1803: George Foster, and thence to the reanimator

It’s not too often that a typical convicted murderer becomes a source for not just law, but also literature and science. George Foster (sometimes spelled George Forster despite few, if any, contemporaneous spellings as such) managed just that on this date in 1803, and his legacy lives on to this day.

Foster’s case was, in the annals of capital punishment, unremarkable.

He was accused in the drowning of his wife and youngest child in the Paddington Canal, one of the many canals being improved at the time to connect various parts of England by water. Foster was found guilty based on circumstantial evidence and sentenced to hang at Newgate Prison on 18 Jan 1803.

Shortly after 8 a.m., Foster was executed; minutes later, he was a science experiment.

Professor Giovanni Aldini was the nephew of biological electricity guru Luigi Galvani, and he wanted to electrify a body. Galvani had shown that frog legs responded to electricity, twitching when current was passed through the muscle, and he was in academic competition with his associate and sometime dissident Alessandro Volta over why this occurred. Galvani claimed that an electrical fluid flowed through the corpse, activating the muscles; Volta said that the cells passed electrical signals between one another. It was this latter assertion that led to the development of Volt’s first battery, a voltaic pile.* Aldini was convinced that his uncle was right about electrical fluid, but he was keen on Volta’s ideas for creating portable electricity.

His stated reason for delving into what was known as galvanic reanimation was to aid the recently drowned, who, he said, might be resuscitated. Galvani leaned on some earlier experience with beheaded victims in Bologna, as well as animal experiments, to convince British government agents of the viability of the plan. As one witness to those events stated:

A very ample series of experiments were made by Professor Aldini which show the eminent and superior power of galvanism beyond any other stimulant in nature. In the months of January and February last, he had the courage to apply it at Bologna to the bodies of various criminals who had suffered death at that place, and by means of the pile he excited the remaining vital forces in a most astonishing manner. This stimulus produced the most horrible contortions and grimaces by the motions of the muscles of the head and face; and an hour and a quarter after death, the arm of one of the bodies was elevated eight inches from the table on which it was supported, and this even when a considerable weight was placed in the hand.

Which is not to say it was really difficult to get permission.

Aldini’s experiments were a very public roadshow demonstration of Galvani’s ideas. London’s Royal College of Surgeons was, at that time, fascinated with the boundaries of life and death, and Aldini was more than happy to offer his services. As well, the 1751 (or 1752) Murder Act would not allow hanged criminals to be buried, and their corpses were often used for scientific discovery. Foster’s body, which had hung for an hour in slightly sub-zero temperatures, was the first complete corpse Aldini acted upon, but he wasn’t the first to get a chance.**

The Newgate Calendar summarizes the events:

On the first application of the process to the face, the jaws of the deceased criminal began to quiver, and the adjoining muscles were horribly contorted, and one eye was actually opened. In the subsequent part of the process the right hand was raised and clenched, and the legs and thighs were set in motion. Mr Pass, the beadle of the Surgeons’ Company, who was officially present during this experiment, was so alarmed that he died of fright soon after his return home.

Aldini’s act was yet another public showcase of strange new technologies, this time sparking the imaginations of the Brits. Within a generation, Scottish experimenters were performing similar feats, and the College of Surgeons had, after further attempts similar to Aldini’s, revived the heart of another convicted murderer, John Bellingham. It was the first recorded heart shock revival in modern medical history.† (Even today’s scientists turn to electricity to instantiate life’s precursors in trying to solve the riddle of abiogenesis.)

But even more than that was the effect these results had on popular culture, where Mary Shelley, well aware of Aldini’s work (as well as that of Erasmus Darwin, a proponent of evolution well before the concept of “natural selection” was framed by his more famous grandson), used the idea of reanimation — such as was attempted on her husband’s first wife after she drowned — to inspire her signature characters, Victor Frankenstein and his “monster.”

As a cultural icon, Frankenstein did exceedingly well. Considered a true Gothic novel, the story was remade for stage as early as 1887, turned into a variety of films which were subsequently parodied (c.f. The Rocky Horror Picture Show, “Treehouse of Horror II”, The Re-Animator, etc.), retold on radio, brought up in song, and re-written in novels.

Galvanization was never mentioned directly in that book, but the studies at the College of Surgeons were clearly an inspiration. And galvanization transcended that book, striking a chord in the public imagination. It continued to pop up in publication for decades after the Aldini/Foster event, for instance in the 1836 illustration “A Galvanized Corpse”, in which the editor of the Washington Globe, Francis Preston Blair, is shown being “galvanized” by two demons, who represent the interests of Andrew Jackson.

* The Voltaic pile was originally used to disprove Galvani’s fluids theory. However, the two were largely non-adversarial, so Volta actively advanced Galvani’s name through the word “galvanism” and, by the time of Foster’s death, “galvanize.” The term “galvanized” metal refers to a conductive element coated with something non-conductive and dates from the late 1830s. Volta, of course, is the recognizable source of the the electrical potential unit of the “Volt.”

** Indeed, the College of Surgeons was receiving all hanging victims from London since 1752, and most were put through rigorous postmortems. Such scientific experimentation is also often blamed for the revival of Patrick Redmond in 1767, who received a windpipe incision following his hanging in Cork, Ireland; Redmond, however, was documented as hanging for just nine minutes, only slightly longer than the average person takes to die if deprived of oxygen.

