1670: Claude Duval, gentleman highwayman

It’s been 340 years since the immortal highwayman Claude Duval (or Du Val, or Du Vall) went to the Tyburn gallows and was turned off into legend as the ne plus ultra of English gentleman thieves.

Duval, actually, was French, an import to Isles in the train of some forgotten noble migrating with the restoration of royal prerogatives.

On the English highway, this formerly impecunious retainer coruscated as a knight of the road, the very model of the chivalrous outlaw against whom the likes of Dick Turpin would be compared to disadvantage. Macaulay recorded

how Claude Duval, the French page of the Duke of Richmond, took to the road, became captain of a formidable gang, and had the honour to be named first in a royal proclamation against notorious offenders; how at the head of his troop he stopped a lady’s coach, in which there was a booty of four hundred pounds; how he took only one hundred, and suffered the fair owner to ransom the rest by dancing a coranto with him on the heath;

how his vivacious gallantry stole away the hearts of all women; how his dexterity at sword and pistol made him a terror to all men; how, at length, in the year 1670, he was seized when overcome by wine; how dames of high rank visited him in prison, and with tears interceded for his life; how the king would have granted a pardon, but for the interference of Judge Morton, the terror of highwaymen, who threatened to resign his office unless the law were carried into full effect; and how, after the execution, the corpse lay in state with all the pomp of scutcheons, wax lights, black hangings and mutes, till the same cruel judge, who had intercepted the mercy of the crown, sent officers to disturb the obsequies. In these anecdotes there is doubtless a large mixture of fable; but they are not on that account unworthy of being recorded; for it is both an authentic and an important fact, that such tales, whether false or true, were heard by our ancestors with eagerness and faith.

Gillian Spraggs justifiably observes that no matter how genuinely gallant the brigand, his profession entailed relieving others of their rightful produce by main force. But then, the same could be said of the lords of the realm.

No, although Duval’s legend invites debunking, this must be for another blog.

We take Duval here at his mythological acme: he is the patron saint of the early modern bandit, the Superman of English outlawry, succoring with the fantasy of freedom upon the road the thousands of porters and scullery maids and apprentices chained to their oars below-decks upon Britannia’s ship of state.

What matter the rest?

This day, we toast Claude Duval, the Knight of the Road, in the manner of the fetching inscription (since destroyed by fire) under which he was reportedly buried:

1726: Mary Standford, shunning convict transportation

Mary Standford was convicted of privately stealing a shagreen pocket book, a silk handkerchief, and 4 guineas from William Smith on July 11, 1726. After her conviction, she strongly rejected transportation to the American colonies as an alternative to execution.

Early Years

Standford was raised just outside of London by good parents who sent her to school and educated her in the principles of Christian values. Standford, however, showed more interest in the “Company of Young Men,” so she was sent to London to become a servant, where she lost several positions due to her behavior. In her last position she was seduced by a footman, which subsequently forced her into prostitution.

Standford quickly fell in company with Mary Rawlins, “a Woman of notorious ill fame,” and the two of them walked the streets between Temple Bar and Ludgate-Hill looking to empty the pockets, one way or another, of gullible men. Later, they had considerable success targeting sailors who, after returning from their voyages, had money to spend for their favors. Standford eventually married a man with the last name of Herbert, but after a year and a half she left him or, by her account, he abandoned her. Soon afterward, she had a child out of wedlock from another man, who was a servant.

Standford’s Arrest

With two mouths to feed, Standford set out to practice prostitution on her own, and it was then that she was arrested for theft. William Smith, who brought her to trial and was surprisingly frank in his testimony, related that he was walking along Shoe Lane after one o’clock in the morning when he was approached by Standford, who offered him to “take a Lodging with her.” He spent 2 or 3 three hours with her, all the while ordering drinks to be brought up from downstairs. He soon realized that he was missing money, and when he confronted Standford about it, she bolted from the room.

A constable caught Standford running away from Smith in the street. He picked up one of Smith’s guineas after Standford had dropped it, and he found another in her hand and two in her mouth. He also discovered Smith’s handkerchief and pocket book on her. In his testimony, the constable called Smith a “Country Man” and described him as very drunk at the time.

Standford’s version of the event was quite different. She claimed that Smith was drunk when she met him, and that he forced himself up to her room. There, he placed the four guineas one by one in her bosom and then threw her onto the bed. In the struggle, she speculated that his pocket book must have fallen out of his pocket, and when she discovered it after he left, she ran after him to return it. Not believing her story, the jury found her guilty, and she was sentenced to death.

A Rejection and a Defense of Transportation

After receiving her sentence, Standford’s friends pleaded with her to ask for a pardon in exchange for transportation. Standford refused, “declaring that she had rather die, not only the most Ignominious, but the most cruel Death that could be invented at home, rather than be sent Abroad to slave for her Living.”

