2013: Xia Junfeng, chengguan slayer

China has announced the execution this day of “homicide criminal” Xia Junfeng, a kebab vendor from Shenyang.

This case has been in the public eye for several years, and the predominant sentiment has been sympathetic towards the condemned man.

Xia and his wife Zhang Jing were part of China’s vast population of working urban poor, Xia having found his way into job insecurity by virtue of a layoff from the state electricity company. In the entrepreneurial spirit of the age, Xia started up an unlicensed business selling sausages and the like.

These denizens of the gray economy are, as a class, afflicted by the attentions of the City Urban Administrative and Law Enforcement Bureau, better known as the chengguan. Their benign job description entails administering municipal regulations, but this much-loathed force’s relationship to everyday citizens is perhaps best illustrated by the word chengguan‘s status as a shorthand neologism for bullying and abuse. Too many people know this goon squad firsthand, and too many stories of their worst excesses have circulated. Just this past July, the chengguan made headlines by killing a watermelon vendor.

“Chengguan abuses are an open scandal in China,” said Human Rights Watch’s China director. “The chengguan’s ability to flout China’s laws and inflict harm on members of the public is a recipe for greater public resentment and more violent confrontations.”

In the violent confrontation at issue in today’s execution, the chengguan chengguanned Xia Junfeng in May 2009. Xia fought back with his meat-carving knife, and slew two of his tormenters.

Death penalty cases redolent of the social stratification and institutional corruption that ordinary Chinese people experience have proven to be lightning rods in recent years.

“Extralegal violence, thus employed to compensate for inadequate regulation and an absence of authority and legal deterrence, is no longer individual behavior. Such violence exists everywhere with the permission of the authorities. It is needed because of an overriding concern for “city image” and “urban management.” Finally, when extralegal violence is not monitored by the people and the media, and not punished by the law, it is only natural for Chengguan members to feel justified. Using violence with impunity enables the Chengguans to see violence psychologically as their “privilege,” a sign of status and pride. Since the legal and political status of Chengguan is unclear, it is only natural for its members to seek personal gain, vent their anger, and prey on the citizens they were intended to protect.”

This allegation didn’t fly in court, where brother chengguan denied that they’d been abusing the shishkebaber, but it’s won in a rout when it comes to the court of public opinion. “His life and death are more than just a legal matter, but a bellwether of the era, with the tsunami-like public opinion firmly on the side of Xia Junfeng,” wrote author Yi Chen today.

Particularly galling for many is the disparity in treatment between Xia Junfeng and the likes of Gu Kailai, the latter a powerful business and political figure who was able to avoid execution despite being convicted of a scandalous contract murder. And Chengguan themselves never seem to be at risk of harsh punishment for any misbehavior; had Xia Junfeng been the one to leave that confrontation in a body bag, there certainly wouldn’t have been a death penalty case.

1537: Jurgen Wullenwever, Burgermeister of Lubeck

On this date in 1537, Jürgen Wullenwever was decapitated and quartered at Wolfenbüttel.

Wullenwever (English Wikipedia entry | German) was a merchant from Hamburg who came to the fore of a popular Lutheran movement in the Hanseatic port of Lübeck that claimed the power of its old aristocratic council for the city’s burghers.

In this capacity, Wullenwever maneuvered — vainly as it turned out — to arrest the century-long wane of the city’s influence. Lubeck in its day had been “the Queen of the Hanseatic League”. Come 16th century, it was struggling to maintain its trading preeminence against the inroads of Dutch merchants and the fragmentation of the once-mighty Hanse.

This project was doomed in its conception — there was nothing Lubeck could really have done to hold back the historical developments happening around it — and bungled in its execution. The merchant magnates of Wullenwever’s democratic coalition grew suspicious of (too-)popular religiosity.

And Wullenwever’s political high-wire act involved arrangements of convenience with the Anabaptist commune of Münster — spurring rumors of his own radical baptist conversion* — and fomenting Catholic peasant uprisings to meddle in the succession of the Danish-Swedish crown. Whatever else one could say of him, one can’t fault him for a want of daring, a quality that stood him in good stead with romantic era writers.

But Wullenwever’s allies lost their fights, and the political coalition that supported his municipal leadership soon broke up under the pressure of events.

The aristocratic party re-took power in 1535 and didn’t immediately persecute Wullenwever. But the hostile Archbishop of Bremen eventually seized the man on his territory and turned him over to a Catholic Saxon duke for punishment.

* I’m certainly not a specialist, but I’m skeptical of the claim in some sources that Wullenwever was an Anabaptist Manchurian candidate type. Wullenwever confessed to a great Anabaptist scheme … but that was under torture of enemies determined to do him to death, and it was retracted before his execution. The claim implies that all of northern Germany might have gone over to a radically democratic Anabaptism had not the ancien regime overthrown the Burgermeister, and for that reason it’s gained Wullenwever the surprising latter-day embrace of nationalists and revolutionaries.

1681: Leticia Wigington, apprentice-flogger

On this date in 1681, Leticia, Letitia, or Laetitia Wigington was hanged at Tyburn for beating her apprentice to death.

A case that would presage the next century’s better-remembered Brownrigg outrage, the Ratcliff Catholic coat-maker Wigington and her lodger John Sadler took five quid from one of Sadler’s fellow-sailors to apprentice their daughter.

On Christmas Eve 1680, Ms. Wigington took exception to the 13-year-old Elizabeth Houlton’s performance or caught her stealing from them or something, and set about thrashing her. After taking an hour to fashion a cruel cat o’ nine tails so they could really give it to her, these two

stript the poor Child barbarously and immodestly stark naked, and [Wigington] held her and ram’d an Apron down her Throat, to prevent her crying out, and the foresaid [Sadler] most inhumanely whipt her for 4 hours or more, with some short intervals of their Cruelty, and, having made her body raw, and all over bloody, sent for Salt, and salted her wounds, to render their Tortures more grievous. Of which Savage usage she dyed next morning [i.e., Christmas].

Salted her wounds?

Sadler fled, and was on the run for nearly a month; he was sentenced to die on February 25 and specifically prohibited from pleading for royal pardon before his March 4 execution.

Wigington got off a little “easier”, pleading her belly after a January conviction and delaying execution all the way to September 9. That’s quite a wait — a suggestive wait, one might think, though no actual record remains to confirm that Wigington left a little bundle of joy behind her to the world’s cat o’ nine tails.

For her part, Wigington went to her death asserting her innocence — “as the Child unborn” — and denouncing her enemies for inducing her “Apprentice Rebecca Clifford by name, who was not full 12 years of age, to swear against me” falsely.

1686: Jonathan Simpson, merchant turned highwayman

Jonathan Simpson, hanged on this date in 1686, had a good many virtues to judge by the account of his life left by the Newgate Calendar.

He was, first, an enterprising man, who served his apprenticeship “with reputation” and then set up shop as a successful linen-draper in the city of Bristol.

This business enabled him to augment the fortune of his own business by marrying a merchant’s daughter — “but the union proved unhappy, because the young lady was before engaged in affection to a gentleman of less fortune in the neighbourhood, whom her father hindered her from having, and with whom she continued a familiarity that soon displeased her husband.”

Such a scenario has been the germ of many a denizen of this here blog, but Simpson didn’t reach the gallows doing anything as straightforward as murdering his rival or his spouse out of pique.

Instead — and the Calendar leaves the hows and whys of this translation unexplored — he channeled his jealousy into a crime spree. Maybe that’s just the writer’s projection: fella went around the bend, it must’ve been because of a woman. The Newgate Calendar, too, had a home life, and many was the Briton who dreamt of escaping the drudgery of it all for a life of adventure and romance making gentlemen stand and deliver.

At any rate, Simpson managed a career of 18 months on the road, burning through his linen-draper savings (and his highwayman “earnings”) to escape a couple of potential capital prosecutions. (At this time, criminal complaints were initiated by private prosecutions, meaning that a victim prepared to accept direct restitution could potentially be bought off pressing a case.)

This brings us to another of Simpson’s admirable qualities: his silver tongue.

One can only speculate how he wheedled his onetime victims behind closed doors to drop their suits. But the Newgate Calendar attests to the man’s wit under pressure once he was finally hauled to the fatal tree.

It turns out that Simpson did well in business because his family had done well in business before him, and dad staked him to £1,500 when the lad went into business himself. These prosperous burghers accordingly rallied to exert their own wealth and influence behind the scenes to obtain for their kin a timely commutation, delivered only “when he was at Tyburn, with the halter about his neck, and just ready to be turned off in company with several others.” Then bureaucracy happened.

When he was brought to the prison door, the turnkey refused to receive him, telling the officer that, as he was sent to be executed, they were discharged of him, and would not have anything to do with him again, unless there was a fresh warrant for his commitment; whereupon Simpson made this reflection: “What an unhappy cast-off dog am I, that both Tyburn and Newgate should in one day refuse to entertain me! Well, I’ll mend my manners for the future, and try whether I can’t merit a reception at them both the next time I am brought hither.”

That’s kind of funny, right? In a self-destructive braggadocio sort of way?

And then Simpson demonstrated a third quality that (in addition to dad’s money) helped him succeed in commerce before his midlife crisis: his phenomenal industry. Simpson, we are told, committed “above 40 robberies” in Middlesex in the six weeks after his reprieve, a healthy pace of one per day.

He robbed the powerful (our writer credits him with a successful stickup of the king’s own son); he robbed the hoi polloi (“the robberies he committed on drovers, pedlars, market-people, etc., were almost innumerable”); he robbed on ice skates;* when he was finally captured, it was by two captains of the Foot Guards whom he was also attempting to rob.

The man lived to rob. On this date in 1686, he finally died for it.

* The online text versions of the Calendar notice Simpson’s skatebourne pilfering during “the great frost of 1689, which held thirteen weeks,” obviously not chronologically correct relative to his execution date. This is an error, likely on the part of software somewhere along the line; the year in question should be 1684 (computers like to mix up fours and nines). 1684 was one of the longest and deepest winter freezes on record, leaving the iced-over Thames bustling with Londoners at the “Frost Fair”.

1936: Josep Sunyol, FC Barcelona President

FC Barcelona is many a sportive leftist’s major European football side of choice, thanks to the club’s longtime identification with its city’s Catalan anti-Francoism.

That identification, stretching all the way back to the club’s formative early-20th century years (“History of FC Barcelona” enjoys its own voluminous Wikipedia page) put the Barca president at the end of fascist guns on this date in 1936.

Josep Sunyol was born into the Catalan elite, and had a varied career in the public eye: left activist, parliamentary deputy, newspaper founder, and, come 1935, president of FC Barcelona. He’d been serving on the Barca board of directors since 1928. There’s a lengthy Sunyol biography here.

It was in his political, rather than his footballing, capacity that in August 1936 — just days into the Spanish Civil War — Sunyol traveled from Barcelona to Madrid to meet with fellow Republicans.

He never made it back.

On the return trip from Madrid, Sunyol’s chauffeured car flying the Catalan senyera was stopped by pro-Franco Falangist forces in the Sierra de Guadarrama north of Madrid. It may have been only inadvertently that Sunyol crossed this checkpoint of nationalists, who were already gathering for an attack on Madrid that would eventually inspire For Whom The Bell Tolls. (Indeed, this novel is set in the Sierra de Guadarrama.)

Whatever Sunyol’s intention, he was quickly recognized and detained by his foes on the evening of August 6. Shortly thereafter, they decided to shoot him out of hand.

The civil war and the era of Franco are still sensitive topic in Spain, but FC Barcelona’s politically engaged supporters have pushed the present-day club (with partial success) to more overtly embrace its anti-fascist “martyr president”.

1813: Johann Christian Claudius Devaranne

Two centuries ago today, Johann Christian Claudius Devaranne got himself shot for resisting Napoleon’s draft in Germany.

The Corsican had fallen back following the debacle of occupying Moscow, but the attempts of Napoleon-allied forces to recoup dwindling numbers by conscription provoked fierce resistance in Solingen — where the draft board was driven out and recruiting materials destroyed.

This little flare-up goes by the excellent title of the “Russian Truncheon Insurgency,” but it soon ran into the bayonets of Napoleon’s German partners. On January 30, 1813, a week after draft riots first erupted, troops began suppressing it. Devaranne, a 29-year-old father of five, was seen as a leader in the resistance and a price put out on his head … a price his own maid collected when the fugitive innkeeper was reckless enough to sleep at home one night.

He was tried and shot at Dusseldorf months later, during a lull in the year’s bloody campaign season.

