1209: Massacre of Beziers, “kill them all, let God sort them out”

Today the French town of Beziers remembers the 800th anniversary of the first sack and massacre of the Albigensian Crusade.

Rome was alarmed by the advent in southern France of a mass religious movement, Catharism, with such scandalous doctrines as spirit-body dualism and not giving tons of money to Rome.

Naturally, God said to cut them to pieces.

Beziers was the first town invested by the invading crusader army, left to its fate as the Cathars mustered in Carcassone. Interestingly, this particular city did not so much present that familiar spectacle of Christians killing Christians who thought differently — unless the thought in question was about handing over their neighbors to a throng of land-grabbing nobles.

Part of the Catholic faith did itself honor this day: those Biterrois who refused to abandon to the glories of martyrdom the Cathars in their midst, who are thought to have numbered merely a few hundred. So when the walls fell, it was mostly orthodox Catholics killing orthodox Catholics.

Well, what’s a crusading army with other cities to sack supposed to do?

“Kill them all”

After the fortified city embarrassingly got itself captured within hours by camp followers, Caesar of Heisterbach recorded one of history’s more quotably infamous instances of prayerful deliberation:

When they discovered, from the admissions of some of them, that there were Catholics mingled with the heretics they said to the abbot “Sir, what shall we do, for we cannot distinguish between the faithful and the heretics.” The abbot, like the others, was afraid that many, in fear of death, would pretend to be Catholics, and after their departure, would return to their heresy, and is said to have replied “Kill them all for the Lord knoweth them that are His” (2 Tim. ii. 19) and so countless number in that town were slain.

Caedite eos. Novit enim Dominus qui sunt eius.

And so they did.

And they killed everyone who fled into the church; no cross or altar or crucifix could save them. And these raving beggarly lads, they killed the clergy too, and the women and children. I doubt if one person came out alive … such a slaughter has not been known or consented to, I think, since the time of the Saracens. (William of Tudela, cited in Cathar Castles)

Ten to twenty thousand are thought to have been slain this day — in what proportions Catholic and heretic, only God can say.

1942: The village of Lidice, for the assassination of Reinhard Heydrich

On this date in 1942, the Germans visited upon the Czechoslovakian village of Lidice one of the most notorious butcheries of World War II: the physical destruction of the town, and the execution of most of the adult population, in revenge for the assassination of Reichsprotektor Reinhard Heydrich.

Heydrich had power of life and death in Nazi-occupied Bohemia and Moravia, and did not scruple to use it.

“The Hangman of Prague” was no mere functionary, but a Nazi grand wizard from way back, who’d had a hand in the Third Reich’s most terrifying greatest hits — the Night of the Long Knives, Kristallnacht. Just four months before this date, Heydrich had chaired the Wannsee Conference.* (Watch Kenneth Branagh as Heydrich ride herd over a gaggle of bureaucrats to get the Final Solution up and running in Conspiracy.) Hitler called him his “man with the iron heart.”

So he was a natural target for the Czechoslovakian army-in-exile and their British handlers, made more so by his lordly disdain for common-sense security safeguards.

Zipping along a predictable route in an open car, he was a sitting duck for a hit squad, who gave the Nazi bastard a mortal shrapnel wound from a grenade that had him lingering painfully at death’s door for several days before he finally died of blood poisoning.

The 1964 Czechoslovakian film Atentat (“Assassination”) chronicles the plot to kill Heydrich and its aftermath.

For this effrontery, Czechoslovakians would pay a dreadful price.

Naturally, the Nazis mercilessly hunted down and slaughtered those with any connection to the plot.

But the Reich also exacted collective reprisals to make plain that the entire “protectorate” could be considered hostage against such plots in the future.

Special transports of Jews marked “Attentat auf Heydrich” were shipped to the camps, and 152 were executed on the day Heydrich succumbed. But then, the Nazis were brutalizing Jews anyway. Something more headline-grabbing would be needed.

Enter Lidice.

After gaudy funerals for the slain Reichsprotektor, the Reich settled upon the small town of Lidice north of Prague — trumping up a few connections to resistance to “justify” collective punishment.

On this date, German troops stormed it, summarily executed all the men and boys** old enough to bear arms and a fair number of women, deported the others, and then physically destroyed and buried the town.

Lidice was intended as a demonstration — boldly published to the world as proof against a repeat,† it became the byword of Nazi cruelty towards subject nations. Though not by quantitative standards the greatest crime of the occupation, not even the greatest crime in reprisal for Heydrich, its three syllables distill all the evil of Hitler’s conquest for Czechoslovakia.

