1832: Elizabeth Jeffery, Carluke poisoner

Account of the Execution of Elizabeth Nicklson, or Shafto, or Jeffrey, when was Executed in front of the Jail, this morning, for a Double Murder, 1st, with administering, on the 4th October last, to Ann Newal or Carl, residing in Carluke, a quantity of arsenic, which she mixed with meal and water and whisky, in consequence of which she died; 2d, with having administered to Hugh Munro, then labourer or miner at’ carluke, a quantity of arsenic, which she mixed with porridge; and Hugh Munro died in consequence of having partaken of the same.

It will be recollected that the unhappy woman who has this day justly forfeited her life to the offended laws of God, and of man, was tried at our last Assizes. The indictment against the prisoner ran thus —

You the said Elizabeth Nicklson or Shafto or Jeffrey, lately residing at Carluke, are charged with administering on the 4th of October, last, to Ann Newal or Carl residing in Carluke, a quantity. of arsenic, which you mixed up with meal and water and whisky, and which you pretended was a medicine for her benefit and the said Ann Newal or Carl having drank there of, became violently ill, and died next day in consequence of having swallowed the said mixture.

You are also charged with having on the 28th of October last, administered to to Hugh Munro, then labourer or miner at Carluke, and lodging with you, a quantity of arsenic which you had mixed up with porridge and the said Hugh Munro having partaken of the porridge became ill and, continued so the two following days. You are likewise accused of having on the 30th, October last, administered to the said Hugh Monro a quantity of arsenic which you had mixed up with rhubarb and the said Hugh Munro died in consequence of having partaken of the same.

The prisoner pleaded Not Guilty, and the trial proceeded. Never before was there so connected and convincing a chain of circumstancial evidence developed in a Court of Justice. The following is a sort of summing up of the facts of the case, as they were sworn to on the trial. It appeared the no suspicion had been excited against the prisoner amongst the villagers of Carluke, on the death of the old woman, Carl, who resided next door to the prisoner — but that when her lodger Munro died in excruciating agony about four weeks after, and was buried by request of the prisoner, (as indeed Carl was also) in a great hurry, reports not favourable to her began to be openly made, and to such a length did the matter go, that both bodies were raised from their graves, and certain portions of the stomachs extracted for medical examination. It afterwards appeared from the evidence of the two surgeonss at Carluke as well as from that of two highly experienced chemists in Edinburgh, to whom portions of the matter found in the stomach s has been transmitted, that minute quantities of arsenic, but quite sufficient to cause death, had been discovered in each of the stomachs. It was also proven that the prisoner had purchased arsenic at two different times, by the hands of another person, for the ostensible purpose, as was alleged, of killing rats, by which she said her house was infested, although none of the witnesses on that spot had ever seen a rat about the premises. These purchases, be it observed, were made immediately preceding the death of Carl and Munro. Add to this it was proven that the prisoner mixed up the dose for the sick woman Carl herself and also made the porridge by which her lodger Munro was poisoned. With regard to this poor highlander, it appeared that he came home on a Saturday, in as good health and high glee as ever he was in his life, looking forward, no doubt to a happy meeting he was soon expecting to have with his friends in Skye, and that having partaken of some porridge made by the prisoner, he was soon after seized with dreadful thirst and pain, in this state the continued for two days when she again tendered him mixture of rhubarb as she alleged; soon after which she expired in great agony. The prisoner owed Munro five pounds, which she could not pay, and this seemed to be the only cause she had for committing so diabolical a crime. About the period of the murder, Jeffrey used many ineffectual tricks to makevthe friends of the deceased believe that she had accounted on the money to the deceased, but it came clearly out that she had not paid a farthing of it. With regard to the murder of the old woman, Carl, the Depute-Advocate’s theory was, that the prisoner had tried her hand on her to discover how much poison it would take to kill the young man, Munro, but the villagers say the houses were very scarce at Carluke, and that the prisoner wished to make room for a more productive lodger. There were many other facts came out in detail, all tending to criminate the prisoner, who after a trial of 18 hours, was found Guilty, and sentenced to be executed this day, but recommended to mercy by the Jury — for what reason, or on what grounds, was not mentioned. On this recommendation the prisoner had great hopes until Thursday, when an answer to an application to Lord John Russell, from a few Quakers and other eccentric individuals in this City, was refused; These characters say it was a mighty piece of unheard-of cruelty to execute BURKE!

But we have no patience with them — their maukish ravings are an outrage on nature and common sense, how humane, and kind, and charitable they are to the cold blooded murderer — while not a sigh is given to the innocent butchered victims!

When the prisoner understood there was no hope, (Which had been so unproperly raised) she betook herself to her devotions, and has continued almost since, engaged in prayer. The crowd, this morning, around the, scaffold was large. After some time spent in earnest prayer with the clergymen who assisted her; she gave the signal, when the drop fell, and in a minute she ceased to exist. The crowd then left the ground in good order.

1831: Atanasio, shot for some buttons

This episode from Mexican Alta California comes from the short-lived administration of Manuel Victoria, who proved himself such a martinet in his few months as governor of that territory that a rebellion that December forced Victoria’s resignation.

Our source is Hubert Howe Bancroft, a historian of the American West, in this volume of his chronicle of California:

The administration of justice was a subject which early claimed the new ruler’s attention. It had been much neglected by the easy-going Echeandia, and crime had gone unpunished. Criminal proceedings had been often instituted, as we have seen in the local presidial annals of the last six years, but penalties had been rarely inflicted with fitting severity. Victoria had strict ideas of discipline, and no doubt of his ability to enforce the laws. He is said to have boasted soon after his arrival at Monterey that before long he would make it safe for any man to leave his handkerchief or his watch lying in the plaza until he might choose to come for it. How he carried out his ideas in this direction will be apparent from a few causas celebres of the year.

