1824: Three Bondy brigands

Bondy, today a Paris suburb, was in the Middle Ages a forest notorious for the bandits and murderers who laired in its leafy shadows — a reputation stretching back to antiquity. The Merovingian king Childeric II was assassinated while hunting there.

Just as the French Revolution swept away the titles and prerogatives left over from feudal Europe, it put the onetime thieves’ forest on the track to respectability. The golden age of the highwayman was rapidly closing anyway; as the 19th century unfolded, the lumberman, the railroad, and the police inspector combined to drain away the outlaw’s arboreal habitat.

But such transitions do not happen overnight, and on this date in 1824 were guillotined in Paris three representatives of this vanishing species — brigands from a ferocious gang who, in the words of their executioners’ memoirs, “excelled in the art of waylaying stage-coaches, and killing the passengers if they refused to give up their money.”

Renaud, Ochard and Delaporte were their names; five others of their band had received sentences of life in prison at hard labor.

1761: Isaac Darkin, dying game

On March 23, 1761, British highwayman Isaac Darkin — “Dumas” by a dashing alias — hanged at Oxford for robbery.

It might be Darkin’s misfortune to have been born just too late for the mythmaking golden age of highwaymen; a generation or two earlier he might have forged a reputation alongside a Dick Turpin. He was one of the last road agents whose career and genteel pretensions might have suited him for the firmament.

The suave outlaw, noted for his natty attire and correct address, first passed under the shadow of the noose in 1758 around age 18, when a death sentence earned for his first legal brush was respited in favor of conscription into the Seven Years’ War.

Darkin took the deal, but not the troop transport to Antigua: instead he devised a route to early retirement from the infantry by bribing the captain of a merchantman anchored nearby in the Thames to stow him away.

And then, quoth this history of highwaymen, our man “rioted all through the West of England, robbing wealthy travellers and gaily spending his takings on what he loved best: fine clothes and fine ladies. He was so attentive to business that he speedily made a name for himself, the name of a daring votary of the high toby.”

Arrested in Salisbury in 1760 for the famous robbery of a Lord Percival, Darkin beat that charge — but not before becoming a favorite of the city’s ladies who were reported to crowd his cell with callers and coo over him at fashionable tea-times. When “Dumas” escaped the noose on a technicality, some Salisbury women dedicated their enchanting Duval a come-hither ode.

Joy to thee, lovely Thief! that thou
Hast ‘scaped the fatal string,
Let Gallows groan with ugly Rogues,
Dumas mut never swing.

Does thou seek Money? — To thy Wants
Our Purses we’ll resign;
Could we our Hearts to guineas coin
Those guineas all were thine.

To Bath in safety let my lord
His loaded Pockets carry;
Thou ne’er again shall tempt the Road,
Sweet youth! if you wilt marry.

No more shall niggard travellers
Avoid thee — We’ll ensure them:
To us thou shalt consign thy Balls
And Pistol; we’ll secure ’em.

Yet think not, when the Chains are off,
Which now thy Legs bedeck,
To fly: in Fetters softer far
We’ll chain thee by the Neck.

Alas for its swooning authors, the handsome bandit had no interest in the bonds of matrimony, and just as well — for he would have left his mate a hempen widow.

A mere six weeks after this merry escape, he was snapped up again in Oxford, having returned inevitably to his career and calling.

This time there was no hope of escape and no technicality to hang his hat on.

There was nothing for it but to die “game” — that is, fearless of death — an underworld virtue Darkin carried almost to a fault. He spent his last days “with reading the Beggars’s Opera” and “said it was always his Determination, whenever he should have the ill Fortune to be taken, ‘to suffer without discovering the least Dread of Death; never to betray his Connections, but to die like a Hero.'”*

So indeed he did, as attested by a letter from Oxford published in the London Evening Post (March 21-24 1761) — hurling himself off the gallows without the hand of the executioner.

