1635: Hans Ulrich Schaffgotsch, man in the middle

On this date in 1635,* the German aristocrat and general Hans Ulrich [von] Schaffgotsch lost his head in Regensburg.

Schaffgotsch (German Wikipedia entry: most information about him online is in German) would have appeared to have won the birthright lottery. Sure, he was no king, but being born to a hereditary Silesian baron of distinguished blue-blood lineage, and being dynastically married to a princess, put him squarely within the 1 percent’s 1 percent.**

Schaffgotsch caught one very bad break: he was born to come of age during the Thirty Years’ War.

The Schaffgotsch family had different branches going, but Hans Ulrich’s was Protestant — and this was also the predominant faith in early 17th century Silesia. (It adhered to the unsuccessful Bohemian Revolt.)

Doctrinal differences aside, Schaffgotsch had favorable terms from the Catholic emperor. He also made himself good friends with a fantastically wealthy duke named Albrecht von Wallenstein. Wallenstein was a little shaky on the religion question himself; he’d been raised Protestant and converted to Catholicism for unknown reasons.

When the Thirty Years’ War came calling again late in the 1620s, Wallenstein used his capacious wealth to field a large army in service of Ferdinand, and Schaffgotsch went right along as the generalissimo’s able adjutant. But Ferdinand, who was short on both cash and troops to call his own, soon came to fear this capable general upon whom he overmuch depended. When the opportunity arose, the sovereign abruptly relieved Wallenstein of command in 1630 — only to have to reinstate him in 1632† when his replacement got killed.

It turns out Ferdinand did have good cause for suspicion. Wallenstein was dissatisfied with the emperor’s treatment as well, and covertly treated with the Protestant league to switch sides or overthrow the emperor and rule in Bohemia. The detection of these plans in Vienna led Ferdinand to have Wallenstein judged by a secret court, then assassinated in 1634.‡

As his aide, Schaffgotsch too was soon dealt with. Unlike the dangerous Wallenstein, Schaffgotsch was a small enough target to arrest and prosecute in the conventional way — which happened in 1635. Schaffgotsch obstinately refused under torture to admit any involvement in treason, but he was condemned to death all the same.

The Silesian aristocrat might have felt hard done by, but he relieved some annoyance with an old-fashioned shopping spree. Schaffgotsch went out in style (German link) by plumping for black drapings for the scaffold, ordering a custom coffin, doing up all his servants in black mourning garb, and bribing the executioner of Regensburg to behead him seated in a chair. (The lord rooted himself so firmly in his seat that his head flew off at the sword’s stroke without his body toppling over.)

Afterwards, Schaffgotsch’s body was laid out for last respects for two days in Regensburg Blauen Krebs inn, which still exists to this day. (And has the story on its website.)

* Gregorian date. With Catholic and Protestant powers both going at it, dating gets confusing in this period; it would have been July 13 per the Julian calendar still in use by most Protestants, and this date is also sometimes attributed.

1644: Joost Schouten, LGBT VOC VIP

On this date in 1644, Joost Schouten, the able merchant and diplomat of the Dutch East India Company, “was strangled and burned to ashes in my presence in Batavia [Jakarta] because of his gruesome sodomy.”

That’s the report of Gijsbert Heeck who, like Scouten, left a noteworthy memoir. Heeck allowed that Schouten “was a man of unusual knowledge and extraordinary intellect,” but despite his gifts remained “in his heart … a hypocritical villain and seducer of many, secretly using his prominence and great authority to force them away from the path of decency into the way of his shameful foulness, seeking thereby to satisfy his devilish lechery.”

Before all that devilish lechery stuff came to light, Joost Schouten (English Wikipedia link | Dutch) had enjoyed a brilliant two-decade career in the Far East, most notably in Siam. There, Schouten ingratiated himself with the Siamese king Prasat Thong,* winning lucrative trade concessions, personal honors, and a seat for himself on the East India Company’s executive organ, the Council of the Indies.

A report that Schouten initially wrote for that company surveying Siam’s geography, people, and politics was published in 1638 and translated into many tongues: he was the first general account of Siam for Europeans. While several others would follow (pdf) in the 17th century, Schouten’s Description remains an essential source for the period.

Schouten himself was no mere observer in the ferocious scramble for colonial position and trade leverage in East Asia. It’s for this august person that the explorer Abel Tasman (as in Tasmania) named Schouten Island (off the coast of Tasmania). That was on the voyage that Tasman undertook to circumnavigate Australia, and discover (for Europeans) New Zealand — a voyage outfitted by Joost Schouten. Given another decade, with Dutch commerce on the come, who knows what heights he might have attained.