The case of Atanasio was pending when Victoria came. Atanasio was an Indian boy less than eighteen years of age, a servant in sub-comisario Jimeno’s office, who had in 1830 stolen from the warehouse property to the extent of something over $200. The prosecution was conducted by Fernandez del Campo, Padres, and Ibarra as fiscales; and the last-named demanded, in consideration of the youth and ignorance of the culprit, as well as on account of the carelessness with which the goods had been exposed, a sentence of only two years in the public works. The asesor, Rafael Gomez, after having sent the case back to the fiscal for the correction of certain irregularities, rendered an opinion April 18th, in favor of the death penalty; and by order of the comandante general Atanasio was shot at 11 a.m. on the 26th. Gomez was an able lawyer, and I suppose was technically correct in his advice, though the penalty seems a severe one. Naturally the Californians were shocked; and though an example of severity was doubtless needed, Victoria was not fortunate in his selection. The circumstance that led to the culprit’s detection seems to have been his using some military buttons for gambling with his comrades; and the popular version of the whole affair has been that an Indian boy was shot by Victoria for stealing a few buttons.

1831: Gesche Margarethe Gottfried, the Angel of Bremen

The Domshof town square still holds a spuckstein (“spit stone”) where passersby can revile Gesche Margarethe Gottfried, a serial poisoner beheaded in Bremen on this date in 1831.

Gottfried wielded the 19th century’s weapon of choice for subtle domestic homicide, arsenic, mixed into spreadable fat, a concoction known as Mäusebutter after its intended legitimate use. This delectable served for 15 murders over as many years in the 1810s and 1820s.

The “Angel of Bremen” — so earned for her kindly habit of nursing her victims through the death throes she prepared them — began as is customary with her spendthrift first husband, followed soon by the three children she had by him, her own mother, father, and brother, and her second husband.

After a six-year break apparently because her access to Mäusebutter had run out, Gottfried was able to resume her career in 1823 by offing her second husband followed by a series of less intimate acquaintances: a neighbor, a landlady, a maid, a creditor. All of her murders seemingly had some pecuniary motive, including those early ones of her own kin (think inheritance). But in many instances the apparent profit was very minor, and her motivations remain uncertain to this day. The phrenologists who examined her head after execution certainly had some ideas: “the brain exhibits an enormously large organ of Destructiveness, with a very deficient Benevolence. This combination appears to have rendered its possessor almost a hyena or tiger in her dispositions.” (Source)

At last one of her proposed victims, one Johann Rumpff who was the husband of the “landlady” Wilhelmine Rumpff already poisoned by Gottfried, became suspicious enough of her to have meals she served to him examined by a doctor, which led speedily to her arrest and to all the rest.

Gottfried was the last person (male or female) publicly executed in Bremen. She survives well enough in the cultural memory to earn periodic tribute on stage, screen, and literature …

1831: Vicente Guerrero, former President of Mexico

Vicente Guerrero, late the president of Mexico, was executed on this date in 1831.

He was once a rebel soldier under Jose Maria Morelos in the Mexican War of Independence against Spain.

The Afro-Mestizo Guerrero (English Wikipedia entry | Spanish) cinched that conflict by successfully appealing to his royalist opposite number, Agustin de Iturbide, to switch sides. Their combined forces rode into Mexico City together in September 1821 but the conservative Iturbide and the liberal Guerrero soon parted ways.

Iturbide was elevated to emperor of Mexico; Guerrero by 1823 had returned to the field to rebel against the strongman. When Iturbide was deposed (and eventually executed), Guerrero became one of the ruling triumvirs and a national political figure. He contested the 19281828 presidential election which he lost at the ballot box but won in the ensuing street battles — an affair that featured the intervention on Guerrero’s side of Santa Anna.

He was quick about abolishing slavery and he had to be, for this mixed-race populist was deposed by his conservative vice president within months — beginning another round of civil conflict that was dishonorably resolved when an Italian sea captain arranged with the Mexico City government to lure him aboard and arrest him. For this gambit Judas received 50,000 pesos and Guerrero a summary court-martial and a firing squad at Cuilapam.

The cruel treatment of Guerrero requires an explanation. Bravo had been defeated in 1827 but was merely exiled and there were other similar cases. It is reasonable to ask, therefore, why in the case of Guerrero the government resorted to the ultimate penalty. The clue is provided by Zavala who, writing several years later, noted that Guerrero was of mixed blood and that the opposition to his presidency came from the great landowners, generals, clerics and Spaniards resident in Mexico. These people could not forget the war of independence with its threat of social and racial subversion. Despite his revolutionary past, the wealthy creole Bravo belonged to this “gentleman’s club’, as did the cultured creole, Zavala, even with his radicalism. Hence Guerrero’s execution was perhaps a warning to men considered as socially and ethnically inferior not to dare to dream of becoming president. (Source)

The southern Mexico state of Guerrero is named for him; its slogan, mi patria es primero (my fatherland is first) is the legendary reply that the young Vicente Guerrero made to his Spain-supporting father when asked to foreswear the independence movement.

1835: Four slaves, for the Malê Rebellion

On this date in 1835, four African slave rebels were shot at Salvador.

The Malê Revolt acquired its name from the local designation for Muslims … which was the predominant religion of the slaves harvested from West Africa* who were pouring into Brazil. (It’s also known as the Muslim Revolt, or simply the Great Revolt.) Ethnically, these were mostly Yoruba peoples, known in Brazil as Nagôs; Nagôs constituted the bulk of the slave sector whom the Portuguese had nicknamed “Minas” — Gold Coast imports who had embarked their slave ships at the notorious Elmina Castle.

