1381: Eppelein von Gailingen

On this day in 1381, probably the most infamous robber baron in Germany was flogged, done in on the breaking wheel, and beheaded in Postbauer, near Nürnberg.

Eppelein von Gailingen (or Egkelein Geyling, or some variation thereof) has been dramatized across the ages, but little is known of the man’s life. His death, certainly, but his life is clouded in myth and folklore. What’s clear is that von Gailingen met his grisly end for robbery and a subsequent escape from incarceration. The rest is a tad murky (German link).

Von Gailingen belonged to the class of original robber barons, who supplemented their income with unauthorized tolls and, sometimes, flat-out theft. While the term is more popularly known for its application to the so-called industrial robber barons, it derived from a literal description from centuries past — Raubritter, in German, “men of birth who elected to live, in a lawless age, by saddle and by sword; who sought gain by masterful spoliation, and strove for glory by despiteful deeds of arms.” (Source)

A combination of factors led to the slow and steady dissolution of the former feudal system in favor of a money-based economy during the Middle Ages, and after the Plague swept through Europe around 1350, the accumulated changes and decimated population left much of the continent short on labor and, as a result, short on production. This really was a spot of bother for barons who, unlike their monarchical brethren, had no way to draft extra manpower. With resources thinning and a social lifestyle to keep up, many of these former lords turned to theft and exploitation. Although Rome established the rules governing tolls and trade, many local lords, now charged with obeying distant regulations, opted for a more convenient route: they stopped ships at unauthorized points, shook down the merchants, and sometimes seized wares to stock their own shelves.

Eppelein von Gailingen (German link), a lord in the castle at Gunzenhausen, near Illesheim, was of this group, but apparently one of its more bold and populist members.

He was often felt to be a kind of Robin Hood, and the earliest celebrations of the man were largely in this vein: a knight’s knight, fighting against an out-of-control state disregarding its people. Eppelein got away with his skulduggery until 1369, when he was captured by a political rival and imprisoned in Nürnberg. Von Gailingen was sentenced to death, but shortly before his hanging, an accomplice managed to sneak him a horse, on which he rode out the tower gates and hurdled the enclosing wall and moat.

Now the leader of a loyal band of brigands flouting the Roman Catholic Church, Eppelein went on the run for six years, eventually making his way back near his home. It was there that, after six more years, his minimal forces finally yielded to the Count of Nürnberg, who carried out a much more unpleasant version of the death sentence.

Eppelein’s rise to prominence began in the 16th century, when he was immortalized by a folk song, a medium that continues to be kind to him. Locals still tell a variety of tales of his exploits, and a rendition of these classics is vaguely effected through the film Ekkelins Knecht.

Others have simply waxed poetic on the topic.

As if all that attention weren’t enough, von Gailingen’s run from the law lives on through the legend of Nürnberg: locals pushing the town on tourists claim that two hoofprints from his daring escape are imprinted in the stonework near the the castle’s five-pointed tower.* And perhaps most indicative of his endurance as a cultural icon, a neighboring town has devoted a festival to him, which is more than most robber barons of any day can claim.

* Not surprisingly, the tower was destroyed and rebuilt at least once — just five decades after Eppelein’s alleged leap. But the new sandstone structure does bear the marks of what could conceivably be a horse’s hooves.

1826: Matthew Brady, gentleman bushranger

On this date in 1826, “gentleman bushranger” Matthew Brady was hanged in the Hobart jail for one Australia’s most colorful outlaw careers.

Shipped from England on penal transportation, Matthew Brady was repeatedly flogged for escape attempts before he successfully busted out of Macquarie Harbour prison in 1824.

He made for the bush and began an 18-month spell as an outlaw, self-consciously constructing the persona of the gentleman outlaw — polite to his victims, never violent towards women, that sort of thing.

Among Brady’s best-known exploits: after the colonial governor George Arthur posted a reward for his capture, Brady posted a public counter-offer:

It has caused Matthew Brady much concern that such a person known as Sir George Arthur is at large.
Twenty gallons of rum will be given to any person that can deliver his person to me.

The authorities hunted him doggedly, and he was at last captured by settler John Batman, later famous for his founding role in the history of Melbourne.

The love letters and gifts that filled his cell attested his place in the folklore, but his fate was never in question. Ever the gentleman, Brady’s main protest was sharing his scaffold with (among several other bushrangers) the murderous cannibal Mark Jefferies.

1739: Dick Turpin, outlaw legend

On this date in 1739, famed desperado Richard “Dick” Turpin rode through York on an open cart, saluting his admirers, then sat upon his gallows at the York raceway for half an hour, chatting with spectators and executioners, until he “with undaunted courage looked about him, and after speaking a few words to the topsman, he threw himself off the ladder and expired in about five minutes.”