But the envoy’s scintillating service record did him little good when a handsome French halberdier repulsed by Schouten’s advances entrapped him in June 1644. This was an offense the Company took incredibly seriously.

Schouten confessed the crime voluntarily, and the only consideration the judges showed him was a pre-burning mercy strangulation. Their verdict, according to Peter Boomgaard, evinced “fear for the punishing hand of God if those who ruled did not take drastic measures.” Schouten was an educated man; indeed, he himself had been a judge. All the worse that, where he had wrought his best service for the Dutch Republic, he had also consciously invited its undoing in a hail of fire and brimstone.

One could, on the other hand, say that it was the Company itself that tempted divine wrath. After all, those in its service routinely spent months in overwhelmingly male environments: ships at sea, and trading outposts that were by now barred to European women. (Local women were a different story, of course.) Nor was Schouten’s particular stomping-grounds of Siam near as virulent in its attitude towards homoeroticism as the Calvinists back home; Schouten’s own travelogue noted that “their Priests, as well as many of the Gentry, are much given to Sodomy, that unnatural passion, being esteemed no sin, nor shameful thing amongst them.” Abroad on the blooming East, coinpurse bursting with the commerce of nations: it must have been a heady experience.

Whether coming around to the Siamese “esteem” or having nurtured it from the start, Schouten had, he said, indulged same-sex encounters** with some 19 different men since putting to sea from a return visit to the mother country in 1637. At least three of those partners — a boatswain’s mate, a soldier, and a burgher — were to their sorrow alive and conveniently identifiable in the Indies.

“Those who were known [to have taken part in his deeds] were, either with him, or later … smothered under water since they were unworthy to continue living among humans,” concluded our eyewitness Gijsbert Heeck. “Which is a fitting recompense and retribution for their gruesome life on earth. In the hereafter, however, the worst is still to come. But it is not for us to judge.”

* Prasat Thong, a law-and-order type, is alleged by the account of another 17th century Dutchman to have personally conducted some executions.

1631: Giles Broadway and Lawrence Fitzpatrick, for consistency

On this date in 1631, Giles Broadway and Lawrence Fitzpatrick hanged at Tyburn.

Although the evidence against them was extremely questionable, their trial just nine days prior could hardly have turned out otherwise, for these men were the servants implicated in conniving with the Earl of Castlehaven in the scandalous debauch of his household.

This notorious case had that May resulted in Castlehaven’s execution (wonderfully guest-blogged in these pages by Courtney Thomas). The Earl appears to have run his household as a veritable den of sexual iniquity, but the actual facts upon which a capital conviction had been secured were sketchy and subject to no little public controversy. Castlehaven himself declared on the scaffold that he was a victim of a conspiracy by other members of his family to lay hands on his inheritance.

Manservants

Crucial to the Earl’s condemnation was the testimony of the servants Giles Broadway and Lawrence Fitzpatrick. Broadway owned, under pressure, that he had raped Castlehaven’s wife at the Earl’s direction. Fitzpatrick copped to having sexual relations with the Earl — but crucially claimed that those acts had not entailed actual penetration.

The whole scandal inspired no end of bodice-ripping broadsides and warring doggerel arguing the Earl’s perspective or his wife’s. Crude as this one is, it gets at the key legal issues at stake in the trial — to wit, whether the actual acts that took place in Castlehaven’s Sodom met the legal definition of buggery or of rape:

Book CoverGiven that the court had found the ejectionem seminis here sufficient to lop off the head of a peer of the realm, the man’s low-born servants could hardly be acquitted in the same matter without undermining the verdict’s already tenuous public confidence. As the judges in the servants’ case put it, “We for our parts thought it to stand with the honor of common justice, that seeing their testimony had been taken to bring a peer of the realm to his death, for an offense as much theirs as his, that they should as well suffer for it as he did, lest any jealousy should arise about the truth of the fact, and the justness of the proceedings.” (Quoted in A House in Gross Disorder: Sex, Law, and the 2nd Earl of Castlehaven, a recent book on the scandal.)

Law Orifices

Broadway was the easier condemnation.

Desperately, he tried insisting that his “rape” of the Countess had not achieved actual penetration: the scare quotes here because the boundaries of a body constituted the bright line establishing whether the capital crime of rape had been committed. (Compare for instance this close call from the 18th century.) As the poem implies, Broadway suggested that he suffered premature ejaculation before he crossed the coital, and legal, threshold.

This circumstance required the victim to testify against him. Anne Stanley, fruit of an ancient and powerful family — she had once upon a time had a case as the heir to the throne of England — therefore had to present herself to attest that this mean person “had known her carnally, and that he did enter her body” while her late beheaded husband sadistically held her down. In court she could not bear to look at Broadway, she said, “but with a kind of indignation, and with shame, in regard of that which had been offered unto her, and she suffered by him.”

Fitzpatrick was a tougher trick.

Castlehaven himself had only been convicted by a bare majority on the sodomy charges, and that only by the dubious expedient of expanding the reading of the sodomy statute to compass all same-sex contact: previously, as with rape, penetration had been understood to constitute the crime.

When it came to Fitzpatrick’s trial, he argued vehemently that he could not be made his own accuser. Moreover, as he said in his dying address at the scaffold, “my lord Dorset had entrapped and ensnared him to his destruction; for saying upon his honour, and speaking it in the plural number (as the mouth of the whole [Privy Council]) that whatsoever he delivered should no ways prejudice himself, he thereby got him to declare the earl guilty of the sin of Buggery; wherein himself being a party, was the only cause he came now to suffer death.” That’s a right dirty trick, just another one of many compelling reasons never to talk to cops.

Broadway, for his part, charged under the gallows that his victim Anne Stanley — who remained in the twisted marriage for five-plus years despite having the means to escape it — was herself a principal despoiler of the household’s virtue, “the wickedest woman in the world.” Two other servants, he said, “lay with her commonly,” and one of them had “gotten a child upon her, which she, like a wicked woman, had made away,” leading that vengeful servant to rape at the Earl’s instigation Anne’s 12-year-old daughter by her previous marriage — for which purpose the Earl himself had to apply “oil to open her body.” Home sweet home.

(Young Elizabeth Barnham was dynastically married to her stepbrother James, who himself initiated the complaint against his father. Castlehaven appears to have hated his own son, and the son feared that the Earl’s largesse with his favorites and his apparent attempt to have his servant father on Elizabeth an heir that was not of the family’s own blood would destroy the Touchets. Castlehaven was not indicted on this specifically and the other charges against him were sufficient to the purpose. But it was surely a sensitive offense for his fellow-bluebloods. In his exhortation to the condemned Castlehaven, the Lord Steward scarcely mentioned the rape and sodomy stuff. “Although you die not for that,” he intoned, “you have abused your own daughter! And having both honour and fortune to leave behind you, you would have had the impious and spurious offspring of a harlot to inherit!” This quote, like all the quotes from the trials and scaffold, can be found here; this volume, however, proposes not “harlot” but the seemingly more suitable word varlet.)

1655: Grete Adrian, Ruethen witch

On this date in 1655, Grete Adrian heard her final condemnation as a witch, then was ushered to the marketplace of Ruethen where she was beheaded and burned.

A remarried widow, Grete was the daughter of a woman who in her own day had been suspected of witchcraft; Grete had lost siblings to witch-hunts during the recent Thirty Years War.

The family history with devilry would help to implicate her when allegations arose that she had produced milk by conjuration and turned into a wolf to kill a neighbor’s horse. Grete didn’t stand up to the torture very long; within a couple of days she agreed that she had taken the devil as a lover, cast malevolent spells, attended witches’ covens, and all the usual Hexenprozesse stuff. All she asked was for quick execution.

In 2011, schoolchildren from Ruethen’s Friedrich-Spee-School — its namesake was a noted critic of torture and witch trials in the 17th century — successfully petitioned local authorities to issue a blanket posthumous pardon for 169 men, women and children executed for witchcraft between 1573 and 1660 … Grete Adrian included.

1762: Crown Prince Sado, locked in a rice chest

On this date in 1762, the Korean king Yeongjo had his son and heir Crown Prince Sado immured in a rice chest — where he would die after eight excrutiating days.

This bizarre incident, attested by the memoirs of Sado’s widow Lady Hyegyeong, continues to perplex down to the present day.

In Lady Hyegyeong’s telling, the tyrannical father warped the sensitive son, sending the latter into a destructive spiral of madness. As the 1750s unfolded, Sado’s behavior grew erratic, violent, and delusional. He was prone to sudden fits of rage, stalked and raped court ladies, and wandered Seoul streets in disguise. He eventually murdered numerous servants, eunuchs, and miscellaneous commoners — even his own concubine. The court lived in terror of the mad prince’s impunity; the ruling dynasty itself stood in peril.

Many years later, the prince’s desperate wife in her autobiography remembered Sado’s own mother finally appealing to the king to do the necessary, unthinkable thing:

“Since the prince’s illness has become quite critical and his case is hopeless, it is only proper that you should protect yourself and the royal grandson, in order to keep the kingdom at peace. I request that you eliminate the prince, even though such a suggestion is outrageous and a sin against humanity.

“It would be terrible for a father to do this in view of the bond of affection between father and son; but it is his illness which is to be blamed for this disaster, and not the prince himself. Though you eliminate him, please exert your benevolence to save the royal grandson, and allow him and his mother to live in peace.

Perhaps to avoid spilling the prince’s blood, the royal lunatic was that very day forced into a sturdy chest in a palace courtyard. The ferocious prince entered it placidly, and his living eyes never again beheld the outside of that box: it was nailed shut and buried. (A recently discovered inscription, however, perhaps implies that the king didn’t actually mean for eight days locked in a box to be fatal. If so, it certainly lends credence to the idea that Sado’s mistreatment in childhood lies behind the later psychotic breaks.)

The royal grandson was indeed spared. When that child, Jeongjo of Joseon, finally succeeded to the throne upon his grandfather’s death in 1776, he wasted little time restoring the honor of his dead father.

1668: A Dutch suicide, posthumously gibbeted

A man … who was in the habit of asking his wife for money to buy brandy, would on her refusal say that he would go hang himself. When on 23 June 1668 he again asked for two pennies to buy brandy, his wife said she had no money, whereupon he replied, “I will hang myself or may the devil take me.” His wife replied, “Do whatever you like, you always say that,” and went back to her cleaning. Shortly thereafter, she found that her husband had hanged himself in their home. She then called for the neighbors, who have all made declarations and given evidence. On a charge by the bailiff, his corpse has been taken to the Volewijk on 26 June 1668 and hanged on a gibbet.

This excerpt, via Machiel Bosman’s chapter “The Judicial Treatment of Suicide in Amsterdam” in From Sin to Insanity: Suicide in Early Modern Europe, represents the last documented case of the Dutch posthumously punishing a suicide.

Well … a certain class of suicide.

It seems that Dutch law from about the 16th century, and certainly in the 17th century, began drawing a categorical distinction between suicides driven by madness or despair, and those ob conscientiam criminis — criminals who took their life to cheat the law.

Posthumous execution was inflicted upon the latter all the way up until the French Revolution reached the Low Countries in 1795. Bosman, for example, notes the case of a thief gibbeted in Amsterdam in 1792 after he hanged himself in jail. For non-criminal suicides, “punishment” was more typically a silent night-time burial, perhaps in unconsecrated ground: a meaningful deterrent for at least some of the living, but very distinct from judicial infamy. The widower of a 1532 suicide had even successfully appealed Amsterdam’s attempt to levy a punitive fine on the estate.

Hans Bontemantel, one of Amsterdam’s sheriffs, was incensed by the archaic sentence executed in 1668: “I am not responsible for this,” he noted in the margin of his summary. “And it is against the law.”

1608: St. Thomas Garnet, protomartyr of Stonyhurst

June 23, alas, was the end of the line for Jesuit Thomas Garnet, martyred on that date in 1608 for Catholic proselytizing in England.

Now accounted a saint and one of the Forty Martyrs of England and Wales, Garnet was the nephew of Henry Garnet, a priest executed in 1606 for complicity in the November 5, 1605 Gunpowder Plot.

Thomas, too — then about 30 years old — was arrested during this same backlash, and put to torture for evidence against uncle Henry. Thomas had been exercising his covert ministry in England since 1599, after slipping English custody once before.

As a result of the Gunpowder Plot hubbub, Thomas Garnet was among 47 Catholic clerics shipped across the English Channel to Flanders in July 1606, where they were warned that they faced execution should they ever again be caught in England.

Thomas Garnet returned, of course. He was betrayed within weeks by another priest named Rouse — whom Garnet publicly forgave while being drawn, hanged, and quartered on this date in 1608. (His faith was treasonable because he refused to swear an oath of allegiance demanded of Catholics post-5.11.)

Garnet’s remains were translated back to his Catholic school on the continent. In more tolerant times, long after Garnet’s death, this English Jesuit school finally had liberty to relocate back to England proper. While Garnet’s relics were destroyed in the French Revolution, he remains the protomartyr (the first martyr associated with a place) of the venerable Stonyhurst College, now in Lancashire.

1699: Madame Tiquet, “nothing more beautiful”

On this date in 1699, Madame Angelique-Nicole Tiquet lost her beautiful head … eventually.

The talk of every Parisian in the spring of 1699 for attempting the life of her husband, Angelique-Nicole Carlier had been well-known in Paris circles since the 1670s; coincidentally or not, that was a period when a perceived boom in “husband-killing” burgeoned the phenomenon into an outright moral panic.

In those bygone days, Mademoiselle Carlier did her manslaying metaphorically, wielding only her limitless charms (not excluding a wealthy inheritance left by her industrious albeit untitled late father). This reputed “masterpiece of nature,” alas, exchanged her magnum opus for deniers on the livre when she succumbed to the suit of Claude Tiquet, a respected councilor of the Parlement of Paris so bedazzled by the young woman that he did not pause to consider her liberalities. Although quite past her in age, Tiquet won her hand with the promise of wealth so capacious that he wooed his intended with a bouquet of flowers studded with 15,000 l. worth of diamonds — and plied her aunt with still more largesse to advance his case.

But actually, Monsieur Tiquet was not wealthy. He stretched his fortune to acquire these amorous bribes as, let us say, investments in a happy future.

“Thus they united their fortunes for life, equally blinded as to each other,” George Henry Borrow wrote. “Such are the steps that lead to the most unhappy destinies.”

The wife’s prodigality — and her belated discovery as she blew through the putative family fortune that it was he who had married the money, and not she — soon brought domestic relations to a frosty pass.

Madame kindled a more edifying romance with a young captain of the guards; Monsieur strove in vain to check her moves with locked doors and snooping skulks. They separated to distinct wings of the family house, seeing one another only rarely — and in deathly silence — while each schemed his or her embittered schemes. Years they wasted at this intolerable impasse.

Despairing at last of being rid of either her horrible husband or his horrible debts, Madame Tiquet took her plotting far enough to compass her spouse’s death. “It is impossible,” she cried in one unguarded moment to a friend, “for me to have any enjoyment of myself while my husband lives, who is in too good health for me to look for such a quick revolution of fortune.”

So she engaged the services of her porter and of a freelance villain, and on the evening of April 8, 1699, these two assassins ambushed Claude Tiquet as he returned from a friend’s house and shot him three times. One ball only barely missed the heart. Tiquet survived, and he demanded those who came to his aid take him not to his own house but back to his friend’s. Of enemies, he said, “I have none but my own wife.”

This scenario speedily became the talk of Paris, and it did not take long for sentiment to coalesce against the wife. The hired assassins implicated Madame Tiquet in a years-long conspiracy to murder her husband whose previous installments — a missed ambush; a failed poisoning — had come to naught. Both Madame Tiquet and the porter, Jacques Moura, received a sentence of death, each appropriate to their respective stations: she to lose her neck, and he to swing from his.

There nevertheless remained some ambiguity about her real guilt, for the evidence was mostly circumstance and inference and colored by the purely titillating qualities of the public scandal. And then there was the fact that she was an attractive woman.

Angelique’s brother, a guardsman like the condemned woman’s lover, organized a petition for pardon. Surprisingly, even Monsieur Tiquet threw himself at Louis XIV‘s feet to plead for the life of his would-be murderess and the mother of his children. But it is said that when the Sun King wavered in his firmness, the Archbishop of Paris himself insisted upon the sentence. That prelate’s warning that save Madame Tiquet’s head should drop, no man could feel safe in his house must have fallen very ominously from the lips of the executive manager of Parisian confessionals.

Madame Tiquet heard the final failure of her appeals this day from an official who in the springtime of life had himself numbered among Mademoiselle Carlier’s suitors. And because the condemned would still not consent to confess the plot, that admirer was further obliged to order her to the cruel water torture to extract her statement.

In this procedure, the poor sinner is stretched out as on the rack, and eight pots of water painfully forced down the gullet. Madame Tiquet endured only a single pot before she calculated her inability to withstand the procedure and admitted all. Even so she continued to insist on the innocence of her lover: “I took care not to let him into the secret, else I had lost his esteem forever!”

These justice-satisfying preliminaries dispensed with, the condemned were conducted to the Place de Greve to suffer the penalty of the law. Thousands crowded the streets and windows, as was becoming the style for the execution spectacle of the era. Genuinely contrite or else wanting to play the part, she conversed humbly with her confessor and her condemned porter, exchanging absolutions and exhortations to die with Christian firmness.

Proceedings were delayed by a thunderstorm, although Madame Tiquet showed nothing but equanimity to wait at the foot of the scaffold while the weather passed. Jacques Moura hanged first: the undercard attraction.

Then the talk of all the town mounted those beams to give her own final performance, one remarked upon by all observers for its poise and stagecraft. The later memoirs of the Sanson family, written after that name inscribed itself on the guillotine during the French Revolution, dramatized the scene. It includes the regrettable inability of their own ancestor Charles Sanson de Longval* to equal the doomed woman’s grace under pressure.

When Angelique’s turn was come, she advanced, gracefully bowing to my ancestor, and holding out her hand, that he might help her to ascend the steps. He took with respect the fingers which were soon to be stiffened by death. Mdme. Tiquet then mounted on the scaffold with the imposing and majestic step which had always been admired in her. She knelt on the platform, said a short prayer, and, turning to her confessor,

“I thank you for your consolations and kind words; I shall bear them to the Lord.”

She arranged her head-dress and long hair; and, after kissing the block, she looked at my ancestor, and said:

“Sir, will you be good enough to show me the position. I am to take?”

Sanson de Longval, impressed by her look, had but just the strength to answer that she had only to put her head on the block.

Angelique obeyed, and said again:

“Am I well thus?”

A cloud passed before my ancestor’s eyes; he raised with both hands the heavy two-edged sword which was used for the purpose of decapitation, described with it a kind of semicircle, and let the blade fall with its full weight on the neck of the handsome victim.

The blood spurted out, but the head did not fall. A cry of horror rose from the crowd.

Sanson de Longval struck again; again the hissing of the sword was heard, but the head was not separated from the body. The cries of the crowd were becoming threatening.

Blinded by the blood which spurted at every stroke, Sanson brandished his weapon a third time with a kind of frenzy. At last the head rolled at his feet. His assistants picked it up and placed it on the block, where it remained for some time; and several witnesses asserted that even in death it retained its former calmness and beauty.

“Nothing was more beautiful” than Madame Tiquet’s lifeless severed head, one spectator discomfitingly enthused.

It’s by the author of this wild true-crime mystery unfolding elsewhere in France at just about the same time.

1631: Mervyn Touchet, Earl of Castlehaven

The crimes of Mervyn Touchet (executed on May 14, 1631), second Earl of Castlehaven, caused a sensation in Stuart England.

Convicted of rape and sodomy by a jury of his aristocratic peers, his crimes were alleged to have taken place under his roof and against members of his own family. While all of the witnesses against Touchet stood to gain materially from his death and various household servants did present evidence which contradicted that of his wife and son (who testified against him), he, as household head, was clearly unable to maintain proper order and obedience within his own house and this was instrumental in ensuring his conviction.

Book CoverIn this sense, although his alleged crimes were themselves horrific, it was Castlehaven’s subversion of expected social roles and modes of conduct in the context of his disordered household which truly shocked contemporaries (as Cynthia B. Herrup has skillfully argued in her study of the Castlehaven case, A House in Gross Disorder: Sex, Law, and the 2nd Earl of Castlehaven).

Mervyn was born in 1593, the eldest son of Lucy Mervyn and George Touchet; the latter was Baron Audley in the English peerage and, from 1616 until his death a year later, first earl of Castlehaven in the Irish peerage. Details of the future Earl’s childhood are scant.

From the time he was seven, in 1600, his family appears to have lived largely in Ireland, first on their estates in Munster and later in county Tyrone and Armagh (although they were in England sporadically, such as in 1594 when the elder Touchets were present at an inn in Beaconsfield to see their daughter Maria clandestinely marry the heir of John and Joan Thynne, Thomas, initiating a prolonged feud between the two families).

In 1608, Mervyn’s father settled the family’s English properties on his son and, while he remained in Ireland, Mervyn took up residence in England in the counties of Somerset and Dorset. In keeping with his new status as a propertied gentleman, he was knighted in the same year.

Sometime in this period Mervyn also embarked on legal studies and, in 1611, he was admitted to the Middle Temple. Around this time he also began his first marriage, taking as his wife Elizabeth Barnham, the daughter (and one of the co-heirs) of Benedict Barnham, a London alderman.

Through this match Mervyn gained additional properties in Middlesex, Hampshire, Kent, and Essex. Roughly a year after the marriage ceremony, in 1612, the couple’s first son, James Touchet, was baptized. The pair went on to have two more sons, George and Mervyn, and three daughters, Lucy, Dorothy, and Frances.

Upon his father’s death in 1617, Mervyn inherited his lands in Ireland and the title of Earl of Castlehaven, becoming the second Earl. It is also possible that he converted to Catholicism during this period. While Castlehaven steadfastly denied this, most of his children later became active Catholics, perhaps as a result of their early upbringing in these years.

Following the death of Elizabeth in 1622, Castlehaven remarried in 1624, this time to Lady Anne Brydges, nee Stanley, who was born in 1580 and was to outlive her husband by sixteen years. The widow of Grey Brydges, Baron Chandos, Anne was roughly thirteen years older than her new husband but she also had several young children from her first marriage and the two families now became one.

This dynastic merger was further consolidated when Anne’s eldest daughter, Elizabeth, was married to Castlehaven’s heir, James, in 1628. Elizabeth was all of 13 years old at the time.

Both marriages proved to be disastrous. In particular, the marriage of Elizabeth and James was dismal affair and ultimately led to the Earl of Castlehaven’s execution. By 1629, James had left the family estate (and his teen wife) at Fonthill Gifford and Elizabeth had become involved with Castlehaven’s favoured servant, Henry Skipwith.

It remains unclear whether this was a consensual relationship or, as was later charged, Castlehaven arranged for Skipwith to rape his step-daughter and daughter-in-law. What is certain is that Castlehaven persisted in showing great favour to Skipwith, which resulted in a confrontation between James and his father and ended with James complaining to King Charles I about his father’s conduct.

With this complaint, a formal inquiry was launched into the allegedly disorderly environment of the Touchet home.

The results of this inquiry, conducted by the Privy Council, revealed abominable crimes, in particular rape and sodomy. On April 25, 1631, the Earl was put on trial, charged with committing sodomy with a servant and assisting another servant, Giles Broadway, with the rape of his own wife, Anne, the Countess of Castlehaven (Anne alleged that the Earl had restrained her while Broadway assaulted her).

Henry Skipwith was never formally charged for his affair with Castlehaven’s daughter-in-law but rumour abounded of Castlehaven’s involvement in this as well (either in terms of instigating the rape, if such it was, or as a panderer who encouraged the illicit affair).

The trial was an early modern media sensation.

Special scaffolding was erected in Westminster Hall to accommodate the huge numbers that turned up to witness the trial and news writers throughout the realm and as far away as colonial North America speculated about the case and the outcome of the trial. Charles I, who prided himself on his happy and close-knit domestic life, was particularly shocked by Castlehaven’s behaviour and remarked that he hoped the “obscene tragedy” would quickly pass.

At the trial itself, twenty-seven peers acted as both judge and jury against Castlehaven and the testimony of six witnesses, including that of the Countess of Castlehaven and her daughter, was recorded by the court.

Their testimony painted a vivid picture of the Castlehaven household at Fonthill Gifford as a den of sexual iniquity and debauchery.

According to the Countess, Castlehaven had sexually and physically abused her from the very beginning of their marriage and this had culminated with Broadway’s rape of her at with Castlehaven’s assistance. Anne revealed that, within a few days of their wedding, the Earl was consorting openly with prostitutes and household serving boys.

She reported that he had commanded the couple’s servants to expose themselves to her and goaded her into illicit relationships with his friends and favoured servants, whom he also encouraged to embezzle money from the estate. She also alleged that, following the marriage of her daughter to Castlehaven’s heir, James, the crazed Earl had concocted a scheme to have Henry Skipwith impregnate the girl with his bastard, whom James would be forced to recognize as his own.

Throughout the trial Castlehaven was described as unstable, erratic, dissolute, and utterly devoid of religious faith and piety.

In his defence, Castlehaven alleged that he was the victim of a plot orchestrated by his family to commit judicial murder and inherit his estate and wealth. The most he would admit was over-generosity to a few of his favoured servants. He countered the charges by accusing his wife of infanticide and adultery and charging his son and daughter-in-law/step-daughter with greed.

As he reminded the court, all the witnesses against him stood to benefit a great deal from his death. Likewise, he told the court that the testimony against him on the rape charges was logically inconsistent and the reports of sodomy did not prove penetration and, without that definitive act, the sodomy charges were not sustainable.

While he was accused of subverting the natural order and not properly governing his household, he painted himself as the victim of his inferiors, who were the ones truly guilty of threatening the natural order by plotting against him.

The preserved records from the trial demonstrate that the evidence against Castlehaven was spotty and ill-sustained. The jury took several hours to deliberate and reach a verdict and, ultimately, twenty-six of the twenty-seven peers voted to convict on the charges of rape but only fifteen were persuaded by the allegations of sodomy.

After his conviction, some members of Castlehaven’s natural family, including his siblings, petitioned the crown for a pardon based on the alleged corruption of the witnesses against him. But Charles I refused to consider it or to investigate the suspicions of corruption while Castlehaven himself refused to confess his guilt and seek a pardon on his own behalf.

When he was taken to the scaffold on Tower Green on May 14, Touchet orally protested the verdict while affirming his acceptance of the King’s right to try and execute him. He also made a final declaration of his loyalty to the Church of England.

Almost immediately after his execution, various broadsides and pamphlets describing the lurid details of the cases and the motivations of those involved began to circulate, ensuring that it remained a topic of discussion and rumour for years to come.

While several writers argued for Castlehaven’s guilt, others, including his sister, Eleanor, authored a number of tracts which proclaimed his innocence and decried the wickedness of his accusers.

In July, two of the Earl’s alleged accomplices were put to death (the household page who was alleged to have committed sodomy with Castlehaven, and Giles Broadway, who aided Touchet in the supposed rape of his wife).

While these two servants had confessed to their crimes (aware that, as Castlehaven had already been convicted and executed, there was little chance that they would be acquitted and confessing meant that some mercy in the manner of their deaths would be shown to them by the state), the details of their confessions offered some support to Castlehaven’s accusations of corruption on the part of his wife and son and so the question of his guilt remained unresolved for many.

With his father’s death, James Touchet had the title of Earl of Castlehaven and his father’s lands conferred upon him by the crown. The executed Earl’s widow did not remarry and James Touchet was never reconciled with his wife, whose alleged misconduct with the servant Henry Skipwith had initiated the prosecution against the Earl.

While the Castlehaven case is often cited as both a potent example of the dangers inherent in the subordination of household discipline and as a celebrated case in the history of the treatment of homosexuality, it also established an important precedent regarding the right of a wife to testify against her husband in cases of marital cruelty and rape.

1664: Elsje Christiaens, Rembrandt model

On or about this date in 1664, a Danish teenager named Elsje Christiaens was strangled at Amsterdam for murder.

The date is a little shaky; I don’t know if it’s directly documented (the verdict, we know, came down on May 1). Whenever the execution took place was, it culminated an extremely short stay in Amsterdam for the young woman.

This was boom time for the Dutch Republic, the last apex years before it all went to hell. Naturally, wealthy Amsterdam drew immigrants: for a penniless Jutland 18-year-old like Elsje Christiaens (English Wikipedia entry | Dutch), here was opportunity.

In mid-April 1664, she took a room to lay her head while she looked for domestic employment.

Two weeks later, she still hadn’t found a job but her landlady expected rent. When she came to demand it and Christiaens tried to stall her, the confrontation turned tragic: the landlady started thwacking her shiftless boarder with a broomstick, and Christiaens defensively grabbed a nearby hand-axe and knocked the poor woman down a flight of steps — to her death.

The sentence called for her killer to be strangled while being beaten with the very same axe. Then her body was to be hung up publicly with the same weapon, and left “until the winds and birds devour her.”

Of course that happened long ago. But at this time, veteran corpsepainter and Dutch Golden Age master Rembrandt van Rijn was hanging out in Amsterdam, living in reduced circumstances after creditors dunned him into the poorhouse.

This was the first woman executed in 21 years, and Rembrandt did not mean to miss his opportunity to sketch it. On May 3, presumably the same day as Elsje Christiaen’s execution, he hired a boat to row him out to the Volewijck moor where the body had been hung up. That day the master sketched the immigrant girl’s freshly-executed corpse, and its shameful axe.

The novelist Margriet de Moor has dramatized the sketchy backstory of Elsje Christiaens and her chance intersection with one of the art world’s greatest names in De schilder en het meisje. Unfortunately for most, this book appears to be available only in Dutch, which is also the language of these reviews: 1, 2, 3.

Rembrandt wasn’t the only Dutch painter haunting Amsterdam’s execution-grounds in 1664.

In this landscape — serene despite its landmarks — Elsje Christiaens is visible on the right. The little copse of gibbets she’s a part of comprises prisoners executed since 1660, according to Michiel Plomp.*

The gallows stood at the Volewijck until 1795. Today, that once-hard-to-reach peninsula is a residential district in Amsterdam-Noord.