Under whichever designation, this population was particularly thick in the agrarian Atlantic province of Bahia; there, “slaves constituted the majority of Bahia’s population in the 1820s and 1830s, [and] the maority of slaves were African-born.” And African-born slaves proved over the years to share a vigorous spirit of resistance. Slave risings and plots had emerged in Bahia in 1807, 1809, 1814, 1816, 1822, 1824, 1826 1827, 1828, 1830, and 1831, spanning the periods of Portuguese colonialism and Brazilian independence. Scottish botanist George Gardner, recalling his travels in Brazil in the late 1830s, opined that

The slaves of Bahia are more difficult to manage than those of any other part of Brazil, and more frequent attempts at revolt have taken place there than elsewhere. The cause of this is obvious. Nearly the whole of the slave population of that place is from the Gold coast. Both the men and the women are not only taller and more handsomely formed than those from Mozambique, Benguela, and the other parts of Africa, but have a much greater share of mental energy, arising, perhaps, from their near relationship to the Moor and the Arab. Among them there are many who both read and write Arabic. They are more united among themselves than the other nations, and hence are less liable to have their secrets divulged when they aim at a revolt.

Here, in secret madrassas and an underground tongue, these people cultivated a shared religion that naturally fused with the religious to the political and eventually germinated a revolutionary conspiracy. Two elderly, enslaved Muslim teachers seems to have been particular nodes in this community of resistance.**

On the night of January 24-25 of 1835, some 300 of these African-born slaves (with a few African-born freedmen) rebelled and attacked the city of Salvador. The fighting spanned only a few midnight hours; rumors of a rising had reached white ears on the 24th and as a result the masters stood halfway prepared and rallied quickly enough to crush the revolt — killing around 80 rebels in the process.

Nevertheless, it was perhaps the largest and most frightening servile rebellion in Brazil’s history. And although not all participants were Muslim, they very distinctively were all African-born: second-generation, Brazil-born blacks (whether slave or free) as well as mulattoes, who occupied a higher caste rank more in simpatico with whites, were deeply distrusted by African natives as liable to betray the plot — and rightly so. This turned out to be the very channel by which advance warning of the imminent rebellion reached white ears on the night of January 24. It was a great, if last-minute, victory for white Brazilians’ intentional stratification of the servile labor force: “The division among Africans is the strongest guarantee of peace in Brazil’s large cities,” the governor of Bahia had written in 1814.

Surprisingly, only four juridical executions are known to have resulted from this rising, although flogging sentences inflicted on others were so brutal that at least one person also died under the lash. Records, however, are patchy, and as João José Reis notes in his essential text on the Malê revolt (Slave Rebellion in Brazil: The Muslim Uprising of 1835 in Bahia) it is scarcely apparent why these particular men came in line for the law’s final extremity:

The president of the province, under pressure from influential members of Bahian society, felt that it was important to put on a public spectacle and hang prisoners as soon as possible so as to intimidate would-be rebels. With this in mind, on 6 March 1835 Francisco de Souza Martins wrote to the minister of justice:

It seems fitting, as has been suggested to me by many Citizens of this Capital, that the Government of His Majesty the Emperor, so as not to diminish the healthy effect of an execution as soon as possible after the crime, should have the sentences carried out on the two or three main leaders, at the same time declaring that these individuals should not have any recourse or appeal; that is, such a measure is thought to be both efficacious and necessary to the present circumstances.

In a decree dated 18 March 1835 the central government accepted this suggestion and ordered that the death sentences be “immediately carried out without being allowed to go before a Court of Appeal, after the remaining legal steps had been taken.” A month later, on 14 May, one day after the publication of the law on deportations, and without having taken “the remaining legal steps,” the government put four Africans to death.

There was only one freedman among those executed: Jorge da Cruz Barbosa, a hod carrier (carregador de cal) whose African name was Ajahi. Ajahi had been arrested on the day after the uprising, in the house of some fellow Nagô acquaintances, Faustina and Tito. Tito was also involved in the rebellion and had left home some days before the twenty-fifth, never to return. On the morning of the twenty-fifth, Ajahi showed up wounded and hid under a bedframe (estrado). Faustina turned him in to inspectors Leonardo Joaquim dos Reis Velloso and Manoel Eustaquio de Figueiredo, who arrested him. Under questioning Ajahi declared that he lived on Rua de Oracao and was a neighbor of Belchior and Gaspar da Cunha, whom he used to visit regularly. Concerning the meetings they had there, he claimed: “Everybody prattled on and on or just stopped in to say hello.” He denied being a Malê and having participated in the revolt. He tried to convince the judge and jury that the bayonet wound in his right leg “had been inflicted by soldiers … while he was at the window, [and] not because he was outside fighting with anybody.” Ajahi was apparently just an ordinary rebel. Indeed none of the Africans questioned in 1835 suggested he had played an important part in the Malê organization. Even so, on 2 March 1835 he was sentenced to death, along with other important prisoners. His sentence had been set by Francisco Goncalves Martins, the chief of police, now presiding over the jury as a judge: “In light of the previous declaration … on behalf of the Sentencing Jury I sentence prisoners: Belchior da Silva Cunha, Gaspar da Silva Cunha, and Jorge da Cruz Barbosa (all freedmen), as well as Luis Sanim, a slave of Pedro Ricardo da Silva, to natural death on the gallows.” With the exception of Jorge Barbosa (Ajahi), all those listed by Martins had their sentences commuted. Ajahi appears to have escaped from prison, but he was quickly recaptured. Perhaps the maintenance of his sentence comes from his being considered an incorrigible rebel.

Little is known about the others sentences to death. They were all Nago slaves. One of them was Pedro, a slave of Joseph Mellors Russell, the English merchant. It seems that all of this man’s slavees took part either in the rebellion or, at least, in the Malê conspiracy. On his own Russell had turned over to the justice of the peace a crate containing a great number of Malê objects belonging to his slaves — Necio, Joao, Joaozinho “the urchin,” Tome, Miguel, and Pedro. Of all these men Joao was the most militant, and his final sentence is not known. No one knows why Pedro was singled out for the death penalty. I could not find the records for his particular trial.

The other two slaves executed were Goncalo, whose owner appears in the records as Lourenco so-and-so, and Joaquim, who belonged to Pedro Luis Mefre. About them all that is known is that they were among the thirteen rebels wounded and taken prisoner during the confrontation at Agua de Meninos. It may be that they were both abandoned by their masters, since nothing suggests that they might have been leaders and none of the other eleven taken prisoner in the same circumstances received similar punishment.