Lidice did live, and does yet, as an emblem par excellence those terrible years.

Less alive: Heydrich’s right-hand man Karl Hermann Frank, who was hanged in Prague after the war for engineering this monstrous crime. Those survivors of Lidice able to make the trip enjoyed priority seating.

* Heydrich’s aide at the Wannsee Conference, and taker of cleaned-up minutes, was Mr. Banality of Evil himself, Adolf Eichmann.

** Only three men of Lidice survived the destruction: two who were in England at that time, and one who was imprisoned in Prague for killing his son. The sentence for this crime, it turned out, was life.

† An effective proof — the calculated wholesale slaughter apparently did cool both the conquered populace and the enemies of Germany on enthusiasm for further assassinations.

1871: The Paris Commune falls

On this date in 1871, the last barricade of the Paris Commune fell to the onslaught of the army — and a legion of Parisians fell to the army’s firing squads.

On the evening of that bright Sunday when the insurrection finally collapsed, a Sunday when the streets of central Paris were crowded with returning bourgeois, all expressing their satisfaction that the struggle was at last over, the city’s walls were placarded with a proclamation emanating from MacMahon. “Inhabitants of Paris,” said he, “the Army of France has come to save you. Paris is delivered. At four o’clock our soldiers carried the last position occupied by the insurgents. Today the struggle is over, order, work and security will now revive.

I read that announcement in the Rue de Rivoli, not far from the Hotel-de-Ville. A moment later, however, I heard a discharge of musketry … Several insurgents who had been taken fighting were being shot. (My Adventures in the Commune, Paris, 1871, an anti-Commune source)

The day was climax and curtains for the first working-class seizure of power in industrial Europe, but in truth indiscriminate reprisal executions had been underway since troops of the conservative Versailles government first breached rebellious Paris on May 21.

What followed was semaine sanglante, the “bloody week” — each barricade’s surviving defenders executed summarily, and anyone in the city liable to a similar fate if the nearest French officer disliked the cut of his or her jib. Rumors swept the city that women of the Commune were torching buildings, for instance, and suddenly any woman in the street could be killed as an arsonist; some firefighters were shot as saboteurs when the “water” they threw on such flames failed to speedily quench them,* and was consequently adjudged to be kerosone.

And heaven help he who should chance to resemble one of the wanted Communard leaders!

Any passer-by calling a man by a revolutionary name caused him to be shot by soldiers eager to get the premium … Members and functionaries of the Commune were thus shot, and often several times over, in the persons of individuals who resembled them more or less.

The total body counts are guesswork: the killing ran far ahead of the record-keeping. Twenty thousand, or thirty, or more are thought to perished by summary execution. Even the press of the bourgeoisie, whose sword arm the Versailles men comprised, was aghast. London’s Times filled its broadsheets with calumnies upon the Commune, but noted on May 29:

“The Revolution is crushed;” but at what a cost, and amid what horrors! … the Communists seem not very much worse than their antagonists. It sounds like trifling for M. Thiers to be denouncing the Insurgents for having shot a captive officer “without respect for the laws of war.” The laws of war! They are mild and Christian compared with the inhuman laws of revenge under which the Versailles troops have been shooting, bayoneting, ripping up prisoners, women and children, during the last six days.

Whatever the true death toll, it massively surpassed that of the much more eagerly commemorated Revolutionary Terror.

This people, heroes in the face of the foreigner, must therefore by called assassins, criminals, wretches, because they died for the Universal Republic, because in defense of their beliefs, their conscience, their idea, they preferred, in their fierce enthusiasm, to bury themselves in the ruins of Paris rather than abandon it to the coalition of despots a thousand times more cruel and more lasting than any foreigner.

At a wall still consecrated to leftists in the Pere Lachaise cemetery of Belleville, 147 were summarily shot.

The 147 are acclaimed as the last defenders of the Commune.

the Commune is in its death throes. Like the dragon of fairy lore, it dies, vomiting flames … What must these men feel who are killing and being killed in the cemetery! To die among the dead seems horrible. But they never give it a thought; the bloody thirst for destruction which possesses them allows them only to think of one thing, of killing! Some of them are gay, they are brave, these men. That makes it only the more dreadful; these wretches are heroic! Behind the barricades there have been instances of the most splendid valour. A man at the Porte Saint-Martin, holding a red flag in his hand, was standing, heedless of danger, on a pile of stones. The balls showered around him, while he leant carelessly against an empty barrel which stood behind. — “Lazy fellow,” cried a comrade. ‘”No,” said he, “I am only leaning that I may not fall when I die.”