Turpin was the ultimus Romanorum, the last of a race, which (we were almost about to say, we regret) is now altogether extinct. Several successors he had, it is true, but no name worthy to be recorded after his own. With him expired the chivalrous spirit which animated successively the bosoms of so many knights of the road; with him died away that passionate love of enterprise, that high spirit of devotion to the fair sex, which was first breathed upon the highway by the gay, gallant Claude Du-Val, the Bayard of the road — le filou sans peur et sans reproche — but which was extinguished at last by the cord that tied the heroic Turpin to the remorseless tree…

Turpin, like the setting sun, threw up some parting rays of glory, and tinged the far highways with a lustre that may yet be traced like a cloud of dust raised by his horse’s retreating heels.

The cloud hasn’t settled since William Harrison Ainsworth wrote those words.*

The “knight of the road”, one understands, is an artifice — a romantic construct. One name to bear its lustre to the present may be as good as another. Even so, in Dick Turpin, it has an exponent who bore very scant resemblance to the archetype … save for celebrity.

Turpin washed out of his apprenticed career as a butcher and took to the road, where he joined the “Essex Gang”. Far from dashing post-road stickups, this troupe specialized in invading domiciles where they would torture women into revealing the household stashes of valuables.

Turpin’s highwayman career commenced when the gang was busted — our principal leaping out a window to evade capture — and he had a profitable couple of years plundering the traffic around Epping Forest.

Many are the colorful tales of Turpin’s career; the one of most moment for his legacy may be this chance encounter with a fellow outlaw, as related in the Newgate Calendar.

On a journey towards Cambridge, he met a man genteelly dressed, and well mounted: and expecting a good booty, he presented a pistol to the supposed gentleman, and demanded his money. The party thus stopped happened to be one King, a famous highwayman, who knew Turpin; and when the latter threatened destruction if he did not deliver his money, King burst into a fit of laughter, and said, “What, dog eat dog? — Come, come, brother Turpin; if you don’t know me, I know you, and shall be glad of your company.”

The well-mannered Tom King — “the gentleman highwayman” — seems to have had his courteous mien conjoined in legend with his much more villainous partner’s prolific career.

Nor is King the only fellow-outlaw whose exploits Turpin has absorbed.

Our anti-hero’s days pillaging the environs of London came to an end in an escapade that saw Turpin shoot his accomplice while trying to rescue him — a klutzy critical miss not usually associated with the swashbuckling rogue character kit. The dying King is supposed to have repaid this bit of friendly fire by revealing to the authorities the pair’s Epping Forest hideouts.

Escaping capture once again, Turpin changed his address, and it is said that the highwayman shed his pursuers with a marvelous 200-mile ride north to Yorkshire in 15 hours.

This feat was not Turpin’s originally, but ascribed to the 17th-century robber John “Swift Nick” Nevison, although even that might be folklore.

Ainsworth, bless his heart, fabricated (pdf) the Turpin ride in the interest of his yarn — “they were distancing Time’s swift chariot in its whirling passage o’er the earth … [Turpin] rode like one insane, and his courser partook of his frenzy. She bounded; she leaped; she tore up the ground beneath her; while Dick gave vent to his exultation in one wild prolonged halloo.” (Picturesquely, he rides his famous steed Black Bess to death on the trip.)

The story has been fixed ever since in the firmament, and licenses every pub along the route to claim Turpin’s patronage.

His end, if not heroic, was certainly attention-grabbing. Turpin settled in Yorkshire under the alias “John Palmer” and passed as a gentleman farmer … with a larcenous side business rustling stock.

His career, in a sense, had come full circle: ’twas a youthful cost-cutting practice of abducting animals that had put the kibosh on his legitimate butcher’s business.

His cover was blown most ingloriously, when he was detained as a possible horse thief and sent a pseudonymous letter to his brother in London asking for help. The brother was too cheap to pay the postage due, so the letter returned to the post office where Turpin’s schoolmaster chanced to see writing in a hand he recognized, and journeyed to York to identify the wanted man and pocket the reward.

So it was not housebreaking, highway heists, or his homicide that hung Turpin, but horse-rustling … although Turpin’s celebrity career attracted curiosity-seekers from far and wide when word of his capture got out. Whatever Ainsworth may have made of Turpin, he did not fabricate the man’s fame; Dick Turpin earned his own ballad sheets and made his own legend possible playing the man at his death.

This man lived in the most gay and thoughtless manner after conviction, regardless of all considerations of futurity, and affecting to make a jest of the dreadful fate that awaited him.

Not many days before his execution, he purchased a new fustian frock and a pair of pumps, in order to wear them at the time of his death: and, on the day before, he hired five poor men, at ten shillings each, to follow the cart as mourners: and he gave hatbands and gloves to several other persons: and he also left a ring, and some other articles, to a married woman in Lincolnshire, with whom he had been acquainted.