These were, then, the four Africans put to death in 1835. Rodrigues began a tradition claiming that five Africans were executed, but there is no evidence for it. He names a freedman by the name of Jose Francisco Goncalves as the fifth victim. This African actually existed. He was a Hausa and lived in the Maciel de Baixo neighborhood. According to his testimony, he earned his living “bringing out samples of sugar from the warehouses for Merchants.” His name appears on the Roll of the Guilty with this observation: “sentenced and acquitted on 4 June 1835.” On that same roll the names of Jorge da Cruz Barbosa, Joaquim, Pedro, and Goncalo appear, with the following observation after each one: “sentenced to death and executed on 14 May 1835.”

Like all public executions, this one had its share of pomp and ceremony. The victims were paraded through the streets of Salvador in handcuffs. At Campo da Polvora new gallows had been constructed to replace the old ones, which had rotted from lack of use. At the head of the cortege marched the council “doorman,” Jose joaquim de Mendonca, who cried the sentence out to the ringing of bells. After him came Joao Pinto Barreto, the execution scribe, and Caetano Vicente de Almeida, a municipal judge. On both sides of the prisoners marched a column of armed Municipal Guardsmen. The Santa Casa da Misericordia was also presente, since the bylaws of that important philanthropic institution obliged its members, who were recruited from the local elite, to march along with people condemned to death as an act of Christian piety. The execution itself was to be witnessed by the interim chief of police (Martins had already gone to Rio de Janeiro as a congressional deputy), Judge Antonio Simoes da Silva, and by the commandant of the Municipal Guard, Manoel Coelho de Almeida Tander.

Much to the authorities’ disappointment, the new gallows could not be used to hang the prisoners. No one would act as executioner. On 13 May, one day before the execution, the vice-president of the province, Manoel Antonio Galvao, in response to a request from the chief of police, offered 20-30 milreis to any ordinary prisoner in Bahia’s many jails to act as executioner. Even though that was four months’ earnings for the average urban slave, no one came forward. The chief warden, Antonio Pereira de Almeida, expressed his disappointment in a communique to the chief of police that afternoon: “I have offered the job to the inmates, and no one will take it. I did the same thing today at the Barbalho and Ribeira dos Gales jails, and no one will take it for any amount of money; not even the other blacks will take it — in spite of the measures and promises I have offered in addition to the money.” Either because of prisoners’ solidarity or out of fear of retaliation from the African Muslims, an executioner could not be found. For this reason, still on 13 May, the president of the province had a firing squad formed to carry out the sentences. Then, on the fourteenth at Campo da Polvora, the four men were executed by a squad of policemen and immediately buried in a common grave in a cemetery run by the Santa Casa, next to the gallows. Without the hangings, the didactic value Bahian leaders envisaged in the spectacle was lost.

Less pomp surrounded floggings, although they too were public. Here, as well, the chief of police insisted (20 March 1835) that the “punishment should immediately follow the crime.” He argued that haste was necessary “so that the prisoners would not overflow,” a practical more than a political reason. The scenes of torture oculd not have been more degrading. The victims were undressed, tied, and whipped on their backs and buttocks. Floggings were held at two different sites: the Campo da Polvora and the cavalry garrison at Agua de Meninos, where the last battle of the uprising had been fought. At times the authorities worried that these public spectacles would themselves disturb the peace. Alufa Licutan’s sentence to one thousand lashes would be carried out in public, “but not on the street of the city.”

Prisoners received fifty lashes per day, “for as many days as it took to undergo the entire sentence … provided there was no risk to a prisoner’s life.” The victims’ suffering was closely watched by armed guards and carefully supervised by officers of the law, as well as by a court scribe who on a daily basis recorded the date, names, and numbers of lashes. From time to time, doctors visited the victims to check on their health and to advise whether the whipping should be continued or suspended for a while. These doctors’ reports are shocking testimony to the physical state of the tortured individuals. On 2 May 1835 Dr. Jose Souza Brito Cotegipe told Caetano Vicente de Almeida, the municipal criminal judge: “I have only found two who are well enough to continue serving their sentences. The rest cannot because of the enormous open wounds on their buttocks.” In a report on 19 September he said: “Having proceeded in the examination … of the Africans being flogged, I can inform Your Grace that the blacks [named] Carlos, Belchior, Cornelio, Joaquim, Carlos, Thomas, Lino, and Luiz (at the Relacao Jail) are in such a state that if they continue to be flogged, they may die.”

On that very day Luiz was admitted to the Santa Casa da Misericordia Hospital, where he stayed for two months. On 3 November he went back to the stocks, and two weeks later he completed his sentence of eight hundred lashes. Narciso, another slave, was less fortunate. He was caught red-handed during the uprising and did not survive the twelve hundred lashes of his sentence. He is the only African known to have died from that terrible punishment, but there may have been more.

After the Malê Rebellion, the signs and practices of Islam came under harsher surveillance than ever before. Brazil did not abolish slavery until May 13, 1888 — the very last nation in the western hemisphere to do so.

* Prisoners taken by all sides during the wars accompanying the formation and growth of the Sokoto Caliphate were a key source for the early 19th century slave trade.

** Neither teacher was directly involved in the rebellion: one, Ahuna, had alredy been exiled to another locale and the other, Bilal, languished in prison for debts. We have particularly poignant word of the latter’s devastation upon hearing word of what had transpired.

After the rebellion, Bilal, still in jail, received news of the fate of the rebellion. One of his cell companions said in a gripping testimony that Bilal lowered his head to weep and that he never saw him raise it again. Bilal wept as many of his cherished students were brought into the jail. When one of the surviving rebels, who was being incarcerated, passed Bilal a piece of paper with a message written on it, he read it and swiftly began to weep. The devastating fate of his students had brought Bilal to a perpetual trail of tears. His fate, however, was to be amongst the most devastating. Although he could not be charged with participation in the physical uprising that took place, it was clear to authorities that he had participated in the spiritual cultivation of the uprising. Bilal “was sentenced to 1,200 lashes of the whip, to be carried out in public, though not in the streets where everyone could see. The sentence was divided up into 50 lashes a day until completed.” We can imagine that this is how Bilal died.