1934: Marinus van der Lubbe, for the Reichstag fire

On this date in 1934, Dutch bricklayer Marinus van der Lubbe was beheaded by guillotine in Leipzig for setting the Reichstag Fire.

A watershed event* in the formation of the Nazi dictatorship, the Reichstag fire days before a parliamentary election enabled Hitler to stampede voters, suspend civil liberties, suppress left-wing parties on grounds of a suspected Communist plot, and seize “emergency” powers he would never relinquish.

This clip from an American miniseries on Hitler with the characters chattering in unaccented English portrays the fascists’ opportunistic use of the attack on a national symbol … something not exactly unknown to later generations.

Van der Lubbe, who was arrested on the scene, suffered the predictable fate. Four other Communists charged as accomplices were acquitted, in a trial with the gratifying spectacle of Hermann Goering personally testifying, and being undressed on cross-examination by one of the reds. One is reminded here that Hitler did not yet have everything in the state apparatus at his beck and call … although he did have a great deal already, inasmuch as the arson law under which van der Lubbe died was passed after the Reichstag fire and made retroactive.

If the big-picture outcome of the Reichstag fire is pretty clear-cut, its real origin and the corresponding rightness of the judicial verdicts have remained murky ever since. The fact that the scene of the crime became Nazi ground zero for the next decade sort of obscures the evidence.

Van der Lubbe confessed, so his participation is generally taken as a given.

Whether he was really able to start the blaze acting alone, as he insisted, and the Nazis “only” exploited this fortuitous calamity; whether he was part of a larger leftist plot, as his prosecutors claimed; or whether, as Shirer and many others since have viewed him, he was a patsy in a false flag operation set up by the Nazis with an eye towards creating a politically advantageous national emergency — these possibilities remain very much up for debate.

For what it’s worth, postwar West German courts reversed and un-reversed the sentence before officially rehabilitating van der Lubbe last year on the non-specifically indisputable grounds that the legal machinery brought to bear on the Reichstag fire “enabled breaches of basic conceptions of justice.”

* From Defying Hitler: A Memoir by a writer who would soon emigrate:

I do not see that one can blame the majority of Germans who, in 1933, believed that the Reichstag fire was the work of the Communists. What one can blame them for, and what shows their terrible collective weakness of character … is that this settled the matter. With sheepish submissiveness, the German people accepted that, as a result of the fire, each one of them lost what little personal freedom and dignity was guaranteed by the constitution, as though it followed as a necessary consequence. If the Communists had burned down the Reichstag, it was perfectly in order that the government took “decisive measures”!

Next morning I discussed these matters with a few other Referendars. All of them were very interested in the question of who had committed the crime, and more than one of them hinted that they had doubts about the official version; but none of them saw anything out of the ordinary in the fact that, from now on, one’s telephone would be tapped, one’s letters opened, and one’s desk might be broken into. “I consider it a personal insult,” I said, “that I should be prevented from reading whichever newspaper I wish, because allegedly a Communist set light to the Reichstag. Don’t you?” One of them cheerfully and harmlessly said, “No. Why should I? Did you read Forwards and The Red Flag up to now?”

1954: Hossein Fatemi, before the blowback

At dawn this date in 1954, the last Foreign Minister of democratic Iran was shot in Tehran.

It was a year since the dramatic events of 1953, when a CIA-backed coup d’etat overthrew Iranian Prime Minister Mohammed Mossadegh (or Mosaddegh, or Mossadeq, or Mosaddeq) for contemplating oil nationalization.

Over several chaotic days of “Operation Ajax” (or TPAJAX), the Mossadegh government repulsed a first coup attempt, then succumbed to another.

After Mossadegh initially appeared to have maintained his hold on power, the autocratic Shah Mohammad Reza Pahlavi fled for his life to Iraq and thence to Rome. Fatemi, Mossadegh’s forceful young foreign minister, excoriated the Shah in words that themselves raised the specter of execution.

A traitor is afraid. The day when you, O traitor, heard by the voice of Teheran that your foreign plot had been defeated you made your way to the nearest country where Britain has an embassy. (Quoted in the New York Times.)

Either way, it was high stakes for all concerned in oil country. There’s been contentious debate over the extent to which the affair was also a Cold War proxy conflict — or whether the involvement of the country’s Communist party was incidental, a smokescreen, or an outright stalking-horse for the west.

The coup against Mossadegh has emerged as a major historical turning point — and after the Shah was himself dramatically overthrown in the 1979 Iranian Revolution, not necessarily so successful for American foreign policy goals as it seemed at the time.

Appropriately — in fact, with eerie prescience given the events that then lay a generation in the future — a recently declassified 1954 CIA report on the coup made the first known use of a neologism that has since grown increasingly familiar: blowback.

Possibilities of blowback against the United States should always be in the back of the minds of all CIA officers involved in this type of operation. Few, if any, operations are as explosive as this type.

Maybe those possibilities should be in the front of the mind.

Today, there’s a street named for Fatemi in Tehran, and — strange to say — still some number of Americans who anticipate the greeting due liberators should they ever manage to roll a tank down it.

1945: Vidkun Quisling, who made his name as a traitor

On this date in 1945, eponymous Nazi collaborator Vidkun Quisling was shot at Oslo’s Akershus Fortress for high treason.

