2004: Ibtisam Hussein, child-murderer

Five years ago today, in Jordan’s Swaqa Prison, a 24-year-old woman named Ibtisam Hussein was hanged for drowning two young children in the Jordan Valley canal in 2002.

Ibtisam Hussein (or Ibtisam Hussain) was the only known execution in Jordan in 2004, after a manslaughter conviction was upgraded on appeal. The unfortunate five- and six-year-old victims belonged to members of her fiance’s family who opposed the engagement to Hussein … evidently with good reason.

The rope reportedly broke on the first attempt; she was executed successfully on a second try an hour later.

1887: Roxalana Druse, the last woman hanged in New York

On this date in 1887, 40-year-old Roxalana Druse was hanged in Herkimer, N.Y.

Ms. Druse and her daughter* had slain, chopped to pieces and destroyed the remains of Roxalana’s 72-year-old husband William.

Attention to her case ran toward the hyperbolic.

As Roxalana Druse’s fatal date approached, said the Saturday Globe (an early national paper here mining the product-moving public fascination with mayhem we have noted across the pond), “she has dwindled to a mere shadow of her former self and would hardly tip the scales at 85 pounds.”

Still, this infamous-at-the-time crime would be little more than a piece of period folklore were it not for the horrible end Druse suffered.

Shrieking with terror as she was hooded (so says the New York Times account, which also reports that she deferred her last statement to her Universalist spiritual counselor, who made a general denunciation of the death penalty), Roxalana Druse was hanged on an upward-jerking gallows — and the rope reportedly failed to snap her neck, leaving her to slowly strangle to death.

This botched job in a high-profile hanging intensified pressure on the New York legislature to do away with the gallows; the next year, it became the first jurisdiction in the world to adopt electrocution for death sentences.

And Roxalana? She’s preserved in local lore in Herkimer, where she is said to haunt the courthouse where she heard her sentence.

* Roxalana Druse insisted that her teenage daughter Mary had nothing to do with it. Mary received a prison sentence, and was pardoned in 1895.

1945: Private Eddie Slovik, the last American shot for desertion

On January 31, 1945, Private Edward Donald “Eddie” Slovik became a curious outlier of World War II: he was executed by firing squad by the U.S. Army for desertion. He is the only person to have been so punished for that crime since the Civil War.

Pvt Slovik was, by all accounts, quiet and helpful, by no means a coward, and more than willing to aid in the effort of World War II, traits which would have put him among a large class of that war’s veterans. Unfortunately, he was also immobilized by shelling. Equally unfortunately, he knew it, and he decided to do something about it.

Slovik and a friend, Pvt John F. Tankey, first separated from their detachment under artillery fire in late August 1944, shortly after being shipped to France. The pair hooked up with a Canadian unit and spent six weeks pitching in. Having recused themselves from the hard shelling others were experiencing on the front line, they opted to rejoin their regular U.S. unit: Slovik and Tankey sent a letter to their commanding officer explaining their absence and returned on Oct. 7.

But the front lines were not a place for Pvt Slovik.

After his assignment to the rifle unit, which would face imminent danger during shelling, Slovik asked to be placed in the rear guard, indicating he was too scared to remain in front. His request was refused. He then reportedly asked whether leaving the unit again would be considered desertion, was told it would be, and opted for the seemingly safer route of, well, deserting. One day later, Slovik was back at a U.S. camp, this time turning himself in to the camp cook. He had drafted a letter explaining his actions and indicating that he knowingly deserted, permanently recording his guilt on paper.

It’s not clear whether Pvt Slovik was acting on principles or out of an understanding of the U.S. military judicial system. He was by no means the only soldier without affinity for the conditions of war, particularly on the allied side. During the war, thousands of soldiers were tried and convicted in military courts for desertion, but up to then, all had received only time in the brig. What is clear is that Slovik was repeatedly offered opportunities to return to the line, and he equally repeatedly refused.

The case was adjudicated on Nov 11 by nine staff officers of the 28th Division, none of whom had yet been in battle. One of those judges, Benedict B. Kimmelman, wrote a stark and intriguing account of his role in the story of Pvt Slovik, capturing the scene thusly:

Five witnesses were heard. The cross-examinations were perfunctory. The defense made no closing argument. The court recessed for ten minutes, resumed, and retired almost immediately afterward. Three ballots were taken in closed court, the verdicts unanimously guilty on all counts. In open court once more, the president announced the verdict and the sentence: to be dishonorably discharged, to forfeit all pay and allowances due, and to be shot to death with musketry. The trial had begun at 10:00 A.M.; it was over at 11:40 A.M.

As with all court martial cases, Slovik’s was sent to a judge advocate for review. His criminal record, including everything from destruction of property to public intoxication to embezzlement, did not endear him to the reviewer. More importantly, though, the advocate felt Slovik could be made an example:

He has directly challenged the authority of the government, and future discipline depends upon a resolute reply to this challenge. If the death penalty is ever to be imposed for desertion, it should be imposed in this case, not as a punitive measure nor as retribution, but to maintain that discipline upon which alone an army can succeed against the enemy.

Strangely, Pvt Slovik was the only person who would be exemplified this way.

Though the military tried 21,000 desertion cases and passed down 49 death sentences for desertion during the war, it carried out only Slovik’s. And in the war’s final battles, with Germany collapsing, his execution seemed like a surreal throwback. As Kimmelman notes, hundreds if not thousands of soldiers were strictly guilty of dereliction of duty and desertion in the waning days of 1944.