The author of the Lives of the Most Remarkable Criminals was baffled by Standford’s position and presents a lengthy defense of the institution of convict transportation:

such strange Apprehensions enter into the Heads of these unhappy Creatures, and hinder them from taking the Advantage of the only possibility they have left of tasting Happiness on this side the Grave, and as this Aversion to the Plantations has so bad Effects, especially in making the Convicts desirous of escaping from the Vessel, or of flying out of the Country whither they were sent, almost before they have seen it. I am surpriz’d that no Care has been taken to print a particular and authentick Account, of the Manner in which they are treated in those Places; I know it may be suggested that the Terrour of such Usage as they are represented to meet with there, has often a good Effect in diverting them from such Facts as they know must bring them to Transportation, yet . . . if instead of magnifying the Miseries of their pretended Slavery, or rather of inventing Stories that make a very easy service, pass on these unhappy Creatures for the severest Bondage. The Convicts were to be told the true state of the Case, and were put in Mind that instead of suffering Death, the Lenity of our Constitution, permitted them to be removed into another Climate, no way inferiour to that in which they were born, where they were to perform no harder tasks, than those who work honestly for their Bread in England do, and this not under Persons of another Nation, who might treat them with less Humanity upon that Account, but to their Countrymen, who are no less English for their living in the New, than if they dwelt in Old England, People famous for their Humanity, Justice and Piety, and amongst whom they are sure of meeting with no variation of Manners, Customs, &c. unless in respect of the Progress of their Vices which are at present, and may they long remain so, far less numerous there than in their Mother-Land. I say if Pains were taken to instill into these unhappy Persons such Notions . . ., they might probably conceive justly of that Clemency which is extended towards them, and instead of shunning Transportation, flying from the Countries where they are landed, as soon as they have set their Foot in them, or neglecting Opportunities they might have on their first coming there, be brought to serve their Masters faithfully, to endure the Time of their Service chearfully, and settle afterwards in the best Manner they are able, so as to pass the Close of their Life in an honest, easy, and reputable Manner; whereas now it too often happens, that their last End is worse than their first, because those who return from Transportation being sure of Death if apprehended, are led thereby to behave themselves worse and more cruelly than any Malefactors whatsoever (Vol. III, pp. 287-289).

The author’s cheery account of life as an indentured servant in the American colonies certainly makes transportation sound like a compelling alternative to execution. The reality of life overseas under such conditions, though, does not match this picture, and some criminals valued their liberty over enforced servitude, even if it meant their own death.

Execution

In his account of her execution, James Guthrie, the minister at Newgate Prison, described Standford as “grosly Ignorant of any thing that is good.” He went on to say that “she was neither ingenious nor full in her Confessions, but appeared obstinate and self-conceited.” Standford continued to maintain her innocence in the affair with Smith, and she appeared indifferent about the fate of her child, expressing to Guthrie the hope that the parish would take care of it. Guthrie claimed, however, that “she acknowledg’d herself among the chief of Sinners.”

Mary Standford was executed on Wednesday, August 3, 1726 at Tyburn. She was 36 years old. Executed alongside her were 3 other criminals. Thomas Smith and Edward Reynolds were both sentenced to die for highway robbery. John Claxton, alias Johnson, was put death for returning twice from transportation before his 7-year sentence had run out.

1777: William Dodd, mind wonderfully concentrated

On this date in 1777, they hanged the macaroni parson at Tyburn.

High-living, Cambridge-educated vicar William Dodd achieved this emasculating nickname for his frippery — macaroni (or maccaroni) being 18th century slang for a sort of outrageous continental metrosexual.*

He came particularly in for public ridicule when he was caught trying to bribe his way to a lucrative ecclesiastical position, financial hardship from his lifestyle having driven him to the desperate need for a pay hike. (In sorer straits later, he would sum up his life: “my greatest evil was expense. To supply it, I fell into the dreadful and ruinous mode of raising money by simonies. The annuities devoured me.”

Playwright Samuel Foote skewered the recently-humiliated Dodd on the stage in The Cozeners as “Dr. Simony,” described in the scrambled boast of “Mrs. Simony”:

not a more populous preacher within the sound of Bow-bells: I don’t mean for the mobility only … with a cambric handkerchief in one hand, and a diamond ring on the other: and then he waves this way and that way; and he curtsies, and he bows, and he bounces, that all the people are ready to — but then his wig, madam! I am sure you must admire his dear wig … short, rounded off at the ear, to show his plump cherry cheeks, white as a curd, feather-topped, and the curls as close as a cauliflower…

Then, my doctor is none of your schismatics, madam; believes in the whole thirty-nine! and so he would if there were nine times as many.

Three years after Foote’s cruel pen gave Dodd’s name immortality, the divine himself was (so he should think) ushered into eternity, after he got caught passing a forged bond against the revenues of his onetime student Lord Chesterfield.

Condemned to die for the offense,** a longer-than-usual lag from sentence to execution gave Dr. Simony leave to follow that classic Calvary of errant clerics with a mien of pious self-flagellation that helped his case raised a public outcry for clemency.

Samuel Johnson was among thousands of Britons who petitioned for mercy, and in Johnson’s case, went a bit further to ghost-write a piece in Dodd’s name, “The convict’s address to his unhappy brethren”. It was when the litterateur’s hand was suspected behind this prose† that Johnson made his quotable, tweetable remark,

“Depend upon it Sir, when a man knows he is to be hanged in a fortnight, it concentrates his mind wonderfully.”