His Behaviour was extremely undaunted; for when he came out of the Gaol to the Ladder, he ascended it with the greatest Resolution; and the Cord being tied up by his own Desire over the Gallows before he came, he instantly went up four Steps higher than that on which he stepped off to hang himself, put the Cord round his own Neck and placed it, then descending the four Steps down, pulled out a white Handkerchief, tied it round his Eyes and Face, and went off without saying one Word.

His Body was ordered to be brought back into the Castle, to be conveyed to the Museum for Desection [sic]; but he declaring that he valued not Death, but only the Thoughts of being anatomized, a large Gang of Bargemen arose, took him a Way in Triumph, carried him to the next Parish Church; and while some rung the Bells for Joy, others opened his Belly, filled it full of unslick’d Lime, and then buried the Body.

1715: Lips Tullian, outlaw and comic hero

On this date in 1715, the legendary outlaw Filip Mengstein was broken on the wheel in Dresden’s marketplace, along with four henchmen.

With the wiseguy nickname “Lips Tullian”, our cutthroat’s gangland derring-do cuts a truly timeless profile. But it happens that Lips did his cutting in the environs of Saxony and Bohemia, exploiting for many years lax domestic security in the Holy Roman Empire occasioned by the preoccupations of the Great Northern War. Legend has it that he was a former dragoon forced to take to the road around 1702 when he slew a comrade in a duel.

From wilderness haunts — there’s still a “Lips Tullian Hill” in Saxony’s Tharandt Forest — Tullian’s “Black Guard” gang sallied into towns to raid prosperous homes and churches. When caught, he had a knack for the dramatic breakout, returning again and again to his gang.

Alas, it was an unsuccessful escape attempt in 1713 that finally caused his captors of the day to realize who they had and put him to torture and, eventually, the brutal breaking-wheel execution.

Immortalized in subsequent folklore, especially in Bohemia, Lips Tullian is best noted recently as the subject of a popular 1970s Czech comic published (until Communist authorities suppressed it) by Mlady Svet. The illustrator Kaja Saudek based his Lips Tullian on the romantic 19th century interpretation of Kvidon de Felses — presenting him as a gold-hearted rogue with an impressively chiseled physique.

1545: Cornelis Appelman and Willem Zeylmaker, Batenburgers

On this date in 1545, the leaders of the violent Anabaptist Batenburgers were burned at the stake in Utrecht.

We know Anabaptists best as peaceniks, but the Batenburgers were the dead-end trail to a wholly different reputation. Named for a former Dutch mayor named Jan Van Batenburg, these Zwaardgeesten (“sword-minded”) Anabaptists answered the annihilation of their brethren’s Münster commune by doubling down on revolutionary struggle.

Batenburgers rejected the blandishments of David Joris to lay down the impolitic swords. Their numbers and their philosophies are hard to know with certainty owing to their secrecy, but they’re thought to have maintained the radical Munsterite teachings on polygamy and property.

Van Batenburg himself was caught and executed in 1538, and with that the Batenburgers — who had been living secretly in regular Catholic and Protestant communities — took to the wilderness under the leadership of a Leiden weaver named Cornelis Appelman. For the next ten years or so (even outlasting Appelman’s own death) this band of a couple of hundred desperate men made their way as marauders. We’d probably just call them terrorists today.

Appelman was even more extreme than his predecessor, verging right into crazy cult leader territory with his dystopian insistence on being called “The Judge” and readiness to mete out the severest penalties for any breach of obedience — to say nothing of the arsons, the church-sackings, and the summary executions dealt out to unbelievers. He was finally caught and put to death with his aide Willem Zeylmaker. Batenburger remnants, however, persisted for several more years with at least one splinter continuing until around 1580.

1601: Starina Novak, hajduk

On this date in 1601, Serbian-Romanian hajduk Starina Novak was slow-roasted in Cluj with two of his captains.

The hajduk in the Balkans was a romantic figure who mixed traits of the “social bandit” outlaw with those of anti-Ottoman guerrilla. Colorful characters answering the archetype persisted into the 20th century.

Novak, who was around 70 by the time of his death, is still celebrated for his feats of arms on the soldiering side of the ledger in a running conflict with the Ottomans. Most of the sites about Starina Novak are in Serbian, like this one.