1836: Two English poisoners

On this date in 1836, two different Englishwomen hanged in Gloucester and Liverpool for seeing off their respective husbands with arsenic.

They’re the subjects of an excellent pair of posts by Naomi Clifford, author of such topical-to-Executed Today fare as Women and the Gallows, 1797-1837 and The Murder of Mary Ashford: The Crime that Changed English Legal History, which concerns the long overdue abolition of juridical trial by combat in Great Britain … after an accused murderer used this artifact to escape prosecution in 1817.

On this day in 1830, at Libberton’s Wynd in Edinburgh, Scotland, Robert Emond or Edmond was hanged for the brutal murders of his sister-in-law, Catherine Franks, a fifty-year-old widow, and her teenage daughter, Magdalene. They had lived in a village called Abbey, near Haddington.

The story of the killings is told in Martin Baggoley’s book, Scottish Murders. It’s a sad but familiar tale of family trouble and domestic violence.

The victims had been discovered by concerned neighbors on the afternoon of October 28, 1829. Neither of them had been seen for days, and Catherine’s pig was squealing continually from hunger in its sty.

Two men went to the Franks cottage to investigate and found Catherine’s body lying in the pigsty. Her throat had been slashed and, as the Newgate Calendar records, her rings, earrings and watch were missing. The neighbors’ first thought was for Magdalene, and they rushed inside the cottage through the open back door and found her in the bedroom. The girl had been beaten to death; there were eight distinct injuries to her head and her skull had been fractured several times.

The doctor who examined the bodies determined Catherine and Magdalene had probably been killed on either Sunday night, October 25, or early Monday morning. The house had been ransacked, drawers had been pulled out of and their contents dumped on the floor, and the floor was covered with blood, including distinct bloody footprints.

The police didn’t have to look far for a suspect: a neighbor told them Catherine had recently accused her brother-in-law of stealing from both her and his wife, the latter also named Magdalene. Robert had then obliquely threatened her, saying, “If you won’t keep away from here and your sister, who are you are making as cross-grained as yourself, I won’t answer for the consequences.”

Although Robert Emond was of “respectable” parentage, had a good education and had been honorably discharged from the Army, he had a reputation for violence even as a youth and the neighbor kids called him “the fiend.”

The Emonds had been married for less than three years by the time Catherine and Magdalene Franks were murdered, but already the relationship was breaking on the rock of Robert’s violent temper and dissatisfaction with his life.

Unusually for that time, Magdalene Emond owned her own successful business and was of independent means, but Robert had had several financial failures and resented his wife’s success. He also resented Catherine because he felt she was continually criticizing him to everybody and making his marital problems worse.

A broadside about the crimes and Emond’s execution noted,

He seems to have brought himself to think that he was utterly despised by Mrs. Franks and his wife, and on being opposed by them in any of his foolish speculations in trade, although for his own ultimate good, was considered by him as resulting from that deep-rooted [antipathy], as he thought, they treated him with.

Guy B. H. Logan, in his 1928 book Dramas of the Dock: True Stories of Crime, described Robert as “a morose, sullen man, given to brooding over real or fancied wrongs, which, in his warped mind, became intolerable injuries,” and suggested he might have been mentally unbalanced, pointing out that there was a history of mental illness in his family.

When police went to Emond’s home in North Berwick, neighbors there told them Robert and his wife had had a violent, screaming argument after she refused to lend him money, and he’d beaten her and tried to throw her down the garden well. During their quarrel, the witnesses said, Magdalene had screamed that she knew Robert had taken money from her and her sister.

When questioned, Robert’s wife admitted the argument had taken place. Magdalene said they’d slept in separate rooms since their fight, and she kept her bedroom door locked from the inside at night.

Catherine Franks’s younger daughter, who was also named Catherine, lived with her aunt and uncle to maximize the reader’s confusion: we’ve got Catherine and Magdalene as victims, survived by Magdalene and Catherine in the killer’s household. The latter Catherine reported that she’d tried to go into Robert’s room at eight o’clock on Monday morning to give him a cup of tea, but found the door shut from the inside.

Magdalene became worried that her husband had “done himself some mischief” and summoned two men, who got a ladder and looked in the bedroom window. Robert wasn’t there and the bed had not been slept in. When he returned several hours later, he was dishelved and agitated.

The little girl would later testify at the trial, “He was wild-like, and trembling a lot. His eyes were fixed and staring.” He wouldn’t say where he’d been. His boots and stockings were wet and little Catherine saw him cleaning them later.

Suspicious, police searched the house and found Robert’s vest and pants, which were damp and bloodstained. They also found a shirt which had a bloody handprint on the fabric in spite of someone’s attempt to clean it. They also confiscated his boots.

Under arrest on two counts of murder, Robert Emond steadfastly maintained his innocence. He wrote the following letter to his wife while in custody:

My dear wife,

I am now confined in Calton Jail charged with the murder of your sister and daughter, of which I declare to you I am perfectly innocent, though I have done as much as deserves the gallows.

My dear Magdalene, I am sorry and even wish to take my own life when I think upon what I have done to you. I can’t rest night or day. I can’t rest night or day. I confess that I am a great sinner and nothing hurts me more than to think that I am suspicion of the crime of murder. I assure you that I am perfectly innocent of the crime laid to my charge and I hope God Almighty who sees into all things will be my advocate on the day of the trial.

I am aware the people are inveterate against me, because the proof, in their opinion, is so much against me. I again, my dearest Magdalene, declare I am innocent, although at this time my mind is so much affected that I hardly know what I say.