On the morning of his death he was put into a cart, and being followed by his mourners, as above-mentioned, he was drawn to the place of execution, in his way to which he bowed to the spectators with an air of the most astonishing indifference and intrepidity.

When he came to the fatal tree, he ascended the ladder; when his right leg trembling, he stamped it down with an air of assumed courage, as if he was ashamed of discovering any signs of fear, Having conversed with the executioner about half an hour, he threw himself off the ladder, and expired in a few minutes.

The spectators of the execution were affected at his fate, as he was distinguished by the comeliness of his appearance … The grave was dug remarkably deep, but notwithstanding the people who acted as mourners took such measures as they thought would secure the body: it was carried off about three o’clock on the following morning; the populace, however, got intimation whither it was conveyed, and found it in a garden belonging to one of the surgeons of the city.

Having got possession of it they laid it on a board, and carried it through the streets in a kind of triumphal manner, they then filled the coffin with unslacked lime, and buried it in the grave where it had been before deposited.

1758: William Page, forgotten highwayman

This date in 1758 marked the hanging of a somewhat more down-market highwayman than we have seen in these parts — the son of a farmer whose scrapes on the lam and gift for evading justice might have served for the day’s gallows-foot mongers, but left little worth posterity’s time.

We’ll bypass the folklorish purported early events of Page’s life — watery graves narrowly survived, further to the proverb that he who is born to be hanged shall never be drowned — to find him a young man bereft, like so many such, of station or direction until a short stint as a livery servant delivers him to a new career:

[Page’s] master having been robbed on his way to town, he formed a notion that highway robbery was an easy and profitable mode of living, and determined that so soon as he should have the means of starting in the profession he would become a “gentleman of the road.”

Page applied a bit of ungentlemanly industry to his apprenticed profession, which seem to have profited his longevity at the expense of his legend.

[H]e had drawn, from his own observation and for his private use, a most curious map of the roads twenty miles round London, and, driving in a phaeton and pair, was not suspected for a highwayman.

In his excursions for robbery he used to dress in a laced or embroidered frock, and wear his hair tied behind; but when at a distance from London he would turn into some unfrequented place and, having disguised himself in other clothes, with a grizzled or black wig, and saddled one of his horses, he would ride to the main road and commit a robbery. This done, he would hasten back to the carriage, resume his former dress, and drive to town again.

Meanwhile, he robbed, gambled it away, made love, was taken by his paramour, revenged himself by more robbery, and so forth.

Page’s habit of going about in disguise helped him dodge several capital charges on account of the difficulty of identifying him. But, you know — ever thus with deadbeats (at least in these pages): one finally stuck, and Page expiated his unusual career in the usual way at Maidstone.

1719: Nicholas Horner, a minister’s son

On this date in 1719, Nicholas Horner was hanged for his highwayman career.

Actually, he was lucky to have made it to his thirties, having dodged the noose thanks to the old man after his first condemnation.

THIS unhappy wretch was the younger son of the minister of Honiton, in Devonshire, and was a very wild untoward child even from infancy. However, his indulgent father, in order to provide for him, bestowed as much learning upon him as qualified him to be clerk to an attorney … but he soon falling into extravagant company, and addicting himself very much to drunkenness and whoredom, ran away from his master before he had served him three years, and betook himself to the highway in order to support himself in the pursuit of those vices. He had such ill luck, nevertheless, in his new profession, as to be taken in the very first robbery he attempted to commit, and accordingly … brought to trial and condemned. However, his father made such interest for him at Court that Queen Anne, who was always known to have a great veneration for the clergy, in consideration of his father’s being one of that order, was prevailed upon to grant him a pardon, upon condition of his being transported out of her Majesty’s dominions, and not settling in any part of Europe for the term of seven years, within six months after his going out of jail.

The Newgate text then indulges a picturesque excursion to the hinterlands, with Horner shipped to India and his English wife being carried off by the Hindoos, then obliged to undergo self-immolation when her Indian husband died.

We rejoin Horner having returned home to find his parents dead. He quickly blew his inheritance and “had again recourse to the highway.”

A slow-moving highway, since his stickup schtick took some time to unfold.

One day, being upon his rambles in quest of prey, and coming up with a rich farmer — “Well overtaken, friend,” said Horner; “methinks you look melancholy: pray what may be your affliction? If you are under any misfortunes by crosses and losses in the world, perhaps it may be in my power to relieve you.” The farmer very frankly replied: “Ah! dear sir, were I to say that I have had any losses in the world, I should be telling a great lie; for I have been a thriving man all my lifetime, and should want for nothing had I but content. But indeed I have crosses enough, through a damned scolding wife at home … Wherefore, could any man tell me a remedy that would cure it, I have a hundred pounds about me in gold and silver which I would freely give him with all my heart for so great a benefit as I should receive by taming this confounded shrew.”