By the time of his death, the Nazi collaborator (English Wikipedia page | Norwegian) had already given his surname to English and other languages as a synonym for traitor.

Just deserts for his efforts as chief of the fascist party Nasjonal Samling to aid the Nazi conquest of his home country. Quisling interrupted a radio broadcast on April 9, 1940 to proclaim himself Prime Minister* and order cooperation with invading Germans.

Although Quisling’s lack of popular support compromised his value even as a puppet, he remained as Minister President of Norway through the war — a crucial tool in Germany’s counter-encirclement jousting with Britain, nicely explained at the outset of Frank Capra’s American propaganda flick Why We Fight:

He enjoyed public regard commensurate with his station.


A 1944 cartoon in Sweden (which remained tenuously neutral and unoccupied during the war) indicates that Quisling had already made his name a byword for treachery. The caption reads:
“I am Quisling.”
“And the name?”

Norway had abolished capital punishment in 1905, but its government-in-exile reinstated it expressly for dealing with high-level collaborators.

Though Quisling himself may have deserved this and worse, the justice and legality of so doing has been controversial ever since.

1917: Mata Hari, femme fatale

At 5 a.m. this date in 1917, Margaretha Geertruida Zelle — better known as Mata Hari — was awoken at Saint-Lazare Prison to news that it was her last day on earth.

She died in a muddy drill field outside Paris, facing a firing squad as she had lived: self-possessed, mysterious, her eyes (she refused a blindfold) open.

For the oldest profession, it may be there is nothing truly original, nothing new under the sun. But Mata Hari — thanks in no small part to her genuinely fatale end — redefined it for the dawning age of mass visual media and tapped the power of sexual allure for a commercial century.

She was already pushing 30 when she got into the exotic dance game, with a failed May-December marriage behind her from what a wag might call her first sexual bargain, to get out from under the thumb of her family and see the world. In Paris in the belle epoque, there were assuredly dancers younger, prettier. Margaretha, who here debuted the show name by which history would know here, surpassed them with showmanship.

She exploited her exotic olive-toned looks — there were rumors of Javanese or Jewish blood even in her childhood — and claimed to be an Indian princess; her talent for repackaging oriental exoticism with just the right amount of otherness combined with her willingness to push boundaries of eroticism made her an instant sensation. Naturally gregarious and unprudish, she segued into the courtesan biz on the side with dashing officers and wealthy industrialists.

Not bad for a thirty-something mother of two.

She comes at the start of our own era: sensual postcards and posed photos of Mata Hari were at once her pitch and her product; celluloid was just coming online, and 14 years after her death, she’d be portrayed by silver screen femme fatale Greta Garbo:

That’s her with the last object of her affections, a Russian aviator young enough to be her son, and a reminder that the birth of Greta Garbo’s era was also the death of Mata Hari’s own.

She was aging, for one thing. For another, of course, war shattered Europe. Famous, decadent, polyglot … those things that had been her passport suddenly became her liabilities. Globetrotting travel? Payoffs from a multinational cast of officers for her companionship?

There’s no take here on whether she was really, as convicted, a German spy of any variety at all — she seems to have been approached, to have tried her hand clumsily or to have been set up by either French or German intelligence, or simply to have behaved indiscreetly. Once she was caught up against events, her maneating reputation did her no favors.

Spying, she was terrible at. Commanding men’s attention? As a British correspondent reported, Margaretha Zelle owned her role to the very last.

The first intimation she received that her plea had been denied was when she was led at daybreak from her cell in the Saint-Lazare prison to a waiting automobile and then rushed to the barracks where the firing squad awaited her.

Never once had the iron will of the beautiful woman failed her. Father Arbaux, accompanied by two sisters of charity, Captain Bouchardon, and Maitre Clunet, her lawyer, entered her cell, where she was still sleeping – a calm, untroubled sleep, it was remarked by the turnkeys and trusties.

The sisters gently shook her. She arose and was told that her hour had come.

‘May I write two letters?’ was all she asked.

Consent was given immediately by Captain Bouchardon, and pen, ink, paper, and envelopes were given to her.

She seated herself at the edge of the bed and wrote the letters with feverish haste. She handed them over to the custody of her lawyer.

Then she drew on her stockings, black, silken, filmy things, grotesque in the circumstances. She placed her high-heeled slippers on her feet and tied the silken ribbons over her insteps.

She arose and took the long black velvet cloak, edged around the bottom with fur and with a huge square fur collar hanging down the back, from a hook over the head of her bed. She placed this cloak over the heavy silk kimono which she had been wearing over her nightdress.

Her wealth of black hair was still coiled about her head in braids. She put on a large, flapping black felt hat with a black silk ribbon and bow. Slowly and indifferently, it seemed, she pulled on a pair of black kid gloves. Then she said calmly:

‘I am ready.’

The party slowly filed out of her cell to the waiting automobile.

The car sped through the heart of the sleeping city. It was scarcely half-past five in the morning and the sun was not yet fully up.

Clear across Paris the car whirled to the Caserne de Vincennes, the barracks of the old fort which the Germans stormed in 1870.

The troops were already drawn up for the execution. The twelve Zouaves, forming the firing squad, stood in line, their rifles at ease. A subofficer stood behind them, sword drawn.

The automobile stopped, and the party descended, Mata Hari last. The party walked straight to the spot, where a little hummock of earth reared itself seven or eight feet high and afforded a background for such bullets as might miss the human target.