Communard Eugene Varlin

Varlin, alas! was not to escape. On Sunday the 28th May he was recognized in the Rue Lafayette, and led, or rather dragged, to the foot of the Buttes Montmartre before the commanding general. The Versaillese sent him to be shot in the Rue des Rosiers. For an hour, a mortal hour, Varlin was dragged through the streets of Montmartre, his hands tied behind his back, under a shower of blows and insults. His young, thoughtful head, that had never harboured other thoughts than of fraternity, slashed open by the sabres, was soon but one mass of blood, of mangled flesh, the eye protruding from the orbit. On reaching the Rue des Rosiers, he no longer walked; he was carried. They set him down to shoot him. The wretches dismembered his corpse with blows of the butt-ends of their muskets.

Varlin was shot along with a nameless batch of others to whom the March 18 execution of Generals Lecomte and Thomas had been hastily imputed (they were held at the generals’ execution site, to contemplate their sin). A pro-government paper allowed that Varlin “died game.”

It is at the Bourse that there was to-day the largest number of executions. The doomed men who attempted to resist were bound to the iron railing.

The stock exchange is “a fit place, to be sure, for this sort of business,” observes our interlocutor.

Eighty-plus defenders of Belleville, at the Arc de Triomphe

The London Times editorialized on May 31 upon this incident when the Marquis de Gallifet plucked from the mass of Belleville’s May 28 captives “eighty prisoners, principally soldiers of every arm, linesmen, artillerymen, and Zouaves, [who] were set apart and afterwards led to the right of the rampart to be shot.”

The French are filling up the darkest page in the book of their own or the world’s history. The charge of ruthless cruelty is no longer limited to one party or to one class of persons. The Versailles troops seem inclined to outdo the Communists in their lavishness of human blood. The Marquis de Gallifet is escorting a column of prisoners to Versailles or Satory. He “picks out eighty-two of them, and shoots them at the Arc de Triomphe.” Next came a lot of 20 firemen, then a dozen women, one aged 70. On another spot our Correspondent came upon “80 corpses, piled upon each other, a mass of arms and legs and distorted faces, while the roads and gutter literally flowed with blood.” About 1,000 are said to have thus suffered. By this wholesale and summary execution of prisoners in batches of 50 and 100, not only must the innocent perish with the guilty, but many must bear the penalty of imaginary guilt.

An utterly disconnected Englishman, according to the paper’s correspondent, was accidentally among the four score at the Arc, and only saved by the fortuitous intervention of a Belgian attache.

an English officer somehow got mixed up in the procession, and was forced to keep in it by the escort, who, out of 5,000 prisoners, could not, of course, be expected to recognize one innocent man … it so happened that some of the prisoners tried to escape, and to make an example the leader of the cavalry escort, the Marquis de Gallifet, a man who is not prone to err on the side of mercy, had then and there 81 shot, and the English officer was all but one of them, his explanations being at first refused the slightest attention. Human life has, in fact, become so cheap that a man is shot more readily than a dog.

One single fact was Tony Moilin reproached with: that of having on the 18th March taken possession of the mairie of his arrondissement, and having thus had a share in giving the signal for the insurrection …

The court-martial condescended to tell him that the fact of the mairie, the only one he could be reproached with, had in itself not much importance, and did not merit death, but that he was one of the chiefs of the Socialist party, dangerous through his talents, his character, and his influence over the masses; one of those men, in short, of whom a prudent and wise Government must rid itself when it finds a legitimate occasion to do so

[A] respite of twelve hours was granted him in order that he might make his testament, write a few words of farewell to his father, and finally [marry his pregnant lover] … on the 28th May, in the morning, Tony Moilin was led into the garden a few steps from the palace and shot. His body, which his widow claimed, the surrender of which had been at first promised, was refused her. (History of the Commune of 1871)

The unnumbered dead of Lobau Barracks

Since morning a strong cordon is being formed round the theatre (Châtelet); where a court-martial is permanently established. From time to time one sees a band of fifteen to twenty individuals coming out, composed of National Guards, civilians, women and children fifteen to sixteen years old.

These individuals are condemned to death. They march two by two, escorted by a platoon of chasseurs, who lead and bring up the rear. This cortege goes up the Quai de Gevres and enters the Republican Barracks in the Place Lobau. A minute after one hears from within the fire of platoons and successive musketry discharges; it is the sentence of the court-martial which has just been executed.

The detachment of chasseurs returns to the Chatelet to fetch other prisoners. The crowd seems deeply impressed on hearing the noise of the shootings.