He emerges as a commander of Serbian and Bulgarian auxiliaries fighting with Michael the Brave in the 1590s to carve out of the Ottoman realm a kingdom of Wallachia, Transylvania, and Moldavia — roughly, present-day Romania plus Moldova. The enterprise was as glorious as its destiny was tragic.

By 1601 an Italian officer aptly christened Giorgio Basta had had enough of his erstwhile allies and double-crossed hajduk and upstart king alike.

The former he shopped as a traitor to Michael’s Hungarian allies, who put him to the stake in Cluj and made sure to throw water on the burning partisan throughout in order to prolong the ordeal. (The charred corpses of Novak and his associates were then impaled.) A few months later, Basta had Michael the Brave assassinated, and placed himself at the head of Michael’s hard-won kingdom.

Being a national hero means your prior career in brigandage gets a little Robin Hood elbow grease.

In the Serbian epic “Starina Novak and Knez Bogosava” — translated here by polyglot friend of the site Sonechka — Novak attributes his turn to banditry to the impositions of his rulers, specifically (and ahistorically) blaming the 15th century despot’s wife Jerina for overtaxing him.

Novak and Radivoj are imbibing wine
By the brisk waters of Bosna,
At a certain Prince Bogosav’s.
And having sated themselves with wine,
Prince Bogosav began to talk:
“Brother, Old Novak,
Tell me straight, as if confessing,
Why did you, brother, become a hajduk?
What compels you
To break your neck, to wander the forest
As a brigand, pursuing your ignoble employ,
Unto your senescence, when your time has passed?”

Replies Old Novak:
“Brother, Prince Bogosav,
When you ask, I answer in earnest —
It was truly not my wish.
If you could recollect
The time when Jerina was building Smederevo
And ordered me to toil.
I labored for three years,
I pulled the trees and carried stones,
All on my own cart and oxen.
And in three years term,
I gained not a dinar,
Not even opanci to put on my feet.
But that, brother, I would have forgiven!
Having built Smederevo,
She began to mount towers,
To engild the gates and windows,
And imposed the duty on the vilayet,
For each house – three measures of gold,
Which is three hundred ducats, brother!
Those who had, gave her the treasure;
Those who gave, stayed.
I was a pauper,
With nothing to give,
I took my pickax, which I toiled with,
And with this pickax I turned to banditry,
No longer could I linger anywhere
In the domain of cursed Jerina,
But ran away to the icy Drina,
Then reached stony Bosnia.
And when I neared Romania,
I met a Turkish wedding party –
Escorting a noble girl,
All passed in peace,
Save for the Turkish groom.
On the great dark brown steed,
He did not want to pass in peace.
He pulls his three-tail whip

1900: Geronimo Parra and Antonio Flores, the last hanged in El Paso

The last-ever hanging in El Paso, Texas, on this date in 1900* was distinguished by an astonishing attempted fight to the finish by the two doomed men.

Despite what Hollywood would have one believe, the dramatic bodily escape from the executioner is really never a thing. (Well, hardly ever.) Yet even if Geronimo Parra and Antonio Flores could not effect their escape that day, they would have been content, as Flores bellowed while brandishing his shank, if “You shall all go to hell with me!”

Parra, by far the more notable character in this drama, was long an infamous desperado in the borderlands. Though known for all manner of outlawry, he was specifically hunted by the Texas Rangers for slaying one of their number, John Fusselman, in a mountain ambush way back in 1890.

Parra was in jail in New Mexico for an unrelated robbery under an assumed name when he was recognized as the wanted murderer. Texas Ranger John R. Hughes cut a deal with the Sheriff of Dona Ana County, New Mexico — a lawman you might have heard of by the name of Pat Garrett.** Garrett wanted a fugitive hiding out in Texas, and arranged to extradite Parra in return if Hughes could find the man for him.

The second man doomed to die with Parra, Antonio Flores, was an altogether more everyday criminal: an avidity for a Smeltertown woman who would not have him led him to stab her to death, crying — as if he had not already done enough to poor Ramona Vizcaya without sending her to the next world with an eye-rolling banality — “If I cannot have you then no other man shall!”