As Father Arbaux spoke with the condemned woman, a French officer approached, carrying a white cloth.

‘The blindfold,’ he whispered to the nuns who stood there and handed it to them.

‘Must I wear that?’ asked Mata Hari, turning to her lawyer, as her eyes glimpsed the blindfold.

Maitre Clunet turned interrogatively to the French officer.

‘If Madame prefers not, it makes no difference,’ replied the officer, hurriedly turning away. .

Mata Hari was not bound and she was not blindfolded. She stood gazing steadfastly at her executioners, when the priest, the nuns, and her lawyer stepped away from her.*

The officer in command of the firing squad, who had been watching his men like a hawk that none might examine his rifle and try to find out whether he was destined to fire the blank cartridge which was in the breech of one rifle, seemed relieved that the business would soon be over.

A sharp, crackling command and the file of twelve men assumed rigid positions at attention. Another command, and their rifles were at their shoulders; each man gazed down his barrel at the breast of the women which was the target.

She did not move a muscle.

The underofficer in charge had moved to a position where from the corners of their eyes they could see him. His sword was extended in the air.

It dropped. The sun – by this time up – flashed on the burnished blade as it described an arc in falling. Simultaneously the sound of the volley rang out. Flame and a tiny puff of greyish smoke issued from the muzzle of each rifle. Automatically the men dropped their arms.

At the report Mata Hari fell. She did not die as actors and moving picture stars would have us believe that people die when they are shot. She did not throw up her hands nor did she plunge straight forward or straight back.

Instead she seemed to collapse. Slowly, inertly, she settled to her knees, her head up always, and without the slightest change of expression on her face. For the fraction of a second it seemed she tottered there, on her knees, gazing directly at those who had taken her life. Then she fell backward, bending at the waist, with her legs doubled up beneath her. She lay prone, motionless, with her face turned towards the sky.

A non-commissioned officer, who accompanied a lieutenant, drew his revolver from the big, black holster strapped about his waist. Bending over, he placed the muzzle of the revolver almost – but not quite – against the left temple of the spy. He pulled the trigger, and the bullet tore into the brain of the woman.

Mata Hari was surely dead.

* Inevitably, a story got around that she’d opened her funereal coat to the firing squad, revealing no clothing beneath it.

1915: Nurse Edith Cavell, “patriotism is not enough”

Early this morning in 1915, the German military occupying Belgium shot aid worker Edith Cavell at Brussels for aiding the British war effort.

The matronly nurse had been condemned only the day before by a German military court for helping Allied soldiers escape from behind German lines — charges Cavell readily admitted. The British chaplain who attended her the night before her death reported her saying (not actually her last words, but recalled as her parting sentiment, as it were):

But this I would say, standing as I do in view of God and eternity, I realize that patriotism is not enough. I must have no hatred or bitterness toward any one.

So naturally, she immediately became the Entente’s bloody banner of the barbarous Hun, helping dramatically ramp up recruitment for the other team’s set of moral cretins.

The thing is, the Germans actually had a point. Cavell ran a nursing school in Brussels, and courageously stuck around when the Germans smashed through Belgium as World War I opened. She’s sometimes remembered as getting in hot water for treating the wounded regardless of nationality, but she did a lot more than that: she got involved with an underground railroad funneling Allied soldiers back to enemy countries.

It was one of those impossible trials of conscience that wartime brings: Cavell, whose hospital was subsumed by the Red Cross during the war, should technically have remained neutral; her actions did bring material aid to Germany’s foes.

However, Belgian, French and English troops caught behind lines by the Germans’ lightning advance were in danger themselves of summary execution, as were civilians who harbored them. Neutrally treating them and handing them over as POWs might have been tantamount to killing many of them, especially in the first few months of the war. Though Edith Cavell said that “I am happy to die for my country,” her actions look more humanitarian than nationalistic — the best choice to be made when no good ones are available. Patriotism of a higher order, if you like.

Probably Cavell’s was a case tailor-made for executive clemency, but Germany was keen to send one of those proverbial messages: civilians in occupied countries had best stay out of the war. Despite the frantic lobbying of England’s ambassadors (and, ominously for Germany, those of the United States), the sentence was carried out on both Cavell and a fellow-traveler in her network, Belgian Philippe Baucq.

Clumsy propagandists, the Kaiser’s boys badly misjudged the message so sent.

In the face of intense international outcry, Germany soon found itself defending its actions (.pdf), and then commuting the sentences (.pdf again) of Cavell’s other collaborators.

None of this abated Cavell’s stupendous propaganda value to Germany’s enemies. And — holy wow, the graying 49-year-old gets made over into quite the heartbreaker in most of these.

The nurse’s repute — and she was said to have struck a Joan of Arc-like chord in those parts — caused a renaissance for the name “Edith” among French and Belgian newborns, most notably singer Edith Piaf (born in December 1915). While Cavell’s sacrifice did nothing to stem her name’s declining Anglo (or at least American) popularity, there is a Mount Edith Cavell named for her in Canada, and a plethora of monuments and public spaces dedicated to her throughout the Allied powers’ lands. (Here are just a handful.) And she still packs enough symbolic punch for the current British Prime Minister Gordon Brown to deploy her in the propagandist’s subtler modern arts.