At the mention of the agreeable name of a hundred pounds Horner pricked up both his ears and answered: “Sir, I will first tell you the ingredients which enter into the composition of a scold, and the cause of a distemper being truly known, ’twill be the more easy to complete the cure. You must understand, then, that Nature, in making an arrant scold, first took of the tongues and galls of bulls, bears, wolves, magpies, parrots, cuckoos and nightingales, each a like number; the tongues and tails of vipers, adders, snails and lizards, six apiece; aurum fulminans, aqua fortis and gunpowder, of each one pound; the clappers of seventeen bells and the pestles of thirty apothecaries’ mortars. These being all mixed together, she calcined them in Mount Strombolo, and dissolved the ashes in water taken just under London Bridge at three-quarters’ flood; she then filtrated the whole through the leaves of Calepine’s Dictionary, to render the operation more verbose, after which she distilled it a second time through a speaking trumpet, and closed up the remaining spirits in the mouth of a cannon.

“Then she opened the graves of all newly deceased pettifoggers, mountebanks, barbers, coffee-men, newsmongers and fishwives from Billingsgate, and with the skin of their tongues made a bladder, which she covered over drum-heads, and filled with storms, tempests, whirlwinds, thunder and lightning; and in the last place, to make the whole composition the more churlish, she cut a vein under the tongue of the dog-star, extracting from thence a pound of the most choleric blood, and then, sublimating the spirits, she mixed them up with the foam of a mad dog, and putting all together in the fore-mentioned bladder stitched them up therein with the nerves of Socrates’ wife.”

“A damned compound indeed this is,” rejoined the farmer. “Surely it must be impossible at this rate for any man to tame a scold.” “Not at all,” continued Horner; “for when she first begins to be in her fits, which you may perceive by the bending of her brows, then apply to her a plaster of good words; after that give her a wheedling potion, and if that will not do, take a birch rod and apply the same with a strong arm from shoulder to flank, according to art; that will infallibly complete the cure.” The farmer, being very well pleased with the prescription, not only gave Horner many thanks, but a good treat at the next inn they came to. Afterwards they rode on together again, and when they came to a convenient place, said Horner: “Will you be pleased to pay me now, sir, for the good advice I have given you?” “I thought, sir,” answered the farmer, “that the treat I gave you in return was sufficient satisfaction.” “No, sir,” quoth Horner, “you promised a hundred pounds, and, d–n me, sir,” continued he, presenting a pistol to his breast, “deliver your bag this instant, or you are a dead man.” At this rough compliment the farmer delivered it to him; but not without a hearty curse or two, and swearing withal that his wife should pay dearly for it the first time he tried the experiment of the birch rod upon her.

Evidently some kind-hearted fellow-bandit, or a target with appointments to keep, or something, helped tighten up Horner’s delivery.

Not long after this exploit Horner met with a gentleman upon Hounslow Heath, whom he saluted with the terrifying words: “Stand and deliver.”

Whereupon the person assaulted gave him what money he had about him, amounting to about six guineas, and said to him: “Truly, sir, you love money better than I do, to venture your neck for it.” “I only follow the general way of the world, sir,” quoth Horner, which now prefers money before either friends or honesty, yea, some before the salvation of their souls; for it is the love of gold that makes an unjust judge take a bribe; a corrupt lawyer plead a wrong cause in defiance of truth and justice; a physician kill a man whom he pretends to cure, without fear of hanging; a surgeon keep a patient long in hand, by laying on one plaster to heal, and two to draw his wound. ‘Tis gold that makes the tradesman tell every day a thousand lies behind the counter, in putting off his bad wares; ’tis that makes the butcher blow his veal, the tailor covet so much cabbage, the miller take toll twice, the baker wear a wooden cravat, and the shoemaker stretch his leather as he does his conscience. In short, ’tis that makes gentlemen of the pad, as I am, wear a Tyburn tippet, or old Storey’s cap, on some country gallows, which all of our noble profession value no more than you, sir, do the losing of this small trifle of six guineas.”

Social criticism of this sort is often put into the mouths of the Newgate Calendar’s evildoers, and in particular its gentleman robbers; note the very close parallel of this last critique to that supposedly uttered by James Withrington.

It is, in fact, essential to the highwayman archetype, and an identity real-life highwaymen intentionally played to — the gentleman thief (mirrored by contemporaries in the Golden Age of Piracy), who here opposes, and there merely parallels, the ascendant order of capitalism.