Flores’s, shall we say, passion would prove an asset for the desperate duo on their final day.

The gallows had only a single trap, so the two men were to hang consecutively. When guards came to retrieve Antonio Flores, however, both he and Parra raced out of the open cell door wielding homemade blades — steel wire twisted and sharpened into makeshift daggers.

With the certainty of immediate death upon them, the prisoners made a desperate melee in the little hall.

Flores planted his cruel dirk into the stomach of a deputy named Ed Bryant, while Parra scored glancing blows on two men before he was shoved back into the cell. While the rustler looked on helplessly from behind bars, the available toughs piled onto Parra and subdued him.

Parra was trussed hand and foot and dragged straight to the scaffold for instant execution. On pain of prospective death by the constables’ revolvers, Parra too submitted when his turn came, and satisfied himself with declaring his innocence on the gallows — after which the noose nearly ripped the man’s head clean away.

Spare a thought for these long-lost frontiersmen when next visiting the gorge where Ranger Fusselman caught that fatal bullet from Parra’s gang of cattle rustlers: Fusselman Canyon.

* Some sites give January 6 for the execution date. The primary sources here unambiguously show this is incorrect.

** Famous for shooting Billy the Kid. Pat Garrett served only a single term as sheriff of Lincoln County; his reputation for excessive violence and shady associations helped to give his career in New Mexico and Texas a somewhat vagabond quality.

1694: James Whitney, highwayman

Dapper highwayman James Whitney was hanged at Smithfield on this date in 1694.

A monument to the allures and the perils of a midlife career change, Whitney threw over a tiresome life as the proprietor of an inn in Cheshunt, Hertfordshire,* purchased with his liquidation the accoutrements of the gentleman thief, and took to the road.

“Captain” Whitney — he had no right to the rank he appropriated for himself — was one of those stickup men who greatly esteemed the pose of honor associated with his new calling. On one occasion, he relieved a gentleman traveler of a large sack of silver on Newmarket Heath, but when his victim pleaded the length of his journey Whitney opened the bag to its former owner with an invitation to take what he would need.

The man plunged his hands in and hauled out as much as they would carry, leading Whitney to remark with a smile, “I thought you would have had more conscience, sir.”

In another fine caper (there are more of them assembled here) Whitney told a man to stand and deliver, only to have the traveler reply that he was about to say the same back to him. The two robbers laughed at their encounter and went their separate ways, but Whitney later chanced to turn up at the same inn as his so-called brother plunderer and overhear him regaling his fellows with the tale of having outwitted a highwayman by pretending to be one of the same profession.

Whitney stalked the man and a companion out of the hostel the next morning and this time robbed them successfully: “You should have kept your secret a little longer, and not have boasted so soon of having outwitted a thief. There is now nothing for you but to deliver or die!” Nobody likes your stories anyway, you blowhard.

True, James Whitney ended his adventure at the gallows: death is the fate of us all. From his day to ours, folk toiling away the ceaseless lonesome days between ashes and ashes have understood the soul’s stirring to exalt their scant mortal hours with deeds of valor and romance and derring-do. And as Whitney himself is said to have remarked to a miser whose lucre he was seizing, “Is it not more generous to take a man’s money from him bravely, than to grind him to death by exacting eight or ten per cent, under cover of serving him?”**

Nobody knows any of James Whitney’s peers in the publican guild, but as Captain Whitney he joined England’s most legendary gentleman outlaw in verse.

When Claude du Val was in Newgate thrown,
He carved his name on the dungeon stone;
Quoth a dubsman, who gazed on the shattered wall,
“You have carved your epitaph, Claude du Val,

Du Val was hanged, and the next who came
On the selfsame stone inscribed his name;
“Aha!” quoth the dubsman, with devilish glee,
Tom Waters, your doom is the triple tree!”

Within that dungeon lay Captain Bew,
Rumbold and Whitney — a jolly crew!
All carved their names on the stone, and all
Share the fate of the brave Du Val!

