this explosive story

As it happened, this cinematic condemnation of the reduced status of women in the Ayatollah’s Iran made its American debut the same week that cell phone footage of Neda Agha-Soltan, bleeding to death after being shot dead during protests against Iran’s recent election results, became an Internet sensation.

1628: Johannes Junius “will never see you more”

On this date in 1628 was burned in Bamberg (former) Burgomaster Johannes Junius, a civic official caught up in the frenetic witch-hunts of Bavaria in the Thirty Years’ War.

Fellow townspeople under torture accused him; Junius eventually did the same, copping to the stock stuff witch trials knew just how to use:

there had come to him a woman like a grass-maid … And thereafter this wench had changed into the form of a goat, which bleated and said, “Now you see with whom you have had to do. You must be mine or I will forthwith break your neck”. Thereupon he had been frightened, and trembled all over for fear. Than the transformed spirit had seized him by the throat, and demanded that he should renounce God Almighty, whereupon Junius said, “God help me”, and thereupon the spirit vanquished through the power of these words. Yet it came straightway back, brought more people with it, and persistently demanded of him that he renounce God in Heaven and all the heavenly host, by which terrible threatening he was obliged to speak this formula: “I renounce God in Heaven and his host, and will henceforward recognize the Devil as my God”.

After the renunciation he was so far persuaded by those present and by the evil spirit that he suffered himself to be baptized by the devil in the evil spirit’s name. The Morhauptin had given him a ducat as dower-gold, which afterward became only a potsherd.

He was then named Krix. His succubus was called Vixen (Füchsin). Those present had congratulated him in Beelzebub’s name and said that they were now all alike.

Etc.

What survives of him among the thousands of similar unfortunates is the illicit letter in his own hand describing those tortures in detail … a reminder (regrettably current) of the reality of crippled limbs and ripped flesh and the meager limits of human hardiness that surround a word like “torture”.

July 24, 1628

Many hundred thousand good-nights, dearly beloved daughter Veronica. Innocent have I come into prison, innocent have I been tortured, innocent must I die. For whoever comes into the witch prison must become a witch or be tortured until he invents something out of his head and – God pity him – bethinks him of something.

I will tell you how it has gone with me.

When I was the first time put to the torture, my brother-in-law, Dr. Braun, Dr. Kotzendorffer, and two strange doctors were there. Then Dr. Braun asks me; “Kinsman, how come you are here?” I answer, “Through falsehood and through misfortune”. “Hear, you,” he retorts, “you are a witch. Will you confess it voluntarily? If not, we’ll bring in witnesses and the executioner for you”. I said, “I am no witch; I have a pure conscience in the matter. If there are a thousand witnesses, I am not anxious, but I’ll gladly hear them”.

Then the Chancellor’s son was set before me, who said he had seen me. I asked that he be sworn and legally examined, but Dr. Braun refused it. Then the Chancellor, Dr. George Haan, was brought, who said the same as his son. Afterward Höppfen Ellse. She had seen me dance on Hauptsmorwald, but they refused to swear her in. I said: “I have never renounced God, and will never do it – God graciously keep me from it. I’ll rather bear whatever I must”.

And then came also – God in highest Heaven have mercy – the executioner, and put the thumbscrews on me, both hands bound together, so that the blood spurted from the nails and everywhere, so that for four weeks I could not use my hands, as you can see from the writing.

Thereafter they stripped me, bound my hands behind me, and drew me up on the ladder. Then I thought heaven and earth were at an end. Eight times did they draw me up and let me fall again, so that I suffered terrible agony. I said to Dr. Braun, “God forgive you for thus misusing an innocent and honorable man”. He replied, “You are a knave”.

And this happened on Friday, June 30, and with God’s help I had to bear the torture. When at last the executioner led me back into the cell, he said to me, “Sir, I beg you, for God’s sake, confess something, whether it be true or not. Invent something, for you cannot endure the torture which you will be put to; and, even if you bear it all, yet you will not escape, not even if you were an earl, but one torture will follow another until you say you are a witch. Not before that,” he said, “will they let you go, as you may see by all their trials, for one is just like another”.