The complexity of 18th century England’s relationship to the highwayman, filtered through a blossoming mass media, has much exercised later historians: where does a pattern of speech like this fit in its milieu? Can one find in a highwayman’s travesty of bourgeois values, with Linebaugh, an expression of class resistance, or is he merely a failed satirist? Does he truly oppose — or does the futile romance of the road waste genuine opposition on escapism?*

The qualities of resistance, satire and escapism were well-known to the 18th century. That century’s smash theatrical hit, The Beggar’s Opera, staged the noble rogue’s critique to packed houses, and to the dismay of the moralistic element.

Since laws were made for every degree,
To curb vice in others, as well as me,
I wonder we han’t better company,
Upon Tyburn Tree!
But gold from the law can take out the sting;
And if rich men like us were to swing,
‘Twould thin the land, such numbers to string
Upon Tyburn Tree!

Decades later, highwaymen like Paul Lewis were still humming this tune en route to the gallows and self-consciously playing “Macheath”.

Nicholas Horner was hanged before The Beggar’s Opera debuted, but he — either the man or the character — had more sharp words for another keystone of propriety, holy wedlock. Whether this is the voice of the robber or his interlocutor, we may venture (given the shrew-taming digression above), that it’s someone whose domicile was less than blissful.

Horner overtook, beyond Maidenhead Thicket, a young man and a young woman who were going to be married at Henley-upon-Thames, with a couple of bridesmen and bridesmaids.

These he presently attacked … [and] demanded also the wedding-ring, for which the intended bridegroom entreated him yet more earnestly than for his money; but Horner being resolutely bent upon having it, they delivered it to him; whereupon he said: “You foolish young devils, do you know what you are going about? Are you voluntarily going to precipitate yourselves into inevitable ruin and destruction, by running your heads into the matrimonial noose with your eyes open? Do you know it is an apprenticeship for life, and a hard one too? You had better be ruled by me, and take one another’s words; and if you do, you’ll find in taking my counsel that it is the best day’s work you ever did since the hour of your birth.”

Ah, for the days when intercity transit entailed the omnipresent prospect of a gentlemanly robbery.

Let’s conclude on a light note — since we know the end of the story, after all — and picture whether this escaped mugging constituted news-you-can-use for broadsheet readers of a thespian bent.

Not long after this exploit a lady of distinction, being alone in the stage-coach … was informed by the coachman … that if her ladyship had any things of value about her, it would be her best way to secure them as well as she could, for he saw several suspicious fellows scouting up and down the heath … [T]he lady put her gold watch, a purse of guineas and a very fine suit of laced head-cloths under her seat. This done she dishevelled her hair in a very uncouth manner all over her head and shoulders, by which time Horner had ridden up to her, and presenting a pistol into the coach demanded her money.

Hereupon the lady … [acted] the part of a lunatic, which she did to the life, for opening the coach door and leaping out, and taking Horner by one of his legs, she shrieked out in a most piteous and lamentable shrill voice: “Ah! dear Cousin Tom, I am glad to see you. I hope you will now rescue me from this rogue of a coachman, who is carrying me, by that villain my husband’s order, to Bedlam for a madwoman.” “D— me,” replied Horner, “I am none of your cousin; I don’t know you. I believe you are mad indeed, so Bedlam is the fittest place for you.” “Ah! Cousin Tom,” said the lady again, “but I will go along with you; I won’t go to Bedlam.” She then clung close to Horner and his horse, and counterfeited lunacy with such dexterity that he really thought it natural, and asked the coachman: “Do you know this mad b—h? “Yes,” replied the coachman, “I know the lady very well she is sadly distracted, for she has torn her head-cloths all to pieces and thrown them away as we came along; and I am now going with her by her husband’s orders to London, to put her into a madhouse, where she may be cured; but not into Bedlam, as she supposes.” “E’en take her then along with you to the devil, if you will,” said Horner in a passion, “for I thought to have met with a good purchase, and I find now there is nothing to be got of this mad toad.” So he set spurs to his horse and rode away as fast as he could, for fear of being plagued any more with her, for she seemed mighty fond of her cousin, and ran a good way after him; but after he was gone out of sight she was better pleased with his absence than his company, and got safe to London.

1691: Jack Withrington, highwayman

On this date in 1691, highwayman Jack Withrington hanged at Tyburn.