Dr. Johnson, nevertheless, was the true author, and the old scribbler used it to express some of his particular opinions on the proper staging of gallows-theater.

It is the duty of a penitent to repair, so far as he has the power, the injury which he has done. What we can do, is commonly nothing more than to leave the world an example of contrition. On the dreadful day, when the sentence of the law has its full force, some will be found to have affected a shameless bravery, or negligent intrepidity. Such is not the proper behaviour of a convicted criminal. To rejoice in tortures is the privilege of a martyr; to meet death with intrepidity is the right only of innocence, if in any human being innocence could be found. Of him, whose life is shortened by his crimes, the last duties are humility and self-abasement. We owe to God sincere repentance; we owe to man the appearance of repentance.—-We ought not to propagate an opinion, that he who lived in wickedness can die with courage.‡

William Dodd (together with another criminal, Joseph Harris: there’s a wonderful profile of this forgotten youth here) had occasion to do just that this day in 1777. Dodd became the last person hanged for forgery at Tyburn.

Updated: According to Wendy Moore, there was an posthumous attempt at resuscitation, which was known to work sometimes.

Dodd, himself a big death penalty opponent from his former public perch, gave a sermon the very year of his eventual death titled The Frequency of Capital Punishments Inconsistent with Justice, Sound Policy and Religion, critiquing “voluntary destruction” of human life and its inconsistency with “the humane and benevolent spirit which characterizes the present times.”

He was also — which helps explain the revival attempt — a big supporter of the Humane Society, which sought to apply the developing science of the Enlightenment to the problem of resuscitating the (near-)drowned. (The Royal Humane Society’s motto today is lateat scintillula forsan, “a small spark may perhaps lie hid.”)

Dodd preached an enthusiastic sermon to this body in 1776, expansively anticipating its work for analogous “various other kinds of sudden and accidental death” such as “malefactors executed at the gallows, [which] would afford opportunities of discovering how far this method might be successful in relieving such as may have unhappily become their own executioners by hanging themselves.” Dodd’s own engagement with both the medical and the theological questions at stake in resuscitation surely conditioned his own anticipation under the noose that, if revived, he might live on as a “renovated being.”

It was, surely, an astounding time to live; no less so, to die. And the mysterious border between the two might be re-engineered by human ingenuity.

As Lord Byron (a man with his own fascination for the scaffold) wrote in Don Juan,

What opposite discoveries we have seen!
(Signs of true genius, and of empty pockets.)
One makes new noses, one a guillotine,
One breaks your bones, one sets them in their sockets;

Bread has been made (indifferent) from potatoes;
And galvanism has set some corpses grinning,
But has not answer’d like the apparatus
Of the Humane Society’s beginning
By which men are unsuffocated gratis:
What wondrous new machines have late been spinning!

* The lyrics of “Yankee Doodle Dandy” (“stuck a feather in his hat and called it macaroni”) may be the most recognizable modern-day relic of this lexicon.

** Dodd made a groveling plea to the jury in the face of overwhelming evidence against him, at one point bold enough to appeal to injury his death would inflict upon those who lent him money: “I have creditors, honest men, who will lose much by my death. I hope, for the sake of justice towards them, some mercy will be shown to me. ”

† Dodd could write a little himself; he had a theological tract and a commentary on Shakespeare already to his name, and at Newgate cranked out Thoughts in Prison, a collection of sub-Villon poetry.

‡ In an addendum that would have warmed the cockles of the Roberts court, Johnson-as-Dodd also opined,

Every man reposes upon the tribunals of his country the stability of possession, and the serenity of life. He therefore who unjustly exposes the courts of judicature to suspicion, either of partiality or error, not only does an injury to those who dispense the laws, but diminishes the public confidence in the laws themselves, and shakes the foundation of public tranquility.

1592: Roger Ashton

On this date in 1592, Roger Ashton was hanged, drawn and quartered at Tyburn.

Ashton is a minor martyr on the Catholic rolls, one of many in the age who (as Edmund Campion put it) were called by determinedly Protestant English crown to “enjoy your Tyburn.”

We’ll let the Catholic Encyclopedia take it from here.

He was hanged, drawn, and quartered at Tyburn, 23 June, 1592. His indictment is not preserved. Challoner says it was for procuring a dispensation from Rome to marry his second cousin. Later evidence, while confirming this, shows that it was not the only cause.

In 1585 he had gone to serve in the under the Earl of Leicester against the Spaniards. Sir William Stanley having been placed on guard over the town of Deventer, which had revolted from the Spaniards, he, with the assistance of Ashton, gave the town back to Spain and went over to their side (29 January, 1587).*

Cardinal Allen published a “Defence” of this act** in the form of a letter addressed to one “R.A.”, whose letter to the Cardinal prefixed and under these initials it seems natural to recognize our martyr. Stanley next entrusted to Ashton the difficult task of bringing over his wife from Ireland, but she was already under arrest, and he is said to have been sent Ashton to Rome. At the close of the year 1587 he returned to England and was apprehended in Kent with the marriage dispensation already mentioned. In January, 1588, he was in the Tower, where he lay ill towards the close of the year, when he was transferred to easier confinement in the Marshalsea. From this he managed to escape and fled to his brothers in Lancashire.

He was seized later, at Shields near Newcastle, while trying to escape over the seas. Transferred thence to Durham and York, he was tried and sentenced at Canterbury, and died “very resolute”, making profession of his faith and “… pitied of the people”, though the infamous Topcliffe tried to stir up ill-feeling against him by enlarging on his services to Spain.

* This event — an English commander betraying a city to the enemy during wartime (in fact, two English commanders, as Rowland York (or Yorke) handed the Spanish the fortress of Zutphen on the same day) — naturally raised a scandal in 1587.

Although this treacherous William Stanley is not to be confused with the contemporaneous fellow-noble of the same name who has a horse in the “who really wrote Shakespeare?” race, Lily Bess Campbell argues that the imprint of events in Deventer and the subsequent volley of pamphleteering informs a discourse of royal prerogative in the Bard’s Henry V, when the disguised monarch goes slumming with the common soldiery on the eve of the Battle of Agincourt.

Henry replies that soldiers should look after their conscience on their own time and obey the prince of the realm in wartime. No doubt Queen Elizabeth approved.

(As long as we’re digressing with Shakespeare and anti-Stratfordian candidates, here’s an argument that the jittery national mood post-Deventer and pre-routing the Spanish Armada — the time when Mary, Queen of Scots lost her head — makes a case for dating the Henry plays to that period, which in turn makes a case for Edward de Vere as their true author. Make of that what you will.)

** The obedience due a sovereign as opposed to the obedience due to an abstract standard of Right is a lasting modern question, so it’s no surprise that Cardinal Allen’s justification has a modern ring.

For that to revolt, is of itselfe, lawful or unlawful, honorable or otherwise, according to the justice, or injustice of the cause, or difference of the person, from or to whom the revolt is made … Whensoever thou art armed, & in readinesse for battayle, let this be thy first cogitation, that thy very corporal streingth itselfe, is the gift of God: whereby thou shalt stil be put in minde, never to use the gift of God, against God him selfe, that gave it thee.

Presumably he wouldn’t have supported the “only following orders” defense.

Unspecified Year: Clever Tom Clinch, hung like a hero

This 1726 poem by Jonathan Swift toasts a charismatic client of the Tyburn tree — who is, alas, completely fictional.

Clever Tom Clinch going to be hanged

As clever Tom Clinch, while the Rabble was bawling,
Rode stately through Holbourn, to die in his Calling;
He stopt at the George for a Bottle of Sack,
And promis’d to pay for it when he’d come back.
His Waistcoat and Stockings, and Breeches were white,
His Cap had a new Cherry Ribbon to ty’t.
The Maids to the Doors and the Balconies ran,
And said, lack-a-day! he’s a proper young Man.
But, as from the Windows the Ladies he spy’d,
Like a Beau in the Box, he bow’d low on each Side;
And when his last Speech the loud Hawkers did cry,
He swore from his Cart, it was all a damn’d Lye.
The Hangman for Pardon fell down on his Knee;
Tom gave him a Kick in the Guts for his Fee.
Then said, I must speak to the People a little,

Any relationship between this literary gallows scene and any particular calendar date is purely coincidental, although the condemned man’s past-tense reference to executed thief-taker Jonathan Wild would theoretically place it subsequent to that man’s hanging on May 24, 1725.

1691: Jack Withrington, highwayman

On this date in 1691, highwayman Jack Withrington hanged at Tyburn.

THIS fellow was the youngest of five brothers, who were all born at Blandford, in Dorsetshire. The other four were all hanged in the country, but Jack had the good fortune to be reserved for Tyburn, and by that means to have his name transmitted to posterity. He was bound to a tanner in Shaftesbury, a town in his native county, with whom he served about three years. Then he entered into the Earl of Oxford’s Regiment of Horse, in which, when Monmouth‘s rebellion was suppressed in the West of England, he came up to London, where he soon met with opportunities of discovering his valour to the world. These occasions were two quarrels in which he was engaged: the first with a man famous for fighting, against whom he behaved with so much bravery and skill that it won him a vast reputation; the second with a person of great estate, but a noted coward, when he showed himself a gentleman by his adherence to the point of honour and good breeding. By these duels he won abundance of applause, so as thereby to contract a familiarity with all the greatest fighting men of the time, especially those in his own regiment. Withrington however carried his manhood so far as to get himself turned out of the regiment within a year after, for challenging his captain. He then became a perfect bully and gamester; and, being fortunate, in a little time by these means saw himself master of a considerable sum of money. Notwithstanding all this good luck at first, he found himself afterwards subject to the fate of gamesters —- viz. to be frequently without money in spite of his large winnings. This brought him at last to consider the uncertainty of Fortune and endeavour to make himself master of her, by supplying with fraud what he might want in plain open skill. But this also did not continue long; for everyone began to be aware of him as a common sharper, and none who knew him would venture to play with him.

In the common scale of knavery the next step above a sharper is a downright thief. Withrington made bold to ascend this degree, and was resolved to take the most honourable station thereon, that of a highwayman. He had money enough to buy him a good horse and accoutrements, so that the resolution and the real attempt were not long asunder. His first adventure was with a farmer, from whom he took forty pounds, giving him in return only an impudent harangue, occasioned by the countryman’s reproaching him with the robbery.

The next that fell in Withrington’s way was Mr Edward Clark, gentleman usher to the Duchess of Mazarin. They met in Devonshire, on the road between Chudleigh and Ashburton. Mr Clark made some resistance, so that in the scuffle Withrington’s mask fell off and discovered his face, which Mr Clark knowing, he called him by his name, and said he hoped he would not rob an old acquaintance. “Indeed I shall, sir,” quoth Withrington, “for you get your money much easier than I do, who am forced to venture my life for a maintenance; you have so much a year for eating, drinking and entertaining your lady with scandal and nonsense. What I shall take from you will do you little harm; it is only putting a higher price upon half-a-score reputations, which you know how to do as well as any coxcomb in England. Ladies never let such faithful servants go unrewarded, nor will yours suffer your loss to fall on yourself.” He got about eight guineas out of this gentleman’s pocket, and for old acquaintance sake bade him “Good-b’w’ye” very heartily.

Withrington’s robberies in less than a year and a half were talked of almost all over the kingdom. But alas! he met with a diversion, common to mankind, that draws even the most stupid into the rank of polite persons. The poor man was in love; and with whom but a rich widow inn-keeper in Bristol! Farewell to the highway: Withrington has another scent to pursue. No more robberies to be thought of from a man who was himself robbed of his heart! He employed an old bawd in the affair, who was intimately acquainted with our hostess, and by this flesh-broker’s mediation things had like to have come to an issue, and Jack to have been master of the Swan Inn. In short, there was nothing prevented it but the accidental coming of a certain gentleman, who knew our highwayman, and informed his mistress what he was. The effects of this discovery were Jack’s being kicked out of doors by the ostler and chamberlain, and the commitment of madam the negotiatress to Bridewell, in order to mill Dolly.

After his return to the highway he and one of his companions met with Mr Thompson, a noted tailor, in a part of Hertfordshire that was convenient for robbing. They took from him about thirty pounds in silver, and then, dismounting him, they ordered him to stay where he was till they brought him more company. As soon as they were gone from him he remounted his horse and attempted to ride off as fast as he could; but our highwaymen perceiving what he was at, and having the best horses, they fetched him back, and mistrusting he had more money, by his being in so much haste, they searched him afresh, he protesting all the while that he had not so much as a farthing left if it were to save his soul. In a literal sense he might be right; but they made a shift to find forty guineas, which they thought better than farthings. Withrington upon this exclaimed that it was a sad thing that one Christian could not believe another! They then shot his horse, to put a stop to his speed, and so rode away and left him.

These, we pause to digress, are not the only stock and store among the (surely half-legendary) c.v. of this colorful bandit. The verbosely entitled Complete History of the Lives and Robberies of the Most Notorious Highwaymen, Footpads, Shoplifts and Cheats of Both Sexes reports that Withrington delivered himself of an even wordier critique of the nascent economic order of the day.

[T]ravelling the road, he met a rich farmer, from whom he took £40. Quoth he, Is not this a downright robbery? Roberry? replied Withrington; So let it be; who is there now-a-days does not rob? The tailor steals before his customer’s face; the weaver steals by eking out the length of a piece of cloth with the remainder of broken ends; the surgeon steals by prolonging a cure; the apothecary steals with a quid pro quo, using one drug for another for cheapness, without any regard to the age and constitution of the patient; the merchant steals by putting his money into the Bank of England; the scrivener steals by selling the soul of a poor man for the money that he can take of a forfeit; the grocer steals by using false weights; the vintner steals by adulterating his wine; the butcher steals by blowing up his meat; the victualler steals by drawing in short measures; the cook steals by roasting his meat twice over; the baker steals by raising his bread when there’s no occasion; and the shoe-maker steals by stretching his leather as much as he does his conscience. Thus, as there is cheating and cozening in all trades but mine, you cannot blame me for borrowing this small trifle; which I shall honestly pay you when we meet again; so till then, farewell.

And a bit of, er, gallantry.

Another time Jack Withrington meeting a gentleman and his wife on the road betwixt St. Albans and Dunstable, he very submissively craved their benevolence; but they not instantly granting his request, he shot the horse on which they both rode, and swore that as he denied him his money, he would take his wife. So forcing her into an adjacent copse, and acting a man’s part by her, he restored her to her husband again, from whom taking eleven or twelve guineas he said, This is no more than my due for I am not obliged to do your drudgery for nothing.

Rape and repartee! Dreamy.

But we know where this is heading.

The last robbery Withrington committed was alone. He stopped a nobleman on Hounslow Heath attended by two footmen. There was a short dispute, but Withrington having the best of it, he took a portmanteau in which were two hundred and eighty guineas, sixty pounds in silver, and a parcel of fine linen. A hue and cry was soon issued out after him, and he was apprehended by means of it at Malmesbury, in Wiltshire, from whence he was removed to London, where he was condemned for this fact.

The sentence of death seemed to have no effect on his temper, for he was as gay and humorous under that circumstance as ever he had been before. When he was riding up Holborn Hill he ordered the cart to stop, and calling up the Sheriff’s deputy, “Sir,” said he, “I owe a small matter at the Three Cups, a little farther on, for which I am afraid of being arrested as I go by the door; therefore I shall be much obliged to you if you will be pleased to carry me down Shoe Lane and bring me up Drury Lane again into the road by which I am to travel this devilish long journey.” The deputy informed him that if such a mischance should happen he should come to no damage. “For,” says he, “I’ll be bail for you myself, rather than you shall go back to prison again.” “Thank you heartily, sir,” quoth Jack; “I protest I could not have thought that I had a friend in the world who would have stood by me so in such a time of need.” After this he rode very contentedly to the place of execution, where he was tucked up with as little ceremony as usual. This fatal day was Wednesday, the 1st of April, in the year 1691.

1705: John “Half-Hanged” Smith Half-Hanged

Because we executioners are not bereft of sentiment, it is with glad season’s tidings that we remember the veritable rebirth on Christmas Eve of housebreaker John Smith, who was cut down from the Tyburn tree this day in 1705 and revived.

“Though the crimes committed by this man were not marked with particular atrocity, nor his life sufficiently remarkable for a place in these volumes, yet the circumstances attending his fate at the place of execution are perhaps more singular than any we may have to record,” begins the Newgate Calendar, and one can all but see our Marlow setting light to his tobacco as he makes ready to unspool a particularly satisfying yarn.

After John Smith dangled 15 minutes this day at Tyburn, the crowd at his hanging began calling for a reprieve. One gets the impression our narrator may be eliding in a sentence quite an unruly affair; that “the malefactor was cut down” we may well guess, but after a mere 15 minutes? Did the crowd overpower the sentries, or were the officers of the law simply in a Christmas spirit?

There is, too, allusion to his friends’ working to obtain clemency and failing. Family and supporters of the accused intervened at Tyburn in all sorts of meddlesome ways, when they could — pulling the condemned prisoner’s legs to shorten his suffering, or holding his legs up to give him a chance at survival; fighting with anatomists for possession of the corpse, and obviously agitating for mercy at the slightest opportunity. Was it these friends who instigated the crowd’s appeal?

Whether or not Smith’s luck was as dumb as William Duell‘s, they did cut him down, and did revive him “in consequence of bleeding and other proper applications.”

So, what’s it like to be hanged?

When he had perfectly recovered his senses he was asked what were his feelings at the time of execution; to which he repeatedly replied, in substance, as follows. When he was turned off, he for some time was sensible of very great pain, occasioned by the weight of his body, and felt his spirits in a strange commotion, violently pressing upwards. That having forced their way to his head, he as it were saw a great blaze, or glaring light, which seemed to go out at his eyes with a flash, and then he lost all sense of pain. That after he was cut down, and began to come to himself, the blood and spirits, forcing themselves into their former channels, put him, by a sort of pricking or shooting, to such intolerable pain that he could have wished those hanged who had cut him down.

All this violent commotion of the spirit was enough to score a pardon, but not quite equal to the task of reforming the man now known as “Half-Hanged Smith”.

Our narrator relates that he went twice more to the Old Bailey in some danger of his neck, escaping once on a technicality and then again upon the uncommonly timely death of the prosecutor.

Nothing more is henceforth heard of the man, and it is unknown whether he decided to stop tempting fate, or whether officers of the law were in no further mood to tempt the hand of a Providence evidently determined to protect him, or whether some still more mysterious purpose thereafter summoned him away from the worldly cares of the justices.


And laying his finger aside of his nose,
And giving a nod, up the chimney he rose;
He sprang to his sleigh, to his team gave a whistle,
And away they all flew like the down of a thistle.
But I heard him exclaim, ere he drove out of sight,
“Happy Christmas to all, and to all a good-night.”

1783: The first hangings at Newgate Prison

On this date in 1783, London’s colorful penal history moved across town.

For centuries, public executions had been carried out at the storied Tyburn gallows, a ribald, rambunctious affair that involved carting the doomed from Newgate Prison through teeming city streets, by way of ale house pit stops.

The Tyburn era drew to a close late in the 18th century. Five weeks before, its last victim swung there.


The former hanging grounds of Tyburn, sketched by William Capon in 1785. The gallery still standing was privately erected, to sell tickets to spectators eager for a view.

Little more than a month later, the curtain raised and the trap fell on a new chapter for the London hanged.

Henceforth, the processional would be dispensed with, and the condemned simply walked across a courtyard and up a flight of stairs to a public gallows just outside the prison.

These were still public executions, and hardly eliminated the carnival atmosphere as this c. 1789 sketch will attest:

But it marked a move towards, if not altogether to, a version of the death penalty more familiar to modern eyes. For one thing, the prison itself became the site of punishment, absent the elaborate and occasionally dangerous theater of the trip to Tyburn; at Newgate, they were regularized, an extension of the frightful dungeon, and as the crowd itself was controlled and separated from the elevated platform, the natural next step would be at last to withdraw inside the prison’s walls.

At the same time, there is a technological advance towards “scientific” hangings geared to minimize suffering: the ‘New Drop’.

This system, whereby a trap sprung beneath the prisoner’s feet suspended him on the gallows, was not strictly new — a form of it had been used at Tyburn as early as 1760, though not repeated.* But the new drop (still just a variety of short drop, where strangulation is likely) marks a distinct shift towards a mechanistic punishment, clearly removed from the sometimes fraught physical confrontation between a prisoner and a hangman attempting to force him or her from the cart, and an antechamber into the grim 19th century science of reckoning hangman’s drops for the precise effect of snapping (without severing) the neck.

Of course, progress always has its detractors.

74-year-old Samuel Johnson groused at the “innovation” of leaving Tyburn:

[T]hey object that the old method drew together too many spectators. Sir, executions are intended to draw spectators; If they do not draw spectators, they don’t answer their purpose. The old method was most satisfactory to all parties; the public were gratified by a procession and the criminal was supported by it.

Approaching the matter from a very different perspective, Lord Byron found the Italian beheadings of Mastro Titta “altogether more impressive than the vulgar and ungentlemanly dirty ‘new drop’, and dog-like agony of infliction upon the sufferers of the English sentence.”

* In the correspondence of an early 19th century Secretary of the Admiralty, we have confirmation of this in a letter of Sir Peter Laurie, available from Google Books here and here. Laurie reports that “something like a drop in hanging criminals”

was not adopted as the general mode of execution till 1783, when ten felons were executed on the 9th of December in that year for the first time in front of Newgate, on a new drop or scaffold hung with black … The gallows used at Tyburn was purchased by a carpenter who, having no sentiment in his composition, converted it into stands for beer butts in the cellars of a public house called the “Carpenter’s Arms” in Adam Street.

1747: Mary Allen and Henry Simms, Gallows Lovers

Gallows Love

When Oscar Wilde allegedly gestured at the garish wallpaper in his cheap Parisian hotel room and announced with his dying breath, “Either it goes or I go,” he was exhibiting something beyond an irrepressibly brilliant wit. Freud, you see, wasn’t whistling “Edelweiss” when he wrote that gallows humor is indicative of “a greatness of soul.” The quips of the condemned prisoner or dying patient tower dramatically above, say, sallies on TV sitcoms by reason of their gloriously inappropriate refusal, even at life’s most acute moment, to surrender to despair.

The Ordinary’s Accounts are some of the earliest true crime stories written in English. Their popularity came at the same time the masses learned to read, and some think there was a cause-and-effect relationship there — Englishmen learned their letters when there were some bloody good murder stories that made the exercise worthwhile.

The Accounts were, in essence, press releases issued by the Newgate prison in London after each execution to give lessons to posterity and to stimulate respect for the criminal laws. Those from the 1740s-1750s are online here.

The authors of these accounts were required to speak to the condemned every day for the weeks between the conviction and execution. They chronicled the confessions and behavior of men and women doomed to die, focusing largely on the personal history of each criminal, their crimes, and questions of faith.

In 1747, an Ordinary recorded the extraordinary story of a shoplifter named Mary Allen and a highwayman named Henry Simms, whose love was born in gaol and lasted to the gallows.

Mary Allen was 26 years old and through shoplifting had “gathered together a large Quantity of Goods of various Kinds, very near sufficient to have furnished a Shop, which it seems was her Intent; which Goods were found in a Room in Park-street.”

The Ordinary did not like Mary. She didn’t want to talk to him because she would have no speeches made about her when she was dead. He thought she was surly, obstinate. She also said it was grief enough to her parents that she was being executed, and she didn’t want to add to their afflictions with her dying quotes. The Ordinary thought it a pity she didn’t think of her parents before she embarked on her criminal career.

Since she wouldn’t speak to him, the Ordinary was forced to record his observations of her. He noted that she was of

[A] turbulent Spirit, and frequently quarrelled with her Fellow-Prisoners, and being the weaker Vessel, frequently came off damaged. When she was tried she had two black Eyes, which she got in a Quarrel; and when she went to the Place of Execution, she had a black Eye, received but a few Days before in another Skirmish. During her Confinement she contracted a great Fondness for Gentleman Harry.

Henry “Gentleman Harry” Simms, aged 30, was an orphan turned highwayman and pimp, known for his large Cutlass and his dandy clothes, and in the Ordinary’s words he was

[As] famous a Thief as ever yet adorn’d the Gallows. The Money he gain’d by Robbing he generally spent among the Whores about Covent-Garden, and as he generally wear very genteely dress’d, they gave him the Title of Gentleman Harry.

While under Sentence of Death, his fertile Brain was continually contriving Schemes in hopes to save his Life. He wrote several Letters to the Secretaries of State, and even to his Majesty himself.

While under Sentence he … still seemed found of the gay Part of Life, having a Number of Ladies coming frequently to see him, and did not appear so much concerned as one in his Circumstances should be.

What occupied Gentleman Harry in his last days was his fellow sufferer Mary Allen. They fell in love and spent their last days in intimacy (though the Ordinary also noted that “they sometimes fell out, when Simms generally beat her.”)

And on the final day, Mary Allen and Gentleman Harry indulged in hugs and kisses and hand-holding until their last moments on earth and met death with a defiant embrace.

At the PLACE of EXECUTION.

THE Morning of their Execution, after going up to Chappel, where they all behaved very devoutly, they were brought down into the Press-Yard, had their Fetters knock’d off, and was then convey’d to Tyburn … Simms was cleanly dress’d in a White Fustian Frock, White Stockings, and White Drawers; and just as he got into the Cart at Newgate, threw off his Shoes. Being arrived at the Place of Execution, some Time was spent in Devotion, in which they all most heartily joined.

SIMMS … owned the Robbery of Mr. Smith in the Borough.

ALLEN Wept a good deal, and own’d the Robbery for which she died.

And they all went off the Stage calling to the Lord to have Mercy on their Souls.

Just before they were turn’d off, Simms and Allen saluted each other; and then joyning Hands, went off, taking hold of each other.

1763: Hannah Dagoe, violently

On this date in 1763, Hannah Dagoe did it her way in “an extraordinary and unprecedented scene” at Tyburn.

A “strong, lusty”* Irish woman, her crime of theft does not much enthrall us, but her behavior on the way to the gallows would have done many a condemned wretch proud:

On the road to Tyburn she showed little concern at her miserable state, and paid no attention to the exhortations of the Romish priest who attended her. When the cart, in which she was bound, was drawn under the gallows, she got her hands and arms loose, seized the executioner, struggled with him, and gave him so violent a blow on the breast that she nearly knocked him down. She dared him to hang her; and in order to revenge herself upon him, and cheat him of his dues,** she took off her hat, cloak and other parts of her dress, and disposed of them among the crowd. After much resistance he got the rope about her neck, which she had no sooner found accomplished than, pulling out a hand kerchief, she bound it round her head and over her face, and threw herself out of the cart, before the signal was given, with such violence that she broke her neck and died instantly.

Somewhere amid that ample throng cheering on the unexpected fisticuffs under the scaffold was notable scribbler James Boswell, he of The Life of Johnson.

Boswell had come along to the spectacle to see another, less pugilistic victim of the hanging party, Paul Lewis, a respectable clergyman’s son and former Navy officer taken to highway robbery. (The third member of the doomed party was stockbroker and forger John Rice.) Boswell’s diary records the happenstance encounter with Lewis and Hannah “Deigo” that led him to Tyburn’s shadow.

TUESDAY 3 MAY.

I walked up to the Tower in order to see Mr. Wilkes† come out. But he was gone. I then thought I should see prisoners of one kind or other, so went to Newgate. I stepped into a sort of court before the cells. They are surely most dismal places. There are three rows of ’em, four in a row, all above each other. They have double iron windows, and within these, strong iron rails; and in these dark mansions are the unhappy criminals confined. I did not go in, but stood in the court, where were a number of strange blackguard beings with sad countenances, most of them being friends and acquaintances of those under sentence of death. Mr. Rice the broker was confined in another part of the house. In the cells were Paul Lewis for robbery and Hannah Diego for theft. I saw them pass by to chapel. The woman was a big unconcerned being. Paul, who had been in the sea-service and was called Captain, was a genteel, spirited young fellow. He was just a Macheath. He was dressed in a white coat and blue silk vest and silver, with his hair neatly queued and a silver-laced hat, smartly cocked. An acquaintance asked him how he was. He said, “Very well”; quite resigned. Poor fellow! I really took a great concern for him, and wished to relieve him. He walked firmly and with a good air, with his chains rattling upon him, to the chapel.

Erskine and I dined at the renowned Donaldson’s, where we were heartily entertained. All this afternoon I felt myself still more melancholy, Newgate being upon my mind like a black cloud. Poor Lewis was always coming across me. I felt myself dreary at night, and made my barber try to read me asleep with Hume’s History, of which he made very sad work. I lay in sad concern.

WEDNESDAY 4 MAY.

My curiosity to see the melancholy spectacle of the executions was so strong that I could not resist it, although I was sensible that I would suffer much from it. In my younger years I had read in the Lives of the Convicts so much about Tyburn that I had a sort of horrid eagerness to be there. I also wished to see the last behaviour of Paul Lewis, the handsome fellow whom I had seen the day before. Accordingly I took Captain Temple with me, and he and I got upon a scaffold very near the fatal tree, so that we could clearly see all the dismal scene. There was a most prodigious crowd of spectators. I was most terribly shocked, and thrown into a very deep melancholy.

The Macheath imagery, if not the melancholy, evidently stuck with the dutiful scribe, who found himself still minded of the Beggar’s Opera hero two weeks later while out on the pull.

I then sallied forth to the Piazzas in rich flow of animal spirits and burning with fierce desire. I met two very pretty little girls who asked me to take them with me. “My dear girls,” said I, “I am a poor fellow. I can give you no money. But if you choose to have a glass of wine and my company and let us be gay and obliging to each other without money, I am your man.” They agreed with great good humour. … We were shown into a good room and had a bottle of sherry before us in a minute. I surveyed my seraglio and found them both good subjects for amorous play. I toyed with them and drank about and sung “Youth’s the Season” and thought myself Captain Macheath; and then I solaced my existence with them, one after the other, according to their seniority. I was quite raised, as the phrase is: thought I was in a London tavern, the Shakespeare’s Head, enjoying high debauchery after my sober winter. I parted with my ladies politely and came home in a glow of spirits.