Full twenty highwaymen blithe and bold,
Rattled their chains in that dungeon old:
Of all that number there ‘scaped not one
Who carved his name on the Newgate Stone.

* The George Inn. A map search does yield a The George in Cheshunt; whether this is actually the same facility where our famous highwayman once earned a lawful keep, I have not been able to establish.

** Parables from this golden age of highwaymen often place in the mouths of outlaws sharp critiques of their targets, who despite putative respectability turn out upon examination to be far more deeply corrupt than the dashing adventurer. See for example Old Mobb.

1578: Kort Kamphues, outlaw judge

Most judges are content to inflict their atrocities with a gavel, but on this date in 1578, a magistrate turned freebooter named Kort Kamphues was beheaded at Bevergern.

Just a few months before his July 1553 death, Prince-Bishop Franz von Waldeck set Kamphues up for his interesting career arc by appointing him Stadtrichter of Coesfeld.

Kamphues’s overbearing presumptions on the perquisites of that sinecure, coming on more than one occasion to physical violence, led other city leaders to petition unsuccessfully for his removal in 1569.

But his attempt in 1572 to assemble a mercenary army on the pretext of getting involved in Spain’s war in the Netherlands led to a definitive break with Coesfeld — which tried to arrest him, and then outlawed him when he escaped with his armed posse into the Westphalian countryside.

For several years, Kamphues and gang marauded merrily until a clumsy bid to frighten a new Coesfeld magistrate led to an arson attack on the city. Kort Kamphues was captured on June 19, 1578, and tortured into confessing to arson, banditry, and breaching the peace — gaining a permanent place in folklore at the small expense of his head.

The Kamphues Dagger, a beautiful 14th century artifact later documented in the Coesfeld treasury, is supposed on sketchy evidence to have been captured from this brigand.

1895: Jesus Vialpando and Feliciano Chavez, desperados

On this date in 1895, two outlaws hanged publicly at Las Vegas, New Mexico, for killing a rancher during a raid on his cattle earlier that year.

We will come soon enough to Jesus Vialpando and Feliciano Chavez, but their story and ours properly begins a bit earlier … with a gentleman named Vicente Silva.

Silva had struck silver and cashed his claim in for the proprietorship of a saloon in Las Vegas, NM where he tolled the vices of later prospectors and of the ranchers and herders who peopled the area.

In the 1880s the deposits were drying up and with them the tumblers at Silva’s well. Ever the enterprising businessman, he procured a remote ranch to use as the base for a fresh initiative: running by night a secretive gang that terrorized San Miguel county and neighboring Guadlupe, Mora, and Santa Fe counties, too. For a couple of years these villains had the run of unsettled territory’s rural places, and waylaid travelers or rustled livestock with near impunity — murdering when necessary and even brazenly “disappearing” some ranchers known to be too vigorous about defending themselves.

The Silva gang came unglued in the winter of 1892-93. Suspecting one of its number of preparing to expose him, Silva ordered the man done to death — and Pat Maes was efficiently lynched to a bridge in a driving snowstorm. Silva himself fled his legitimate persona in Las Vegas and embraced outlawry as a fugitive in the bush.

Having already proven his willingness to slay his own followers, Silva soon had to go even farther than that: in February 1893 he demanded that his cronies murder his (Silva’s) wife, and the wife’s brother — again for fear of betrayal. The men so tasked did carry out their orders, but, wary of the Robespierrian trend betokened by these purges, they also took the opportunity to murder Silva himself.

That scattered his associated desperadoes to the desert winds. Pursued by rewards on their heads — and no longer in mortal terror of the chief’s vengeance should they turn stool pigeon on their former mates to collect — many of the gangsters were rounded up in the years to come.

Our two characters, Vialpando and Chavez, numbered among Silva’s dispersed marauders and had managed to escape the most recent instance of a tattling comrade. Come the winter of 1894-95, two years on from Silva’s exit stage 6 feet under, these ex-henchmen still had their former liberty … and none of their former ease.