This is another publication’s story cited in the History of the Commune of 1871, which itself also details the court-martial procedures of this drumhead tribunal:

Thousands of prisoners who were led there were first of all penned in upon the stage and in the auditorium, under the guns of the soldiers placed in the boxes; then, little by little, like sheep driven to the door of the slaughter-house, from wing to wing they were pushed to the saloon, where, round a large table, officers of the army and the honest National Guard were seated, their sabres between their legs, cigars in their mouths. The examination lasted a quarter of a minute. ‘Did you take arms? Did you serve the Commune? Show your hands.’ If the resolute attitude of a prisoner betrayed a combatant, if his face was unpleasant, without asking for his name, his profession, without entering any note upon any register, he was classed. ‘You?’ was said to the next one, and so on to the end of the file, without excepting the women, children, and old men. When by a caprice a prisoner was spared, he was said to be ordinary, and reserved for Versailles. No one was liberated.

The classed ones were at once delivered to the executioners, who led them into the nearest garden or court. From the Châtelet, for instance, they were taken to the Lebau Barracks. There the doors were no sooner closed than the gendarmes fired, without even grouping their victims before a platoon. Some, only wounded, ran along by the walls, the gendarmes chasing and shooting at them till they fell dead. … There were so many victims, that the soldiers, tired out, were obliged to rest their guns actually against the sufferers. The wall of the terrace was covered with brains; the executioners waded through pools of blood.


Summary executions — death squads — continued for days or weeks afterwards in Paris; martial law throttled left organizing in the city; and those “fortunate” enough to have been captured alive were processed in a steady stream of judicial executions over the months yet to come.

The Commune, a palpably subversive example even in the present day, was destroyed in every way possible for the Versailles government. But its example could hardly be forgotten.

Marx would write The Civil War in France of the only proletarian revolution he would actually witness in his lifetime.

The next generation’s subversives also took inspiration from the Parisian example … and lessons from its mistakes. Lenin — a fond student of the Commune, who was eventually buried wrapped in a Communard banner — said that

two mistakes destroyed the fruits of the splendid victory. The proletariat stopped half-way: instead of setting about “expropriating the expropriators”, it allowed itself to be led astray by dreams of establishing a higher justice in the country united by a common national task; such institutions as the banks, for example, were not taken over … The second mistake was excessive magnanimity on the part of the proletariat: instead of destroying its enemies it sought to exert moral influence on them; it underestimated the significance of direct military operations in civil war, and instead of launching a resolute offensive against Versailles that would have crowned its victory in Paris, it tarried and gave the Versailles government time to gather the dark forces and prepare for the blood-soaked week of May.

“The lesson learnt by the proletariat will not be forgotten,” Lenin vowed, and his own revolution gained a vital object lesson in the Bloody Week of Paris, and an anthem besides: Communard Eugene Pottier, fleeing the Versailles army’s slaughter, wrote the verses that have been sung ever since by millions dreaming of a better world — the Internationale.

1297: Marion (Murron) Braidfute, bride of The Wallace

May of 1297 marks the first appearance in the historical record of Braveheart hero William Wallace … so we mark today the undated (and presumably fictional) execution/murder of his wife that, by the most cinematic account possible, set Wallace on his own path to the scaffold.

The face that lifted a thousand claymores: Catherine McCormack as Braveheart‘s version of Marion, Murron MacClannough. Murron’s “execution” inspires William Wallace.

Marion (or Marian) Braidfute, she’s called by the Scottish poet Blind Harry in the epic dating near two centuries after famed rebel’s rising. Not wanting audiences to confuse her with Robin Hood sweetie Maid Marian, the Braveheart script renamed her Murron MacClannough.

In Mel Gibson’s gory silver screen epic, Wallace is, at this point, a determinedly apolitical commoner — a stance contrasting markedly with a backstory of nationalistic identity-forming experiences, like having his father and brother killed by the English. He’s radicalized only after his attempt to protect Murron from rape results in her demonstrative summary execution.

And of course, Wallace then wreaks a bloody revenge (complete with summary execution of his own) that soon has the country in flames.

Hollywood’s avenging-his-woman angle exploits a folkloric embroidery of a female character perhaps created by Blind Harry, writing in the 15th century. In “The Wallace”, the titular hero is already well along his conflict with the English crown when he weds Marion — whose story arc differs greatly from that of the peasant eye candy Mel Gibson taps. In the poem, Marion is exposed to the vengeance of the Sheriff of Lanark, William Heselrig, when Wallace goes off to fight and refuses to take her along.