THIS fellow was the youngest of five brothers, who were all born at Blandford, in Dorsetshire. The other four were all hanged in the country, but Jack had the good fortune to be reserved for Tyburn, and by that means to have his name transmitted to posterity. He was bound to a tanner in Shaftesbury, a town in his native county, with whom he served about three years. Then he entered into the Earl of Oxford’s Regiment of Horse, in which, when Monmouth‘s rebellion was suppressed in the West of England, he came up to London, where he soon met with opportunities of discovering his valour to the world. These occasions were two quarrels in which he was engaged: the first with a man famous for fighting, against whom he behaved with so much bravery and skill that it won him a vast reputation; the second with a person of great estate, but a noted coward, when he showed himself a gentleman by his adherence to the point of honour and good breeding. By these duels he won abundance of applause, so as thereby to contract a familiarity with all the greatest fighting men of the time, especially those in his own regiment. Withrington however carried his manhood so far as to get himself turned out of the regiment within a year after, for challenging his captain. He then became a perfect bully and gamester; and, being fortunate, in a little time by these means saw himself master of a considerable sum of money. Notwithstanding all this good luck at first, he found himself afterwards subject to the fate of gamesters —- viz. to be frequently without money in spite of his large winnings. This brought him at last to consider the uncertainty of Fortune and endeavour to make himself master of her, by supplying with fraud what he might want in plain open skill. But this also did not continue long; for everyone began to be aware of him as a common sharper, and none who knew him would venture to play with him.

In the common scale of knavery the next step above a sharper is a downright thief. Withrington made bold to ascend this degree, and was resolved to take the most honourable station thereon, that of a highwayman. He had money enough to buy him a good horse and accoutrements, so that the resolution and the real attempt were not long asunder. His first adventure was with a farmer, from whom he took forty pounds, giving him in return only an impudent harangue, occasioned by the countryman’s reproaching him with the robbery.

The next that fell in Withrington’s way was Mr Edward Clark, gentleman usher to the Duchess of Mazarin. They met in Devonshire, on the road between Chudleigh and Ashburton. Mr Clark made some resistance, so that in the scuffle Withrington’s mask fell off and discovered his face, which Mr Clark knowing, he called him by his name, and said he hoped he would not rob an old acquaintance. “Indeed I shall, sir,” quoth Withrington, “for you get your money much easier than I do, who am forced to venture my life for a maintenance; you have so much a year for eating, drinking and entertaining your lady with scandal and nonsense. What I shall take from you will do you little harm; it is only putting a higher price upon half-a-score reputations, which you know how to do as well as any coxcomb in England. Ladies never let such faithful servants go unrewarded, nor will yours suffer your loss to fall on yourself.” He got about eight guineas out of this gentleman’s pocket, and for old acquaintance sake bade him “Good-b’w’ye” very heartily.

Withrington’s robberies in less than a year and a half were talked of almost all over the kingdom. But alas! he met with a diversion, common to mankind, that draws even the most stupid into the rank of polite persons. The poor man was in love; and with whom but a rich widow inn-keeper in Bristol! Farewell to the highway: Withrington has another scent to pursue. No more robberies to be thought of from a man who was himself robbed of his heart! He employed an old bawd in the affair, who was intimately acquainted with our hostess, and by this flesh-broker’s mediation things had like to have come to an issue, and Jack to have been master of the Swan Inn. In short, there was nothing prevented it but the accidental coming of a certain gentleman, who knew our highwayman, and informed his mistress what he was. The effects of this discovery were Jack’s being kicked out of doors by the ostler and chamberlain, and the commitment of madam the negotiatress to Bridewell, in order to mill Dolly.

After his return to the highway he and one of his companions met with Mr Thompson, a noted tailor, in a part of Hertfordshire that was convenient for robbing. They took from him about thirty pounds in silver, and then, dismounting him, they ordered him to stay where he was till they brought him more company. As soon as they were gone from him he remounted his horse and attempted to ride off as fast as he could; but our highwaymen perceiving what he was at, and having the best horses, they fetched him back, and mistrusting he had more money, by his being in so much haste, they searched him afresh, he protesting all the while that he had not so much as a farthing left if it were to save his soul. In a literal sense he might be right; but they made a shift to find forty guineas, which they thought better than farthings. Withrington upon this exclaimed that it was a sad thing that one Christian could not believe another! They then shot his horse, to put a stop to his speed, and so rode away and left him.

These, we pause to digress, are not the only stock and store among the (surely half-legendary) c.v. of this colorful bandit. The verbosely entitled Complete History of the Lives and Robberies of the Most Notorious Highwaymen, Footpads, Shoplifts and Cheats of Both Sexes reports that Withrington delivered himself of an even wordier critique of the nascent economic order of the day.

[T]ravelling the road, he met a rich farmer, from whom he took £40. Quoth he, Is not this a downright robbery? Roberry? replied Withrington; So let it be; who is there now-a-days does not rob? The tailor steals before his customer’s face; the weaver steals by eking out the length of a piece of cloth with the remainder of broken ends; the surgeon steals by prolonging a cure; the apothecary steals with a quid pro quo, using one drug for another for cheapness, without any regard to the age and constitution of the patient; the merchant steals by putting his money into the Bank of England; the scrivener steals by selling the soul of a poor man for the money that he can take of a forfeit; the grocer steals by using false weights; the vintner steals by adulterating his wine; the butcher steals by blowing up his meat; the victualler steals by drawing in short measures; the cook steals by roasting his meat twice over; the baker steals by raising his bread when there’s no occasion; and the shoe-maker steals by stretching his leather as much as he does his conscience. Thus, as there is cheating and cozening in all trades but mine, you cannot blame me for borrowing this small trifle; which I shall honestly pay you when we meet again; so till then, farewell.