Three weeks after his conviction and three weeks before the Battle of the Bulge, Slovik’s execution order was confirmed by the 28th Division’s commander, Major General Norman “Dutch” Cota. Cota was disturbed by Slovik’s forthrightness in confessing to the desertion, and, as a front line commander who had sustained severe casualty rates in the Battle of Hurtgen Forest, had no sympathy for the crime.

After an appeal to the deaf ears of Dwight Eisenhower shortly before the sentence was to be carried out, Slovik was out of options. He was taken to the courtyard of an estate near the village of Sainte-Marie-aux-Mines and shot by 11 Army marksmen* at 10 a.m. By 10:04, as they were reloading, he was declared dead. His body was interred at a French cemetery, and after decades of lobbying the U.S. government, his remains were returned to Michigan in 1987.

Because he was dishonorably discharged, Slovik was not entitled to a pension, and his wife, Antoinette, stopped receiving payments. Curiously, though the Army managed to communicate this to her, they omitted the bit about the execution. She found out in 1953 from William Bradford Huie.

Huie was a journalist who took immediate interest in Slovik’s story, popularizing it with his book The Execution of Private Slovik, which was released in 1954. Twenty years later, the book and title were requisitioned for a well-received TV movie starring Martin Sheen.

Perhaps more interesting than this film was its never-produced predecessor, which is entitled to a place in the history of the Hollywood Blacklist. Frank Sinatra acquired rights to The Execution of Private Slovik and in 1960 announced that he would produce it as his directorial debut — with the script of this inherently political story to be written by “Hollywood Ten” blacklistee Albert Maltz. Maltz and other blackballed writers had continued working pseudonymously during the anti-Communist blacklist, but Sinatra’s openly announcing an intent to hire and credit Maltz constituted a significant crack in the wall — even though commercial and political heat eventually forced Sinatra to abandon the project. * The firing squad included 12 marksmen, but one was given a blank. Despite their skill, the 11 remaining shooters did not manage to kill him instantaneously.

1758: Francois Macandal, forgotten black messiah

The world was astounded when Barack Obama was elected to the Presidency in 2008 knowing the cultural barriers minorities have faced for hundreds of years. The date of inauguration, January 20, also happens to be the anniversary of the burning at the stake of a virtually unknown man, Francois Macandal,* whose epic war against cultural barriers has been buried for centuries.

Read some of his story and judge if the historic election of Barack Obama could have occurred without the man they called “Macandal.”

The parallels with Barack Obama’s journey are numerous, but the life of Macandal was perhaps even more remarkable, reaching great heights and falling into the darkest chasms of despair, yet succeeding in spite of staggering odds. Macandal’s travails may be about finding one’s purpose and dreaming of victory even when condemned by a majority, as he was relentlessly pursued by soldiers and hounded by countless naysayers.

251 years ago on January 20, 1758, Macandal was chained to a post on a platform before thousands of slaves brought together to witness his brutal torture and execution. Because of his importance, the French gathered slaves from hundreds of plantations throughout the colony of St. Domingue (now Haiti and the Dominican Republic). They believed such a horrific spectacle would quash Macandal’s Revolution, which he began to end French rule and abolish slavery, 12 years before.

Around 1746 Macandal escaped his plantation, united thousands of escaped slaves along with many still enslaved, and proclaimed that he would lead them all to independence and freedom. This declaration, from someone who had only six years before been taken from his home in the Congo, was unprecedented, since no slave colony had ever defeated a European nation. Then Macandal mobilized tens of thousands and may have inspired millions to end slavery and defeat colonial hegemony in the Haitian Revolution consummated decades after his death.

But ironically even the famous, black Marxist writer C.L.R. James, attributed one of the greatest revolutions in history to something akin to ‘spontaneous rioting’ by 500,000 black slaves in 1791. Since 1791 almost every historian has reduced the “Haitian Revolution,” the only successful overthrow of a colonial power by black slaves, to a ‘collective rage,’ inspired by the whites of the “French Revolution.” Yet it may have been Macandal’s Revolution, not the starving peasants of France, that inspired their uprising in 1789.

The true story of Macandal represents obscure but recorded testimonies about his life and explains why the slave revolt of 1791 was in fact, “Macandal’s Revolution,” almost 50 years in the making. Macandal foretold the end of slavery, then planned it, plotted it and began it. His story shatters a myth that has gone unchallenged for over 200 years: that the Haitian Revolution of 1791 was a spontaneous slave uprising inspired by the French peasants who had charged the Bastille Prison in Paris two years earlier.

The Haitian Revolution ultimately ousted the French, defeating Napoleon and numerous French generals. It also succeeded against the vaunted British army and established a new government run by former slaves. It was the first domino in a series of colonial defeats and changes in law that led to the end of institutional slavery; and Macandal started it all.

Correcting the Historical Record

Macandal is rarely the focus of historians and when mentioned only his insignificance is noted. But the popular version of his story was immortalized by the original French writers themselves, in the interest of bolstering a self-image of innate superiority as a nation and a race. To have recognized Macandal’s brilliance would have acknowledged slavery’s illegitimacy, so Macandal’s real story had to be trivialized and buried.