Then came George Haan, who said the commissioners had said the Prince-Bishop wished to make such an example of me, that everybody would be astonished.

And so I begged, since I was in wretched plight, to be given one day for thought and a priest. The priest was refused me, but the time for thought was given. Now, my dearest child, see in what hazard I stood and still stand. I must say that I am a witch, though I am not – must now renounce God, though I have never done it before. Day and night I was deeply troubled, but at last there came to me a new idea. I would not be anxious, but, since I had been given no priest with whom I could take counsel, I would myself think of something and say it. It were surely better that I just say it with mouth and words, even though I had not really done it; and afterwards I could confess it to the priest, and let those answer for it who compel me to do it . . . And so I made my confession, as follows; but it was all a lie.

Now follows, dear child, what I confessed in order to escape the great anguish and bitter torture, which it was impossible for me longer to bear.

Then I had to tell what people I had seen (at the witch sabbat). I said that I had not recognized them. “You old knave, I must put the torturer at your throat. Say – was not the Chancellor there?” So I said yes. “Who besides?” I had not recognized anybody. So he said: “Take one street after another. Begin at the market, go out on one street and back on the next”. I had to name several persons there. Then came the long street (die lange Gasse). I knew nobody. Had to name eight persons there. Then the Zinkenwert – one person more. Then over the upper bridge to the Georgthor, on both sides. Knew nobody again. Did I know nobody in the castle – whoever it might be, I should speak without fear. And thus continuously they asked me on all the streets, though I could not and would not say more. So they gave me to the torturer, told him to strip me, shave me all over, and put me to the torture. “The rascal knows one on the market-place, is with him daily, and yet won’t name him”. By this they meant Burgomaster Dietmeyer: so I had to name him too.

Then I had to tell what crimes I had committed. I said nothing. . . “Hoist the knave up!” So I said that I was to kill my children, but I had killed a horse instead. It did not help. I had also taken a sacred wafer, and had buried it. When I had said this, they left me in peace.

Now, dearest child, here you have all my acts and confession, for which I must die. And they are sheer lies and inventions, so help me God. For all this I was forced to say through dread of the torture beyond what I had already endured. For they never leave off with the torture till one confesses something; be he ever so pious, he must be a witch. Nobody escapes, though he were an earl. Junius adds, in the margin, a touching gesture towards posthumous healing by asking no bitterness be kept against his false accusers.

Dear child, six have confessed against me at once: the Chancellor, his son, Neudecker, Zaner, Hoffmaisters Ursel, and Hoppfens Elsse–all false, through compulsion, as they have all told me, and begged my forgiveness in God’s name before they were executed. . . . They know nothing but good of me. They were forced to say it, just as I myself was. . . .

Haan, Junius’s accuser, was also burned at the stake.

Their mutual inquisitor, Dr. Braun, was arrested in 1629 — tortured — confessed — and burned as well. (Source)

1941: Paul Ogorzow, the S-Bahn Murderer

On this date in 1941, Nazi Berlin disposed of its railway killer.

Roger Moorhouse, author of a forthcoming book about Ogorzow, tells the story of this unjustly neglected homicidal maniac on his blog, and in a BBC History Magazine interview:

Paul Ogorzow (German link) plied his trade in a city blacked-out against British bombing, but he provides an illuminating glimpse at criminal investigation.

While Ogorzow benefited from Berlin’s preternatural darkness, he didn’t go greatly out of his way to cover his tracks otherwise. At least four of his eight murders were within a mile of his house; one woman who survived his attack reported the assailant was wearing German Railways kit.

The police, prone then as now to (sometimes hastily) settle on a theory and seek evidence to confirm it, remained blind to the seemingly obvious possibility that a railway worker was the culprit … even if he also happened to be a Nazi party member in good standing.