For the 120th anniversary of Devaranne’s execution — which was also six months into Adolf Hitler’s Chancellorship — Solingen dedicated a memorial plaque to Devaranne, claiming his nationalist martyrdom as its own.

“It is no accident that precisely the Third Reich celebrates the memory of this hero. The same spirit which animated Devaranne, animates our SA as well,” said the city’s Lord Mayor. (There was an SA honor guard on hand for the occasion.) “Then as now, we revolt against repression, then against the Corsican, today the SA’s revolution against the Marxists. We need the memory of our heroes to redirect us to their spirit in dark hours.”

The plaque went missing after the war, but Devaranne still has a street named after him in Solingen.

1644: Joost Schouten, LGBT VOC VIP

On this date in 1644, Joost Schouten, the able merchant and diplomat of the Dutch East India Company, “was strangled and burned to ashes in my presence in Batavia [Jakarta] because of his gruesome sodomy.”

That’s the report of Gijsbert Heeck who, like Scouten, left a noteworthy memoir. Heeck allowed that Schouten “was a man of unusual knowledge and extraordinary intellect,” but despite his gifts remained “in his heart … a hypocritical villain and seducer of many, secretly using his prominence and great authority to force them away from the path of decency into the way of his shameful foulness, seeking thereby to satisfy his devilish lechery.”

Before all that devilish lechery stuff came to light, Joost Schouten (English Wikipedia link | Dutch) had enjoyed a brilliant two-decade career in the Far East, most notably in Siam. There, Schouten ingratiated himself with the Siamese king Prasat Thong,* winning lucrative trade concessions, personal honors, and a seat for himself on the East India Company’s executive organ, the Council of the Indies.

A report that Schouten initially wrote for that company surveying Siam’s geography, people, and politics was published in 1638 and translated into many tongues: he was the first general account of Siam for Europeans. While several others would follow (pdf) in the 17th century, Schouten’s Description remains an essential source for the period.

Schouten himself was no mere observer in the ferocious scramble for colonial position and trade leverage in East Asia. It’s for this august person that the explorer Abel Tasman (as in Tasmania) named Schouten Island (off the coast of Tasmania). That was on the voyage that Tasman undertook to circumnavigate Australia, and discover (for Europeans) New Zealand — a voyage outfitted by Joost Schouten. Given another decade, with Dutch commerce on the come, who knows what heights he might have attained.

But the envoy’s scintillating service record did him little good when a handsome French halberdier repulsed by Schouten’s advances entrapped him in June 1644. This was an offense the Company took incredibly seriously.

Schouten confessed the crime voluntarily, and the only consideration the judges showed him was a pre-burning mercy strangulation. Their verdict, according to Peter Boomgaard, evinced “fear for the punishing hand of God if those who ruled did not take drastic measures.” Schouten was an educated man; indeed, he himself had been a judge. All the worse that, where he had wrought his best service for the Dutch Republic, he had also consciously invited its undoing in a hail of fire and brimstone.

One could, on the other hand, say that it was the Company itself that tempted divine wrath. After all, those in its service routinely spent months in overwhelmingly male environments: ships at sea, and trading outposts that were by now barred to European women. (Local women were a different story, of course.) Nor was Schouten’s particular stomping-grounds of Siam near as virulent in its attitude towards homoeroticism as the Calvinists back home; Schouten’s own travelogue noted that “their Priests, as well as many of the Gentry, are much given to Sodomy, that unnatural passion, being esteemed no sin, nor shameful thing amongst them.” Abroad on the blooming East, coinpurse bursting with the commerce of nations: it must have been a heady experience.

Whether coming around to the Siamese “esteem” or having nurtured it from the start, Schouten had, he said, indulged same-sex encounters** with some 19 different men since putting to sea from a return visit to the mother country in 1637. At least three of those partners — a boatswain’s mate, a soldier, and a burgher — were to their sorrow alive and conveniently identifiable in the Indies.

“Those who were known [to have taken part in his deeds] were, either with him, or later … smothered under water since they were unworthy to continue living among humans,” concluded our eyewitness Gijsbert Heeck. “Which is a fitting recompense and retribution for their gruesome life on earth. In the hereafter, however, the worst is still to come. But it is not for us to judge.”

* Prasat Thong, a law-and-order type, is alleged by the account of another 17th century Dutchman to have personally conducted some executions.

** Schouten, 40ish at his death, said that he was always the “passive” (penetrated) partner in these affairs with much younger men. (This, and all the text that follows it in the post, is also as per Boomgaard.)

1944: A day in mass executions in Axis Europe

June 29, 1944, saw several noteworthy mass executions around Axis western Europe.

France: Seven Jewish hostages for the assassination of Philippe Henriot

Poet and journalist Philippe Henriot (English Wikipedia entry | French), the “French Goebbels”, was the Vichy government’s able chief propagandist.

On June 28, 1944, Henriot was assassinated by Maquis operatives disguised as milice paramlitaries.

Incensed, the real milice this morning gathered seven Jews already held in prison as hostages at Rillieux, drove them to the cemetery, and shot them one by one.

(Paul Touvier, who orchestrated this retaliatory execution, managed to stay underground until 1989. At his 1994 war crimes trial, he claimed that the Germans wanted 30 hostages killed, and therefore what he actually did was “save 23 human lives.” Touvier was convicted on the charge of crimes against humanity.)


Italy: Massacres in San Pancrazio, Cornia, and Civitella

As dawn broke this date, German soldiers retreating from liberated Rome fell upon several Tuscan villages.

German columns had been beset by partisans on the way, and standard operating procedure was to retaliate against partisans indirectly, by killing civilians — as in the notorious massacre in the Ardeatine caves. This vengeance was visited on the three towns: over 200 civilians were summarily executed on June 29, 1944.

“My mother later said she went to speak to my father,” remembered one San Pancrazio man. “A soldier turned her back and told her they were taking him to be tortured. She and my father both cried.” The father and those taken with him were shot in the basement of a farmhouse.

The towns themselves have kept this date in remembrance, but the massacres were swept under the rug in the postwar settlement as Italy, Germany, and their former western enemies realigned for the Cold War. Only in the 21st century have they come to wider attention, when the discovery of secret archives documenting the atrocities enabled an Italian court to convict an aged German soldier in absentia.

1858: William and Daniel Cormack, for murdering John Ellis

“Land agents” — the rent-squeezing fist of distant landlords — were not popular people in Ireland. These bill collectors literally ran people out of house and home: one late 19th century land agent in Ireland recalled in his memoirs having received over a hundred threatening letters and, in November 1884, having his house in Kerry dynamited.

So the 1857 murder of Tipperary land agent John Ellis drew little surprise (his life had been attempted at least twice before, when he evicted people to prospective starvation during the Great Famine), and drew scarcely any mourning.

“He had been earning this for many a year, if any man however bad could be said to earn such an end, by turning people out in the road,” an observer noted. That observer was the Archbishop … talk about a tough crowd.

Since £90 had been left undisturbed in the murdered man’s pockets, authorities were pretty sure it was no passing robber that got the best of John Ellis but someone who targeted the hated land agent. However, the only witness — and the word applies only in the loosest sense — was the teenage cart-driver who had been ferrying Ellis home near midnight when his passenger had been shot by ambush from the bushes. Young Thomas Burke hadn’t seen anything useful.

Still, within only days, police had zeroed in on their suspects — with classic tunnel vision.

In fine, the working official hypothesis was that Ellis had been shot over a personal grudge, and not because of his distasteful profession. William and Daniel Cormack had a sister who had just given birth out of wedlock in the poorhouse; they had another sister who was known to be carrying on with John Ellis, who was a notorious cad during his downtime between evictions. The idea was that the brothers shot Ellis to preserve their one sister from the other sister’s fate.

With no actual evidence to buttress this just-so story, John Law got to twisting arms. An 11-year-old girl was parked in solitary confinement for two months to try to get her to incriminate the Cormacks.

The child, to her glory, stubbornly refused to do so. But Thomas Burke, the cart-driver, could not equal her steel. After initially deposing that he had seen nothing — it was very dark, after all — he managed to “remember” that he actually had seen the Cormacks on the scene after all. Another man also “verified” this testimony.

On the strength of these eminently impeachable eyewitnesses the Cormacks were doomed to die. Burke would later admit that he lied, and 2,000-plus people signed a petition pleading for a pardon.