And a bit of, er, gallantry.

Another time Jack Withrington meeting a gentleman and his wife on the road betwixt St. Albans and Dunstable, he very submissively craved their benevolence; but they not instantly granting his request, he shot the horse on which they both rode, and swore that as he denied him his money, he would take his wife. So forcing her into an adjacent copse, and acting a man’s part by her, he restored her to her husband again, from whom taking eleven or twelve guineas he said, This is no more than my due for I am not obliged to do your drudgery for nothing.

Rape and repartee! Dreamy.

But we know where this is heading.

The last robbery Withrington committed was alone. He stopped a nobleman on Hounslow Heath attended by two footmen. There was a short dispute, but Withrington having the best of it, he took a portmanteau in which were two hundred and eighty guineas, sixty pounds in silver, and a parcel of fine linen. A hue and cry was soon issued out after him, and he was apprehended by means of it at Malmesbury, in Wiltshire, from whence he was removed to London, where he was condemned for this fact.

The sentence of death seemed to have no effect on his temper, for he was as gay and humorous under that circumstance as ever he had been before. When he was riding up Holborn Hill he ordered the cart to stop, and calling up the Sheriff’s deputy, “Sir,” said he, “I owe a small matter at the Three Cups, a little farther on, for which I am afraid of being arrested as I go by the door; therefore I shall be much obliged to you if you will be pleased to carry me down Shoe Lane and bring me up Drury Lane again into the road by which I am to travel this devilish long journey.” The deputy informed him that if such a mischance should happen he should come to no damage. “For,” says he, “I’ll be bail for you myself, rather than you shall go back to prison again.” “Thank you heartily, sir,” quoth Jack; “I protest I could not have thought that I had a friend in the world who would have stood by me so in such a time of need.” After this he rode very contentedly to the place of execution, where he was tucked up with as little ceremony as usual. This fatal day was Wednesday, the 1st of April, in the year 1691.

1652: Captain James Hind, royalist highwayman

On this date in 1652, James Hind, a highwayman who preyed on Roundheads, was drawn and quartered for treason.

Famed throughout the realm for his dashing heists on the roads, Hind was the subject of no less than 16 printed pamphlets of the nascent popular press in the early 1650’s, which magnified brigand’s feats, oratory and persona into a sort of populist Cavalier superhero: Marvel Comics for the woodcut age.

The highlights of Hind’s adventures receive rapturous attention from the Newgate Chronicles:

  • Setting upon Oliver Cromwell shortly after the execution of Charles I, his partner Thomas Allen being taken in the affray;
  • An amusing duel of Biblical citations while robbing regicide Hugh Peters, resolved in the characteristic manner of such impasses by reference to which disputant holds the gun.

    “Pray, sir, make no reflections on my profession; for Solomon plainly says, ‘Do not despise a thief’; but it is to little purpose for us to dispute. The substance of what I have to say is this: deliver thy money presently, or else I shall send thee out of the world to thy master in an instant.”

  • Any number of pleasing episodes with lesser personages suitable for the gallant highwayman — ladies charmed but un-pillaged, paupers subsidized, and always, wicked Parliamentarians chastened. Several excellent Hind anecdotes are gathered by Gillian Spraggs here.

As to the veracity of this stuff, the Captain himself suggests a pinch of caution.

A Gentleman or two, desired so much favour of [the gaoler], as to aske Mr. Hind a civil question; which was granted. So pulling two books out of his pocket, the one entituled, Hind’s Ramble, The other Hind’s Exploits, asked him whether he had ever seen them or not: He answered, yes; And said upon the word of a Christian, they were fictions: But some merry Pranks and Revels I have plaid, that I deny not.

But Hind’s adherence to the Stuart cause was real enough, or at any rate something he had the 17th century media savvy to play up. At his execution, he professed pleasure in having targeted Roundheads for most of his crimes, and it was not theft that saw him to the scaffold, but treason. He made free royalist talk upon his arrest, proposing a toast to the exiled king that otherwise sympathetic guests were too cautious to take up.

Hind fits symbolically into the tradition of the romantic outlaw of Robin Hood stock, and anticipates the 18th century rogues’ gallery of noble brigands fighting a doomed rearguard against capitalism. Hind’s acts, criminal by any standard, are justified by the illegitimacy of the society he preys upon; he embodies at once a social and political rejection of the nascent mercantile England, and a biographical realization of its actuating mythos — personal aptitude and acquisition,* with a cover story for why his victims had it coming.