This telling of Macandal’s journey from a free child in Africa to slavery and then revolution, relies less on popular writings and more on a review of all of the records in context. For example French writers claimed Macandal broke free because he was tied with ropes and the post was made of rotted wood that fell apart when he was set ablaze. Historians have repeated this without scrutiny. The French on St. Domingue regularly burned slaves to death at the town square of the capital, “Cap Francais.” At Macandal’s execution they gathered thousands of slaves as witnesses, to insure a humiliating defeat and halt his widely supported rebellion. Yet, despite this grandiose staging, we are supposed to believe Macandal was insignificant. And we must accept that the French military was so inept they forgot how to execute and did not know that ropes burn and untreated, rotted wood is flammable. Many such dubious “facts,” are still repeated blithely about Macandal and few Westerners grant him his bravery, genius or impact.

Interestingly, the U.S. Bill of Rights guaranteeing equality for all was also adopted in 1791, but it would be more than seven decades before slavery was outlawed in the U.S. and almost two centuries before equal opportunity laws were passed and enforced. For one tiny nation, Macandal enabled this to occur over 200 years ago.

Background

I began researching the life of Macandal 20 years ago, startled and inspired by one chapter in Wade Davis’ popular book The Serpent and the Rainbow, which focused on secret societies, Voodoo and Zombification. His version of Macandal’s story was dictated to him by Rachel Bouvoir-Dominique, a Haitian Anthropologist I interviewed in 1997, at her office in Cap Haitien. Working under the tutelage of well-known author and expert on Haitian history Michel Laguerre, a professor at U.C. Berkeley, I received grants for a field study and documentary on the subject of Macandal.

Anthropologists often allocate greater weight to oral history, informal observer accounts, burial remains, maps and gravures, re-evaluating more accepted published works historians rely on, and so this account reflects my perspective and research as an Anthropologist. I examined European gravures (illustrations) and colonial records cited commonly more skeptically, because they were clearly burdened by religious, sexist and racial paradigms of the day. For example illustrations portrayed slaves with happy smiles and sanguine facades, enjoying their lives in idyllic settings on the plantations. Yet slaves faced torture, rape, separation of family and death from over-work, every day. Blacks were often drawn with monkey features (toes, ears etc.) and other demeaning caricatures.

Western writers were fiercely loyal to provincial rhetoric, including the gender and racial bias then considered crucial foundations of Christian theology. Western scholars dehumanized natives and women to rationalize slavery, prejudice and justify the infamous “hierarchy of being,” which granted “white men” a closeness to God that no one else could approach. This endowed them with the right to use others as they saw fit.

There were many reasons colonial authorities destroyed or buried the noteworthy exploits of slaves. Few accounts of courageous acts from among the ranks of millions of Africans during 400 years of slavery were recorded and preserved, primarily to maintain the perception that slavery was justified, necessary and Nubian Africans were not truly human but beasts of burden. There are literally thousands of articles, books and films about individuals among the six million Jews who died during the holocaust but only a scant few from among the 100-200 million indigenous peoples killed during the colonial expansion; all the more reason to re-evaluate slaves like Macandal.

A Brief History of Macandal

During the early 18th century, around the age of 12, Macandal was taken from the west coast of Africa, probably the Loango Kingdom in the Congo. I claim the date of his birth was 1728 primarily because oral historians in Haiti I interviewed believed him to be 30 when he was fastened to a post before thousands and set on fire in 1758.

The French called him Macandal which may derive from a city in the Congo called “Makanda.” The town of Makanda no longer exists due to civil war but could have ancient roots and slaves were often named after the places they came from. His name may have been taken from the term makanda (plural form of “kanda”) referring to African societal groups. Some written accounts report that Macandal claimed to be descended from a ranking societal group and the son of a Chief or King.

Amazingly, Macandal could speak, read and write Arabic fluently. Some believe this is because he was raised Muslim, yet the Congo was Christianized long before Macandal was born. Portuguese mercenaries, missionaries and armies had combed every square inch of the Congo beginning in the late 1400’s, searching for gold, diamonds and slaves, forcing conversion to Christianity. However Macandal’s words and actions reveal a unique knowledge of both Christianity and Islam. His ancestors may have emigrated from the east coast where Muslims and Asians had allied with Swahilis to build beautiful cities and schools before the Portuguese invasion. His family may have then hidden themselves for centuries.

Conversion to Christianity was also a requirement for slaves on colony plantations but Macandal defied the French by learning the underpinnings of Christianity, to understand the roots of slavery and challenge newly acquired doctrines. Despite many influences the adult Macandal claimed no affiliation with Christianity, Islam, Voodoo or Animism.

As a child Macandal was educated and known to be accomplished in both music and art, including painting and sculpture. His dedication to learning was apparent throughout his life. He displayed a vast knowledge of plants, became a doctor on the plantation he was taken to and was sought by even the French themselves for treatment of diseases and ailments. Yet the vegetation on St. Domingue was completely different from that of the Congo; therefore, Macandal had to study his new environment and learn the properties of perhaps hundreds of plants. He secretly taught himself French and became so eloquent that the French aristocrats remarked that he could speak it better than they themselves, though education was strictly forbidden for slaves.

Based on historical records and interviews, it appears that Macandal was first sentenced to death on his plantation, around 1746 at the age of 18, for falling in love with the plantation owner’s favorite lover, a young and beautiful house slave. He underwent a scene of heinous torture intended to culminate in his death in front of many witnesses, but escaped mysteriously and fled into the hills. The French replaced this account with a tale about Macandal becoming handicapped from losing a hand in a sugar mill and then being left unguarded. His escapes were always attributed to poor guard oversight.