Now fierce with Rage the cruel Foe draws near,
Oh does not Heaven make Innocence its Care!
Where fled thy guardian Angel in that Hour
And left his Charge to the fell Tyrant’s Power,
Shall his fierce Steel be redned with thy Gore
And streaming Blood distain thy Beauties o’er?

But now awaken’d with the dreadfull Sound
The trembling Matron threw her Eyes around,
In vain alace were all the Tears she shed
When fierce he waves the Fauchion o’er her Head
All Tyes of Honour by the Rogue abjur’d

Wallace slays Heselrig the next day, according to the poem — the actual historical event of May, 1297,* that marks Wallace’s emergence from the dim fogs of history. (In the film Braveheart, the chronology is unstated, but Wallace is revenged before Murron’s burial.)

John of Fordun, writing in the 14th century, tells the tale.

The same year William Wallace lifted up his head from his den — as it were — and slew the English sheriff of Lanark, a doughty and powerful man, in the town of Lanark. From that time, therefore, there flocked to him all who were in bitterness of spirit, and weighed down beneath the burden of bondage under the unbearable domination of English despotism; and he became their leader. He was wondrously brave and bold, of goodly mien, and boundless liberality … So Wallace overthrew the English on all sides; and gaining strength daily, he, in a short time, by force, and by dint of his prowess, brought all the magnates of Scotland under his sway, whether they would or not.

1993: Leonel Herrera, perilously close to simple murder?

On this date in 1993, Leonel Herrera was executed by lethal injection in Huntsville, Texas, for shooting two policemen. Herrera’s last statement averred,

Herrera’s sister Norma self-published this book about the case — keeping a promise to her executed brother.

I am innocent, innocent, innocent. Make no mistake about this; I owe society nothing. Continue the struggle for human rights, helping those who are innocent, especially Mr. Graham. I am an innocent man, and something very wrong is taking place tonight. May God bless you all. I am ready.

Well, Herrera wasn’t the first to go to his death maintaining his innocence. The circumstances (and circumstantial evidence) of the crime rate on the forgettable side.

But Leonel Torres Herrera was a bit different from his cousins in hopeless protestation: while he died this evening, his name lived on … in a landmark Supreme Court decision

Herrera v. Collins

Years after Herrera was convicted and death-sentenced, multiple affidavits were produced to the effect that his late brother, Raul, was the real killer.

This evidence was naturally pursued with gusto by the condemned man.

Unfortunately, a claim like Herrera’s of “actual innocence” faces a very high bar when raised in appellate courts, once a prisoner has already been convicted and their presumption of innocence become a presumption of guilt.

That this arbitrary rule of the game has a defensible rationale — could any criminal justice system operate if prisoners could continually relitigate their cases while memories fade and evidence ages into obsolescence? — does not make it the less Kafkaesque for individual prisoners, some of whom are in fact innocent.

Herrera presented this problem in unusually stark terms. Lacking any procedural violation upon which to hang his hat as an appeals issue, his claim pitted substance against form in the Supreme Court. (Oral arguments at Oyez.org)

You already know how it ended.

Chief Justice William Rehnquist’s opinion patiently explained a jurisprudential truism loftily uncolored by any experience in life liable to introduce a sense of kinship with a Hispanic man charged with a Texas cop-killing who uncovers too late the evidence that could save him.

“[A]ctual innocence” is not itself a constitutional claim.*

Instead, the Court recommended — tongue no doubt planted firmly in cheek — that Herrera apply for executive clemency, a dead letter procedure in Texas used exclusively in a good cop/bad cop routine opposite the black robes.

“Judicial restraint forbids relieving you,” says the court. “Go ask the governor.”

“The courts have thoroughly reviewed the case,” intones the governor. “May God have mercy on your soul.”

Herrera himself may or may not have been innocent. At the end of the day, he went down because the game was rigged against him: his exculpatory evidence was not available at trial, when it might have introduced “reasonable doubt” — as Rehnquist’s opinion put it, “in state criminal proceedings the trial is the paramount event for determining the guilt or innocence of the defendant.” Once that evidence became available deep in the appeals process, it was procedurally barred, and far from such a slam-dunk exoneration that any institutional actor would stick his, her or its neck out to lift Leonel Torres Herrera from the gurney.

Justice Harry Blackmun’s dissent retorted,

Just as an execution without adequate safeguards is unacceptable, so too is an execution when the condemned prisoner can prove that he is innocent. The execution of a person who can show that he is innocent comes perilously close to simple murder.

Whether “simple murder” happened in Huntsville this night in 1993, perhaps no one can really say with certainty.