None was forthcoming.

Mounting a public scaffold at Nenagh for a crowd welling with pity, Daniel Cormack made a dying declaration that everyone believed: “Lord have mercy on me, for you know, Jesus, that I neither had hand, act, nor part in that for which I am about to die. Good people, pray for me.”

This rank injustice only rankled more* as years passed.

Fifty-two years later the hanged boys were exhumed from their graves in Nenagh Gaol and given a long honorary procession to their native town of Loughmore, where they were laid to rest in a prominent white mausoleum that can still be visited today.

The plaque at that structure records the closest thing to the verdict of history upon the case:

By the Irish Race in memory of the brothers DANIEL and WILLIAM CORMACK who for the murder of a land agent named ELLIS were hanged at NENAGH after solemn protestation by each on the scaffold of absolute and entire innocence of that crime, the 11th day of May 1858. The tragedy of the brothers occurred through false testimony procured through GOLD and terror, the action in their trial of JUDGE KEOGH, a man who considered personally, politically, religiously and officially was one of the monsters of mankind, and the verdict of a prejudiced, partisan packed perjured jury. Clear proof of the innocence of the brothers afforded by ARCHBISHOP LEAHY to the VICEROY of the day but he nevertheless gratified the appetite of a bigoted, exterminating and ascendancy caste by a judicial murder of the kind which lives bitterly and perpetually in a nation’s remembrance.

From the coachman who was driving at the time that Ellis was shot.
They said that they were innocent, but ’twas all of no avail.
They were handcuffed and made prisoners and conveyed to County Gaol.
At the Spring Assizes these two young men stood their trial in Nenagh town.
By a packed jury of Orangemen, they were guilty found.
The judge addressed the prisoners. He asked what they had to say
Before he signed their execution for eleventh day of May.

“In Mill Killara we were reared, between Thurles and Templemore,
Well known by all inhabitants around the parish of Loughmore.
We’re as innocent of shooting Ellis as the child in the cradle do lie,
And can’t see the reason, for another man’s crime, we are condemned to die.”
The execution it took place, by their holy priest reconciled, their maker for to face.
Such thunder, rain and lightning has ne’er been witnessed since
As the Lord sent down on that day, as a token of their innocence,
That their sould may rest in heaven above as their remains rest in Loughmore.

1979: Rahim Ali Khorram and Habib Elghanian, millionaire businessmen

Iranian Revolution firing squads claimed seven lives on this date in 1979, including two multimillionaire businessmen.

One of the businessmen was Rahim Ali Khorram, “an immensely rich contractor who built roads and airports for the government, and sometimes used his 2,000-man work force as a political shock force in support of the Shah.” That quote is from a New York Times profile of Khorram’s son, Hossain, who says that he himself was led out for a mock-execution not long after. (Hossain also says that his father was dead or dying of a heart attack as he was dragged out for execution.)

The charges against Khorram pere consisted of “operating gambling dens, cabarets and a prostitution ring* and feeding a man to a lion in his amusement park.” No lie. He was supposed to have an entire secret necropolis in that park stuffed with the bodies of his enemies. (New York Times, May 10, 1979.)

Habib Elghanian

The other businessman was the Jewish-Iranian plastics mogul Habib Elghanian.

Elghanian was the first Jewish person executed during the Iranian Revolution. His death on charges of spying for Israel, fundraising for Israel, and “friendship with the enemies of God” for having met with Israeli politicians, greatly alarmed Iran’s Jewish community: many fled the country, something Elghanian had pointedly refused to contemplate.

Though Elghanian allegedly claimed not to be a Zionist, he had investments and contacts in Israel — and a radio denunciation made clear to what extent such an association would be anathematized going forward.

He was a disgrace to the Jews in this country. He was an individual who wished to equate Jewry with Zionism … the mass of information he kept sending to Israel, his actions to achieve Israel’s designs, the colossal sum of foreign exchange and funds he kept transferring to Israel; these are only samples of his antinational actions; these were the acts used to crush our Palestinian brethren. Weirdly, this execution has made news more recently: the Stuxnet computer worm, which is widely thought to have been engineered in Israel to attack Iran, contains the string 19790509. It’s been hypothesized that this apparent reference to May 9, 1979 might allude to Elghanian’s execution.