1780: Major John Andre, Benedict Arnold’s handler

On this date in 1780, the honorable British Major John Andre got what Benedict Arnold had coming to him.

Piqued that his (quite considerable) brilliance in the field did not earn honors he thought his due, General Benedict Arnold contrived to betray West Point to the British during the American Revolution — the plot that made his name a synonym for treachery.

As the scheme ripened, the turncoat asked Sir Henry Clinton for “a personal interview with an officer that you can confide in.”

Enter Clinton’s adjutant John Andre, head of British Special Intelligence.

The dashing officer, well-liked in society on either side of the permeable divide between Tories and Patriots on the continent, slipped into Haverstraw, N.Y. to make the arrangements. On his way back — when he already thought himself safely clear of American-held territory — he was nabbed with the incriminating documents.

The narrowly-averted betrayal was mirrored by the narrowest of escapes: luckily for Benedict Arnold, Andre was received in custody by a subordinate officer of his, whose initial report to Arnold alerted the general to his danger and enabled him to escape to the British a whisker ahead of the law.

Treason, of the blackest dye, was yesterday discovered. General Arnold, who commanded at West Point, lost to every sentiment of honor, of private and public obligation, was about to deliver up that important post into the hands of the enemy. Such an event must have given the American cause a dangerous, if not a fatal wound; happily the treason has been timely discovered, to prevent the fatal misfortune. The providential train of circumstances which led to it, afford the most convincing proofs that the liberties of America are the object of Divine protection.

It was a gentlemanly war, and Andre didn’t seem like the guy to hang in the whole exchange. But his argument before a court-martial that he was merely availing “an advantage taken in war” by agreeing to talk to an enemy general who wanted to hand them the keys to a fort didn’t fly: he’d been behind enemy lines, out of uniform, sneaking around. That made him a spy.

And the British refused to obtain Andre’s liberty by trading the man the Americans really wanted to execute.

Instead, by year’s end, the hero of Saratoga was commanding redcoats in the field — perhaps a little nervously; when he asked a captured American what might happen to him should he be taken, the reply was “Cut off your right leg, bury it with full military honors, and then hang the rest of you on a gibbet.”

John Andre was left holding the bag, to the dismay of just about everyone American and British alike. This extended account of the luckless major’s last moments* is from the pen of Continental Army surgeon James Thacher.

Major Andre is no more among the living. I have just witnessed his exit. It was a tragical scene of the deepest interest. During his confinement and trial, he exhibited those proud and elevated sensibilities which designate greatness and dignity of mind. Not a murmur or a sigh ever escaped him, and the civilities and attentions bestowed on him were politely acknowledged…

The fatal hour having arrived, a large detachment of troops was paraded, and an immense concourse of people assembled; almost all our general and field officers, excepting his excellency [George Washington] and his staff, were present on horseback; melancholy and gloom pervaded all ranks, and the scene was affectingly awful … Major Andre walked from the stone house, in which he had been confined, between two of our subaltern officers, arm in arm; the eyes of the immense multitude were fixed on him, who, rising superior to the fears of death, appeared as if conscious of the dignified deportment which he displayed. He betrayed no want of fortitude, but retained a complacent smile on his countenance, and politely bowed to several gentlemen whom he knew, which was respectfully returned. It was his earnest desire to be shot, as being the mode of death most comformable to the feelings of a military man, and he had indulged the hope that his request would be granted. At the moment, therefore, when suddenly he came in view of the gallows, he involuntarily started backward, and made a pause. “Why this emotion, sir?” said an officer by his side. Instantly recovering his composure, he said, “I am reconciled to my death, but I detest the mode.” While waiting and standing near the gallows, I observed some degree of trepidation; placing his foot on a stone, and rolling it over and choking in his throat, as if attempting to swallow. So soon, however, as he perceived that things were in readiness, he stepped quickly into the wagon, and at this moment he appeared to shrink, but instantly elevating his head with firmness, he said, “It will be but a momentary pang,” and taking from his pocket two white handkerchiefs, the provost-marshal, with one, loosely pinioned his arms, and with the other, the victim, after taking off his had and stock, bandaged his own eyes with perfect firmness, which melted the hearts and moistened the cheeks, not only of his servant, but of the throng of spectators. The rope being appended to the gallows, he slipped the noose over his head and adjusted it to his neck, without the assistance of the awkward executioner. Colonel Scammel now informed him that he had an opportunity to speak, if he desired it; he raised the handkerchief from his eyes, and said, “I pray you to bear me witness that I meet my fate like a brave man.” The wagon being now removed from under him, he was suspended, and instantly expired; it proved indeed “but a momentary pang.” He was dressed in his royal regimentals and boots, and his remains, in the same dress, were placed in an ordinary coffin, and interred at the foot of the gallows; and the spot was consecrated by the tears of thousands.

Thus died, in the bloom of life, the accomplished Major Andre, the pride of the royal army, and the valued friend of Sir Henry Clinton. He was about twenty-nine years of age, in his person well proportioned, tall, genteel and graceful. His mien respectable and dignified. His countenance mild, expressive and prepossessing, indicative of an intelligent and amiable mind. … considered as a skilful, brave and enterprising officer, and he is reported to have been benevolent and humane to our people who have been prisoners in New York. … The heart of sensibility mourns when a life of so much worth is sacrified on a gibbet. General Washington was called to discharge a duty from which his soul revolted; and it is asserted that his hand could scarcely command his pen, when signing the warrant for the execution of Major Andre. … Could Arnold have been suspended on the gibbet erected for Andre, not a tear or a sigh would have been produced, but exultation and joy would have been visible on every countenance.