Staggering through another blizzard like the one that had fallen on poor Pat Maes so many moons before, they* came upon Lorenzo Martinez’s land and trespassed with famished gusto. They had soon made of one of Martinez’s cows a much-needed repast, but as they huddled around a fire to devour it in warmth, the rancher’s son Tomas arrived on the scene. Who knows but with what suspicion these parties eyed one another, and what guarded words they exchanged. Later Vialpando would explain through an interpreter that, catching glimpse of the man’s cartridge belt “I became afraid of him that he might be the owner of that animal that we had killed there,” and with familiar glances to Feliciano made a silent impromptu pact to kill Martinez before the rancher got a drop on them.

Four days later, Martinez’s faithful dog Gallardo — whom the raiders had also shot, but not managed to kill — turned up back at the family homestead half-frozen and matted in its own blood and all but dragged Martinez’s brother to the spot where Tomas’s cremated remains mingled with the carcass of the dead cow. The discovery was quick enough to put authorities on the right track, and they had Vialpando and Chavez in custody within a fortnight.

They offered only a feeble attempt at spinning the admitted homicide as “self-defense”. At the prisoners’ request, Governor William Thornton met personally with them in jail a few days before their hanging, where the doomed men begged for mercy “without pretending to give any reason why he should” grant it. (New Mexican, Nov. 14, 1895)

Around 6 o’clock on the morning of November 19, Vialpando was escorted alone to a one-man public gallows at an arroyo north of town. Wan and terrified, Vialpando had all he could do to keep his composure and made no statement before he was efficiently executed.

By 7 o’clock the sheriff’s party had returned to the jail for Chavez. Less unmanned by the occasion, Chavez had a rambling 18-minute address to the crowd from the gallows, translated on the fly from his Spanish by a handy interpreter, the substance of which was to vaguely distribute among the rest of his party enough responsibility for Martinez’s murder that he could complain about taking the punishment for it. At last, with the parting cry of “Adios, todos!”, Chavez too was hanged at 8 o’clock.

The men’s bodies were shipped a few miles down the way to their families in Romeroville, along with a few dollars in nickels they had accumulated from well-wishers while awaiting execution. A public subscription covered the cost of their burial.

* The party was four in all. Zenobia Trujillo and Emilio Encinias were present when Martinez found their party but were sent away before he was murdered; they were charged as accessories after the fact.

1700: Jamie Macpherson, Highlander

The legendary Highlands freebooter Jamie Macpherson was hanged on this date in 1700 in Banff.

Macpherson is said to be an illegitimate half-Gypsy child with every talent necessary to live larger than life — and if gigantism can be inferred from the size of his enormous alleged sword, that would be extremely large indeed.

Besides his elite SPARQ score, Macpherson was blessed with complementary gifts for making music and sweet sweet love, and plundered livestock and merchandise and maidenheads as he sprang through the vicinities of Banff and Aberdeen. Despite living by his prowess with the sword every source concurs that he never used it to harm anyone that the audience would sympathize with.

But he outraged the local grandees, and at length he was apprehended (as befits his outsized tale) by a fellow with the improbable name “Duff of Braco” — then was duly condemned to hang on market-day (“Forasmeikle as you James McPherson, pannal are found guilty by ane verdict of ane assyse, to be knoun, holden, and repute to be Egiptian and a wagabond” etc.).

In the week before his hanging, Macpherson reportedly composed an air variously described as “Macpherson’s Lament” or “Rant” or “Farewell” which he then performed on the gallows.

In the most picturuesque version, he played his own fiddle in this exit performance, then dramatically smashed the instrument. As Chambers’s Journal observes, it seems hard to accept that the sheriff would have given this veritable Goliath the free use of his hands at such a desperate moment. Indeed, local legend has it that the authorities were so afraid that a reprieve might arrive that upon catching sight of an approaching rider on the horizon, they put the town’s clocks 15 minutes forward.

At any rate, several versions of the Lament/Rant/Farewell survive and one can follow its evolution in this open-source Annals of Banff. Robert Burns’s eventually immortalized the verse with this gloss on it from the late 18th century:
