1649: Charles I

On this date in 1649, the struggle between parliament and crown cost the Stuart monarch Charles I his head.

Charles‘ political clumsiness and unreconstructed authoritarianism had seen the realm whose unitary sovereignty he insisted upon blunder from disaster to disaster: into bankruptcy, military defeat, religious conflict and the English Civil War.

The assignation of cause and consequence in that war’s genesis has much exercised historians.

What is beyond dispute is that the confrontation between monarch and subject, pitting against each other political and economic epochs, theories of state and power, rates as one of history’s most captivating courtroom dramas.

Charles refused to answer the court’s charge of treason, occasioned most particularly by the king’s fomenting the Second Civil War while already a defeated prisoner of parliament following the first Civil War. He rested firmly on royal prerogatives against what some interlocutors take to be an almost desperate plea by his judges for some hint of acknowledgment that could open the door to compromise:

[A] King cannot be tried by any superior jurisdiction on earth. But it is not my case alone — it is the freedom and the liberty of the people of England. And do you pretend what you will, I stand more for their liberties — for if the power without law may make laws, may alter the fundamental laws of the kingdom, I do not know what subject he is in England that can be sure of his life or anything that he calls his own. Therefore, when that I came here I did expect particular reasons to know by what law, what authority, you did proceed against me here.

It must be borne in mind that the trial of a king was a completely unprecedented event. Charles might be forgiven his attitude, even if it smacked of the impolitic high-handedness that had forced this deadly test of powers.

Parliament’s position — here in the words of its President — is distinctly in the stream of political discourse (if not always actual practice) ascendant in the West to this day.

Sir, as the law is your superior, so truly, sir, there is something that is superior to the law and that is indeed the parent or author of the law — and that is the people of England.

And therefore, sir, for this breach of trust when you are called to account, you are called to account by your superiors — “when a king is summoned to judgment by the people, the lesser is summoned by the greater.”

Charles played his lordly disdain to the end, refusing to admit parliament’s jurisdiction by making any sort of plea.

The line between heroic defiance and pig-headed obstinacy being very much in the eye of the beholder, the confrontation is typically played straight-up for its arresting clash of principles — as in the 1970 biopic Cromwell, with Alec Guinness as the monarch:Probably more troubling for the parliamentary party than the regicide taboo was consideration that the execution would transfer royalist loyalties from a man safely imprisoned to an heir beyond their power, who could be expected to (as in fact he did) resume the civil war.

Competing philosophies expounded for the competing interests; the dispute involved the era’s intellectual titans, in conflict over the most fundamental concepts of the state. Thomas Hobbes wrote his magnum opus The Leviathan as a royalist exile in Paris, and its abhorrence for rebellion and divided sovereignty unmistakably reflects the English Civil War experience. John Milton earned his bread as a republican polemicist; his poetic celebration of Satan’s failed rebellion in Paradise Lost, written after the Stuart restoration, can be read as a political critique.

It’s conventionally thought that the beheading was conducted by a radical minority, though that supposition is debatable, colored as it is by the ultimate restoration of the crown. But although England would have a king again, the weight of political authority would steadily, permanently, gravitate towards parliament, organ of the merchant classes who would steer England henceforward.

Did it have the right? Two implacable powers each claimed an indivisible object; “between equal rights, force decides.” So on this cold winter’s afternoon — Charles wore thick undergarments, so he would not shiver with the appearance of fright — the deposed king was marched to a scaffold erected at Whitehall. He gave a short final address, with the famous words for his principle of martyrdom — “a sovereign and a subject are clean different things” — then laid his head on a low block, where a masked executioner (never definitively identified) cleanly chopped it off.

After the monarchy’s restoration, Charles was canonized as a saint by the Church of England: he’s still the last person so venerated, an odd salute to a mortal career of unalloyed arrogance and incompetence. Observance of the cult was toned down in the 19th century, although a Society of King Charles the Martyr dedicated to its preservation still exists; monarchists of a more secular inclination also continue to mark his martyrdom on this anniversary.

Less reverent by far was Monty Python’s homage:

“The most interesting thing about King Charles the First is that he was five foot six inches tall at the start of his reign, but only four foot eight inches tall at the end of it.”

1943: Sue Logue, George Logue and Clarence Bagwell

On this date in 1943, as the New York Times laconically led the story, “[t]wo men and a woman died in the electric chair … bringing to eight the number of deaths in ‘The Logue Case,’ which started over a dead calf.”

This culmination to an operatic South Carolina feud has a book all its own, and that scarcely seems equal to the events.

The dead calf in question* belonged to the Logue family, and (your headsman wouldn’t make this up) had been kicked to death by a mule of the neighboring Timmermans. Perhaps mistaking themselves for a cartoon parody, the two leading families of rural Edgefield County, S.C., used the incident to escalate a long-simmering feud.

Killing higher up the food chain soon followed.

The Timmerman patriarch wasted the Logue patriarch — Sue Logue’s husband and George Logue’s brother — but claimed self-defense and was acquitted. (Body Count: 1)

So Sue and George hired (via nephew Joe Frank Logue) a down-on-his-luck plasterer to even the score. Clarence Bagwell said he’d kill everyone in the county for $500, but he earned his fee just by gunning down old man Timmerman. (Body Count: 2)

The investigation brought the law to the Logue doorstep, and the requisite gun battle ensued. A sharecropper on the farm was killed. So was the sheriff — he was Sue Logue’s cousin — and the sheriff’s deputy. (Body Count: 5)

“[T]he only circuit court judge in South Carolina history to have made love to a condemned murderess as she was being transferred … to Death Row.” (Source)

The officers’ death necessitated the appearance of the man who now became the senior law enforcement official in the county: Strom Thurmond, still a local judge and a few years away from his vault into national prominence as a segregationist presidential candidate and 46-year South Carolina Senator.

Thurmond waded through the posse and talked the trio into surrendering. His warning that they were liable to be lynched must have been compelling in any circumstance, but the old goat was a uniquely qualified ambassador: he’d been having an affair with Sue Logue.

Small wonder the trial venue was moved. “[N]o section of the county could be found that did not include a relative of theirs.” (Source)

And small good it did the Logues, who died with their hireling in the early morning hours this day. (Body Count: 8)

For such an outlandish case, it earned only muted national coverage — a pittance reckoned against the feeding frenzy latterly occasioned by such relatively meager gruel as Scott Peterson. World War II stole its thunder, although local interest was intense.

Yet it lives on for the involvement of Thurmond in a second guise that rates as quite possibly the juiciest slice of death row gossip in American history. According to Ol’ Strom: An Unauthorized Biography of Strom Thurmond:

Randall Johnson, a black man who supervised “colored help” at the State House and often served as driver and messenger, drove Sue from the women’s penitentiary to the death house at the main penitentiary in Columbia.** In the back seat with her, he said many years later, was Thurmond, then an Army officer on active duty. They were “a-huggin’ and a-kissin’ the whole day,” said Johnson, whom Thurmond later as governor considered a trusted driver… In whispered “graveyard talk” — the kind of stories not to be told outsiders — the word around SLED (State Law Enforcement Division) was that Joe Frank said his aunt Sue was the only person seduced on the way to the electric chair.

1862: 38 Sioux

On this date in 1862, 38 rebellious Sioux were hanged in Mankato, Minnesota, in the largest mass execution in U.S. history.

Fully 303 had been condemned to die in drumhead trials after the five-week Dakota War, one of the numerous native conflicts sparked by the march of European settlers across North America.

Abraham Lincoln — in a political risk — commuted all but 39 sentences* adjudged “to have participated in massacres, as distinguished from participation in battles,” essentially defining a special category for what today might be considered “war crimes.”

Lincoln had more pressing business on his hands, to be sure, but seems to have been affected by the plight of the natives that drove them to wage hopeless war on encroaching settlers:

“[Bishop Henry Whipple] came here the other day and talked with me about the rascality of this Indian business until I felt it down to my boots. If we get through this war, and I live, this Indian system shall be reformed!”

Fateful “if” — but politicians say many things, after all, and it was long before Lincoln went to Ford’s Theater that the tribes had been forced out of Minnesota, scattered to wasteland reservations and subsequent clashes with the American army.

On this day, all that doleful future was prefigured in the 38 who hanged together in what is now Mankato’s Reconciliation Park, an event that after a century’s time has become a moment for commemoration.

41 B.C.E.: Arsinoe IV, Cleopatra’s sister

On an unknown date late in 41 B.C.E., Cleopatra’s younger sister and rival Arsinoe was put to death in Asia Minor as the famous queen cemented her fatal alliance with Mark Antony.

Like Cleopatra herself, Arsinoe lived her short life in the internecine maelstrom of Ptolemaic politics under the sway of a Roman Empire itself immersed in civil strife. Violent death was something of an occupational hazard.

Nevertheless, had some flash of prescient irony visited her when Antony’s legionaries unsheathed their blades, she might well have wondered at the small happenstances of fate that left her a nigh-forgotten footnote in her sister’s story, rather than the other way around.

Three siblings had grasped at the Egyptian throne during the Alexandrian War, and whether it was charm or cold calculation won Caesar’s backing for Cleopatra, Arsinoe and her brother Ptolemy XIII still pressed the Roman garrison of Alexandria with a vastly superior force in a battle that was said to have set the Library of Alexandria aflame.

Timely Roman reinforcements decided the matter, and Arsinoe was marched in chains at Caesar’s sumptuous quadruple Triumph of 46 B.C.E. — though she was spared the execution that typically concluded such an ignominy and instead packed off to a temple on the coast of modern-day Turkey.*

In Margaret George’s historical novel The Memoirs of Cleopatra, the danger of maintaining an enemy who has styled herself Queen is neatly summarized in a conversation between Caesar and Cleopatra set after the Triumph:

“I have spared Arsinoe.” [said Caesar]

My [Cleopatra’s] first feeling was a rush of relief. My second was worry. Arsinoe the proud would not retire quietly.

“Where is she to go?”

“She has requested sanctuary at the great Temple of Diana in Ephesus,” he said. “And I will grant it, if you agree.”

Ephesus! Too close to Egypt! Better send her to Britain! Yet … I would gamble, and be merciful. Perhaps I was not enough of a Ptolemy after all. Arsinoe would not have granted it.

“Yes, I will allow it.”

That very perception of her potential danger hung over Arsinoe like the sword of Damocles.

The sword fell — figuratively and literally — five years later after Cleopatra seduced Mark Antony at Tarsus in the autumn of 41. Her terms for Egypt’s alliance supposedly included elimination of this lingering rival — though if Arsinoe had made common cause with Caesar’s Republican assassins, Antony may well have had his own reasons to dispatch the young woman.

Arsinoe’s death helped seal a pact that was itself destined for a bloody end. Distracted by his foreign paramour, Antony steadily lost political ground to his adversary Octavian. In another decade’s time, open war broke out again.

The Egyptian fleet would gather at Ephesus, not far from Arsinoe’s final resting place, bound for the catastrophic Battle of Actium whose outcome added Cleopatra’s and Antony’s blood to the soil from which sprung the long reign of Octavian — soon to be styled Augustus Caesar, the first emperor of Rome.

* A Temple of Artemis — either in Miletus (as Appian has it), or the wonder of the world in Ephesus (as Josephus has it). She met her death at the temple — whichever it was — dragged to its steps and put to the sword. Ephesus seems to be the more generally accepted locale, and an octagonal tomb there has been speculatively identified as Arsinoe’s.

63 B.C.E.: Publius Cornelius Lentulus

On this date in 63 B.C.E., Publius Cornelius Lentulus was executed by strangulation in Rome’s Tullianum for conspiring to overthrow the Roman Republic.

He was one of the key figures in the Catiline conspiracy, a political intrigue set against a ruinous social crisis that pushed the country to the precipice of civil war.

Roman had fought Roman intermittently over much of the preceding 70 years in episodes underpinned by a class conflict pitting wealthy landowners (politically represented by the Senate) against the growing populations of plantation slaves who tilled their fields and urban plebeians displaced from independent farming on the other. Debt was choking the Roman economy.

Catiline, an ambitious politician from a fading patrician family, had sought the consulship on a populist platform of debt forgiveness; failing to win the office through legal channels, he maneuvered to take it by force. The affair is known mostly through the testimony of its enemies, so it is difficult to gauge the true mixture of opportunism and conviction that informed the conspirators.

A cliffhanger sequence of moves and countermoves against the consul Cicero ensued, highlighted most spectacularly by one of Cicero’s famous orations driving every Senator to seat himself away from Catiline — who nevertheless rose passionately in his own defense.

Catiline left Rome to raise an army in the countryside, leaving Lentulus (himself a former consul) to manage the intrigue within Rome.

Lentulus made the least of the moment, dilating when he could have acted and exposing the plot by dint of a ham-handed attempt to involve visiting Gauls with grievances of their own.

The arrested conspirators’ fate was debated in the Senate this very morning. The young Gaius Julius Caesar, then conducting an affair with Cicero’s Cato’s [correction] sister, stood against (illegal) summary execution, but the victories he would enjoy over Cicero yet lay some years into the future; fearing an attempted rescue, the Senate’s grim sentence was carried out immediately. Cicero personally escorted Lentulus to his death.

Lentulus’ failure likewise doomed Catiline, whose army shrunk from desertions before its commander hurled it into martyrdom with a stirring speech that recalled in passing “how severe a penalty the inactivity and cowardice of Lentulus has brought upon himself and us.”

1919: Felipe Angeles

On this date in 1919, Mexican hero General Felipe Angeles was shot at dawn in Chihuahua, hours after a military tribunal condemned him for rebellion.

Angeles, a humane and cosmopolitan socialist, had tacked a unique course through the dangerous Mexican Revolution. The career artillerist’s military counsel was a high card in the hands of the revolutionaries, and helped to make the coruscating career of Pancho Villa. Crucially, Angeles advised Villa to seize the mines of Zacatecas, dealing a mortal blow to the putschist Huerta government by throttling its currency at the source.

But that brilliant maneuver countermanded an order of the Revolution’s moderate political face, Venustiano Carranza, and both personality conflicts and support for more radically redistributionist measures soon sundered the Villa factions’ alliance with Carranza.

Angeles hitched his destiny to Pancho Villa and is historically recalled as the “angelic” opposite number to the famed guerrilla’s other top military henchman, the murderous Roberto Fierro. The three lend themselves almost implausibly to allegorical literature — “the decisive biographical proof of Villa’s duality … found in the two men closest to him, equidistant and extreme extensions of his nature.” (Enrique Krauze)

Angeles aimed, perhaps, at a statesmanship that might have remembered him the father of his country.

‘It was the recurrent dream of the impotent revolutionary intellectual: to play Plato to some powerful but pliant popular caudillo.’ This may well be an accurate analysis of Angeles, who probably had ambitions to be president of Mexico, with Villa as the power behind the throne but based in Chihuahua, allowing Angeles free rein to implement radical reforms in the capital

… Angeles probably saw Villa as a tabula rasa on which he could imprint his ideology. The problem was that Villa had no taste for abstract thought; as [John] Reed remarked ironically: ‘You had to be a philosopher to explain anything to Villa.’

To the grief of both, Villa neglected Angeles’ expertise when the Villists faced Carranzo at arms. Against advice, Villa abandoned Mexico City, failed to attack when the constitutionalists were tenuous, then spurned guerrilla operations for a frontal assault into the teeth of a foe with numerical superiority and lethal tactical advances culled from the slaughterhouse of World War I.

All was postscript after the Battle of Celaya — Villa maintaining for a few years as a bandit force and famously raiding New Mexico while his strategist drifted into exile in Texas before returning to Mexico on a quixotic peacemaking mission that led him instead to a show trial.

Angeles’ end came with the all the dignity of his romantic age. Before his judges — before all the world — he gave “full and clear expositions of his history and his ideas about everything from politics to ontology. It was clear that he knew this was his end, and he seems to have written a kind of intellectual memoir in the protracted answers … he was not defeated morally so much as physically.”

Angeles himself arranged particulars of his own execution with the Carranza men detailed to shoot him. He enjoys posthumous esteem commensurate with his qualities in life:

1944: An unknown Allied airman

On this date in 1944, in the midst of a worldwide conflagration that would claim 70 million lives, one unknown crew member of an Allied bomber was shot by Nazi SS/SD troops in the woods around Enschede, Netherlands.

From late 1942, the Allies’ massive industrial capacity had sapped the vaunted Luftwaffe, bleeding down the German air force in desperate airborne combat in the Mediterranean and the Eastern front. Crippling losses in July and August 1943 lay Germany’s industrial heart open to devastating bombing and would within a year spell the end of the Luftwaffe as an effective fighting force.

The contest’s stakes were high. This hour-long compilation of contemporaneous U.S. propaganda footage celebrates the decisive effect of air supremacy in western Europe:

With hostile planes darkening Europe’s skies, the Germans called upon ruthlessness to stand in for materiel. Nazi SS chief Heinrich Himmler issued, according to Robin O’Neil, an August 1943 order to show no quarter to captured enemy pilots.

The young man shot this day suffered its effects:

The airman (estimated age 26 years), who was apparently unhurt, was taken by the SS to the cellar of the villa [serving as SS headquarters], where he was kept under guard while arrangements were made for his disposal. These arrangements consisted of the removal of his flying kit, and the substitution of a civilian light-coloured shirt, a pair of dark trousers, and a pair of socks.

In this dress he was put into a security vehicle, his hands handcuffed behind his back, and taken some distance in the grounds of the SS HQ to a spot within the compound where a grave had already been prepared. The airman was marched from the car by an escort of two SS men, one of whom dropped back and shot the airman in the back of the neck. He was buried and the grave was carefully camouflaged.

To this day, the airman’s identity has not been established. It was assumed that he was British or American, most probably American, as the trousers he was wearing were of a dark shade of khaki, and the fact that when he was informed in the car, in English, that he was to be executed, he made an indistinct reply in which the word “America” was uttered.

Countless such executions undoubtedly took place and were lost, forgotten or concealed in the charnel house of war. Thanks to the witness of Dutch prisoners who survived the war, this single act of routine brutality endured not only historically but juridically: little more than a year later, its author, Dr. Karl Eberhard Schongarth — an SS officer who participated in the Wannsee Conference and slaughtered thousands in occupied Poland and Holland — faced a war crimes prosecution for the execution of the anonymous airman.

His actions this date may have been small by the gauge of a bloodthirsty career, but since pre-war treaties explicitly regulated treatment of war prisoners, they also constituted a conveniently plain transgression of the far-from-bright line demarcating “war crimes.” For this one killing, Schongarth was himself hanged as a war criminal in Hamelin, Germany on May 16, 1946.

1491: Eight current and converted Jews at an auto de fe

On this date in 1491, the murder of the Holy Child of La Guardia was punished with an auto de fe and the public execution of eight Jews — some practicing, some converted to Christianity (who enjoyed the mercy of strangulation before being burnt) — and three others already dead but exhumed for the occasion.

The auto de fe — literally, “act of faith” — was a public ritual of religious penance for the condemned. Though its performance did not always precede the execution of its participants, it became closely associated with the savagery of the Spanish Inquisition.

In the hysteria of the Holy Child of La Guardia case — one of history’s better-remembered instances of “blood libel” implicating Jews in the ritual murder of Christian children — the result was foreordained.

Knitting together (inconsistent) confessions obtained under torture, the famed Inquisitor Torquemada proved a conspiracy of Jews had kidnapped and crucified a child further to the concoction of a magic potion that depended on the heart of an innocent Christian — despite a fruitless high-and-low search for some missing child who might have been the actual victim.

After this day’s gaudy public slaughter, a cult sprang up around the supposed martyr, adored in a chapel erected where one of the prisoners had once had a home — the very spot, it was said, where the Jews conspired. The Holy Child was a staple of Spanish literature down to the 20th century and is still venerated in La Guardia.

But Torquemada aimed for results well beyond Christendom’s martyrology, and the wretches at the stake would not be this day’s only victims.

John Edward Longhurst argues in The Age of Torquemada that the Inquisitor seized on the Holy Child case to orchestrate “his heart’s desire — the expulsion of all Jews from Spain.”*

Early the next year, the Spanish monarchy obliged, permanently remaking Spain:

If Ferdinand and Isabella were hesitating over expelling the Jews from Spain, the discovery of this latest Jewish plot would surely resolve all doubts. The Auto de Fe of November, 1491, exploited the affair to its fullest, emphasizing not only all the gruesome details of the Murder but the Jewish menace to Christians intended by it. The sentence against the Jew Juce Franco, read aloud to the great crowd at the Auto de Fe, identifies him as a seducer of Christians to the Law of Moses in language that clearly foreshadows the Edict of Expulsion four months later

We may be sure that Ferdinand and Isabella were treated to a lengthy account of this case. It also is clear, from their own observations in the Edict of Expulsion, that Torquemada impressed on them the determination of the Jews to persist in their efforts to seduce Christians to Judaism. As long as they were permitted to remain, the danger of infection would never be eliminated, no matter how harsh the measures employed against them.

* Or, their forcible conversion … which would then keep the Inquisition in business for years to come.