Though Macandal probably began his new life of freedom with the intention of bringing vengeance to his former owner Lenormand de Mezy and rescuing his true love, for some reason his objective evolved. Perhaps because of the totality of his traumatic experiences or because of the influence of Maroons (ex-slaves already living in the distant mountains) Macandal met after escaping, he began working for a new goal of freedom for all.

Macandal led a sweeping and unwavering revolution during the 12 years after his escape from the plantation. Unlike other escaped slaves, Macandal actually made the end of slavery his stated mission. He became the first to unite thousands of disparate Maroons who were living free but divided by tribal affiliation and known to be ardently dedicated to the destruction of each other. His uniting of these groups was an extraordinary accomplishment and he is the first known black leader and ex-slave to do so.

He began calling himself the “Black Messiah” and gave rousing speeches in secret locations to recruit slaves. He made dangerous and daring appearances on plantations during the night to urge loyalty and inspire hope. The name “Black Messiah” had great meaning to Macandal as evidenced by one of his famous speeches at a secret recruitment meeting. The words exposed Macandal’s understanding of Islam and Christianity and their link to institutional slavery. The term was a powerful catalyst he used to preempt religious and ethical indoctrination of blacks and free them from the ideological bonds of slavery. He had to usurp the authority of the Church and French government to convince slaves they deserved equality, freedom, family sanctity, education and self-government.

Macandal became a brilliant strategist and had a large, organized camp with lieutenants, captains and other ranks. He led countless attacks and escaped capture mysteriously many times. His tactics were unique and devastating. They were known to be carried on after his disappearance despite the brutal efforts of the French to extinguish illegal grassroots activity. During his reign as a Maroon leader he may have recruited half or more of the 100,000 slaves living on the plantations as secret agents of his revolution.

Maroons and slaves apparently employed his tactics for decades after his disappearance in 1758. During the decade before the final thrust for overthrow in 1791, and despite harsh measures to thwart rebellion, Maroon activity greatly increased. This activity was so secret that virtually nothing is known about this period and is one reason historians assume the war for independence was unplanned, even though the first massive attack was led by Boukman Dutty, formerly a cruel black overseer who was a contemporary of Macandal. His gathering, which launched the war, was convened at a hidden location where Macandal formerly gave his speeches, the symbolism of which cannot be denied.

Generals that followed Boukman used ingenuity and unique strategies to win the 13-year war and Toussaint L’Ouverture is given most of the credit for the victory. But Toussaint refused to support the war until after it had begun; its inevitability certain. He was 13 when Macandal was sentenced to death in 1758. A voracious reader and student of warfare he was well aware of Macandal but content as a slave under a liberal planter.

It is my thesis the “Macandal Revolution” continued through the three decades preceding the Haitian Revolution. No other slave is known to have prophesied and promised the end of slavery yet Macandal predicted that blacks would defeat the French, become free and independent of colonial rule and control the colony of St. Domingue. His rally cry and pronouncement repeatedly rang throughout the colony despite opposition and betrayal from many slaves who greatly feared the French and did not believe victory was possible.

The Haitian Revolution remains the only successful movement by black slaves to defeat a colonial power and achieve complete independence. It stands alone as a towering victory against incalculable odds. Though it is characterized as a ‘riot’ that generated its own momentum, 500,000 slaves and free blacks mysteriously rose up in unison, using sticks and stones, against over 50,000 heavily armed soldiers, landowners and henchmen.

The Fall of Colonialism

As Macandal’s victories mounted I propose that word of his revolution spread to Europe and bolstered many anti-colonial movements. For example one of his closest secret allies was a French Jesuit priest and the Jesuits along with other religious leaders in Europe began fomenting rebellion during this period. Before news of Macandal’s revolt spread, many in Europe believed the slave trade was not only profitable but philanthropic. It had long been heard in the churches that slaves were heathens being brought to Christ and treated well in the process. His uprising no doubt made many Europeans aware that slaves were not being treated well and were desperate. Macandal’s shocking victories may have provoked Europeans to finally condemn colonialism and slavery. His fearless attacks and disregard for colonial might may have also seeded the French Revolution.

What really happened on January 20, 1758? Macandal endured great agony during an intense and excruciating punishment. He did this so that slaves everywhere might become free. The French claim Macandal was burned alive at the town square in Cap Francais.** Admitting he broke free and leaped out of the fire, they wrote that soldiers reclaimed Macandal and threw him back in. However some observers claimed Macandal broke his chains and fled, never to be seen again. How he broke free during any of his escapes despite being surrounded by guards and soldiers, is not known. It is interesting to note that his remains were never found and there is no burial site. Given the French proclivity for making examples of slaves to increase fear and enforce discipline, a successful execution should have been commemorated by another French monument.

For most historians, January 20, 1758, came and went with barely a mention in official memorandums. Yet a detailed search of documents reveals a massive cover-up, confusion and consternation. Macandal’s Revolution was not quashed or even slowed; instead it was impelled and sent wildly rumbling down a path of manifest destiny. Plantation owners later discovered their most trusted slaves were working for the revolution. New restrictions were put on all blacks throughout the colony and 4-5 rebels were burned at the town square every month to strike fear into the rest. Intense interrogation and torture revealed ever more depth to the conspiracy. Macandal’s execution day inflamed slaves and intensified their commitment to him and they became more united and fervently bent on winning freedom. Jesuits were banned from St. Domingue five years later.

As the first U.S. President with African roots is inaugurated on January 20, no one will speak of Macandal or Macandal’s Revolution, which led to equal rights in 1804 for one small nation. January 20, 1758, the day the French sought to secure colonialism and slavery in perpetuity, became a day of victory for Macandal and a watershed event which brought colonialism down. Though Macandal has been denied his place, his actions may have ended slavery and paved the way for people like Barack Obama to make history.

1864: Two Dodds, as two spies, in two states, and twice botched

On January 8, 1864, young David Owen Dodd was hanged in Little Rock for spying on federal troops … and cavalryman Ephraim Dodd (no known relation) suffered the same fate for the same crime in Knoxville.

Just one of those strange coincidences.

Ephraim Shelby Dodd is the subject of an outstanding HistoryNet profile whose contents this blog can not so much improve upon as summarize.

A member of Terry’s Texas Rangers (“men who ride like Arabs and fight like devils”) Dodd was captured in December 1863 and convicted by his diary — a particularly harsh reading of his diary in which a reference to having passed himself off as a Yankee was interpreted as evidence of espionage. (The diary is available online and as part of a book on Terry’s Rangers.)

Knoxville worthies rallied to save him and Ephraim Dodd insisted upon his innocence, but not so vociferously that he displayed any terror of his fate.

Do not grieve for me, my dear parents, for I am leaving a world full of crime and sin for one of perfect bliss.

The hanging itself wasn’t bliss, exactly, despite a well-planned soundtrack.

From the “Death March” the music gradually slid into “Mary’s Dream,” and then we were carried back by the magic of the plaintive notes to juvenile days; to visions of “Sandy far at Sea,” and to the sad cadence of that fading refrain,

“When, soft and low, a voice she heard
Saying, Mary, weep no more for me.”

The solemn march, the wailing notes of the fife, and perhaps above all the calm, unmoved, manly bearing of the prisoner — so we thought — produced a mournful impression upon the spectators.

Points earned on artistic merit, however, were deducted for technique.

At a signal the bolt was now withdrawn, the culprit fell, but the cotton rope broke by the sudden tension, and the man lay stretched and stunned upon the frozen ground below. A mummer of horror, mingled with expressions of pity, ran through the assembled crowd. Recovering for an instant from the shock — for his neck was not broken — he said — perhaps incoherently: “Release me quick, if you please.” For some ten minutes the unfortunate man lay thus upon his back, without moving a muscle. Meantime the officers and men, whose painful duty it was to see to the execution of the law, adjusted this time two parts of the same rope instead of one, and the half-conscious man was borne up the fatal steps a second time, being partly supported upon the drop until the double noose had been adjusted. Not a word or sign of suffering all this time escaped his lips. In another moment the drop fell, and prisoner’s form now hung by the neck — the knot behind the head. Death finally ensued by strangulation. In ten minutes, Dr. Cogswell, the officiating surgeon, pronounced life extinct, and the body was taken down and buried.

A few hours later and 500 miles down the way, the entirely unrelated hanging of David Owen Dodd proceeded in Little Rock, Ark.

Only 17 at his hanging and not physically robust enough to get his brains blown out at Gettysburg, Dodd was sent by his father on a business trip across Union lines — everything legit, and carrying a pass — but got busted with morse code notations of Union troop strength in the city.

Unlike Ephraim, who was basically a normal soldier thrust into incriminating-looking circumstances by the chance of war, young David Dodd was rightly accused.

He didn’t bother protesting his innocence, but he also kept mum about his contacts. (Suggestively, a teenage girl and her father were whisked out of town and kept under guard in Vermont for the rest of the war.) That proud silence has won him quite a reputation in Arkansas as the Boy Hero of the Confederacy.

But similarities between the condemned men extended beyond their names. David’s parting filial reassurance could pass for a paraphrase of Ephraim’s.

[D]o not weep for me for I will be better off in heaven. I will soon be out of this world of sorrow and trouble.

And the hanging itself, conducted in a tense atmosphere, was likewise a botched job. In this case, the slight young man didn’t fall hard enough to break his neck, but did fall far enough to get his tiptoes on the ground, initiating an agonizingly protracted strangulation which the soldiers on detail expedited by (accounts differ) pulling on David Dodd’s legs and/or pulling up on the rope.

1984: Alpha Otis O’Daniel Stephens: hear it live

On this date in 1984, Alpha Otis O’Daniel Stephens was electrocuted in Georgia for the execution-style murder of Roy Asbell after the latter surprised Stephens in the course of a burglary.

Stephens makes these pages for two reasons:

First, he survived his initial electrocution, requiring a second application of the lethal current — awful, though not exactly unheard-of.

Second, it emerged years later that the Georgia Department of Corrections was making audio recordings of its executions as a secret archive of the proceedings.

Several hours’ worth of these (subsequently leaked) recordings from various different Georgia electrocutions are available at SoundPortraits.org.*

We begin our trip back in time to Georgia’s execution chamber with the atmospheric sound of the warrant for his execution being read to the condemned and the witness — nicely juxtaposing the sentence of death with the body responsible for administering it: the Georgia Department of Offender Rehabilitation.

But the real action is the sound behind the curtain as prison officials realize the electrocution has not killed their man, wait agonizing minutes for the still-living body to cool enough for doctors to examine it officially, and begin the execution cycle anew. From the sound of it, they only barely killed him with the second pass: the officials are worrying openly that it looks like he’s still breathing very late in the procedure.

This file, obviously, comes with a content advisory sticker — though it lacks any directly identifiable hideous sound from the chair, or the prisoner, or the witnesses, the routine narrative of a prison bureaucrat as a man dies dreadfully in the next room is an altogether different order of horror.