Andre makes a sort of loyalist counterpart to Nathan Hale. Interestingly, Thacher’s account — in which he uses his old diaries for a book that was published in 1823 — footnotes an extended narration of Nathan Hale in a comparative vein, complaining that “whilst almost every historian of the American Revolution has celebrated the virtues and lamented the fate of Andre, Hale has remained unnoticed, and it is scarcely known that such a character ever existed.” Today, in terms of their public recognizability, the two are rather reversed.

* Andre was to have been hanged October 1, but the matter was stayed when a British deputation arrived under flag of truce to make one last parley for their man’s life.

1776: Nathan Hale, with regrets

On this date in 1776, Revolutionary spy Nathan Hale was hanged by the British in Manhattan — allegedly uttering the immortal last words, “I only regret that I have but one life to lose for my country.”

Nathan Hale statuary (with bound feet and hands) ironically stationed at Washington D.C.’s Department of Justice. Like statues are at the Chicago Tribune building and the Yale University campus; dueling plaques in New York contend to mark the execution spot.

Two years out of Yale when the Revolution broke out in 1775, the Connecticut-born Hale hitched onto the Continental Army and was directly promoted to captain.

When British Gen. William Howe landed at New York in the summer of 1776, Nathan Hale volunteered to slip behind enemy lines and reconnoiter enemy strength for George Washington. It turned out to be his mission into eternity.

As one might suspect, there’s a great deal more to Nathan Hale than his last words — and a fair bit of uncertainty about what his last words really were. Hale’s Wikipedia page retails many versions of the line from many sources.

The sentiment commonly attributed him (formulated in slight variations, e.g., “I only regret that I have but one life to give to my country”) was supposed to have been reported by a British officer attending him; it’s certainly a punchier version than, e.g., a Revolutionary War era report of “I am so satisfied with the cause in which I have engaged, that my only regret is, that I have not more lives than one to offer in its service.” Gah.

If all these presumably paraphrased reports have the gist right, it’s possible the 21-year-old recited an identical sentiment in the tragic play Cato:*

How beautiful is death, when earn’d by virtue!
Who would not be that youth? What pity is it
That we can die but once to serve our country.

1860: (William) Walker, Nicaragua Ranger

On this date in 1860, a kid from Tennessee who had made himself President of Nicaragua got his grateful subjects’ comeuppance in the form of a fusillade.

It was westward the wagons that first bestirred the pioneering blood of William Walker, a scion of privilege with an Ivy League medical degree, who uprooted for San Francisco in 1849.

But the “grey-eyed man of destiny” had an altogether grander gold rush in mind, as he stared pensively into the middle distance.

The air was fervid with Manifest Destiny, and most Americans reckoned that the entire hemisphere was its rightful Manifestation. In a time when private settlers effected the statecraft of conquering the Great Plains, was it really any crazier for Walker to fancy privately conquering some distracted European power’s American colonies?

Walker was one of — soon to be the most famous of — a whole class of such characters: filibusters, a word etymologically rooted in piracy but now claimed by the bustling ranks of soldiers of fortune with private militias bent on detaching some parcel of land from south of the border, for money or glory or what have you.*

Oh, and “what have you”? That means slavery.

Nicely dovetailing the individual spur to derring-do, the South’s structural impulsion to expand slaveholding territories to maintain political parity encouraged — and often bankrolled — filibuster adventuring.

It is to these unwholesome fellows that the United States likely owes its sovereignty over Texas, which was pelted with Anglo filibustering expeditions in the early 19th century, helping set the table for the revolution that severed the Lone Star state from Mexico; arguably, the Texas Revolution itself was a (fantastically successful) filibuster.

So Walker had the glittering destinies manifest before his grey eyes when he put off the white collar career to play soldier. After an abortive 1853 attempt to set up his own country in Mexico’s Baja California — a jury instantly acquitted him of waging war on a neutral power; filibustering, and damn near anything that promised America more Manifestly Destined land, was as popular as it was illegal — Walker moved on war-torn Nicaragua under the guise of a “colony”. With a few hundred men, he was able to conquer the capital and set himself up as head of state.

Who knows whether he could have had a future if he’d done it differently. In the actual fact, he wasn’t as hot an administrator as his ego might then have been telling him. He revoked Nicaragua’s anti-slavery edicts, of course; though this sparked resistance, more damaging may have been revoking a Vanderbilt trade concession and bringing a tycoon into the private warfare game on the opposite team.

Cornelius Vanderbilt-backed opponents drove Walker out of Nicaragua in 1857. Not knowing when he was beat, the ex-Presidente kept knocking around stateside piecing together several expeditions, each sadder than the last … until in 1860, when a landing at Honduras collapsed, and he surrendered himself to a British (rather than American) officer. Europeans with colonies to exploit didn’t have much use for filibustering, and Walker had made everyone nervous by openly aspiring to conquer Nicaragua’s neighbors — including British assets. Rather than return him home where he could continue scheming to meddle in the future canal zone, the Brits handed him over to the Hondurans, who stood him in a court-martial, then stood him up against a wall.