But as DNA evidence and other forensic advances in the intervening years have increasingly eroded confidence in the reliability of the justice system that metes out death, Herrera v. Collins stands as a key precedent in a case now before the Supreme Court — in which states (joined by the Obama administration) are asking the justices to agree that convicted prisoners have no right to cheap, simple, and frequently dispositive DNA testing that may not have been available when they were tried.

Given the composition of the court (including three holdovers from the Herrera majority), that decision figures to have Leonel Herrera rolling over in his grave.

* Rehnquist conceded a theoretical possibility that extraordinarily persuasive evidence could generate relief on due process grounds. Antonin Scalia and Clarence Thomas went much further, claiming that prisoners had no right to anything but their trial and their (procedural) appeals.

1994: Rwandan Queen Dowager Rosalie Gicanda, and six attendants

When the Rwandan genocide erupted following the April 6, 1994 assassination of President Juvenal Habyarimana, the southern province of Butare went initially unscathed. Its large and powerful Tutsi population had limited the foothold of violent Hutu paramilitaries.

That calm lasted a mere fortnight, however, and was shattered this date in 1994 when the aged widow of Rwanda’s last monarch was hauled to Butare city’s national museum and shot along with several of her caregivers.

Taken in marriage in 1942 (French link) by King Mutara III, Rosalie Gicanda had stayed out of politics after he died mysteriously and Rwanda became a republic.

Being an emblematic Tutsi in April 1994, however, was all the political involvement needed to doom her. According to Human Rights Watch.

At 11 a.m. … a detachment of soldiers commanded by Lt. (jg) Pierre Bizimana, acting under the orders of Capt. Nizeyimana, invaded the modest home of Rosalie Gicanda … About eighty years old, she lived a quiet life as a devout Catholic, sharing her home with her bed-ridden mother and several women and girls who cared for them both. Because she eschewed any involvement in politics and behaved with discreet dignity, even the most anti-Tutsi politicians had left her largely undisturbed throughout the thirty years of Hutu rule…. The soldiers passed through the wooded enclosure that protected the house from the main street and entered the little house with its air of faded respectability. They seized the former queen and six others, leaving her bed-ridden mother and one girl to care for her. The soldiers passed by the ESO and then took Gicanda and the others to a place behind the national museum where they shot them. One teenaged girl, left for dead, survived to recount the murders. The soldiers returned to pillage Gicanda’s home in the afternoon and, two days later, they killed her mother. …

The news that this gracious lady and others from her household had been taken away by soldiers in the back of a pickup truck spread rapidly and alarmed Tutsi and all others who opposed the genocide. They concluded that if soldiers dared to seize even this revered person, then no one was safe.

That conclusion, of course, was well-founded. Over 200,000 Butare Tutsis are thought to have suffered Gicanda’s fate (or worse) in the ensuing months, making it the Rwandan genocide’s bloodiest province.

Pierre Bizimana was sentenced to death for Gicanda’s killing in 1998; I have been unable to document whether that sentence was ever carried out. His commanding officer, Idelphonse Nizeyimana, was arrested in October 2009.

1814: Six slaves in Guyana

An alarming rumour, meanwhile, … spread throughout the Colonies; a rumour which, whatever of truth or fact, little or none, might be at the foundation, gathering, as it went, size and gloom, and dust of slander, was calculated to make them all feel very unhappy. The report was that a slave insurrection had been discovered, having its centre on the Berbice West Coast, but extending right and left so as to include all the shore from the Corentyne Coast to Mahaica, about eighty miles; that the negroes had chosen a governor and other officers; that it was their intention to murder all the white men, and take possession of all the rest; that some of the Demerara East Coast negroes were leaders in the rebellion, especially Philip, a member of the church on Le Resouvenir; and that instruction of the negroes was to blame.

the account which the negroes gave of the matter was, that there had been formed a society in imitation of the Freemasons, they wishing to have, as well as their buckras or masters, a society of that nature; and that the money collected was to support the poor and defray the expense of their dances, &c.; just as it had been formerly very common for them to assume the names of their masters, or of the Governor or Fiscal, and send invitations to friends to supper or a dance, and appoint a captain of their own as president of the feast; sometimes to put feathers in their hats at holiday time and parade the streets. “No one,” as far as Mr. Wray could learn, “had been injured by them, neither was any property destroyed,” yet on 12th April six of the unhappy people apprehended on the West Coast were executed in New Amsterdam as ringleaders, their heads cut off and fixed upon poles on the different estates to which they belonged; one of them white with age, whose master, Mr. Rader, told Mr. Wray that he denied to the last having any bad intentions. Several others were flogged under the gallows, and some were transported.

A proclamation was subsequently issued to the effect that as “the privilege allowed the slaves of the Colony, of publicly or privately dancing on estates and other places at stated periods, had been perverted by them to purposes of the most dangerous nature, all dancing was forbidden until next year, 1815, or the further pleasure of the Court;” … This was followed, late in the year, by another calling upon the colonists to pay their quota of the expenses incurred in crushing the plot and indemnifying the proprietors of the slaves capitally punished … Better still, the law concerning Sunday labour was amended in favour of the slave, forbidding field-work on that day, except in sudden emergencies; and further enactments were issued limiting and regulating the excessive use of the whip, and forbidding the burial of any slave dying suddenly or by suicide, or in consequence of punishment or hurt, without previously acquainting the authorities …

1804: Louis-Antoine-Henri de Bourbon-Condé, duc d’Enghien

It was worse than a crime, it was a blunder on this date in 1804.

Napoleon shocked, just shocked, his admirers and more especially his foes by having a royal relative ventilated at Vincennes for the trifling offense of plotting against his life.

The particular allegations against him may have been formulated with greater haste than precision, but the duc d’Enghien actually had been taking English coin to overthrow Republican France for the past decade, and nonchalantly avowed as much at his drumhead tribunal.

After surviving one too many assassination attempts, Napoleon was in the market for someone to make an example of, and the Bourbon scion, hanging about the French frontiers conniving with the English, certainly qualified.

The dispatch of his military commission, which rammed through a conviction the night of the 20th and arranged the fusillade immediately thereafter, raised self-righteous hackles among rival monarchs who had little enough compunction of their own about politically expeditious regicide.

Conventional disdain for the shooting (as with this (pdf) from the Fourth Estate), reached far and wide, and appears in Tolstoy’s War and Peace as a subject for (spurious) gossip in the Russian salons.

The group about Mortemart immediately began discussing the murder of the Duc d’Enghien. The vicomte said that the Duc d’Enghien had perished by his own magnanimity, and that there were particular reasons for Bonaparte’s hatred of him.

The vicomte told his tale very neatly. It was an anecdote, then current, to the effect that the Duc d’Enghien had gone secretly to Paris to visit Mademoiselle George; that at her house he came upon Bonaparte, who also enjoyed the famous actress’ favors, and that in his presence Napoleon happened to fall into one of the fainting fits to which he was subject, and was thus at the duc’s mercy. The latter spared him, and this magnanimity Bonaparte subsequently repaid by death.

Pierre Bezukhov, the novel’s spirit-questing Russian noble then in the thrall of the Little Corporal, has the rashness to defend d’Enghien’s execution.

“The execution of the Duc d’Enghien,” declared Monsieur Pierre, “was a political necessity, and it seems to me that Napoleon showed greatness of soul by not fearing to take on himself the whole responsibility of that deed.”

Though that defense went over like a lead balloon with the partygoers (and with Tolstoy), others have ventured to stand in the breach for the Corsican, who assuredly attracts far more opprobrium as a commoner shooting a royal traitor than he would have had their bloodlines been reversed. Bonaparte enthusiasts, like those of the Napoleon podcast, are particularly susceptible to such impolitic sentiment.

But Louis-Antoine-Henri normally gets better sympathy than that, as he did with the like of Chateaubriand, who resigned his Napoleonic commission in outrage.

And his death — far more notable than anything he did in life — is supposed to have occasioned the quip, “C’est pire qu’un crime, c’est une faute”: “it is worse than a crime, it is a blunder.” (Or, “it is worse than a crime, it is a mistake.”) Often attributed to Talleyrand, it was more likely uttered by his machiavellian mirror image, Joseph Fouche.

(See here for more on the phrase’s lineage. Talleyrand was so strongly in support of d’Enghien’s death that he is sometimes accused of steamrolling Napoleon on the subject. The wily minister destroyed some evidence and effected a timely volte-face when Bonaparte fell.)

The First Consul — he would crown himself Emperor later in 1804 — never had use for any such soft-pedaling, and unapologetically avowed the Duke’s execution literally to the end of his life.

Dying in exile on St. Helena years later, it is said, Napoleon read a calumny upon the d’Enghien shooting in the English press and promptly hauled out his already-completed will to insert in his own hand his lasting justification for the affair.

I caused the Duc d’Enghien to be arrested and tried, because that step was essential to the safety, interest, and honour of the French people, when the Count d’Artois* was maintaining, by his own confession, sixty assassins at Paris. Under similar circumstances, I should act in the same way.