The official fixation on Untermenschen may not be surprising given the ideological climate, but Germany had had its share of noteworthy murderers in the interwar years who were neither Jews nor foreign laborers nor British agents — the suspect profiles favored by German investigators while Ogorzow continued his killing spree.

With the slightest measure of care, the S-Bahn Murderer might have plied his hobby unmolested until the wartime manpower shortages started making him look like an attractive bit of cannon-fodder for the eastern front. Alas for him, his voracious appetite for murder — eight victims with similar m.o. in just a few months — eventually made him so obvious that even the police could no longer overlook him.

Although the government kept the crime and its unedifying investigation fairly quiet, it was known. There was even a 1944 true crime potboiler by Wilhelm Ihde (pseudonymously writing as “Axel Alt”), Der Tod fuhr im Zug (Death Rode the Train). According to Todd Herzog,

Alt’s novel is representative of the dominant tendency of the period to celebrate the work of the criminal police while avoiding any portrayal of the totalitarian apparatus that surrounded criminal politics in the Third Reich.

Little surprise there.

Alt’s novel ultimately aligns itself with [Fritz] Lang’s film [M] in showing the methodical work of professional detectives to be ineffective in capturing the modern killer and explicitly calling for … recruitment of the public to aid the police in fighting crime.

1920: Dennis Gunn, hanged by a fingerprint

On this date in 1920, Dennis Gunn’s fingerprints made history by hanging their owner for murder.

“You’ll have a job to prove it,” said Dennis Gunn when police charged him with murder.

Use of the fingerprint in forensic science had been developing over the decades preceding, and already begun to earn its bones with criminal convictions.

Dennis Gunn’s conviction marked a watershed in the mainstreaming of the youthful science, especially in New Zealand and the British Empire/Commonwealth: the first execution that hung — so to speak — on a print.

The 25-year-old was tied to the murder of Ponsonby postmaster Augustus Braithwaite because a smudge left on a stolen cashbox matched the prints Gunn had contributed to the nascent New Zealand fingerprint library when he had been convicted of evading military service two years before.

Armed with this connection, a police search of Gunn’s environs turned up the apparent tools of the crime — a revolver (with yet another matching print), a thieves’ kit, and more pilfered proceeds of the postal strongroom.

Gunn attempted to indict the reliability of the fingerprint evidence at trial, and according to the London Times (Apr. 20, 1920) he had the support in this endeavor of “public demonstrations of sympathy, men and women rushing to shake hands with Gunn.”

But it didn’t fly with the jury.*

Gunn’s condemnation, read the official report,

disposes of all attempts to question the conclusiveness of this class of evidence, and proves the truth of the remark of the Chief Justice of Australia, that a man who leaves a clear fingerprint on an object leaves there an unforgettable signature.

Law enforcement organs around the world rapidly accepted the principle.

Too rapidly? Some think so; and, in the train of a new century’s bulletproof identification technology, DNA, wrongful convictions founded on purported fingerprint matches have drawn some renewed scrutiny (pdf) to the technique that put Dennis Gunn on the Mount Eden Prison gallows this date in 1920.

* Playing for time after conviction, Gunn copped to the robbery and tried to pin the murder on a supposed confederate. No dice.

1864: Doctor Edmond-Désiré Couty de la Pommerais, poisoner

At dawn this morning before the walls of La Roquette, a homeopath convicted of poisoning his mistress was beheaded for one of Paris’s most sensational crime dramas of the 1860’s.

The ill-fated Madame de Pauw had fallen suddenly ill and expired in the doctor’s care; means and opportunity were obvious, and motive readily adduced from the handsome life insurance policies of the expired woman.

La Pommerais was convicted on this basis of killing his paramour in the midst of a farcical insurance scam, with noted forensic scientist Ambroise Tardieu establishing to the court’s satisfaction the presence of the poison digitalin.

(One can read a detailed 1865 critique of Tardieu’s conclusions and testimony, a reminder that the criminal justice system’s struggles with the uses and limitations of forensic science are a longstanding concern. This (if one takes it as such) murder, which reads in retrospection like a classic in the genre of comedic criminality, might have been the perfect crime absent an obvious pecuniary design: the death was put down to a routine cause and only scrutinized when an anonymous tip and/or the suspicious insurance adjusters led the authorities to exhume the body 13 days after burial.)