WILLIS MARABLE: The execution now has begun. There was one small jerk from the condemned at the time the execution was initiated. He is sitting very still now, and we are also now into the second phase of the execution. We are now into the third phase of the execution. No movement from the condemned. No activity, no movement from the witnesses. He appears to be relaxing a little bit more now. There’s sixty seconds remaining on the third phase of the execution. There is a slight movement from the condemned’s head. He seems to be moving his head from side to side slightly.

UNIDENTIFIED: I show the time is 12:19.

WILLIS MARABLE: Commissioner, he is still moving his head, and he seems to have slumped down in a relaxing-type position in the chair. But his head is moving from side to side slightly. Commissioner, Mr. Low, the execution is completed at this time. The electrical panel box is secured and locked. I do not detect any movement from the condemned at this time. He seems to have stopped moving his head and also his arms.

UNIDENTIFIED: I show the time is 12:20.

UNIDENTIFIED: You are in the lapse time countdown, is that correct?

WILLIS MARABLE: Yes, sir. We’re into the first minute of the lapse time now. No movement from any of the witnesses, and at this time no movement from the condemned. Still very little movement from any of the witnesses, and I detect no movement from the condemned at this time.

WILLIS MARABLE: Commissioner?

COMMISSIONER: Yes?

WILLIS MARABLE: Mr. Low?

COLONEL LOW: Yes.

WILLIS MARABLE: There is some slight movement. He’s still moving his head slightly. The only thing we can do is continue until the physicians can check him after the lapse time has expired.

COLONEL LOW: Don’t vary from your checklist.

WILLIS MARABLE: OK, sir. OK, we have completed three minutes of lapsed time, two minutes remaining. Commissioner? Mr. Low?

COLONEL LOW: Yes.

WILLIS MARABLE: He is still moving his head slightly, kind of a bobbing up-and-down movement. Commissioner?

COMMISSIONER: Yes.

WILLIS MARABLE: Mr. Low? We have completed four minutes of lapsed time. We have one minute remaining. And from my vantage point I do detect or it seems to be that he is breathing. Commissioner? Mr. Low? We have completed the five minutes lapsed time. Stand by for the physicians’ check. Commissioner?

COMMISSIONER: Yes?

WILLIS MARABLE: It appears the doctors agree with me that he’s still breathing. You want us to check him and then go through it again, or just go ahead and go through it again?

COMMISSIONER: Check him, and then go through it again. Definitely check him. Don’t vary from the checklist.

WILLIS MARABLE: Alright.

COMMISSIONER: Have them check him.

WILLIS MARABLE: OK. [inaudible] We’re going to do it again?

UNIDENTIFIED: It doesn’t say so.

WILLIS MARABLE: It’s too late now. He’s already briefed them, and he’s on the way back in, sir.

COMMISSIONER: Fine, alright.

UNIDENTIFIED: I show the time is 12:28.

UNIDENTIFIED: OK, Commissioner, we’ll proceed at this time.

COMMISSIONER: Proceed.

UNIDENTIFIED: On my count of three, you press your button. One, two, three.

WILLIS MARABLE: Commissioner? Mr. Low? The execution is initiated again at this time. The condemned made one big jerk, and now he is relaxing in the chair. COMMISSIONER: Yes.

WILLIS MARABLE: He is still at this time moving his head from side to side and appears to be breathing. We’ll continue it just like we did previously.

UNIDENTIFIED: We’re going to have to check that [inaudible].

WILLIS MARABLE: We have fifteen seconds remaining on the third phase of the execution. Commissioner, Mr. Low, the third phase of the execution is completed. The equipment is switched off, secured at this time. We are now into the five-minutes lapse time.

COMMISSIONER: What is the status on the condemned?

WILLIS MARABLE: Sir, he appears to be breathing to me.

COMMISSIONER: You’re going to have to have them check those sponges and check their connections or something. There’s something they don’t have connected right, Willis.

WILLIS MARABLE: Yes, sir. Do you want us to go ahead and complete this whole thing and then—

COMMISSIONER: Yeah, complete the phase, and then you’re going to have to make the check.

WILLIS MARABLE: OK, sir. Commissioner, Mr. Low, we have completed one minute of lapse time. We have four minutes remaining. I might also advise at this time that I do not detect any movement from him at this time. He appears to have stopped moving. Still no movement from any of the witnesses. They were just sitting very still, observing the condemned in the chair.

UNIDENTIFIED: I show the time at 12:32.

WILLIS MARABLE: We have now completed two minutes of phase time, lapse time. We have three minutes remaining. I might also add that I do not detect any movement from the condemned. Commissioner, Mr. Low, we have now completed three minutes lapse time. We have two minutes remaining. There is still no movement from the condemned. Commissioner, Mr. Low, we have completed four minutes of lapse time. We have one minute remaining. Still no detectable movement from the condemned. He does seem to have stopped moving entirely. Commissioner, Mr. Low, we have completed our five minutes lapse time. Stand by for the physicians’ check.

At this time, the superintendent and the two physicians are entering the execution chambers for their check. The first doctor is now in the process of making his check for vital signs.

UNIDENTIFIED: I show the time at 12:36. I show the time is 12:37.

WILLIS MARABLE: The second doctor is still in the process of conducting his check for vital signs. The superintendent is at this time, Commissioner, Mr. Low, is still in the process of briefing the witnesses that at 12:37 hours this date the condemned was pronounced dead. He has instructed all witnesses to depart the witness room. Back to the front of the institution. At this time, the curtains are drawn.