Alex Cox (Repo Man) turned this bizarre biography into a film, back when Ronald Reagan’s filibusters narco-terrorists “moral equals of our founding fathers” were having their own unofficial way with the country Walker once governed:

And for a corner of Americana little-known to most in the U.S. — well, the colorful, nigh-unbelievable quality of the action has overridden its obscurity when it comes to the written word.

Not surprisingly, this usage came online at the same time mercenary filibusters were active, and proceeds from the word’s original sense of “piracy”.

1890: William Kemmler, only in America

On this date in 1890 the iconic symbol of the American death penalty made its grisly debut upon the person of William Kemmler at New York’s Auburn Prison.

The long New World tradition of hanging condemned prisoners came under fire as a barbarism in the late 19th century, leading reformers to look for killing procedures less likely to result in a horrendously protracted strangulation or a midair decapitation. As Empire State Governor David Hill put it,

The present mode of executing criminals by hanging has come down to us from the dark ages, and it may well be questioned whether the science of the present day cannot provide a means for taking the life of such as are condemned to die in a less barbarous manner.

On this stage, Executed Today presents a rogues’ gallery of homo Americanus, the salesmen and swindlers who would help the U.S.A. ride the lightning.

The Dentist

A true renaissance man, Buffalo dentist Dr. Alfred Southwick, applied his active mind to the need to better kill a fellow, and soon hit upon an inspiration — that is to say, a town drunk hit upon an electrical generator and died instantaneously, and the observant Southwick said “eureka!”

Without the subsequent industry of this neglected gentleman, who added to his repertoire scientifically-minded electrical butchery of animals alongside political gladhandings to bring a flutter to a busybody’s heart, the Chair’s entire oeuvre of machismo-sadism might have missed the country altogether. Just imagine living in a world where New York had pioneered its other leading reform alternative: lethal injection.

(This, incidentally, is why the chair is a chair, and not a bed or a stake or a St. Andrew’s Cross: because the guy who thought of it spent all day administering his own tender mercies to seated penitents.)

The Plutocrats

As Southwick nagged his senator and shocked stray cats into the great hereafter, the gears of commerce strove relentlessly ever-onward. The business of America was ever business, and never more so than the Gilded Age.

And the business of killing people was about to become the biggest business there was.

The age of electricity was buzzing into incandescence, and two rival standards were at currents amped over eventual dominance of this stupendous industry. Thomas Edison’s earlier Direct Current (DC) standard was being challenged by Nikolai Tesla’s Alternating Current (AC), backed by the financial muscle of George Westinghouse.

Cheaper and more efficient, AC tilted the playing field against Edison. Seeing his days numbered, the Wizard of Menlo Park fought back the way any dinosaur industry would: dirty.

AC, Edison said, was too dangerous for consumer use — a lurking killer. “Is this what your wife should be cooking with?” And he started taking up traveling road shows zapping large animals with AC to demonstrate the rival product’s deadliness. (This press coined the term “electrocution” from these spectacles.)

This clip of the electric demise of a circus elephant — don’t hit “play” if you’re not up for animal cruelty — is from some years later (Edison kept tilting at windmills and megafauna carcasses as his DC empire disappeared), but it’ll give a sense of the horrifying spectacle.

(Topsy, it should be noted, was being put down as a danger and not strictly for kicks.)

Elephants? Horses? Dogs?

How about a human?

With the New York legislature’s embrace of Southwick’s seated voltage people-eater, Edison turned his PR gears on the state, demanding they adopt his competitor’s “deadlier” current for the contraption. And they did, reflecting a widespread belief inculcated by Edison’s experiments — as this New York Times article on an Edison crony’s public livestock-killing show in the days leading up to the advent of the electrocution law indicates:

The experiments proved the alternating current to be the most deadly force known to science, and that less than half the pressure used in this city for electric lighting by this system is sufficient to cause instant death.

After Jan. 1 the alternating current will undoubtedly drive the hangmen out of business in this State.

Too bad for Edison that the business he was really trying to kill was made of sturdier stuff.

The Alcoholic Vegetable Merchant

As the 1880’s wane, we come at last to our subject — in several senses of the term — an illiterate nobody of German stock who chanced to kill his common-law wife with just the right timing to join in a new kind of experiment.

William Kemmler mounted a “cruel and unusual punishment” appeal against his sentence funded by Westinghouse himself: no dice. Perhaps appreciating the odd foothold on history he was about to attain, he showed little worry as he entered the execution room and sat himself — “undoubtedly the coolest man in the room,” a journalist present reported.

The End of the Beginning

That reporter’s description for the New York Herald graphically captures humanity’s first horrible encounter with this “humanitarian” machine, beginning with the prisoner’s parting remarks.*

Doubtless he knew that his words will go down in history and he had his lesson well learned. He addressed his audience [in] a commonplace way and without hesitation.

“Well, gentleman, I wish everyone good luck in this world, and I think I am going to a good place, and the papers have been sa[yi]ng a lot of stuff that isn’t so. That’s all I have to say.”

And so with a parting shot at what he was good enough to refer to not long ago as “those d—d reporters,” William Kemmler took his leave of earth. The quiet demeanor of the man as he entered had made a strong impression on those in the room. His self-possession after his oratorical effort simply amazed them. He got up out of his chair as though he were anxious to try the experiment, not as though he courted death, but as though he was thoroughly prepared for it. …

There was no delay. Kemmler constantly encouraged the workers at the straps with “Take your time; don’t be in a hurry; do it well; be sure everything is all right.” He did not speak with any nervous apprehension.