I have been examined before the Sheriff of Edinburgh several times but I think they can’t prove nothing against me. The public are aware I understand of the iron heels of my shoes corresponding with some marks at Mrs. Frank’s [sic] house and with a bloody shirt found in my house, which you can prove was occasioned by the bleeding of my knows, or you know better by the blood that flowed from your head the Sunday preceding that most horrid murder. I understand that the authorities in Edinburgh are anxious to discover my old coat, but I hope they never shall.

My dearest wife, my name has been branded in Edinburgh by illiterate stationers and I suppose that even in North Berwick is held in as much dread as the notorious murderers Burke and Hare. I must allow suspicions are against me that is nothing. I again implore you to banish from your mind the idea [that I am] a murderer of your sister and niece.

My love to all your friends, for friends I have none. Would that God take me to himself.

Robert Emond

Robert was tried in February. The prosecution argued that he’d killed Catherine Franks to get revenge, and Magdalene Franks because she was a witness, and then tore the house apart and stole Catherine’s jewelry to make it look like a robbery.

Some local witnesses who saw Robert on October 26 testified, reporting that he had “blood about his mouth, both above and below,” and that he complained that Catherine Franks was ruining his marriage and said, “This is a terrible business. I am so confused I don’t know what I am doing.” He told a friend that “the devil had been very busy with him.”

Robert pleaded not guilty and claimed the blood on his clothes came from a nosebleed, the injuries his wife sustained when he beat her, or a chicken he’d killed. The coat he mentioned in his letter never did turn up, but one witness testified that he’d seen Robert wearing it shortly after the murders and it had a “wet, reddish stain” on the sleeve.

But there wasn’t a lot he could say about the bloody footprints at the crime scene: a local cobbler testified and said he’d compared the prints to Robert Emond’s boots and “it was a most unusual design and they matched the heels of Emond’s boots perfectly.”

The jury deliberated an hour before convicting him, and after his conviction he finally confessed. In spite of several attempts at suicide while in jail, Robert lived to be hanged five weeks later. On the scaffold he admitted his crime and said he deserved to die. His body was dissected at the University of Edinburgh, as per the custom.

1838: William Moore, thirsty for blood

On this date in 1838, William Moore hanged at High Street, Maitland, New South Wales, a mere 25 days after slaughtering his master.

Australian convicts were commonly assigned to work for the free population — as Moore was to a butcher named John Hoskins/Hosking. Pissed that Hosking had reported him absent to the police when he ditched work the previous day, Moore on February 1st got drunk and

made an attack upon him with a knife, and inflicted six wounds, either of which would have caused death; he then left the house with the bloody knife in his hand, and wiping the blood off with his hand, he put it to his lips, saying, “This is flash Hosking’s heart’s blood, and, thank God! I have got a good appetite to eat it.” He then drew his finger along the blade, licked off the blood, and swallowed it!

The blood-licking was the least of it. Once the maniac was overpowered and the butcher’s shop examined, well,

[t]he first thing, which met the eye on entering, was a stream of gore flowing over the shop, and proceeding backwards by the track of blood visible on the floor, the body of the unfortunate Hoskins was discovered perfectly lifeless, his throat cut through to the bone, the vertebral column broken and a frightful gash on the chin; independent of these wounds, which were enough to have destroyed him, there was a second in the pit of the stomach, a third in the region of the heart, a fourth in the right side, a fifth above the hip, from which the intestines protruded in a frightful manner, a sixth across the arm, and a seventh, by which his left thumb was nearly severed from his body, that had evidently been inflicted when the unfortunate man was struggling with his murderer.

He was hanged to the hisses of a hostile populace at the site of Hoskins’s house.

1830: Benito de Soto, a pirate hanged at Gibraltar

On this date in 1830, the Galician or Portuguese pirate Benito de Soto was hanged at Gibraltar.

One of the very last of the dying breed of high-seas pirates, de Soto mutinied aboard an Argentine slave smuggler in 1827, re-christened her Burla Negra (“Black Joke”), and ran up the black flag.*

The pirates now entered freely into their villianous [sic] pursuit, and plundered many vessels; amongst others was an American brig, the treatment of which forms the chef d’oeuvre of their atrocity. Having taken out of this brig all the valuables they could find, they hatched down all hands to the hold, except a black man, who was allowed to remain on deck, for the special purpose of affording in his torture an amusing exhibition to Soto and his gang. They set fire to the brig, then lay to, to observe the progress of the flames; and as the miserable African bounded from rope to rope, now climbing to the mast head — now clinging to the shrouds — now leaping to one part of the vessel, and now to another, — their enjoyment seemed raised to its highest pitch. At length the hatches opened to the devouring element, the tortured victim of their fiendish cruelty fell exhausted into the flames, and the horrid and revolting scene closed amidst the shouts of the miscreants who had caused it.

Of their other exploits, that which ranks next in turpitude, and which led to their overthrow, was the piracy of the Morning Star. They fell in with that vessel near the Island Ascension, in the year 1828, as she was on her voyage from Ceylon to England. This vessel, besides a valuable cargo, had on board sevreal [sic] passengers, consisting of a major and his wife, an assistant surgeon, two civilians, about five and twenty invalid soldiers, and three or four of their wives. As soon as Benito de Soto perceived the ship, which was at day-light on the 21st of February, he called up all hands, and prepared for attacking her; he was at the time steering on an opposite course to that of the Morning Star. On reconnoitring [sic] her, he at first supposed she was a French vessel; but Rabazan, one of his crew, who was himself a Frenchman, assured him the ship was British. “So much the better,” exclaimed Soto, in English, (for he could speak that language,) “we shall find the more booty.”

The Burla Negra was much the faster and better-armed ship — in fact the Morning Star was completely unarmed, with not even a store of small arms for her frightened passengers — and soon corralled her prey, murdered the captain and mate, plundered the ship, and gang-raped the women aboard. The only mercy was that the marauders, out of tenderness or drunkenness (having also helped themselves to the Morning Star‘s wine), only imprisoned the human cargo below when they scuttled the ship and sailed away — and the passengers and crew were able to free themselves before they drowned and return safe home to tell the tale of their outrage.