American newsman George Alfred Townsend chanced to be abroad in Paris on this occasion, and recorded the scene as “thousands of Parisians bent their steps the night before the execution” in Campaigns of a Non-combatant — excerpted at length here for its topicality to this blog.

The news had gone abroad that la Pommerais would not be pardoned. It was also generally credited that this would be the last execution ever held in Paris, since there is a general desire for the abolition of capital punishment in France, and a conviction that the Legislature, at its next session, will substitute life-imprisonment.* This, with the rarity of the event, and that terrible allurement of blood which distinguishes all populaces, brought out all the excitable folk of the town; and at dusk, on the night before the expiation, the whole neighborhood of La Roquette was crowded with men and women. All classes of Parisians were there, — the blouses, or workingmen, standing first in number; the students from the Latin Quartier being well represented, and idlers, and well-dressed nondescripts without enumeration, — distributing themselves among women, dogs, and babies.

Venders of galeaux, muscles, and fruit were out in force. The “Savage of Paris,” clothed in his war plumes, paint, greaves, armlets, and moccasins, was selling razors by gaslight; here and there ballad-mongers were singing the latest songs, and boys, with chairs to let, elbowed into the intricacies of the crowd, which amused itself all the night long by smoking, drinking, and hallooing. At last, the mass became formidable in numbers, covering every inch of ground within sight of the prison, and many soldiers and sergeants de ville, mounted and on foot, pushed through the dense mass to restore order.

At midnight, a body of cavalry forced back the people from the square of La Roquette. A number of workmen, issuing from the prison-gates, proceeded to set up the instrument of death by the light of blazing torches. The flame lit up the dark jail walls, and shone on the helmets and cuirasses of the sabre-men, and flared upon spots of the upturned faces, now bringing them into strong, ruddy relief, now plunging them into shadow. When the several pieces had been framed together, we had a real guillotine in view, — the same spectre at which thousands of good and bad men had shuddered; and the folks around it, peering up so eagerly, were descendants of those who stood on the Place de la Concorde to witness the head of a king roll into the common basket. Imagine two tall, straight timbers, a foot apart, rising fifteen feet from the ground. They are grooved, and spring from a wide platform, approached by a flight of steps. At the base, rests a spring-plank or bascule, to which leather thongs are attached to buckle down the victim, and a basket or pannier filled with sawdust to receive the severed head. Between these, at their summit, hangs the shining knife in its appointed grooves, and a cord, which may be disconnected by a jerk, holds it to its position. Two men will be required to work the instrument promptly, — the one to bind the condemned, the other to drop the axe. The bascule is so arranged that the whole weight and length of the trunk will rest upon it, leaving the head and neck free, and when prone it will reach to the grooves, leaving space for the knife to pass below it. The knife itself is short and wide, with a bright concave edge, and a rim of heavy steel ridges it at the top; it moves easily in the greased grooves, and may weigh forty pounds. It has a terrible fascination, hanging so high and so lightly in the blaze of the torches, which play and glitter upon it, and cast stains of red lights along its keen blade, as if by their brilliance all its past blood-marks had become visible again. A child may send it shimmering and crashing to the scaffold, but only God can fasten together the warm and throbbing parts which it shall soon dissever. And now that the terrible creature has been recreated, the workmen slink away, as if afraid of it, and a body of soldiers stand guard upon it, as if they fear that it might grow thirsty and insatiate as in the days of its youth. The multitude press up again, reinforced every hour, and at last the pale day climbs over the jail-walls, and waiting people see each other by its glimmer. The bells of Notre Dame peal out; a hundred towers fall into the march of the music; the early journals are shrieked by French newsboys, and folks begin to count the minutes on their watches. There are men on the ground who saw the first guillotine at work. They describe the click of the cleaver, the steady march of victims upon the scaffold-stairs, the rattle of the death-cart turning out of the rue Saint Honore, the painted executioners, with their dripping hands, wiping away the jets of blood from the hard, rough faces; nay! the step of the young queen, white-haired with care, but very beautiful, who bent her body as she had never bent her knee and paid the penalty of her pride with the neck which a king had fondled.

At four minutes to six o’clock on Thursday morning, the wicket in the prison-gate swung open; the condemned appeared, with his hands tied behind his back, and his knees bound together. He walked with difficulty, so fettered; but other than the artificial restraints, there was no hesitation nor terror in his movements. His hair, which had been long, dark, and wavy, was severed close to his scalp; his beard had likewise been clipped, and the fine moustache and goatee, which had set off his most interesting face, no longer appeared to enhance his romantic, expressive physiognomy. Yet his black eyes and cleanly cut mouth, nostrils, and eyebrows, demonstrated that Couty de la Pommerais was not a beauty dependent upon small accessories. There was a dignity even in his painful gait; the coarse prison-shirt, scissored low in the neck, exhibited the straight columnar throat and swelling chest; for the rest, he wore only a pair of black pantaloons and his own shapely boots. As he emerged from the wicket, the chill morning air, laden with the dew of the truck gardens near at hand, blew across the open spaces of the suburbs, and smote him with a cold chill. He was plainly seen to tremble; but in an instant, as if by the mere force of his will, he stood motionless, and cast a first and only glance at the guillotine straight before him. It was the glance of a man who meets an enemy’s eye, not shrinkingly, but half-defiant, as if even the bitter retribution could not abash his strong courage … he seemed to feel that forty thousand men and women, and young children were looking upon him to see how he dared to die, and that for a generation his bearing should go into fireside descriptions. Then he moved on between the files of soldiers at his shuffling pace, and before him went the aumonier or chaplain, swaying the crucifix, behind him the executioner of Versailles — a rough and bearded man — to assist in the final horror.

It was at this intense moment a most wonderful spectacle. As the prisoner had first appeared, a single great shout had shaken the multitude. It was the French word “Voila!” which means “Behold!” “See!” Then every spectator stood on tiptoe; the silence of death succeeded;** all the close street was undulant with human emotion; a few house roofs near by were dizzy with folks who gazed down from the tiles; all the way up the heights of Pere la Chaise, among the pale chapels and monuments of the dead, the thousands of stirred beings swung and shook like so many drowned corpses floating on the sea. Every eye and mind turned to the little structure raised among the trees, on the space before La Roquette, and there they saw a dark, shaven, disrobed young man, going quietly toward his grave.

He mounted the steps deliberately, looking towards his feet; the priest held up the crucifix, and he felt it was there, but did not see it; his lips one moment touched the image of Christ, but he did not look up nor speak; then, as he gained the last step, the bascule or swingboard sprang up before him; the executioner gave him a single push, and he fell prone upon the plank, with his face downward; it gave way before him, bearing him into the space between the upright beams, and he lay horizontally beneath the knife, presenting the back of his neck to it. Thus resting, he could look into the pannier or basket, into whose sawdust lining his head was to drop in a moment. And in that awful space, while all the people gazed with their fingers tingling, the legitimate Parisian executioner gave a jerk at the cord which held the fatal knife. With a quick, keen sound, the steel became detached; it fell hurtling through the grooves; it struck something with a dead, dumb thump; a jet of bright blood spurted into the light, and dyed the face of an attendant horribly read; and Couty de la Pommerais’s head lay in the sawdust of the pannier, while every vein in the lopped trunk trickled upon the scaffold-floor! They threw a cloth upon the carcass and carried away the pannier; the guillotine disappeared beneath the surrounding heads; loud exclamations and acclaims burst from the multitude; the venders of trash and edibles resumed their cheerful cries, and a hearse dashed through the mass, carrying the warm body of the guillotined to the cemetery of Mt. Parnasse. In thirty minutes, newsboys were hawking the scene of the execution upon all the quays and bridges. In every cafe of Paris some witness was telling the incidents of the show to breathless listeners, and the crowds which stopped to see the funeral procession of the great Marshal Pelissier divided their attention between the warrior and the poisoner, — the latter obtaining the preponderance of fame.

(This attention-getting execution attracted an apocryphal story† (pdf) that the severed head of La Pommerais was subject to a “wink test” to determine whether consciousness survived the fall of the blade.)

The doctor bequeathed the world a book on homeopathic medicine, which the discerning reader of French can peruse free.

* Actually, the last execution in France was still 113 years away.

** Rashomon-like, not all observers concurred as to the event’s quiet solemnity. The New York Times reported that

[t]he language of those non-official persons who assembled to witness this expiation of a great crime was brutal to the last decree. They hissed and hooted as the convict was about to mount the ladder, and were loudest in their brutal demonstrations when the crucifix was pressed to his lips. The blade had scarcely severed his head from his body, when a rush was made to do violence to the trunk. The troops were obliged to interfere, and had some difficulty in repelling the crowd, which was excited by the sight of a ‘gentleman criminal’ to a pitch of savage ferocity … The Pays, in noticing this expiation of a great crime, states that the crowd retired in silence. But I am in a position to affirm that the contrary was the cxase.

1820: The Cato Street Conspirators

On this date in 1820 — which was not yet a red-letter day on the leftist calendar — five radicals were hanged at Newgate Prison for a plot to overthrow the government.

A British government that had tilted from reactionary after the French Revolution to furiously repressive after defeating Napoleon was energetically at work stamping out the wide-ranging upheaval convulsing the isles.

This day’s conspirators plotted to overturn the authoritarian rule of Lord Liverpool by murdering his ministers at a dinner party. Next steps:

Revolution!

This excellent plot was hatched by none other than a government informant, who planted the idea among the circle and arranged their arrest when they took the bait. Already-notorious subversive Arthur Thistlewood was the jewel in the crown’s crown, particularly after having slain an arresting officer in the fray when the trap was sprung.

Ten were condemned to death, five of those sentences commuted to transportation — leaving Thistlewood to hang* along with John Brunt, James Ings, Richard Tidd and the Afro-Caribbean tradesman William Davidson. The crowd was reportedly vocally supportive of the condemned.


The Cato Street Conspirators hanged. As represented at the bottom of the scaffold: the dead men were cut down after their execution and posthumously beheaded.

It was in the aftermath of this shocking affair that Byron completed his work on a long-ago Venetian putsch, Marino Faliero, with such stirring reflections upon the blood sacrifice of liberty as

They never fail who die
In a great cause: the block may soak their gore:
Their heads may sodden in the sun; their limbs
Be strung to city gates and castle walls —
But still their Spirit walks abroad. Though years
Elapse, and others share as dark a doom,
They but augment the deep and sweeping thoughts
Which overpower all others, and conduct
The world at last to Freedom.

Still, even from the safety of Italy, the rakish rebel had a gentleman’s disdain for these lowborn butchers overpowering anything at all.

What a set of desperate fools these Utican conspirators seem to have been. As if in London, after the disarming acts, or indeed at any time, a secret could have been kept among thirty or forty. And if they had killed poor Harrowby — in whose house I have been five hundred times, at dinners and parties; his wife is one of ‘the Exquisites’ — and t’other fellows, what end would it have answered? ‘They understand these things better in France’, as Yorick says, but really, if these sort of awkward butchers are to get the upper hand, I for one will declare off. I have always been (before you were, as you well know) a well-wisher to, and voter for reform in parliament; but ‘such fellows as these, who will never go to the gallows with any credit’ … and make one doubt of the virtue of any principle or politics which can be embraced by similar ragamuffins. I know that revolutions are not to be made with rose water, but though some blood may, and must be shed on such occasions, there is no reason it should be clotted; in short, the Radicals seem to be no better than Jack Cade or Wat Tyler, and to be dealt with accordingly.