1887: Parsons, Spies, Fischer and Engel, the Haymarket Martyrs

On this date in 1887, the Chicago political machine hanged four at Cook County Jail to defend civilization from the eight-hour day.

The Haymarket martyrs, as they would be remembered ere the hysterical atmosphere of their sentencing had passed, were four from a group of eight anarchist agitators rounded up when a never-identified person threw a bomb at Chicago police breaking up a peaceful rally. The bomb killed one cop; the indiscriminate police shooting that followed killed several more in friendly fire, plus an uncertain number of civilians.

The incident occurred just days after nationwide strikes began on May 1, 1886, in support of the eight-hour day. Nowhere were the tensions greater than Chicago, an epicenter of militant organizing. When tens of thousands poured into the streets on May 1, the Chicago Mail darkly said of high-profile radicals Albert Parsons and August Spies,

Mark them for today. Hold them responsible for any trouble that occurs. Make an example of them if trouble does occur.

Sure enough …

Most of the eight hadn’t even been present at the time the bomb was thrown, but the state put anarchism itself on trial under the capacious umbrella of “conspiracy,” in a proceeding so absurdly rigged that a relative of a slain cop was on the jury. Quoth the prosecutor,

Law is upon trial. Anarchy is on trial. These men have been selected, picked out by the grand jury and indicted because they were leaders. They are no more guilty than the thousand who follow them. Gentlemen of the jury; convict these men, make examples of them, hang them and save our institutions, our society.

That was the argument for hanging them. And right-thinking burghers applauded it.

Seven of the eight were condemned to die; two had their sentences commuted, but the other five refused to ask for clemency on the grounds that, innocent, they would “demand either liberty or death.” One of those five, Louis Lingg, painfully cheated the hangman by setting off a blasting cap in his mouth the night before his execution. (Lingg might have made, though seemingly not thrown, the mysterious bomb.)

The others — Parsons and Spies, along with Adolph Fischer and George Engel — hanged together, with their epitaphs upon their lips — literally so for Parsons, whose parting remark is at the base of the Haymarket Martyrs Monument*

“The time will come when our silence will be more powerful than the voices you are throttling today.”

“Throttle” was right, as the Chicago Tribune reported the next day, taking up when the trap was sprung:

Then begins a scene of horror that freezes the blood. The loosely-adjusted nooses remain behind the left ear and do not slip to the back of the neck. Not a single neck is broken, and the horrors of a death by strangulation begin.

Six years later, Illinois Gov. John Altgeld granted the free pardon the hanged men had demanded to the three surviving Haymarket anarchists. There is no institutional mechanism to determine erroneous executions in American jurisprudence — a fact that occasionally leads to smugly circular avowals that nobody recently executed has ever been “proven” innocent — and death penalty researchers Michael Radelet and Hugo Bedau believed as of this 1998 paper (pdf) that Altgeld’s executive statement flatly asserting the injustice of the Haymarket convictions was the most recent official acknowledgment of a wrongful execution in U.S. history. If true, its uniqueness would be understandable: the gesture cost Altgeld his political career.

Long gone as all these principals are, the legacy of Haymarket remains very much with us, and not just as a magnet for digital archives like this, this and this (don’t miss the brass gallows pin).

May 1, now rich with the symbolism of the Haymarket Passion, was soon selected by the international labor movement as the date to resume the eight-hour-day push — thus becoming the global workers’ holiday it remains to this day.

* Opposing interpretations of the Haymarket affair — which can be the “Haymarket riot” or the “Haymarket massacre,” depending on where you line up — were marked by opposing memorials. The police memorial was itself eventually bombed by the Weather Underground, and subsequently squirreled away from easy public view. Paradoxically, the Haymarket Martyrs Monument has been federally dignified as a National Historic Landmark.

1858: Marion Ira Stout, for loving his sister

It’s the sesquicentennial of a then-sensational, now-forgotten hanging in Rochester, N.Y.

At dawn on December 20, 1857, the city had awoken to the discovery of a mangled corpse by the Genesee River’s High Falls … and more than enough evidence to have the corpse’s killers in hand by tea time.

Marion Ira Stout — he just went by Ira — had made a dog’s breakfast of the job, according to History of Rochester and Monroe County New York from the Earliest Historic Times to the Beginning of 1907.

[W]hen they got near the edge of the bank, Ira struck his victim a sudden blow with an iron mallet, smashing the skull and producing death instantly. Stout then threw the body over the precipice, supposing that it would fall into the river and be swept into the lake before sunrise, but instead of that it landed on a projecting ledge thirty feet below the upper level. Perceiving that there had been some failure in the matter, Ira started to go down a narrow path that led sideways along the cliff, but in the darkness he missed his footing and fell headlong, breaking his left arm in the descent and landing beside the corpse. Summoning all his remaining strength he was just able to push the body over the bank, when he sank in a dead faint. On recovering from which in a few minutes, he called to his sister, who was still above, to come and help him. When she started to do so, the bushes to which she clung gave way; she stumbled, broke her left wrist, and fell beside her prostrate brother. But it would not do to remain there, wretched as was their plight. So, after searching in vain for Ira’s spectacles, which they had to leave behind them, but taking with them the fatal mallet, they scrambled slowly and painfully up the bank and made their way laboriously to their home on Monroe Street.

Sure enough, the glasses were waiting near the victim for the cops to find come daylight.

How did Ira, his sister, and the late Charles Littles — the sister’s husband — find themselves in this macabre dance?

That’s the murky bit, though it’s fair to say there was some negative energy in the family.

Littles was a violent, jealous, philandering drunk. His wife Sarah seems like the classic abused spouse. Ira was an ex-con who seemingly had his life back together. Oh, and Ira and Sarah were sleeping together — professedly true in the literal sense (they were observed to sleep in bed together in their underthings), and possibly true in the Biblical sense.

Now, where in this tangled knot of incestuous desire, domestic violence, protectiveness, jealousy and intrigue lies the motive is less than self-evident, but Ira and Sarah most definitely schemed to lure Charles to his demise. (Charles was found with a club which he’d brought to clobber a lover of Sarah that he’d been told would make a rendezvous.)

Still, the condemned charmer garnered sympathy for having saved his sister from an abusive marriage; Susan B. Anthony and Frederick Douglass rallied to his defense, and a female admirer smuggled him poison to cheat the hangman … which said admirer managed to end up ingesting herself, and barely survived.

Death got all ten-thumbed around Ira Stout, it seems. His hanging was no different.

The New York Times‘ archive has free access to the report of Stout’s execution, interestingly detailing the upward-jerking “sudden suspension” hanging apparatus in use for the job:

The gallows is the same which has always been in use in the jail — the rope, a hempen cord, alone being new. A weight of 186 pounds rests upon a swing door set in the garret floor of the jail. From this weight, the rope runs over two pulleys above, and the end of it drops through two doors, and nearly to the main floor of the jail. The weight falls about eight feet, jerking the slack end that distance. The halter attached to the main rope is a long distance below the main enginery of death, and the latter is not seen by the spectators or prisoner. The Sheriff stood at the foot of the stairs, some forty feet from the prisoner, and by a small cord pulled the latch which let the fatal weight fall.

But since this is Ira Stout, you know it didn’t come off without a hitch.

The death of the ill-fated man was not as sudden as could be desired. His struggles for eight or ten minutes were severe, and caused the spectators to turn away in disgust.

His neck was probably not dislocated, and he died by a slow process of strangulation. Doctors Hall, Avery, James and Miller stood near, and in eight minutes after the drop fell they said his pulse was as full as in life.

Sort of puts a grim twist on Stout’s own (fairly self-pitying) letters to the papers, in one of which he remarked, “I do not wish to show a cowardly tenacity for life, but I consider it my right and duty to live as long as I can.”

According to a feature story in the newsletter of Mount Hope Cemetery where Ira Stout takes his eternal rest, he might have tried to hang on quite a bit longer.

A rumor was current last night at a late hour that Stout was not dead, and that efforts were being made to resuscitate him by the use of galvanic batteries and other means sometimes employed for the restoration of persons supposed to be dead. How much truth there is in the rumors thus made we cannot say, as we have not taken pains to inquire at the house of Mrs. Stout.

No surprise, that didn’t work either.

1946: Amon Göth, Schindler’s List villain

On this date in 1946, Plaszow concentration camp commandante Amon Göth was hanged near the camp site by Poland’s postwar Communist government.

Göth is most widely recognizable as Ralph Fiennes’ fiendish character in Schindler’s List, one of the American Film Institute’s top movie villains of all time. (And, naturally, a first-class bastard in real life, too.)

A short-drop strangulation is not the way you’d want to go. It turns out, though, that Steven Spielberg (ever the sentimentalist) seriously tidied up the proceedings.

As you watch the video of the real Amon Goeth’s exit below — and it’s a snuff film, so proceed advisedly — consider the following:

  • Amon Goeth does bear a passing fair resemblance to Ralph Fiennes.

  • To judge by their getup — dig the masks! — the executioners might have been Batman and Robin.
  • To judge by the discharge of their duties, the executioners might have been Larry, Moe and Curly. Goeth survived two drops (notice the executioner on the right gesticulating in frustration as the second try fails) before they finally got it right:

1807: James McLean, twice

On this date in 1807, James McLean survived one hanging but not a second at Batavia, N.Y.

Subject of the first public execution in Genesee County, the drunken Scottish immigrant had axed to death a fellow squatter in an argument … and then a second man who ran to his victim’s aid … and then almost a third who was saved by flight.

This minor execution is the subject of an extensive historical inquiry* by a descendant of one of the victims full of period color: the defendant claiming the (then-recognized) right to a jury consisting of half non-citizen aliens as a “jury of his peers”; the billing receipts for the manhunt and the gallows construction (including gallons of brandy for the guards); and the indeterminate legends about what happened when the rope broke the first time.

The story has been told and retold that during the hanging the rope broke and McLean fell to the ground, shaken and stunned but alive. While another rope was being secured, McLean was reputed to remark, “As I killed two men, I deserve two hangings.” Another version has McLean protesting a second hanging since he had been convicted of only the one murder and had already been hung for that.

However, a historian’s recounting of the era’s newspaper accounts claims

that when the weight fell, the rope broke and McClean fell to the ground. He soon recovered from the shock and rising to his feet, expressed a strong desire not to be “hung again.” Some insisted that one hanging was a fulfillment of the law. Others, however, thought differently and informed McClean that “as he had killed two men, he ought to be hung twice.”

* The writer’s use of “gibbet” to mean an apparatus for a “sudden suspension” hanging, where the prisoner is not dropped but jerked into the air by a countervailing weight, is non-standard; “gibbet” means a gallows (or certain types of gallows structures, if you’re persnickety about it), and became a verb signifying the salutary posthumous display upon such a structure of an executed prisoner’s remains.