Neither did I ever wrong any poor man of the worth of a penny: but I must confess, I have (when I have been necessitated thereto) made bold with a rich Bompkin, or a lying Lawyer, whose full-fed fees from the rich Farmer, doth too too much impoverish the poor cottage-keeper: And truly I could wish, that thing were as little used in England amongst Lawyers, as the eating of Swines-flesh was amongst the Jews.

* In a supposed rhapsody over gold forced from the hand of John Bradshaw — yet another regicide; Hind seemingly met them at every turn — our robber rather has his cake and eats it too in extolling and condemning lucre.

Ay, marry, sir, this is the metal that wins my heart for ever. Oh! precious gold, I admire thee as much as Bradshaw, Prynne or other such villains, who would for the sake of it sell our Redeemer again, were He now upon earth.

1833: Midgegooroo, Noongar rebel

On this date in 1833, an aged aboriginal Noongar (or Nyungar) was sentenced to execution and summarily shot in southwest Australia.

Midgegooroo was one of the many indigenous casualties of European settlement — Perth, in this case.

Little is documented of his life but the end and that, of course, by his enemies; he helped raise resistance to the arriving whites in 1831 after a native was killed trying to raid a potato patch. As tensions heightened over the ensuing months, he was outlawed with a £20 reward on his head. He was sentenced — possibly without any sort of formal trial — and summarily shot a few days after capture.

Midgegooroo’s son Yagan outlived his father two more months, and in that scanty condescension of destiny carved a place as one of Australia’s most illustrious native rebels. (pdf)

In the end, inevitably, Yagan’s fate was the same — not so precisely as to qualify him directly for these pages but ambush by settlers amounted to much the same as the rickety assemblage of formal semi-legalisms that thrust his father into the ground: the law of conquest without apology. It would be years yet before any white would face the law’s lethal sanction for killing Australian natives.

Yagan’s head was hewn off and packed for England as a grisly trophy-cum-souvenir-cum-“anthropological curiosity”. Not until the recent trend towards repatriating such remains was it was finally exhumed and returned to the Noongar nation — in 1997.

1881: Not Billy the Kid

“You will be hanged by the neck, Billy, until you are dead, dead, dead!”

“You can go, Judge, to hell, hell, hell!”

We have no source for whether William Bonney’s reply to the judge who sentenced him to hang was vindicated by the Almighty. But the judge’s sentence, due to be executed this day, assuredly never came to pass: two weeks before, Billy the Kid effected the last of his famous escapes.

The exploits of this legendary gunfighter — and his legend rather exceeds his exploits — are exhaustively chronicled online. The Manhattan-born Kid, a pup of 21 at his death, was a gunfighter in the Lincoln County War, a fight between two frontier magnates. Billy counted himself among the Regulators, a deputized posse (so it claimed, by way of legality) that was the armed militia of a murdered rancher.

Billy’s winning way with the press after his capture helped endear him to popular imagination, even after he was condemned in Mesilla, New Mexico for ambushing a lawman.

Here’s how Emilio Estevez played the crime in Young Guns:

On April 28, in a building that still stands in Lincoln, New Mexico, Bonney got the drop on one of his guards and high-tailed it out of town.

Though spared the ignominy of the gallows, Billy the Kid would not long outlive his judicially appointed hour. Lincoln County sheriff Pat Garrett found and killed the fugitive a few months later.

Ironically, this transaction darkened the reputation of the successful officer of the law — the circumstances of the killing were ambiguous, and seem less than honorable to some — while helping valorize the young outlaw who by all rights should long since have been at the end of a rope. And for this, maybe Billy’s shade has stood Garrett’s a drink or two, because a shadowy and youthful disappearance from the scene helped catapult Billy into folklore that has long outlasted the forgotten Lincoln County War.

Billy the Kid — even the name evokes the American self-image with perfect pitch — has come to so fully embody the floating signifiers of the Wild West, of America in its adolescence, that around the same time Bob Dylan composed “Knockin’ on Heaven’s Door” for the clip above (the 1973 film Pat Garrett and Billy the Kid), Billy Joel took the gunslinger for an all-purpose western motif in “The Ballad of Billy the Kid”. Joel’s song’s describes a life that seems to be just what the listener thinks it ought to be while remaining factually untrue of its titular character in almost every particular, including, in his version, a picturesque death by hanging:

The ballad form of romanticized narrative poetry suits our elusive subject well. Skip music and cinema a generation ahead and we have Guns n’ Roses covering “Knockin’ on Heaven’s Door” and power balladeer par excellence Jon Bon Jovi climbing the charts with this signature hit from the Young Guns II soundtrack:
