1962: Georges Kageorgis, assassin

On this date in 1962, Georges Kageorgis* was shot at Usumbura (now Bujumbura) for assassinating the charismatic national figure seemingly destined to lead the country into its postcolonial age.

“It was a bit like what could have happened in South Africa if Nelson Mandela was murdered before assuming the presidency in 1994,” said one pol later.

A prince, a pro-independence nationalist, a Tutsi who had married a Hutu and spurned a tribal leadership position lest he cast too sectarian a profile, Louis Rwagasore became prime minister in the fall of 1961 on the strength of his party‘s comprehensive electoral victory.

Rwagasore admired Patrice Lumumba. He was destined to share Lumumba’s fate.

Two weeks after his election, “the one truly popular national figure” was gunned down by Kageorgis, a Greek mercenary drawing pay from Belgian settlers who reckoned a better situation (French link) for themselves with Hutu governance. A revolution of (Belgian- and Catholic-backed) Hutu in Rwanda had had a “neo-colonial” character, according to Rene Lemarchand … and it had heightened ethnic tensions in Burundi.

With the murdered prince went ethnic cohesion; the bloody Kamenge riots of January 1962 presaged worse to come as leadership in the Rwagasore-less party collapsed. Ethnic conflict sharpened through the 1960’s, with a Tutsi-dominated dictatorship ultimately gaining control of the country and setting the stage for intermittent massacres (two classed as genocides) that haunt Burundi to this day and form part of the context for the Rwandan genocide.

Rwagasore Day — October 13, the anniversary of the prince’s assassination — is still observed in Burundi. Kageorgis’s execution date is notable for other reasons: it was the last day before Belgian authority in Ruanda-Urundi officially ended.

* This Greek newspaper gives the killer’s name as Ioannis Karagiorgis.

1962: Marthinus Rossouw, for services rendered

On this date in 1962, Marthinus Rossouw was hanged in Pretoria after an unusual defense strategy failed to repel a headline-grabbing murder charge.

Rossouw shot dead Baron Dieterich Joachim Gunther von Schauroth, a rich farmer (dude was born in a castle) who had been forced into city living by a long run of drought and was known for the life expectancy-compromising habit of toting around large sums of cash.

Rossouw insisted at trial that the killing had been at Von Schauroth’s own instigation, so freighted with care was the victim’s life that he implored his younger friend to end it. The defendant hoped thereby to mitigate the sentence as a case of murder by consent.*

Whether telling the truth or not, Rossouw didn’t make a very credible witness; caught in several lies and omissions, and naturally lacking any corroborating witness to the alleged murder pact, the jury gave him no slack.

Neither did the noose.

* The proper legal handling of a case where the victim of a homicide has freely desired to die is a longstanding salami-slicing juridical problem — witness a whole chapter in an 1897 British primer on consent issues in the law.

1962: Gheorghe Arsenescu, Romanian partisan

On this date in 1962, partisan Gheorghe Arsenescu was put to death at Bucharest’s Jilava Prison.

Arsenescu was a leader and co-founder of one of Romania’s several bands of anti-communist resistance units. Arsenescu’s Haiducii Muscelului — the Muscel Outlaws — were a band of 30 to 40 in the Carpathian fooothills who scarcely posed a serious threat to the Romanian state, but who nevertheless managed to elude capture for nine solid years in the 1950’s.

Arsenescu was finally nabbed in 1960, a few months after his former comrades Toma and Petre Arnautoiu had themselves been executed. According to Revolution and Resistance in Eastern Europe, Arsenescu’s wife and father were also given long prison sentences for aiding him.

This band was perhaps most especially notable for one of its members who not only survived capture, but outlived the Communist regime: Elisabeta Rizea.

Crippled by torture, Rizea became a potent symbol in post-Communist Romania of the resistance of Arsenescu and others.

1961: John A. Bennett, the last American military execution (so far)

As of this date, it’s been 48 years since the United States military last carried out an execution — the Fort Leavenworth hanging* of John Arthur Bennett for rape.

An epileptic black soldier with a family history of mental illness, Bennett had enlisted to find a way up out of sharecropping. Instead, on Christmas Eve 1954, he drunkenly raped a 12-year-old girl near his base in Austria.

He spent six years awaiting execution — “six years,” observed the Los Angeles Times, “in which six other black soldiers were hanged while all four of the white men — many of them multiple murderers — were saved.”

Bennett dodged two execution dates, once receiving his stay during his last meal, but a seemingly compelling plea for clemency — the victim herself, and her parents, asked for mercy — availed Bennett nothing. His last frantic plea to the new president, John F. Kennedy, was dispatched with only hours yet to live.

I beg in the name of God … Will you please in the name of God and mercy spare my life?”

No dice. Kennedy was preoccupied.

Coincidentally, but poignantly for this case, the Kirk Douglas vehicle A Town Without Pity opened a month before Bennett’s execution. In that film (trailer here), four American servicemen face capital trial for the rape of a German girl — and Douglas, as their lawyer, struggles to talk pity into someone so he won’t be obliged to humiliate the victim in court in order to save his clients from the noose.

The victim’s father in that movie is so blinded by his lust for vengeance that he forces Douglas to destroy his own daughter: striking contrast with the real-life father of Bennett’s flesh-and-blood victim, who wrote in support of clemency for his daughter’s assailant, “I know how hard it is for the parents when their own child is so close to the verge of death.”

Bennett’s milestone, however, is hardly assured of lasting much beyond this 49th year.

In 2008, President George W. Bush affirmed the death sentence of condemned Army cook Ronald Gray, the first such action by any U.S. president since Bennett’s day. According to the NAACP Legal Defense Fund’s Death Row USA most current as of this writing,** Gray is one of nine prisoners currently on the U.S. military’s death row.

1960: Hoang Le Kha, NVA cadre

On this date in 1960, the former French colony of Vietnam made its last use of that most characteristically Gallic killing-machine: the guillotine.

Communist cadre Hoang Le Kha of the Vietnam People’s Army — the insurgent force also known at different times, in different manifestations, and through different eyes as the Viet Minh, the North Vietnamese Army (NVA) and the Vietcong* — earned the unpleasant distinction. According to a disappointingly truncated article (.pdf) from the Texas Tech University Vietnam Archive, the beheading took place notwithstanding an appeal pending before the International Control Commission, the multinational body charged with overseeing the supposedly temporary partition of Vietnam.

So, six years after Dien Bien Phu, what was independent Vietnam using this hated machine for?

Why, the same thing the French used it for: Terror.

The demonstrative device was redeployed in 1959 by Ngo Dinh Diem — a man whose obliviousness to blowback would soon land him in these pages — for exacting frightful, visible justice on subversive types.

According to that troubled former Secretary of Defense Robert McNamara,

On May 6, 1959, Diem signed Law 10/59, which, in an ironic bow to the former French colonial masters, inaugurated the era of death by beheading, as Diem’s lieutenants traveled the countryside with mobile guillotines and platforms, looking for “communists.” Article 1 of Law 10/59 called for “sentence of death, and confiscation of the whole or part of his property” for anyone convicted of crimes ranging from murder to stealing farm implements and water buffalo. Article 3 proclaimed that anyone belonging to “an organization designed to help to prepare or to perpetrate” such crimes “will be subjected to the sentences provided for” — that is, they will also be beheaded. … Article 16 announced: “The decisions of the special military court are not subject to appeal, and no appeal is allowed to the High Court.”

He then cites Hanoi historian Tran Van Giau’s recollection of the period.

“In 1959, the most difficult period of the revolution in South Vietnam, the Ngo Dinh Diem puppet regime dragged the guillotine everywhere and carried out a bloody fascist repression.”

Though officially downplayed overseas, all-but-summary beheadings were intentionally publicized in Vietnam in an effort to cow rebels.

The Diem government had many public executions. A lot of people in the West denied that it happened but Diem made no bones about it. They advertised the executions and there were pictures in the paper of people getting their heads chopped off by a guillotine. … In 1959, when I went around with the map teams there were many military outposts where they summarily chopped off the heads of people they thought were Communists. They put the heads on stakes right in front of their outposts, sometimes with two cigarettes up the nostrils. They even invited people to take pictures of it. They were very proud of themselves.

It didn’t work.

As a result, the guillotine itself, an archaic French model, can be seen among other dreadful mementos of that horrific war at Ho Chi Minh City’s War Remnants Museum.

1968: Nguyen Van Lem

Around noon of February 1, 1968, in the opening days of the communist Tet Offensive, South Vietnamese General Nguyen Ngoc Loan summarily executed a Viet Cong prisoner on the streets of Saigon — and photographer Eddie Adams captured perhaps the war’s most unforgettable image.

An American cameraman also captured it in on celluloid. Caution: This clip shows … well, a man being shot in the head at point-blank range.

Though the image brought Adams the Pulitzer Prize, he would express discomfort with it later in life, and eulogized General Loan in Time magazine when he died in the U.S. in 1998.

The general killed the Viet Cong; I killed the general with my camera … photographs do lie, even without manipulation.

For Adams, the lie was the omission of context — that the plainclothes Lem had allegedly just been caught having murdered not only South Vietnamese police but their civilian family members; that Loan was a good officer and not a cold-blooded killer.

Adams’ editor has said that many such summary executions were taking place during the Battle of Saigon — a broader context to the image no matter its specific fairness to the executioner.

But of course, the shot gained its deeper resonance from the growing disgust with the Vietnam War … and from its concise tableau of a century’s brutality. Here is a frozen image of Orwell’s boot stamping on a human face, forever.

Like any great work of art, Adams’ serendipitous photograph took on a life of its own … and a tapestry of meanings richer than its creator could ever have intended.

1961: Patrice Lumumba

No brutality, no torture has ever made me plead for mercy, because I prefer to die with my head up, with unshakable faith and deep confidence in the destiny of my country, rather than live in submission and spurning of scared principles.

One person’s “murdered under controversial circumstances” is another person’s “executed.” By most unbiased accounts, Patrice Lumumba was both.

A strident anti-colonialist caught in the most inflammatory of Cold War power struggles, Lumumba remains a controversial figure.

In 1956, Patrice Lumumba was a mail clerk in Belgian Congo recently out of prison for embezzlement of post office funds. Though previously involved with the Liberal Party of Belgium, a colonialist political party, after prison, he helped found the Mouvement National Congolais, a pro-independence national party (an important distinction at the time, as most pro-independence parties were at least partially tribal in nature).

Convicted in 1959 of inciting an anti-colonial riot and sentenced to 6 months in prison, Lumumba was released early as Congo won its independence and the MNC became an important political force. Just how important became apparent the following June, when the 35-year-old Lumumba was ratified as the newly independent Congo’s first prime minister.

From criminal to high statesman in just over a year, Lumumba took his new power in stride, and watched in disgust as the deposed King Baudouin of Belgium attended the new nation’s first Independence Day celebration, and before a fawning international media condescendingly congratulated Belgium’s colonial beneficence to its former slave plantation.

Struck from the day’s official celebrations in favor of the the lukewarm exhortations of the new President Kasa-Vubu, Lumumba found time on the day’s unofficial program. Strident, emotional, and unabashed in its anticolonialist, nationalist, and pan-Africanist bent, Lumumba’s famous speech was roundly criticized by the domestic and foreign press, but well-received by the crowd and ultimately delivered directly to history.

Lumumba’s tenure as prime minister was short-lived, however.

Mere weeks after independence, a mutiny on army bases broke out in reaction to Lumumba’s ill-fated decision to leave the military out of a government pay raise. The resulting anarchy quickly spread throughout the country, and the province of Katanga, with the support of King Baudouin and powerful mining companies, declared independence. As United Nations troops failed to quell the situation, Lumumba appealed to the Soviets, whose intervention succeeded only in causing Lumumba’s political support to crumble.

Kasa-Vuba dismissed Lumumba in September; in response, Lumumba declared Kasa-Vuba deposed — quite illegally, as it happens — and appealed to the Senate, from whom he managed to win a vote of confidence.

At this point, in the heat of the Cold War, things got interesting.

Deposed again, this time in a CIA-endorsed coup, Lumumba found himself under house arrest and under the protection of UN troops. Not certain whether to trust the rule of the various laws surrounding him, Lumumba slipped out under the cover of night and escaped to nearby Stanleyville (now Kisangani), where he believed he had enough supporters to set up his own government — and army, whom one supposes he had by then resolved to pay rather better.

Pursued by forces loyal to the new government, Lumumba was captured and arrested in early December 1960 and charged with “inciting the army to rebellion.” Devoid of his former UN protection, the man who would be the leader of a newly free nation watched as he became a pawn in a much larger struggle. UN Secretary General Dag Hammarskjöld appealed to the process of law –- whatever that was –- while the USSR jumped a step ahead, demanding that Lumumba be immediately released and reinstated as prime minister and all UN forces withdrawn.

So much for that. The UN Security Council convened, and, a week later, the USSR’s resolution was defeated. Another, Western-backed resolution that would have given the UN power to act as impartial arbitrator was vetoed by the USSR.

At this point, caught between hostility of Cold War politics and the ever-hazy idea of “international law,” Lumumba languished in the military barracks of an even more hostile government. Hearing of plans for his transfer to barracks at the now-subdued Katanga province, Lumumba was wild on the plane trip and was forcibly restrained after appealing to other passengers to intervene on his behalf. Late at night after his arrival at his new prison, Lumumba was driven to an isolated spot and executed by firing squad. News of his death was not released until three weeks later, when it sparked protests in several European cities over the role of the Belgian government, which denied any involvement.

The extent of US and Belgian involvement in Lumumba’s death remains the subject of ongoing speculation. So does the question of what might have been.

1963: Henry John Burnett, Scotland’s last hanging

On this date in 1963, the executioner paid his last call to Scotland with the hanging of Henry John Burnett for the murder of a rival-in-love seaman.

The type whom parents hope their daughter never dates, Burnett liked to keep his squeeze Margaret May Guyan under lock and key to keep her stepping out on him.

It’s an old, old tale. Boy meets girl, boy makes girl his prisoner, girl gets creeped out and returns to estranged hubby Thomas Guyan at 14 Jackson Terrace in Aberdeen, boy blasts Guyan in the face with a shotgun. How many times have we heard it told?

Even though the noose was on its way out — this is not only the last execution in Scotland, but the only hanging in Aberdeen in the past century and a half — there wasn’t much pussyfooting around when they’d made up their mind to use it: Burnett outlived his victim by only eleven weeks — notwithstanding an insanity plea and clemency petitions from both his own and the victim’s families — before hanging at Craiginches Prison, a facility that surely ought to be somebody’s porn name.

1964: Gwynne Owen Evans and Peter Anthony Allen, England’s last hangings

At 8 o’clock in the morning this date in 1964, two gallows traps 50 kilometers apart opened simultaneously — dropping the last two men England ever hanged.

Gwynne Owen Evans and Peter Anthony Allen couldn’t have been much smaller fare for a milestone as momentous as the last entry in England’s copious annals of execution.

The two twentysomethings had dropped by Evans’s former coworker’s place in the aptly-named port Workington to borrow money. Since the call was at 3 a.m. and the petitioners were armed, it might appear that they had in mind an offer that John Alan West couldn’t refuse. The reader is invited to fill in the rest: a quarrel, a murder, a stolen watch, a medallion dropped at the crime scene with one of the perps’ own names on it …

Three months later, they were on trial for their lives; a month after that, hanged by the neck until dead. If there is tragedy in these hapless thugs, it may be that either could possibly have saved the other by claiming sole responsibility for the murder; since each blamed the other, the jury ended up finding them equally culpable.

While the last hangings in Canada featured two unconnected men hanged together, the last in England had partners in crime hanged separately. Allen died at Liverpool’s Walton Prison; Evans was dropped at Manchester’s Strangeways Prison.*

And unlike the Canadian case, Evans and Allen didn’t die knowing they were likely the last.

Although hangings had slowed to a crawl in Britain — there were just two in 1963, and none in 1964 before this day — death sentences continued to be handed down. But the trend was toward abolition: the British Parliament suspended the death penalty for ordinary crimes late in 1965, and made the suspension permanent in 1969. The handful of exceptional crimes for which the gallows remained nominally available — treason, piracy, espionage — were never enforced as such before those statutes too were removed from the hangman’s jurisdiction by 1998.

1962: Adolf Eichmann

On this date in 1962, the architect of the Final Solution received such justice as could be meted to him on earth at Israel’s Ramla Prison.

Adolf Eichmann, the vacuum cleaner salesman turned SS Obersturnbannfuhrer, remains the only person judicially executed in the history of modern Israel, whose intelligence services kidnapped him from Argentina where he had settled after the war.

Other Nazis had used the “only following orders” defense with little success in the Nuremberg Trials shortly after World War II. On trial years later (and at the hands a Jewish state) Eichmann — a bookish, unmenacing man who invoked Kant — posed the questions of individual responsibility and human psychology in starker terms.

To be sure, he was no anonymous functionary. Neither, however, had he dirtied his nails at the stomach-churning business end of the Holocaust: rather, he had engineered the stupendous logistical project of deporting Eastern Europe’s Jews for extermination, an (impressive) accomplishment worth exponentially more lives than any Einsatzgruppe could ever account for, yet simultaneously abstract from the upshot.

Eichmann said he did it without ill-will towards its subjects — simply to obey and to achieve.

The Banality of Evil

[I]f it was of small legal relevance, it was of great political interest to know how long it takes for an average person to overcome his innate repugnance of crime, and what exactly happens to him once he has reached that point. To this question, the case of Adolf Eichmann supplied an answer that could not have been clearer or more precise.

Hannah Arendt took him at his word* and saw in Eichmann the abyss gazing back into us, into his judges — not a monster but a man unsettling in his normalcy, whose job was not TPS reports or quarterly sales results but turning humans into ash.

The company man. The career man. Every man, standing in for countless thousands more who pushed the papers that drove the trains to Auschwitz.

What for Eichmann was a job, with its daily routine, its ups and downs, was for the Jews quite literally the end of the world.

Not everyone accepts her conclusions, but Arendt’s characterization of “the banality of evil” has become the man’s epigraph. And Eichmann disturbs us precisely because we seem to be able to meet him on his terms, even sympathize with him when the horror of his crimes begs for a monster like Streicher or Goebbels we could safely consign to the Other.

Arendt’s turn of phrase has a certain breezy (hackneyed, even) life in the public discourse, but her analysis of Eichmann’s careerism remains a challenging and deeply relevant one for we heirs of the world that hanged him.