Benito de Soto sailed next for his home port of Corunna, with the aid of a hostage navigator commandeered from his next prize. (The captain ruthlessly shot said unwilling helmsman dead upon arrival.) This adventure, however, marked the last of his career for on the way back to sea the corsairs were shipwrecked and had to take refuge at British Gibraltar where, after residing some time under false identities, a survivor of the Morning Star recognized them.

Easy come, easy go. “Adeus todos!” were his understated last words, not counting those syllables whistled by the salt winds through his posthumous pike-mounted skull.

However, British authorities — who were very conscious that they had detected the villain by pure chance — were not at all amused by the ease with which he had set up in Gibraltar. His legacy would be an impetus to Gibraltar officials to tighten up entrance regulations and, later that same year of 1830, to institute the Royal Gibraltar Police — the oldest police force in the Commonwealth outside the British isles.

* The slaver was full of African slaves, so the first profitable thing the buccaneers did was complete the vessel’s “legitimate” purpose by smuggling them to the West Indies. A black cabin boy that de Soto chose to retain would be captured with the rest and give evidence against the pirates. “The black slave of the pirate stood upon the battery trembling before his dying master to behold the awful termination of a series of events, the recital of which to his African countrymen, when he shall return to his home, will give them no doubt, a dreadful picture of European civilization,” muses our reporter.

1835: Patrick O’Brien, Francis Spaight apprentice boy

On or very near this date in 1835,* a Limerick ship’s boy named Patrick O’Brien lost a casting of lots … then lost his life to feed his ravenous shipmates.

The spanking new 457-ton barque Francis Spaight was on the return leg of her second-ever run to Quebec to fetch timber back to her home port of Limerick. The ship was named for her owner, a big landowner and shipping magnate who had thriftily sent 216 passengers on the voyage’s first leg. As Spaight would explain to a state commission a decade later amid the Great Famine, replacing ballast with emigres on outbound voyages was pure profit. In a sort of microcosm of Ireland’s terrible economic machinery,** Spaight’s own commercial interests on land and sea dovetailed nicely in filling his hulls with Ireland’s surplus population. For example, when Spaight gained the 4,200-acre Tipperary estate of Derry Castle in 1844 he smoothly set about depopulating it** — as Ciaran O Murchada describes in The Great Famine: Ireland’s Agony 1845-1852:

He [Spaight] did this by obligating unwanted tenants to emigrate to America on board his own ships and at his cost. It was all done extremely cheaply since the ships were cargo vessels which were empty on each outward voyage in any case. By 1847 Spaight’s businesslike approach had rid him of half the Derrycastle tenants, and by the time his consolidation was completed two years later he had removed some 2,000 persons in an operation which was admired by other landlords for its efficiency and the fact that it was done without arousing any overt protest on the part of the tenants.

As to the ship that bore the master’s name, discharged of her Irish exiles and loaded with Canadian lumber, she departed her last port of call in Newfoundland on November 24. Aboard were eighteen souls: fourteen crew and four boys among whom we find our principal Patrick O’Brien — a penniless 15-year-old bound over from the Limerick workhouse as an apprentice to Mr. Spaight approximately on the eve of the Francis Spaight‘s departure. He was destined never to lay eyes on his native soil again.

On December 3, the ship capsized.† Three men were lost at sea; the other 11 crew and all four boys clambered aboard a dinghy, adrift and unprovisioned in the frigid Atlantic. There the torments of privation worked them until they slaked their hunger on their comrades’ flesh, as the Irish and then the English press related months later to their titillated readers — such as this entry from Manchester Times, June 25, 1836.

On the 19th of December, the sixteenth day since the wreck, the captain said they were now such a length of time without sustenance, that it was beyond human nature to endure it any longer, and that the only question for them to consider was, whether one or all should die; his opinion was that one should suffer for the rest, and that lots should be drawn between the four boys, as they had no families, and could not be considered so great a loss to their friends as those who had wives and children depending on them.

None objected to this except the boys, who cried out against the injustice of such a proceeding. O’Brien, in particular, protested against it; and some mutterings were heard amongst the men that led the latter to apprehend they might proceed in a more summary way. Friendless and forlorn as he was, they were well calculated to terrify the boy into acquiescence, and he at length submitted.

Mulville now prepared some sticks of different lengths for the lots. A bandage was tied over O’Brien’s eyes, and he knelt down resting his face on Mulville’s knees. The latter had the sticks in his hand, and was to hold them up one by one demanding whose lot it was O’Brien was to call out a name, and whatever person he named for the shortest stick was to die. Muville held up the first stick, and demanded who it was for? The answer was “for little Johnny Sheehan,” and the lot was laid aside. The next stick was held up, and the demand was repeated, “on whom is this lot to fall?” O’Brien’s reply was, “on myself,” upon which Mulville said, that was the death lot — that O’Brien had called it for himself.

The poor fellow heard the announcement without uttering a word.

This same story, said to have been related by an unnamed survivor of the Spaight, appeared in a number of papers with slightly varying embroideries around this time. Some versions suggest that this blind man’s bluff lot-drawing was rigged to target O’Brien as the least popular crewman; whether or not that was the case, even the “fair” version of the game was rigged at the outset to exclude the adult crew members and leave only the apprentice boys for gobbling.

The lot having been cast, we resume the ghastly narrative with Bells Life in London and Sporting Chronicle, June 26, 1836:

The men now told him he must prepare for death, and the captain said it was better it should be done by bleeding him in the arm, to which O’Brien made no objection. The captain then directed the cook, John Gorman, to do it, telling him it was his duty; but Gorman strenuously refused. He was, however, threatened with death himself by the men if he continued obstinate, and he at last consented.

O’Brien then took off his jacket without waiting to be desired, and after telling the crew, if any of them ever reached home, to tell his poor mother what had happened to him, bared his right arm. The cook cut his veins across twice with a small knife, but could bring no flow of blood, upon which there seemed to be much hesitation among the men as to what could be done.