Warden Durston leaned over, drawing the buckle of the straps about the arm. “It won’t hurt you, Bill,” he said, “I’ll be with you all the time.”

A minute later Kemmler said, “There’s plenty of time.” He said it as calmly as the conductor of a streetcar might have encouraged a passenger not to hurry.

Kemmler was pinioned so close that he could hardly have moved a muscle except those of his mouth.

The Warden took a last look at the straps. “This is all right,” he said.

“All right,” said Dr. Spitzka, and then bent over and said, “God bless you, Kemmler.”

“Thank you,” said the little man, quietly.

“Ready?” Said the Warden.

“Ready,” answered the doctors.

“Goodbye,” said the Warden to Kemmler. There was no response.

GAVE THE SIGNAL.

The Warden stepped to the door leading into the next room. It was then forty-three and one-half minutes past six o’clock by the prison clock. “Everything is ready,” said the Warden to some one hidden from view in the next room.

The answer came like a flash in the sudden convulsion that went over the frame of the chair. If it seemed rigid before under the influence of the straps, [it] was doubly so now has it strained against them.

The seconds ticked off. Dr. McDonald, who was holding the stopwatch, said “Stop.”

Two voices near him echoed, “Stop.”

The Warden stepped to the door of the next room and repeated the word “Stop.”

As the syllable [passed] his lips the forehead of the man in the chair [grew] dark [in] color, while his nose, or so much of it as was exposed, appeared a dark red.

There was very little apparent relaxation of the body, however. [A] fly lighted on the nose and walked about unconcernedly. The witnesses drew nearer to the chair.

“He’s dead,” said Spitzka, authoritatively.

“Oh, yes, he’s dead,” said McDonald.

“You’ll notice,” said Spitzka, “the post-mortem appearance of the nose immediately. There is that remarkable change that cannot be mistaken for anything else, that remarkable appearance of the nose.”

The other doctors nodded [assent]. They looked at the body critically for a minute and then Spitzka said, [“]oh, undo that now. The body can be taken to the hospital.”

“Well, I can’t let you gentlemen out of here until I have your certificates,” said the Warden.

FOUND SIGNS OF LIFE.

It was while this businesslike conversation was going on that Dr. Balch made a discovery.

“McDonald,” he cried, “McDonald, look at that rupture,” he pointed at the abrasion of the skin on Kemmler’s right thumb. In the contraction of the muscles the figurehead[?] scraped against it and removed the skin, and from that little [wound] blood was flowing-[an] almost certain indication of life.

A low cry of horror went through the assemblage.

“[Turn] on the current,” excitedly cried Dr. Spitzka. “This man is not dead.”

The crowd fell back from the chair, as though they were in danger. The Warden sprang into the closed door and pounded on it with his hand.

“Start the current!” he cried. As he spoke of fluid began to drop from Kemmler’s mouth and to run down his beard; a groaning sound came from his lips, repeated and growing louder each time.

It seemed [an] age before the card was again turned on. In fact it was just seventy-three seconds from the end of the first contact when the first sound was heard to issue from Kemmler’s lips, and it was not more than a half [minute] before the card was again turned on.

RECOVERING CONSCIOUSNESS.

But every second to that time the horrible sound from those groaning lips was becoming more distinct, [a straining] of the chest against the leather harness stronger and more evident.

The man was coming to life. The spectators grew faint and sick. [Men] who had stood over dead and dying [men] and had cut [men] to pieces without an emotion [grew] pale and turned their heads away.

One witness was forced to lie down while one of the doctors fanned him.

But [the end] came at last. There was another convulsion of the body, and … it became rigid with the rigidity of iron.

“That man wasn’t dead,” cried Spitzka excitedly. As he spoke the body twitched again. The electrician had given the current gain new alternation and now 2,000 volts [were] playing in short, successive shocks down Kemmler spine. The sound ceased with the first convulsion, but the fluid continued to trip from the mouth and down the beard, making the body a sickening spectacle.

“Keep it on now until he’s killed,” said one of the doctors. …

“Keep it on! Keep it on!” Cried Warden Durston through the door.

Silence reigned for a moment. A bell without began to [toll] solemnly. …

BURNED BY THE CURRENT.

Then from the chair came a sizzling sound, as of [meat] cooking on hand. Following it immediately a billow of smoke came from the body and filled the air of the room with the odor of burning hair.

There was a cry from all the members of the little group, and Warden Durston cried through the door leading to the next room to [turn] the current off.

More shocking — so to speak — papers ran the next day’s headline “Kemmler Westinghoused,” the verb “to Westinghouse” being another shameless Edisonian bid to stamp his marketing project onto the Queen’s English. This fine, rounded, archaic neologism the right sports anchor could resuscitate as a fresh synonym for thrashing, horsewhipping, poleaxing, or else (in greater justice) for moderation and decency as the only principal in the sordid affair that rejected death-dealing by electricity.

(Officially, Edison also opposed the death penalty. Like Dr. Guillotin, he was doing his part for humanity in the meantime … just with a little skin in the game. Did we mention the business of America is business?)

Westinghouse, for his own part, thought the Kemmler debacle would nip the electric chair in the bud, and he was scarcely the only one.