* The Comte d’Artois was, at the time of Napoleon’s writing, the heir presumptive to the restored Bourbon monarchy — and he did indeed succeed in 1824 as Charles X. In 1804, the future king was in exile in Britain funding hits on Bonaparte and kindred counterrevolutionary stuff. For adherents of the much-disputed theory that Napoleon was poisoned in his island captivity, d’Artois figures as a possible instigator of the murder.

1937: Alexander Yulevich Tivel

On this date in 1937 — probably — one of the numberless obscurities consumed by Stalin’s purges was convicted and presumably shot for “preparing to commit a terrorist act against [NKVD head] Yezhov.”

Alexander Yulevich Tivel, a Jewish bureaucrat who had the misfortune to have been in a party organ too close to Zinoviev, was disappeared by the NKVD one day in 1936.

His fate forms the opening hook for J. Arch Getty’s The Road to Terror: Stalin and the Self-Destruction of the Bolsheviks, 1932-1939 — “the story of the Stalinist terror writ small.” (Here’s a review)

We do not know whether he was physically tortured by his interrogators, but there is ample evidence that countless others were. Even high-ranking officials under arrest were beaten or, as Molotov would put it, “worked over.” Ten years later, a high-ranking police official described interrogation procedures in a letter to Stalin. First, prisoners were offered better conditions — better food, mail, and so on — in return for a confession. If that failed, appeals to the prisoner’s conscience and concern for his family followed. The next step was a solitary-confinement cell without exercise, a bed, tobacco, or sleep for up to twenty days … Finally, the use of “physical pressure” was authorized …

Tivel was probably executed on the same day [of his conviction]. Unlike many others who were badgered and tortured by the NKVD, he had not confessed.

His wife and mother-in-law to internal exile. His son would suffer the stigma of being the child of an executed traitor.

The widow Eva Tivel, reports Getty, grappled for years with the unresponsive bureaucracy until she finally cleared Sasha Tivel’s name.

On 23 May 1957, twenty years after Tivel’s execution and after Eva’s many letters and appeals, Tivel’s sentence and party expulsion were overturned … [as] “based on contradictory and dubious materials.”

1939: Three Men For Murder, But Not Isidore Zimmerman

On this date in 1937, Isidore “Beansy” Zimmerman spent the day preparing for death in New York’s electric chair … but was spared by an 11th-hour clemency from New York Governor Herbert Lehman.

Here’s the scene, as laid in the anti-death penalty tome of wrongful convictions In Spite of Innocence:

As dawn broke over Sing Sing Prison, Beansy Zimmerman had every reason to think it would be his last day.

Zimmerman numbly went through the pre-execution rituals. The last meal (choose whatever you want), and music (you get to choose that, too) played on the wind-up phonograph. The barber shaves your scalp so the electrodes can fit snugly against your bare skin. The tailor slits one of your trouser legs for another electrode. Officials treat you with unaccustomed politeness. A final family visit — how do you say good-bye when you know it is forever? What should your last words be? Beansy’s mother stayed away, unable to face such finality.

Two hours before execution, Gov. Lehman commuted his sentence.

In this blog, we lay aside each story day by day, but for those affected, it’s rarely so easy — which is why the mothers of the five men condemned today put in their personal clemency appeals to the governor.

For Zimmerman and a fellow “accomplice” named Philip Chaleff whose respective roles in a robbery/murder were doubted, it had the desired effect. (Dominick Guariglia, Arthur Friedman and Joseph O’Loughlin weren’t so lucky.)

Chaleff, a diabetic being kept alive just for execution, soon succumbed. For Zimmerman, the execution that did not happen was to define the rest of his 66 years. He was alive, but to what end?

“I wasn’t dead, no,” he remembered. “But every day from now on they’d bury me a little more.”

Zimmerman fought, by becoming a skilled jailhouse lawyer and in 1962 finally winning exoneration from the New York Supreme Court, which held that the testimony against him had been perjured with the connivance of the prosecutor.

He’d spent nearly a quarter-century in prison. Now, he was just another ex-con scrabbling after dead-end employment.

For years thereafter, Zimmerman fought for a special bill that would allow him to sue the Empire State for wrongful imprisonment, finally winning approval in 1981.

His suit asked for $10 million. The judge reckoned Zimmerman’s time and trouble were worth a tenth of that.

Expenses deducted, Zimmerman walked away with $660,000 — that, and sweet vindication.

Fourteen weeks later, he dropped dead of a heart attack.