They were relieved by the boy himself, who immediately desired the cook to give him the knife, as he could not be looking at him putting him to pain. When he got the knife, and was about to cut the vein, the captain recommended him to try the left arm, which he accordingly did. He attempted to open the vein at the bend of the elbow with the point of a knife, as a surgeon would, but like the cook he failed in bringing blood.

A dead consternation now fell upon all; but in a minute or two the captain said, “This is all of no use, ’tis better to put him out of pain by at once bleeding him in the throat,” and some of them said it was true.

At this O’Brien, for the first time, looked terrified, and begged hard that they would not do so, but give him a little time; he said he was cold and weak; but if they would let him lay down and sleep for a little, he would get warm, and then he would bleed freely.

To this wish there was some expression of dissent from the men, and the captain shortly after said to them, “that it was useless leaving the boy this way in pain; ’twas best at once to lay hold of him, and let the cook cut his throat!”

O’Brien, now roused, and driven to extremity, seemed working himself up for resistance, and declared he would not let them; the first man, he said, who laid hands on him, ‘twould be worse for him; that he’d appear to him at another time; that he’d haunt him after death.

The poor youth was, however, among so many, soon got down, and the cook was again called upon to put him to death. The man now refused more strenuously than before, and another altercation arose: but, weak and irresolute, and seeing that his own life would absolutely be taken instead of O’Brien’s, if he persisted, he at length yielded to their menaces.

Some one at this time brought him down a large case knife that was on the poop, instead of the clasp-knife that he had first prepared, with which, pale and trembling, he stood over O’Brien, who was still endeavouring to free himself from those who held him. One of them now placed the cover of the tureen (which they before used to collect rain) under the boy’s neck, and several cried out to the cook to do his duty.

The horror stricken man, over and over again, endeavoured to summon up hardihood for the deed, but, when he caught the boy’s eye, his heart always failed him, and then he looked supplicatingly to the men again.

Their cries and threats were, however, loud for death — he made a desperate effort — there was a short struggle — and O’Brien was no more.

As soon as this horrid act was perpetrated, the blood was served to the men; but a few of them, among whom was Mahony, refused to partake of it.

They afterwards laid open the body, and separated the limbs; the latter were hung over the stern, while a portion of the former was allotted for immediate use.

Shocked, as, for the sake of human nature, it is to be hoped many were at the scene they had just witnessed, a gnawing hunger came upon them all when they saw even this disgusting meal put out for them, and almost every one, even the unwilling boys, partook more or less of it.

This was the evening of the sixteenth day. They ate again late at night, and some greedily; but the thirst, which was before at least endurable, now became craving, and as there was no more blood, they slaked it with salt water.

They then lay down to rest, but several were raving and talking wildly through the night, and in the morning the cook was observed to be quite insane — his eyes inflamed and glaring, and his speech rambling and incoherent; he threw his clothes about restlessly, and was often violent. His raving continued during the succeeding night, & in the morning, as his end seemed to be approaching, the veins of his neck were cut, and the blood drawn from him. This was the second death.

On the night of that day, Michael Behane was mad, and the boy George Burns on the following morning; they were both so violent, that they were obliged to be tied by the crew, and the latter was bled to death, like the cook, by cutting his throat. Michael Behane died unexpectedly, or he would have suffered the same fate.

Next morning the captain came off deck, and, feeling too weak and exhausted to keep a look-out any longer, desired some one to take his place above. Harrington and Mahony went up very soon after; the latter thought he could distinguish a sail, and raised a shout of joy, upon which those below immediately came up. A ship was clearly discernible, and apparently bearing her course towards them.

Signals were hoisted with as much alacrity as the weakness of the survivors would allow, and, when she approached, and was almost within hail, their apprehension of her passing by was so great, that they held up the hands and feet of O’Brien to excite commiseration.

The vessel proved to be the Agenoria [sic — Agenora is the correct name of the ship], an American. She put off a boat to their assistance without any hesitation, although the weather was so rough at the time, and the survivors were saved.

The Francis Spaight was channeled almost straight from such reports by Jack London into a shocking short story.

The notoriety of cannibalism did not translate to any sense that the famished survivors ought to be prosecuted: they were objects of pity and the survival of those who made it was rather celebrated than disdained since even weeks later as they arrived back at Limerick they presented an appearance “ghastly and spectre like with a singular woe-be-gone expression of countenance.” (Quoted in Neil Hanson’s book about a later instance of cannibalism, The Custom of the Sea)

Francis Spaight — the oligarch, not his barque — wrote an appeal that the public sustain with charity his own invalided employees … for, “mutilated by the frost and otherwise rendered helpless” they would “be unable not only to obtain bread, but to labour for it during the rest of their lives.” What, you think I’m going to hire them? (Actually the skipper who orchestrated O’Brien’s death went back to work captaining Spaight’s ships.) Spaight put in ten quid for the lot of them, something like US $1,000 in present-day money.

And the grief-stricken mother of Patrick O’Brien haunted Spaight’s country estate “where her hysterical cries were truly heart-rendering.” (Source)

* Understandably calendar-keeping was not foremost on the minds of the Francis Spaight survivors. Many sources give the 18th as the date of O’Brien’s sacrifice; I’m gingerly preferring the 19th in deference to the immediate newspaper reports such as the one quoted in this article. This also appears to square with rescue on the 23rd: by the quoted narrative, the cook is slaughtered two days after O’Brien (hence, the 21st), and Michael Behane and George Burns die on the following day (the 22nd), only for the survivors’ salvation to appear “the next morning.”

** “Irish genius discovered an altogether new way of spiriting a poor people thousands of miles away from the scene of its misery … instead of costing Ireland anything, emigration forms one of the most lucrative branches of its export trade.” –Marx

† Though useless to our survivors in their hour of need, the Francis Spaight did not sink. She was recovered, pumped out, and returned to service. Years later she went down for good at Table Bay, near the Cape of Good Hope.
